All right. Good. Good evening. My name is Carlos Rosario, and I'm the chair of the Planning Commission. Welcome to the Planning Commission meeting. Please remember to turn off your cell phones. Before I begin, I want to remind Planning Commission members of the public to follow our code of conduct at all meetings. This includes commenting on the specific agenda item only and addressing the full body. Public speakers will not engage in conversation with commissioners or staff, all members of the Planning Commission, staff and the public are expected to refrain from abusive language. Repeated failure to comply with code of conduct which will disturb, disrupt or impede the orderly conduct of this meeting may result in removal from the meeting. This meeting of Planning Commission will now come to order. Summary of hearing procedures. If you want the if you want to address the commission, please fill out a speaker card located at the table near the visual technician in the back and deposit or leave it with the person in the. Back. The procedure for this hearing is as follows. After SAP's presentation, applicants and appellants make up to a five minute presentation. During the public comment period, the chair will call out the names on submitted speaker cards and the order received for those members of the public who attend in person, as your name is called. Line up in front of the microphone at the front, over there in the front of the chairs. Generally, each speaker will be given up to two minutes for public testimony. Speakers will have up to four minutes of the time allotted for each speaker may change depending on a number of items on the agenda number, speakers, and other factors. Speakers using a translator will have double the time allotted. After public testimony, the applicant and appellant closing remarks for an additional five minutes. Commissioners may ask questions of the speaker's response to commissioners. Will not reduce response to commissioner. Will not reduce the speaker's time allowance, the public hearing will then be closed. The Planning Commission will take action on item. Planning Commission may request to respond to public testimony, ask questions and discuss the item. If you challenge these land use decisions in court, you may be limited to raising only those issues you or someone else raised at the public hearing, or in written correspondence delivered to the city at or prior to the public hearing. The Planning Commission's actions on rezoning, rezoning, General Plan amendments and amendments is only advisory to the City Council. The City Council will hold public hearings on these items. Section. Section 21 2400 of the code provides the procedures for legal protests to the City Council on rezoning and rezoning. The Planning Commission's actions on conditional use permits is available to the Council in accordance with section 2120 of the Municipal. Code agenda, and all staff reports for this meeting may be accessed at the city's website. Public comment. Public comments to the Planning Commission on non agendized items. Please fill out a speaker's card and give it to the technician. Each member of the public may address the commission for up to two minutes. The Commission cannot take any formal action without the item being properly noticed and placed on the agenda. In response to public comment, the Planning Commission is limited to the following options. Responding to statements made or questions posed by members of the public, or requesting staff to report back on a matter at a subsequent meeting, or directing staff to place the item on a future agenda. We have any public speakers for public comment for items not on the Planning Commission's agenda. Seeing none, we will go to agenda item four deferrals and removals from the calendar. Any items scheduled for this hearing or referrals being requested or taken out of order will be heard first. On the matter of deferral or removal. Staff will provide an update on items for deferral or removal is being requested. If you want to change any of the deferral dates recommended, or speak to the question of deferring or removing any of these items, you should say so at this time. Do we have any deferrals or removal from the calendar? Does not look like it. Moving on to item number five, the consent calendar for the public. There will be no discussion on of consent calendar items as they are to be considered to be as they are considered to be routine and will be adopted by one motion. If a member of the Commission requests a separate vote or recusal on a particular item, that item may be removed from consent calendar by chair and considered separately. Public comment on the consent calendar and any items from the consent Calendar by the chair staff will provide an update on the Consent Calendar. If you wish to speak on one of these items individually, please come to the podium at this time. Are there any members that are there any public speakers on items on the Consent. Calendar? Consent calendar? Okay, we. Do have an amendment that needs to be made before. Item item five point C CB 25029. Item from the emotion. So motion to approve items A, B, and D, we can make the amendment without removing it from the. Do you need to explain? So this is a minor text change to condition number five of the permit. The proposed permit I'll share the text change on the screen so everyone can see. It. So the the text changes to just clarify that any consumption of alcohol within the premises shall be in conformance with the permits, ABC licenses, and no other consumption or open alcoholic beverages will be permitted on the premises. And the reason for this text change is so that samples at the supermarket can be made if the situation calls for it. That's all. This is a supermarket within the mall? The public hearing is considered the Planning Commission, the order in which they appear on the agenda and agenda. Please be advised that the Commission may take items out of order to accommodate significant public testimony or discussion on the agenda for public hearing time management purposes. It appears that we have no items tonight for public hearing. Is that. Correct? We have no items. We will move on to agenda item number seven, referrals from city council boards, commissions or other agencies. No referrals. There are no referrals. We'll move on to agenda item eight good and welfare. Is there a report from City Council? Yes, chair. Thank you. We have a few updates. So the February 10th City Council meeting, the City Council heard and approved two items of note. The first one was a public hearing on the 2026 Abatement Commencement report. And the second one was an administrative hearing on the appeal of Planning Commission's denial of a conditional use permit located at 1692 Story Road. The City Council approved the denial. The continued denial of the project for that that cup. And then on February 24th yesterday, we had two items as well. One administrative hearing appeal on the planning directors approval and environmental appeal. The site development permit, located at 2334 Lundy Avenue. The City Council approved the the site development and environmental appeal. So the environmental review. So the appeal was denied. That project will move forward. And the second project was another appeal of the planning director's approval and plan development permit amendment for project at 1123 Coleman Avenue, also known as Papal Park, and that appeal was denied so the project would be able to move forward. That was a concerts, right? Yes. Okay. Thank you very much. That's it. For good and welfare. Then we can move to adjourn. Oh, I just wanted to add for the commission calendar and study sessions, we talked about this earlier, but just a reminder, next week is the next General Plan for your review task force meeting. I think we have a good amount of time for public comment, but it is it's a good memorandum. We'll be ready for your questions. It may go over, I think, especially if we get a lot more people in attendance. The team is working on the slides. I want to say they want to post them on Friday.
