sorry fine yes mayor fassfender yes that motion prevails [4:10] Mary Fasbender: tonight under community development we have a plan for quality one woodworking and john hansman from the community development the community development director is here to explain welcome john [4:25] John Hinzman: aaron city council members tonight we have a site plan approval scheduled for an expansion to the quality one site and i'll share my screen here and show a little information about this this is the quality one woodwork site 31st street millard avenue within the industrial park you can see here the existing building is about 100 000 square feet they're proposing to add another 50 000 square feet in about this location here this would be to provide some important amenities and expansions to their kitchen cabinets and vanities line you may recall that as a city council and hedgerow we took action on the transfer of two properties necessary to make this project complete that would be this parcel down here as well as an access parcel located here so we have taken action on those did take a look at the concept plan earlier we did have the planning commission take a look at the site plan itself at the last meeting they did recommend approval of the site plan on a unanimous vote with limited discussion so let's take a look at where what we're approving here tonight this is the existing site looking at 31st street to the north you can see they have an outdoor trucking area berm landscaping here this is looking southwest from enterprise avenue towards the site here the new building would be constructed in about this location here where the building would be parking area would be improved you may note that on the existing site there are some gravel areas in which there are some truck trailer parking these parking areas would be improved to be all bituminous surface curb and gutter be a new entrance constructed here out to enterprise avenue as well as a new entrance here to the south a couple infiltration bases to handle storm water would be constructed in this location towards millard 31st as well as here along the east side of 31st new parking would be added for employees in this location and a lot of the parking down here would be dedicated to the parking of semis that they use for their loading and unloading operation itself so taking a look at the site plan a couple of things to note we will be having an action on this item relating to the establishment of a drainage utility easement on a neighboring property purpose behind that is the building itself from a building code standpoint needs to maintain a minimum distance from the northern property line right now that distance is about 52 feet i think they need to maintain 60 feet that would be covered under an existing drainage and utility easement here which would provide that needed separation and on another property that the city owns in this location we would have another drainage and utility easement added to the perimeter of that that is something that is pretty standard practice that we do normally upon the planning was not done in the circumstance for whatever reason from a parking standpoint uh we're comfortable with the parking levels they are providing they are a little bit short of what we would have for minimum parking although you can see they have a ton of parking for trucks along the site we did add a condition to the site plan that if parking should became become problematic in the future that they would look at the conversion of some of this truck parking area about 11 spaces into parking for employees if that does become a problem from an architectural standpoint the building is similar to the other building that they built and from an architectural standard standpoint when we take a look at extensions to buildings we look at conformity to what's built already so the same materials the same coloration is used here that's acceptable under our standards ultimately we take a look at a project like this this is a very large industrial expansion to our park provide jobs and provide much needed industrial output so this will be a great addition for the city we recommend approval of it and i can stand for any questions we do have representatives from quality one available as well if you have any questions for them thank you thank you john [8:45] Mary Fasbender: questions for john council at this time uh councilmember vaughn [8:53] Councilmember DawnMarie Vihrachoff: john real quick that you had mentioned that we have to do another easement into that city-owned property to the north i think it is that affect that looking at their map here it looks fairly small will that affect the future sale of that is it going to happen [9:06] John Hinzman: so in the nutshell we'll have an easement going through it so whoever purchases it's got to recognize that remember the perimeter the easement would be on the perimeter of the property so 10 feet around the edges of it so it should not affect the build-ability of it and any building that would be constructed landscape it would need to be at least 10 feet off that line anyway so it shouldn't have any issue thank you samara vaughan [9:40] Councilmember Dave Pemble: the easement was actually my question as well thank you councilmember run um it's just a little funny but um john thank you for the details about building out on a structure like that i was kind of curious but didn't know how to ask the question that's this is a great opportunity for the industrial park thanks special use permit for the climate controlled storage 275 33rd street west and john you may continue [11:22] John Hinzman: this item mayor city council member i'll share my screen again take a look at the property before us this is for the county crossroads strip mall which is located just to the west of colburns off of 33rd street and highway 316. the proposal before us tonight is a special use permit to allow for climate-controlled storage within about two-thirds of the strip mall here the two existing tenants that are there right now the the vfw and snap fitness would remain and the middle of the of the mall here would be converted into climate controlled storage what these are essentially are are smaller individually rented units for folks that require climate control for their goods unlike mini storage where you have more general items that may not be as valuable items here generally have a higher value and as a practice the city council amended the city code a couple of years ago to allow this type of storage via a special use permit under certain parameters and this does meet those parameters we did have the planning commission review this at their last meeting on june 14th they did recommend approval on a 5-0 vote we did have one person comment at the meeting a neighbor from the adjoining area to the south who had concerns about uh the building the activity and uh some interruptions that might occur within this area and so that was taken into consideration by the planning commission and i think that comment was also forward to the the council tonight for your consideration as well uh so we are recommending approval of this look at the structure in the site strip mall itself be located more in the middle of it view rear view here so as far as the loading and unloading materials here most of it would occur in the rear of the facility there is a larger garage door which you can barely see here that will would allow access to the site uh for goods and services uh one thing that we did learn today is that the hours of operation for this facility are not likely to be 24 7 likely to be uh be closed at about the 10 o'clock hours so so there would not be overnight traffic coming in here the amount of traffic that generally comes into these type of facilities is much less than you would a general storage mini service mini storage service facility it would look like on the inside itself and so this would be the view to the front of the mall here the different doors that would be on it these these structures itself are a little bit misleading they would be set back probably two to three feet from the wall itself before the structures would be within there so from a view at the front of the building you would see a kind of a hallway uh passageway between the window and the facility uh the rental facilities that would be painted in a cohesive style so that it would be visually appealing on the inside of it there so as you walk by you you'd see these these type of facilities set back about two or three feet into the interior of the site so we are recommending approval of this subject to the conditions within the staff report uh one thing to note this is a special use permission would require six of seven council members to take action with one member absent tonight that would require a unanimous vote thank you sure thank you john [14:40] Councilmember Lisa Leifeld: what's the number lightfield was first if you want to let her go it is okay councilmember lightfield thank you thank you bro oh okay two questions in relation to the email that we received the resident that you were talking about just a couple follow-up questions there so my first question would be the lighting that was mentioned since this is an indoor facility um envisioning big large lights but i'm imagining some lighting along the back side of the building that might be a little bit different than they currently have john any any comments to that that's the first part of my question [15:28] John Hinzman: councilmember i think they have all pack lighting lighting attached to structure along the rear of the facility if they were to add any more lighting we do have a requirement that on a illumination limitation on that of a half a foot candle essentially it would would mean that the lights would need to diminish with certain extent [15:59] Councilmember Lisa Leifeld: and then my second question then in regards to um access i know there it sounds like it's not gonna be 24 hours but there was an awful lot of doors in the building and on the back of the building um how does what is the process that one gets in the building do can anyone get in the building as a member [16:15] John Hinzman: from what i understand each uh each renter of a storage space in there would have their individual key card number and it would be key card access to get in there during limited periods of time just into their own unit but into the building itself [16:34] Councilmember Lisa Leifeld: into the building itself and then access to their individual unit correct do we anticipate any concerns with the um where it's located that kind of out of the way backside of that building being pretty secluded is there do we have any concern as far as safety or theft or criminal activity would go because that is a pretty beaten path sort of a location sure do we have any consequences or is there anything we should be talking about [17:00] John Hinzman: sure council member the uh the owner of the site would be putting video cameras and lighting in the in the back of there to make sure that those are well documented recording i think from his standpoint he wants to ensure that there is a safe environment for the storage of the facilities which should help from a crime standpoint i mean i would have to think that just to kind of answer the concerns of that of the neighborhood would be as an owner of this building clearly um they want to keep criminal activity down to zero in order to rent this facility outright it doesn't want to get a bad a bad reputation so i feel comfortable with um with those answers thanks jenna thank you council councilmember brox [17:58] Mary Fasbender: all right i would accept a motion for a resolution to the city council of the city of hastings granting special use permit approval for operation of climate controlled storage within the c4 zoning district locating at 275 33rd street west [18:17] Mary Fasbender: so johnner and councilman and who seconded i'm sorry i'm sorry council number four yes yes and your past bender yes and that motion prevails [19:04] Mary Fasbender: okay tonight we also have a resolution variance for a garage side yard setback at 809 6th street west and john you may continue [19:15] John Hinzman: thank you mayor city council members what we're looking at today is a variance at 809 6th street west which is the property located here this is a little bit of an older property because it shows the location of the garage the garage itself was damaged and removed last year what the applicant proposes to do is to reconstruct the garage at its same size in the same location because the original structure did not meet the five foot setback requirement this does require a variance to be considered we did have the planning commission review this at their last meeting they did recommend approval and a 5-0 vote we did receive a couple of comments in support of the project from neighboring property owners that i'll put into the record here the rationale for granting the variance uh really deals with the go to the next page here it goes with the impact and the unusual circumstance that we have here with the garage being located here position here this is what would be proposed to be reconstructed which would be a similar size in this so we're looking at this as an unusual circumstance because we're reconstructing the the former garage if it had not been damaged it would still be there i we don't believe that's going to set any any unreasonable precedence we believe that it's putting the ordinance into use in a in a any reasonable manner so within the resolution itself we did cite several criteria according to our city code as to rationale for granting the variance and we bring that recommendation forward for your review tonight and i can stand for any questions thank you [21:08] Mary Fasbender: for clarification john i believe that as a variances needs six votes also that is correct this would be six of seven as well all all six oh six yep [21:18] Councilmember Dave Pemble: for fox i believe this is very straightforward and an easy decision for me and my neighbors and i want to thank mr carlson and mr milburn for also thinking this is straightforward and a good decision for that household so thank you for your comments gentlemen and i would move to pass this resolution your honor [21:40] Councilmember Lisa Leifeld: sick leave dan waticha [22:50] Dan Wietecha: just this update there's two pieces here um at least two pieces here uh one being some general discussion around the emergency declaration uh anticipate that actually being on the agenda july 6 but if there's thoughts or input from the council tonight would would love to hear that uh the specific action item is related to the emergency paid sick leave with that which is on on for tonight with that said in march of 2020 as uh kovic came on the city the mayor approved by city council made a local city of hastings emergency declaration and that served as the legal basis for a number of actions over the past 14 15 months however too long it's been um it has been uh and most of these actions are things that we could have done without that emergency declaration uh but but it certainly helped uh enforce uh their the authority to do these things so it was the basis for uh holding remote meetings by zoom which we're anticipating uh ending in another week here starting july 1 city council committee commission meetings should be going back in person it's been the basis for some unbudgeted spending decisions primarily personal protective equipment ppe plexiglas disinfectant some smaller items nearly all of which were later approved and reimbursed through the cares funds and the more expensive items although we might have had authority to to go bigger without the budgetary authority we did not use that it was the basis for uh council having several emergency ordinances so instead of having a public hearing and a first reading and a second reading there were a couple of actions that council did by ordinance in a single meeting so a number of actions like this um under our emergency declaration as uh hastings is beginning to return to normal i anticipate that we could remove that declaration in with the resolution out with the resolution so that will likely be on your agenda july 6. some feedback from you on when do we trigger that do we end it july 6 do we end it july 31st some other date but anticipate that that'll be on a agenda in the near future i do want to say that whether the the declaration is still in place or not or what if it is in place really what it does is it gives authority for other actions or some basis for other actions so uh absent things changing in the world we will still be returning to in-person meetings in july even if the declaration is still in place until august uh but um it is something that uh as we return to a more normal footing we really don't need that that emergency authority in place um two of specific items that i do want to discuss one is under our emergency declaration one of those emergency ordinances we passed we said our city council said we are waiving uh utility late fees and penalties so people are still going to get their bill expect that the principal will get paid sooner or later if it wasn't paid by by fall that actually could or should have been levied as an assessment against their taxes but if somebody did not make their payment we were not going to during the the difficulties of the pandemic we were not going to penalize anybody with late fees resolution i don't recall there's a resolution or an ordinance it may have been an ordinance um that action um said during the emergency declarations plural the city as well as the state and federal so we should clarify that it's tied to the city's declaration uh but it said during that the term of that declaration uh those late fees would not be charged i think open to discussion but i think if we suddenly uh july 6 said here's the declaration emergency is over and july 7th late fees are due or start to be imposed uh that's just not fair business it's not good dealings with our our customers our public uh so you may want to in the declaration at the end of july give people notice or if you chose uh could word that um that action uh at your next meeting to say we're ending the declaration on date july 7th but we're not going to impose the fees we're going to continue to have that delay for 30 days past the declaration or it could be you know december 30th then august 30th uh whatever however you may want to choose i think some sort of warning some notice timing would be good for our residents that may be used using that benefit the other action which is recommended for tonight is over the past year initially the federal government put in place the family's first coronavirus relief act ffcra which had a number of provisions one of which was up to 80 hours of paid emergency sick leave actually paid by by city coffers but but mandated by the federal government for somebody who was suffering from covid or had ice some sort of quarantine due to covid or caring for a family member that initially expired december 31st and as we approached that deadline council said uh prevalence of of the pandemic out in the community we want to make sure that city employees are kept safe so the city council said independent of the federal government we are going to extend that for three months through the end of march and then as march approached we said conditions still aren't great we're going to extend until the end of june so currently that expires june 30th and it certainly can be allowed to expire june 30. we're certainly coming to the end of the the declaration in the near future but staff and i recommend actually extending it again and tying it specifically to whatever date that um that emergency declaration may be so if the declaration goes another week another month month and a half uh this emergency uh paid sick leave would match the city's emergency declaration end date but with that i know a couple of mashed together and maybe a little bit complexity to them and over a year plus of history to it but i can certainly stand for any questions [31:30] Mary Fasbender: counsel any questions for dan i know that's a lot to absorb and declarations and emergencies and questions extending it any further [31:44] Councilmember DawnMarie Vihrachoff: i just asked that staff look at if when we end the emergency everything ends so it's consistent um so whatever the emergency is complete whatever we pick i just i'd rather not stagger everything out let's just make one decision to be done thank you mr mayor vaughn [32:17] Dan Wietecha: dan stated you know would be nice to let the residents know when they'll have to start peeing on their utilities if they've been passed dan as we chatted staff was comfortable with maybe ending it july 31st yes as a um simply as the the convenience of a calendar uh july 31st would would work i i tomorrow i'll check with finance department and see if in terms of timing of utility bills the particular mail date that might matter for example if the bills i want to check on the dates certainly don't quote this but as an example if the the bills are mailed on uh by 14th and due july 30th are we including enough you know message in the bill or publication in the paper enough notice for somebody that 30th is is coming when the the notice gets out the 14th or would we be better pushing it into an august billing cycle but but i i would anticipate um absent other comment identity being around the end of july thank you [33:51] Mary Fasbender: comments council your honor i just have council member bulge thank you [33:57] Councilmember Angie Haus: just clarifying about the emergency paid sick leave for the staff oh um i wouldn't want to end that just because i mean we're not mandating that staff get on the coronavirus uh the the covet shot in or the vaccination excuse me and so um and there is a new delta variant that's called it and so um i wouldn't want to definitely not want to stop that and so um so but they're two different issues right or are they are the two connected if we if we stop the emergency um declaration does that stop emergency paid sick leave for staff because i think having us being meeting in person and having you know all of the commission's meeting in person and such is one thing but stopping emergency paid sick leave for staff especially our first responders makes me very uncomfortable and i think [35:05] Dan Wietecha: dan speak to that leave the emergency paid sick leave regardless of any thoughts on the declaration currently the emergency paid sick leave expires june 30th proposal is a extension to that and rather than simply putting it out another month or another quarter picking a calendar date uh the recommendation is to tie it to the emergency declaration currently it's not tied to the declaration that the intent is to the recommendation is that it would become tied to the declaration so if the declaration is ended at the end of july the emergency paid sick leave although extended past june 30 would also end at the end of july or whatever date might wind up being decided for the the declaration [36:14] Councilmember Angie Haus: i would disagree in connecting those two because they're two separate issues i mean having abiding by the open meeting law and having um our buildings open to the public and such and paying of you know fees i think that's all one thing but i think that the role that our staff provide to us is too important and especially when emergency our first responders are out there day in and day out giving it at their all i don't think that it's fair um to stop they remain the emergency paid sick leave just in case they do get sick so i disagree i don't think i i'm glad that they're not tied and i wouldn't recommend that they be tied to one another so um so that's my two cents i guess i need to read the resolution closer as to what it is you're asking us to do [37:11] Mary Fasbender: there's not a resolution we got into it with emotion so it's it's just a motion regarding continuing it so there's not a resolution just be the the text in the middle i'm sorry i don't have it in front of me was there a resolution on that one two too many papers to keep straight today the resolution was coming next hi no resolution in the packet now yeah it was just a motion let's remember i was just going to point out that's what staff right in the middle there's two action requests at the top but there is no right resolution resolution would be in july i think we spoke [38:34] Dan Wietecha: then any other just the the resolution in july would be a resolution about the date of the end of the emergency declaration it's not a resolution specifically about emergency paid sick leave okay [38:52] Dan Wietecha: so the motion would be to extend the emergency paid sick leave through the duration of the city's public health emergency that is the recommendation which at this point there is no end date so come june 30th emergency paid sick leave does not expire because the declaration's still in place and then sometime presumably july 6 our next council meeting although it does not need to be acted on that night uh there would be a resolution saying the end date for probably around july 31st here's the end date for the emergency declaration would trigger anything tied to it one just the the general authority for some actions it also would trigger the uh the late fees on utility bills and it would trigger the end of the emergency paid sick leave the reaction which i think is aligned in along the lines of what councilmember folch is proposing is instead of a set of emotion tonight tying the emergency paid sick leave to the declaration would simply be a motion uh extending the emergency paid sick leave to september first you know pick a date [40:34] Councilmember Angie Haus: so councilmember fultz do you want to make a motion to that self well i would um i'd make a motion okay just for clarification i do agree with planning the city's um and and ending it at the end of july i think that was a good recommendation from staff i think the governor is kind of going along those lines and they're just trying to wrap up some legislative issues and then leaving the approving the extended emergency paid sick leave um i would i would keep that through the end of september just because we don't know what we don't know at this point and i don't think that we should be mandating i mean we're not mandating the staff to get vaccine vaccinated at this point so um i think that we should keep that as an open and open option for them at this point like to make that as a motion yes ma'am thank you okay okay thank you then i would be looking for council member facts additional discussion council member vaughn [42:01] Councilmember DawnMarie Vihrachoff: thank you hunter dan you made all of us but can we use the rescue plan funding for that um sick leave since it's a unfunded mandate i just want to see can we use that funding that is provided [42:14] Dan Wietecha: yeah we should be able to do that um one of the general pieces of guidance on the arpa funds is that almost anything with one huge exception but almost anything that was allowed under the karzak funds should still be able to be done under the the arpa funds and whatever was used from march through maybe april through uh mid-november last year we did reimburse through the the cares act funds and this should be similar thank you i don't know why we put a date on it then because that funding doesn't have to be used until 2024. as councilmember vote says the unknowns are there i don't tie it together just let it be and then we'll at the end of the year or the fiscal year or something like that but what was there's a funding source for it i don't know if i'd put it in data at this time remember [43:10] Mary Fasbender: motion on the floor by council member false folks you want to restate that please verification and we can always extend it again at the end of september that's what we've been doing is just moving in so it would be a motion um to end the city's emergency declaration at the end of july no i'm confused not asking for a date on the declaration we got into that with a resolution we should get out of it with the resolution the the motion tonight is simply on the emergency paid sick leave which currently is is set to expire next wednesday the 30th [43:32] Councilmember Angie Haus: okay i'm sorry we're dealing with too many issues yeah there's several pieces packed into this okay well um i well you know honestly i concur with um council member vaughn that that we keep it you know open-ended because this virus isn't going away anytime soon and i mean we could continue to keep extending it every quarter or every six months but i thought you were looking for us to try to give it a sunset that you just wanted to extend it and and so it was at least trying to extend it out further and not end it for for staff so um yes so you already had a motion in a second and that was to extend the um the emergency paid sick leave through the end of september so um at this point it would need to take a vote understanding the rabbit rules first of all so um yes that was my that was my result that was my motion to extend emergency paid signaling for staff to the end of september [46:12] Mary Fasbender: von no no that motion prevails okay it does not prevail i mean it does not prevail so we're not ending the emergency paid sick leave right so could i make a motion though to approve extending the emergency paid sick leave um an undefined date um to be determined into the future or does it have to have an end date and we can read [46:51] Dan Wietecha: i would really recommend a date and i i i want to defer to council's policy decision but i i would have a lot of trouble recommending beyond september i i it uh although the the pandemic is out there uh the the comment about the emergency declaration is foundation and basis for a number of decisions that the council has made if it if anticipating ending you know going back to normal the building's open we're returning to in-person meetings uh we're ending the emergency declaration how do you justify needing to have this emergency sick leave for months beyond other actions so i i would really be reluctant to something open-ended i think you'd be better picking a date um i recognize you that you did not like the september 30th date but i would recommend that you pick a specific date rather than open-ended and as as council member folks pointed out if if we hit that date or close to that date and want to extend it we can't base it off of the circumstances at that time it can be extended we've done it twice already okay that makes sense councilmember fulch [48:28] Councilmember Angie Haus: well you know there still is a virus out there we have over 600 000 americans dead people are dying by less amounts throughout the world and so i don't feel comfortable throwing our emergency responders out to the wind and so i'm not going to do that i'm not going to cut it off at this point because the mutations are still evolving and they can still have exposures and so um so i would rather um extend it through the end of the year then because it's not going to go away by the end of the year and then we can have a another discussion about it at that time and as council member von said we currently have the the ability to pay for the leave with the additional um corona relief funds and so it makes sense to me that we have the backs of our emergency responders um well and you know not the role of public works or anybody else but they're the ones that put their lives on the line for us and so i feel that we should make sure that we have their back so um so i guess i can try again i mean comfortable with looking at the end of the at the end of this calendar year and then we can revisit it or looking for head nods or put on another motion fair enough and then we can that's important okay so i'll make it okay i'll make a motion to approve extending the emergency paid sick leave through the end of the 2021 calendar year of december 30th or 31st so that's emotion on the floor second council and council member vaughn seconds additional discussion council for merchant yes yes motion does my council members [50:38] Mary Fasbender: do you have any announcements i have a few um boy summer has definitely begun today because starting tuesday june 22nd there is a in the park and the haitian dancers supported by manufacturing and metropolitan regional arts council thursday june 24th there's music in the park with no limits b-side band supported by ruth and george goffing charitable foundation friday june 25th movie in the park is planes fire and rescue sponsored by ardent mills please bring a periscope non-perishable food donation for hastings family service wednesday june 30th is story time in the park and the theme is farm in partnership with pleasant hill library thursday july 1st music in the park with the jolly huntsman supported by ruth and george drafting charitable foundation thank the sponsors the major sponsors that sponsor these events at the pavilion and around our community and it's greatly appreciated [52:10] Mary Fasbender: congratulations to officer vomistek and k9 sunny for their top rookie and agility awards at the regional 12 trials trail trials last week city offices will be closed on monday july 5th servants of independence day our following meetings are planning commission on seven on june 28th june 28th at 7 pm our next city council meeting is july 6th and keep in mind we will not be zooming or we'll be in our council chambers and looking forward to i it we all are our meetings of commissions and committees we're all going to be in person so we're thankful that we are that far and next this time i would look for a motion to adjourn council adjourn uh council member vaughn and a second by council member brock's no discussion clerk murcha please call the roll yes that's a member forge yes yes that's the number of life help yes mike yes [53:44] Mary Fasbender: i will add one thing there's still music in the park going on they play till 8 45 tonight at the pavilion so got 45 minutes you can hear the last band
