As a result, I would love to change the corner of West 16 drive and West 68th Street, turn it into a three-way stop sign. And right across the street of my my townhouse only my townhouse a one just like the stop sign. No parking any time that it runs for more than four blocks. It says parking no parking anytime sign with a little arrow pointing to the to the stop sign. That's it. Very small space. The picture number two. If West Mall parking get this much car action, Sears will still be open. You see the black SUV leaving. That's car number two already. I have to stop for car number one already gone. This is number two. And I couldn't go anywhere because the upcoming traffic. I'm going towards West 16th um Avenue. So, I can't pass. I just sit there. So, I might as well take a picture, show it to you guys. This is nothing. Nothing compared to the traffic hazard that is going on in my corner. Uh, picture number three. I call it driveby, pickup, drop off. Dryby, pickup, drop off. This is right right next to the corner, West 16 Drive. See the pickup truck stop. the other pickup truck behind. Gotta wait, not moving. Pass it like that. And this is nothing compared. Like I said, later on the day, this is just a few cars. Picture number four. Anyone wants that gray SUV, please give me your 411. I give it to that driver. Not only does he parks there 24/7, he cleans his car, his garbage end up on my door, either my driveway or the doorstep. At least it's not fees that it happened before. So, can you number picture number four? Uh, the next one once again, bring your work car home. That's across the street of my townhouse. right there. Trailer cargo. I call it repeater offender because it's been part doing that since 2024. This is it. This is what I have. My American dream. All this. Bring your work car home ends up across the street of my house. I serve as chair of the Miami Date County Commission on Disability Issues and as a board member on the Miami Springs Disability Board. I'm also a state activist leader with the National MS Society and a national peer adviser with the Schizophrenia and Psychosis Action Alliance. I want to highlight a commitment in the city's 2018 ADA transition plan. It says Hyalia will implement an ADA compliance committee that meets at least twice a year in public with citizen input to review city facilities and services and stay current with law and best practices. I I've been asking for years for this committee to be formed and and and for those public meetings to happen. No such committee appears to exist. I'm asking for your help tonight to get to to get it started by directing staff to convene it and and to publish a schedule, agenda, public participation process and meeting minutes. This should be a committee that welcomes and represents all people with disabilities in in including physical and and mental disabilities, many of whom still do not have a clear seat at the table. and hyaliyah. If the city needs help getting it up and running, I will volunteer. I would be glad to serve, help chair um to help organize the first meetings so this becomes real and functional. Our disabil our disabled community is hoping to hear soon voices of support from city hall and and see this commitment put into action. Thank you. >> Thank you. >> If I may through the chair. Legal >> Well, he's speaking of the American Disabilities Act. Yes. >> And um obviously internally within the city, administratively, we do in fact address whether or not um we are the city is ADA compliant. if the council wishes to set up some type of committee or board that will require an ordinance uh because our our code and our charter does not provide for once um so is at the pleasure of the council >> is it um regular practice that you've seen in other municipalities that they have such board for for this compliance I I know that the city does meet for our buildings um our elderly buildings our park to make sure we have the ramps the proper parking But I I think the gentleman was speaking more in general um to host these meetings like a town hall is what I from what I understood that he was explaining and invite the public. Is that something that we legally should do that we're we're we're not in compliance with? >> No, Councilwoman. I would have to do some research to see what other municipalities have done and um uh provide that information to you if you want to sponsor any type of committee in the future. >> Okay. Okay. So, on record right now, we have no such committee ever that we know that it's existed here in the city. >> It's not in our code and it's not in our charter as far as I'm aware, but I could definitely do um uh additional research. >> Okay. Council President, if I may, like to address the newly elected council. >> Yes, please. >> Willie Morero, no disrespect, but I will tell you this. Good job, kid. You worked hard. Councilwoman Jayen Perez, nobody will ever outwork you in this city. Good job. We've watched you grow from the time as you started as a temporary aid to a full-time employee to the HR director to a councilman sitting in the sixth largest city of the state of Florida. Good job, Mayor Calvo. from the underdog to the top dog. Just like that. Good job. You worked hard. May we continue with a semblance of democracy in our city. Uh on behalf of our 240 firefighters, we stand ready to work with you and your administration side by side and hand in hand as we always do. I'd like to salute you for reaching out early to work with our first responders in the fire department by making station visits, talking to the members, see what is going on, see where the dysfunctions lie, and and we all pretty much know what that is. Uh uh so the council is aware, we do have a massive uh bill of overtime in the fire department. We have struggled with recruitment. We have struggled with retention. It is something the mayor has uh already uh been advised of. Uh we've already spoken about it. has already uh talked to our chief about it. Something that we are working on hand in hand in tackling. Uh we have a lot of great ideas and solutions. Uh that's what we do here in Hyia. We do it for less and we do it with less and amazingly enough we always make it work. But congratulations to all. Welcome to our city. Uh understand as uh we have your backs, we expect you to have ours. It's one thing that we ask for. We will give our lives for everybody on this council, for everybody in this room. no questions asked. But when we need you, I want to make sure you're there for us and we're here for you 365 days a year, 24 hours a day. Thank you so much. >> Thank you. Very important matter appointing the next member of the city council. Um I believe I have the experience and knowledge 30 years uh dedicated service to the citizens of Hy Alia that I think would be a big benefit to this uh governing body. That's all I have. Um, Mayor Calvo, um, and to the esteemed highly city council members, my name is Britney Sto, and I would like to speak to you today regarding postponing filling the vacant council position. As you may or may not know, uh, I am one of the candidates that has applied for the interim position. I am speaking out knowing that this could affect my chances and your consideration of my candidacy. However, I do so because I truly believe it is in the best interest of Halia. I attend many council meetings. I sit quietly back here in the corner. For nearly the past year since Bovo resigned, having an incomplete council has impacted the city's ability to do business. On several occasions, the council has been deadlocked on decisions. Resolutions have not been able to be passed or amended because five council members were not present. If I recall correctly, and I think he might be here today, um Diego Perez, I think, had to wait three or four meetings before being officially reappointed to the planning and zoning board because there was insufficient council members present. I understand that there are unknowns at play with previous council members that were removed from office. I also deeply respect um your belief and the belief in a democratic election uh rather than just appointing an interim council member. However, I am in disagreement with postponing the next postponing the appointment until the next regular election cycle. Um, I strongly urge this council to either appoint an interim person or to let it go to a special elections. I understand that there are financial implications of having a special election, but there are also financial implications with lost opportunity costs and inefficiencies in this city when there's an incomplete council. Um, respectfully and humbly, I ask you to please not to make the people and the city of Halo wait till the next regular election cycle to fulfill the vacant position on the council. >> Thank you. >> Through the chair. >> Yes, ma'am. >> Uh, thank you, Miss Oto. Thank you for for speaking. And I just want to make it clear. So, we're not uh postponing it to the next regular election cycle. Uh, simply, it's a two-e deferral to the next meeting, which will be January 27th. Um I've asked the city clerk to please open up the application process and extend that through January 23rd. Uh the reason that we made the decision to push it over is because uh we do have like you mentioned a council member who was removed from office and that individual is going to be set for trial uh in just a few weeks. And so it would be imprudent in the interim period uh to appoint someone with this pending trial. If that individual does um beat the charges and gets acquitted, then that individual will then return to to the city council and we would have the seven council members in in that fashion. Uh so for the time being, we we have 30 days. Uh that 30-day clock began yesterday, January 12th, so we have until February 12th. My expectation is that one way or another we'll have a resolution and have a full council within the next 30 days. Ideally sooner, but we have 30 days. So, Miami date pretty much just um run me through this. is pretty much a recruitment center or active or >> Miami Dade is where our training academy or the training academy for South Florida. City of Miami has one. We go to Miami Dade College where our instructors go teach. They have also instructors that uh teach our recruits for an academy. Once their academy is complete, once they graduate, that's when they come on board and we uh start performing our field training uh program uh for a few months until they go out on the road on their own. But that's the academy portion of their training. That's our basic law enforcement training. >> Got it. Thank you. That's it. Request permission to ratify payment made to Feeding South Florida for the purchase and distribution of Thanksgiving meals, which included 675 full meals and 650 turkeys at various community events in a a total communive amount not to exceed $26,12.50. Yes, ma'am. >> So, I just wanted to wanted to check this is just for 675 full meals and 650 turkeys, but we did much more than that, right? >> Yes, we did. So, what hap what George Hernandez, division director, special events, 4,800 Palm Avenue. Uh, basically what this is is ratifying the turkey distribution that we did as a whole. Um the first meals that we got was actually 67 625 meals >> that were boxed. Um that was in conjunction with a sponsorship that the city received by Leon Medical Centers. >> Um this was in conjunction with Halia Housing Authority which also gave out an additional 800 boxes. So, every single senior facility home um under the city of Halia jurisdiction got a full meal and a turkey breast >> within that meal, >> right? Um then on top of that, we bought an additional 600 turkeys that were given out at a drive-thru at Myander Center. >> Mhm. >> Um right before Thanksgiving and an additional 30 turkeys that were purchased to make up for missing turkeys that we needed to give up. >> So this is just making up for whatever the sponsorship didn't cover. That's the cover. Now um this is for the total cost of everything, right? the sponsorship revenue offset what the total cost of >> right so um I just wanted to double check I know that we got a lot of funds um you know checks for senior meals and um a lot of funding that comes from the state I don't know if legally if we we can use any of those funds to pay for these holiday meals um I don't know >> if it's tied to any of that >> typically when we receive the fundings from the state um they're already allocated. They're pre-allocated before the request is made. We can certainly uh for future years make allocations um ahead of time, right, for the legislative session. Um you know, this year obviously we inherited the allocations that were made under the previous administration >> and we'll see how much we get or don't get. Um you know, I don't think it's going to be a lot, right? Right. So, we're inheriting what we have, but uh we'll put in those requests basically at the end of this year or next uh year fiscal year. >> I think that that'd be wise. Maybe we could get a total of what that cost is in all >> and maybe tie that in with maybe um what we are asking our our representatives for those funds since it is for tied to the seniors. I think that would be >> an additional cost that we that the city has. It's between 50,000 to 75,000. >> The initial the initial distribution this year that was planned was a cost of over $65,000 >> and we were short this year. We do a lot it was changed. It was changed. We do a lot because we partner with different entities. Some turkeys we actually purchase but other distributions we do the entity provides everything. So there is no cost. So these were the the 1,200 turkeys and meals that we passed out, but we also did other distributions with organizations that actually brought us everything. Right. So there was no expense other than us providing the staff. >> Correct. Well, I think that's something just to consider and ask for it in the next legislative session. >> Absolutely. >> Um and then if we do get any additional funding or sponsorship, we could use that for anything else, additional labor, other costs that come associated with with the holidays. >> Yeah. And one of the things that you know my administration is working on is to revamp what's basically been gutted out and lost u for the past few months if nothing more than that which is the sponsorship component. Uh right now we have no one no one to uh have their soul sole job and sole efforts to be dedicated to sponsorships and that's something that we're looking to change. That's a conversation I've had with the director. um you know we were making somewhere in the realm of over half a million dollars a year in sponsorships which was obviously put to good use and that number is you know less than half of that >> uh is what we've seen in the last 12 months. Uh I believe we have the gentleman from from Goldstein can give uh kind of an overview of what we're looking to do here. >> Thank you. Name and address for the record, sir. >> Thank you. >> Good evening. My name is Brett Brumand with the Goldstein Environmental Law Firm. We have offices at 2100 Ponillion Boulevard in Coral Gables. And good evening, Mr. President, vice president, members of the council, and mayor. Uh we were engaged by the city just about a year ago to assist with the creation of the city of Halia green reuse area pursuant to Florida's brownfields redevelopment act. Uh this area would cover two parcels currently owned by the city located on West 36th Avenue uh on the north and south side of West 104th Street. Go to the next slide please. Uh these two parcels are approximately 30 acres in size. uh currently used as a public park with a workout equipment, a sidewalk, and a small parking area on each side. Uh these two parcels do have a long environmental history. Go to the next slide, please. Thank you. Uh historically, these uh were the eastern most portions of a roughly 500 acre construction and demolition debris landfill. This landfill operated from about 1988 until 2003. Uh however, in the 90s, Miami date county identified uh environmental impacts from the deposition of waste at the landfill, specifically ammonia in groundwater as well as metals and petroleum compounds in soil uh through later site assessment activities. Uh however, given the westward expansion of Miami Dade County and the city of Hyia, uh over time, a redevelopment project came about that helped rehabilitate nearly all of this uh former landfill. Uh the county line corporate park development uh uh conducted site assessment of the entire former landfill and capped much of the site for redevelopment with uh light industrial and commercial uses. However, these two parcels uh were given to the city and the city uh were made into this public parks they are today. Uh through the uh capping work that was done at the site by these developers, uh Miami County issued a no further action with conditions determination for the two parks. Uh which means that no additional cleanup or assessment work is required provided. Conditions remain unchanged at the site. Uh right now on those two parks, we have a soil cap consisting of 1 ft of clean fill bel with a high visibility liner below it that prevents anybody from accessing the underlying waste that remains at the property. There's also some uh remediation equipment that remains there and I believe is maintained by the adjacent developers. However, if any work is done on these parks, I understand there are considerations for redeveloping or renovating the parks or optimizing their use for potential municipal services that may require reopening that existing closure, which brings its own environmental costs and risks that could be mitigated through Florida's brownfields redevelopment program. Next slide, please. Thank you. Uh so Florida Florida Florida's brownfields redevelopment program was created in 1997 as a tool for both local governments and private property owners to mitigate the environmental costs and risk associated with redeveloping contaminated sites. Uh it's available only to innocent property owners or those who have not created or caused or contributed to the contamination at the site and it incentivizes cleanup and redevelopment providing state-based incentives that come at no additional cost to the city. Uh next slide please. So we have two key definitions uh to keep in mind here. The first is a brownfield and that is any real property the expansion, redevelopment or reuse of which is complicated by actual or perceived environmental contamination. And the second is a brownfield area which is what the city council would create by approving this resolution. And that is a contiguous area of one or more brownfields some which may not be contaminated which has been designated by the local government by resolution. uh and in this sense the brownfield area which we would call a green reuse area uh because the statute does allow you to call it anything you like to avoid any stigma associated with the brownfield name and to recognize that the end result is something different than the brownfield that it started as but these act as an sort of a mini economic development district with a specific purpose within which the property owner can access these state incentives. Next slide please. Uh so the program mitigates these uh barriers to redevelopment uh through uh financial incentives and legal liability incentives primarily and these incentives are available only upon execution of a brownfield site rehabilitation agreement in this case with Miami date county as the environmental regulatory agency who administers the brownfield program. Uh the two big ticket items here, the the big brownfield incentives are available are the voluntary cleanup tax credit program and brownfield liability protections. There are a few additional brownfield incentives that are available that likely would not apply to this project, including a sales tax refund on construction materials used in affordable housing development, uh as well as job bonus tax refunds for new job creation following a certain investment into a new project. Next slide, please. Uh the voluntary cleanup tax credit program, however, is the one of the the biggest attractors for Florida's brownfields program. Uh it's an incentive that encourages voluntary cleanup by awarding Florida corporate income tax credits uh to offset site rehabilitation costs. Uh this program is funded through the state corporate income tax. It's not funded through property taxes and it's not funded through sales taxes. Uh and it's set an allocation is set in statute by the Florida legislature. Uh this allocation has gone from $2 million per year for all of the brownfield sites in Florida at the program inception up to $35 million was the most recent increase in 2023. So it's uh more than enough money to go around for all the brownfield applicants throughout the state every year. Uh the voluntary cleanup tax credit program would allow the city to recover eligible site rehabilitation costs which are defined rather vaguely as costs that are integral to site rehabilitation. Uh this is defined as work that is necessary to implement the requirements of chapter 62-780 Florida administrative code which is our state cleanup rule. Uh but in practice these costs would uh eligible costs would encompass everything from site assessment uh soil and groundwater reporting to Miami date county is the regulatory agency active remediation so excavating contaminated soil and disposing of it replacing it with clean fill treating contaminated groundwater but it can also include certain sunk development cost. The whole purpose of the brownfields redevelopment program is to encourage redevelopment. And uh uh a simple way to address contamination of a site is through construction of an engineering control which may consist of your existing or your planned uh building foundations, building slab on grade, paid parking areas. These costs are all engineering control construction costs that could be eligible for the tax credit. Uh local governments may also benefit from this program even though local governments pay no state corporate income tax because these tax credits are transferable in the secondary market. They're typically sold for a rate of about 90 to 92 cents on the dollar to companies that do pay Florida corporate income tax. And again, this is not a grant program. So this is uh this program requires that the city would spend that money first on the cleanup cost and then apply to the state at the end of every year for that partial reimbursement in the form of the tax credit. Uh, next slide please. Now, taking a deeper look at these tax credits, we have a few categories that would be available to the city here. So, first is there is an annual site rehabilitation voluntary cleanup tax credit. Uh, this tax credit is a maximum of $500,000 per year based on up to $1 million in eligible cleanup costs. So, it's a 50% tax credit every year that costs are incurred. There is no limit. As long as you keep incurring costs leading up to regulatory closure, you can apply for this tax credit. Second category is a cleanup completion bonus tax credit. Uh this is available one time. It's also a maximum $500,000 tax credit based on 25% of up to $2 million in cost from project start to project finish. Uh an additional bonus tax credit that may be available here depending on how the city uh determines decides to use the property uh is a healthcare provider bonus tax credit that works the same way as in the completion order. I'm sorry, in the cleanup completion tax credit. This would be another maximum $500,000 tax credit if any type of health care use uh is open on the property. It could range from a dietitian, a physical therapist, a clinic, anyone who's licensed under u certain sections of the Florida statutes to be a healthcare provider. Uh that would enable the city to apply for this healthcare provider bonus tax credit once that uh operation begins. Uh two additional categories that likely would not be available here are the affordable housing bonus which is available if you construct affordable housing on the property and a solid waste removal tax credit. Uh that is likely unavailable here because the site was a permanent solid waste disposal facility. So the state uh would find it ineligible for removing the existing waste and moving it somewhere else because that waste was deposited legally. However, there are opportunities to discuss this with the state. Next slide, please. The second big incentive that would be available to the city through the brownfields redevelopment program are the brownfield liability protections. Uh under section 376.82 Florida statutes. Any person which would include local governments who executes a brownfield site rehabilitation agreement is relieved of liability for remediation of the contaminated site to the state and third parties. And what this means is others cannot compel the city to do more cleanup than is required under the state law or has been agreed to with Miami date county as the regulatory agency. The second uh is uh the city will be free from liability in contribution to any other party who has incurred cleanup liability for the contaminated site subject to the brownfield site rehabilitation agreement. And this would prevent previous owners from seeking to recover their past cleanup costs from the city in contribution because in environmental law most things have come with joint and several liability. So even if the city did not cause the contamination, the city could be potentially liable for the contamination on property it owns. So this uh places a barrier between others seeking to recover their own cleanup costs from the city just based on that theory of joint and several liability. And finally, uh, the city would be protected from liability for claims of property damages, including diminished value, uh, and stigma associated with the contamination that's located on the property. So, upon immediately upon execution of this brownfield site rehabilitation agreement, if the uh, resolution is approved, then uh, the city would enjoy these liability protections in addition to any other liability protections the city already enjoys. Uh, next slide, please. Uh and the legislature just recently amended this statute to specifically enable or grant eligibility to local governments even if they have caused or contributed to contamination at a brownfield site. Uh with a new cutoff date of July 1st, 2025, although we don't believe that's the case here. Uh this is just an example of how this program is equally geared towards local governments and private property owners. Uh within Miami Date County, many municipalities do participate in the program and generate these voluntary cleanup tax credits for sale, including the town of Cutler Bay, the city of Dorado, uh city of Miami Beach, the city of North Miami. Uh so this is a fantastic way for the city to reduce cleanup costs as it moves forward with the project. Next slide, please. And now looking at just the process here for designation. Uh the brownfields redevelopment act has a specific path or designation for uh local government proposed designations or designation of local government owned property and this designation would be required before Miami date county would entertain review of a brownfield site rehabilitation agreement. Uh here the process requires notice through posting and publication conducting two public hearings even though this is a resolution. The statute does require two public hearings and then adopting that resolution following consideration of four factors. Next slide please. So the statute establishes four factors for consideration. Uh the statute does not require that you make any particular finding with respect to these factors merely that they be considered and I'll touch on each of those very briefly. Uh next slide please. So the first is whether the brownfield area warrants economic development and has a regional potential for such activities. And here the property is currently underutilized as a passive park in an area that with significant economic development both commercial and residential recently. So optimizing this park space uh can support that continuing economic development in the surrounding community. The second factor for your consideration is whether the proposed area represents a reasonably focused approach and is not overly large. Uh here this proposed designation focuses solely on the two parcels owned by the city. They're roughly 30 acres in size which fits within about 24% of all designated brownfield areas in the state. Next slide please. The third consideration is whether the area has the potential to interest the private sector in participating in the rehabilitation. And here this is an unusual case where the private sector has already uh done the bulk of the work to rehabilitate the property. Uh so I believe that uh factor has been uh adequately addressed. However, the private sector will continue to be involved as redevelopment continues and the city engages private sector uh environmental and construction professionals to complete the job. And finally, whether the area contains sites or parts of site suitable for limited recreational, open space, cultural or historical preservation purposes. U and I think that's very clear here. The entire area is currently a park and the proposed plans that we've seen and discuss with city staff uh would include a significant portion of the of the site as a renovated and more optimized park. Next slide, please. If I'll just jump in a second. >> Um beautiful explanation. I think you went into all the details. In a nutshell, what it is is we have these two parcels, a north and a south parcel out in the annex. Uh they're 30 acres total, 15 a piece. And these are basically completely underutilized. They're passive parks. It's just a simple trail. And we understand that there are some very serious remediation efforts that have to be done in order to develop those properties further. If we want to create anything more uh from a park perspective, we have to do remediation. If we want to put some sort of a a police or fire a permanent building, we're going to need to do this remediation. And so essentially there are monies available out there uh by the state where basically it's free money um that is given to the city so that we can conduct the remediation efforts on this property. In order to get there, in order to start and be eligible for that money, the local governing authority, the city council basically has to agree that this is a site that qualifies per the statute as a brownsfield. Once that designation happens by the by the board then the process begins. Uh gold scene has been the firm that was previously retained uh in order to start this process and that will allow then monies to start flowing from the state and then we can start the remediation efforts which then would uh turn into you know the future outlook of those two parcels uh so that they're better utilized. So that's all we're doing right now. Uh there's no uh necessary vote on this. This is simply just a discussion item and this would come back as a resolution for a vote at the next council meeting. U but obviously any questions these are the experts but in a high level that's what we're doing. It's free money uh from the state in order to be able to remediate these parcels and get our residents in the annex uh some much needed uh additional services. That's all. When will we when will the funds be available? By this year or >> there's an annual application cycle. Uh the state operates on a calendar year basis. So cost incurred from December, sorry, January 1st, 2026 through December 31st, 2026 would be applied for in an application that's due by January 31st of 2027. So you have a full year to incur those costs, an extra month to pay those costs before the application's submitted, and then the state usually issues those tax credits uh between then and July of that of 2027 depending on the availability of the last year's allocation. >> Okay. Thank you. >> If I may through the chair. >> Yes, ma'am. >> So, so therefore, in order for us to complete the project, are we given um kind of a clear contract by when each project needs to be completed in order then to be reimbursed? And if we don't meet those deadlines, would we still qualify for the following year? Or if we don't meet the deadlines, we're not reimbursed. >> So the uh from a project uh standpoint, uh this is completely project driven. So you would there are certain uh deadlines to submit, say, for example, a site assessment report and a remedial action plan, but they don't dictate when you need to complete your project. And those uh deadlines can be established with Miami date county as the regulatory agency and they're generally Miami date county is very agreeable with with Brownfield's projects. There is the a key deadline is submitt of that voluntary cleanup tax credit application if it is not submitted by the application deadline. You lose the ability to claim tax credits for any of those costs incurred in the previous year. >> Got it. Um, mayor, just just for you to know this area, um, I know that that um JC Bermudees and David Boredo um drove that area. They they looked at some of that property. They they were informed on um the contamination that's found in those those different fields. And they um I know that David had said that he was interested in helping us get some kind of appropriation funding through the state. Um and and I don't know if that's something we could combine with this project and and you know work together. I don't think it would impede if we would get any appropriation funds from the state on how we pay for the project. >> We would still be issued the tax credits. >> Yes. >> Okay. So that's something that maybe we can make an you know schedule a conversation with the representative. >> I'm happy I'm happy to have the conversation. You know I'll let you know and and I expressed it to Mr. Bero directly. He submitted a total of zero dollars in appropriations this year for the city of Halia and he represents the second largest district in the city. So I'm very upset with him and and hopefully he gets his act together uh because we need money and he's our second biggest representative. Um but yes, absolutely we should push for more state and federal funding and again that's one of our priorities. Uh if you look at the chart, the amount of money that used to come in uh based on what we're getting now with some of the appropriations, what they were looking like, it's it's it's pennies on the dollar. And at the end of the day, that just means the taxpayers are footing more of the bill. So, absolutely. And and we're going to push them with everything we got. >> I know that he submitted um the bill not this year, last year for the 911 tower that we built out there. He was the co-sponsor on that one. Um, so I I'm I'm sure it's just a matter of having a dialogue with someone and communicating our needs and then them advocating for for our city. So, >> thank you. >> Yes, of course. >> Mr. President, >> oh, sorry, but can I also add that if you do receive an allocation from the state of whether it's through a grant or it's allocated by the legislature, uh, those funds can also be used in the tax credit application. And so in a sense you're able to receive those that funding from the state and then get a additional discount by using uh using those funds as they were spent in the tax credit applications. >> That's it. >> M Mr. Mayor or Mr. Robbins was it >> Rund? >> Yeah. >> Historically the re remediation although maybe it's hard to tell now but the remediation we have to do to this property to bring it up to compliance. So you have a a million annual cap which would yield a $500,000 tax credit. So that may cover a significant portion of the cost, but it really just depends on exactly what the remedial approach is here because uh discussing with city staff over the past year, I understand there may be some soil excavation and replacement with a clean field, but there also may be some engineering control construction. Just depends on what the final configuration is. So, uh there's also an opportunity to sequence some of the work there. So that way you don't ever exceed your $1 million cap in any given year. If you do some work towards the end of the year and then continue it at the beginning of the year, you're looking at two separate application cycles and two separate million-doll caps. Congratulations, how this is so clear and everything was explained. and hoped of the future. But before that, I want to congratulate you, Miss uh this is the second time I call you Mayor Cavo. I know you worked your ass off and man, you really really worked hard. Everybody said that. So did Councilwoman Perez and Councilman Morero. I I I just applaud the work that that you do, you know, and people don't know what much work that is, you know, and um I want to congratulate you for that. I want to talk on this issue because in the past the the practices we did like we used to use folio numbers and we didn't put addresses the reason the prime administration did that was to confuse the residents I know I was here a lot of times with three friends park when they used the folio and nobody knew what they were talking about to later on in the project they they didn't put addresses they didn't put and I want to hope one day hope Alexander our assistant attorney comes up here when three three friends park went in front of the ethics committee, the Miami date ethics department said our past practices, they were legal, but they were not ethical. I know we saw Deborah Storch a lot of times come up here, oh but what we're doing is legal. But yeah, the ethics department, Miami date told what you're doing is legal, but it's not ethical. This is a very ethical. You you're doing something you're telling everybody and that's that just stops confusion. I want to remind you too when we gave away uh Slate Park and we gave it to the school the the residents were only told that 200 extra students were going to be added in that resolution. They didn't tell them that the some parkland was going to be given away. So there's nothing like transparency just I mean you're going to have more respect when just keep this up you know just tell people what's happening. I I want to talk about I received a letter before when Dub a a change a home wants to do changes and I received a letter in my house telling me exactly what the changes are everything they're asking for I hope our our planning is only our planning director sorry I forgot her name she keeps doing what we're doing because before we would only re receive like a little three by postcard and it will briefly say this property which by law by 500 ft. Everybody lives within 500 ft. They have to be told what's happening. We received a little postcard and it only said there's going to be changes to this property. That letter I received two weeks ago that from the planning and zoning department said exactly every little change that was going to happen in that property. I hope you you you um you keep that practice up and transparency and and people nobody can complain. You received the letter, you receive in English and Spanish. That was the one of the main complaints because the prime ministation was only doing in English and the ethics department was very clear with with our Alexander our attorney that no we're Spanish speaking community. I was very proud to our on Monday yesterday seems like a year away but yesterday I was done but it was bilingual bilingual um service a bilingual ceremony and and I I please uh it's very important everything in Spanish too but because we're uh one last comment has the most foreignb born residents in any city in the state of Florida. So that council member or elected official would not um be charged for that as long as they're doing so in their official capacity obviously uh and not for campaign purposes or um personal reason or what have you. So as long as it's in their official capacity uh they can receive that document free of charge uh in the exercise of their duties and uh if there's any some sort of uh redaction that is required that would also be waved as well. So, it's making sure that uh this is a transparent uh government moving forward and that all the council members are able to get the information they need in order to do their job accordingly. Uh the city has designated certain areas in the city as transitoriented districts. Uh which means you have a higher density um and kind of a redoing of the properties within that area to be more dense to create more affordable housing, more housing uh close to the transit corridors. This is uh close to uh 25th Street. There's a tri rail station there. There's a metro rail station. And the city has designated an area a map which is part of my presentation that this property is located within. So for purposes of the land use, um I'll show you the properties. Next slide. It's two properties. It was originally one, but then the uh the client was able to go ahead and purchase the other one. uh altogether they're approximately uh almost 17,000 square feet. It's a corner property. Uh we're developing it within the guidelines of the transit oriented district. For land use purposes, um staff's report shows that it is consistent with the transit oriented district. uh there school concurrency is available which means that there's uh space for the schools and the other services of the area are there uh for the land use portion I'll go ahead and make my presentation for uh the reasonzoning also item 19I uh the other part is resoning it from R1 the single there's two single family homes there now uh one built in 1949 I believe and the other one in 1940 um what we're going to do is a fourstory multi multif family uh building with 33 units. The first floor has parking uh with 34 spaces, two ADA spaces. Uh the first floor also has a lobby, storage room, electrical room, garage room, and the second through fourth floors have uh three studio units, seven onebedrooms, and one two bedrooms. Uh the building complies with all of the setbacks uh dimensions except the stairs stick out a little too far on 19 on 19th Street. Uh next slide. Next slide. This is just showing you that the land use that it was before lowdensity residential and single family home. Next slide. This is what I was telling you about the transit oriented district. This is the map that the uh city has actually put out. This shows you that this property is located within uh that district. Next one. This is um an overhead because some of the issues have been um a neighborhood that appears to be a single family neighborhood. Um and and um I I've talked to the um zoning director and she has agreed that this neighborhood in particular uh kind of has lost its single family character. And the reason I put these on there so you can see of the overhead how almost every single property has had additions and additions and additions. Next slide. Kind of there. Some of them go from property line to property line. So just showing you that this actual multifamily building done the proper way will be an improvement to u the illegal efficiencies, illegal additions that uh seem to be have been made on this on this on this area. Next slide. Same thing. Next slide. Next slide. This is the proposal. Uh the architect on this is uh Manny Rails who was here before you. Uh we've been working on this together. So you see a very nice design, modern design. Next slide. Just showing you the plans. Um like I said, all of the setbacks are met except for the one on 19th Street, which is the stairs that stick out a little bit, but uh staff in their own report says that this will not be a hindrance. Uh walkway is clear, everything's clear. Um we will uh have the like I said the 33 units with the 34 parking spaces. Um there there are we are short one parking space but in this code since this is a uh related to the transit the idea is to have people not use their cars uh as much. The idea is to get people to use public transit etc. So, they do give you the opportunity within your code to mitigate the parking. So, this client will have to pay $25,000 for one uh parking space that they're short. So, uh the recommendation of staff is approval. The vote at PNZ was uh unanimous for approval. Next, um the school was started over 20 years ago, a private school there. And as time has gone on, they took over over properties. Um when we started this process, we found out that some of the properties were zoned one thing, other properties were zoned another thing. Some had one land use, another one had a different land use. So, what we did was try to get it all together and clear it up and make sure that it's all compliant with uh the requirements of the city. The city has a requirement that for any private school to be authorized, you have to come in for a conditional use permit and they look at certain things and make sure that everything's okay. Uh, which is one of the things that you're doing today cuz some of the property did not have that. Um, we they incorporated, if you see there, there's four different properties that are part of this application. Um, on the top left, it's a little house that was the last one that they purchased. Um the one on the bottom left is the corner uh used to be a restaurant many many many years ago for those of us that have been around Halia for a long time. And then you have the two on the north side of those two. So all four properties are what comprise uh this application. Um, the property is 100% paved uh from lot line to lot line. It extends the entire length of the of the block and right now it serves as a transition zone. So across the streets a new Shoma Plazas um which is an eightstory building uh that went up and actually oh there's a PowerPoint. Um I do have a rendition of of the area. If we go to the next slide, I'll try to make it a little bit quicker, but that's the existing conditions as you all know. Um it's approaching it 75th anniversary. It's an old building and we're looking to repurpose it uh for a new project. Um next slide. This is the uh asbuilt survey. Just what I mentioned before. One parcel is a surface parking lot. One parcel is the building and it extends from uh block face to block face. Next slide please. These are the views of the uh existing neighborhood. Um it shows you the 80 foot rightway that we abut and um it shows the um commercial uh commercial units on on the south and the north of us which is Navaro on the north of us and then commercial also on the south. Next slide please. Um this is from one of the side streets and it shows the new Shoma uh towers and behind us on the slide right before um it shows that we to to the west of us which is our rear uh we have bought a townhouse community and right adjacent to that townhouse community is a three-story multif family community. So we go from eight stories across the street to the townhouse community. So, we're looking at red designing this property for a new project. We worked very diligently with your staff. Um, and we worked more on this project than any other ones I've been involved in actually. Um, because we went through many different renditions. Want to make sure it was a transition from the higher density and the higher height to the the lower density. So, it's almost like the wedding cake, the traditional wedding cake. Uh we're proposing the eight stories from the show home down to a four-story building down to two and threetory buildings. Uh next slide please. This just shows the uh site plan. Um and what we did was we wanted to make sure that there's no curb cuts along the main thoroughfare that the entire frontage of the building is activated uh to promote pedestrian walkways, promote activity and make it more aesthetic. So all ingress and egress is uh restricted to the two side streets. Uh the front street will have on the ground level to have office. Um it'll have our gymnasium, our leasing office and a formal uh entryway and uh an elevator uh area. Um next slide please. So the all the parking is going to be naturally v ventilated. Uh, one advantage to that is to make sure that you eliminate any type of noise generated from mechanical ventilation. If you ever go into one of the um, uh, enclosed parking garages that have I don't know if you've been to IKEA lately, but if you go to IKEA, you'll see like they look like jet turbines that are plastered on the ceiling. We want to avoid that because we do above a residential area. So, one of the things that we wanted to highlight is that this is a naturally ventilated garage, but it's going to be screened by landscaping. Um, and also it's only limited to the side streets. Next slide, please. We're going to have double loaded corridors for the 71 units that we're proposing, which makes it a much more efficient um type of building. Next slide. This is a breakdown of the units. Uh we have 18 studio uh units, 41 one-bedroom, uh six one-bedroom/den and six twobs. Next slide, please. This shows you the square footage of each of our units and they go they start off at uh 576 ft and they go up to almost 1,000 ft. Next slide, please. shows you our roof plan just to um expand upon our attempts to make sure that uh the building is efficient, aesthetic, but also um a a good neighbor to the the community, making sure that we can eliminate noise wherever possible. So, what we did was we made sure that all of our mechanical equipment is limited to the rooftop. Next slide, please. This shows you what we were able to do by making sure that we have a naturally ventilated garage and that all the uh mechanical equipment is isolated to the rooftop. Right now, we have a completely paved uh uh piece of property. Uh if this project is approved and built, we'll have 1,300 ft² of lawn area. In addition to that, another 5,100 square ft of landscaped area. uh 30 new lot trees, eight palm trees, 19 street trees, and over 300 shrubs. Next slide, please. This is something I talked about a little bit before about the um aesthetics uh qualities of the building when you're looking at the main thoroughfare. So it in addition to the active street front, it has different elevation features, different architectural treatments that make it look and appear from street view as a building that is um more than just one building. It has uh projections. Uh next slide please. This is the side elevations uh that show that natural ventilation and how we accommodated that uh within the building. Next slide. And then this is just our requests. Um, so we don't have any variances for parking on this application. We're not having a a request for reszoning. Uh, this is a uh application that's been diligently reviewed by your professional staff, has gone through many re reiterations of planning. We think we've come up with a really really good and project that we're proud of. And we went to the planning and zoning board and they recommended approval unanimously.
