VARIANCES ACCOMMODATE THE BUILDING AS WELL AS PATIOS ALONG THE FRONT YARD AND A BALCONY ALONG THE SIDE YARD. THE APPLICANTS APPLIED FOR ADMINISTRATIVE HEIGHT AND IF THERE ARE INCREASES FOR THE PROJECT AND SITE PLAN REVIEW. [10:00] Lindsey Silas: HERE IS AN AERIAL VIEW OF THE SITE AND SOME PHOTOS OF THE EXISTING STRUCTURE. THIS IS THE SITE PLAN. AS YOU CAN SEE THE BUILDING IS RECTANGULAR IN SHAPE AND THE SITE IS DECIDEDLY NOT. SO THE APPLICANT HAS PROPOSED TO FRONT THE BUILDING ON MINNEHAHA. THEY ARE PROPOSING TO MEET THE MIXED USE DENSITY BONUS WHICH THEY ARE USING FOR THEIR HEIGHT INCREASES. THEY ARE ALSO USING THAT WHICH ALLOWS THEM TO DECREASE THE FRONT YARD, ALONG WITH REDUCE THE CORRIDOR TO 0. THEY HAVE MET TWO OF THE THREE STANDARDS OF THE BONUS HERE. [10:33] Lindsey Silas: YOU CAN SEE THE OUTLINE OF THE HOUSE TO THE EAST. YOU CAN SEE THERE ARE DASH LINES SHOWING WHERE THE CORNERS OF THE BUILDING PROTRUDE INTO THE REQUIRED YARDS. THE CORNERS THAT PROTRUDE INTO THE FRONT YARD ONLY PROJECT 6.17 FEET AND THE CORNER THAT PROJECTS INTO THE SIDE YARD IS 4.15 FEET. THE VARIANCE HAS BEEN TRIGGERED FOR BALCONIES, PATIOS AND PERGOLA. THE PATIOS ARE ORIENTED QUITE AWAY FROM THE SINGLE FAMILY HOME TO THE EAST. HERE ARE SOME FLOOR PLANS. THE FIRST FLOOR HAS COMMERCIAL SPACE, A LOUNGE, LOBBY SPACE AND STORAGE. [11:34] Lindsey Silas: AND THIS IS THE ELEVATIONS WHERE WE CAN SEE MORE CLEARLY. SO THE APPLICANT IS PROPOSING A SIGNIFICANT SOLAR ARRAY ON THE ROOF OF THE BUILDING, WHICH IS WHY THEY PROPOSED THE SHED ROOF CONFIGURATION TO GET THE RIGHT SLOPE FOR THAT. LIKE I MENTIONED, THERE IS A HEIGHT INCREASE REQUIRED. THERE ARE ONLY FOUR FLOORS THAT CONTAIN DWELLING UNITS, BUT BY PURPOSES OF THE ZONING CODE, THERE IS A FIFTH FLOOR AT THE NORTHERN PORTION OF THE BUILDING WHERE THE SHED ROOF GETS TALL ENOUGH THAT THE FOURTH FLOOR EXCEEDS 14 FEET IN HEIGHT. IT IS CONSIDERED A FIFTH STORY AND THE OVERALL HEIGHT OF THE BUILDING IS 56 FEET, 10". THEY ARE REQUESTING AN ADDITIONAL 10" AND TO BE ALLOWED WHAT IS FUNCTIONALLY — OR BY ZONING CODE, A FIFTH FLOOR, BUT DOESN'T ACTUALLY HAVE A UNIT. [12:44] Lindsey Silas: THERE ARE BALCONIES AND IT IS THE ONLY EASTERN-MOST BALCONIES THAT ARE PROTRUDING CORNERS OF THEM INTO THE SIDE YARD. THE APPLICANT HAS SUBMITTED A SHADOW STUDY HERE. LOOKING AT A FOUR-STORY BUILDING OF 56 FEET IN HEIGHT COMPARED TO THE SHED ROOF BUILDING THAT IS 56 FEET, 10". YOU CAN SEE THE SHADOWING IMPACTS ARE SUBSTANTIALLY SIMILAR. NO ADDITIONAL SHADOWING IS CREATED BY THE SHADOW STUDY AND THEREFORE, STAFF WAS ABLE TO MAKE THE FINDING REGARDING SHADOWING OF ADJACENT PROPERTIES TO RECOMMEND APPROVAL OF BOTH THE HEIGHT AND FAR INCREASES. [13:26] Lindsey Silas: THE APPLICANT, WHEN THEY SUBMITTED THEIR HEIGHT INCREASE AND FAR INCREASE, THEY NOTED THEY ARE GOING FOR PASSIVE HOUSE CERTIFICATION. THEY ONLY NEED ONE BONUS FOR HEIGHT AND FAR. THEY HAVE PROPOSED THEY ARE ALSO PURSUING TRANSIT PROXIMITY, WHICH WOULD ALLOW THEM ANOTHER BONUS, BUT THEY AREN'T NECESSARILY USING THAT. THEY INDICATED THEY ARE PURSUING THE AFFORDABLE 4D HOUSING PROGRAM. THERE IS A TYPO IN THE STAFF REPORT. THERE WAS A TYPO IN THE APPLICANT'S MATERIALS. THEY WOULD BE PURSUING 4D AS THE STANDARDS THAT THE CITY SETS FORWARD, WHICH IS 20% OF UNITS AT 60% AMI. THE TYPO WAS THE 80% AMI THAT WAS BASED ON SOME INCORRECT INFORMATION. THEY PROPOSE TO CONFORM TO THE STANDARDS OF THE PROGRAM. [14:14] Lindsey Silas: STAFF WAS ABLE TO MAKE THE FINDINGS FOR BOTH VARIANCES. THIS IS A VERY UNIQUELY SHAPED LOT. IT HAS TWO FRONT YARDS. THE APPLICANT IS DOING THEIR BEST TO COMPLY WITH THE SPIRIT OF THE ORDINANCE BY ONLY HAVING SMALL SECTIONS OF THE BUILDING. I WON'T GO INTO TOO MUCH DETAIL HERE, BUT IN THE VARIANCE FINDINGS I NOTED THAT THE PORTIONS OF THE BUILDING THAT ARE PROJECTING INTO THE SETBACK AREA ARE STILL QUITE DISTANT FROM THE SINGLE FAMILY HOME. STAFF FOUND THE PROPOSAL FOR THOSE SMALL PROJECTIONS WAS REASONABLE AND WOULD NOT HAVE AN INJURIOUS EFFECT ON THE SURROUNDING USES. STAFF RECOMMENDS APPROVAL OF THE TWO VARIANCES AND SITE PLAN REVIEW WITH THE EIGHT STATED CONDITIONS ON THE SITE PLAN REVIEW CONDITION AND I'M HAPPY TO STAND FOR QUESTIONS. I THINK WHEN STAFF WAS LOOKING AT THIS, THE CONTEXT GIVEN THAT THE COMMERCIAL PATIO IS LOCATED CLOSE TO THE GOOD AND SERVICES CORRIDOR IS WHAT WAS COMPELLING IN SUPPORTING THAT AS FAR AS ACTIVATING THAT STREET. SO THIS PROJECT HAS GONE THROUGH PDR AND THERE HAVE BEEN SOME DIFFERENT ISSUES NOTED AND REVISIONS REQUIRED FROM PUBLIC WORKS SPECIFICALLY RELATED TO THE DOORS SWINGING OUT INTO PUBLIC RIGHT OF WAY. I STARTED FOOTPRINT AND PROPOSED THIS PROJECT SPECIFICALLY BECAUSE I'M PASSIONATE ABOUT OUR HOUSING SHORTAGE, CLIMATE CHANGE, REDUCING CAR DEPENDENCY AND IMPROVING QUALITY AND URBANISM IN OUR CITY. THIS PROJECT WILL ADD 32 HOMES TO THE NEIGHBORHOOD AND ONE TO THREE NEW HOMES FOR BUSINESSES IN THE NEIGHBORHOOD. IT IS GOING TO BE 100% ELECTRIC, LOW IN BODY CARBON, SOLAR POWERED AND ULTRA ENERGY EFFICIENT. ON THE SHED ROOF, COMPARED TO A FLAT ROOF, WE'LL BE ABLE TO DOUBLE THE AMOUNT OF ROOFTOP SOLAR PRODUCTION. [20:45] Cody Fisher: I THINK THE PROPOSED VARIANCES ALLOW US TO CREATE A COMMERCIAL UNIT ALSO, WITH A GENEROUS PATIO AREA THAT I THINK WILL HELP ACTIVATE A HIGHLY VISIBLE CORNER ON THIS CORRIDOR. I WANT TO THANK COUNCIL MEMBER JOHNSON AND LCC FOR THE MULTIPLE OPPORTUNITIES THEY GAVE ME TO PRESENT THE PROJECT CONCEPT AS IT EVOLVED. I BEYOND THE UNIQUE BASICALLY DOUBLE FRONT YARD CONDITION, I WANT TO EMPHASIZE HOW LITTLE THE BUILDING ENCROACHES ON THE SETBACK VARIANCE THAT WE ARE REQUESTING. THE NEIGHBORS TO THE NORTH AT 3553 MINNEHAHA WILL EXPERIENCE THE BIGGEST CHANGE FROM THIS PROJECT. I'M NOT GOING TO STAND HERE AND PRETEND THAT IS NOT THE CASE. WE MINIMIZED THE WINDOWS AND BALCONIES IN PARTICULAR ON THE LOWER FLOORS THAT WOULD BE LOOKING INTO THEIR HOME TO MINIMIZE THE PRIVACY IMPACT AND I HAVE COMMITTED TO THEM AND COMMITTING PUBLICLY, WE ARE GOING TO DO A SURVEY INTERIOR STRUCTURALLY ON THEIR OLDER HOME BEFORE ANY WORK IS DONE.
