One faces senators improvements in 2 through And this is football 4th edition, which is north of 31st, Street, South and east of May's Road. The developer will be getting these privately and the city of will take over will fire them after the projects are complete. Recommended action is approved. First off, I'd like thank our staff for this snow removal on our roads and runways on Saturday. There's an amazing amount of snow over the extended period of time. And I thought they did an amazing job, keeping it as clear as possible. >> I know the airport had shut down for a period of time, but it's also due the record amount of snow that we've got. So just to get thanks to our public works, the airport first responders. They've been the best of a bad situation also Saturday, our small business Saturday was affected because they can get out. And now there's a movement right now to do a do-over on this Saturday. So highly encourage folks to get out and shop local local support local as much as they can on this Saturday must have a do-over and finally today is giving Tuesday. So lot of our nonprofits are struggling this time of year. And anyone can find a little extra in there. And their wallet this year to help out our nonprofits, especially the small ones that would be most appreciative. So thank you. Appreciate those especially among the city staff is out there working. They don't get nearly enough credit. >> And also in regards to giving Tuesday, it's been a little more difficult for charities over the last couple years. Thank you, >> For the past year, staff has been doing some review work in the city code specifically in title 3 and he's got a number of amendments that it's bringing forward to you. I'm Jenn, German and the law department going to start off of the presentation specifically be looking at items that we believe are obsolete and many cases and worthy of a either deletion or remember it with them and turn over to Jen. >> Good morning. Vice Mayor Council Jan Durham and a lot of apartment. This has been an ongoing Where we were asked by finance to review some of the title 3 licensing provisions. I know this. I've Steve Abbas Meyer and she'll and hear licensing take a look at what we are proposing today. City lights, as I said, city licensee requested law Department to review title 3. There are a lot of changes we want to do. But we thought we'd pick basically the low hanging fruit first and go for the easy ones that we don't use very often. The goal with this is to eliminate license requirements that are no longer necessary. They're basically unused at this time. It at this point. We've only review title 3 licenses. There are some in other titles we may visit later, but we're going to start with title 3. A city licensing compiled a list of licenses that are rarely used. Analysts was has been provided this point. The City Council, the Department of Lot contacted any department that we thought would be impacted by elimination of these licenses. I spoke with the police department with the Wichita Airport fire with him, APD and city licensing to make sure we have input from everyone to whether these licenses are necessary at this point. The standard we used to determine if we should keep a license is whether it currently serves to protect the public. We're otherwise promote a healthy community. And if we found the licenses doing then then we have them before you today because we're not sure there's a need for them. Starting with the first license that proposed. is 3, 0, 8, 0, 3, o Cabaret license. Capri is no longer used at all because we years ago created entertainment establishment license which meant the cabaret no longer necessary. The second one present to you is clairvoyance and 4 $40. We suggest just eliminating this license. There was one of these licenses issued in 2023. We appreciate that. But I'm not sure if it promotes the a healthy public to have this license. No one, there's no been no clairvoyant busts by the police It's just something where somebody pays a fee and and we have The 3rd one. are thinking about and interest in what you all think, though. But it's directories. They created an ordinance. If you have a few director, Ian, put a directory out that you should have a license to do But no one's ever gotten that license ever had send. Is that a phone book? It would be like, yes, yes. So none of the phone books that we had, the passive had licenses. Now. >> So no one is ever it's never been enforced. We never ask someone to get. We never call them and said We need a directory are need a license for this directory. >> And it's it's been mixed. Domino some time ago. they created a license where to public domino table. You need a license and we do have to domino tables in Wichita that you have licenses. not sure that really promotes public safety or welfare. So we are the elimination of that license. Itinerant photographers are people don't have a photography business inside of brick and They just meet out of the park and do photography And no one knows none of those licenses have been issued in 2023. So recommend eliminating. Penny That's outdated. actually have another ordinance to takes over, although we're recommending elimination of that as well. But Penny Arcade's, none have been issued in 2023 or for some time. 3.1 2 is hitters and shows and we are recommending the elimination of that has an interest in ordinance. Really old. Looks like it probably happened around the time that we have and their long ago movies weren't allowed on Sundays and it looks like Wichita probably started to allow movies on Sundays, but they put some restrictions on the movies. really we're just concerned about the building and it's a safe place to be in fire. Would always be a part of that. Whether you have this license or not, this license is not really necessary to keep the public safe in the building. So we would request ordinance really has to do about the content of the shows and not not a safety issue. So we suggest elimination of it. There were 6 of them issued. And 23. Probably the most would be coin 3.0. 2, 4 point operated amusement. That is ordinance that says you have to have a license to deal in coin-operated machine. So if you have a pool table that takes coins and you take those to a bar, you place your machines in the bar. You a license to put them in the bar. The bar also has to have a license to have them and they have to have a sticker that cost about a dollar. And every coy not machine in an establishment has to have the sticker. We definitely eliminating the sticker because what's happened is there's no review for you. Just go by stickers and you put him on everything and people are putting them on illegal machines and they think that means that the city is beaming them legal when nobody look at the machine there, just a roll of stickers while we're in that ordinance. We're also recommending to the license of a person has to have to deal pool tables. It does garner. We have licenses issued and it Garner about $11,400 to the city for those fees. But there's really no inspections that are done. There really hasn't been kind safety issue we've had with pool tables are dark machines or that kind of thing. it's it's a doesn't mean our definition of being required for health and safety reasons. So recommending elimination if the council is not comfortable with that, we'd at least like to get rid of like the one dollar that are required on the machines because we don't want people to use those on illegal machines anymore and and leave people with the idea that those are somehow now legal because of the sticker. >> How much are the licenses off the top? they one moment. >> A bit for the business. you know, with the license art with how much it $600. So 600 operator, 50 owner, one dollar for the decal. >> get back up to the side that you're just on. Thanks No help. No forward Yeah. Thank you. So on 3.1 to theaters and shows does that also included? I know that there was a a show recently in the town ease parking lot that had a big circus. tent is that same type of thing since it's more temporary? Or is this only for permanent type facilities? >> It is one moment. I'll tell you. 2 issues that safety for the tents. The parking lot show. We will not eliminate the tent fire still has to review and they do an actual inspection of the tent and eliminating this license will not eliminate the need to get a license for your like so so that would have any impact on that part of it. I do think it would have one moment. Look at the definition. trickle production. So I would call that a theatrical production. And I think under under the current ordinance, you should get a 10 license and you should get a license. They would be eliminated we But we still have the safety issue. good Thank All right, go to great. >> All right. 3, 2, 8, is dance halls that has there's been an issue 2023, they're not necessary. Morgan, because entertainment establishment is now used instead of dance halls. 3, 3, 2 business termination, liquidations. If you. are going out of business and you put the big yellow signs up and you're going to have a business going out of business sale. We actually have an ordinance says you have to have a license to have one. I would assume so. You don't have one every week in protest like you're constantly going out of business. Sort of a slippery I we don't manage prices in other types of businesses sense not are issues. We just not sure we see it as being necessary to protect the public. So we're recommending elimination. We're also recommending elimination of 3.3, 6 auctions and auctioneers. There have been 6 their low license they probably created. It's it's a fairly have quite a few provisions probably created to decrease or to keep an eye like theft and and Sen seen items through an auctioneer. But that's not we haven't had a big auction bust. As long as I've been here almost 30 years. That's not normally where you see things fenced. And I contact the police department and they don't think it's necessary. To to protect public against theft and resale of theft items. So we are recommending termination. 3, 6, advertising vehicular advertising. ordinance says you have to have a license if you're going to sound or video, you see those trucks drive around that have advertisements. You've got a license for or have a sound. You have to have a license for that. And there were only 3 issued. We don't do any kinds of inspections. All you have to do is come in and pay the fee and you get your license. And that's really what we're trying to eliminate. We're going to try to get to a point. If you have a license, there's a reason because we're going to look at what you're doing now. They may be impacted if they have loud noise state. But we still have noise that we could use if they became a problem if they were distracting to drivers. That's the only reason the council you owe me want to keep it is there might be some concern about distractions for drivers on these led advertising. But but because we're not doing any you inspection of them, we are we for their limitation. Yeah. >> I think on our outdoor signage ordinances, we do have limitations on a frequency of movement held off and changes and also the brilliance. How bright And that could be a distraction, especially if you're in traffic. So I would be concerned about those 2 elements how we can enforce that on these. Advertising vehicles. >> This might be an ordinance. It's better instead of eliminating. If you're interested in that issue that we could improve the way it's written now, it could use some honing in that direction. And as long as we're not dealing with message and we're just dealing with brilliance yeah, then I think it's something you might want to look at. So we can look into that. 3, 6, 6, is advertising signs, bills, posters. These are for the folks who leave like, you know, lawnmower. >> Service handles on your front porch. You are technically you're supposed to have a license for that. actually people do have licenses to leave those hand bills. If you're a politician, you don't have to have a license. Because we know we can't in French on a political speech. It is the core of of what the Constitution protects. But we do say that you have go by the littering. You can't litter. You have leave your flyer under a mask or tell notice that they're attached with rubber bands. That's because of ordinances. You have to leave those under way that they won't blow away so again, that's an ordinance a little has probably too many provisions. If the council is interested in keeping that we could refine it. I think we could also eliminated because we do have littering ordinances that we can apply if we had a company and they were flying all the neighborhood. There are still things that we could do there. We have other ways of keeping the litter from happening. You get a lot of folks who are upset with people giving up on their property in Lee on their porch and and leaving a hand bill. This doesn't say you can't. It just says that you have to have a license to do And there's no inspection. There's no, no, he does a background check. You just pay your feet, get your license. And which is why we're recommending the elimination. 3 day is airport There is a charter Turner Limousine ordinance and it has some good safety provisions and we're not repeal of that. But the airport limousine there, but there were none issued in 2023. I spoke with the airport authority. They don't feel that it's necessary to have a specific ordinance. So we are requesting elimination. 3, 9, one cultural market. I don't think that come around while I was here but at this point, all of our cultural markets are city-owned and they're covered under community event processes. So there's no need to have a separate license for the cultural market. So we're recommending just eliminating it at this point. not necessary. 3, 9, 8 is happened overnight. Laundromat use was have a license. There were none issued in 2023. So we are elimination of that. Now, if certain things happen to the laundromat, there's some music and dancing. They might have to have an after-hours a license But if it's just a regular laundromat with a couple people, we don't recommend you have to a license for business going Just the long All of these are the percent. >> And that is phase are recommended cleanup of title 3. Other thoughts. I hear you on the vehicle or advertising. We're going go back and do some work on that. Are there any others that are concerned with? >> Not in Do we have a toll estimated loss for the city as far as what expected, I can imagine be more than 20,000 ares. It would be more than 20. Steve, do share with you all agree with that? >> The biggest one is that point which is 11. But the rest of those licenses are very inexpensive. Have there. >> Are there any that that the PD have any issues hasn't all been cleared by them a half. I've cleared through multiple department to pull. >> Divisions of Wpd including the chief and and there's no no issues with Again. >> I think clairvoyance kind of filled me. I was waiting on my district 5 colleagues say looks like cutting the red tape and rolling up the I didn't have current license to be that Couldn't. >> Jen, how we let the folks, you know, in rare exception circumstances, people did have licenses communicate with them and let them know that they're >> longer need to do that. So they don't come down to city Hall or, you know, take their time. That's a honestly probably they would. They would apply and we would tell them it's no longer necessary. I think it would. great expense to us to send out notices. >> I mean, the small ones we could clairvoyance, but was just thinking like the one that had 3 licenses just communicate with those 3 entities, not every, you know, whatever. I'm getting a nod from licensing that that could that could happen. It just have to just thought it was just curious so that we, you know, that note, thanks for doing it. arts to do any more e-mail said be I okay, we have their emails. I get another. Second portion of this again is come some staff review and has to do with community events and trends emerging licenses. >> And with that will turn over Johnson from department. >> Thank you, manager just chat with Steve about that last We stevenson's out renewal notices basically for every license. So instead of the renewal notice she would just send a letter that's like you don't even know this. This time we went through the same thing with the secondhand dealer changes over the summer. So it will be a similar sort of process to that. trip some other changes to title 3 will focus a little bit more on community events and transient And I've been working a lot with the community events coordinator. So this won't be nearly as broad as the first part of the presentation, but drill down on a couple of things for us here. We're looking at the community of permanent mostly just based on experience with that. There's some recommendations from the court mater and changes that we could make just to make things smooth air. There's also been other changes in the coats. We can line some stuff up. Well, with the transient merchants side, it's a little bit different but connected to community events. We don't do a lot of transient merchant licensing anymore. But if you have more than 2 transient merchants, which is really just kind of any business booth, anything like that at any event, you have to have a community event permit. There's been some other issues with transient merchant Licensings. We figured we kind of try to deal with all of that here. And So starting with the community and that he says that the first the first thing is kind of a cleanup with how the city functions. there's reference in the community ordinance to the Office of Environmental Health. We don't have one of those anymore so we won't allow them to approve a events. We can remove that from the ordinance. Another change is part of that may have written here consideration of whether but this is more of straight staff recommendation to change the placement of the community events coordinator from Cultural Art, Arts and cultural Services to the Department of Parks and Recreation. It's currently heart House and arts and cultural services. But it's kind of been an odd fit. Honestly. Park does a lot more events. They apply for a lot of community events, I is our community events. Coordinator is on the same for in the same areas. Parking is technically an employee of part. So we think it would make a lot more sense to have secret synchronicity there. that coordinator position designee of the Department of Parks and Recreation Sunday. If you can go back to first bullet point, there. >> That removing that references that change anything procedurally as House staff refuse the application. I mean, obviously it's there for some reason. Even though we don't have a city department. >> my apologies. I should given more context to that. it's in the provision that's like when the court Nader has an event, they should talk to all of these different departments. So it's not an explicit approval or veto power or anything like that. It's just too does the community events coordinator talk to to make the best decision about approval or denial. So, you know, more just the cleanup to remove it from that. but there would still be a consultation with someone. It is a city staff will regarding any environmental health concerns. It could. >> Be from that application. That's exactly right. It would just be with the department's we have said Department of Public Parks Department work make sure we were changing the process. Not at know. And this is just because we don't have and actually right. Thank you. some other kind of cleanup pieces. But this isn't the permitting exceptions piece for community events. We do have some exceptions for a community event one of those include the baseball stadium and we can do an exception listed as Florence team instead of Riverfronts. We want to update actually refer to the stadium as names now. >> One thing that we want to consider is Riverfront Stadium should be part of the list of facilities that are totally exempt from community event to rules. So there are some there's some permitting exceptions that apply. But there's a big list, especially of city properties, things like exploration place at the bottom where there's no permitting requirements at all and consideration of whether we want to Riverfront Stadium down into that piece. The 3rd bullet point here is whether we want to add other parks such Jaye Watson part or other city properties to the list of exempted facilities. And we're still kind of looking into what that list should be and what the benefits and disadvantages might be of totally accepting a place. I Riverfront Stadium does have some large events that may want to continue to permit. So that might be a little bit different than OJ want some part, but wanted to bring this idea to maybe streamlined the permitting, an exception process for a few places right Just so I understand. So currently, if you have a Jay Watson part, you have to have a permit regardless. >> a community of that, not every event triggers a community event permit. You have 250 if the city sponsoring it, we apply. But there are really requirements so much because we trust ourselves and have all these situations put in place. Most private events Jaye Watson Park like birthday parties. Things like that. That doesn't require community event it has to be an expected attendance. At least the 250 people. And we kind of It's got to be that that that sort number another thing that we want to add to the exceptions is and you heard a little bit about how we've got this entertainment establishment licensing regime, technically entertainment establishments are subject to the community events, application process. But like everything they do every night would probably be a community event since its indoor with more than 250 people. We think that the entertainment establishment license covers that. That's how the city functions. That's how we enforce both of those licenses. We just want to make that clear for entertainment establishment licensees basically. >> So as relates to Riverfront Stadium. Were there ever any events that city staff operated independently of the operator? That's there now. >> Not that I'm aware of, but I want to hear about a year and a half so. Maybe that obviously the operator has their own rules and allowances for that use the facility and they. charge of facility itself. It would seem kind a necessary to have our own set of rules and we don't do any events there. >> We have the ability hopefully that's there and use the facility for. But at least 5, remember correctly but you're The team controls the stadium would establish the rules for the use of the facility. So I don't personally believe that it's necessary to a community event. Rules apply at the stadium. you coach, Jay Watson, Parker and the properties that still falls apart our staff, correct to run those events so forth. >> Yes, so not entirely analogous situations, but different properties that were considered for sure. So moving the authority of the community events coordinator. And this is a question we'd like definitely your guys There's waiver authority that the coordinator has now. So if someone submits an application a little late or their notifications of neighbors coming a little late, we can waive those time limits and there has been a request from the community events coordinator to consider the authority to waive application fees as well. It does not come up very often, but there are some situations where the application fee is an impediment and for something like good cause. We can set out some standards to waive that fee. Now, I did want to highlight, though, that there's a separate sections. So which is the authority of the community events, coordinator is the specific provision about fees and it's currently set up where council approves fees that are set by the manager. So because of that, I just want to have the strays that explicit authority because of the way it to the request from the community events coordinator to at least have some means to waive fees and we can come up with some standard. So it's every time not totally discretionary, but there have been some situations where that would help the process. what are the fees currently? >> And let me pull that up. I'm sorry. I've got the annual community event permit fee but not the other one. >> And see that you have the community of permit fee. I know that's not a little when you look at sorry. >> it's not actually mean, the double type of Isaac and what it for the amount for community event because it's it's not in the code and it's on our application page with try to pull up as we good for this presentation to my apologies for that. And of course, this is the next one that's up with the annual permit where I do know the actual fee because we're asking to lower it. So, you know, perfect timing the annual permit for certain properties is currently set at $1500, which has been very prohibitive for folks. There's a similar fees like for entertainment establishments are farmers. Markets are much lower we're thinking something more like $500 for those 81 permits. We've had a few requests for things like Culinary institutes for some things on Wichita State and some properties there. So this would help. I think open up that possibility instead of it being $1500 for an upfront fee when you don't know how many events are going to happen for the year. So just putting that more in with what similar kind of events programs with the so we do have some questions some issues race, but the application of community event permit itself. So we had talk lately about security plans for things like drinking establishments after hours establishments and currently for community events. The code requires some security measures, but it's all laid out basically has a formula that the chief of police puts together for the number of off-duty officers that need to be at the event. There's not a planned requirement for any kind of diagram that we get are where entry or exit necessarily will look at kind of a diagram of what the event is, but not a security plan itself. So we're thinking a security plan could follow the model of similar recent amendments to drinking establishments where we get kind of some detail from the applicant about what the security will be light at the instead of just that, the number of off-duty officers that would be there. And again, we've got some pretty we've got model language from recent actions well, if that's something that we would like to add a community event applications as well. part of the review, this is kind of a cleanup thing when the community bank or Nader is reviewing the applications. There's a piece about making sure that all street closures have been approved by council. Now that language is a little sloppy because not all street closures are full. The ones we're concerned about it with temporary entertainment district. So it's cleaning that up. So there's no confusion. That's how we enforce it currently. But we just want to make clear there's no fussiness on review As part of street There's a couple things that we wanted to add to we might want or thinking about maybe adding traffic and parking is a required prove or of street closures. Currently the community events coordinator in tracks communicates consults with traffic engineering as necessary. Things like item of the Lia larger events with lots of potential traffic issues. We could make that a requirement anytime there is a street. Closure is part of the community events and maybe. Just cilla tape that process a little bit more. the other part of this is there's a requirement that when we've got alcohol licenses and street closure, the community event coordinators supposed to meet with applicant and any alcohol licensee that's going to be at the a prior to the event that apparently almost never happens. But it's kind of because the community event, coordinators party in constant communication with the applicant throughout the entire process. Our coordinator has asked that we make that a discretionary option to meet not necessarily a requirement that might create some confusion again for applicants when they've been in constant communication with with our regulated So NATO first one >> As traffic engineering consulted on street closures. Now they are, but it's not required by code. I'm the only requirement is to work with the chief of police. So we think just to make sure that always happens, it would be get that good So what looking at here with the traffic engineering. >> With that mean that they would have to approve or are they just consultation mode that the way it's set up now is it is consultation. That's kind of a >> power kind of consultations. So chief of police might offer some recommendations and will make that a condition of application approval or will negotiate with the applicant to maybe find something that works for chief police as well as the applicant. >> Same sort of thing with traffic engineering. They have to give the go ahead and we can incorporate conditions but ultimate approval, but still be with the community events, coordinator. >> Do you know if we've had any issues with traffic engineering over any events here? >> Recently, I mean, there's been traffic issues, but there's not been an issue with consulting with traffic engineering, I think does a great job of keeping folks in the loop. But we just think that because it happens every time and it is very valuable. It should be something we add to the if only to send the signal to applicants so they understand they'll be gone for. So this kind that concludes the piece then on community event, recommendations, street closures as part of a community event. Herman says, well, we've got a few related and some tangential transient merchant recommendations to a big thing that we'd like to do is expand the exceptions for transient merchants licensing. We think that maybe too sales that occur within the city would be subject to this licensing regime when we don't enforce it all that effectively. Anyway, a really big one is that there is an exemption when there's a sale event, something like that sponsored by a nonprofit educational institution, civic organization, something like that and an example might be the kids business fair over Bradley That's put on Lake Wichita State Innovation center. Things like that. It occurs on the Bradley Fair Street. There's a question of whether it's close enough to the nonprofit educational institution. And there's these. We're 10 foot geographic limitations that the sales have to be super close physically to where the nonprofits building basically now, I can imagine this came out because we had some situations where maybe we had too many sales all throughout the city of different merchants, something like that. That's not really an issue anymore. And these geographic physical conditions on event sponsored by nonprofit at just created a really difficult for just events that are focused again, not on profit so much as just an event like the kids business Fair to develop. Another situation we've had non-profit organizations might want to host a like art sale or event for folks who don't have homes and we don't they they would have to post it may be on their property, but they don't have a space big enough for that are just right outside. we're just making it when there's a primary sponsor of an educational institution, nonprofit, those folks making sales at the event do not need a transient merchant wisonsin. The money can go right back to them. We had the word primarily in there as well. So the exception doesn't follow the rule. You can't just tack on a non profit in just a big, massive kind of sale event or something like that. The big for that purpose is just if there's kind of a nonprofit situation to not have to be a transient, champ, another exception to is sales for my 5 miners who are not transacting business is like an employee or agent another entity. So I its business fares, another example technically kids selling lemonade currently probably need a transient purchased license. we're just trying to avoid that. That situation. He also thinks that we could probably just eliminate that section and instead transient merchants being a trigger for community events. I agree moving that person of the parks and rec someone done some community events was always a lot of extra work to go talk to cultural arts parks and rec. There's exceptions for certain public properties to allow alcohol where it lists the parks, where you can do that is entitled for kind of part of the alcohol licensing. But we can definitely look at that to to try sink a the exceptions and or alcohol licensing to make sure it matches exceptions that we have with community event Does that kind what you're talking >> that on the security with having those that formula has interesting. Some of the events that we have like last year team probably the biggest year we've had. >> So I don't know what that would require as far as law enforcement. But I think a security plan good. But if there's a security firm, I think somewhere in there there should be some validation that they know what they're doing. And it's not just a bunch of friends hanging Because because of something happens and they don't have the training or response plan necessary, that could be a bad situation. So some form of security plans to be there. I don't know about the NSA's the formula necessarily, but I do trust that officers come about what they can handle what they can so. More is chief of police or traffic engineering will say yes or no with conditions community event, coordinator. Do their best to get the applicant to accept all of those conditions. But then it is the decision of the community event coordinator. Ultimately whether to accept that from the traffic engineer it's yeah, it's not full veto, but it is.
