SO THE NEXT AGENDA ITEM UNDER 10D WILL PERTAIN TO DRIVE WAY DESIGN. THIS SECTION OF CODE, JUST PERTAINS TO THE CITY'SABILITY TO ENFORCE PARKING VIOLATIONS, SO EVERYTHING HERE WOULD BE ENCOMPASSED UNDER A PARKING TICKET OR POTENTIAL SPECIAL MAGISTRATE PROCESS. EVERYTHING THERE, SECTION 72-01H, OUR RECOMMENDATION IS TO DEFINE THE IMPROVED SURFACES KWHRKS WOULD ALLOW A VEHICLE TO PARK IN THE FRONT OF A HOME, WE WANT TO MATCH THAT TO AN UPCOMING ORDINANCE. CONCRETE, ASPHALT, STONE PAVERS, CONCRETE PAVERS. ALONG WITH SEMIIMPERVIOUS CRUSHED STONE OR CRUSHED ROCK. THE DRIVE WAY CONSTRUCTION WILL COME IN THE NEXT AGENDA ITEM. FOR THIS SPECIFICALLY, THIS IS JUST WHERE WE CAN TICKET A VEHICLE PARKED ON PRIVATE PROPERTY IN FRONT OF A HOUSE. AND IT WOULD BE THOSE SPECIFIC AREAS, IF YOU'RE PARKED IN THE GRASS OR THE DIRT, YOU WOULD RECEIVE THAT TICKET. WE DO NOT RECOMMEND ANY CHANGES TO ANY OTHER SECTION OF 72-01, WHICH PERTAIN TO SWALE PARKING. YOU'RE ALLOWED TO PARK IN THE GRASS IN THE SWALE, AS LONG AS YOU FOLLOW THAT CODE, WHICH WOULD BE 12 INCHES FROM THE ROADWAY, WITH THE FLOW OF TRAFFIC, AS LONG AS YOU'RE NOT PARKED THERE FOR MORE THAN 36 HOURS. >> AND PERMISSION FROM THE OWNER, CORRECT? >> YES. THE NEXT SECTION WE RECOMMEND, OUR CHANGES ARE UNDER 72-03, PERTAINING TO COMMERCIAL VEHICLES PARKED IN A RESIDENTIAL AREA. WE WOULD LIKE TO AMEND THE PROHIBITION AND INCLUDE BOX TRUCKS, WE HAVE A GAP IN OUR CODE WHERE A FOUR WHEELED BOX TRUCK WOULD BE ALLOWED FOR OUR CODE, WE'D LIKE TO PROHIBIT THOSE VEHICLES, HOWEVER, WE DO WANT TO ADD A STANDARD TRUCK, AN F-350 WITH SIX WHEELS, PER OUR CODE NOW, IS TECHNICALLY A VIOLATION, WE WANT TO MAKE THAT ALLOWABLE TO BE PARKED IN A RESIDENTIAL AREA. WE DO RECOMMEND REMOVING THE SIX WHEEL EXEMPTION PROCESS, IT'S OUTDATED, WE HAVEN'T USED IT FOR THE BETTER PART OF A DECADE, THE ON CHANGE TO THIS SECTION FROM THE LAST HEARING WOULD BE TO EXPAND THE COMMERCIAL VEHICLE EXEMPTIONS, TO ALLOW FOR ANY VEHICLE IN SERVICE, SUPPORTING FIRST RESPONDERS OR ANY PERSONNEL ON CALL TO BE ALLOWED, AS LONG AS THEY'RE PERFORMING AN ESSENTIAL GOVERNMENT FUNCTION THIS DOES BRING US IN LINE WITH OTHER MUNICIPALITIES, WHO HAVE SIMILAR ORDINANCES IN EFFECT, IT ALLOWS A SERVICE VEHICLE WHO'S THERE TO ASSIST A FIRST RESPONDER OR GOVERNMENT ORGANIZATION. TO PARK A COMMERCIAL VEHICLE AT A RESIDENTIALLY ZONED PROPERTY, AS LONG AS IT'S PARKED IN THE DRIVE WAY. >> MAYOR: OKAY. >> SO RIGHT HERE WOULD BE A PICTURE ON THE LEFT, YOU WOULD SEE MULTIPLE VEHICLES PARKED, OUR CURRENT CODE IS -- THERE'S A GAP IN THAT CODE, WHICH WOULD ALLOW PARKING IN SOME GRASS AREAS ON THE FRONT OF THE PROPERTY, WE JUST WANT TO MAKE SURE IT'S IN A CLEARLY DEFINED PARKING AREA, DEFINE WHAT THOSE ARE AND THE MATERIALS, AND YOU SEE HERE ON THE RIGHT, THAT FOUR WHEELED BOX TRUCK IS TECHNICALLY ALLOWED PER OUR CURRENT CODE, AND THAT WOULD BE A VIOLATION, WE WANT TO REVERSE THOSE. FOR OPEN UTILITY TRAILERS, WE WANT TO INCREASE THE SIZE OF THEM, CURRENTLY IT'S 32 SQUARE FEET, SO A 4x8 RELATIVELY SMALL TRAILER, WE WANT TO MATCH FOR THE LENGTH REQUIREMENT FOR AN ENCLOSED UTILITY TRAILER, WHICH IS 20 FEET, IT INCREASES THE SIZE OF AN OPEN UTILITY TRAILER, ALLOWED TO BE PARKED AT A PROPERTY. >> I WANT TO SAY, THIS IS A BIG IMPROVEMENT, IN THE SENSE OF THE REMOVAL OF COMMERCIAL LETTERING. ONE TRAILER HAD AN ADVERTISEMENT FOR A FOOD TRUCK ON THE WEEKENDS, VERSUS SOMETHING THAT WAS COMPLETELY BLANK. SAME SIZE, JUST THE ACTUAL LETTERING, I'M GLAD THAT'S BEING CORECTED. >> AND YOU SEE RIGHT HERE, ON THE LEFT, THERE'S MULTIPLE TRAILERS PARKED AT THE PROPERTY, YOU WOULDN'T BE ABLE TO PARK THEM IN THE GRASS, THAT'S PER OUR CURRENT CODE, WITHIN THE FRONT OF THE PROPERTY, THEY CAN STILL PARK ON THE SIDE AND THE REAR, BUT IT WOULD HAVE TO BE BEHIND A 6 FOOT FENCE, IT WOULD STILL BE ALLOWED TO BE PARKED LIKE NORMAL. THEN YOU SEE THERE, THE COMMERCIAL LETTERING, IT'S A TECHNICAL VIOLATION OF OUR CODE RIGHT NOW, WE WANT TO ALLOW THAT. >> WHY IS IT WE ALLOW PEOPLE TO PARK TRAILERS ON THE SIDE OF THEIR HOUSE, AND NOT UTILITY TRAILERS. YOU CAN PARK A REGULAR TRAILER, CAMPER AND NOT HAVE TO HAVE IT BEHIND A FENSE. >> YOU WOULD BE ABLE TO PARK BOTH. UTILITY TRAILERS, AS WELL AS BOATS, RV'S AND RECREATION VEHICLES WOULD BE ALLOWED TO PARK NOT BEHIND A FENCE, IT'S ONLY WHEN YOU PASS THE REAR THRESHOLD OF THE HOME, THAT IT WOULD BE REQUIRED TO BE BEHIND THE FENCE. >> OKAY. >> THE SAME THING WITH A MOTOR VEHICLE AS WELL. THE MOTOR VEHICLE CAN PARK BESIDE THE HOUSE NOT 34I7B H BEHIND A FENCE. WE'RE NOT RECOMMENDING THOSE CHANGES. THE LAST SECTION WOULD BE THE PENALTY SECTION. IT WOULD BE ON THE LOWER END OF THOSE MUNICIPALITIES, TO INCREASE ALL PARKING FINES TO $50, AND THEN TO INCREASE THE PARKING FINES FOR 200 FOR THE FIRST OFFENSE, 300 FOR THE SECOND, 400 FOR THE THIRD AND SO ON. AND HAVE THE LANGUAGE IN THIS SECTION BE BROUGHT BEFORE THE SPECIAL MAGISTRATE. ANOTHER AVENUE FOR ENFORCEMENT, IF WE CAN'T MAKE CONTACT AND HAVE SOMEONE CORRECT THE VIOLATION. IF THESE CHANGES GO THROUGH, WE WILL HOST PUBLIC INFORMATION MEETINGS, WE WILL HAVE A SIX MONTH EDUCATIONAL OUTREACH PLAN THAT WE WOULD NOT DO FOR ENFORCEMENT FOR THOSE SIX MOTDS.
