Agenda. Item number two. Request to rezone from Light Industrial one to single family residence six on 0.2 acre. Located on the east side of Municipal Avenue, 80ft north of 12th Street. Located within the Expressway corridor. Overlay district. Petitioners. The City of Plano. This item is for legislative consideration. Good evening, commissioners. Destiny woods, planner with the Planning Department. So this is the aerial image of the subject property. And the purpose of this request is to rezone the subject property from light industrial one to single family residence six. The intent of this rezoning is to return the property back to its original use, which is a single family dwelling unit, and there are no proposed site improvements associated with the request. This is. This slide is showing the history of the site. So the site was initially built as a single family home, but was zoned industrial with the city's original zoning map, and the existing structure was later used as a commercial building under its permitted zoning, and in 2015 the adjacent properties were rezoned from Light Industrial One to SF six, and that's indicated by this map. So the adjacent properties rezoned. Are the next door neighbors. Those are shown by the red stars on the screen, and the subject property is outlined in blue. So similar to the subject property, these these properties were also built as homes but zoned industrial. And so they were rezoned to be consistent with their land use. The subject property is guided by the Silver Line Station Areas Plan. And this plan is an extension of the Comprehensive Plan. And the request meets the relevant policies set by the Comprehensive Plan. We did receive one letter of support from within the subject property. We received one letter of opposition within 200ft of the subject property. And that makes for a total of three responses citywide, one in support and two in opposition. And to summarize, this request is to rezone the subject property from Lee one to SF six. The use is consistent with the adjacent properties and with the comprehensive plan, and this item is recommended for approval as submitted. I'm available for any questions. Commissioners. Questions for staff. Commissioner Lingamfelter. We had seen the opposition that what did they indicate? Why are they just simply against rezoning? I mean, what what is the reasoning? So the letter within 200ft did not list any reasoning on their letter. I saw that I didn't know if maybe you've spoken to them or. Yeah. And the other opposition was an online response and it was just kind of talking about not wanting any more residential. All right. Commissioner Holly. Commissioner Lankford asked one of mine, can you go back to the timeline? Yes. When? In 2015, when the adjacent properties were resumed. That was in the city, initiated rezoning. Those properties asked for. Yes. So one of them was initiated by the property owner and the other was a city initiated rezoning as a result of that rezoning. So it came up during that zoning case that we ought to rezone the property next door, or to align with the character of the area. Did we reach out to the subject property in question to ask or see if we could do a blanket rezoning at that point? Or was it because of the commercial use that restricted us from Mike Bell? Do you think you can help me out with that question? I don't believe they reached out to the subject property, but it's been used commercially for some time. So I think the idea was just let it stay conforming as it was being used at the time. Okay, I presume that if we rezone the subject property, the do we receive the rescind the building permit for commercial use? Do we remove the CEO for the service constructor and contractor use, or how does that work? We would not rescind it, but I believe the business owner is retiring and. Stop the business themselves. I'd like to add that any additional certificate of occupancy for commercial use would not be issued under the rezone property. So once the CEO CFO expires. Here's what I'm pointing. Pointing at business owners retiring. We rezone, the land gets sold. It's zoned as an Sf6. Can I now come in and take over that CFO or. Assume the building permit? Essentially, no. The existing business owner can keep operating, but they cannot transfer that business to another once it's rezoned. Thank you. Commissioner. Commissioner Tom. Thank you, Mr. Chairman. So can we go back to that map where the opposition is coming from, that does that show that the opposition actually came from that red property owner? So I'm wondering because the it's adjacent to the subject property, I wonder by changing the zoning of that subject property, would it create any compliance issues for the neighbor? Do you know not for the neighbor? No, it wouldn't create any noncompliance or whatever for the neighbors, because the zoning change of this particular subject property. That's right. There should be no nonconforming happening for the neighbor with the result of this rezoning. Gotcha. Thank you. Question for me, I just to make sure this is clear, the subject, the property owner is fully supportive of this and involved in this process. Request for a specific use permit for Transit Center Station 1.1 acre, located 60ft east of Communications Parkway and 24ft north of Legacy Drive. Zoned planned development 65 Central Business one and located within the Dallas North Tollway Overlay District. This item is for legislative consideration. Good evening commissioners. My name is John Kim, senior planner with the Planning Department. The subject property is located on an existing lot with developed with the hotel. It is at the northeast corner of Legacy Drive and Communications Parkway. It is currently zoned PD 65 Central Business one. The applicant is requesting a specific use permit for a transit center slash station to operate a bus transit service at an existing hotel. If approved, the request would allow another transportation option for residents in Plano and visitors visitors. On the screen. You'll kind of see the layout of the proposal. So in orange is the existing hotel building, green is the parking garage, and then in blue you will see the outline of the permit boundary, and that's where the bus will operate. They will park the temporarily, park the bus there, as well as the passenger loading area. They will not be proposing any improvements on the actual lot. So as far as the associated hotel, as mentioned, the bus parking space and passenger loading area will be located at the hotel. So in the picture it is going to be located along the left side of the the image, and so it will be parked below that bay. And that's where passengers will load. Riders are allowed to use hotel amenities. So anything such as lobby, restrooms. So anything they can, you know, kind of use to wait on it will be available. And then Legacy West is also another attraction for this site. There's opportunities to shop to eat, you know, just to visit Plano. So it is an attractive location. So as far as the operation goes, the bus will park in front of the hotel and only one bus will be allowed at a time on site, and they cannot be stored long term on the site as well, just temporarily parked for the bus services. On the screen is the proposed operation schedule for the busses. You know, subject to change based on the operator, but it does run daily at different times, some days more than others. As far as the access for the bus. So because of the heavy level of pedestrian activity and vehicular traffic on Windrose Avenue, it will be limited to take access off Legacy Drive and exit through Communications Parkway. And that is what's shown in the image here. So as far as the parking, there's currently no defined rate for a transit center slash station. So it would default to the use type which is vehicle and related uses. And the parking rate for that is one per one space per employee and one space per storage vehicle. Because the this use will not have any any employees parking on site. And no vehicles will be stored. The applicant is proposing just to provide two parking spaces for the use. While staff did ask for an analysis of the parking because we do have some concern, you know, there may be more more riders park on the site than what is shown. The applicant has agreed to file a letter with the county that basically ensures that if there are any nuisances to the subject, property or adjacent properties, that they will find a way to mitigate so City Council can ask for them to find additional parking or revoke the s u p. And then so on the site, the 481 spaces will be required and the site is currently providing 488. Here. The proposed stipulations and kind of what I went over previously. Here, is that it does conform to the comprehensive plan. There were no official responses within the subject property or within 200ft. We did receive one online response in support of the zoning case. It is recommended to approve Zoning case 2025 zero 12 for specific use. Permit for Transit Center Station. I'm available for questions and the applicant also has a presentation. Okay, commissioners questions for staff. Commissioner Brounoff. Thank you. What size bus are we talking about? So when I spoke with the applicant, they mentioned that it's roughly 22 to 24 seats. I think it's for like a more luxury style bus. Is it as big as, say, a Greyhound bus or more like a van? I think it is more of a Greyhound style bus, just less seating than a typical Greyhound bus. Okay, with lots of space between the seats, I suppose. Could you repeat that with lots of space between the seats? Yes. Could you go back to your drawing or excuse me, the slide that showed the arrows showing the direction of travel. That one? Yes. Thank you. I noticed that the the driveway facing Communications Parkway has parking spaces for cars. On both sides. Is a bus that big going to be able to make that right hand turn with all those parking spaces on either side? Yes. So it is also a you know, it is 24ft over there. So that's typically the width of a fire lane as well. And so it should be able to support the bus operating here. You understand I'm talking about the 90 degree right hand turn from facing west in order to face north on the property in order to get to the exit. Yes. There should be enough room. Okay. Where would this bus be going to and from besides the hotel? So I believe as of right now it is just to a location in Austin, somewhere in Austin. But I know they do have other locations, so if they open it up to other locations, that's all right. Maybe in the future. Okay. The locations need not be specified on this plan. No. Okay. Thank you, Commissioner Tom. Thank you, Mr. Chairman. Do you know if there was a traffic study is required or has done regarding to the traffic going to in front of the hotel, like the valet parking or the traffic through front of the hotel when the bus is there? Because I know that whoever has been to the hotel knows that getting into the hotel is a nightmare. Literally, that even the valet line will go all the way down to legacy and even past the traffic light onto the bridge over on the other side, on the other side of the roadway. So if the bus is there, would they create any more traffic issue in that little corner there? Was there any study done or is it necessary? So I don't believe that it will be the case. I don't think there was a traffic study done, but our traffic department has reviewed it and didn't express any concerns about the site or the bus impacting the traffic at the location that the bus will be there was previously, you know, some parallel parking stalls there. And so it essentially is replacing that the the regular vehicle parking with the bus parking. And so I don't know that there would be additional traffic issues from that, but yes. So yes, our traffic department has already evaluated the situation. They don't think there's an issue. Correct. Okay. Thank you. Commissioner Olli. Similar to that, I'm going to pick on that a little bit. So the bus is going to be parked taking up the parallel parking spaces as it waits for on boarding and off boarding. In a situation where, for whatever reason, you have two busses that are. Coming into the on board and off board area almost at the same time. What what is the mechanism? Just because you don't want to have two those two busses parked at the same time, either schedule gets cramped or what have you. What can we do to to enforce that, that we don't have at any one particular point in time, two of those busses, because that changes the calculus of that space. And very quickly, do we have anything that we can do to enforce that, or are we at the mercy of the operator? Yeah. So let me show you the proposed stipulation here. So from number four, no more than one transit bus may be on site at any time. So that is a restriction as part of the scope. And so, you know, if there are any troubles, you know I think property standards can, you know, cite them as well as, you know, the letter that they file with the county, you know, that does have, I guess, some teeth to it to enforce if there are any issues, including, you know, traffic back up into the street. And so I think, you know, a lot of that will be up to the operator, but the city will have some ability to enforce that. The parking is the assumption that for folks who are going to board the bus, the bus in Legacy West to go to Austin will consume some of the already existing hotel parking. The covered parking. So the hotel already has the required parking met. And so the proposed bus use would only with the required amount. It would just add two additional parking and then they would still have some excess parking available. So theoretically, if it does become an issue, you know, the hotel, you know, would be the first one to kind of manage that issue. Yeah. But I'm surprised that it requires only two additional parking. So if it's a bus that carries 24 people, let's assume you're offloading all 24. In Plano, you're picking a new batch that's easily 24 cars that are going to park to get on the bus to go to Austin. Why are we only asking for two? So the applicant has stated that in their so far with their business that in their experience, most of the people that use their bus service are either just dropped off, you know, by friends and family, or they use a rideshare service or, you know, if they live around the area, they can just walk to it and take the bus. And so, you know, it does promote, you know, just having another transportation option available. And I think in this, you know, more urban area, you know, it is kind of encouraged to have that transportation option. And so I think that's why we only have two. And then we also have the letter to fall back on as well. Okay. I can add to that, Mr. Kim. Other considerations are this is owned by the hotel and there are issues in the hotel can remove their permission to operate here. That was one consideration. The second was we asked we had the same questions when we were reviewing this. And we we wanted more of a projected demand. And so the feedback we got was, well, there's just there's just not in their experience. And but what they did provide was more of a utilization study of how many of the existing hotel spaces are currently used and how many of them are empty. And they found that many of them are empty a lot of the time. And so if riders do come and use the parking they can provide, they can use it just like any other hotel guests, paid parking, they can utilize that parking on the on site. Thank you. Would this specific use permit, if granted, permit the use of this space for other types of bus companies besides Von Lane, for example, a Dart bus or perhaps an airport shuttle service? It could potentially do that, but in this case, I think it would be up to the hotel operator, because, you know, they are working with Von Lane directly here to kind of manage, you know, what other bus companies are allowed to operate on the site. And because there cannot be more than one bus at a time, you know, I think there would be some of the issues from that removed. Thank you. Right. Any other questions for staff? All right. I thought I would come today to just tell you a little bit about Von Lane. We have been in business for 11 years now. We're a two time winner and named to the Inc. 500 list of fastest growing companies privately held in the United States. Our strategy is to provide people with a transportation option that gives them an alternative to flying or driving themselves between cities that are about 200 miles apart. Oftentimes, it's a flip of the coin. Do I drive to the airport, go through security, have that hassle, or do I just drive myself? Driving yourself is stressful and tiring and the highways are are scary. So we've given people this option to ride in a more kind of first class atmosphere that you see here. 22 seats. It is a 45 foot motor coach. We customized the interior and make it a first class cabin. We have a galley aboard. We have an attendant aboard. Very nice restroom and large oversize seats as you can see. So it's really an exceptional travel experience we've been offering now. And our, our, our strategy is to focus on these cities that are 200 to 250 miles apart and to put terminals close to where people work, live and play. And so for years we have connected Dallas Austin Houston San Antonio, Fort Worth. And this year we thought, Plano is booming. We should be in Plano. We should give people in Plano the opportunity to be really close to their destination, where they live, where they work and ride very easily to Austin and vice versa. Bring people from Austin to Plano and all that North Dallas has to offer. So we partner with hotels in all the markets that we work in. And so for years we have gone to each city that we serve, and we partner with a hotel like the Renaissance. They allow us to come onto their property, load and unload passengers. A lot of our passengers, the smart ones, will get off the motorcoach and check into the hotel. It's really easy. It's great. So we bring room nights to the hotel and then the hotel serve as our kitchens. They are our caterers. All of our trips have meal service, so the hotels also become a great vendor for us, and we become a great customer to them. And we spend a lot of money with each hotel. So it's a good deal for them to provide the catering for us. So it's a very high end service. Our average fare is $130 one way. These are great people that we're bringing from Austin to Plano, great business travelers, a lot of high end luxury leisure travelers. 95% of our passengers just rave about the service. We've driven over 31 million safe miles on Texas highways, and we've transported over 2 million people here. You can see some of the hotels that we work with, very high end brands. Hyatts, Doubletrees, Marriotts. These are all great referenceable partners for us, and these cities have really enjoyed having us connect them to other cities in Texas. And then in 2023, we were able to expand outside of Texas. And we opened up in Atlanta, Memphis, Nashville and Knoxville. And again, that's been very successful. So it's a service that people enjoy. It does bring travelers into the markets. And as you can see here from these pictures, it's it's quite nice. And so it is one vehicle, you know, at a time. On the Renaissance location. We can only with a 45 foot motor coach enter from legacy and exit out on communications. There's no other way to do it. We've tested it and it does work. We communicate with the hotel during transit so they know when our vehicle is about 15 20 minutes away, and we do work with them to make sure we can come right in. The valets are ready for us. They have areas coned off so that we can come right in and not hold up any traffic. So I'm happy to answer any questions. Great commission questions for the applicant, Commissioner Lingenfelter. So I share some of the concerns that Commissioner Olli had had kind of mentioned with the parking. That was really when I went through this. That was that was the thing that jumped out at me when I was doing my homework last. And during over the weekend, but. Two, two spots doesn't seem right. So I, I believe the truth behind that is quite a bit more. But but it does sound like you're working with the hotel. The hotel is going to probably have surplus, but what happens if they have a big event? They're full and now you have 25 spots or whatever, or maybe more if there's multiple busses throughout the day, are we are we going to have to bleed into Legacy West? And and that's really crazy parking. If anybody's ever shopped there. So so now you start causing problems for the neighbors and, and the residents and everything. So I'm just my biggest concern was the parking. So great question. Talk about that. Great question. So you know, 11 years, 31 million miles I have traveled a lot on our our vehicles. As you can imagine, it is heavy, heavy use of rideshare when when our one of our vehicles pulls into one of our hotel partners, the the Ubers are there ready to go for the passengers. And so not a lot of parking takes place when your scenario happens. And it does happen. For instance, in Austin, one of our hotel partners is very close proximity to the University of Texas football stadium. On a football day on Saturday, that place is, you know, taken up for, for for all the parking. So we have the ability to do is to communicate to our passengers that there is no parking at this hotel facility for these, these days, these specific days. So we will send out email, blast text messages to the to the travelers, letting them know that they cannot park at the facility and they must use rideshare or be dropped off. Mr. Tong. Thank you, Mr. Chairman. So you mentioned rideshare. So we have been seeing all the rideshare designated areas at the airport similar to this. So I wonder if I didn't see it on the map. Maybe I missed it. Is there a designated rideshare spot? Instead of waiting in from the in front of the hotel? Because the hotel in front of the hotel has very, very limited real estate there for people to pass through for the valet parking. And if you have a bus there and they're, you know, 20 some people getting off and waiting there for rideshare to arrive, I can imagine that's a problem. So I don't know if you have a designated area for people to go to to wait for their rideshare vehicles to arrive. We don't. That would be something the hotel would would put in place if they wanted to. It has been done at other hotels. I will tell you from my experience working with hotels for so long, most hotels have large events that happen when you know 40, 50, 100 people walk out waiting for rideshares. And so we're very small fraction of people just a few times a day. And our times, if you notice from the schedule, are really off peak times, you know, 6 a.m. 9 a.m. 10 a.m. those types of times are very off peak at a hotel. All right.
