I'll call the regular meeting to order. To make it easier for residents to voice their comments, there will be two public comment periods. There will be one at the beginning of the meeting designated for comments related to items on the agenda and one at the end of the meeting for general public comment. Public comment for designated public hearing items will be heard when the item is called. Speakers will be limited to three minutes to state their comments and we recognize that some of you are here to discuss Pinecrest. We're aware that the start of school year last week has contributed to increased traffic in that area. And as Pinecrest Horizon has made changes to the school's drop off and pick up procedures, things are even more congested than usual. While a traffic circulation plan was approved by the city several years ago, its implementation is the responsibility of the school. We encourage you to share your concerns directly with Pinecrest. City staff has already been in contact with the school, their chartering organization, and the adjacent landowners to encourage them to come to a resolution. Although this is not a city matter, Henderson Police will continue their patrols in the vicinity to ensure traffic laws are followed, and if you still want to make a public comment, the appropriate time to do that would be at the end, the second public comment period. We have some very, very special guests today, so we're going to go a little bit out of order so they don't all have to sit with their families through all the rest of the meeting. So with that, we'll We'll go straight to presentations, and then we'll go back into the order of the meeting. Mayor and Council, we'll start with presentation number one, Public Servant of the Year Award. So our first item this afternoon is a presentation of the Public Servant of the Year Awards by the Veterans of Foreign Wars Association. Doc Enos, Post 983. The VFW is the nation's oldest major veteran service organization, tracing its roots back to 1899. VFW Post 983 annually recognizes exceptional service by public safety personnel in our community. This year, they have selected Henderson Fire Department Captain Michael SIG Utah and firefighter paramedic Ben Forbes and Henderson Police Department Officer Michael Coleman and communications operator Ashley Vince to receive their public servant of the year award in recognition of their service to the city of Henderson. I would like to welcome VFW Doc Enos post 983 Commander Larry Brower and Senior Vice Commander Robert Zentz to present the awards. Mayor and Council are invited to the gallery to congratulate the honorees. First award goes to, where'd I put my notes? Right behind me. There we go. Gotta get this man's job right. First, we're going to take, well, let me say a few words and then we'll take a picture. I want to thank the VFW for their service to our community and for recognizing those that we know who are already heroes in our eyes. We are so proud of the men and women who serve in both our police and fire departments and the way they represent the city and the way they make us safe in our community. We're recognized nationally as one of the safest cities in America, and it's because of the hard work of the men and women in both of these departments. Thank you for recognizing that for us, and thank you for being here today, and thank you for your service to our country. Number two is our next presentation. Next, we want to recognize the Vegas Aces 12 Wren Volleyball team who earned the gold medal in the 12 USA division at the 2025 USA Volleyball Girls Junior National Championships. That's right. This is This is the first ever gold medal and any medal for a 12U team in the Valley, so they deserve some more applause. The Vegas Aces team includes athletes aged 11 to 12 from Henderson and surrounding areas, many of whom are expected to go on to represent Southern Nevada at higher levels in the sport. We welcome coaches Ruben Herrera and Lily Redmond and Cordelia Palipoy and the team of talented young women who have demonstrated outstanding skill and teamwork throughout the tournament, finishing with an eight and two overall record and defeating teams from across the country. I'd like to invite the national gold champions down front for a special photo op with the mayor and council. Thank you girls for being here today and I feel like this is Henderson's year. I think this is like the seventh time we've had a state champion or a national champion just this year. So you're wonderful representatives to the rest of the girls in our community of what can be done with hard work. Thank you for representing us so well. Congratulations on a job very well done and we look forward to seeing you back here next year for the next championship and we have some special certificates of congratulations for you. I'm speaking on item 42 tonight. I'm the executive vice president of George Chacacus, Inc., and this is the transfer of private activity bond cap. I want to thank the council for considering this item. I also want to thank staff for their tireless efforts to provide housing opportunities for all. Private activity bond cap is one of the most critical tools for developing affordable workforce housing throughout the country. Private activity bonds finance the majority of workforce housing in the country and also here in Henderson. The private activity bond cap allocated to this development will help finance 119 units of affordable workforce housing in Henderson that is critically needed. So once again, thank you. City Council and City leaders joined veterans and other members of the community for the Purple Heart Day ceremony on August 7th at our Purple Heart Plaza in downtown. We honored the extraordinary men and women who have received this distinguished award this year and acknowledged all previous Purple Heart combat veterans for their great sacrifices. The communications department earned three 2025 APEX awards, which recognize excellence in graphic design, editorial content, and the ability to achieve overall communications excellence. The team was recognized for the Join Henderson Fire website and the Team Henderson Spotlight newsletter and received the grant award for the 2024 F1 Las Vegas Grand Prix watch party award. marketing campaign. Congratulations to the Communications Department and their collaborations with Parks and Recreation and the Henderson Fire Department on this great achievement. Thank you, Mayor and Council. This item is to amend the current ambulance franchise agreement between the city and community ambulance. I need to disclose that my son-in-law and daughter work for community ambulance. Their employment with community ambulance is a conflict of interest that could be perceived by a reasonable person to affect the independence of my judgment on this matter. Item number 33 is a continued public hearing, the appeal of decision AP-3-25. for WOS-2021-008175-A1 Waiver of Standards Amendment for the Abitan Garage for Landscape, and the recommendation is to affirm Planning Commission's decision of approval. Mayor and members of council, this is an appeal of a May 15th Planning Commission approval to amend a waiver of standards for an accessory structure, a garage. To request a deletion of a condition of approval requiring increased landscaping in the form of nine 24-inch box juniper trees. Planning Commission found that the applicant had compensating benefits and approved the deletion of that condition. Staff's recommendation is to follow Planning Commission's recommendation and deny the appeal. Thank you. This item is a public hearing. Is there anyone wishing to speak on this item? Mayor, there is not. Oh, there is for this item. I'm sorry. It's George Abiton for item 33, public hearing item. I hope I pronounced that last name correctly. Okay, good. Hi there. My name is George Abiton, zip code is 89015. And I just have some letters from my neighbors that I'd like to hand off. And I I don't think I really need to speak since nobody's here to oppose, I don't believe. Thank you. Mayor, if I could just note for the record, you received some correspondence this afternoon from the appellant, Mr. Yacubic. In that letter, he made a series of statements, but one of the ones I want to make clear to you is he stated that the code prevented you from acting on this because he had requested a continuance. That's a misreading of the code, and you certainly have the discretion to hear this appeal today and continue with this item. Thank you. Any questions or comments from the council members? Well, from me, thank you for clearing that up because I did receive that letter requesting that, so thank you for clearing that up. And then to committee about how long has this been pushed along? How long has Mr. Abington been waiting for an outcome on this? approximately. This was approved at the May 15th Planning Commission meeting and then it was scheduled and then we had one continuing so it's been several months. Yes, it's been several months. Right, so it would be my position to continue to bring this forward based on your guidance as well because I believe he's waited long enough for this to have an outcome from what Planning Commission had already approved. I have one more comment if there's anything else. I am a little concerned because he is citing that due process is being violated. Refusal to grant this statutory right undermines procedural fairness and the integrity of the appeal process itself. Let me respond to that. There's a misreading of the code here. There is no right to a continuance from either the applicant or an appellant like Mr. Yacubic. In fact, what our code says is that the council has discretion. If anything, it limits the discretion of the council to grant more than two continuances. So it's actually the opposite of the fact of the way it's being read. And there's certainly no due process violations that I can see whatsoever. Due process requires notice and opportunity be heard. Mr. Yucubic, as the appellant, has had that opportunity. We were granted one continuance because he said he could not be here. One of the things staff asked for when he asked for this second continuance for today was a reason. And to my knowledge, unless Eddie knows better, we never received a response to that. His letter is really compelling. I'm just going to let you know on the... There you go. Mr. Olson, Public Works went out and confirmed that drainage is satisfactory. All the components that we would normally require somebody to do have been met. Is that correct? Yeah, as far as the driveway and the public right-of-way, we're fine with that. He'll apply for a driveway permit, amend his plan to show it, that it's completely across the front of the garage. We're fine. Thank you. And community development, same thing, correct? Yes, yes, we are fine with the submittal. We're going to ask them for just an updated site plan that shows the entire area being paved without the horseshoe that's on the current drawing and the backup, but that's an easy two-second change to the site plan. And that was approved by Planning Commission. They clearly understood that the entire frontage of the garage out to the street was paved. Just also want to note for the record that in his correspondence, Mr. Koukoubek threatened to file a petition for judicial review if you heard this matter. Just for the record, I want to note that I'm happy to defend that matter and very confident that we would be successful. Right, and the only thing I'm aware of is he was just requesting more information from your office in regards to this, and that was part of what he was waiting on. Yeah, he did send some correspondence to my office. I think it was a few weeks ago now to one of my assistant city attorneys. Largely, it consisted of some complaints along the same lines of the letter in terms of how he's been treated or feels he's been treated. From my perspective, it didn't merit a response from us because it was really just his complaints. Of course, we represent the department and would defend them. I'd just like to hear both sides. Okay, thank you. Yeah, no, I'd like to hear the whole thing, but thank you. Thank you, Nick, for your legal expertise. We appreciate it. So I'd like to make a motion, but before I do, there was a couple things I had asked community development should this happen to go forward, and I'm requesting that it do move forward. There was a couple things I'd like to have read in or recommendations that you had from a community development standpoint, reference the approval. If we vote and approve planning commission's denial. Yeah, per our discussions and also discussion here tonight about the exhibit and what Mr. Olson said about the exhibit and the drainage. So two possible suggested recommendations of conditions. Public Works added condition, applicants shall apply for a new Public Works driveway permit or amend the existing Public Works driveway permit with the updated site plan showing the fully paved driveway as constructed and the required drainage within one month of the effective date of approval. An additional Community Development Services condition, applicants shall submit to Community Development Services an updated site plan showing the fully paved driveway as constructed within one month of the effective date of approval. All right, so I'd like to make my motion contingent with those two conditions that was spoken about. I think your motion is to affirm the Planning Commission with the two conditions. That is correct. Yeah, so a yes vote means I agree with Planning Commission's denial. Decision. Decision. Thank you. Thank you. So that's my motion. Mayor, there are two people in the public comment queue. First one is Nathan Buck. Mr. Buck. OK, Mr. Buck's not here. Second person is Eddie Lakins. Good afternoon, Mayor Romero and members of the Henderson City Council. My name is Jonathan Lakins. I go by Eddie. My wife and I are Henderson residents for over 12 years. My wife is a teacher here in Henderson for about three years. I myself am a City of Henderson employee for three years, and my children have been City of Henderson students for five-plus years. Henderson is our home. My children attend Pinecrest Horizon off of Boulder and Racetrack. My son is beginning his fifth year there and my daughter her second year. Pinecrest Horizon is the only school they know. Today's our eighth day of school for this calendar year, and we are advised late on their fifth day of school that we, the parents, are no longer able to use a parking lot shared with MACBID. And the entire school is to solely utilize the carpool lane to pick up and drop off the children. The carpool lane is two lanes wide with a partial third lane, strictly for fifth grade students and their accompanying siblings. This causes a huge burden on the families getting to work, but more importantly, getting our children to school on time. The families I have spoken to, some of them also here this afternoon, report waiting a minimum of 45 minutes simply to pick up and drop off their children. Aside from this, we have a rogue citizen from MACBID policing the parents and dictating where and how to pick up the children in the appropriate lines and how to move the vehicles. I personally witnessed shouting matches between this individual and multiple families. Some families have even reported this to MACBID's review page and Google Review on Yelp. It should be noted that the school day starts at 8 and MACBID doesn't open until 10 a.m. On the meet your teacher day before the official start of the school year, MACBID threatened to have cars towed. Henderson police are regularly sitting in MACBID's parking lot during pickup and drop-offs. My children are scared. Their friends are scared. Pictures and videos of police sitting in the MACBID parking lot as well as the confrontations between the employee and MACBID's employees and management are being shared online. things are getting ridiculous and we simply want to get our children to school on time. The parking situation has gotten so out of hand that events, one of them being my daughter's event that was supposed to happen tomorrow, had to be canceled due to parking challenges. This speaks with little regard to upcoming events such as graduations, field trips, and fundraising events. I understand that the parking situation is a civil matter between the school and MACBID, but I am urging the City of Henderson to do anything in their power to alleviate and or remedy the situation. I call on Mayor Romero and my Council Board Member Seabock to address this matter as quickly as possible. Thank you. Thank you. Our last person is Michael Sam. My name is Michael Sam's. I'm 89011. I made my complaints last city council meeting and I got no feedback. So I don't know what I'm doing here today because I expect no feedback again. But your police department is rogue. Your court system, public defenders do not do a job at all. And people are found guilty just so somebody else can make money. I have two minutes and 30 seconds left. The rest remain in silence.
