Hey. [Music] All right. Welcome everybody. Uh we only have one item on the agenda tonight and that is the reszoning for Z3424 Honeyut Road and we have Hannah Rekal from planning and development here. Good evening. So this is a resoning request Z 3924 8415 Honeyut Road, one parcel, a little over 14 acres in size. is currently zoned R1 with the Falls Wershed Protection Overlay District. The request is to retain the overlay district and reszone to R6 conditional use. So, I'll situate ourselves. This is uh just north of the Falls of New Strickland Road um intersection. Um the site is undeveloped has frontage on Honeyut Road and then uh Chatter Drive uh Stub Ends um Bren in the western part of the property. Uh other landmarks nearby Lafayette Village off to the east southeast of the site and then generally residential in the surrounding area. So there are nine proposed zoning conditions. They uh limit residential uh uh uses so dwelling no more than 56 dwelling units. Prohibit apartment building type uh prohibit other uses normally allowed in R six. Um they also uh commit to 15% of the site as tree conservation area. So that's the the rate for the current zoning R1. For every other zoning district it is 10%. They're also committing to 30% of the site to be designated as open space. And then the remaining conditions uh pertain to transportation features. So condition six would exempt the site from the UDO block perimeter standard, deadend, street standard and cross- access requirements. Generally speaking, zoning conditions are not allowed to be less restrictive than code. This is the one example that the UDO allows. So they're they're requesting that. Uh normally the Chatter Drive stub would be required to connect through the site to Honeyut Road. um conditions also commit to a 10- foot wide path from that Chatter Drive um uh dead end there to the internal pedestrian network of any future development. And then uh condition 8 uh provides an option. So, uh, the developer would provide either a sidewalk at least 6 feet wide on both sides of the street internal, uh, to that development or a multi-use path of at least 10 ft in width uh, on one side of the street. And then the final condition uh, subject to approval by NC DOT would provide a high visil high visibility crosswalk across Honeyut Road uh, near the intersection with Ruminet Drive. So existing versus proposed uh keeping the false wershed uh protection overlay district both uh residential districts but an increase in the uh variety of building types that are allowed smaller lots smaller set packs uh allows quite a few more dwelling units on the site. Uh again that's capped by the proposed zoning condition uh no more than 56 request is uh consistent with the comprehensive plan. It is inconsistent with the future land use map designation here which is rural residential and there are a number of consistent policies. You can see these touch on um housing uh compact development, open space preservation and a few of these uh area plan uh policies inconsistent policies in addition to the future land use map. Uh the development would be different than this how the area is currently uh developed. Uh and then that road connectivity policy um is in response to the uh block perimeter condition. So, uh, because this request is inconsistent with the future land use map, approval would amend the map, uh, specifically that would be from rural residential to low-scale residential. Here's an image of what that map currently looks like in the surrounding area. So, um, if approved, that property would turn uh, yellow like uh, the area south of Falls of News Road. Planning Commission recommended approval in a split vote uh, 4 to two. I can see their finding here. Um, the two commissioners who uh opposed u approval um cited concerns about pedestrian safety and concerns about uh environmental impacts of the request. As with that, um happy to answer any questions before you proceed with the hearing. Questions? Okay. So, I can open the hearing. Good evening, madame mayor, members of council. Michael Burch with Longleaf Law Partners here on behalf of the uh resoning applicant. uh appreciate Hannah's uh presentation and I will be brief because uh we are going to be requesting a deferral to the June 3 meeting so that we can add a few zoning conditions. Uh those are in response to some of the council member feedback as well as uh our meeting. Uh we attended the storm water management advisory commission meeting last Thursday and uh agreed to add conditions related to increased storm water detention as well as enhanced uh erosion control measures during construction. Uh additionally the other condition that we will be adding is um you know there is this segment of uh the multi-use path that will connect to Chatter and then to our internal public street. So it's a somewhat short segment relatively speaking but uh we will be adding a condition requiring a public bike ped easement to ensure that portion is public. you know, the portion of the path within our road uh right of way will of course be public, but we want to make sure it's a continuous public connection from Chatter out to Honeyut Road. So, bike ped uh access easement as well as uh an easement for emergency services vehicles. Uh so we will be widening the easement a tad to accommodate that. Uh and then we will also have in that condition uh requirement for kind of collapsible ballards or other kind of barriers to prevent your standard vehicular traffic over that area. But of course we'll allow for emergency services to utilize that. So those are the conditions we're adding. Um and again we will be you know requesting a deferral to the June 3 uh afternoon session if that's uh the will of the council. do just want to note uh again in addition to Hannah's presentation we are preserving the falls wershed protection overlay district so maintaining that 30% imperous surface limit the 40% forestation requirement the the double width buffers along one of the stream features on our site goes from 50 on either side to 100 ft on either side uh as well as requiring the use of gsi if we exceed 24% impervious which we intend to to do so gsi will be required as part of the uh site development as well. Uh I want to acknowledge and just thank uh the leadership of the Bentree uh HOA for working with us throughout the process. Uh we have tried to be as responsive as possible to um all the comments and concerns that have been expressed uh and discussed throughout this process. Uh we feel like we've uh yeah just really appreciate them uh working with us and keeping open lines of communication. do want to highlight uh that we are consistent with the Falls Lake area plan uh density recommendation as well as use recommendations. Uh right plan suggests no new commercial uses. So we've limited our uh uses to residential and it says only up to four units per acre for residential. So we have capped uh our density at that 56 unit number which is four units per acre on site. Um so I want to respect everyone's time given that we are uh the only ones here tonight and appreciate you all being here as well. So happy to answer any questions or address any comments. Thank you councelor Silver. Well, first I want to thank you, Council Member Patton, uh, when this matter came up, expressed concern about just having more access for emergency vehicles. I concurred with that. So, I want to thank you for ensuring the easement will be wide enough. I I understand they'll probably put ballards to prevent vehicles from going through, but to have emergency access. This is really upholding public safety in case, you know, one of the other access points for whatever reason a storm, a tree goes down, it's it's it's important. So, I just want to thank you for that. Also met with uh some of the residents in Bentry and found them to be uh very easy to work with and reasonable. So, I'm glad that you were able to uh come up with conditions uh that satisfies uh the community, but more importantly uh that connection. I know they wanted badly because of the internal um environment of their subdivision, which is an older subdivision, no sidewalks. And so, I just want to thank you for accommodating them and and adding those conditions. I have no questions. Any other questions? I just have one one question. The overlay are I know the overlay is there and you're keeping it, but is this actually in the falls watershed? I've heard conflicting. No, we we are in the secondary watershed area. Okay. So, this site drains uh to the north uh eventually picks up and goes under 540. So, it does it doesn't drain directly to the news, it goes kind of directly to Falls Lake. Yeah. Okay. Um, next we do have the opposition. Uh, we have one person signed up, Graham Smith. Thank you. Um, Graham Smith 509 Vista Way here in Raleigh. I'm the chair of the stormwater management advisory commission. So, didn't really know where to opposition or in favor. Um, yet we had some really good I will uh reinforce what um Mr. Mr. Burch stated, we had a very good conversation with the applicant and the engineer on Thursday. Um we're able to talk about some of our concerns being in the secondary watershed. Um the overlay and kind of the the headwaters of of our drinking water. Um the idea of them addressing both uh storm water concerns permanently and then temporary sediment erosion control concerns. We're very happy with that. We've seen some draft conditions and we're very pleased with that. So, we're at this point have no opposition to to the presenter. Thank you. Thank you for chairing the the committee. Thanks.
