[0:57] Mayor: All right, good evening. We'll call this meeting to order for the October 23rd, 2025 Apple Valley City Council meeting. Welcome everyone. Uh, as your item is called on the agenda, we'd ask that you'd come forward to address the council at the podium. Our first item on the agenda is the pledge of allegiance. And I would ask everyone to rise and join us in the pledge.
[1:12] Council and Audience: Pledge allegiance to the flag of the United States of America and to the republic for which it stands. One nation under God, indivisible, with liberty and justice for all.
[1:32] Mayor: Next item on our agenda is to approve the agenda. And Tom, do we have any changes?
[1:36] Tom (City Administrator): Mr. Mayor, members of the council, no changes to tonight's agenda.
[1:42] Mayor: Great. Thank you. Do we have a motion to approve the agenda?

[1:52] Mayor: And opposed. All right, that item carries. The next item on our agenda is our audience participation portion of the meeting. We do have a total of 10 minutes for this item. It looks like we have somebody coming in just now. So, I will pause for just a second here. So, Christina can come up. Ma'am, ma'am, if you're going to speak, come on forward. We're ready for you. So, then you don't have to get settled and uh and make you stand right back up and come right back up. So actually as you come up to the podium that way the microphone will pick you up and anybody who is there. So for this for this section since you were just walking in right we've got a short time for this and so our practice is to take feedback but we don't make any decisions or take any action on items this evening. So I would have you start by saying your name and address for the record so Christina can record can record that and then the microphone's all yours.

[3:01] Karm Tanhoff: And what’s your address? 407 Upper. You don't have to get close. These microphones are super sensitive, so you don't have to worry about getting super close. It'll pick you up just fine. 407 Upper Woodway. Three words. Burnsville, Minnesota 55337.

[3:21] Karm Tanhoff: Um, I'd like to propose a change or addition to the animal code for the city of Apple Valley. I understand it's the city, not the county or the state. Okay. To include um right now, my understanding is that it is only most, you know, for uh service animals that they be, you know, inside the building. And I'd like to add um therapy animals and emotional support animals and other animals that are very mildnatured like kittens.
[4:02] Mayor: And is this for you said for for the city? Are you talking specific city facilities or are you talking facility?
[4:10] Karm Tanhoff: Well, any facility would be nice, too, but um I'd like especially it to include for the Apple Valley Senior Center.
[4:19] Mayor: Okay. We can we can uh talk with park and rec staff and talk about senior center.
[4:24] Karm Tanhoff: I already um just I've already been in contact with um both Sharon LMY who is the director and also uh Nate.
[4:33] Mayor: Okay. Thank you. uh just so you know when you talk about other buildings in the city there are things like health codes that come into play and we don't have necessarily control but we'll we'll we'll take it in consideration
[4:45] Karm Tanhoff: and the reason is um because I I founded and lead a pets group pets discussion group been doing that for about two and a half years and in the winter of course you know we were inside and we're talking discussing different topics about pets you know toys and grief and you know all sorts of things. But outside in the spring and summer, I've been able to get animals to um come outside and and then I was told I was allowed to if the weather was really bad, you know, like raining or snowing or, you know, not so much snow because in the winter time I don't have animals in, but you know, like rain or oh, too hot, you know, like almost 90 degrees. that's too hot for both animals and people and that I could bring them into a room that wasn't carpeted. Um and and then lately I've been told um by both Sharon and Nate that that um we have to go by the city code which is only service animals. And I said, "Well, that doesn't really include kines." And both of us are book, you know, we book kines. When I book kines, I um you know, have them come in and they, you know, they're able to um the attendees are able to pet the canines.
[6:10] Mayor: So, just so I understand the request and just so you know, we're not prepared to discuss this in detail tonight. We don't have the city code in front of us. We don't have the people here we need. But so just so I understand your request, it's to modify the code andor the rules around city facilities or park facilities that would allow more animals in for different purposes.
[6:29] Karm Tanhoff: Yeah. I mean, right now it's basically I don't think people really understand the difference between a service animal, which is mostly just for
[6:38] Mayor: So I'm going to just pause you for a second. I think we understand what the ask is.
[6:41] Karm Tanhoff: Okay.
[6:42] Mayor: We're not prepared to discuss all the ins and outs tonight. This isn't the forum for that. I I think it's key to understand what the differences are. Understand, but we're not we're not prepared to have that discussion tonight. None of us when something walks in, right? We need to be ready to have a conversation. You know, all of your pieces you want to talk about. We don't have any understanding of city code right now. So, we're not in a position to help you understand why those decisions were made, what what health codes may come into place like a senior center, those kind of things. Mhm. So, which is why we just can't take issues that come in and make a decision on them because we don't clearly have all the facts. I think we understand I'm looking at nods here. I think everybody kind of understands what the concern is and that you'd like to have more than just service animals in the building for not just reasons of your group but right for other people as well and we can take that into consideration, understand what we need to and talk about it.
[7:32] Karm Tanhoff: Yeah. right now, you know, uh, recently it was amended to say that, um, that I could still have the animals outside, you know, and mostly bring in cats and dogs, but we were going to recently have the Minnesota Zoom mobilebile come, but that didn't work out because they have kind of a rule of their own that the temperature has to be 60° to have the animals outside, and they didn't, of course, want them inside. And, um, we're going to have like an armadillo and a turtle. So, so I think we I think we understand I think we understand the ask. So, I'm I'm going to just But it didn't work out because it was too um cold and we missed it by a few degrees.
[8:10] Mayor: Understand? I I think we have what we need. So, thank you.
[8:13] Karm Tanhoff: Oh, one more thing too. Another reason for it is to be able to come inside is because some of the people like especially um I know one woman who's come a couple times and she's she has a therapy dog and she has to take time off work to come to our volunteer organization and you know talk to the pets group. So that's another reason
[8:35] Mayor: we understand the request. Okay. So we will we will look at it. We understand the value of having animals there. Um, I know a lot of the therapy dog volunteers myself, so I understand the value of that. So, we're not saying it doesn't have value. I'm just saying we're not equipped to discuss it further uh this evening. So, we will take it into advisement and
[8:53] Karm Tanhoff: basically to just edit or revise or add other types of animals.

[9:05] Council Member Bergman: I mean, I had an experience this weekend. family members cat I mean alert all allergies I mean like locks up and can't even breathe so I mean I think we have to take some of that into consideration also
[9:17] Mayor: I before we change any ordinance or rule I want to understand why we made the rule or the ordinance in the first place right so that's part of it so thank you anyone else that would like to speak for the audience participation portion all right seeing none we'll move on to our consent agenda and these are items that are considered routine and will be enacted with a single motion unless a council member or citizen request to pull an item. [10:14] Christina (City Staff): Good evening, mayor and city council. Brick and Bourbon Apple Valley LLC has applied for an on-sale liquor and Sunday license. Um a notice of public hearing has been published as required by city code. The police department and fire department have conduct conducted investigations and found no reason to deny the license. So tonight we are requesting that you hold the public hearing um take action on the resolution approving the um liquor licenses and then we have Gary Seir here from um Brick and Bourbon who can um can let us know about his restaurant, introduce himself to the community and I'm available for any questions of course.
[10:48] Mayor: Right, let's start with any questions for Christina. All right, if not we'll we'll hold the public hearing then we'll take action and then we'll invite our applicant up to introduce himself. So, we'll go ahead and open the public hearing for the Brick and Bourbon Apple Valley LLC liquor license. Anyone who would like to speak to this item? Anyone who would like to speak to the public hearing? One last opportunity. We will close the public hearing. And do we have a motion to adopt the resolution approving the issuance of the on sale intoxicating liquor and special license for Sunday liquor sales?

[11:47] Gary Seir: Oh, it depends on today. Um we're hoping to open in the next uh week or two. Um obviously it's all dependent upon what happened this evening. Um I just want to personally express my uh thanks to the city and the community for helping us during our buildout. We're super excited to be here. Uh I am a past resident of Apple Valley. I currently live in Farmington. So it's myself, my other business partner. We're all local. So this will be our fifth uh brick and bourbon and uh we are a scratch kitchen craft cocktail establishment. Um, you know, we have legendary service and we're hoping to just add to the amazing dining options that are in the city and be a part of the community um here and into the future and, you know, kind of bring some stability to that uh building that I know has had a couple different entities inside. Um, but my personal excitement, I live eight minutes away, so I'm beyond excited to open. So, give us a week or two and we'll be happy to have you.

I know you mentioned as we were chatting before, you've had many people come rattle your doors and uh a day try to come in in the middle of your setting up. [13:06] Mayor: Thank you. That brings us to staff and council communication items. And Tom, do we have anything?
[13:10] Tom (City Administrator): Mr. Mayor, Chief Francis would like to come on up and give us one more advertisement for the upcoming trunk or treat.
[13:18] Mayor: Or should we say one more knockknock joke?
[13:21] Chief Francis: Yes. All right. Knock-knock.
[13:22] Mayor: Who's there?
[13:23] Chief Francis: Yeah.
[13:24] Mayor: Yahoo.
[13:25] Chief Francis: I'm really excited too about trunk or treat, which is going to take off this weekend here. Uh, this is the last and final call. So, uh, Saturday the 25th from 11 to 1, we will be down in the Splash Valley parking lot area. Weather looks really good. um maybe a little overcast, but 50 degrees just your perfect fall day. Um and we also remind people like we do with the um recycling day and garbage drop off, you don't need to be there early. If you show up 10 or 15 minutes after it starts, there's less of a line. You can kind of get going right away. So, the biggest line of the day will be right, you know, at at 10:45 or 10:50. Uh you show up a little bit later and there will be um plenty of room to move around. So, we're looking forward to it. It's always uh a fun event. Um all sorts of city staff will be there um supporting businesses, a lot of our public safety partners. Um so, we're looking forward to it. Saturday, 11 to1 at Splash Valley.

[14:17] Tom (City Administrator): Thanks, Mr. Mayor, I could mention that after Halloween is over and you have the pumpkin sitting on your patio and you don't know what to do with that, uh we do have an opportunity this year for the pumpkin composting event. Uh that will take place November 1st and 2nd at Apple Valley Maintenance Facility on 150th Street. So just a word out there that don't put the pumpkin in the trash, take it here and we'll have it properly composted.
[14:45] Council Member Heert: The date again?
[14:47] Tom (City Administrator): November 1st and 2nd at the at the maintenance facility in 140th. And is that correct? That's correct. 6442 140th Street, C address.
[15:02] Mayor: Wonderful. Thank you. Any other items from staff? I would just add that we all just left a uh a couple ribbon cutings for the Goodwin pickle ball complex as well as the new skate park. Um skate park was not staged. We probably had 50 skateboarders out there uh riding around in the background as we cut that ribbon and they were all super excited to be there. And yeah, as I told several people, I was surprised how quickly that came up on the list of things people wanted as we did that early early surveying. And I think that crowd tells you that that uh that was an investment that is going to is going to get well used over the years right there. So, and it was it was good to see council member Goodwin as well and his wife tonight as we as we got to dedicate that pickle ball complex. So, thanks to staff and park and rec committee for their work and getting all of that here and just even getting tonight's events. I have a feeling there was a little extra work here in the last few days just to get all that show ready for this evening. So, thanks for making that work. Anything else from uh council members, do you have anything else? You you were leaning forward. I thought you had something last minute to sneak in there. So, gotcha. Um All right. How about the calendar of upcoming events? Our city offices are closed Tuesday, November 11th, 2025 in honor of Veterans Day. And our next informal city council meeting is Thursday, November 13th at 5:30. And our next regular city council meeting is Thursday, November 13th at 7.
