[0:00] Chair Rody: All right, we'll call the meeting to order. On behalf of the planning commission, I'd like to welcome our residents and viewers to this regular meeting of January 13, 2026. On tonight's agenda, we have one discussion item. Uh before we get into that, we have one housekeeping item, and that would be the minutes from our December 9th, 2025 regular meeting. Are there any additions or corrections to those minutes? If not, is there a motion? [0:39] Commissioner: Motion to approve. [0:39] Chair Rody: Have a motion for approval. Is there a second? This is the final plat for Dakota Meadows Preserve, second edition, and this is located just south of Dakota Electric. Tony, you're going to take this? [0:58] Tony: I will. Thank you, Mr. Chair, Commission members. Yes. Before you this evening is the final plat for Dakota Meadows Preserve, second edition. Uh, as Chair Rody had mentioned, this development is generally located towards the southeastern intersection of Denmark Avenue and 220th Street West, uh, just south of the Dakota Electric Facility and west of the fairgrounds. Uh the second edition final plat consists of 46 single family lots. The lots are part of the uh 134 overall single family lots that were approved with the preliminary plat. Um 42 of those lots uh of those 134 were approved with the first edition uh last year. Uh the second edition final plat does correspond with the preliminary plat which was approved by the planning commission on April 8th of 2025 and then subsequently the city council on the uh 21st of April of 25 as well. Lot sizes in the development range from 4,261 square ft up to 7,182 ft in size. And that is just for the lots within this particular uh second edition. The average lot area is 5,219 square feet with a minimum lot width of 40 ft. Just as a reminder, this was done as a or approved as a planned unit development for those uh certain deviations. As far as setbacks, uh same as with the first edition, the front yard setback is 20 feet with a 25 foot uh setback along a sidewalk side, a rear yard setback of 6 feet, sideyard interior setback of 5t, and sideyard corner of 15 ft. There are five outlots with this particular final plat, and they're labeled A through E on uh the plat document itself. Outlot A is a combination of storm water ponding and trail corridor. Outlot B is a remnant parcel and trail corridor. Out lot C, combination of storm water ponding and trail. Outlot D, future development phases. And out lot E is a remnant parcel and trail corridor. Out lots A and C will be deed to the city with this final plat. Uh this is just a representation of the final plat uh showing the general layout and extension of uh roads and lots within the development. As far as transportation and access, 223rd Street uh west will be extended to the east and tie into Deep Water Path at intersection. Deep Water Path will then extend north and south to provide future access to the adjoining property to the north and provide access for additional development phases. uh to the south. The roadway width within the development is 60 ft wide and then the uh or the right ofway width, excuse me, is 60 ft wide with a roadway width of 29 ft. Parks, trails, and sidewalks. Uh as with the first edition, we will take cash in lie of park dedication. Uh the park that will service this development is the Westview Acre Acres Park, which is uh a little bit north of this development. A five foot wide sidewalk will be constructed on the north side of 223rd Street West and on the west side of Deep Water Path. And then there will be 8 foot wide Buminous path that will be constructed between lots eight and nine block one. And then that trail will then extend northwesterly from or extend northwesterly from the sidewalk in 223rd Street West. And then it will follow that northern property boundary up to Ash Street. Uh if you'll recall, we had a a pretty big discussion on that with the preliminary plat a year ago. Um and this is in um alignment with what the park and recck commission had uh requested. The engineering engineering department, excuse me, has reviewed the de the uh Dakota Meadows preserve second edition final plat and recommend approval upon satisfaction of all engineering comments related to construction plans for grading utilities as well as the applicant entering into a development contract with the city and all security fees and cost paid. Therefore, the action as requested this evening is to recommend approval of the Dakota Meadows Preserve second edition final plat contingent upon the following and forward that recommendation on to the city council. Uh there are two uh contingencies. The first being satisfaction of all engineering comments related to construction plans for grading and utilities. And number two, a development contract between the developer and city of Farmington shall be executed and security fees and costs shall be paid. Submission of all other documents required under the development contract shall be required. [5:51] Chair Rody: All right. Thank you, Tony. With us tonight is a representative of the developer, John. Anything to add to the staff report? [5:54] John (Developer): Yeah. Uh good evening. So, uh we have the second phase of Dakota Preserve um uh here before you tonight for the final plat. Uh last year we did the first edition, platted the 42 lots, constructed the streets and they actually have 18 houses under construction already in that first phase. So they are moving along pretty well. Uh that phase also uh finalized the connection into the Dakota town homes to the north of us. So their temporary access was removed late last fall and has now been restored with SAD and their access comes through our development which was initially planned for when they went through prior to us coming along. So all that's been taken care of. I think pretty much everything's done in that first edition other than the wear course and some uh trees in the ponding areas which will go in this spring, early summer sometime. So, um tonight we have 46 additional lots here for the final plat. Um we have no issues with any of the requirements or conditions. I know there was a set of engineering comments that we received here late last year which we have responded to and actually resubmitted plans. I have not seen any re uh final response from that, but we should be pretty close to having the plans constructed. We do have the site ready to go for grading first thing in the spring. Uh there has been some minor grading in some of the areas already with the pond work out there and things of that nature. And once it's graded, we are going to go right into building the utilities and streets in this phase. Um as I mentioned, that's out for bid right now. So, we should have our bids back here in a couple weeks and uh probably look to schedule a pre-construction meeting, you know, maybe March sometime for the streets and utilities and have that ready to go. And other than that, everything's been going along pretty well out there. So, [7:40] Chair Rody: sounds good. If you can stay available for questions, Commissioner Tesy. [7:40] Commissioner Tesy: Uh, yeah, I don't have any questions. It corresponds to what we've what we reviewed originally. So, [7:40] Chair Rody: Commissioner Winshidle. [7:40] Commissioner Bird: Yeah, like everyone said, it looks like what we've talked about previously. Any thoughts on outlaw D as far as timing when you may or may not move forward with [8:16] John (Developer): uh yeah outlaw D would be the uh third phase and that's another 46 lots and that would plat all the lots in the current plumary plat and our plan would be do do that sometime like next winter like this and then construct that in 2027. [8:16] Commissioner Bird: Yeah. Great. Sounds [8:16] John (Developer): based on the current schedule we have. [8:16] Commissioner Bird: Yeah. Everything else depending right. [8:16] John (Developer): Yeah. Absolutely. [8:16] Chair Rody: Okay. Great. Sounds good. John, thank you. you went through the timing of when you're going to find development. I appreciate that. Have you had any dewatering issues? [9:02] John (Developer): Uh, no. We did dewater last year. Uh, we the sewer is deep with our connection into the Dakota town homes. So, we do have to continue to dewater for that to keep it deep so it can service properties to the south potentially to the north. Uh, also the the pond in the middle. We did construct or build that pond to some extent, but we didn't dewater for that pond last year. So, we dug it down as deep as we could. Uh we can probably go deeper yet before we need to dewater, but when we start grading out there, um we will dewater for that pond to get that down to a deeper depth. And that fill is what's going to be used to raise up the streets and the building pads. But uh the dewatering we did last summer, we've had no issues that I'm aware of. So, [9:02] Chair Rody: and you mentioned about using the the spoils or the the soil from the pond. Can you remind us how deep you're going with that? [9:02] John (Developer): Uh they're going to go as deep as they need to to balance the site. So, we're projecting somewhere in that 35 ft. [9:18] Chair Rody: That's what I remember. Something of that nature. [9:18] John (Developer): very similar when we did the Sapphire Lake p uh big pond in the middle out there, which turned out to be a nice amenity for that community. This will be very similar to that. So, [9:18] Chair Rody: okay. [9:18] John (Developer): Same type of soils. It's real sandy and uh you know, nice sand soil out there. [9:34] Chair Rody: Okay, good. And you had mentioned in your discussion that you uh [clears throat] agree to the conditions that's in the staff report, [9:34] John (Developer): correct? Yes, everything in there we're fine with. Uh we had no issues with any of the engineering comments. Uh we did just get the development agreement. I mentioned to Tony, there's a couple things that I'll address, but it's not it's more just addressing the development agreement type. [9:54] Chair Rody: Yeah, we don't we don't deal with the development [laughter] city council. So, [9:54] John (Developer): Yep. So, other than that, everything's pretty straightforward and like I said, things have gone pretty well out there. So, [9:54] Chair Rody: yeah, we appreciate that. Was there anything else from the commission? If not, then we'd look for a motion. This will be a recommendation to our city council on the final plat of Dakota Meadows Preserve, second edition with the two contingencies as agreed to with the developer. Is there a motion? [10:50] Tony: I will I will thank you uh Mr. Chair. I am saddened to say that we will be losing two of our commission members. This is their last meeting. Um we have uh Commissioner Tesy who has been with us since 2018 and has been vice chair since 2022 and Mitch Snowbeck who has been with us since uh beginning of 2024. um would just like to wish them both well and thank you both for your time, energy, and just common sense that you brought to this commission. Um with that, I do have certificates of appreciation. [11:32] Commissioner Tesy: Thank you very much. [11:32] Commissioner Snowback: Thank you very much. [11:32] Tony: That's all I have. [11:32] Chair Rody: All right. Thank you, Tony. They don't get out this easy, though. No. And I, you know, I I appreciate you both. Um, I'll start with Mitch. Um, just a few comments. I've written them down. You've been a quick learner. I suspect that's the educator and you coming out. Um, you know, maybe your experience on the waterboard or probably your experience on the waterboard has helped you inform this commission. Um, give us some knowledge and what we should look for. and you asked some great questions in that regard. Um, and I suspect you're going back to the water board and you're going to do a great job there also. And I just want to thank you for your service and dedication to the residents of our community. [12:18] Commissioner Snowback: Appreciate it. Thank you. [applause] [12:18] Chair Rody: This one's a harder one. [laughter] Um, we've been through a lot together, you and I. [12:37] Commissioner Tesy: Yeah. [12:37] Chair Rody: Um, a lot of public hearings. Some short, some not so short, some pretty intense. [12:37] Commissioner Tesy: Mhm. [12:37] Chair Rody: Um, you've always handled yourself extremely well. Anytime you've spoken with a resident of our community, you you've made it like a conversation with them. You've put them at ease. Um, your knowledge and your intelligence, have helped this commission in building and building type issues, and we appreciate that. Um, it's been an honor to serve with you. [13:04] Commissioner Tesy: Thank you. [13:04] Chair Rody: Um, I want to thank you for your service and dedication to the residents of our community. I'll miss you.
