yes well CH yes very good and that's that's it for the housekeeping and okay we we'll move on to the uh bottom of page two everything's on the first reading tonight and the first piece piece of legislation we have is ordinance number 2023-24 it's an ordinance accepting the proposal of pen Care Incorporated to remount the fire department's 2016 Brun ambulance in an amount not to exceed 235,000 987 and chief I see you were here Chief excuse me Jack are you leaving are you leaving I was going oh did you want me to sign something no no no it's okay I apologize I thought I want to make okay I just want to make sure okay mer Christmas thank you uh Chief would you like to explain that we've gotten your memo yeah um so uh the vehicle that we are um going to remount uh this project is due in 25 but the build per period is about 2 to 2 and a/2 years so we want to get the project going or get in line to have this accomplished uh essentially uh back in 2016 we started getting uh Vehicles manufactured by Brun and they build a box that is very strong very durable lifetime warranty so at that time we we envisioned uh this vehicle being remounted so essentially what we're going to do is take the old chassis out from under it put a new chassis on it um update anything that needs to be updated and repaired and then we'll have a essentially a new ambulance coming in uh this is done at a reduced cost because we're reusing the Box um new squads now take up to three years to manufacture and they were probably about $100,000 more uh this this project does fit the funding that we had earmarked for it other than the fact that we're having to pull the trigger two and a half years early uh because of the build times that are out there now so um we are seeing cost reductions uh in terms of what we're doing with this remount um the other good thing is that the chassis that's being taken off is a four-wheel drive chassis which then can be reused by the rec department or service department to plow or do whatever they want with on that because it is four-wheel drive so uh Braun will be doing this work for us uh at that cost is there any other questions this includes the new chassis too correct yes this includes the new chassis however uh in this contract they do kind of leave it open if the chass cost increase over those twoe periods we might have to come back because of that and there is a $5,000 amount in here contingency if they start taking the vehicle apart and find something that is damaged or should be replaced there's a little bit of money in there to work with on that because we're basically taking apart a eight-year-old vehicle and is that chassis ordered yet um they will order that chassis um when it they get closer to the build time so once we get in line for a build and they get closer to Manufacturing it um what they'll do is we'll continue to use that vehicle for the next year and a half to two years and then when they be four mons out they'll call for it we'll send the the squad away and it'll come back as a new vehicle within four months so so this locks in our price with the contingency for just remounting but we don't know what the price of the chassis is going to be the price of the chassis is actually in here um it's just that if it ends up going up by x amount then we'd have to maybe increase it by that that much and then B currently that we have $195,000 in incumbrances and uh we'll have to use a I guess a current capital po that'll make up the other 41,000 that's correct in Chief uh in the memo attached to this legislation it reads following the delivery of this new unit our old ambulance will be sold at auction if not needed elsewhere we will also receive our 2016 for F450 chassity back so you know what I think I I had that um I was thinking of the uh the current ambulance we have because we are taking delivery of our another ambulance this month uh that's being built by Bron so that was probably just a Mis thought on my part okay so we're not going to be down an ambulance no no no the way this works out with the remounts we'll be using it up till that period where they call for it and then we we send it in so and then on the line above that it says that there's a monthly increase in material cost of about3 ,000 that's what they're that's what they're telling me U because I knew you know towards the end of the year if we get into January there's always usually an automatic increase in addition to any cost but they're saying this the parts and stuff that they are required for these vehicles and that's one of the reasons there's such a long build period um they they're going up they keep going up so this will lock Us in on on most of the equipment on the vehicle with the exception of the chassis which um I'm sure Dennis can tell you that even on the uh Ford SUVs were we're taking a shot at what they're going to cost but that could change too and do we anticipate reusing this 2016 chassis somewhere in the service I would recommend it I mean it uh it would still serve them well as a plow truck or something like that and see uh by going this method and everything how much are we actually you know saving then then going just getting a brand new I I don't have the exact figure but I I think approximately $100,000 mhm plus 3,000 bucks a month for another 18 months so another $48,000 yeah yeah I I don't like what's going on with this how these vehicles take so long to to be manufactured because our projections on our F Capital tend to end right when the year that you're due and you know in the old days the build times were 10 months to 12 months maybe 14 at the most but now we're out you know 24 to 30 months uh in an engine right now is 4 for four years you know if you order a ladder truck it could be up to four years the technology changes and they're just guessing at the cost at that point believable so seems to be a common theme with our service dep BR with the trucks around that and vehicles and the same way with the police it's just the way of the way of the economy right now with this country uh any other questions for chief R any opposition putting this on the consent agenda this evening uh de we will place this ordinance on the consent agenda we move to uh page three of the uh uh agenda and that's um ordinance 223-2823 d81 authorizing an increase in the amount of funds requested from $4,180 to an amount not to exceed 43821 4 regarding the purchase and delivery of of a utility terrain vehicle accessories and patient caring unit for the fire department uh and I guess uh this just amend this uh Steve just for the increased price yeah we um we're going to try to mount some lights on it ourselves but in the end we just the thought was just have it professionally done because there was a little bit more to it than we thought so we had gotten a quote from Hall Public Safety does a lot of work for us um and so essentially we're just increasing it by the amount needed there uh to cover that we currently have a purchase order that's associated with this project that we won't have to allocate new funds or encumber new funds it just we needed to increase the not to exceed amount in order to make it acceptable any questions for Steve on this one put this on the consent agenda this evening we move to ordinance number 20 23-01 29 it's an ordinance authorizing the mayor to enter into an agreement with noek to receive energized Community grants for 2023 and Dennis you You' given us your memo on this everyone uh this ordinance will allow the city to accept the 2023 Grant from milc uh the grant is for $ 22,25 we are still part of the N community so we are entitled this money it's just uh a requirement for us to accept the money from thank you Den any questions for Dennis on this uh Jim sometimes we we designate funds towards certain causes has that been T discussed with the these grants as yet yeah there's liit of things that it could be used for anything that is uh energy efficient you know like in the past we used it for the tree lighting and things that the community would benefit the next one uh we have your memo also this is ordinance number 20 23-13 it's ordinance authorizing the installation of d sted City graphics on City vehicles and about not see $2,230 and I guess these are uh not these aren't not police vehicles or what they're other yes these are all the non-emergency Vehicles these are the vehicles used by the various departments uh we did attempt to reach out to other vendors to supply this service but uh it's it's a unique service we dealt with the classic designed in the past classic will come on site and install the uh new uh markings uh and it's it's kind of limited by the uh conditions weather conditions and everything that they're outside so this might not move forward till you know the weather would break but uh we'd like to get this scheduled so we can you know move forward within new graphing I guess this includes 16 additional decals for for future vehicles and that yes that's correct the the service director requested a couple extra you know details and markings uh should the need arise uh and it's the most effective way to buy them at this point in time we discussed with the vendor thank you Dennis any questions for Dennis on this hi Jim hi J yeah so it it just seems like I thought when we when we put a we bought a new vehicle we were going to be putting the new branding on but with with this we be using putting them on current Vehicles yes it's going on current vehicles I think it seems like there's a schedule should have been attached on the back that has a schedule the vehicle the different departments and what size marking and decal go on that I think half the money is is to take the old decals off correct and put the new ones on that's half of it that's I guess I thought we were going to try to do it where we had just when a new vehicle came in I mean it still says the city been dependence on it just seems like a lot of money for what we're getting here and do we anticipate doing the police vehicles in the future or those how are those going to be handled yeah I think that that is something that's down Road that's going to be considered I had spoke to all about that uh earlier today and that was a plan for that I think had the most effect out of the new branding the thought process here was to VI all the vehicles at at one time so we're not mixing old with the new any other questions for and there were no other companies that were able to quote this no no not they could do it under our time constraints and they had the expertise with these guys have and they were willing to come on site and do it that was the big and what is our time constraint how long do they have many of these veh companies were looking at doing things come you know in the spring when weather breaks because they don't have the facilities to do them a lot of them do just like one offs type things this is a a pretty big project fire department's used them in the past have been very happy with the results according to the chief yeah we've been we've been using them since I think 2012 um and I just know talking to other Chiefs you know there are people out there that do these Services a lot cheaper but in the end you know they start having problems with them um these guys are pretty professional they know how and when to put it on properly that's going to stay on there and there's a lot of prep work on the vehicle as well um but they have come out and done them in our Bay U they also have a new facility that they might be able to accommodate them there I don't know but um that they we've been very satisfied with the the decaling we've had um some of the vehicles that I'm replacing have the still have the decals on them and they're looking good and and they're holding up so uh that's what I can say about that any other questions or comments what is the thought about putting this on the consent agenda do you want to vote on it separately I'd like to vote on it separately I de you we we'll vote on this uh ordinance uh separately than you up for 131 very good now we're at the on page four there the top of page four ordinance number 2023 d131 uh it's an ordinance accepting the bid of Petroleum Traders Corporation and ports petroleum company Inc for the purchase and delivery of unlet fuel and diesel fuel for City vehicles through the joint Municipal Improvement consort now both of them going to be on there I just thought maybe when I was looking at the uh uh docent it looked like it was just going to be ports petroleum but this has both companies on there that's correct I think it was amended it was amended this morning uh the legal department inadvertently put on the other oh so it's only supposed to be ports that's what I thought I I was wondering why both companies were on there when everything pointed to to Ports being the the so go ahead Dennis Okay the reason for was chosen they offer tank wagon delivery the other vendors required a full tanker which is 7500 gallons director McKinley doesn't like to run we could take a full tanker but we would have to empty the you the holding tanks just about you know completely and uh you know director M Kinley doesn't feel like that's a prudent way to work because you know something come up and there' be a delay or something you know we would forc to get fuel somewhere else so we have flexibility we still take a tanker though we yes that's correct so we have some flexibility with this accepting it with these conditions correct that's correct in in the past just for some numbers in case someone wondering how uh this Diesel and a had gone in the past 2020 we spent uh 200,000 2021 240,000 2022 we spent $410,000 uh this year as of today we've spent $295,000 so it has come down it's come down from the year before the high of our year and a yeah Debbie do we need to amend this uh the title since it's incorrect on the agenda actually it it is we correct we correct okay any other questions for Dennis on this we've been working with this Consortium for many many years yes Cor Dennis besides price are we monitoring uh actually gallons utilization or uh within the service department or you mean the vehicle use or vehicle yeah yeah so the guys do have a code um it's a personal code it's not a vehicle code we can't monitor per vehicle but we do monitor throughout the year as to the gallons that we use yes any other questions any opposition to putting this on the consent agenda we will put this on the consent agenda thank you very much D we move on to ordinance 2023-24 23 and 32134 uh Vern thank you vice mayor typical legislation most of you have seen it before it just allows the county to advance the property tax collections to various municipalities prior to waiting for the entire collection for the first half or the second half of the year to come in so we get the same amount of money in the long run this just allows the county to advance it a little bit ahead of waiting for all of it thank you Vern any other questions of our finance director as ver say this is a ritual this is on the December agenda every year and so no opposition putting this on the consent agenda thank you very we move to ordinance number 2023 d133 this is ordinance imposing a moratorium on the accepting of applications and or granting of building permits or certificates of occupancy for any building structure use or change of use that would enable the cul cultivation processing sale and purchase of recreational marijuana for a period not to exceed 180 days and I believe mayor I know Lakewood they made it was on the news a few other communities have gone so I imagine most of the communities are going this route y until we see what the state's going to do and I don't Mike I don't know if you have any I think your name was on the but I don't know if you had anything to add to this yeah thank you vice mayor this is uh very similar to what we did a few months back with the electric vehicle charging stations we just put it on hold until we were able to figure out how we wanted to address it and uh uh process any type of thing like that we do have a a Prohibition on any medical marijuana facilities or use that type of thing already in our ordinances that uh was put into play uh when that issue uh came in to uh arose and was permitted so this we're just B basically following uh that suit to see how we're going to react to this thank you Mike is that cannabis college or is that still an indep yes that's yeah that's I think they were they were located on Granger yes they're still still in grer any questions for either Mike on that or our our law director here it makes perfect sense as far as with a new legislation like this just to get our bearing straight uh um any opposition putting this on the consent agenda this evening I just have one quick question about it and then just out of curiosity because there's been no um uh enabling legislation enacted and the Constitutional Amendment took place on the or on the 7th um do we have a policy in place in the interim period for how you know because the you know like smoking in public uh for cigarette smoking that's not legal but for for marijuana it might be legal I don't know do we are we considering that thank you councilman um so you cannot smoke marijuana in public uh remember when this law was passed it was under the same impression of alcohol usage just much like you can't open a bottle of vodka and drink that on the side of the street you can't smoke marijuana if you are smoking marijuana in the city of Independence and we get a complaint of that we would stop that individual site them for disorderly conduct minor misdemeanor causing annoyance or alarm to others seize the marijuana and and uh you know issue that citation as necessary uh it should be noted that marijuana is not able to be legally purchased in the state of Ohio still as there has not been anything passed nobody's received a license the only way you can purchase it is your medical marijuana if you have a medical ID card so if somebody is transporting marijuana they have obtained that in legal fashion in the state of Ohio so I've met with our prosecutor we've had multiple conversations on this uh we are prepared at this point and if somebody's driving Under the Influence we're also prepared to take care of that so um until further has uh been discussed with the Senate who attempted to pass something and the house is not choosing to address that until uh early next year yeah uh we are prepared where it is at currently to enforce the laws and keep our residents safe marvelous thank you Chief one other quick thing on that um it's also illegal federally to pay for Mar with money cash money correct I'm sorry it's illegal Cas correct you have to use cash you can't use credit cards I would have to look into that further yes most of the transactions are done with cash that is why they are heavy cash business I know the answer to this good so uh you can't use it with a credit card that's on a a federally Chartered Bank but if you had a credit card that is a State Credit Union you could buy whether or not a dispensary will accept that but all the um cultivators all the manufacturers right now are even despite the uh there's two US attorney opinions saying that we're not going to enforce the law for banking most National Banks refuse to accept deposits from Cannabis organizations or anyone affiliated with cannabis organizations so right now every single medical uh dispensary cultivator and processor all funnel their money through State chartered Banks they keep a lot of cash on hand and a lot of safes this is what leads to others uh issues with entrepreneurial activity and the state chartered banks are making a killing on the premiums they're charging to accept that cash thank you and then Chief I can imagine now if someone gets pulled over you know we have the open container law as far as with alcohol or but now if you see a a a a smoked you know marijuana joint and everything and the person's driving erratically or that is that all goes towards the facts of driving in the influence yes after the day after the law pass we arrested somebody for driving under the influence of marijuana um we I am a drug recognition expert which is uh there's only 200 of us in the state that can test for this but we do have over 10 officers that uh have further training on identifying somebody that is under the influence of this and we have another officer that's going in January to drug recognition expert school so somebody's driving Under the Influence we know that there's Key signs smell could be one of those but if they're using gummies or anything else there's other aspects of the person that we are looking for bloodshot eyes behaviors that the officers are trained to look for and to take these people off the street before they put somebody uh at risk thank you I can imagine our insurance is going to be going up uh the next year too just just from what's happened in other jurisdictions uh any opposition to putting this on the consent agenda we will put ordinance 20231 133 on the consent agenda uh ordinance number 2023-24 uh this is an ordinance authorizing the mayor to enter into an agreement with the village of Valley View to share Municipal income and property tax on specific property traversing both municipalities adjust this this came up uh in Planning Commission uh and was approved Planning Commission approved as did the Valley View Planning Commission approved uh the um uh project and I think the the name of the uh project I refresh yes project what's unique about this is the project straddles both the city of independent and the vill property lines so uh the village and the city got together to make a better project for everyone came to the consensus that perhaps a revenue sharing agreement would be the best way to handle a situation uh to divise the taxes both property and income tax uh so this this agreement was also before the village of Val they have approved it subject toity approving it and it's a 7030 split as far as tax tax and just iide the 80% of this is in the is in Valley View's territory 20% in in Independence and I think just that last building is the only one that the building is so when they when they look at the the site plan for the project uh there's three buildings that would be constructed one is a for Bronco experience Center the other is a regular board dealership and the third is a commercial truck that third building would be the one that would be partially in city of the other two will be in Valley and uh U but but another caveat on this too is that our building department Mike your your department is going to handle all the inspections and the approval uh the permitting and everything on this project yes vice mayor uh the village of Val view does not have a commercial building department therefore any commercial uh Construction in their Village has to go through the State of Ohio's building department uh which can be very cumbersome at times go uh so we were able to put together an agreement which will be in the next ordinance uh that the May can enter into with the Ohio Department of Commerce uh acknowledging the fact that the city of Independence uh building department will handle all of the construction details I see and also our engineering is that correct M Don will be I think combination of Don RAM and the village engineer will work together what our village department is going to handle exclusively right very good you know just to recap the entire process that uh met with Valley View basically what this agreement does is take away ambiguity or uncertainty or uh the attempt to put one building in a village or one in the city and what our goal was to maximize the use of the proper property by the by the uh vendor or the the owner and not have to worry about the abstract boundaries that the river created 100 200 years ago so uh we entered an agreement a 7030 split for both income tax and property tax and uh thought that that would be in everyone's best interest we have a good relationship with the village and so the thought was let's just come up with something that's fair to both communities and that uh we could go forward on jointly and optimize the use of the property rather than worrying about where the corporate boundary was and may You' be applauded for that me that really makes sense to instead of having and I know the Valley Ford people at the planning we're very satisfied with how this worked out I mean they couldn't have been happier as far as from the project standpoint the other thing I read in the agreement talks about the potential of Tiff financing for this too uh uh uh Jessica so I you know hopefully that'll be a possibility where both communities have Tiff revenue from this also work theage and obviously on our to theun very good any questions for Jess John real quick you said uh I guess just about the project three buildings is essentially dealerships so one is a Ford Bronco experience Center so you're for Bronco accessories here at Bronco purchase them at this facility the second is a regular for dealership and then the third is the commercial building and then I didn't follow what is the payment schedule exhibit B that's listed in here it's a talks about1 $150,000 payment schedule I didn't understand what that was for is that like a reimburse for the uh inspections what is that it's a 5.26% interest rate it's page 102 of our 180 page packet I it's l it's listed as exhibit B in the agreement is for the uh is the building department and the uh amount paid design and construction of the property it's approved by the state of Ohio authorizing the city of independent building department official relative to design and construction of the property they have their own schedule Mike I've never is that part of the agreement yeah well I I take it as a reimbursable anyway section five in the ordinance talks about in the agreement talks about um in accordance with powers and Authority provided by the state of Ohio to the city as set forth in exhibit B I wonder if uh a mistaken document got thrown into this legislation and marked exhibit B um because this doesn't describe powers and Authority provided by the state of Ohio this is a financing schedule was supposed to be the memor uh memorandum of understanding state in the uh City yes which is on tonight's agenda yes exhibit B is supposed to be the mou between the state and the city yeah I have I have no idea what that exhibit B is in the legislation I've never seen it before so it's it's a at the very least a scrib error that shouldn't be in there and has no relevance to the ordinances presented to council do we need to make a motion to remove this exhibit B you can just be on the safe side uh but I've never even in our conversations like of you I think the better course to remove it maybe yeah let's do it let's just remove always add it something remove exhibit B make that motion amended I I just talk about the other one yes the ordinance number 2023-the the mayor to enter into a memorandum of understanding with the Ohio Department of Commerce Division of industrial compliance in connection with the Ford Pro Elite project and I think that's what was discussed I think Mike that you had mentioned that yes that uh the document that's in this uh the memorandum understanding in this uh uh supporting documentation is actually the agreement that should be exhibit B uh for the previous ordinance this lays out the the uh six Parcels that are involved in the project um the limitations that the city has and the authority that the city has uh for uh to serve as the authority with jurisdiction in the in the above uh reference project of Ford Pro Elite project on Canal I any question any questions for Michael how do we um maybe Vern it's a question I mean property tax is going to go through the county we'll get 30% of our rate is independent commercial rate different than Valley View yes just by reading it it's unclear whether valy view is going to get 100% of the property tax payments and then send us a check for 30% of that amount or if the county will allocate it between the village and the city uh by paral it it's it's going to be pretty complicated if you got three buildings spread over multiple Parcels either way yeah most of the two of the buildings are completely inval you CH mik plus a tiff component potential reimbursed for expense right for yeah I just want to make sure that we're going to be reimbursed for all our expenses as part of that inspection process both engineering and uh building department correct this this U memorandum understanding gives us the full authority to charge our usual and customary fees for permit expenses plan review fees uh and any other expenses that we come into play yep that's okay okay just want to make sure everybody's aware of that and may I was going to ask is there any other potential poal property down there that would straddle both you both communities there's a well we have we have is it Wall Street and uh was it bank which we have two buildings that are already in Independence that we collect the taxes from Pally at the end of uh Bank Street Wall Street Wall Street Wall Street and then further north there may be some up by the Clover Leaf I see that uh traverses both the V the village and the City and the reason this is this is this way this because the old riverbed went that way and when it was straightened out in the early 7s it doesn't negate or change the who which Community you're in it just changed the river just changed but the city is capturing its percentage of uh land on the east side of the existing River I see any other questions on this uh legislation any opposition again putting this on cons agenda hearing none Debbie we'll put 2023 135 on the consent agenda uh ordinance number 2023-24 of the codified ordinances and declaring an emergency and this is regarding the uh uh the expansion there at the cemetery and the uh uh of course we'd already uh agreed upon as far as the niche goes for the columbarium and everything what we wanted to do is uh this Ron the service director we we we met in June we met in August with Council we went we went through various different meetings and uh that's when we approved earlier this year the cost or the recouping of uh the cost for the the niches the colum barrier wall and so this was the other half of that equation uh with the new plots coming online uh this was the last um last piece of legislation portion that was discussed with Council and the thought was let's get it before Council so that uh when we open up that new section we'll have pricing in place and and may when did you anticipate uh sale of first first quarter the goal is to uh we do have to stake each plot and so that'll be weather dependent but once that's accomp we'll be in a position and not necessarily people won't wait necessarily until it's to that point to buy because we'll have it delineated and outline but uh this puts us in a position that people will know eff of the first of the year that these These are the effective rates that uh that keep us somewhat balanced in terms of the cost considering the amount of money we're putting into the site considering the cost of maintaining the cost of operating every year it's still uh and and you all have the information that was distributed by Annie clearly this is a low-end low-end pricing relative to everything else that's out there and I think we've had this information since July I believe uh you provide us at one of the meetings there in July so this what may I suggest probably putting it in our in the poster that so people will be aware right and if there if there's a change down the road we can always address it but we have something to come out of the gate with that's fair and reasonable and we're not going to be uh in in a rears in terms of trying to manage the uh the uh Cemetery going forward you can see anybody that's been there uh by that area you see the concrete's been poured for the different uh for the routing and so they'll finish up uh cleaning up we should be in a position to uh to delineate each grave site uh at weather permitting thank you any any other questions John well mayor did you say I guess the process is we stake these but we could sell them we can still in a general we we can't they take a deed we actually actually each plot is a is a deed like your like your house like a piece anything that's a piece of property so we won't physically we'll let them Reserve but we're not going to be able to physically sell until we can plot it on site and then provide them the deed so that's when the transaction will take place but at least people can anticipate uh they'll know the cost they can get on an list and then when it comes time we'll be seamless in order to complete the transactions rather than starting sometime in a couple months later so that's the strategy so go ahead Council yeah I just had one question I I guess I thought when we talked about this that we were going to keep the graves in the old section the same price until the sold out and then this would affect the new section but does that functionally do that well that's the impression I'm under also okay but I that's the way we're going to treat it okay reading it it doesn't that way right it it seems as though this should be kept on first reading until the new expansion of the cemeter is completely plotted and ready for sale and then you can open up sales to those lots and change the pricing at that point in time to close off your current pricing in the existing lots and that's not a problem we can do that as long as everybody agrees that's with the pricing structur is in place I don't want to be disingenuous to someone and and assume that they're going to reserve a spot and then find out that conso changed the pricing no and that wouldn't be that'd be disingenuous so if you I have no problem with this suggestion as long as we understand which that whatever we go public with that's we're locking into we could either do that mayor or or just as you said you know in the old section we use the old pricing when that sells out then this kicks in but but that's not what the that's not what it says so so we can we can either amend it we can amend that if you're comfortable we can amend it to incorporate that uh the old section pricing would remain the current pricing the new anything that's new would be uh the new pricing just because we're down to we don't have a lot left in the old section anyway yeah I would so move that so in other words what we're saying is that any plots available for sale in the year 2023 would be at the current prices when those sell out in the new section opens up the new section would be at these prices is that a fair way of saying it just remove it so what we'll do is we'll remove this legislation okay and then do it in January because there's no first you know going to the new year and everything so okay uh 3 -136 will be removed thank you is it fair just for just because we get calls that we can show the pricing and uh and so we'll have that but we just we'll tell them that we're not going to actually we put them on the list they'll know what they're going to pay but we're not going to take orders so to speak until we uh complete the uh put ourselves in that position fair enough I think that's totally fair yeah any objection to that okay that's what we'll number 2023 137 uh it's an ordinance authorizing the purchase and delivery of two new 2025 Ford Explorer interceptors for the police department and an amount not to exceed $993 21 Dennis yes the these vehicles we purchased on the Ohio procurement purchasing program uh the reason we're trying to move forward now is because the order bank for 2025 Vehicles will open in January and Ford will not accept a an order unless they have a valid purchase order just one good thing that's coming out of this the vehicles we purchased back in 2023 the ones that we uh got from the City of Kent through sourcewell we paid $52,400 a vehicle uh these vehicles on the under saate pricing are $49,400 so it's a $3,000 savings and I think that just gives an indication of what's going on with the market now I think pricing might be coming back a little bit and then do I then your memo there your letter anticipate the projected cost to up each of the vehicle will be about 12,500 yes that's correct and we will come to council with additional legislation for that when it gets closer to Del very good any any questions for Dennis and chief this will go along with your plan as far as updating our our vehicle inventory and everything yes sir this is uh the proper cycle for that and also I know we had a conversation on this at one of the other meetings these would be the silver the newer looking vehicles uh the ones that are coming in 24 are the older gray ones these two ones will be the newer silver look with the updated package that has the backup protection for the officers windows that raise up if somebody's approaching an officer while they're not expecting them to so additional protection for officers and safety for the community thank you Chief and what sort of lettering and branding will go on these vehicles the most recent three vehicle uh the three vehicles that we got um that are silver it'll have the updated um Graphics that we put on those and we also designed a updated patch uh with the new logo everything it's on every one of our Cruisers we on the back it's on the back of every one of the Cruisers we have the new Bell and the new uh displays that we got on the newer cars so we're just waiting for the new cycle to to get those stuff thank you Chief any other questions for for Dennis or the chief on this any have putting this on the consent agenda this evening car none Debbie will put uh 137 on the consent agenda ordinance number 20231 38 this is an ordinance authorizing the purchase and delivery of two new 2025 Ford explore interceptors for the fire department and this is amount not to exceed $14,700 and this is a similar situation with what's going on with the police department I know there had been a couple questions as to why the different pricing in on the vehicle one example would be uh on the police department Vehicles the back doors are inoperable on the fire department Vehicles those doors are operable uh there are a number of other uh small changes and that's why there's a difference in the pricing between the vehicles uh one of the police K Vehicles is going to be a k9 vehicle which will have an acceler think of the word auxilary uh auxiliary uh air conditioning in the back for the K9 vehicle I see the the estimate cost upfit these two vehicles is 18,000 yes that's correct 9,000 vehicle I see now the other was 12,5 is that total or is that per vehicle that was per vehicle per vehicle yeah so a little little more to do the police we have we have the dash cameras uh and other items that I don't believe I can't speak for fire but we have those type of items inside of our cars that need to be added that's any questions for Dennis or chief Regan Chief you have anything to add to this uh no I just I without looking at the individual items that were ordered I can't really tell you what the difference is between the police and fire but there are definitely some differences I know we put some carpeting in there so the vehicle can be you know it's repurposed at the end of the our use of it it could it's a little bit more practical for another department to use yeah U we will have to come back over for some of the upfitting uh graphics and things like that uh it's hard to project when we're going to get these vehicles and what the pricing would be then so that's why that was kind of put on their separate way both vehicles that were purchase or that are recommended for purchase the fire department we have an extended warranty and I believe that is like $3,000 cost for people that's a warranty goes for $1,000 miles yeah we're hanging on to our vehicles for probably 10 years in the fire department as opposed to the period of time of the police it's probably much shorter now Chief R is that the vehicle that we see when you have an ambulance run in hit you see the yeah one of these will be yes the a Chase vehicle and the other one is a um I think it's a we're replacing I think assistant chief wheeler got one right now of them that was 14 in the uh original chase vehicles of 13 I see thank you any other any other questions I I don't have an issue maybe just I mean Dennis I mean maybe just something we can all think about so or maybe a little appetizer for like our organizational meeting thinking about so we got these two ordinances back to back they're essentially the same but the summary you know they just read a little different um so the information's good and you know two departments giving information are going to be a little different if we asked uh Ron here to buy two explorers it would read a little different so I guess I like I like the summary that comes out but maybe if it was just became more of a checklist type procedure you know one of them talks about replacing the old equipment one talks about outfitting per each for his total I mean I think I think there's just maybe some things we can do with just it's it was just apparent looking at these like wow they got two exactly the same things but they're slightly they're slightly different I try to you know take a memo I'll get from the director and kind of work it into the legislation but I'll try to you know streamline it and have it uh use the same language yeah and then just try to think like all right if if there's a a purchase what are the you know three four questions that we always ask the same question seems like how you know what's a useful life and what's it do we have a picture of it so I guess just thinking moving forward you know maybe a process for some of these that we could standardize something we could think about thank you John okay thank you thank you den no problem putting this on the consent agenda uh Debbie will will include this also Now we move to the the last page of the agenda and we have no there's one more down there 139 no to the last page no there's there's one more on this page that 139 one that's the first I'm going off I think you have different versions have addition sorry no I I don't monitor the last agenda came this is ordinance number 2023 139 it's ordinance authorizing the mayor to enter into a lease agreement with Great Oaks engineering engineered Solutions LLC the premises located at 6573 brexel Road Independence Ohio I believe that was the dentist uh barth's old office that's that's correct and it's just part of the space uh that space has been vacant since prior to the city acquiring it from the Kindle Brothers uh the Kindle Brothers had engaged a leasing agent and that leasing agent was successful in getting some leases for some of the other spaces but uh this base is just so old so tired so cut up so specific Ally used for a a single type of business at dental office it it's been very hard to to get any bites on it but this uh Great Oaks engineered Solutions it's a a young couple from Independence that uh the the husband and wife has started electrical engineering company done not civil but Electrical uh so we can't really use them for our infrastructure projects but uh he's doing business in a number of states uh just needs a couple hundred square feet to to get away from from the house and and have somewhere to go so uh this would be for two offices in the back we call it the back of the the second floor above the Foot Spa uh it's the Eastern end of that that space and um uh the rent is there and it would just be a one-year lease where where any leases that have come up for Renewal with any of the tenants we're all telling them just we're only renewing 12 months at a time so that if if we get engag if the city gets engaged with the developer serious about the property uh it'll take a little while for those negotiations to take place and and nobody will have to be out right away but we don't want to commit anybody to two three five year leases and then tie the city's hands should something come come down the pike that uh that's ENT interesting for the city and and the city's going to entertain a Redevelopment project so this is a way to get at least some money coming in for for part of that space and it doesn't preclude us from still trying to rent the rest of that floor but um it's it's tough unless the city was willing to to spend some money to to kind of cut up the choppiness and make it more open and and updated and do that I I don't see it getting rented but you never know but at least we'd get a couple offices in the back and and get the $300 plus the uh the monthly cost back every month and and so it's good for the city to get a couple couple Buck coming in and it's good for this young couple they Independence residents uh bought a home in Independence their three boys go to Independence primary school so it helps them too so that's what before you he was going to hire a couple other Engineers also though yeah he said a lot of them work remotely and on the road and so forth it sounded like although that's a possibility they could stop in here it's only 300 Square ft so it it probably is mostly just for him and his wife to to get away from the boys now and then and get some work done without the distractions at home myself any other uh Jim do we have to do any tenant improvements bur we're not doing any no he's taking it as is okay and is the second floor of that building metered separately uh yes and and we're we're just to try to make it simple and instead of trying to um allocate part of the floor and part of the the rent part of of the utilities you could see that we got some charges included for for the utilities that are built to the city um it's two offices so it's minimal electric uh it'll be minimal water sewer uh because it doesn't even sound like he's going to be there every day it's just a part-time just hey I need a place to get away from home once in a while and this is right in my city so can I rent this for for for for a year and yeah it's uh it won't be a problem so they're paying $125 a month for water gas on top of yeah on top of the 300 so I believe is what the four and a quarter total and then how will their two offices be cordoned off from the rest of the space or will they have access to the entire second floor they will have access to it because uh you walk up the stairs from the front west entrance you're you're basically walking into the kind of common hallway there and there's no real doorways into the office but um they'll limit their use to just those those two back rooms there so then does that render the rest of the floor un rentable if there were another no the city could try to rent those other bu other spaces but then we'd have to probably engage with Dave's Department to maybe put up a couple walls or or kind of more formally partition it off at that time it's rough up there we could take you up there if you want to see it everybody we've shown it to just kind of like eh thanks but no thanks and and they pass so and that's what Moren russler told us when when she tried to lease it for for Frank and Dale back when they still owned it she said ver we got I got tenants for all the other spaces but this one she goes I I came up crickets on this one and and we had to but it's it's built and plumbed for a dental office right I mean that correct the restrooms are off of the hallway so um they don't need that that Dental space but um to try an accountant an attorney to try to to use it for for their own purposes you got a reception area that that was meant for common reception as you go to a dental office and you walk in and somebody greets you and you sit and wait and there's a lot of very small hygienist offices a lot smaller than the current ones that that are standard at the dentist I go to so it's um it it just doesn't lend itself to being readily marketable to to tenants and we're hesitant to put money I mean we could put money we could demo walls we could throw out the carpet we could pull the old wallpaper down we could we could make it real nice but uh we're not looking to spend that kind of money in a building that the ultimate goal is to to raise that both buildings and redevelop the entire Corner those two Parcels as well as the former Middle School site and so then after the 12-month lease does this become a month to month what happens to this no we either have to renew it or or they walk away at the end of 24 and how are the other leases uh on city-owned properties written are they specified terms are they month to month these are all the ones in the Kindle buildings are uh when they've come up for Renewal uh they we've just told them all we we'll only do 12- month renewal so um nobody will have a lease renewed beyond the end of 2024 the next lease we have coming due is the foot spot itself and I believe that's at the end of January so we we'll just make a decision if we would if they want to stay if they want to renew for 11 months until the end of 24 or if we remove renew them for 12 months and then they go to January 31st of 2025 so it sounds like you're going to syn the other leases then sink them get them all so they all come up at the same time well some of them expired in the spring and the summer of this past year so uh we renewed them for 12 months and and so no they're not all on a on the the same calendar year but that might be something to do ongoing so that everything ends up at the same time yeah the the tenants just ask for as much notice as we could give them if if the city feels like they're not going to renew the leases and if if the building's going to maybe reach its demise because then uh you know they we've got some thriving businesses there they're doing quite well and and they got to know if if they're not going to have space to lease so they're just asked to uh us to to give them as much notice as we can when we know of a specific project that's going to impact them but right now there isn't any so so we're we're comfortable just going 12 months at a time figuring if somebody landed on the city's doorstep today with an interest in a project by the time that gets negotiated internally the time it gets presented to council by the time we have public hearings by the time it goes through Planning Commission zoning board ARB and so forth that's probably a one-year process so that's why we've been going with the oneyear renewals and you said some of the leases expired this summer and we renewed them this past summer yes now is it Council act on those don't isn't we've been told correct me if I'm wrong uh law director O'Brien but that Council has to approve a a new lease but that if it's just a renewal of an existing lease uh if it's no more than 12 months the the administration can hand that handle that internally yes that's why we've always done it in fact we have some houses similar on renews any new leases we bring them back to council approve which within those lease allows for an amendment under the same terms now if there was some different terms or something I would probably bring those back to city council to approve but it's just a renewal be interesting to have uh the public buildings and lands committee go through all the leases I I don't think I've ever seen the lease of our rental dwellings I have no idea how much they're paying in rent there and I know there's others that have been outstanding for a number of years so be good to refresh Council on those very good any other questions any opposition putting this on the consent agenda this evening Debbie will place this on the consent agenda we move to ordinance number 2023 d140 it's ordinance amending ordinance 20 23-18 authorizing change order number five to the agreement with El Robinson engineering for professional engineering design services in connection with brexil Road improvements Rockside Road to State Route 17 Cloverly and I I think um if I'm correct it's just that the there was a paragraph omitted last month that's basically correct the the amendment that was in 2021-22 was not included in that last piece of legislation last month or in October which was 20 23-18 so um the total amount of the El Robinson contract was incorrect in that particular piece of legislation so this legislation is just not approving well technically we're approving the 135 550 because the old one 118 will will become null and void because it's being amended by this one but Council approved the one Council approved all of them starting in 201802 201851 201818 201917 2021 91 and 2023 118 the problem this this corrects the issue that the last one that we did 118 said the total of all those was $995,000 M 69,6 19 so this just corrects that total um the 135 550 was already approved by that last ordinance so bottom line no new money's being approved or anything no everything Council has approved by one two three six different ordinances already this just corrects the grand total of what those six add up to I I think it wasn't it wasn't unanimous last month so we should probably put with this we'll vote on this separately so we will that will not be part of the consent agenda any other questions regarding that it's just basically again another housekeeping type they have be corrected uh we move on now to uh ordinance number 20231 141 this ordinance amending ordinance number 20227 regarding compensation of exempt Personnel uh bridg thank you um in fact uh ordinance number 20231 142 um they kind of go hand in hand so uh they're twofold in a sense um ultimately uh 20231 141 um this is to amend our exempt uh salary chart currently we have the clerk of council role uh position on the exemp chart um the clerk of council beginning at the first of the year will no longer qualify as an exempt employee and at that time the request would be to go ahead and have that position uh you know transitioned over to the non-exempt Chart so 20231 142 illustrates your non-exempt CH uh essentially this is a technicality we're just asking that uh again the clerk of council role be move from exempt to nonexempt and uh we're also asking that the chart uh a 2020 column and a 2021 column we would like to see that cleaned up um and just maintain the salary range there it's 2022 um and just make that the actual any any questions for br any opposition putting both of these on the consent we say some either nice or not so nice things about vice mayor grindell while his family's here well I'm so glad you ask Dave grindell thank you for your commitment to the city of Independence over so many decades since you first were elected to the school board and later the city council you have always supported our colle your colleagues and encouraged everyone to do their best you are a gentleman's gentleman always professional courteous compassionate and kind I will always be grateful for your friendship calm and steady demeanor and thoughtful councel thank you for leading by example and being inspiration for so many others and finally on behalf of a grateful Community thank you for always going above and beyond to ensure the city stayed focused on the future continued to grow and provided a high quality of life for our residents thank you David thank you Mar thank you everyone and mayor thank you so much I I just have a few words this will be on my monthly report but I figure I I'd like to say it now just if I can and it's just a few uh but my composure here it's been a sincere honor and privilege to have served as the vice mayor for the past eight years I thoroughly enjoyed my 20 years of service on city council and nine years on the independence Board of Education I have a tremendous amount of admiration for mayor Greg Cs and the numerous accomplishments he and his administration have achieved over your Decades of service I also recognize the excellent achievements of Fred Ramos and Anthony tolotti during their terms of office and I had the privilege of serving in councel i al also have to complement another retiree TB Beal for outstanding tenure is Clerk of counsel I mean Debbie's always been there when we text each other or email and that and uh Debbie's just been a dream to be in that position I I wish Amanda if you could be uh oh there's Amanda you could be uh 60% of what de is you're going to be outstanding yourself too and you've you're well on your way to to achieving that but uh Debbie I know you'll be deeply missed too and I'll just miss you just uh like I say you kept us on our toes and remind us of different filings that we had to do personally for that but uh uh I do have a deep respect for the men and women I've served with on Council over the years I don't know how many I I'd have to go back and see uh how many different members there were as well as the numers administ the administration here from only only two Finance directors so I at least perent on so at least I can remember those pretty distinctly Vern and and John Veris but all the the the different departments over the years have been wonderful have really uh made this city what it is so we I respect and and honor you folks too for the the work you've done and and the attitude you've kept uh uh and U uh I've learned valuable lessons from each and every one of my fellow Council persons and I I'll deeply you know remember that I still remember to this day the when we found the Bob Zuber passed away I that affect us yes but finally I couldn't have accomplished my work on Council well without the support and love my best friend and my wife Carrie I hoped for everybody their family means everything and having this support and strength of your family that gets you through that is it anybody else you want to recognize oh my beautiful daughter mad are you mad at me are you mad at me you I can say we're a close S I think now a day goes by we're not texting each other or communicating with each other I mean at all times of day so you know it it's it you know if you just somebody ask me what's wrong with our country you just have to look and say if you get back to basics and just you take care of your family and and your the the closest and your neighbors and that I I think we'd be a far better Nation I mean you get back to basic and the sniping and the uh one-upsmanship and everything else that you see going on so that's that's the way uh uh that uh you know we try to live our lives and again we we appreciate everybody in this room and and like I said wish everybody the merry Christmas and a happy especially healthy new year thank you David thank you I also want to thank the clerk of council Debbie Beal for your commitment to the city of Independence starting in the building department not many people know she started out in the building department and finishing as the clerk of counil your professionalism responsiveness and integrity speaks volumes you will be missed but not forgotten thank you for how well you've worked with my Administration over the years it's invaluable and as my mom said and I'll convey to both of you whatever you do leave it better than you found it and I can attest to the fact that person on my left and the person on my right have definitely done that on behalf of all the residents of the city of independence with that I think we should Round of Applause and thank you with that I like to wish everyone a want Merry Christmas and uh Happy New Year and blessed New Year like Dave said appropriately family is everything and we're blessed to be part of the family and the
