well good evening welcome to glendale city council meeting of december 8th 2020. this meeting is called order roll call we'll go ahead and do that right now uh on the phone with this councilmember aldama are you present present councilmember clark yeah councilmember hugh councilmember thomas here councilmember turner here vice mayor i'm president well the next two items on our agenda are the invocation and our pledge of allegiance the invocation tonight is going to be delivered by pastor jim hummel with the vineyard church of north phoenix uh if everyone would please rise gentlemen if you're wearing a hat if it's appropriate please remove it and then following the invocation please remain standing for our pledge of allegiance pastor good evening my name is uh jim hummel and i'm with the vineyard church north phoenix i'm also a resident here in catlin court let's pray lord we thank you for this beautiful city and all that it has to offer i pray tonight that you would be with the decision makers i pray that you give them supernatural wisdom and guidance as they may have to make some tough decisions tonight and for pres for the presenters i just pray that you would give them uh clear words and and concise words and everybody would understand them and at the end of this meeting i pray that everyone would walk out of here being unified and at peace with one another and indivisible with liberty and justice for all yes great thank you okay before we get started i'd like to remind everyone of the following this meeting is televised live on the city of glendale's facebook and the youtube pages also as well as glendale's own channel 11. our meetings are located in the glendale civic center and with the audience seated next door in the same building we request if you're sitting next door that you do wear a face mask covering if you're unable to social distance for those of you that are seated next door please be aware you have a large screen that allows you to see and hear us but we also have a large screen where we can see and hear you with that said if you wish to speak on any item on the agenda please fill complete a golden colored card give it to the officer in the room to be given to our city clerk and that'll be then given to me if you submitted a speaker card and indicated that you wish to speak on an agenda item i'll wait for you to make your development reimbursable grant agreement with the arizona department of transportation multimodal planning division e-1 s-1 f-0-1-l and the acceptance and expenditure of grant funds in the amount of chair boats eye the motion does carry public hearing land development actions we're now going to do just that uh item number 23 ordinances 0-2-0-8-0 ordinance number o 20-80 an ordinance of the council of the city of glendale maricopa county arizona rezoning 100 acres located at northwest corner of and state route 303 from p.a.d planned area development to pad planned area development for a development plan entitled ca ventures glendale 303 amending the zoning map providing for an effective date and directing the city clerk to record a certified copy of the ordinance mayor members of the council being that this is our last uh scheduled meeting for this year i would like to take a brief moment as i introduce our presenter uh to let you know this will be lisa collins last meeting with us as you know she's going to be leaving the city of glendale and lisa came in at a very challenging time because we had a tremendous amount of workload and she's worn a couple different hats both as our planning administrator and our interim director development services so i just want to personally recognize the great work that she's done she really helped guide um i think the city through some huge opportunities and so with that uh our presentation will be by lisa collins thank you thank you mr phillips phelps and thanks for bringing me on board it's been great so this case is ca ventures glendale 303 zoning case 20-16 so you've seen this request before it came to us in an annexation case and it was brought in with like zoning which was a pad because they did have previous zoning action in the county so this is a request from pad to pad to allow the mixed use development and to allow for modified development standards on approximately 100 acres and the subject property again is located on the northwest corner of glendale avenue in loop 303 this map shows that in proximity to city hall again this is the developments that we've seen along the loop 303 so the general plan does show this as mixed use and the zoning map again does show pad and this will be changed to pad just a new pad the ariel shows the location it does extend from the loop 303 over to cotton lane orangewood avenue on the north and glendale avenue on the south so again the property is currently undeveloped and has historically been used for agricultural purposes and as i said it was annexed into the city june 23 2020 and it did have previous zoning in the county so again the like zoning when it came in was pad this is the site plan and landscape plan to give you an indication of what the development will look like again this was within the noise contour so this is the only type of development that occurred there that could occur there industrial and warehouse uses a conceptual elevation to show you and the development standards so primarily what they're looking at are standards that would make this consistent with other pads in the area namely height so there is an 85 foot limit which again is consistent with other p80s that have been approved in the area and there are some changes to the parking because again this is warehouse manufacturing it doesn't require the same level of parking again that's been approved in previous pads the public involvement did include include the 300-foot notification letter virtual neighborhood meetings the site postings that are required hearings advertised postcards sent and the planning commission did see this case just last week and they did recommend approval so they did see this on december 3rd 2020. and the findings are that this is consistent with the policies and objectives of the general plan glendale's general plan it does further the public health safety and general welfare and as i stated it's compatible with other pad development along the loop 303 therefore the step is recommending approval and it will be in substantial conformance with the pad that was submitted and the developer will be required to dedicate additional right-of-way the site driveways will be determined once a traffic impact study is reviewed and approved and that will be part of the design review process and there will be a detached sidewalk along glendale avenue and the property frontage and then the typical stipulation that we have regarding digital billboards as you know the pad expressly does not allow them does not allow an amendment that would allow them however as we're going through our zoning ordinance rewrite if there is an amendment that would allow them as proposed in this case then they would be allowed they wouldn't be required to come back and amend the pa just for that and this is a condition that you've seen in in many other cases along loop 303 and with that i'm happy to answer any questions you o 20-81 an ordinance of the council the city of glendale maricopa county arizona amending the zoning ordinance of the city of glendale arizona by approving zoning text amendment zta 20-01 for group homes which amends the zoning ordinance as follows article 7 general development standards section 7.502 group homes providing for severability setting forth an effective date and directing city clerk to record a certified copy of the ordinance mayor members of the council here provide staff report is lisa collins thank you mr phelps thank you mayor members of the council again yes this is a zoning text amendment for group home zta 20-01 so a group home is defined in the city of glendale as a dwelling that's shared as a primary residence by at least six but not more than 10 handicapped or disabled persons in an order for a group home to be permitted in the ordinance currently a distance separation of 1 320 feet is required which is a quarter of a mile so the purpose for this text amendment is to allow an applicant to apply to our board of adjustment for an exception to that separation spacing requirement for a disability accommodation so as you know the board of adjustments sits as judges and so their decisions are final and less appealed to superior court the planning commission and the city council do not hear requests for variances to the board of adjustment so again you'll recall the purpose of this request is based on a complaint that we received from the housing and urban development department regarding the city's ordinance requiring this distance separation and having no specific ordinance criteria that would allow for a special accommodation based on that complaint and as you know we spoke with you earlier in an executive session and received direction from our city's legal staff to process a zoning ordinance amendment so [Music] for the next slide here oh there we go so uh public involvement of course there were hearing notices mailed and these are parties of interest that get these because it does apply city-wide it's no specific location there was also a notice of the public hearing in the glendale star on november 19th the planning commission did recommend approval at their hearing on december 3rd 2020 which was last week and again that was not included in your report because your report was published prior to the hearing for the planning commission so the proposed amendment would allow a disability accommodation and again this is the only thing that would change in the group homes ordinance and i'll go through these so a disability accommodation from a development standard or separation requirement shall not be authorized unless the board of adjustment shall find upon sufficient evidence all of the following the requested accommodation is requested buyer on the behalf of one or more individuals with a disability protected under federal and arizona fair housing laws the requested accommodation is necessary to afford an individual with a disability equal opportunity to use and enjoy a dwelling the standard of requirement unduly restricts the opportunity for a person with a disability from finding adequate housing within the city of glendale the requested accommodation does not fundamentally alter the nature and purpose of the zoning ordinance of the city of glendale the requested accommodation will not impose an undue financial or administrative burden on the city as undue financial or administrative burden is defined in federal and arizona fair housing and interpretive case law and the profitability or financial hardship of the owner service provider of the facility shall not be considered in determining whether to grant a disability accommodation and the requested accommodation must comply with all applicable building and fire codes the requested accommodation must not under the specific facts of the application result in a direct threat to the health or safety or other individuals or substantial physical damage to the property of others and the requested accommodation shall require submittal of an application including the required fee is published in the fee schedule and comply with all public notification requirements so with that the staff is recommending approval of zta 20-01 subject to the proposed amendment as presented and written in ordinance 0 2 0-8-1 with that i'm and directing the city manager to execute the real property transfer agreement and all necessary documents for the acquisition of real property from alice b bacon kevin p traynor catherine l bacon and jeffrey e dunmeyer as trustees of the dunmeyer family trust and marilyn m story as trustee of the maryland m story trust to accommodate future development in the ballpark boulevard extension project area and directing the city clerk to record a certified copy of the ordinance mayor members of the council here to provide staff report is glendale city engineer david beard thank you mayor city council this is a request for city council to waive reading beyond the title adopt an ordinance authorizing city manager to execute a real property transfer agreement to acquire 2.56 acres of real property the purpose of this real property transfer agreement is to acquire the property so we can finish the ballpark phase 2 project which includes completing the southwest quadrant of the intersection at 99th avenue and ballpark boulevard including signal improvements completing ballpark the south half of ballpark boulevard west of 99th avenue tiling the rid canal along ballpark boulevard and acquiring a future parcel or acquiring a parcel for a future lift station site that would serve the development west of 99th avenue and south of glendale avenue that completes my 3 offenses against public safety and order division 5 fireworks section 26-70.5 postings of signs by persons engaged in the selling of permissible consumer fireworks civil penalty section 26-7 70.7 penalties and chapter 25 nuisances section 25-65 exemptions from noise level regulations and declaring an emergency mayor members of the council here provide staff report is deputy city manager rick st john evening mayor members of the council we're excited to bring you tonight some amendments to the fireworks ordinance and our noise ordinance these amendments were discussed in detail for your constituents that would like to see the discussion on june 23rd of this year and november 24th of this year what we're asking tonight is to amend the ordinance for noise to include a section that says it's permissible to use permissible fireworks up until 12 30 a.m and then we're amending the fireworks ordinance uh so that the penalty is set at fifteen hundred dollars for a first offense two thousand for any subsequent offense in the same 12-month period and that signs be posted notifying the public of these fine changes in conspicuous places where these fireworks permissible fireworks are sold and with that i'd be happy to answer any questions you may have i do have one question i know we talked about this in a workshop those signs will also be printed in spanish mary yes sir if you can make that amendment i do not believe it was written into the document so if you can make that amendment when you offer [Music] the motion that would be great sure i'm going to make that one yeah all right very good i just have a question for staff thank you illegal fireworks is still illegal permissible or legal fireworks are permissible only on the days that are stipulated in state law and if we pass this tonight it will only be during the hours or it will not be during the hours from 12 30 p.m until what time mayor council member turner everything you said is correct display fireworks are always illegal the definition of display fireworks can be found in arizona revised statutes but for the sake of conversation display fireworks are those that go in the air and make a loud noise and permissible fireworks typically sparkle and stay on the ground and they are permissible two times out of the year essentially around new year's and around fourth of july and they are permissible from 12 30 a.m to s or they're non-permissible from 12 30 a.m to 7 a.m thank you thank you mr st jones same mistake i couldn't remember the other way so even permissible fireworks under state law which are those that do not go up in the air and do not make a loud bang even those will will not be permissible from 12 30 a.m to 7 a.m so mayor council member turner that is correct and they're non-permissible during those times of the year that are not around new year's and fourth of july right and i'm just trying to make sure we all are making this point that as a council if this passes we're doing what we can to minimize the negative impact of the loosening of the statewide fireworks statute and out of response to concerns that have been raised by constituents i think throughout all of our districts but we're doing the best we can folks thank you mr bailey comment mayor and council in and to piggyback with with what mr st john is saying and just to have a clarification of those questions we are not regulating permissible fireworks what we are doing which we have the right to do is regulating the sound of them so there technically can be a firework which i'm not sure one exists that makes no sound and somebody could light that off because we're not regulating fireworks right possibly but it would depending on the noise associated with it that would be in violation of our noise ordinance because we don't have the right i believe to regulate fireworks that's been preempted by the state but we are regulating the sound of those fireworks under our noise ordinance which we do have the right to do everybody clear on that okay are you finished yes sir okay i have no speaker cards no sir okay very good can i get a motion for ordinance 020-83 i do have a couple of things um i had a constituent a couple of constituents actually asked me to clarify um something in our mask uh man ordinance and it's not an ordinance but it's a proclamation that you issued so i'm just going to read just a little brief part of it about outdoors with masks if you don't mind if you're exempt if you're exercising outdoors while walking or exercising with other people who are within a small group of people that are closely and frequently associated with as long as physical distancing from others is maintained for your you are not exempt from wearing a mask outdoors if you're congregating outdoors with other people not within a small group of people they are closely and frequently associated with face coverings are required when physical distancing is not maintained i just wanted to clarify that because i think there's some confusion around what what are you supposed to do when you're outside at parks if you're exercising so anyway i promised i would do that and i want to wish a merry christmas and a happy new year to all the staff all the residents um this is going to be a very different holiday season i think for all of us so just stay safe it looks like things are going to be getting better hopefully early next year but in the meantime wear your mask and stay safe and we'll see you next year thank you turner uh thank you mayor um i have i'm pleased that councilmember thomas brought up masks and wearing a mask it's the single most important and effective thing we can do to spread to stop the spread of covid i saw something today did some fact checking on it it seems to be true the deadliest day in american history was the galveston hurricane in 1928 over 8 000 people died the second deadliest day was the battle of antietam during the civil war 3600 people died the third deadliest day was september 11 2001 when in addition to all of the other people who died that day 2977 americans were killed in the three three airplane attacks the fourth deadliest day in american history was last thursday 2861 americans died the fifth deadliest day was last wednesday 2762 died the sixth deadliest day last tuesday the seventh deadliest day last friday the eighth deadliest day in american history was december 7th 1941 pearl harbor day when and 2403 people died wear your masks avoid large gatherings take the precautions 2020 has been a crazy year you know we're into the final stretch for this year but the danger is real we're seeing the spikes now from thanksgiving we'll see spikes that'll carry us through and past christmas and new year's the vaccines are ways off yet where are your masks with that on that sad note i wish all of those of us still here in our city and as residents or as employees our great residents and our terrific employees wish you all the happy holidays and a happy new year thank you mr melner thank you mayor yeah i just want to wish all the residents of glendale as well as other uh folks in the valley uh all the staff uh very merry christmas a happy hanukkah and uh hope that we have a very happy and prosperous new year all right and then i uh be very brief i want to thank lisa collins i don't know where she went paradise valley i heard dirty leftists she's uh she's had a very very difficult year this year not only because of covid and all that but because this has been one of the busiest years the city's had for economic development and she's been just eyeball deep in it the whole time she's moving on i'm not going to say to better things but certainly probably easier things and then we are going to miss her and so i want to thank her for all her hard work along with all of the city staff this has really been an incredibly tough year for so many different people whether it's our personal lives uh or our working life so with that uh you know i wish everybody the very very best next year we all have a great opportunity to make 2021 so different than 2020 and and i think a lot of it has to do with uh what councilmember turner was referring to earlier it's it's a it's up to all of us to try to slow this curve down uh take that safety precautions do the arizona the number of cover 19 cases is increasing in the state of arizona the hospitalization could hit 100 percent cap chassis very soon the state of california is currently on cover 19 lockdown which is causing small businesses to go out of business due to lack of stimulus from the federal government according to the arizona state university bible design institute we are looking at starting to hit capacity in the state for competitions across in the next week or two we are airing a difficult winter in our country in the effort to slow the coronal virus by raining face mass and keeping sick feet also circumsting glenda residents wear a mesh and wash no hands for 20 seconds finally we need to support more businesses in the city of glendale during this difficult time small businesses
