Discussion for possible action regarding a resolution finding the project proposed by electrical utility incentive program reimbursement agreement between the city of Las Vegas redevelopment agency and TUPR2 LLC to be in compliance with and furtherance of the goals and objectives of the redevelopment plan and authorizing the execution of the EUIP by the RD RDA. Furthermore, the incentive agreement encourages the property owner to underground electrical lines in conjunction with the development located at 222 310 and 324 South Main Street, 250,000 RDA special revenue fund redevelopment area 1, W 3, Councilwoman Diaz, and there's a note that this item is related to council item 35R-17 2025. Here with you this morning are our wonderful guests. uh Mr. Jonathan Josel with the plaza and also Mr. Gran Garcia. Uh welcome. Thank you for having us. Yes, thank you. Good morning everyone. So today for your consideration, we're bringing forward an application for the program that you approved, I want to say maybe a couple months ago. It is a program to help our uh partners underground the utility lines. If you recall, uh you know, I'm sure you see those polls all over downtown. They're dissecting every city block left to right. Um and in order for us to do different development projects and in this case a very special uh project that we'll go into detail a little later uh we need to put those lines underground and so the redevelopment agency obviously is uh entering into a reimbursement agreement upon your approval to uh reimburse for some of the costs incurred uh by Mr. Jonathan Josel and his partners during the undergrounding of the utility lines. The site for the project we see every single day when we come to work. Uh is right across from city hall. Uh uh you know where we have the rodeo. Uh sometimes we refer to it as a core arena, but most importantly it is the land that is part of the uh plaza hotel. Um around the neighborhood uh obviously there's city hall but of course we know that this is part of our resorts and the civic district. they kind of overlap in this area and uh there's again a lot of uh old and aging infrastructure. Uh just to pinpoint uh some of the utility lines that did go underground uh in preparation for the project. I believe there's total of four that went under. Uh they're old uh very aged and essentially were uh you know splitting the the core arena. I want to say right in the middle almost. Um this is the after photo. Um and as you can see the the wooden uh util lines are now underground. Those are there. No those are gone. Oh those are gone. Oh okay. So apparently this this is an old photo but we'll show you a new video. Yes. So um if we could please play the video. Jeeoff. Heat. [Music] Heat. [Music] Amazing. Um, just to clarify, uh, the utility the utility lines that went under on this side, they're actually in W five, but the substation itself is in W three. Ah, there's a so yes. Um, so with that, um, I'd like to, uh, just go over the details of the reimbursement agreement. Uh, the applicant, they invested quite a large amount of money to put the lines underground, over half a million dollars, which makes them eligible for $250,000 in reimbursement from the redevelopment agency. Uh, as you uh can see, the work was completed in preparation for Life is Beautiful last fall. Um, I'm sure there's other things that are not going to be able to take place uh on the land because of that work. With that, I'd like to pass the word over to Mr. Josel and Mr. Garcia to provide any additional details or answer questions. Good morning, Mayor. Good morning, Mayor. Uh, thank you, Dina, for those that lovely presentation and kind words. We are just thrilled of how good it looks out there to have those old power lines buried. you see in the video the the the site after the power lines are gone and how much cleaner it looks and it's obviously aesthetically much better but operationally for us it's safer they were a hazard but also allowed us to do a bigger event with life is beautiful and other potential bigger events mayor prom we talked about something yesterday ironically about it but that site now has a lot more potential we're working on a few things with Dorado and some other events to continue to use that site but if nothing else it's a real cleanup of the neighborhood and helps between sandwiching between city hall and symphony park a much cleaner beautiful site so thank you for your consideration of this uh I'll just add uh thanks to the EU department we definitely couldn't do it without the partnership of the city uh it was a very short time frame and of course we ran into a lot of issues with NV Energy um so it definitely took the partnership of the plaza and the city and EUD to really get this done and in a timely manner So, um, again, thanks for the partnership. Thank you, Dana, for your leadership. Oh, thanks to my team. Thank you. I think this is one of the most innovative programs I've seen in our valley because one of our biggest challenges is um at least in the areas that I represent and I know Councilwoman Diaz and Councilwoman Sean Shandra Summers Armstrong that being able to underground those power lines I think is part of our the evolution of our our of our community. So, thank you for being the first to participate in this program. Just my quick question was what was the timeline from when you thought about it to when it was finished? Well, I've been thinking about bearing those power poles for 17 years. Yeah, I understand that. Looking at those things every day was was was difficult, but um I think we we thought about burying them around February and we finished around uh couple of weeks before the first of September. Okay. Which which actually from what I'm told is like a world record speed to move with NV Energy and it was a lot of help from the city to get us to that point. So, it was a it was a great project, but February to September was the window. I may have to take your notes because I'm meeting with NB Energy next week and I may need to figure out how to do that better. Uh, okay. Agenda item number six, RA-7-2025. discussion for possible action regarding a resolution finding the project proposed by the owner participation agreement between the city of Las Vegas redevelopment agency and Aztec Aztec in casino limited partnership to pay for a portion on the installation of a proposed parking lot located at 120-130 West Cleveland Avenue is in compliance with and in furtherance of the goals and objectives ives of the redevelopment plan and authorizing the execution of OPA by the RDA $95,000 RDA special revenue fund redevelopment area 1 ward 3 uh councilwoman Dios uh please note this item is related to council items 18 and 36 R-18-2025 Miss Babski yes uh good morning mayor uh Dina Babski director of economic and urban development for the city. And with me here today is Mr. Will Heaton, the representative for the application. Welcome. Thank you. For your consideration today, we are presenting an application for an owner participation agreement grant. Uh the site for the project is in W 3 as you mentioned at 125 West Pops Tupac Avenue. Most of us uh would recognize the site due to the obviously the the Aztec hotel and casino and also it is right south of the strip of the strat. Um around the neighborhood uh you will see that you know there is uh some older uh structures uh some of them obviously we have helped before with RDA grants. So this one is something that we have been working on uh for a while. There were uh five different buildings uh former residential that had been vacant for a while. Uh they had you know had some hazards I would say occasionally for community some safety whatnot. And so, uh, due to the great partnership with the applicant, we were able to, uh, work out a deal where the the the buildings were to come down and then the city, well, the RDA would help participate on getting, uh, that property into a temporary parking structure until a bigger and more um, I guess a bigger redevelopment would come along. So, these are some of the photos of the former of the old residential buildings that came down. Um and now um the idea is that that the land is vacant. Uh the funds will be used to pave the lot and then we will move forward with a temporary parking pave parking lot and it is actually on the council agenda later. Um that parking lot will be managed by our parking services division under uh EUD. it will provide close to 120 spaces or whatn not or so and we have partnered with the strat to uh to lease some of the spaces for their employees and potentially their guests. So this is almost like a uh partnership between three different parties to make sure that you know we clean up the area and make it safer and get it prepared for a bigger development in the future. Uh the owners of the property invested over $150,000. uh it does make them eligible for a $95,000 reimbursement uh by the redevelopment agency. If this grant is approved, which I hope it is, the work will start uh right at the beginning of April um and be done quite swiftly. Absolutely. With that, I'd like to pass the uh mic over to Mr. Heaton for any additional comments. Well, I appreciate the opportunity to be here. My principles wanted to be here, but for health reasons, we're not able to today. But we do express our appreciation to the redevelopment agency and also the city of Las Vegas as we try to make this improvement to the property. As has been indicated, the property was in some disrepair and our clients have been working diligently to try to resolve that in the last u the recent year or so. and uh we really look forward to the opportunity to participate in this venture to further improve the property for the benefit of all involved. Charles is a neighborhood outreach specialist who joined the city team three years ago. Charles works tirelessly as part of the city's shift team. If you are not familiar, the safe home improvement funding and training or shift program is a proactive approach to assist homeowners to repair and improve homes that may be in jeopardy of falling out of code compliance. Charles comes to work each day full of energy and with a positive attitude that is infectious. He is a problem solver who helps residents navigate challenging situations with clarity and compassion. Each resident and issue he encounters is different and Charles is able to find the right fit for the job by offering wraparound services. Charles works to not only address immediate issues but also any underlying problems that if not mitigated could result in a recurrence of code or safety violations. Charles ability to connect with people and help them is an example to us all. Charles, thank you for all your hard work and for helping those in need. It's my pleasure to share with you a little bit about Chuck and why he is so deserving of this award. So, Czech joined the city in 2022 and quickly became an integral part of our shift team. Um, as the mayor mentioned, the goal of our shift team is to ensure housing safety and security for individuals and families through an array of programs focusing on code compliance and housing rehabilitation. In his role, Chuck works with individuals and families from mature and often underserved communities where folks often shy away from government and public officials. Due his due to his joyous nature and kindness, Chuck is able to quickly overcome barriers and establish rapport with individuals and families, enabling him to provide much neededed housing repairs and assistance. He not only earns their trust, he obtains their commitment to the program and also remains committed to seeing the projects through completion for each household that he works with. Chuck is smart and great at leveraging community resources and partnerships for greater impact. Just recently, he and the team collaborated with two local contractors and Home Depot to obtain donated materials and labor to replace a dilapitated fence that posed safety concerns for an elderly couple, thus improving their chances of aging in place. So today I want to recognize Chief Jason Pototts and his exceptional team in the public safety department for their outstanding effort and dedication to Operation Positive Change, an undercover sting operation targeting illegal breeding in the city of Las Vegas. I and the animal community met with him shortly after he came to the city only a few years ago. He got to know me very well because as a brand new chief, he was there without hesitation when I needed someone to accompany me on a critical surprise inspection. I'm not sure he knew why he was there, but I quickly understood I had an ally who shared my passion for animals in our city. He indulged the animal advocates at our several town hall meetings and patiently listened to our concerns about illegal breeding. He understood the crisis and took action with Operation Positive Change because illegal breeding was destroying our animals and our shelters. This operation, which has resulted in several arrests, multiple violations, and the rescue of several dogs, is a testament to the hard work and determination of Chief Pototts and his Flex team. Illegal breeding is a devastating issue that has plagued our animal community, flooding the streets, local rescues, and shelters with abandoned and abused animals. The animal community and I are grateful to Chief Pototts and his team for his leadership on this important issue. Sometimes the animal community and I felt like our cries for action fell on deaf ears. But Chief Pototts, Rudy Tovar, and the team understood how serious the crisis was. Illegal breeding is an industry driven by profit without regard for an animals well-being. These practices have led to overcrowded shelters, increased euthanasia rates, and countless innocent lives lost in the cycle of neglect and cruelty. Operations like Operation Positive Change are crucial because they hold illegal breeders accountable and raise awareness of the far-reaching problems caused by illegal breeding. We are making significant strides in addressing this issue thanks to Chief Pototts and his team. His efforts have saved countless dogs lives and taken dangerous weapons off the street. It sent a message to those who exploit animals for profit. We will not stand by. We will hold you accountable. Thank you, Chief Pototts, and thank your entire team for your dedication and hard work. We have made our community a safer, more compassionate place for all living beings. Your efforts are generally appre genuinely appreciated and we look forward to supporting you in future endeavors as we continue to fight for the well-being of all living entities in the city of Las Vegas. I would now like to present you with a proclamation recognizing operation positive change. So uh it's right here but let me read it because it's important. Whereas the city of Las Vegas department and of public safety under the leadership of Chief Jason Pototts has demonstrated unwavering commitment to protecting the welfare of animals and enforcing laws against illegal breeding operations. And whereas the Department of Public Safety Flex team including Lieutenant Tim Mullins, Sergeant Jeff Jeff Belchure, Officer John Wright, Officer Carlos Garcia, Officer Jorge Ko Koka, and Officer Louie Uvalde conducted a dedicated six-day operation resulting in 35 citations, two arrests, and the rescue of 16 puppies, including high value breeds. And whereas Operation Positive Change successfully disrupted illegal breeding activities by addressing addressing violations such as selling without a license, breeding without a permit, and selling underage puppies, leading to a significant reduction reduction in online listings for unlawfully sold animals. And whereas the operation rescued not only vulnerable animals, but also enhanced public safety by seizing four firearms, including a a stolen AR-15 rifle, underscoring the broader impact of illegal breeding on our community. And whereas we extend our sincere gratitude to the APS team, Rudy Tovar, Sergeant Christine Watkins, and Brandy Fuse for their invaluable expertise, as well as Carly Halbert and the CAO team for their support in making this operation a success. And now therefore, we the mayor and the members of the Las Vegas City Council hereby proudly proclaim March 19th, 2025 as Operation Positive Change Day. We definitely want to hear from you. [Applause] Before I turn over the mic to Chris, I want to tell a few words to you about Chris's uh career in the innovation and technology world. And I will tell you Chris Craig's career u in innovation and technology spans well over 25 years. And it is impressive. In this time, he's held positions at every level of that industry. And for that reason, Chris has great respect from his staff that's behind me, co-workers and other departments, and certainly from the industry as a whole. Besides his working career, Chris also did quite well on the education side. And similar to his work history starting from the bottom and working himself all the way up. Chris earned degrees, associates degree, a bachelor's degree, a master's degree, and on top of that, he's been an instructor at both UNLV and at Porterville College in California. Essentially paying it forward to the next generation of IT professionals. And um with those types of credentials, um I'm just pleased to present them to you today. And I want to mention uh besides an army of IT team and behind me uh Chris's wife Myra is here as well to support him on this special day. So with that I'm going to turn it over to Chris. Um, uh, Mr. Yang, managing member, ward six, Miss Brunie. Uh, Miss Oh, who's Okay. Would you please state your name for the record? Yes. Good morning, madame mayor and city council. Darcy Adelby, business licensing manager. Um, we're here with item number 39 for the denial of a permanent massage establishment license for Duo Duo Massage in W 6. Um, the applicant's council, uh, Kirk Kennedy is here. He has indicated that this location has closed and has been confirmed by our compliance team. However, we still would like to make a record of the activity that took place under the ownership at the location the short time it was opened. Um, with your permission, I would like to read that the record. Uh, in September of 2024, our staff conducted a pre-issuance inspection, provided education to the lency um of our Las Vegas municipal code. The following day, temporary license was issued on September 5th. Three weeks later, on September 24th, a follow-up inspection was found, um there were beds in the office and the break room. It appeared someone was living on site. The massage therapist on site did not have a license. Staff provided education once again to the Lency. In November, a routine follow-up inspection was conducted and found a newly locked hallway door that led to the massage rooms and even uh though no massages were taking place at the time, it took some time for access to be granted to our staff. Um, our license officers found condoms in the bathroom, red lighting in the massage rooms, and personal items such as toiletries, undergarments, and clothing in the shower room, which are signs of residential activity, with two lounge beds with fully fully stocked bedding in the back office and break room. Again, the massage therapists on site did not have a license. The following month in December on December 6, 2024, Las Vegas Metropolitan Police Department did an undercover operation where the undercover officer's thigh and groin area were touched after the UC the undercover um uh oper uh officer asked for sexual favors and the therapist told him to come back a different day. So, no arrests were made that day. But on February 7th this year, 2025, two months later, Metro did another operation where the key employee uh Yang Bay or Bay solicited for prostitution after his massage. Our staff was notified and a joint inspection was conducted where the interior hallway door was once once again found locked. The employee break room was still set up for residential use and alcohol was found on site as well. An emergency closure was issued by Metro and a and the temporary license was suspended. As mentioned, their council informed us that they have closed and withdrawn their application and with staff's recommendation of denial of the permanent license as per Las Vegas Municipal Code 6.06160, any person and/or entity who has been denied may not apply for a license or approval for suitability until one year following the effective date. Uh just Kirk Kennedy uh bar number 5032 815 South Casino Center Boulevard council for the ownership and yes they did vacate the unit and lease has been cancelled and uh so they've surrendered their application and they understand the consequences. Agenda item 40. discussion for possible action regarding the denial of a permanent massage establishment license for Golden Class LLC DBA Luna Massage at 7350 West Cheyenne Avenue Sweet 102 Sarin Moon Zang Managing Member Ward 4 uh Miss Palinski um councilwoman I almost made you a congresswoman I apologize for that I apologize um would you care to Yes. Uh, Darcy Ali, business licency manager for the record. Um, so item 40 is for the denial of the permanent license for massage establishment golden class LLC doing business as Luna. Um, Luna was first uh was issued its first temporary license in March 2022 following multiple inspections conducted in the subsequent months. The business was found to be in compliance and a permanent license was granted in November of 2022. However, in August of 2024, an investigation showed that Lal Luna was advertising online for illicit massage services and sexual activities. As a result, an undercover operation was conducted on August 22nd, 2024, during which a Las Vegas Metropolitan Police officer received a massage and was solicited for prostitution. After this operation, our staff along with the state Nevada massage therapy board did an inspection, found evidence of residential use on site, including finding bedding, personal toiletries, undergarments, clothing, and a fully stocked refrigerator. Metro issued an emergency closure requiring the business to meet with the city with city officials. After a meeting was conducted on September 23rd with the applicant, licensing, and the city attorney's office, the business was allowed to reopen based on the assurances from the owner that this was an isolated incident and that stricter oversight would be implemented. However, one a week later on October 1st, 2024, we received a complaint forwarded by the massage therapy board that G. Wang, the mother of the Lency and the key employee of the business was operating the business and facilitating the illicit acts. Our office did an inspection on October 4th and found a newly installed locked door hallway leading to massage rooms and also found G-wing on site along with personal items. On February 7th, Las Vegas Metropolitan Police Department conducted an undercover operation during which the UC was again solicited for prostitution. Our team did an inspection after and confirmed the employee room laundry room were still set up for residential use and a notice of violation and correction notices were issued in the amounts of $849. We received an application on um February 10th for a change of ownership transferring the entity of Golden Class LLC from the bis the uh business from the husband Xiao Bay Zang to his wife Sarin Zang. However, because of the ongoing violations and the fact that Sarin as the key employee was acting in the capacity during the previous in u inh department reviewed her application and deemed it not eligible to qualify for a temporary license. We ask you to consider the denial of the permanent license as per Las Vegas Municipal Code 6.06160. Any person under entry who has been denied may not apply for a license or approval for suitability until one year following the effective date. Thank you. Thank you very much. I'm here today with my client, Mr. Xiaoi Jiang and his wife Sarah Linen Jang. Xiaoi is spelled X I A O B A I Jang Z H A N G and then Sarah Lin S A R A L Y N Jang as his wife. I wanted to provide you a little background um before your decision here today about my client. Mr. Jeang uh is the owner of Golden Class LLC. It's a Nevada uh limited liability company that he had formed back in 2023 in order to pursue the effort to open this massage business here within the city. Uh it was licensed and and oper operational as of I believe April 2023 and have been going since that time. I wanted to give you some background on Mr. Jang. Mr. Jang uh presents to you someone who uh came here from China uh in 2010 when he was only 18 years old. He came here by himself uh to try to make a life for himself. And not only did he just come here to uh try to make a life for himself, he gave back to us his new country. Uh and he joined the United States Army in 2015. Uh he became a member of the US Army Reserves, worked his way up to an E5 rank. I think that's like a sergeant equivalent to a sergeant rank. and within the US Army Reserves based primarily in California. Uh he uh provided services uh mechanic services and training as well as worked with the Army Finance Department with the reserves. Uh he was actually a member of the reserves until August of last year when he received an honorable discharge uh from the the US Army. He gained his citizenship in 2017. Uh he works in the finance industry and he has worked with a private accounting firm here in the in the Las Vegas community. While in the reserves, he met his wife Sarah Lynn, who also came from China in 2010. Uh different part, so they didn't know each other, but they met each other and struck up a relationship that's resulted in a marriage uh last year. Uh she joined the reserves as well in 2016, and she's still a member of the US Army Reserves and she's a registered nurse uh and uh works as well as a hospice nurse at a a hospice facility here in Las Vegas. So you have I wanted to make it clear to who the ownership was. I think sometimes with massage businesses they there's all sorts of negative implications including about the owners. But this is not that. These are two US Army uh veterans. One's still in there. Uh these are citizens. These are individuals who came here from another country and they have shown what an entrepreneurial spirit is all about. They came here uh gave back right away to their country, joining the army, serving our nation. They didn't have to do that. Uh they become citizens and they're still trying to work hard and do things the right way. Uh they he decided in 23 he tried to open this business. His mother is here and she was going to help out with the business. Uh unfortunately that has caused some issues uh as far as management and oversight. But uh he started this small business here within our community. it was approved by the city uh as a way to give back and also to try to make something of himself uh with with an extra business that he could oversee and manage and develop here within our city. Uh in late last year, well in August roughly last year as the business license representative has indicated uh they did have some trouble there. They did have an indiv individual who was arrested and then this happened again with another therapist relatively recently and I've talked with my client about that about you know what's happened here. Clearly it's it's a question of of selection of who your therapists are and also a question of uh of oversight and management. Uh every therapist that is hired by the business has been a a licensed Nevada massage board uh lency. They're they're allowed to give massage services. But as you all know, even with licensed therapists, some negative things could have happened. And that happened here in this case. And I've talked with my client as well about what could be done if given another opportunity. Here we are. It's he's already had one opportunity. I get it. And and here's the the second bite of the apple or the third that that we're looking for here. Um I've talked to my client as well about what could be done as far as selecting better therapists, better training, better background checks. Uh also the management and oversight. Uh Sarah Lynn uh Shang is now able she was applying to be a co-owner uh with her husband uh with the city and that application obviously is kind of in limbo because of everything that's gone down but she's now in a position that she can be at the business on a more regular basis. His mother was there when the the arrest incidents had occurred and it's unfortunate that and I'm not we're not trying to blame his mother but the fact is uh the motivations are a little different um between his mother and Mr. Jang as far as oversight and management of the business. Uh I've now have a confirmation from Miss Jang that she can be there. She has the time and the effort. That's one of the reasons she wanted to become a co-owner of the business. Uh so she could be there more often and have a stake in this not not just with her husband uh but to support him and to support this business. Uh so I think that they they definitely realize one thing. Getting a license uh is a privilege not a right. Becoming a citizen is a privilege, not a right. And they had to go through those steps. You have two individuals here who've given back to this country. They're trying to do it the right way. Obviously, uh minority ownership here. So, you have veterans, minority ownership trying to make something of themselves here in the United States and to further their goals of of becoming more successful. Uh I my client has indicated as well that if um I was granted another opportunity there will be greater efforts at management and oversight in addition to the greater background checks on who the therapists are are and who who who is being hired. Obviously this can't happen. Having individuals arrested is is more than just a little no no. It's a major breach of trust between the city, which grants a license, and the massage business owners that they have to have more stringent uh levels of management and oversight. And I believe my client and his wife, they both understand that. What we're asking the city council to consider today despite this history which has been laid out uh is to allow a the issuance of a six-month temporary license subject to any conditions uh deemed appropriate by the city or by business license and allow a six-month period of time for them to make some changes here. Show some proof, show some more good faith due diligence and to prove that this can be done the right way. There are massage businesses in Clark County and in the city which you never hear from because they do things the right way. This is not a business, a type of business that is inherently flawed, that has inherent issues with character and the people that work there and own them. There are many massage businesses that get their license, they pay their annual fee, and nobody hears anything of them because nothing happens there and they do things the right way. My clients are trying to do that. Obviously, they need uh the city's assistance with this with the grant of a temporary license. We understand how we how we come here had hand in hand having uh he went through a previous matter last September uh to try and stay open. But my client is determined to uh do this the right way to show good faith. And we are asking the city to show some back to this veteranowned, minority owned business and allow a six-month temporary license with no obviously with no issues or concerns that happened during those six months and we'll come back here in 6 months or whatever deemed appropriate and then I make the pitch that they showed their good faith. Can we get a permanent license or do we continue it on on a temporary status? We're asking for this opportunity for my clients. Thank you very much. Thank you, Mr. Kennedy. Yes, sir. I am also filling in for my partner Jennifer Lazovich, who has been called away this morning to Carson City to attend to some legislative matters. So, I will do my best this morning to fill in for her. Um, as indicated, we are representing Trioint Homes on a proposed single family detached residential project. Uh the project is just to familiarize yourself with it is located as you can see from the aerial on the north side of Kyle Canyon Road west of Shamber and south of Rustin. Um what we have before you is a uh development that really has two parts to it. Can see the site is bisected by a log cabin. On the north side we have a proposing 34 homes. Um works out to a density of about 3.2 units to the acre. To the south, we are proposing 68 homes. That works out to a density of about 3.5 units to the acre. We started this entitlement process about a year and a half ago. Uh Trip Point has been working with Councilwoman Brun and her office as well as planning commissioner Jennifer Taylor during that time period. And during that collaborative uh effort, um we now believe we have reached a point where we're providing a very nice uh product for your consideration. Um during those uh discussions there was a lot of uh discussion with related to an amenity plan. Um we have tried to emphasize that here blowing up some of it um entryway where we're going to have uh not only amenities but active amenities in this case a volleyball uh park and associated uses with it. You can see kind of a more of a blowup of that as well. We are going to have provide a walking path which is along our northern portion right here. It does have benches and and dog stations and etc. Um so again, not only is it open space, but active in nature. We appreciate uh planning uh recommendation of approval and um at least planning commission's recommendation of approval and we agree to all of the conditions contained in the staff report and more than happy to answer any questions you may have. Here on behalf of the applicant, this application is a request to amend a previously approved site development plan review. The subject site is 8.83 acres and we're located near the northwest corner of Smoke Ranch Road to the south. Uh somewhat to the northeast we have Rancho Drive along with the North Las Vegas airport and to the west we have North Decar Boulevard. The site was previously approved in August of 2018 for a multifamily residential development consisting of three phases. We have phase one to the north which is completely constructed. We have phase two to the south which is currently under construction and highlighted in yellow is phase three that we're before you on today. Uh just in developing phases one and two. The developer has um determined that there's some changes that they would like to make to phase three. Included in those changes are um an increase in the units for phase three from 224 to 252 units which still puts us significantly below what would be permitted within the um zoning of R3. We are including threebedroom units which weren't a part of the previous approval. We are increasing the studio unit counts. Uh there is a reduction in parking from uh 376 to 355. And to help address that uh parking reduction, we do have a cross access in uh cross access agreement and parking agreement with phase two or phase two to the south uh which is currently slightly overparked. So that'll give us um some more spaces. We are increasing the clubhouse size just to add additional space for future residents to enjoy and also host their guest. Um, and we are requesting a special use permit to increase the height of the building from um, 35 ft, which is permitted, to uh, 38 ft. That same request was approved for phase 2 to the south in October of 2022. um in working with the council woman uh to help address concerns of maintenance and landscaping. We are in agreement with um uh with recording, excuse me, a declaration of private maintenance requirements um to make sure that the landscaping on this site is maintained uh moving forward. Additionally, in working with the planning commission, we are in agreement to a condition to add 36-in box trees along the frontage of Rancho instead of the 24-in box trees which were previously approved. Uh we feel that this site will be a nice addition to the area. Phase one and phase two have turned out great. Um and we're excited about building and developing this one as well. Uh, so based on that, I thank you all for your time and consideration and I'm here to answer any questions you may have. Uh, thank you, Miss Green. May I have a staff report? Yes, Madame Mayor. The applicant is proposing a modification to phase three of the multif family development that have resulted in a need of a parking variance and a special use permit to allow heights to exceed the airport overlay limits that staff uh is not able to support. The applicant has indicated a share parking agreement with phase two of the multif family residential development. Phase 2 provides 536 parking spaces where 533 are required for phase 2 only which is in excess of three parking spaces. While additional parking spaces are available, a variance for the reduction of parking in phase 3 is still required which staff does not support. Therefore, staff is recommending denial of all applications. If approved, staff would like to add the following condition of approval to 24-0667- SDR1. And now, bear with me. It's a it's a little lengthy, so I'll try to get through it as quickly as possible. Prior to the exercising of the site development plan review as expressed in title 19.16.100 subsection J, the developer is required to record a declaration of private maintenance requirements uh parenthesis DPMR as a covenant on all associated properties and on behalf of all current and future property owners. The DPMR is to include a listing of all private owned and or maintained infrastructure improvements come along with assignments of maintenance responsibilities for each of the subject sites landscape areas. Come including but not limited uh to perimeter landscape buffers, parking lot landscaping and foundation landscaping. and is to provide a brief description of the required level of maintenance for private maintained components including but not limited to building elevations, parking lot striping, trash enclosures, and driveway pens. The DPMR must be reviewed and approved by the City of Las Vegas Department of Community Development prior to the exercising of the site development review as expressed in title 1916 100 subsection J and must include a statement that all properties within the subject site are subject to assessment for all associated costs should private maintenance obligations not be met and the city of Las Vegas be required to provide for said maintenance. I have uh been involved with downtown Las Vegas for a long time with convention authority for 24 years and since 2009 with many events that are historic iconic for downtown I believe in the downtown area. I've uh met with many of the council in the past. It's good to see Nancy again. Uh Mayor Prom Kudson. Uh what I'm going to talk about is basically to say thank you to two people that have gone out of their way to spend time with me. First would be you mayor Berkeley. you uh spent some quality time with me in a meeting in your office. I explain everything that I do. You were very enthusiastic about the ideas of bringing more to Las Vegas. Uh in the past we did 10 years from uh 2009 to 2019 Las Vegas cars. Over 100,000 people would watch the procession as it would go from Shelby downtown. We raised tens of millions of dollars. In 2022, I was very lucky to receive the Presidential Lifetime Achievement Award from President Biden for my contributions to the charities and what I do for Las Vegas. I've also created the iconic Abigail Crossing, which is over in Fremont East working with Mike Nolan, and that is in Councilwoman Diaz's uh jurisdiction. And then I believe the other would be in Councilwoman Summers Armstrong with the Fremont Street Experience. So, I want to thank you for your time. Appreciate it. I'm a magician who travels to Las Vegas to be part of its thriving magic community. um to learn from my mentors and as part of my self-educ education. I perform on the Fremont Street experience following the guidelines set by city ordinance 11.68. However, my experience has shown enforcement on Fremont Street is anything but fair or consistent. I have personally been targeted by security enforcing arbitrary madeup rules and have that have no basis in the city code. For example, I was cited simply for having a small dolly despite the fact that it was folded up and stored in my case. There's nothing in the ordinance that prohibits this. yet it was still issued a criminal citation. This pattern goes beyond just security. The city marshals instead of ensuring fair enforcement of the law frequently issue citations without checking or validating whether a violation of 11.68 has occurred. Rather than upholding the ordinance as written, they act on security's arbitrary decisions leading to wrongful citations and unnecessary legal burdens on performers. In some cases, I've been threatened with unlawful arrest. Now, I I am facing the burden of returning to Las Vegas at great personal expense to defend myself against a charge that never should have been issued. My case is still forthcoming, but the very fact that I must fight this demonstrates a serious problem with how these laws are being enforced. This is not just me. It's about every performer who comes to Las Vegas to share their art only to be subject to intimidation and arbitrary enforcement. I urge the council to review these practices, ensure that the city street performers who follow the law are treated fairly and that our due process is respected. Thank you for your time. You know, we got to build for people to live. But, um I'd also like to um another big one is just touching up on the homelessness and cleaning up the streets. That's another big one on my heart because um you know as I was looking at um you know the topics at hand you know it see you know um Vegas is growing always and uh as you know as new comes in I feel like the old should be kind of just dispersed around properly you know if the funds are there to purchase like some vehicles for rehabs, churches and stuff like that you know and um yeah I just wanted to just introduce myself and look forward to working with y'all. Um I'm a performer on Fremont Street. Um my only issue, uh I can only speak for myself is that first of all, I do respect the integrity of the maintaining a professional environment. Um sometimes they have a three-day event like St. Patrick's Day and we're kicked out for the whole 3 days. And I was wondering if we could just limit it down possibly to one day. I'm not an attorney. I don't know all the particulars of how they come to their decisions, but it's how it's done. And they have an area called the free zone, which we're not permitted to perform in even doing a three-day festival if that could possibly have some leniency for us to be able to perform there. I've been a street performer on Fremont Street for the last nine years. Recently, the Fremont Street LLC have been displaying from very abnormal behavior. Last weekend, for example, they closed all of the circles. Now, 1168 108B2 says that no fewer than 25 circles will be available. The only time they can close the whole street is when the street is closed from the public. They have a permit. They go by the startup, the setup date, and the tear down date of the permit and disregarded the time stipulated in the permit from 12 noon to 11:00 p.m. They took away our ability to participate in expressive ability for 72 hours. Everyone's and they did this twice. this they did it for the new festival and they have intention of doing it again in the near future. This is not how the ordinance was designed at least this is not the ordinance that says on the website. Please take a look at this. We need your help. Thank you very much. Thank you so much. Williams Elementary, Doris Reed Elementary, Ali Deetweiler, Rainbow Dreams Academy, Matt Kelly, and Kermit Booker Elementary School. The kids had a blast. We had a blast reading to them. Uh it is just so fun to read books and uh we I encourage parents to please continue to read to your children as often as possible. It opens up their little minds and helps them to dream big. Um, we have an upcoming event next Saturday. Um, that this Saturday, the 22nd of March, there will be a spring cleaning. We will be partnering uh with the Southern Nevada Regional Housing Authority to beautify in uh his in historic West Las Vegas. Uh we'll be picking up trash in the neighborhood. We all have unique traits and strengths and have an incredible opportunity to impact and give back to our community every day. Uh next up, this past Saturday, I hosted another successful shredding and medication disposal event for my Sun City Summerland residents. My staff, the city events team, and folks from Shreddit clocked a record of processing over 300 cars in the first hour alone. March 19th is the birthday of Dr. Margarita Greta Madden Styles, one of the greatest leaders in the field of nursing certification. It's also International Read toMe Day. March 19th is also celebrating International Read to Me Day. It's an international campaign to advocate for children's literacy and build a community, to support, to empower children with the gift of reading. It fits in perfectly with all of our experiences reading over the last uh couple of weeks. It was super fun at all of our all of our schools. I had to read to a whole grade. I don't know if anybody got that, but an entire grade. Yeah, me too. For three classes. And we have Bruise with Brian coming up. It's on Tuesday, March 25th at 5:30 at the Bagel Cafe. Um, our our topical area is homelessness. We're going to be talking with our Moore team and our DPS team. Uh, but we're going to be super crowded. There's a lot going on in that field. So, if you don't like crowds, this is not the one for you. Uh, call me and we'll we'll get together individually. Uh, because there's going to be a lot of people here. There's a lot to talk about. So, I'm just going to share some things we've been up to on last Saturday, uh well, not last Saturday, but Saturday before last, it was International Women's Day on March 8th, and it was amazing to celebrate our sisterhood um there at East Las Vegas Community Center. Thank you to La Campina 96.7 for their support. Assemblywoman Selena Torres also stopped by the event. And a huge thank you to all sponsors and organizations who made this event possible and who attended and your presence made the day's activities and festivities truly special. That same morning, right before I hit that event, I went to the ribbon cutting of Republic Goods um and we have a new female um entrepreneur, Noel Hurst, who opened um a secondhand um goods store. And I invite everyone to go. It's kind of like a co-op. She's renting closets to over 70 different individuals who curate those closets. And uh there's no need to buy new. You can just go find some really good um gems in Republic goods off of Main Street. So uh please find them uh in our fabulous arts district. Uh on March 12th, we had a wonderful potluck with Mcnite seniors. And I always love to get my time in with my seniors. Um, and we've been able to stop by when many of them are having birthdays and they love to play bingo and win raffle prizes. So, always love to give to them. Uh, that same day, Wednesday, March 12th, in the evening, we had a Steuart Avenue complete streets public meeting. Uh we're about 30% design of the improvements that are going to stretch both councilwoman uh Summers Armstrong's ward uh from Sixth Street and then once we hit Bruce on the other side it's Ward three and it goes all the way to Nellis. So we're going to basically be reinventing and reimagining that avenue. And um I want to give a shout out to all of our city staff for the amazing presentation and taking the input from the residents. But I also want to put in a plug for Parametrics. Parametrics is a technology company that was able to provide what the renderings currently look like that the the improvements we're looking to do on Steuart. So you could see it 3D Google maps with what it's going to potentially look like and then you could also put on VR goggles and kind of play around with stretches of the streets or things you're interested in seeing through the lens of improvement. Um so I just want to thank everyone who had a hand in that. It was absolutely mind-blowing and amazing. Uh March 12th is a really busy day. On that day, uh earlier we were able to um attend the official historic designation of the home located on 1433 Cottonwood Place as a Huntidge home. The house, one of only three determined individually eligible for historic listing, was constructed in 1944. Um and Mr. Stodall, Dr. Sebrandt uh the owner wealthy Silva and I took part in the dedication of this home uh to our Las Vegas historic property register because it retains it its integrity of location, setting, feeling and association and it is located at its original address and due to the retention of the original modest size evokes everything that a historic home of this um of these many years that was built during World War II should. So, congratulations to Miss Silva on being added to the historic register. Uh, Tuesday, March 11th, we had an awesome community workshop um at East Las Vegas Community Center. You can see all the folks to the left who parttook and they found that it was very helpful to de-stress and let your creative juices flow and listen to an artist. Adri Rosio was in town, the artist that's responsible for the beautiful mural on East Las Vegas Community Center. our collective strength has no boundaries and so we wanted to take advantage that she was back in Las Vegas to do a community workshop and everybody loved it. We also partnered up with uh UNLV and at UNLV's Barrack Museum of Art, she was able to uh basically talk to us about what it means to be a woman muralist um from Mexico and all of her uh creations and struggles and challenges and how she's been able to grow as an artist. So, I just wanted to thank everyone, UNLV, our fabulous East Las Vegas Community Center staff, PLT, the Consulate of Mexico, and all of the attendees for making um these two events absolutely amazing and inspirational. On March 13th, we were able to u partake in a Jonas Park walking tour. I want to thank Alan Rogers, board member of the Nevada Preservation Foundation and proud resident of the historic Jonas Park neighborhood for graciously giving the City of Las Vegas team an excellent tour of Jonas Park's history on the wetest day of Las Vegas. We learned uh interesting facts about the homes and past residents of the oldest homes in Jon Park that date back to 1931. Eric Crawl, board member of the Jonis Park Neighborhood Association, also joined the tour and shared the unique design components of the newly installed Jonas Park signs that you can see here on the right hand picture um that the the neighborhood association designed collectively and we the city helped them uh place them. We still have to relocate some signs, but we're working on that. But that was all accomplished through our neighborhood partners fund. So, if you're a neighborhood association, please look out for that opportunity. If you want to do something collectively, the neighborhood partners fund is an awesome way to get the funds and you just need to match it with your work. Um, on Saturday, March 15th, we hosted a wonderful cleanup and block party at Gary Reese Freedom Park. Thank you to all the volunteers that helped us collect 194 pounds of trash. Even though we keep our grounds pretty tidy, there's always so much more to collect. Um, and to the community partners that taught us how to better be stewards of our environment. The Wilderness Society, Indigenous Voices of Nevada, the Solidarity Fridge, Nevada Plants, Somos Wantes, Mojave Max, and Clark County Parks and Recre all helped us out with this amazing feat. Um, just for these events coming up, you and the family are invited to the third annual free art and resource fair supporting mental health and self-care through the arts and live music. Stop by the historic Fifth Street School this Saturday between 10:00 a.m. and 2:00 p.m. for this very special event co-sponsored by the First Friday Foundation and a grant from the National Endowment for the Arts. It's Art You okay? It's its third time. I hope that you guys will all attend. Um on Saturday, March 22nd, meet and mingle with neighborhood associations from W 3. We're going to have um this awesome event, too. Share and learn about things that you could be doing with your neighborhood associations and your neighbors. I can attest, I've called into it at late last year and uh had to wait only a couple of minutes versus uh the lengthy time that a lot of residents had communicated in the past. It was great celebrating Nevada Reading Week with the outstanding students at Strong Start Elementary School. Interacting with our next generation of leaders gives me great joy. I was honored to be recognized as one of the honories of the outstanding women of the year award ceremony. Standing alongside an incredible group of women whose achievements continue to uplift and empower our community. I also want to congratulate Jerry Schroeder for being one of the awardees. I visited Kitty McDonald Ward Elementary School to present Cub Scout 500 with the certificate of recognition for their outstanding leadership service and commitment to insights into local politics, the voting process, and the role of a council member so they could learn so they could earn a merit badge. These kids inspired me with great questions about local government. I was also excited to be invited as a speaker at the Nevada Hispanic Group. I also presented them with the certificate of recognition celebrating their dedication to supporting Hispanic and non-Hispanic businesses, driving economic growth, and fostering strong community connections. It was an inspiring afternoon surrounded by passionate leaders and change [Applause] makers. Next slide. Last but not least, good morning everyone. I wanted to start today by highlighting some of our recent events. We were thrilled to participate in Nevada Reading Week last week. I attended Clyde Cox Elementary School and enjoyed hanging out in Mrs. Parker's kindergarten classroom. This was an extra special time for me because Miss Parker is a resident of W 6 who actually used to babysit my kids and read to them. So, it was a wonderful circle of life moment to see Miss Parker and read to her classroom kids. Last week, I was thrilled to particip to celebrate St. Patrick's Day with the seniors in Ward 6 who attended the lunchon hosted by the Centennial Hills Active Adult Center. A call out to Jen Blanchard who always plans the menus, cooks all of the food, and decorates so beautifully. Thank you to Maggie Plaster for joining the festive celebration. As the vice chair of the Southern Nevada Housing Authority, I was thrilled to be joined by my colleagues, Mayor Berkeley and Councilman Sha Shandra Summers Armstrong to break ground on 201 affordable housing units in Ward 5. Thank you to the Michaels Company for your interest in building a beautiful community complete with amazing amenities like a dog park and barbecue stations that will serve the residents and their families. Looking ahead, we have some great events you won't want to miss. First, join us next Wednesday from 6:00 to 8:00 PM at our Centennial Hills Active Adult Center where our community connections meeting will be focused on the topic of HOAs. We've been getting a lot of questions about HOAs. So, we're thrilled to be bringing to our residents a panel of experts, including the Nevada OMBbudsman for HOAs, as well as representatives from our city's code enforcement department and legal team. Bring your questions and come meet your neighbors. Next month's Bokeaditos with Bernie will be held on Thursday, April 10th from 9 to 11 at our Centennial Hills Y satellite office. Then we'll be hopping into spring with our annual spring fling pet parade and classic car show on Saturday, April 19th from 10:00 a.m. to 2:00 p.m. at Floyd Lamb Park.
