hope everyone's doing all right we will start with our invitation is there anybody that wishes to give us the invitation up here or out there I'll be happy thank you we remain standing as will be followed by Pledge of Allegiance let's pray father we thank you for uh giving us this opportunity to serve you through the works of of of your kingdom do the work of Greenwood C be with us during this meeting that we may make great decisions to be able to glorify your kingdom in your name we pray amen [Music] amen to the flag of the United States of America Republic for it stands one nation under God indivisible with liy and justice for all appears that we certainly have a quum we confirm that yes sir it's clear all right thank you in accordance with the Freedom of Information Act chapter 4 title 30 code laws of South Carolina 1976 the agenda has been posted on the front door of City Hall and notification of this meeting has been given to the news media all right first up looks like we got our minutes consent agenda motion to approve consent agenda second I have a motion by Mr Miller second by Mr Dean any further discussion with the approval of the consent agenda it's been read all in favor of approval of the consent agenda all right that motion carries unanimously seven votes first up on the agenda tonight we would like to request an executive session please all right the basis for it is is on the screen we have any hearing motions um motion to enter executive session for the receipt of legal advice related to a pending threatened or potential claim with possible action after coming back to our regular meeting second motion by Mr Miller second by Mr Bass any further discussion about going into executive session all right all in favor of going into executive session for the receive of legal advice related to appending threatened or potential claim with potential action upon a return the motion carries unanimously to seven VES session and I guess we need a motion to go back into our regular meeting I think we're good we're good yes all right first thing we have up moving forward is public hearing on ordinance number 23-14 yes uh this is a public hearing uh to amend the zoning map by rezoning approximately. 35 acres of land located at 97 cury Drive West from neighborhood commercial to General commercial Miss Hut is abstaining from this item thank you m Goldman you want to give us a little background before we I'll be glad to give you an overview um as you stated earlier it's um adjacent to the property owner also owns the piece just to the north of it in the photograph and we took it Planning Commission at the August Planning Commission meeting and the total amount of land is. 35 Acres um the request was to go from North Car North Carolina sorry I'm tired um neighborhood commercial to General commercial the piece that he he you got the cursor right now that's actually General commercial now so the piece below it is the piece it acquired also and wanted to expand the business both using the land and expanding the building that's on The General commercial property right now he didn't have any room to expand that property because he already he was already meeting the not meeting the setback as it was so um this is the way it was when I went out to take photos prior to the Planning Commission meeting he was originally reported for having um vehicles on site and the entire parking area in front of that building which used to be a tire store um which meets the zoning that you can have the auto s service and everything in The General commercial but not neighborhood commercial so he brought the application in to rezone it when I went out to take pictures prior to Planning Commission he had moved some of the cars around and it was it was he had done it neatly as compared to what it was before the application came in but um we looked at it on a couple of different levels we looked at it because of the surrounding zoning I did talk to one of the property owners that was nearby and he had no concerns with it because it wasn't coming that close to him um the biggest thing for us was the uh future Lan use map shows that is future commercial development and it was clearly shown that way it does not distinguish between neighborhood commercial and General commercial so um we we made a recommendation to to support it because he was going to combine it with the property he owns both of them and if you're going to combine them rather than having a split line down the middle of where the property line used to be we felt like it was a better option and the Planning Commission supported it so I went back out after the last meeting and I spoke with the mayor today and I told him I said he took everything on board as to what was said at the last meeting because it it was absolutely clean and pristine and in front of the building was cleaned up even more so so this is the way it looks currently um again we had recommended staff had recommended approval in the first place and Planning Commission did support it we did not have a lot of opposition at the Planning Commission meeting but um if you have any questions I'll be glad to address them you said you didn't have much did you have any opposition actually I don't think we had any make sure I don't think I brought the minute with me but I think um I don't think we had anybody signed up to speak in opposition we did have someone ask questions um and in fact the one gentleman said I'm not here to oppose it I just want to know what's going on um let me think and there was a building on there at one time but I think you you were all aware of the fact that it had burned and that had been cleaned up so that was one violation that been on the property and I don't know that Mr Masters owned it at the time that it burned or not but that had been cleaned up and code enforcement had gone out to check on that and it was after we found out that um the business had kind of expanded onto the property that we contacted them and said it you could rezone it that's that's an option for you but um there were there were a lot of concerns that have been made known since that time is there I drove by there today it looked uh REM remarkably clear is there are there still any violations on either of those Parcels not to my knowledge I was there Saturday and on Saturday I did not notice anything that I would have flagged as a violation if that property is going to be used for storing any vehicles um and using you know expansion of the business which would was the other idea um it would have to be screened and the land language of the ordinance says that it has to be screened so that it's not visible from the adjacent RightWay or the adjacent Property Owners so they'd have to have screening materials that would keep you from looking through the fence slats to see it and then again we the language of the ordinance also says you can't have more than five unlicensed vehicles that you're working on at a time um that were store that could be stored out there if they're licensed you can have them but they have to be licensed and registered so the screening would be for the the partiel he asking to be reone why does he not need screening on the existing parcel is it grandfathered in you mean where the building is right um because I mean that's basically his parking I got you because the the building goes right it goes all the way of Main Street yeah anywhere anywhere if that if that piece even if he combines them which I would recommend that you combine cuz is one of the things I'm trying to stop here is having any businesses that don't have some sort of a building anchor on there I don't want businesses that are just on property that you can't go and address someone on site for anything that you see um one of the other things I did not bring up when I was just talking about it is that one of the things that made me more comfortable with saying that General commercial was okay right there even though it was adjacent to residential is across the street where you go back into some County zoning across kirsy there there are some light industrial uses back in there so we do have established light industrial uses that are literally across the street from the property well M we may have some more questions for you but right now does anybody have any other questions from Miss go thank you thank you all right is there anybody that wishes to speak in favor of ordinance number 23-14 me Richard if you can just state your name and your address for your record just one second I got pack where everybody's open clear understand than if you want to take a look at that before I before I start off go ahead and start there's a lot here so we'll we'll let you get started and you can direct us to okay what we need to look at but if you can make sure just for a record we got your name and address um first of all my name is Richard Masters um I live at 550 East crestle Avenue here in Greenwood um I've been Greenwood resident for 59 years that old but so I've been here all my life um so um I purchased this property at 97 CTC Drive U roughly about a year ago it's a very small lot it's only 35 of an acre but it's essential that I need this for parking and there's no way I can expand or grow or do anything without some additional parking and also um I've been in that building for about eight years and the traffic down South Main Street is getting busier and busier and busier it's very very difficult to get in and out of this um this the lot my building um is 7,950 square ft it's a big building that consumes um 95% of the property so um the property that I purchased next door I tried to I've tried to purchase that property for the last eight years finally um the gentleman that owned that property was his had his um I think his childhood home there he wouldn't sell it at any price he passed away and I was able to obtain that property so now we're trying to get to the point where we can expand the building um on the far um right hand side of the building the um convenience store has purchased that property so I can't grow that way there's nowhere I can go there and U they had a U-Haul lot there at one point in time so pretty much what I'm going to have to do is add on to the building to the left left side and because it's so tight in there that's just kind of when you say the left side facing it facing it from Main Street like where my cursor going so so yeah and one of the great things about having this extra property is it touches um kiry kirsy and I can make an entrance on off of kirsy um what I what I do at that shop now is I'm uh I do automotive repair Restorations of course I've been in the car business all my life and I'm try to retire from the car business but um but anyway have a love for automobile so we have an automotive restoration shop there and um so if I could add on to the building to the to the left hand side facing it from Main Street that's where I could that house the the extra extra CS that I would have um and the the the building on I mean you talking about something attached to what's already on your your current structure I mean I just right yeah I'm I'm talking about actually literally building up to the side of it to the structure I'm assuming that's going to take some regrading cuz it's kind of a it's a little bit is I'm going to have to excavate some dirt out of there and not exactly sure how far and and what we're going to do like I said this is kind of the next step to kind of see what we can do um but but that's the plan excavate out some dirt not all of it but enough to add on to um not not we're going to add a tremendous amount of but we're going to add some so um but you know one of the things where you know it it it looks like and and and and I I realize we got The Foundry Park going across the street and I respect that and you I look forward to it so I know we got to clean this mess up we've I've I can't even tell you how hard I've worked to try to clean this this up and get these cars out of here and get get this stuff cleaned up um but we like said we when when we have cars that I call barn finds that we find and we bring in on a trailer they usually come in on a trailer they look like hell and you know we get them off we take them in and and restore those things but it takes some when that car that trailer comes in and you have to back that car off it takes some space to do that and I really need that lot to be able to do that um so that's kind of where we're at at this point any other questions than you any questions for Mr Masters thank you Richard we would you like for me to walk you guys through the the stuff that I showed you here we got that the dog trouble to do that so we'll take it take we'll take a quick with the that if you have time the first uh the first six pictures are surrounding properties so they're going to be properties that are that are commercial if you look at the the one very the very first picture that's Jr's food Mark which is to my right hand side in the corner and then the second page is the um the back of Jr's food Mark um third page is Brewer uh Brewer Enterprise which is a Car Lot next door to me page number four is where Mr Brewer expanded his car lot onto a residential lot that this Council change to um General commercial so he could he could expand there that's the number four there and you can see there was a house back there so I'm not asking for anything that anybody else hasn't done um page five is the the there is Mr um Brew price again page six is a um piece of property that's right behind my property that's a Pallet Company I'm not exactly sure what they do with the pallets but they do something back there with them and um that's that's industrial now you look over at page seven that's the horrible ugly house that used to be back there that um some that a v set on fire they used to be oh it was own this piece of property yet and so we tore this house down removed it it's completely gone and in its history so if you look at page eight you'll see where the house used to be and you can see we cleaned it off it's all gone I still have a little pile of dirt there that I got to do something with um but that ugly eyes sword is gone it's history of course page nine is just another view of that looking back towards the p place so we've cleaned that off and graded that like I said i' still got to take some dirt out we'll go to page page 10 you'll see the front of my business and you'll see when you I have I have two curb cuting one that enters right in front of my business and when go in and out of there it's it's it's dangerous to get in and out of that area you have to kind of swing around and what we propos to do is to to Asphalt or concrete out this other part so we can get have two curb cuttings as you can see it there is actually a second curb cutting already there on that piece so we can get in and out of there the part that I'm going to add on to the building on is over there where you will'll see my tractor up against the wall that's where we're going to we're going to add on to that and so anything that would be an eyesore would be you know would be quickly put inside um if we take a look at 11 that's kind of just another picture of that and let's see 12 uh page 12 that's that's a picture of the front of my business and the the lot and course you can see there is a there's a different grade there that we're going to have to do but we still want to be able to to get in and out on kirsy drive and then page 13 is basically what I'm doing now it's it's just a picture of uh some of the classic cars that we have what we restore and what we do so pretty much wraps it up yeah well Miss colan if she was aware of any violations like I said I went by there today um both the properties were remarkably cleaner than I remember having seen them are you aware of any current violations that you have no no take care not anything that I know of back to where you say you're going to attach something to the building say that again you say you're going to attach something you're going to build something attach certainly hope to um what you going to deal there we're going to just we're going to try to come off the same roof line as you can see to the left hand side of the building you're just extending it we're going to try to extend it straight on out which means you can see yeah that area there where that where that red truck is sitting we're going to have to extend that out there to just create some more space and to get out there we really need to we need to join these two lots I need to put this point .35 of an acre together with this so that we can make it all have a setback issues yeah I would have a setback problem I wouldn't be able to get this out here I think there's a I remember correctly I think there's a 5ft setback um so that's just that's just what we need to do and so we're you know we're the last I guess commercial property coming that from that way to before you get into the to the The Mill Village there all right thank you any other questions for Mr Master appreciate it uh what do you plan on doing with these cars when you start building the on you got hi behind the track right there the ones that got hid behind the track about 5 car behind the track okay well the the first first truck out there is a it's a work truck that we we have and um I don't car some up five cars that you took off the heel up there and you put down there and hidden behind the tractor well the two the two that's closest to the building are I don't know you know you my automobiles but they're but they're one's a 70 1978 El Camino and I think the other one is a 1970 or El something like that they're going back in the building to be restored we're also working on the inside of the building and in order to get this stuff that we need to do on the inside of the building we got to take the cars out for a little bit um those cars are you know I mean I know that they might look like junk to you but they not junk to me um but those all those cars anything on that lot there is going to be either sold restored or or something along those L um but I'm not that's not a jard I don't think I don't think see allow anybody um there's just no way you can do that anyway if you wanted to do that even if this changes The General commercial it does doesn't change the fact there's no way I can do a junk yard there I mean it's obvious it's obvious there's a part going across the street and you I bless that and it's obvious that can't have you can't have more than four or five cars out there without tags we're not going to have them that's just I mean obviously I understand the rules you know and but for many many years you know we were able to do that and and and and that wasn't a problem so you the part's coming it's a problem now so we'll we'll address it that's why we need to B on to the building that's why we need to we need get this zoning changed we're not asking to go from General commercial to residential we're just going neighborhood commercial to General commercial not a I don't think a big step but anyway that answer all right any other questions for Mr Masters when you when you finish restoring and plan to sell do you usually go to auction or do you most of our Sal most of our sales honestly are done online um I've sold very few here in Greenwood um if I do decide to sell cars I have property on the bypass in the county and more than likely in all honesty and all fairness I can take them from there move them two miles over in the county and they bring a lot more money so I just haven't had a whole lot of luck selling any cars on that location and getting any a decent price so I don't see that happening um but a lot of those cars that are sold are that they go online and they're sold to somebody out of town usually thank anybody else thank you Rich okay is there anyone else that wishes to speak speak in favor of this proposed ordinance make sure I got let the record reflect there another is there anyone that wishes to speak in opposition to this proposed ordinance Al I saw your hand up yes ma'am come on up if you state your name and address for the aane again 207 George Avenue uh I live in the city limits of Greenwood and I know a little bit more now after hear him speak than I did prior but I still feel that aesthetically even with screaming even with the only five cars if if I heard him correctly he said barn finds to me that is a junky looking car and on the south end of town we we would like to improve the looks of our area and I think that that would not do our area Justice I wrote a lot of things down but after hearing him speak I'm not going through it but I think that um I know that resoning would benefit the owner but I think that the Community should come first and I think um that the the benefit of the community should outweigh the benefit of a property owner and I just don't think it would be aesthetically pleasing to the eye even with screening because when you go buy something with screening you know automatically there's junk behind it and um you know I'm aware that he's situated with a task on something to do but I don't think the city limits of Greenwood should be the place to do that I think restoring barn finds and older cars should be in another area and we do have pride most of us have pride in our homes and our yards on the south end but we have so much going on that's that brings our property values down and I just really don't want to see it get any worse I mean I would like to see it improve not go backwards and I would just like for the the property owners to have you give more weight to the property owners of the community than one parcel that you that might need to expand a little bit it's not like it's expanding it a lot it's not going to be benefit the City of Greenwood it the only thing it can do is is is take away it's not going to make that area prettier uh it's not going to raise their home values at all and I just think that there are other places and I'm aware that he purchases property but I just don't think that's the place to do it and since I live on that end of town I prefer it not be there thank you Lane anybody have any questions for m k appreciate your time Miss gy she I that for nothing and G 258 wi with circle Greenwood and thank you for answering some of the questions and concerns that I did have but I'm not going to be like her I'm going to say what I had to say even though um it may not apply at this time but thanks for allowing us to um Force our opinions about the property that is being reson in the area and sir we are by no means trying to negatively negatively impact his growing his business but we do want to preserve the surrounding neighborhood and the south end of town by continuing to improve the appearance and cleanliness of the area and as he mentioned there's a new park being developed on Foundry Road so we want to build on that Legacy and to continue to move forward in that area there are already several buildings on the other end of kirsy that are old and dilapidated so we don't need another isore in the area to bring our property values down and our concern is that area would be over run by junk cars but he has promised us that that's not going to happen and I'm sure Carol you're going to you're going to mind with that right so we shouldn't have a problem so if we have a problem we come to you yes okay all right so as a realtor I know that junked cars in an area is the first thing that brings the property down so we don't need that in south end of Greenwood cuz we already got two two um junk cars on 221 and they are in eyesore so we don't need another one so if um you have any reason or if any junky yards are being located we ask you to move it North not South C we got enough there and no thank you we don't want we don't need enough thank thank you is there anyone else that wishes to speak in opposition to ordinance proposed ordinance number 23- 014 all right let the record reflect there nothing we have a motion with regard to ordinance number 23- 014 I make a motion reject the request right we have a motion by Mr Ables to deny is zing request is there a second all right not here in a second you hear any other motions motion to approve the or the new zoning with the idea that and the promise that Mr Masters is going to do all the things that he has promised neighborhoods that he's going to do and we will hold you accountable I don't know if we can do that Kevin I didn't mean to threaten you it's not a threat but he just said to make sure that you follow that you stay in guidelines with the ordinance that is that the way it appears that you're going to do all the things that you that within the ordinance that you promised for the neighborhood because as you heard they do not want it to go back to the way it was prior to you taking the time out to clean it up they want you to continue to clean it up and keep it clean and not Park junk cars W cars and all those kind of things since you are on the watchful eye maybe I put it that way Tiffany did you get all that the SM motion ever I have um you don't have to repeat it thank you it's it's essentially a motion to approve ordinance number 23-14 motion by Miss BS second have a second by Mr Bass and now is the time for the discussion I just add to what Miss bu said and and just more in a the thought that all the things that were were promised I think are part of our ordinance and that those things can be followed up on with code enforcement so exactly um yeah we've got the law we got the ordinances in place currently it's um and I certainly I think I speak for everybody appreciate the the the cleaning up of the area that's been done thus far it does look remarkably remarkably better um you know I I guess there a couple questions you know the the existing I mean we're talking about um we're talking about this specific property but the one that's adjacent that's currently General commercial Carol can you tell us how long there there were violations there that were uncured in the where he acquired it or the the the the building that he' owned for 8 years it was like that when I came here I've only been back a little over a year but I mean it there were too many cars parked out on the on the drive and you could tell that it was overloaded but I think that's before he undertook the effort to clean out the building and organize it better and that's one thing he said when we met with him that he was trying to do was to better use the structure even though even at that time he wanted to expand it but I do want to say that we have been actively in the county pursuing junkyards and trying to enforce those even some that were declared years ago as being grandfathered that's been something that's been on our agenda and we have a couple people that are working daily at going out and looking at them and and taking pictures and sending letters and we're we're determined that we're going to get rid of a lot of them at least clean them up let me ask again about this screening requirement um is that a condition of this one specifically or would screening be required anytime you're operating a an auto mechanic shop and you're you're asking to be reson to GC if the adjacent use is residential or a a lighter commercial then yes you would have to screen it I mean that that's my heart work is I I I do agree screen's great but I mean you do kind of know what's not that you're seeing it but um it gives the indication that there's something else back there even though again you know if he's if he doesn't have tags on he's got a dealer license so we can put dealer tags on there even if it's screened and he doesn't have tags on there he's in violation well if he has more than five more than five if he has fewer than five then we wouldn't have a problem well think has to screen the entire property that's one thing I said before and it was based on the assumption that the entire property was going to be for vehicle storage if he's expanding onto the property then the building's going to take up some of that area um the only area I would say would that would have to be screen would be if anything triggered the need for it to be screened okay's not doing anything that reques it doesn't necessarily have to be screened just in and of itself it's what he's doing that's going to require the screening so let me let me ask you this the the five cars on the property is that for any one property any any Automotive property yes so currently he's got an automotive the existing property with the buildings he can put five yes with this he could put five more but if he were to uh unite those Parcels then he's back to five then he's back to five for the total parcel right so combining the properties would actually reduce the number of vehicles that could be out there but see that's what I was saying is I need them to be combined because I don't want to have businesses that are just on a piece of property without some sort of an office or some sort of a business base for the structure or have a structure I mean the only only thing that property could be used for it's a small portion of it could be a structure but the rest of it you cannot build a structure underneath it because of the transmission lines exactly you can't have you can't have a structure under those transmission lines that's an Eastman he's got room to push the building out to that point but he can't go farther than that he could park Vehicles as long as um I was going to drop back to my long history and say s Cooper but as long as the power company if it's cbw D power or whomever as long as they're okay with what's out there then they just need to be able to get there in the event that they have to do maintenance but they will not let you build a structure under it and you have to have a clearance point to the sides of it as well so they what we'll do is if he comes in to expand the building if he if he's able to combine them and he comes in to expand the building we'll have to look and see where that line is going to be and then draw off straight down from that point and just just briefly M Master do you are you planning to combine those two lights I'd like to absolutely okay and I'm okay with the rule only five just kind of changing things making things better and said I'm well aware of the parks going across there and I understand I want to see South Greenwood grow and improve so I'm on the same page with everybody else um I'm I'm not opposed to that I also have to take into consideration you know we have a repair shop there you know sometimes sometimes you know and I don't I don't fix wrecks we don't have any wrecks or anything that but sometimes cars come in with and and screening on the screening on the front of that building would be almost impossible concrete out there and there the driveway when the driveway it's just not it's just not it's not enough room the screen on the front if want to screen to the back there's no need to screen I think the screen would be ugly I think the screen would be unraced and there's nothing that need to screen there not going to be anything there that's going to be there per I can't say that customer customer customer comes in they're going to have a tag on the car that car's not going to sit there but mostly needing that to be able to travel through there and be able to turn things around thank you you know the back the back thank you what M question was ask make why long why it took you so long to decide to do you to clean it up around there and if we I can answer that you know the same reason that a lot of people can't get a lot of stuff done it's finding the right employees to do that I don't know if you no this but my my old but's been out there working my I can't hire people to get out do that guess what I don't you remember it's cold out there now but July and August was and you know it difficult difficult to I saw you there at 8:00 one night moving cars around yeah all right thank you thank thank you I'll tell you what I mean does anybody need bring Mr Masters I mean I think probably appropriate thing is to bring him back up if we have any further questions I'm good I'm good thank you you come no thank you look at the ugly building that I got we got you thank you um any further discussion regarding ordinance number 23- 014 there's a motion second M any further questions for Miss Co this oh is reone General commercial what can be put in General commercial anything not anything the same things that can go next door but I mean there's there's a limited list of what can go there but my point in bringing out the zoning across the street is that the on the other side of kirsy is not some of that's not the city some of that's the county and that's actually industrial right so um anything anything where you see the the bright green is General commercial and it does allow a lot of uses but it does not specifically go beyond what he's doing now it allows that and allows other things as well but if you want me to read from the ordinance I can bring it up I just wondering if this don't if he decided to change it I we change the zoning he he put anything about just about he wants so right there from what I understand you can put anything from a church to a liquor store right but he can do that on his property as well did you do that NE it's it's not it's not that General commercial is not already in the area it's just not on that one parcel and he could do some of that stuff with neighborhood commercial too you do more M so neighborhood commercial does allow with the with the right of way there wouldn't be much to space the build on anyway to bring that second point of Ingress and agress that's I'm I'm asking questions that was asking me yeah okay any other questions for car thank you Mr all right any further discussion regarding ordinance sorry I left my purse out there Mr SES we we got Che down for 5 minutes yes sir hello my name is I'm the resident at 216 SW Avenue my family has approximately 40 acres in Ed South Carolina um Greenwood police came out there say they was search stolen property um policy 3274 request outside assistance I want to see the request that was made for as County to assist Greenwood in this search there was no public worlds on this property no arrest was made no paperwork was shown to any of the property owners I fil the complant the next day which is 6:30 22 at 11:45 I was stopped at 12:10 leaving Greenwood Police Department for a third break light I was told that my hair smelt like marijuana and that my driving license was suspended the car was searched no marijuana was found in the car or anything else to their nature I was placed in the back of the police car where there was a baby seat at the back of the police car Wasing my brain of motion I'm on disability I've been there for about 7 years the car seat located in the back of the police car asked to be moved it wasn't policy 7.4 states that personal property in the vehicle should be approved from the chief of police or the division Commander where the request was made by the officer I would like to see that to determine if this a public police vehicle or do the citizens provide this vehicle to the officers um I was pulled over again on edfield street at 12:30 at night 2 days after Christmas the temp was 25 below I was stopped for a Headlight by the officer the officer came up to the vehicle as for the license of registration he goes back to his vehicle he stated nothing El but license registration officer theor comes up to the vehicle on the passenger side he said that he smell over marijuana I have my kids and my wife in the car with me at this time the officer told everyone to exit the vehicle a female officer was never attempted to be called officer the lawers pretend to pack found my passenger female policy 3124 section F states that a officer or the opposite set should be reached or try to be reached in order before a search can be conducted I want to see a copy of his search report states that he tried to reach out to a female offic my kids was in the cold for several minutes with no jacket on and my female passenger was search as I stated before i f a complaint with Mr mallister the mayor he said quote all policy protocol was followed and I have found nothing that would say otherwise just a quick search of the Greenwood police policy I found several violations which I stated below I want to see the council to cify to clarify your policy the violation that I brought to you board today I would like a follow report if possible if you have no policy on searching of people who our keeps are there and Implement weather or I also want to see how your policy is to deal with a person with limited Mobility or disability in their range of motion I've read the entire polic these situations are not stated in the policy please clarify and I have reports from that 1220 traffic stop the reports made by Mr mallister and Mr Adams are totally different and I want a independent followup review to State what actually happened on that day and see why their police reports are so different thanks for your time and your patience I will be looking forward to see this response thank you Mr s thank you all all right next up we got under new business item number one is to consider approval of the audit firm for uh the next four years which is 2023 to 2026 uh we received two bids uh for our audit uh one from Manley Garden one from Malin Jenkins which is a firm that operates in the Southeast they have an office in Columbia um the low bidder in this situation was Mal and Jenkins um the city staff is recommending approval of M and J as the city's new AIT for the next four years these services will begin on with the 2023 audit which would begin at the end of this year all right do we have a uh a motion make a motion to approve mod J as the city's new auditude for the 2023 2026 audit years second all right we've got a motion by Mr Dean second by Mr Miller um any further discussion regarding approval of the audit firm recommendation just to just to confirm we we discussed this a little bit previously the there the low bidder there were some there were it was somewhat of a sliding scale depending on services offer Apples to Apples in this particular comparison I believe um uh mainly garage's bid was 170 over the same 4year period um it's it's not exact because there's some variables but that's the best average I could get over the 4year period is the 111 compared to 170 so um that's for those services but odly enough caring the exact same Services right do enough if we were to remove some of the requirements from Sarah Manley garens was less not less than right Mar Jenkins but was less than their 170 it was slightly less than Mar Jenkins but internally after staff discussion we felt like it didn't behoove the city to remove those services from the finance director um we would have been looking at expending 150 ,000 over four years versus 111 over four years we didn't feel like the scales tipped enough to make that Financial recommendation to council you we did look at the fact that manland Garin is a local firm they're a city business we looked at taxes they pay you know business license taxes they pay and the fact that they are um Community engaged I just don't think um unfortunately that you can justify that large of a gap you know Council recently approved um this is a 5% variable right in our new procurement ordinance that if you have a bid within 5% you can offer the the job to the local business this is way outside of 5% um and also as Professional Services go council is not required to select the low bidder however in this situation M Jenkins is highly qualified to do the audit and I believe their price is fair thank you sir anything you wanted to add about that covers it thank you any further discussion regarding audit firm recommendation all in favor of the all fir recommendation as presented motion carries next under new business item number two is to consider approval of the 2024 city council meeting calendar that was distributed in your packet and also we provide you with an updated cic tonight which just clarifies that there is no work session in July do we ever oh it's right we approve this year Advance before um yeah we usually approve it around this time okay I'm not sure if I've actually ever put it on the agenda before but I felt like it was a good item to just have you all clarify and yeah I'm live but no work session adult I'm just kidding if you guys really want to have one we can put it back on it's up to you you get to approve the calendar that one's not historically we don't um have one we have not had a work session in July well it says but does it not in the packet I think there's an option but in this one that I updated today there's oh I got you yeah got you so the one in your hand is the one we're asking you to approve and the only difference is there's no work session in July the um Barbecue Festival is what weekend in 2024 it's this this the um I think it's the 12th to the 12th through the 14th start or 11th through the 13th it's got a regular meeting set for July 15 we always had the regular meeting well yeah but we had in the past gotten rid of our work session because it was going to be within the week or week after we we just typically as a St just were asked if Council would consider foregoing the work session in July even though some weeks it isn't right on top of it it's not the same week you still have the Fourth of July holiday you have that Festival that we're planning uh there just a lot going on in that brief two we period and it's just um it's it's a consideration of council that staff would request should we leave the regular meeting July 22nd like we did we didn't do that is the there's always a meeting the Monday after the festival false that is not true true it's always we always have it we can move it Ryan Ryan will you answer this question okay so that my question then will be do you want it that's why y'all got so badad at me a few years ago the only discussion that's ever been is about the work session we've never asked Council to cancel the meeting not cancel no canel but we might have moved it before it's never been moved this is the I said why don't we have this meeting so we can Zone curb side collection is going and uh I I really want to give Ryan a pat on the back he has worked just tirelessly with this um holy smokes and so he's going to give you a quick kind of rund down on these slides yeah there's not there's like three slides so um so here you have this is this I'm sorry I didn't mean to change this to the go ahead okay so code enforcement started the scouting process that's going through the Zone sequentially identifying all the waste types all the non-compliant piles on October 4th believe that was a Wednesday they started in zone six you can see here how many um piles of waste they identified in each Zone and by type so 73 piles and that's through um we were about halfway through Zone 10 on Friday so that's 6789 and half of 10 they're 73 piles you go and they're doing a great job they've misidentified probably less than 3% of everything and so when you're talking about rolling this out we they we have to make sure that they're on the same page as uh our sanitation staff too so there's been very little that we've had to go back and have them follow up on um which is very encouraging um and they're obviously like I said before they're they're passing out those FES that Draper made that you've all seen I didn't that should say October 6th yeah Julie corrected me but she incorrect me cuz it said today and I thought anyway yeah anyway so we didn't actually start the um collection process with the route Optimizer until uh Friday October 6th we had I rode with somebody all day Eric Michael um and Austin we all we rode with all four drivers um so you can see here so far it's been a a success um we've decreased the average cycle time for each one of those zones by about 35% um so it's certainly you know proving um it's it's working the way we wanted it to and the drivers have um you can go ahead and go to the next slide so staff's responded very very well to it uh I think our code enforcement staff is liking the new structure that they've had in in their day um I know our our all four drivers on the curb side are really liking um just feeling more efficient and just taking the the the monotony out of driving up and down every single Street they have direct points they're going to now it's obviously making them much more efficient too so obviously this is a very small sample um and once people start getting pulled out you know we start running a leaf truck this cycle time is going to drop again which shows The Importance of Being fully staffed um we're still down a couple drivers so once you start a leaf truck you're only going to have one person that's has a CDL that's on um a knuckle boom so you know it's it's just parly of course things are going to slow down a little bit but relief collection this year hopefully we're not going to get it as behind because we're identifying those piles in advance too so we're going to use the same system it's just one driver collecting something different um but uh very encouraging so far we just wanted to give you a quick update we're going to bring some additional recommendations to you guys at the retreat yeah thank you um here is all the events Tiffany emailed us out on Friday I just wanted to highlight couple that are coming up we got the state of the city on October the 31st I believe Tiffany's heard from everyone at this point that is attending she's registering everybody um Laura has her Uptown annual meeting tomorrow at the Museum um there's a litter pickup coming up on October the 28th in Miss BS wward um and we're meeting at Brewer the boo bash is coming up on the 26th and then we also have I don't have a for this but we also have the um Shriners in town the 27th and the 28th there'll be a parade Uptown on the 28th down Main Street and then there will be a concert at the market at 5:30 on the 28th so busy busy month uh there's the the scarecrows are out if you haven't seen them already you know go around take a look at them that's the Shriners are putting on that concert the 28th and we're assisting uptown's giving a little bit of money uh uh tourism is giving a little bit of money and then they're putting in a little bit of money so gotcha good that's always a good good event those Shriners do some good things that's all the comments oh I did we did we're going to delay the eight tracks vote uh just so we can discuss that a little bit further Thursday and Friday and then we'll put that on the agenda in November all right we're working on the budget I was hopeful to have a draft to you guys today my goal is to have it out to you by no later than Wednesday so at least you'll have it before the retreat David you you're aware of our Retreat it hasn't been we haven't sent it out yet because there were so many like we had a joint meeting we had this meeting now so once this meeting's over tiany will send all that out but yeah it's Thursday and Friday it's a good time man come on right um well we'll trash time ter this past weekend had a good number of people show up and we picked up a lot of trash um even though we've done that one Sample Road and those areas related to that in the past year it needed to be completely redone and um I think some of the volunteers went on over to Little Road on W five right after for that to be able to do a little pick up over there too so um it was a good time really really appreciate everybody's help yeah thank you Jonathan for for being B that hate I wasn't able to to be there it is frustrated when you clean up some of the same roads um but um you know there there were there I think there was a proposal to go out of the sea limits which you know anything is a gateway into the city we want to clean it up but I'm glad we were able to clean up within the city appreciate that Miss B what's going on in war three well you know no news is I hope it's good news I haven't gotten um many U that many complaints about trash or anything just want to invite everyone to join us on the 28th for trash pickup um meeting at the old um Center on the 28th I think this be I put my tablet up was that for 9 I think we moved it up to8 8:30 8:30 8:30 8:30 to 10:30 that's right all right come get your steps in come get your steps in got a lot of lot of streets to cover was my day I wish my day um Mr Dean how we doing in war two a little bit better but uh no complaints nothing new all right I like the optimistic um approach everybody says we're doing a little bit better was is it 6 for six WS that we're doing better well for the trash pickup yes um for other things I've got my neighbors are up in arms soing yes they are so um I'm going to be presenting to them the new proposals it's went from r10 to R4 which is a big that's a big jump um but basically the H the amount of housing dropped just 10 houses with with the change and um you know the clear cutting has already started because that's not the Builder but it's the landowner is has a right to clearcut the Timber and so they are clear cutting the Timber and so the 30 foot um perimeter supposedly the buffer has been cut down and so now the Builder is going to have to guess replan so that's why I'm still hoping that we can get some sort of tree ordinance so some of this doesn't get all clear cuted before it gets built so is this this is the um per se it's U Marshall and what I found very interesting reading the packet in memo is that a subdivision that um several people in Mr Dean which is so close to mine it's just like a my word it's like a flip and it it all affects that that um zoning that was dropped on Marshall Road across from Wesley commin on the other side is now resuscitated and it doesn't come before Council because guess what it is there is no zoning change because they can do it R4 with the cluster so that's additional traffic all on that Corridor and additional homes so that 1987 was kind of Staggering something like that 18 1867 18 excuse me I got my numbers so but are the immediate neighbors um yeah they are so my question is this you know we uh looked at that piece of property up by North Side Marywood and we decided to vote against it because we're our resources are stretched in so these new developments that are just coming in without coming before us you're still stretching our resources is there like nothing that can be done to talk to these people tell them look we we can't service these areas I mean there's already zoned it's already zoned for it yeah if it's already zoned I mean I think that's kind of one of the reasons why we denied that knowing that there are areas that are already zoned for people have the right to develop well that was going to be that going to be annexed I mean these are properties the properties we're talking about are properties that are already in the city of all the properties of all properties that were doing I believe only one was annexed into the city with the which was Seven Oaks everything else that's being developed were properties already in the city limits am I correct or not which one street okay excuse me rid was Annex to yeah [Music] okay Park was already in the city Spring Street was already in the city brenwood Hills the part of brenwood Hills we annexed back in the city that was not in the city either so so we oh yeah that was not that's your word it's probably about 5050 yeah and I think so a lot of the new a lot of the stuff that you're thinking of are like things that are they're a little more contiguous with what we already have and it's not just like some random thing that we're pushing out you know where we already don't have nearby so should be a little better it's still going to be an interesting process to see how we can well I mean in theory the revenue from the taxes from new residents is what funds additional staff to like if you if we use public work staff as an example if you need additional public work staff to expand service because your population is growing you use the revenue the tax revenue from those new houses so it's like chicken or egg but not really because you you I mean if we had the ability to hire the new people we would hire them now right because we could use them but if you you can't really hire them without the revenue and you shouldn't hire them until you have the revenue so until the houses are built and they start paying taxes there's really I mean I'm not saying there's no reason to hire more people but I'm saying we you know if you go ahead and say oh there's 2,000 units approved we better hire a bunch more people in a perfect world that would be great if we had Revenue to do that we just don't and so until you have the revenue coming from those houses that are built and lived in and somebody's paying taxes then you don't hire the new people until you have that money a lot of these new neighborhoods don't necessarily aren't going to require the same level of service either cuz like we're talking a lot of them are clear cut so there's not as much yard waste uh I mean you use an example like Milford Pines there's very very little bulk waste coming out of Milford pin so use that as an example I mean it's still going to be we're still going to have to address our capacity but hopefully it's neighbor have their own HOAs that probably say you can't put that kind of we have very few we have very few collections in like using Milford pond you can't you can't put furniture and stuff out there a lot of has HOAs both of what you seeing the neighborhood of H is is yard was yeah do you have any like further information like the expansion in Brentwood Hills my question about that is every house in Brentwood Hill is a traditional brick home and this new person whoever's going in there to build are they going to keep that the same or are they going in there whatever they see there was a lot of back and forth about this and the way that it's so that gosh I hope I don't get this wrong that back portion was not part of the PDD so there was no requirement for those properties to be a certain faide the developer did agree to do bricks on brick on three sides to the ones that are adjacent to the existing neighborhood so extending into the new NE the new portion brick on three sides he may continue that design all the way through but he's not required we we we there's a lot of discussion with that we negotiated reason we Annex that in is to get some certain concessions like that because they could have they could have built whatever they wanted to the county and so we V that they in the city we annexed it to try to protect them from some uncertainties I felt like towards the end of that's my word I felt like towards the end of it they were appreciative that we were annexing it and that we had done so much work with them and that was collectively that was everybody um that we had that we were doing what was in the best interest they also have only one entrance and exit to their neighborhood and it goes next to a body of water that they consider a dam and so um um I just uh you know there's there's a lot to do with that with with that so I even but they're I think they have very open dialogue with that devel ER so um and I and I think that's been a very positive thing and I and i' he's he has called me occasionally about certain things and um most recently was um you know and specifically about some engineering stuff that he was waiting to hear back from and how it was going to impact that project so um he's been communicating with me they've been communicating with him I think everybody seems to on the page on the same page quite a bit yeah he really does get go out his way to try to communicate all right if there are no other Council
