The first item on your agenda is a presentation to acknowledge the re-accreditation of our Public Works Department by the American Public Works Association. This marks the third re-accreditation for the team. Pursuing national accreditation like this ensures that we're employing accepted best practices and operating at the highest standards. I'd like to invite Juben Pakpur APWA Director of Region 8 to present the accreditation plaque to Henderson Public Works Director Lance Olson and his team, and also a few other plaques recognizing some recent awards. After some comments, I'd like to also invite the Mayor and Council to the gallery to join for the photo op. Welcome, Mr. Pockpore. Madam Mayor, Honorable Council, thank you so much for the opportunity to be here to speak about your Public Works Department. My name is Jubin Parkpore. I represent the public works professionals in the great state of Nevada, California, and Hawaii, Nevada being my favorite to travel to. I'm a volunteer. I represent the 6,000 members in these great states on the National American Public Works Association Board. There's 35,000 of us all throughout the United States and Canada. This is one of my greatest honors to be here to present this accreditation. There's only 225 agencies let me repeat that, 225 agencies that achieved this accreditation throughout the United States and Canada. Thousands and thousands and thousands of agencies out there, Public Works Department's 225, I congratulate you for your reaccreditation. Now, you folks and the other folks in the in city government know when things go wrong in public works. You get the calls from your citizens, your constituents, when your kids can't be dropped off at school, trees are down during storms, but you don't get the calls when things are good, right? When everything is functioning perfectly in the public works department, no one very rarely calls in and says, good job, I got to drop off my kid at school on time. My drinking water is working. So how do you know as elected officials if your public works department is doing a good job? You know when they're not doing a good job, you get the calls, but how do you know when they're doing a good job? And I'm here to say they're doing an exceptional job. This accreditation is tough, tough to get. Hundreds of applicants come in on a yearly basis, and like I said, there's only 225 that have achieved this throughout the United States and Canada. When we do this reaccreditation, we look at 100. for this particular recordation we looked at 111 different practices in your public works department and each of those have sub practices and these aren't just check boxes where it's kind of fill in the blank yourself we send in folks to come and verify if you're actually doing, if your department is doing this work. And not that you don't get enough California people showing up, but the two folks that came in to make sure that it was done were from California. So I appreciate your hospitality for us California boys. And you're one of the few agencies, and I shared this with you before this, that achieved 100 percent. 100 percent. And I've given these presentations. I've only run it across that one time, 100% verification. So great job. And lastly, I want to say that there's two model practices that we're actually going to take back and share with other public works departments. You're doing such a great job at these practices that we're going to Hopefully you're open to sharing this stuff with other departments because of the great work you're doing in your finance and CIP ranking and also for traffic operations. So great job. So I wanted to just say congratulations to Director Olson with you and your staff on this recordation. It's a tough, tough process and I'm so happy that you were able to achieve it. And congratulations to City of Henderson because this is a monumental achievement. I also have with me today two project awards that the city was has won and I'd like to invite folks from the chapter to give those awards to your department also congratulations all right Andrew Howard Westwood and we're happy to present the award project of the year award Conference fall 2025 for structures, projects less than $5 million for a fire station 95 renovation, as well as the water street shade structure, historic preservation project less than 5 million. So congratulations to the winners. While everybody's lining up, if I could just take a second. Thank you APWA. Thank you, Public Works team. This has been a journey for us. We actually welcome it in Public Works to kind of revisit every five years how we do things, how we can do them better. In Public Works, we don't say, well, that's the way we've always done it. That's not acceptable. So it's been great for us to take the time to look at what we do, and we want to keep doing it. I do want to do a special thanks to Michelle Howard. My address is 7787 Eastgate Road, Hinnerson 89011. THE MICROPHONE IS NOT TURNED ON. IS IT ON? IT'S ON. OKAY. I'M SORRY ABOUT THAT. Today I want to speak about how we treat volunteers and dedicate their time in serving the community. I have served on multiple boards and committees for over two decades in case and then the service ended, it was because I chose to step down due to health or work obligation. I have never been removed from a board and I have never seen a situation like this. I believe deeply in civic engagement and always encourage residents to get involved, participate, and help strengthen the community. My wife Patsy shares the same passion. She was born and raised in Clark County. We work in Henderson and committed to serving the families and the students here. We show up, we participate, we take care and deeply in the people that live in their community. Volunteers do not get paid. We do not receive benefits or political influences. They give their time, energy and talent because we want to make the community better. They deserve to be treated with transparency and respect. In this case, Patsy was told that the board needed a different skill set, yet she is extremely qualified with multiple graduate degrees and nearly four years of teaching students here within Henderson. She stepped up to serve just as many residents and workers are encouraged to do. I have met many of you in Grand openings, community events across Henderson have always supported our city leadership. Up to this point, I have never questioned how the officials represent our city. However, it is difficult to believe that Councilwoman Larson removed Patsy because of a lack of qualification. She is extremely qualified. My concern is the decision that has been tied to personal associations connected to me rather than Patsy's service and ability. And this is not how volunteers should be treated. And it is sending a discouraging message to the people that want to contribute to our community. Let me be clear. We are not challenging the council's legal authority to make an appointment removal. The authority is not in dispute. We are here because process matters and public records matters. When a volunteer is removed in a way that does not reflect the truth or communication that took place It undermines the trust and discourage future of people that want to volunteer. I want Henderson to continue to the city where transparency, fairness, and integrity are standard. We are who work to support the community, feel welcome, and serve confident and treat with respect. Thank you for this time, and thank you for serving our community. Next person is Patsy Zimmerman. Good evening, Mayor, City Council members and members of the community. My name is Patsy Zimmerman and I have served on the Henderson Community Education Advisory Committee. I'm here tonight to respectfully correct the public record regarding my unwilling departure from the committee. On September 24th, I received a formal letter from Councilwoman Larson stating that I resigned and that this resignation was confirmed during a supposed phone conversation with Councilwoman Larson on September 17th. I want to state clearly, no phone conversation ever took place and I did not resign. The only communication I received was text message from Councilwoman Larson informing me that a change was being made to the committee. I replied, I understand. Thank you for the opportunity. To be clear, the response was to the portion of the message thanking me for my willingness to serve while acknowledging that change was necessary for continued growth, though I was unaware of what that change might be. It was simply a polite acknowledgement, not a resignation in form or intent. Later that day, I received another message from Councilwoman Larson asking me to submit a resignation email. I then replied asking for clarification because the original communication did not ask me to resign. It stated that a change was being made. I never received a response and I never submitted a resignation. I fully recognize the council that council members have the authority to appoint or remove advisory board members at any time. I'm not disputing that right. However, I would like to remain on the CAB board. My purpose today is simply to ensure that the public record reflects the truth that I did not resign and there was no phone conversation confirming a resignation. I also want to affirm my qualifications and commitment to this community. I've been a teacher in Henderson for three and a half years. My academic background includes a bachelor's degree in English with a concentration in creative writing from UNLV, a master's of English in creative writing, a master's of English in rhetoric from National University, and I am currently pursuing my PhD in business administration with a focus on homeland security leadership and policy. I value public I value our city and I value accuracy in public records. It matters that volunteer service is documented truthfully and that residents who raise their hands to serve are treated with transparency and respect. I'm grateful for the opportunity I had to serve and I will continue to support education and civic engagement in Henderson with professionalism and integrity. Thank you for your time. I represent the Veterans Action Foundation, which is a subcategory of Military Order of the Purple Heart, Chapter 730. I've come here to present a certificate of appreciation. Once again, Ralph McTamara from the Veterans Action Formation, which is a subcategory of the Military Order Purple Heart 730. I'm here as the representative, as the president, to present a certificate of appreciation to the mayor and city council for all they do for our organization which helps veterans throughout, not all Henderson, but throughout Nevada. It's a great privilege to be able to do this because as an organization, a non-profit organization, we don't really have the ability to give gold coins or something like that. So the way we show our appreciation is through certificates and our heartfelt great appreciation for all you do. There's many things that I could go on saying about what the council and the mayor do. They've been so helpful not only to us like I said but to many many veterans living in Henderson and throughout Clark County. So I would like to present this certificate to the mayor and I'd like to also introduce my vice president Judge Mark Stevens and board member Joe Averrore. So you have the Marine Corps, the Air Force, and the Army. So this is the certificate, which is a small number. presentation to you and the council for all that you guys do. You provide support for us when we have an office. You provide support for us when we have events. The only thing I can say from deep down in my heart is I don't have the words to say how grateful we are. Because everyone knows that freedom is not free. And the veterans pay for that. And the only way we have to show our appreciation to veterans is to have what we call a village of community partners. And you are certainly one of the biggest villages or village members of the community partners. And along with that, we have given each member of the council a challenge coin. Now, in the military, a challenge coin is given to individuals that go above and beyond for what they've done. So we appreciate everybody. and anything that you've done, thank you so much. And I hope my three minutes are up. be remiss if I didn't point out that both Ralph and Judge Stevens have committed countless countless hours in helping veterans in our community and this honor is it this recognition is truly an honor on behalf of the council members and I we really appreciate the work you do for helping our veterans in this community we have more than 25,000 veterans living in Henderson And every day I see you doing something to help them. And it's so greatly appreciated and so greatly needed. So thank you so much. This is an honor. And we greatly appreciate it. Council, the next item on your agenda is the City Manager's Report. We are proud to announce that our Parks and Recreation Department has once again received national accreditation from the Commission for Accreditation of Parks and Recreation Agencies and the National Recreation and Park Association. Our team joins an elite group of parks and recreation agencies across the country distinguished by excellence in operation and outstanding service. Congratulations to our Parks and Recreation team on this achievement. Congratulations to the Department of Utility Services for being honored by the Water Environment Federation with the Utility of the Future Today Award recognizing the department's exceptional progress and leadership in community partnering and engagement. This achievement reflects the team's innovative and forward-thinking approach to providing sustainable, efficient, and value-added services that advance our community's water conservation efforts. I'm proud to share that we have been recognized as a 2025 Thank you. research-backed employee engagement survey, which led to this award that recognizes our dedication to supporting Team Henderson's careers and overall professional growth. Mayor Romero served as this year's president of the Nevada League of Cities and Municipalities and Henderson was proud to host their annual conference last week. The event included several informative panels and presentations on key topics and an address by Governor Lombardo. We are committed to collaborating with municipalities across the state as we work together to build a stronger, safer Nevada. Thank you to Nicole Rourke and the Government Relations Team for their work to support the conference and the League. Mayor and members of council, this is a two-part item for laying use and zoning on a 4.2-acre parcel located in the northeast corner of Haven Street and Robyn Avenue. The land use change is from medium density residential to employment center and the zone change is to apply general industry zoning to a site with no zoning and to add the subject site into the Mosaic master plan. Planning Commission recommended approval. Mr. Amick. Thank you, Madam Members of the Council. Tom Amick, 1980 Festival Plaza. Also with me is Mr. Tassi and Mr. Marciano. We're here on behalf of Mr. Shetler. on this application, this is the current Mosaic Master Plan, which you have seen a number of times. What we are here for tonight is this five-acre piece right there that's highlighted in yellow. That is a piece that Vince has, and we did not put it in the master plan originally. But now that the master plan has been approved and everything basically between Shana and Villanueva is going to be industrial in accordance with this master plan, we want to add that five acres in. Item 34 is a public hearing, a major modification to development agreement DEV-2022-009469-A2 the Pinnacle Residences at McDonald Highlands, and the recommendation is to approve. Mayor, members, council, this is a major modification to the Pinnacle Residence of McDonald Highlands Development Agreement to extend the term of the development agreement, add a definition of project completion, clarify developer financing provisions within the development agreement, and provide developers direct and indirect lenders certain lender protections and cure rights. I'd like to thank everybody at the city for working with us on this major modification to extend the agreement. We're excited to move forward with this project. The funding source is the general fund, and it's for possible action, and the recommendation is to approve. Mayor, members of council, this is a request by ovation for cities to subsidize building plan check and inspection fees for the West Henderson affordable family apartment project, pursuant to section 19-1. .10, .4, .G, .5, in the total amount of approximately $235,165. This is one of the affordable housing incentives, and staff has been planning for this request for over a year. Staff recommends approval. Thank you, Mayor, members of the council. As you guys know, this is one of the first affordable projects to go through the Southern Nevada Public Lands Management Act, and Alan is very excited to be doing this project, and he just wanted to make sure that we that you guys know how much we appreciate this. There is no silver bullet to solve the affordable housing crisis that we're in, but every little bit helps and we appreciate you stepping up. It takes a lot of patience to do something like this. And item 57 is bill number 3879, a standard development agreement, DEV-2025-017382, Inspirata Town Center, North via Centro, multifamily, and the recommendation is to adopt as ordinance number 4117. The next item is item number 58, bill number 3880-ZOA-2025-017696, Zoning Ordinance Amendment Annual Development Code Update, and the recommendation is to adopt as ordinance number 4118. Good evening, Mayor and Council Dada. And before you tonight is the 2025 development code update, which includes 36 individual changes. In your backup materials, you'll find a matrix and a red line copy showing all of the specific code changes. Most of them are minor, like grammatical corrections or formatting updates, but I'd like to take a moment to highlight a few of the more significant ones. The first is a change to our tavern standards. We've updated those to allow the bar area to be enclosed if the operator chooses. This change came from feedback from several of our operators who wanted to fully separate the dining area from the bar. It allows them to better serve the customers who prefer the bar area experience only, while also creating a more comfortable space for families who just want the restaurant component and not the bar experience. So now they can do that. Next change is with our restaurant and bar standards. We've removed the minimum seating requirement when there isn't a gaming component. This provides operators more flexibility, especially those mom and pops looking to open a smaller restaurant space that also wants to include a physical PAR, so it's easier for them to do that now. We made a change to the freestanding signs by updating the setback measurement to the back of curb instead of property line. This will help reduce some of those modification requests for sign placement. Marijuana establishments, we've increased the maximum wall sign area from 25 to 50 square feet per elevation. This will help provide additional area for establishments that occupy an entire building rather than just a single storefront tenant space. And also in the most recent legislative session included several NRS changes that required updates to our development code. Four of them are included with this now and we'll continue to review additional changes for a future update. Lastly, a copy of the proposed changes was provided to the Southern Nevada Home Builders Association and NAOP. Staff also met with both of those organizations and went line by line explaining the changes and neither of them have any opposition to the changes proposed today. Staff has already been in work on the next round of code update revisions and I look forward to coming back next year with these changes. So with that, I ask if you have any questions. Thank you. Councilman Monica Larson from the Henderson Community Education Advisory Board. The recommendation is to remove Patsy Zimmerman from and appoint Jennifer Maddox to the Henderson Community Education Advisory Board. Mayor and Council, at the request of Councilwoman Larson, this item is for the removal of her current appointee, Patsy Zimmerman, from the Henderson Community Education Advisory Board and the appointment of Jennifer Maddox to that position on SEAB. Under Henderson Municipal Code Section 2.50.0406, E, a council member may move for the removal of any board member appointed by the council member. Removal is effective upon approval by the city council. Accordingly, city clerk staff recommends approval of this item. Thank you. Any questions or comments? Yes. I'll go first since this is my appointment. Sure. I've decided to make a change in my appointment to the Henderson City Community Education Advisory Committee. Therefore, I ask staff to place this item on the agenda to remove my current appointee, Patsy Zimmerman, and replace her with Jennifer Maddox. I want to thank Patsy for her service and her dedication to improving education in Henderson. Jennifer is a long-time educator and currently serves as assistant principal to Del Webb Middle School. She is also a parent of CCSD students, she will bring a well-rounded perspective to CF. She also fills a gap on CF, which currently lacks representation on the middle school level. I'll make a motion to remove and replace as specified in this item. I think I have a solution in light of the situation. After hearing Patsy speak, she would like to remain on SEAB. She's qualified and has several degrees, as she listed. She currently works as a teacher. I have an open SEAB position. And so my suggestion as the solution is, is that everybody could have a win-win here, including Patsy, as she could be my appointee and remain on the SEAB board. I think we can. That could still be a solution, but I don't think we can do it without posting it. Is that correct? That's exactly what I was going to say. That's not an item for business tonight, so that's something that could be added to the agenda in the future, but not for tonight. Okay. We would just go through the normal process that you would do, put it on a different agenda, and then it would come forward. Okay, wonderful. Then I intend to do that. Thank you so much. Item 61 is a resolution adopting ballot materials and directing the city clerk to submit items to the Clark County Register of Voters. The recommendation is to adopt as resolution number 4652. Chair and Council, at the July 15, 2025 regular meeting of the City Council, a presentation was given by the Parks and Recreation Department and the Department of Finance highlighting Parks and Recreation Services and explaining the expiration of a 30-year special elective property tax in 2027. At that same meeting, a resolution was adopted which began the process for putting a question to the City of Henderson voters at the June 9, 2026 primary election asking for authorization to maintain the expiring tax. At the August 5 regular meeting of the City Council, a resolution directing the City Clerk to accept names of ballot question committee candidates for consideration was adopted. On August 27th, the City of Henderson received approval from the Clark County Debt Management Commission to move forward with the ballot question process. At the September 16th regular City Council meeting, the ballot question committees were appointed, Stephanie Clark, Ted Olivas, and Eldon Thompson to the for committee and Tim Brooks to the against committee. Each committee wrote and submitted their arguments and rebuttals within the prescribed time frames. Upon adoption of this resolution today as required by applicable Nevada law and the City Clerk's Office, I should say, will submit a copy of the ballot question and final ballot materials, including the explanation and digest arguments and rebuttals and fiscal effect to the Clark County Registrar of Voters for inclusion on the June 9, 2026 primary election ballot, and will be known on the ballot as City of Henderson ballot question number one. Item 62 is a resolution acceptance of offer for land sale approximately 7.75 acres the southeast corner of Bermuda Road and Bruner Avenue and the recommendation is to adopt as resolution number 4653 and accept. So on August 19th, you guys approved, adopted Resolution 4642 to go to competitive bid for this 7.75 acres for no less than market value. We received one bid. Staff verified that it meets the minimum requirements outlined in the resolution. It's LTA property, so the proceeds actually go to the BLM for deposit in the SNIPLMA special account.
