[0:00] **Mayor Wayne Boucher:** Let's call the meeting to order and stand for the Pledge of Allegiance.
[0:05] **All:** I pledge allegiance to the flag of the United States of America and to the Republic for which it stands, one nation under God, indivisible, with liberty and justice for all.
[0:18] **Mayor Wayne Boucher:** Roll call, please.
[0:19] **Alissa McClure (City Clerk):** Councilor Jones?
[0:20] **Councilor Jones:** Here.
[0:21] **Alissa McClure (City Clerk):** Councilor Geissler?
[0:21] **Councilor John Geissler:** Here.
[0:22] **Alissa McClure (City Clerk):** Councilor Hjelle?
[0:22] **Councilor Andy Hjelle:** Here.
[0:23] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[0:23] **Councilor Brian LeBlanc:** Here.
[0:24] **Alissa McClure (City Clerk):** Mayor Boucher?
[0:24] **Mayor Wayne Boucher:** Here. Uh, do any council members have announcements? Not tonight. I'd like to congratulate the council members that did file for office, say thank you. Uh, we don't have any public hearing.
[0:46] **Mayor Wayne Boucher:** Uh, Communications. Mr. Mulder, I noticed there was something in there on the state demographer for population. Do we know what, if any, changes were made?
[0:56] **John Mulder:** Um, yeah, the population—off the top of my head, the 2020 census was 10,221. I think the April 1st estimate was 10,550-something. I think it went down last year? Yeah, I don't know that I—I can't speak to '22, but that—and that's a '23 number. Wow, Microsoft is present, thank you.
[1:31] **Mayor Wayne Boucher:** Presentations. We had a short presentation at pre-agenda from Brandon Holmes on our new digital permitting implementation that'll be coming in within a few weeks. I'd like to thank him for that. Uh, eventually building permits will be available online. Anything you need to add on that, Mr. Mulder?
[2:01] **John Mulder:** No.
[2:03] **Mayor Wayne Boucher:** Um, we have public discussion. We have two people vying for that public discussion—well wait, that's a presentation, hang on a second. Um, so Todd, you can wait until we take up the resolution. Yeah. Okay, Grant, it's all yours.
[2:18] **Grant Hauschild (State Senator):** Hello Hermantown, thanks for having me. Uh, for the record, I'm Grant Hauschild, State Senator for our District, 4918 Whitetail Drive here in Hermantown. Um, and grateful to be welcomed back to City Hall, where I formerly served. I wanted to give you guys an update since the session is now over... [Senator Hauschild provides an extensive legislative update on Northland Strong, EMS crisis, permitting reforms, helium discovery, and CTE funding].
[14:52] **Grant Hauschild:** ...those are the initiatives I've worked on. I look forward to advancing Child Care again next year, hopefully we have some funding for that, but I'm happy to take questions. Really pleased with the session—not so much the process, but the deliverables are pretty sweet. So I appreciate your guys' time and happy to take questions.
[15:15] **Mayor Wayne Boucher:** Any questions from the Council? What besides balloons do they do with helium gas?
[15:19] **Grant Hauschild:** Yeah, good. So it's funny that it's used in balloons, because they're really moving away from that because it's so critical for so many things: MRIs, fiber optics, green technologies, chip manufacturing—you hear a lot about chips sort of internationally and the arguments over that—and space exploration, rockets. A lot of those things. So, huge potential. And they're seeing that it's really becoming a rare resource.
[15:52] **Councilor Brian LeBlanc:** I know there's been a shortage of it to use for—
[15:56] **Grant Hauschild:** Right, right, right. Yeah, people can't have their parties.
[15:59] **Councilor Andy Hjelle:** Grant, I just like to thank you for everything you've done for the community and Northern Minnesota. Uh, you represent us well and I appreciate it.
[16:09] **Grant Hauschild:** Yeah, thank you guys. Yeah, can I take a quick selfie? Would you guys mind? Is that appropriate? Okay, I'm gonna do it quick, don't say no. Thank you guys, thank you.
[16:21] **Mayor Wayne Boucher:** I think that's the first request for that you know, of all the other ones, there was no request. I just did it, right? Thank you.
[16:35] **Mayor Wayne Boucher:** Is there any other public discussion? Do we have anyone online raising their hand? Kevin, are you watching that, or are you watching it, John?
[16:44] **John Mulder:** I'm watching it, Mr. Mayor, and we are okay on that front.
[16:47] **Mayor Wayne Boucher:** Okay, well a ghost, thank you. Um, any other public discussion for the council? Next is motions. Motion to approve or deny the renewal of liquor licenses in the attached list, if that's the easiest way to say it. There are several on-sale, off-sale, 3.2, and dance and Sunday liquor licenses. Do we have a motion to approve them?
[17:23] **Councilor John Geissler:** I'll make a motion to approve.
[17:25] **Mayor Wayne Boucher:** Motion by Councilor Geissler. Is there a second?
[17:26] **Councilor Jones:** I will second.
[17:27] **Mayor Wayne Boucher:** Second by Councilor Jones. Any questions or comments from Council?
[17:31] **Councilor Brian LeBlanc:** Has this list changed at all since last year?
[17:34] **Alissa McClure (City Clerk):** There is—there are two additions. Um, the movie theater, um, this is their first renewal, they were approved, oh man, I think in the wintertime. And then, um, Joe's QuickMart is a change from Kareem Inc, they did a rebrand.
[18:03] **Councilor Brian LeBlanc:** Thank you.
[18:05] **Mayor Wayne Boucher:** Um, any public input on the list or the approvals? Any public input on the list of liquor license renewals? Last opportunity for public input on the liquor license renewals. Roll call, please.

[18:54] **Councilor Brian LeBlanc:** Second.
[18:55] **Mayor Wayne Boucher:** Second by Councilor LeBlanc. Mr. Mulder?
[18:57] **John Mulder:** Um, we're told that they will be shutting the music off at midnight. Yeah, as in the past year, they'll serve till one, but the music will be done at midnight. Wanted to make sure that was clarified.
[19:11] **Mayor Wayne Boucher:** Any questions or comments from Council? Is there any public input on this motion? Any public input on the motion for a temporary service area for the Beacon Sports Bar for Summerfest? Any public input on the temporary service area for the Beacon Sports Bar? Roll call, please.

[19:40] **Councilor John Geissler:** Aye.
[19:41] **Alissa McClure (City Clerk):** Mayor Boucher?
[19:41] **Mayor Wayne Boucher:** Aye. And a motion to appoint Kevin Hagen to a three-year term on the Planning and Zoning Commission. Do we have a motion?
[19:51] **Councilor John Geissler:** Motion to appoint.
[19:53] **Mayor Wayne Boucher:** Motion by Councilor Geissler. Is there a second?
[19:54] **Councilor Andy Hjelle:** Second.
[19:55] **Mayor Wayne Boucher:** Second by Councilor Hjelle. Councilor Geissler and I interviewed Kevin and, uh, we're satisfied with his interest and enthusiasm in this area. Do you have any questions or comments from Council?
[20:11] **Councilor Andy Hjelle:** I guess, Molly, question: did he get a packet for tomorrow?
[20:17] **Alissa McClure (City Clerk):** Mary should have it, I think, or maybe was it on his application? His email? Yeah, it was, but I'll—I'll just—you guys can communicate with him tomorrow because we did let him know of the date.
[20:25] **Councilor Andy Hjelle:** Okay, thank you.
[20:27] **Mayor Wayne Boucher:** Any other comment from Council? Any public input on this motion? Any public input on the motion of Kevin Hagen to Planning and Zoning Commission? [20:53] **Alissa McClure (City Clerk):** Councilor Hjelle?
[20:54] **Councilor Andy Hjelle:** Aye.

[20:55] **Mayor Wayne Boucher:** Aye. Next is the consent agenda, including the minutes approval or correction of the June 3rd, 2024, City Council continuation minutes and accounts payable approved General City warrants from June 1st, 2024, through June 15th, 2024, in the amount of $516,746.22. Is there a motion?
[21:40] **Councilor Andy Hjelle:** Motion to approve.
[21:42] **Mayor Wayne Boucher:** Motion by Councilor Hjelle. Is there a second?
[21:43] **Councilor Brian LeBlanc:** Second.
[21:45] **Mayor Wayne Boucher:** Second by Councilor LeBlanc. Roll call, please.
[21:48] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[21:48] **Councilor Brian LeBlanc:** Aye.
[21:49] **Alissa McClure (City Clerk):** Councilor Jones?
[21:49] **Councilor Jones:** Aye.
[21:50] **Alissa McClure (City Clerk):** Councilor Geissler?
[21:51] **Councilor John Geissler:** Aye.
[21:52] **Alissa McClure (City Clerk):** Councilor Hjelle?
[21:53] **Councilor Andy Hjelle:** Aye.
[21:54] **Alissa McClure (City Clerk):** Mayor Boucher?
[21:55] **Mayor Wayne Boucher:** Aye. Resolutions. Resolution 2024-89, resolution approving implementation plan for placing police officers on the newly adopted 2024 Compensation Plan. Is there a motion?
[22:07] **Councilor John Geissler:** Motion to approve.
[22:09] **Mayor Wayne Boucher:** Motion by Councilor Geissler. Do we have a second?
[22:11] **Councilor Andy Hjelle:** Second.
[22:12] **Mayor Wayne Boucher:** Second by Councilor Hjelle. Mr. Mulder?
[22:14] **John Mulder:** So, uh, earlier this year, um, we talked about possible ways to implement the new Compensation Plan and we talked about doing that, um, in July of this year. So I met with, uh, the union to talk about, um, how that would work relative to their current wage rate and we really were working on two things. One was to get them on the Compensation Plan, but two was then it also sets the rates that we'll work off of for the 2025, uh, contract negotiations. So, um, we met with the union, um, I think three different times, um, and, um, this was the proposal that we came up with. This gives everybody, um—it moves them onto a step, um, not that's just a minimum raise, but it guarantees them at least a minimum of a 4% wage rate increase.
[23:14] **Mayor Wayne Boucher:** Thank you. Any questions or comments from Council?
[23:18] **Councilor Brian LeBlanc:** Uh, I would—go ahead. I'm just going to address all four of them at the same time. I just think with giving everyone a $10,000 bonus—correction, their annual three and a half percent raise and a minimum of another 4%, I think is just a little excessive, and especially with contract negotiations coming up. So just want to say that to address the next four resolutions.
[23:55] **Mayor Wayne Boucher:** Thank you. Any other comments from Council? Any public comment on this resolution? Any public comment on the resolution implementing a plan for placing police officers on a newly adopted Compensation Plan? Is there any public input on resolution 2024-89? Roll call, please.
[24:14] **Alissa McClure (City Clerk):** Councilor Hjelle?
[24:14] **Councilor Andy Hjelle:** Aye.
[24:15] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[24:15] **Councilor Brian LeBlanc:** No.
[24:16] **Alissa McClure (City Clerk):** Councilor Jones?
[24:16] **Councilor Jones:** Aye.
[24:17] **Alissa McClure (City Clerk):** Councilor Geissler?
[24:18] **Councilor John Geissler:** Aye.
[24:18] **Alissa McClure (City Clerk):** Mayor Boucher?
[24:19] **Mayor Wayne Boucher:** Aye. 2024-91, resolution approving implementation plan for placing employees represented by AFSCME on the newly adopted 2024 Compensation Plan. Is there a motion?
[24:32] **Councilor Andy Hjelle:** Motion to approve.
[24:34] **Mayor Wayne Boucher:** Motion by Councilor Hjelle. Do we have a second?
[24:35] **Councilor John Geissler:** I'll second.
[24:36] **Mayor Wayne Boucher:** Second by Councilor Geissler. Mr. Mulder?
[24:38] **John Mulder:** So again, we met with the unions on a couple different occasions to talk about, um, how to implement the Compensation Plan. In this particular one, one of the, um, positions, the negotiated wage rate was actually higher than what the Compensation Plan was. But instead of reducing, um, those rates—those were negotiated in good faith effort by the city and the union—we kept those. Um, when we go into negotiations, we'll look at trying to, um, increase those at a lower rate of pay so that we try to get those in line with the Compensation Plan.
[25:17] **Mayor Wayne Boucher:** Thank you. Any questions or comments from Council? Any public input on this resolution? Any public input on the resolution implementing a plan for placing employees represented by AFSCME on the newly adopted Compensation Plan? Any public input on Resolution 2024-91? Roll call, please.
[25:42] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[25:42] **Councilor Brian LeBlanc:** No.
[25:43] **Alissa McClure (City Clerk):** Councilor Jones?
[25:44] **Councilor Jones:** Aye.
[25:45] **Alissa McClure (City Clerk):** Councilor Geissler?
[25:45] **Councilor John Geissler:** Aye.
[25:46] **Alissa McClure (City Clerk):** Councilor Hjelle?
[25:46] **Councilor Andy Hjelle:** Aye.
[25:47] **Alissa McClure (City Clerk):** Mayor Boucher?
[25:47] **Mayor Wayne Boucher:** Aye. 2024-92, resolution approving implementation plan for placing utility maintenance workers and building maintenance workers represented by IUOE Local 49 on the newly adopted 2024 Compensation Plan. Scratch the word "officers" there. Uh, do we have a motion?
[26:08] **Councilor John Geissler:** Motion to approve.
[26:10] **Mayor Wayne Boucher:** Motion by Councilor Geissler. Is there a second?
[26:11] **Councilor Andy Hjelle:** Second.
[26:12] **Mayor Wayne Boucher:** Second by Councilor Hjelle. Any comment by Council? Mr. Mulder, do you need to add anything to this one that's not part of the other two?
[26:19] **John Mulder:** Just a little bit of a tweak on this one is, again, because, uh, the negotiated rates were actually higher than what the Compensation Plan said should be, we kept those rates. Um, and then we adjusted just some of them. So, um, some of the steps, um, are not in line, but we will adjust those at a different rate to try to get them on line. In two cases—uh, three cases—um, they don't fit, they don't fall on the plan, so we "red circle" those and we have a specific dollar rate, and then they will move onto one of those steps at a later date.
[27:03] **Mayor Wayne Boucher:** Thank you. Any comments from Council? Any public input on this resolution? Any public input on resolution 2024-92? Any public input on the resolution placing maintenance workers on the newly adopted Compensation Plan? Roll call, please.
[27:26] **Alissa McClure (City Clerk):** Councilor Geissler?
[27:27] **Councilor John Geissler:** Aye.
[27:27] **Alissa McClure (City Clerk):** Councilor Hjelle?
[27:28] **Councilor Andy Hjelle:** Aye.
[27:29] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[27:29] **Councilor Brian LeBlanc:** No.
[27:30] **Alissa McClure (City Clerk):** Councilor Jones?
[27:30] **Councilor Jones:** Aye.
[27:31] **Alissa McClure (City Clerk):** Mayor Boucher?
[27:32] **Mayor Wayne Boucher:** Aye. Next is resolution 2024-93, resolution approving implementation plan for placing certain management employees on the newly adopted 2024 Compensation Plan. Do we have a motion?
[27:54] **Councilor Andy Hjelle:** Motion to approve.
[27:56] **Mayor Wayne Boucher:** Motion by Councilor Hjelle. Is there a second?
[27:57] **Councilor John Geissler:** Second.
[27:58] **Mayor Wayne Boucher:** Second by Councilor Geissler. Mr. Mulder, anything else?
[28:02] **John Mulder:** Previously we had reclassified three positions earlier this year and put them on the plan, so this deals with, um, a number of the remaining ones. Um, the only three that have not been implemented yet would be the two fire department employees and the City Administrator, but those would put the management employees, um, on the new Compensation Plan.
[28:29] **Mayor Wayne Boucher:** Thank you. Any questions or comments from Council?
[28:33] **Councilor Andy Hjelle:** I just wanted—Mr. Mulder, can you remind me which three we did previously?
[28:38] **John Mulder:** The, um, Assistant City Administrator, the Director of Public Safety, and the Assistant, um, Finance Director, King.
[28:49] **Councilor Andy Hjelle:** Thank you.
[28:50] **Mayor Wayne Boucher:** Anything else from Council?
[28:52] **Councilor Brian LeBlanc:** Um, I'm looking at these and we didn't have the opportunity to speak at these at pre-agenda, but, uh, I see four that I just—I don't feel are rated properly, that should be, uh, rated differently, and I'll go forward with that sentiment.
[29:09] **Mayor Wayne Boucher:** Uh, any public comment on this resolution? Any public comment on Resolution 2024-93 on the 2024 Compensation Plan? Roll call, please.
[29:26] **Alissa McClure (City Clerk):** Councilor Hjelle?
[29:26] **Councilor Andy Hjelle:** Aye.
[29:27] **Alissa McClure (City Clerk):** Councilor Geissler?
[29:28] **Councilor John Geissler:** Aye.
[29:29] **Alissa McClure (City Clerk):** Councilor Jones?
[29:29] **Councilor Jones:** Aye.
[29:30] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[29:31] **Councilor Brian LeBlanc:** No.
[29:32] **Alissa McClure (City Clerk):** Mayor Boucher?
[29:32] **Mayor Wayne Boucher:** Nay. Resolution 2024-94, resolution adopting the Minnesota General Records Retention Schedule. Do we have a motion?
[30:16] **Councilor Jones:** You can give it to Ellie. Motion.
[30:18] **Mayor Wayne Boucher:** Motion by Councilor Jones. Do we have a second?
[30:19] **Councilor Brian LeBlanc:** Second.
[30:20] **Mayor Wayne Boucher:** Second from Councilor LeBlanc. Mr. Mulder?
[30:22] **John Mulder:** So, we're updating our records retention schedule in compliance with the state of Minnesota and then also just dealing with the issue of electronic files being a permanent retention method. This is, uh, to update that and just to be in compliance with the state of Minnesota.
[30:42] **Mayor Wayne Boucher:** Thank you. Any questions or comments from Council? Any public input on this resolution? Any public input on the resolution adopting the Minnesota General Records Retention Schedule and adopting electronic files as a permanent retention method? Any public input on resolution 2024-94? Roll call, please.
[31:07] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[31:07] **Councilor Brian LeBlanc:** Aye.
[31:08] **Alissa McClure (City Clerk):** Councilor Jones?
[31:08] **Councilor Jones:** Aye.
[31:09] **Alissa McClure (City Clerk):** Councilor Geissler?
[31:09] **Councilor John Geissler:** Aye.
[31:10] **Alissa McClure (City Clerk):** Councilor Hjelle?
[31:10] **Councilor Andy Hjelle:** Aye.
[31:11] **Alissa McClure (City Clerk):** Mayor Boucher?
[31:11] **Mayor Wayne Boucher:** Aye. Resolution 2024-95, resolution establishing an absentee ballot board. Do we have a motion?
[31:39] **Councilor Andy Hjelle:** Motion to approve.
[31:41] **Mayor Wayne Boucher:** Motion by Councilor Hjelle. Is there a second?
[31:42] **Councilor Jones:** Second.
[31:43] **Mayor Wayne Boucher:** Second by Councilor Jones. Mr. Mulder?
[31:45] **John Mulder:** Um, this is a requirement for every election that we hold that we need to have an absentee ballot board. So this is for the August, uh, 2024 election.
[31:58] **Mayor Wayne Boucher:** Thank you. Any questions or comments from Council? Hearing none, is there any public input on this resolution? Any public input on the resolution establishing an absentee ballot board? Any public input on resolution 2024-95? Roll call, please.
[32:22] **Alissa McClure (City Clerk):** Councilor Geissler?
[32:22] **Councilor John Geissler:** Aye.
[32:23] **Alissa McClure (City Clerk):** Councilor Hjelle?
[32:23] **Councilor Andy Hjelle:** Aye.
[32:24] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[32:25] **Councilor Brian LeBlanc:** Aye.
[32:25] **Alissa McClure (City Clerk):** Councilor Jones?
[32:26] **Councilor Jones:** Aye.
[32:27] **Alissa McClure (City Clerk):** Mayor Boucher?
[32:27] **Mayor Wayne Boucher:** Aye. Resolution 2024-96, resolution adopting performance measures. Do we have a motion?
[32:41] **Councilor Jones:** Move to approve.
[32:43] **Councilor John Geissler:** Second.
[32:44] **Mayor Wayne Boucher:** Motion by Councilor Jones, second by Councilor Geissler. Mr. Mulder?
[32:48] **John Mulder:** So, um, we do this annually since 2020. Um, and what this does is creates performance measures and we do a survey of the residents about various items that, um, um, we're concerned about. And so, um, part of this is for the state of Minnesota—they have a, um, Council on Local Results and Innovation—just to show like how do local governments, um, measure the work that they're doing in their performance. But we also do it just for ourselves and understanding how we're serving, uh, the residents. It gives the residents an opportunity to kind of, um, give their feedback on various things.
[33:38] **Mayor Wayne Boucher:** Thank you. Any questions or comments from Council?
[33:42] **Councilor Andy Hjelle:** Have we—do we have any specific examples of us taking action based off of this survey in the past?
[33:48] **John Mulder:** We talked a lot, yeah. We talked a lot about, um, the conditions of roads and the quality of parks, um, several years ago. And that's part of the reason where a community recreation initiative comes out of that. Also, a little bit was like, "okay, we need to come up with a plan on how do we improve local streets," and it's kind of a little bit about, you know, local road improvement—like okay, that's a way that we could address that.
[34:15] **Councilor Andy Hjelle:** I'm just wondering if we could market it so that maybe we get a better turnout than less than a hundred people out of, what did we talk about, 10,500 roughly, you know?
[34:26] **John Mulder:** Uh, we can continue to try to improve that. We actually had—um, this is the year that we've had the best results, um, in part because we attached it to, um, the survey about the comprehensive plan.
[34:39] **Mayor Wayne Boucher:** So any other questions or comments from Council?
[34:41] **Councilor Brian LeBlanc:** Um, is this the only form of LGA that we received, Mr. Mulder?
[34:46] **John Mulder:** No, this is—this was—um, I was looking back at this and I was like, you know, when we started this in 2018 we did not receive any LGA. We could, if we did this, we were getting a couple thousand dollars worth of LGA and then subsequently that, um, formula changed.
[35:05] **Councilor Brian LeBlanc:** Okay, so we still get no LGA?
[35:08] **John Mulder:** No, we get LGA. I say didn't we get like 300 grand or 500 grand—$300,000 LGA. Get more because of—yes, because of the funding formula. Yeah.
[35:21] **Councilor Brian LeBlanc:** Thank you.
[35:23] **Mayor Wayne Boucher:** Any public input on this resolution? Is there any public input on the resolution adopting performance measures? Any public input on resolution 2024-96? Roll call, please.
[35:45] **Alissa McClure (City Clerk):** Councilor Hjelle?
[35:45] **Councilor Andy Hjelle:** Aye.
[35:46] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[35:46] **Councilor Brian LeBlanc:** Aye.
[35:47] **Alissa McClure (City Clerk):** Councilor Jones?
[35:48] **Councilor Jones:** Aye.
[35:49] **Alissa McClure (City Clerk):** Councilor Geissler?
[35:50] **Councilor John Geissler:** Aye.
[35:51] **Alissa McClure (City Clerk):** Mayor Boucher?
[35:52] **Mayor Wayne Boucher:** Aye. Resolution 2024-97, resolution authorizing the issuance, sale, and delivery of $8,745,000 in General Obligation bonds, series 2024A. Do we have a motion?
[36:06] **Councilor Brian LeBlanc:** Move to approve.
[36:08] **Councilor Jones:** Second.
[36:09] **Mayor Wayne Boucher:** Motion by Councilor LeBlanc, second by Councilor Jones. And we have an explanation, sure, from Todd. Yeah, introduce yourself, please.
[36:19] **Todd Hagen (Ellers & Associates):** Todd Hagen from Ellers and Associates from Roseville, Minnesota. So thanks for having me, I appreciate it. Um, I'll try to do as good a job as John does to summarize the resolution. Um, thank you. Um, so we were here on May 6th, I believe, for the pre-sale report and that set up the parameters and the terms and conditions for issuing these bonds for, you know, Hermantown Road improvements, Old Midway Road, and Fictner Park... [Todd Hagen provides a detailed financial report on bond bidding, credit ratings, and premiums].
[46:18] **Todd Hagen:** ...And I believe that is—I'm just looking here—those are the highlights um to this. It's all final tonight. Um, so I'll yield to you folks for questions if you have any for me, but it works out as planned.
[46:31] **Mayor Wayne Boucher:** That's good. We planned that.
[46:34] **Todd Hagen:** Yeah, it's a good plan.
[46:35] **Councilor Brian LeBlanc:** I just have one question. You said it's not a bank-qualified loan because it's over 10 million, but it's 9.6—it was 9.6, now it's 8.74. So it's more than 10 million or it's not?
[46:46] **Todd Hagen:** Oh, we have another one coming up that's going to be 17 or so million, so we're going to be over the total 10 million in a calendar year. Yep. Great question.
[46:56] **Councilor Brian LeBlanc:** Got it. Okay.
[46:58] **John Mulder:** Yeah, just comment on that. So, um, we've in the past had projects that were over $10 million, but we—at least one project where we split it, so we did 9 million in one year and then we waited until January to issue the second one, so that way both of them were bank-qualified. Because this year we're going to issue two that are going to be more than 10 million, we don't call them bank-qualified.
[47:24] **Todd Hagen:** Yep. I think we did that with the wellness center, probably—we skipped over a year just to do that. But now it's the perfect storm; these non-bank-qualified are actually cheaper. Yeah.
[47:37] **Councilor Brian LeBlanc:** Can we get a copy of that report?
[47:39] **Todd Hagen:** Yes. Yeah, we did—my fault, I meant to have that in front of you when I didn't get it done. We'll get that.
[47:46] **Councilor Andy Hjelle:** I have a question on the schedule in the resolution. Um, it shows interest rates of 5% and dropping at 4%. How does that relate to this percentage?
[47:57] **Todd Hagen:** Yep, that's a good question too. So, if you had the report, uh, you'd see the bid tabulation here. You'd see the 5 percenters are the coupon rate, that's actually what you're going to pay, and there's a reoffering yield, is what the customers that hold these bonds are going to get. The difference between those two is the premium... [Todd explains bond premiums and reoffering yields].
[50:24] **Mayor Wayne Boucher:** Any other questions for Todd? Any public input on this resolution?
[50:30] **John Mulder:** Mr. Mulder, just one comment. Um, kudos to Todd and Ellers in terms of just pulling this all together. It's a lot of work to, um, make sure we, um, respond to the, uh, rating agency, um, figure out, you know, the amount that needs to be borrowed, um, just—and all of that. So just, you know, thanks to Kevin for all the work on this.
[50:54] **Todd Hagen:** And we're gonna do it again. Yes, he's our—he's our quality control, that's for sure.
[50:59] **Mayor Wayne Boucher:** Thank you. And uh, any other public input on this? Any public input on resolution 2024-97, $8,745,000 in General Obligation bonds? Roll call, please.
[51:24] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[51:24] **Councilor Brian LeBlanc:** Aye.
[51:25] **Alissa McClure (City Clerk):** Councilor Jones?
[51:25] **Councilor Jones:** Aye.
[51:26] **Alissa McClure (City Clerk):** Councilor Geissler?
[51:27] **Councilor John Geissler:** Aye.
[51:28] **Alissa McClure (City Clerk):** Councilor Hjelle?
[51:28] **Councilor Andy Hjelle:** Aye.
[51:29] **Alissa McClure (City Clerk):** Mayor Boucher?
[51:29] **Mayor Wayne Boucher:** Aye. Resolution 2024-98, resolution approving preliminary and final plat of Stebner Park. Do we have a motion?
[51:50] **Councilor John Geissler:** Motion to approve.
[51:53] **Mayor Wayne Boucher:** Motion by Councilor Geissler. Is there a second?
[51:55] **Councilor Brian LeBlanc:** Second.
[51:56] **Mayor Wayne Boucher:** Second by Councilor LeBlanc. Mr. Mulder, do we want Mr. Johnson to go over this?
[52:01] **John Mulder:** Sure, great.
[52:03] **Eric Johnson (Community Development Director):** Thank you very much. Uh, before us is this preliminary and final plat. The purpose of this is to create an 8.67-acre development parcel uh associated with the Great Northern sports dome that we've talked about at previous meetings. Uh, so what this plat is doing: it's creating two outlots which essentially contain the soccer fields and Hermantown Trail, it creates a public right-of-way associated with Stebner Park Drive, and then lastly, as I mentioned, that 8.67-acre development parcel. Uh, this property is zoned Hermantown Marketplace, um, it does not have any minimum lot sizes, so essentially what we're doing tonight does meet our Hermantown Marketplace zoning as well from a plat standpoint.
[52:50] **Mayor Wayne Boucher:** Thank you. Any questions or comments from Council? Is there any public input on this resolution? Any public input on resolution approving preliminary and final plat of Stebner Park and imposing conditions on the final plat? Any public input on resolution 2024-98? Roll call, please.
[53:20] **Alissa McClure (City Clerk):** Councilor Hjelle?
[53:20] **Councilor Andy Hjelle:** Aye.
[53:21] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[53:21] **Councilor Brian LeBlanc:** Aye.
[53:22] **Alissa McClure (City Clerk):** Councilor Jones?
[53:22] **Councilor Jones:** Aye.
[53:23] **Alissa McClure (City Clerk):** Councilor Geissler?
[53:24] **Councilor John Geissler:** Aye.
[53:25] **Alissa McClure (City Clerk):** Mayor Boucher?
[53:25] **Mayor Wayne Boucher:** Aye. Next is resolution 2024-99, resolution approving final pay request for Stebner Park Utility Improvement District number 544 to Northern Interstate Construction Incorporated in the amount of $26,465.73. Do we have a motion?
[53:50] **Councilor Andy Hjelle:** Motion to approve.
[53:52] **Mayor Wayne Boucher:** Motion by Councilor Hjelle. Is there a second?
[53:53] **Councilor Jones:** Second.
[53:54] **Mayor Wayne Boucher:** Second by Councilor Jones. Mr. Mulder?
[53:56] **John Mulder:** So this is the final payment for extending uh utilities into Stebner Park with the idea of hopefully serving uh the—the sports dome at a later date.
[54:07] **Mayor Wayne Boucher:** Thank you. Any questions or comments from Council? Hearing none, is there any public input on this resolution? Any public input on resolution 2024-99? Any public input on the final pay request for Park Utility Improvement District number 544? Roll call, please.
[54:34] **Alissa McClure (City Clerk):** Councilor Geissler?
[54:34] **Councilor John Geissler:** Aye.
[54:35] **Alissa McClure (City Clerk):** Councilor Hjelle?
[54:36] **Councilor Andy Hjelle:** Aye.
[54:37] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[54:37] **Councilor Brian LeBlanc:** Aye.
[54:38] **Alissa McClure (City Clerk):** Councilor Jones?
[54:38] **Councilor Jones:** Aye.
[54:39] **Alissa McClure (City Clerk):** Mayor Boucher?
[54:39] **Mayor Wayne Boucher:** Aye. Next is resolution 2024-100, resolution approving change orders number 1 through 2 for Fictner Park improvements. Do we have a motion?
[54:57] **Councilor John Geissler:** I'll move to approve.
[54:59] **Mayor Wayne Boucher:** Motion by Councilor Geissler. Is there a second?
[55:01] **Councilor Andy Hjelle:** Second.
[55:02] **Mayor Wayne Boucher:** Second by Councilor Hjelle. Mr. Mulder?
[55:04] **John Mulder:** So briefly, the two change orders: one is to replace um an existing sewer line um in the park that runs under the uh one of the parking lots that would serve this building. As we—as we looked at this, there was a sag in the line and we think we need—that needs to be corrected. The second one is to redo the parking lot that is off of, um, Ugstad Road. Um, we were going to add some curb and gutter and, um, change the, um, elevation so that it all flows in one direction.
[55:48] **Mayor Wayne Boucher:** Thank you. Any questions or comments from Council? Hearing none, is there any public input on this resolution? Is there any public input on a resolution approving change orders number 1 through 2 for Fictner Park Improvement? Is there any public input on resolution 2024-100? Roll call, please.
[56:13] **Alissa McClure (City Clerk):** Councilor Geissler?
[56:14] **Councilor John Geissler:** Aye.
[56:15] **Alissa McClure (City Clerk):** Councilor Hjelle?
[56:16] **Councilor Andy Hjelle:** Aye.
[56:17] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[56:17] **Councilor Brian LeBlanc:** Aye.
[56:18] **Alissa McClure (City Clerk):** Councilor Jones?
[56:18] **Councilor Jones:** Aye.
[56:19] **Alissa McClure (City Clerk):** Mayor Boucher?
[56:19] **Mayor Wayne Boucher:** Aye. Resolution 2024-101, resolution approving pay request number 1 for Fictner Park improvements to Kaski Incorporated in the amount of $371,515.65. Do we have a motion?
[56:34] **Councilor Andy Hjelle:** Motion to approve.
[56:36] **Councilor Jones:** Second.
[56:37] **Mayor Wayne Boucher:** Motion by Councilor Hjelle, second by Councilor Jones. Any questions or comments from Council? Hearing none, is there any public input on this resolution? Any public input on the resolution approving pay request number 1 for Fictner Park improvements? Is there any public input on resolution 2024-101? Roll call, please.
[57:24] **Alissa McClure (City Clerk):** Councilor Hjelle?
[57:24] **Councilor Andy Hjelle:** Aye.
[57:25] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[57:26] **Councilor Brian LeBlanc:** Aye.
[57:27] **Alissa McClure (City Clerk):** Councilor Jones?
[57:27] **Councilor Jones:** Aye.
[57:28] **Alissa McClure (City Clerk):** Councilor Geissler?
[57:29] **Councilor John Geissler:** Aye.
[57:30] **Alissa McClure (City Clerk):** Mayor Boucher?
[57:30] **Mayor Wayne Boucher:** Aye. Resolution 2024-102, resolution authorizing and directing mayor and City Clerk to execute an acceptance of easement agreement to the City of Hermantown from Mark W. Kimus for the Benson Road improvements. Do we have a motion?
[58:00] **Councilor John Geissler:** Move to approve.
[58:02] **Mayor Wayne Boucher:** Motion by Councilor Geissler. Is there a second?
[58:03] **Councilor Andy Hjelle:** Second.
[58:04] **Mayor Wayne Boucher:** Second by Councilor Hjelle. Mr. Mulder?
[58:06] **John Mulder:** Um, for this one and the next one, we are, um, going to, um, replace a culvert on Benson Road and so we needed temporary easements from these two property owners to get that work done.
[58:20] **Mayor Wayne Boucher:** Thank you. Any questions or comments from Council? Hearing none, is there any public input on this resolution? Any public input on a resolution of the acceptance of easement agreement? Any public input on resolution 2024-102? Roll call, please.
[58:45] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[58:46] **Councilor Brian LeBlanc:** Aye.
[58:47] **Alissa McClure (City Clerk):** Councilor Jones?
[58:47] **Councilor Jones:** Aye.
[58:48] **Alissa McClure (City Clerk):** Councilor Geissler?
[58:49] **Councilor John Geissler:** Aye.
[58:50] **Alissa McClure (City Clerk):** Councilor Hjelle?
[58:50] **Councilor Andy Hjelle:** Aye.
[58:51] **Alissa McClure (City Clerk):** Mayor Boucher?
[58:51] **Mayor Wayne Boucher:** Aye. 2024-103, resolution authorizing and directing mayor and City Clerk to execute an acceptance of easement agreement to the City of Hermantown from Theodore J. Kimus for the Benson Road improvements. Do we have a motion?
[59:12] **Councilor Jones:** Move to be approved.
[59:14] **Councilor John Geissler:** Second.
[59:15] **Mayor Wayne Boucher:** Motion by Councilor Jones, second by Councilor Geissler. We got an explanation on the last one. Is there any questions or comments from Council? Is there any public input on this resolution? Any public input on an easement agreement for the Benson Road improvements? Is there any public input on resolution 2024-103? Roll call, please.
[59:40] **Alissa McClure (City Clerk):** Councilor Jones?
[59:40] **Councilor Jones:** Aye.
[59:41] **Alissa McClure (City Clerk):** Councilor Geissler?
[59:42] **Councilor John Geissler:** Aye.
[59:43] **Alissa McClure (City Clerk):** Councilor Hjelle?
[59:43] **Councilor Andy Hjelle:** Aye.
[59:44] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[59:45] **Councilor Brian LeBlanc:** Aye.
[59:46] **Alissa McClure (City Clerk):** Mayor Boucher?
[59:46] **Mayor Wayne Boucher:** Aye. Resolution 2024-104, resolution approving an agreement with Daniel Williams and Heather Williams in regard to project number 601 to extend Benson Road within the city of Hermantown. Is there a motion?
[1:00:10] **Councilor Andy Hjelle:** Motion to approve.
[1:00:12] **Mayor Wayne Boucher:** Motion by Councilor Hjelle. Is there a second?
[1:00:13] **Councilor Jones:** Second.
[1:00:14] **Mayor Wayne Boucher:** Second by Councilor Jones. Mr. Mulder?
[1:00:16] **John Mulder:** So as we redo the Benson Road culverts, we're also going to extend the road. The right-of-way is on—um, we have the right-of-way already, but the road isn't built to the property line. So we're going to build the road to the property line within the existing right-of-way.
[1:00:32] **Mayor Wayne Boucher:** Thank you. Are there any questions or comments from Council?
[1:00:36] **Councilor Brian LeBlanc:** Yeah, are we requiring them to put a cul-de-sac into that road?
[1:00:44] **John Mulder:** Uh, no, there's—we are not.
[1:00:46] **Councilor Brian LeBlanc:** I know I was told in the past it was a safety thing that we have cul-de-sacs at the end of our dead-end roads.
[1:00:52] **John Mulder:** And there's—there's no right-of-way today that's a—um, so that's why we will allow that to happen.
[1:00:59] **Councilor Brian LeBlanc:** I just think maybe we should have a little more consistency when we add on to these roads. If we're going to require it from one spot, we should be requiring it across the board.
[1:01:08] **John Mulder:** In a newly platted area that would be easier because we would define that, but in this case, it's not there. We would have to go buy that easement from—
[1:01:17] **Councilor Brian LeBlanc:** We already have the easement for the road?
[1:01:19] **John Mulder:** Not for a cul-de-sac. We only have the 66-foot wide. We would need a much bigger bell at the end to make the cul-de-sac.
[1:01:28] **Councilor Brian LeBlanc:** All right.
[1:01:30] **Mayor Wayne Boucher:** Any other questions or comments from Council? Public input on Resolution 2024-104. Trying to get this over with. Is there any public input on this resolution? Any public input on the resolution extending the Benson Road? Roll call, please.
[1:01:54] **Alissa McClure (City Clerk):** Councilor Geissler?
[1:01:55] **Councilor John Geissler:** Aye.
[1:01:56] **Alissa McClure (City Clerk):** Councilor Hjelle?
[1:01:57] **Councilor Andy Hjelle:** Aye.
[1:01:58] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[1:01:58] **Councilor Brian LeBlanc:** Aye.
[1:01:59] **Alissa McClure (City Clerk):** Councilor Jones?
[1:02:00] **Councilor Jones:** Aye.
[1:02:01] **Alissa McClure (City Clerk):** Mayor Boucher?
[1:02:01] **Mayor Wayne Boucher:** Aye. Next is resolution 2024-105, resolution approving request number 7 for Road Improvement District number 538 to Ulland Brothers Incorporated in the amount of $176,684.82. Do we have a motion?
[1:02:18] **Councilor Andy Hjelle:** Motion to approve.
[1:02:20] **Mayor Wayne Boucher:** Motion by Councilor Hjelle. Is there a second?
[1:02:21] **Councilor Jones:** Second.
[1:02:22] **Mayor Wayne Boucher:** Second by Councilor Jones. Mr. Mulder?
[1:02:24] **John Mulder:** So, as you know, uh, we paved the streets last year, but there was a significant amount of punch list work, and specifically, uh, some of the curb and gutter and some of the sidewalk. So that work has now been completed. So, um, this is the payment for that work.
[1:02:44] **Mayor Wayne Boucher:** Thank you. Any questions or comments from Council? Is there any public input on this resolution? Any public input on the resolution for the final pay request for Road Improvement District number 538? Any public input on resolution 2024-105? Roll call, please.
[1:03:39] **Alissa McClure (City Clerk):** Councilor Jones?
[1:03:39] **Councilor Jones:** Aye.
[1:03:40] **Alissa McClure (City Clerk):** Councilor Geissler?
[1:03:41] **Councilor John Geissler:** Aye.
[1:03:42] **Alissa McClure (City Clerk):** Councilor Hjelle?
[1:03:43] **Councilor Andy Hjelle:** Aye.
[1:03:44] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[1:03:44] **Councilor Brian LeBlanc:** Aye.
[1:03:45] **Alissa McClure (City Clerk):** Mayor Boucher?
[1:03:45] **Mayor Wayne Boucher:** Aye. Next is resolution 2024-106, resolution approving plans and specifications and ordering an advertisement for bids for bid package number 2 for the Northstar Ford Arena. Do we have a motion?
[1:03:52] **Councilor Jones:** Move to approve.
[1:03:54] **Mayor Wayne Boucher:** Motion by Councilor Jones. Is there a second?
[1:03:56] **Councilor Brian LeBlanc:** Second.
[1:03:57] **Mayor Wayne Boucher:** Second by Councilor LeBlanc. Mr. Mulder?
[1:04:00] **John Mulder:** So, Kraus-Anderson is finishing up those bid documents, um, this week and they hope to be out on the 19th. Um, bids will be due on July 18th and if everything goes as planned, we would have the council award those bids on August 5th. Um, we will make sure that we have a complete bid package, um, on file at the office.
[1:04:26] **Mayor Wayne Boucher:** Thank you. Any questions or comments from Council?
[1:04:30] **Councilor John Geissler:** I—I have one relating to procedure now. We—we've been told there's going to be a guaranteed maximum price, but all the bids will be in before that is set?
[1:04:42] **John Mulder:** That's correct.
[1:04:44] **Councilor John Geissler:** Is that normal?
[1:04:46] **John Mulder:** Yes.
[1:04:47] **Councilor John Geissler:** Okay. So does that cover any change orders? So the council won't see any change orders then for the duration of this project unless you say we want something different? What happens if we have an unforeseen something pop up like the sewer line on Fictner? Would that be covered by their guaranteed maximum price?
[1:05:09] **John Mulder:** And again, it would depend upon the scope of work and what was in the scope. Typically not, because it's added scope. Nobody would have known to bid that unless we scoped the lines before we put it out for bid.
[1:05:22] **Mayor Wayne Boucher:** Any other questions from Council? Any public input on this resolution? Any public input on the resolution approving plans and specs and ordering advertisement for bids for bid package number 2 for the Northstar Ford Arena? Is there any public input on resolution 2024-106? Roll call, please.
[1:05:54] **Alissa McClure (City Clerk):** Councilor Geissler?
[1:05:54] **Councilor John Geissler:** Aye.
[1:05:55] **Alissa McClure (City Clerk):** Councilor Hjelle?
[1:05:56] **Councilor Andy Hjelle:** Aye.
[1:05:57] **Alissa McClure (City Clerk):** Councilor LeBlanc?
[1:05:58] **Councilor Brian LeBlanc:** Aye.
[1:05:59] **Alissa McClure (City Clerk):** Councilor Jones?
[1:05:59] **Councilor Jones:** Aye.
[1:06:00] **Alissa McClure (City Clerk):** Mayor Boucher?
[1:06:01] **Mayor Wayne Boucher:** Aye. Next is a motion to go into closed session. Motion to close the meeting of the Hermantown City Council pursuant to Minnesota Statute section 13D.05 subdivision 3B to discuss the City Administrator's performance evaluation. Following this closed session, the Hermantown City Council will reconvene in open session pursuant to the posted agenda for that date and time and during such open session summarize its conclusions regarding the evaluation. Do we have a motion to go into closed session?
[1:06:16] **Councilor Brian LeBlanc:** Move to closed session.
[1:06:18] **Councilor Jones:** Second.
[1:06:20] **Mayor Wayne Boucher:** All in favor say aye.
[1:06:22] **All:** Aye.
