So, I'm here today to present our special use permit application um um applied for by ABJKM Holdings LLC. um which is then going to construct uh mango cannabis which is being represented today by Jason Terzek. [1:01] **Amelia (Intern):** Um and so quickly just some background on um cannabis and SCPs for cannabis. It's a crucial step in moving forward for them to get their state licensing um to be able to then open within Hastings, which then is going to be issued um is going to be registered with the city. [1:25] **Amelia (Intern):** It's a full full process. Um and as in our city code, there's only one retail cannabis business allowed within the city. Um, so the property that they're looking at and they currently have a uh purchase agreement with Crossroads Mall to buy Outlot B, which is right here on the southwest corner of Highway 316 and 33rd Street West. [1:52] **Amelia (Intern):** And this purchase agreement is um contingent on a few different things including the um um licensing for operating the cannabis retail. Um this property is currently zoned for retail. So there's no changes that need to be made with our comprehensive plan also continuing to be retail. It's surrounded by retail besides um the two streets. um low commercial or low residential on the other side of 316, but there's no concern about that. Um it also um the site location also passes all of our um requirements 500 ft from schools um or thousand feet from schools, parks. It's also currently situated um within with over 500 ft from Cobborn's liquor which has a low potency cannabis license and they need to be 500 ft from door to door as we understand it. And so right now as it's situated with this current um concept plan um they're totally fine and they pass all of those requirements as well. [3:07] **Amelia (Intern):** Currently, the lot is vacant. Um, and there is now, as we um discussed in a meeting last week, there's uh it's unlikely that this connection to um 33rd Street will actually happen and they'll just have entrance through the parking lot of the cross crossroads mall. Um the all of our um special use permit requirements have been passed with this concept plan, but there's still the expectation that they would go through preliminary final plat applications and site uh site plan applications as well. [3:51] **Amelia (Intern):** And the other important thing is that there would be um another special use permit approval um would need to be amended if this building if the concept plan gets changed um dramatically to be more than the 4,900 ft currently proposed. Um so currently staff is recommending to approve the special use permit and I can stand for any questions. [4:20] **Acting Chair:** All right. Thanks, Amelia. Appreciate it. Good job. Thank you. [5:03] **Melanie Peters:** Um, I just wanted to say I think the plan is really clear and when reading through it, I really appreciated the detail um about the the security monitoring, those extra pages at the end, the security monitoring and the equipment. And um it just seemed really clear that um whoever is presenting this plan is aware of all of the current regulations and has um you know the I guess the all of yeah all of the security stuff in mind. I just I really appreciated that part of the plan and the detail in that. So thank you. [5:45] **Acting Chair:** Thanks. Right. Thank you. Oh. Oh, go ahead. Sorry. [5:45] **Commissioner:** That's okay. Um, I just wanted a point of clarification. I think I heard—did you say it was going to be a 4,900 foot facility or did I misunderstood the 4,900? You said something about 4,900 at the end. [6:10] **Amelia (Intern):** Yeah, Commissioner. I believe that's the the size of the building. Was there—did you see some place different? [6:10] **Commissioner:** No, I was just wondering if that was what the 4900 was referring to. Thank you. [6:10] **Amelia (Intern):** Correct. [6:31] **Acting Chair:** Um John, does this uh so the last the two last two that we looked at, is this part of that process where it goes into the group and then eventually part of the decision? [6:31] **John Hinzman (Community Development Director):** It is with the special use permit. it allows one to apply for state lensure to check the box for that. Uh it doesn't necessarily secure that a permit is going to be issued. So once this goes to the state then it would come back to us for registration and under the codes we've established we can only have one registered retail cannabis business. So, we do have two other special use permits that have gone through and received approval to apply at the state and I don't have any word back as to where they are as far as status goes. Okay. [7:17] **Commissioner:** Thanks John. Mr. Chair, uh John, is there a time frame that anyone that wants to put in for a special use permit um like a deadline for them to be considered for it for the actual license itself? [7:17] **John Hinzman:** Yeah, Commissioner, we do not have a deadline for those that wish to apply for a special use permit and register the business. I think it's incumbent upon those to do it sooner than later in case uh one of the other special use permits that have been approved or in consideration is set to register because once that first registration occurs and that first registration would occur uh the first one to get through the the state process and make application here. [8:02] **Commissioner:** Thanks John. Uh I also wanted to second Commissioner Peters. This is very clean and very easy to understand. Um, it's a nice—and couple of the other ones there's been a lot of extemporaneous pros. Um, whereas this is pretty much straight to the point and so thank you for that. I can provide a couple of updates here from staff standpoint. Last time we met, we did have a variance request that was recommended for approval to the city council for offense. We did have a meeting on that with city council last week. Unfortunately, with variances, it requires a super majority which we did not have in attendance. Uh however, we did receive direction from those in attendance to prepare a resolution for approval of that variance. So, we will be bringing that forward on July 7th as well for that final action. So that'll take care of that variance request. Our next meeting would be scheduled in three weeks on July 14th. I don't have anything scheduled at this time.
