Seeing no others, I'll close the open forum and go on to Old Business, which is none. New Business: the first item is a public hearing for Jacob Murray, 4603 Hillville Way North, a conditional use permit for an oversized accessory building. Luke?
**[02:40] Luke McClanahan:** Actually, Max will take this one.
**[02:42] Max (City Staff):** Thank you Chair and Planning Commission and good evening. Tonight before us we have a request for a conditional use permit for an oversized accessory structure at 4603 Hillville Way North... [Summarizes report]... Staff recommends approval of the request. The applicant is here in attendance and I'd be happy to answer any questions.
**[04:00] Chairperson Stellari:** Thank you. Does anyone have any questions for Max?

**[04:10] Chairperson Stellari:** Then I'll offer the opportunity to the applicant if they wish to come forward to make any statement. Not seeing a motion, I'll open the public hearing... Next order of business: a public hearing for the Tanner Lake LLC, Tanner Lake Planned Unit Development preliminary plat and final plat of Tanner Lake Second Edition and the site plan for the Tanner Lake mixed use development. Luke.
**[05:10] Luke McClanahan:** Thank you, Chair. So we have in front of us two different requests yet they are related... [Presents detailed PUD and Redevelopment plans]... Staff recommends approval of the proposed Tanner Lake PUD, preliminary plat, final plat, and site plans subject to the conditions found in the resolutions.
**[11:00] Chairperson Stellari:** Thank you. First question I would have is something that's not mentioned anywhere here... Perkins and LivINN? Is there been some consideration to fire department access to them?
**[11:15] Luke McClanahan:** Yes, those facilities are outside of our jurisdiction. Those are actually within the City of Maplewood.
**[11:25] Commissioner Campbell:** I have a couple. Just clarifying—no boat launch? You said no motorized boats, but like, no public launch where I can back a boat in?
**[11:35] Luke McClanahan:** That’s correct. Nothing to that effect is being proposed.
**[11:40] Commissioner Campbell:** What is our code standard for multi-family parking? I'm curious what that delta is and how close are we to a public transit stop?
**[11:55] Luke McClanahan:** I believe the nearest is about a quarter mile at the 3M campus.
**[12:05] Andrew Gitzlaff (Community Development Director):** Good evening Planning Commission members. To verify, Luke is correct about a quarter mile for local transit. For the Gold Line, it’s about .6 miles. Also, the project includes a significant amount of pedestrian improvements and a trail.
**[12:25] Commissioner Campbell:** Did we receive a material board? These uncolored elevations are flat... I would have liked to have seen some renderings or colored elevations.
**[12:35] Luke McClanahan:** Everything we’ve received is in the packet.
**[12:45] Commissioner Campbell:** Condition six says they must dedicate 10 parking spaces for public use. We’re not asking to dedicate those to the City, just keep them reserved?
**[12:55] Luke McClanahan:** That’s correct.
**[13:00] Commissioner Gary Severson:** I guess I have a question. I don't really see where you've made any arrangements for the actual lake. These 126 families will be having access to the lake?
**[13:10] Luke McClanahan:** That is correct.
**[13:15] Chairperson Stellari:** I’ll offer the opportunity for the developer to come forth.
**[13:20] Patrick McGlynn (Developer, Tanner Lake LLC):** Mr. Chairperson, members of the Commission, thank you for having us tonight. We are excited to be here... We're taking a site that's frankly seen better days and we're hoping to create something all the residents of Oakdale can enjoy.
**[14:00] Commissioner Severson:** I have a couple questions for the developer. You're almost treating the lake as if it's a pool... 126 families on a lake that is only 74 acres. I live on the lake; my address is 508 Glenbrook Avenue. I just think this is ridiculous. It’s way overbuilt. It’s going to destroy the lake. [Applause from audience]
**[14:35] Patrick McGlynn:** Respectfully, we have considered that. That’s why we’re going to restore the shoreline and put native plants back in.
**[14:45] Commissioner Severson:** 74 acres is a very small lake for 126 additional families. Rental people don't have the same feeling as people that actually own the place. I just think it's not a good idea.
**[15:15] Commissioner Campbell:** Mr. Chair, I have a couple questions. (To audience: You guys hold your applause, please.) What’s the average rental of one of these market rate units?
**[15:25] Patrick McGlynn:** Studios between $900–$1100, up to $2800 for three bedrooms. Townhomes between $3000–$3500 a month. High-quality housing.
**[15:45] Andrew Gitzlaff:** Mr. Chair, maybe if the Commission can take a step back. This is the opportunity for gathering information; deliberation can occur after the public hearing.
**[15:55] Commissioner Campbell:** I have a couple questions for you specifically on the building. Do you have any colored materials tonight?
**[16:05] Patrick McGlynn:** I don't have physical materials, but my architect can show some images.
**[16:10] Commissioner Campbell:** I'm concerned about this mid-block driveway directly into your building. How can they get back out if they make a wrong turn?
**[16:20] Chairperson Stellari:** The waterfront—that’s a boardwalk, not a public beach?
**[16:25] Patrick McGlynn:** Correct. No swimming or motorized watercraft activities there.
**[16:35] Commissioner Willandur:** I agree with Chris [Campbell] about that entrance. Have you had discussions with MnDOT about the availability of doing that?
**[16:45] Patrick McGlynn:** We have started the conversation. We are looking at other options.
**[17:05] Chairperson Stellari:** At this point, I would be opening the Public Hearing. Three minutes per person.
**[17:15] Florence Buer (Resident):** I live at 329 Geneva Avenue North. Has an environmental impact study been conducted? [Asks several technical questions regarding PUD acreage and Lake View Terrace parking].
**[18:50] Matthew Conan (Resident):** 329 Geneva Avenue North. This looks like you're trying to put 12 dozen eggs in a single saucer. My concern is "eminent domain abuse" against Lake View Terrace in the long-term.
**[20:15] Tony Dub (Resident):** 329 Geneva. [Asks a list of questions regarding density calculations, commercial operation, and MnDOT traffic counts]. I request that approvals be tabled.
**[21:10] Carrie Kinky (Resident):** 421 Gentry. How will we hear the responses to these questions? I have concerns about environmental impact, population density, and traffic on Fourth Street.
**[23:05] Tom Smith (Resident):** Speaking for my son at 329 Geneva. I didn't note any guest parking. There’s no common sense applied to where guests stay. Also, will the traffic exit through the Lake View Terrace parking lot?
**[24:15] Scott Malcolm (Resident):** 439 Gentry Avenue North. I think it’s crowding the lake. First red flag is changing our rules to make the parking work.
**[25:30] Patrick McGlynn:** I would like to offer to host multiple times where we can all sit down and answer every one of your concerns individually.
**[25:45] Ryan Shrader (Resident):** 329 Geneva. The PUD allows you to violate height and parking requirements by a lot. We will be driving through their parking lot to get to our front door. The data in the staff report is lacking.
**[27:50] Unidentified Resident (Lake View Terrace):** I have concern about noise from the heating and cooling system and potential structural damage to our older building during construction.
**[28:30] Chairperson Stellari:** I’m going to close the public hearing. Bring it back to the Commissioners.
**[28:40] Andrew Gitzlaff:** We had a list of questions and staff’s been taking notes. We can walk through some high-level themes tonight.
**[29:00] Luke McClanahan:** [Addresses questions regarding environmental studies, acreage, eminent domain legality, and storm water systems].
**[31:30] Chairperson Stellari:** I think there’s confusion on jurisdictions. Explain the differences between City, MnDOT, and the Watershed District.
**[31:45] Luke McClanahan:** [Explains the roles of Watershed District for runoff, MnDOT for Highway 120, and DNR for Shoreland regulations].
**[33:10] Andrew Gitzlaff:** There were questions about the developer. Patrick, can you speak to your background?
**[33:25] Patrick McGlynn:** I own McGlynn Partners. I’ve done projects in Edina and Jordan. I work with JLG Architects. This building will be near Net Zero—geothermal heat pumps, solar panels, no natural gas.
**[35:10] Commissioner Willandur:** I have concerns about traffic access off 120. And building materials—I’d like to see the hkg recommendations incorporated. I wouldn't be opposed to tabling this.
**[35:50] Commissioner Campbell:** As far as traffic goes, that road is not our purview. If MnDOT says no study is needed, we should defer to experts. On density, the proposed development is actually one unit per 1,511 sq ft, while Lake View Terrace is one unit per 1,059 sq ft. It is actually less dense than what currently exists.
**[37:10] Commissioner Severson:** I respectfully disagree. Obviously you don't live on a lake.
**[37:20] Commissioner Campbell:** I take offense to that. Just because I don't live on a lake doesn't mean I don't understand.
**[37:30] Commissioner Severson:** This is my time! I feel this is a really bad fit. I believe we should table this and get more information.
**[38:15] Commissioner Pearson:** It sounds like you're thinking every single person in the new development is going to buy a boat. There’s public access across the street. I don't see anywhere in these plans for boat storage or a marina.
**[39:00] Chairperson Stellari:** As the oldest one here—I’ve been here for 50 years. Human nature being what it is, the number of people actually using the lake for boats will be a small number. The next step is a motion. I've heard a request to table, but we need to choose.
**[40:15] Andrew Gitzlaff:** The Planning Commission is a recommending body. The Council has seen an earlier version. You can pass with conditions, table, or deny.
**[41:30] Chairperson Stellari:** Taking the first one: the Planned Unit Development. Personally, I believe this should be passed to set the stage. Can I get a motion?
