Abstained. >> Next up is the public hearing to consider a recommendation to the city council for a resolution approving a conditional use permit for used automobile sales and major and minor automobile repair facility for the property located at 7583 Highway 13 West project 25-30. Angie, if you would please. >> Thank you, Mr. Chair and planning commission members. So, this evening, I'll be presenting from the table here. It's kind of a new technology that allows us to be separated from uh the podium stand, which um is often used for public hearings for people to speak at. So, test it out here and hope it goes well. Um so, tonight um we are considering conditional use permit um application for Frontline Auto. Um, the property is located at 7583 Highway 13 West. It is on the south side of Highway 13 West and on the east side of Highway 13 South. Uh, the property is just less than 1 acre in size at 0.86 acres. The property is zoned C2, which stands for General Commerce District, as you can see on the left side of the screen on the zoning map. And the future guided land use designation is commercial which is on the right side of the screen on the future land use map. Um here we're looking at an aerial image of the property zoomed in to take a closer look at the view. Uh the property is outlined in red. The property does include an existing access from the north off of Frontage Road West and a second access from Road Island Avenue on the west side of the site. Um other site conditions include um there is an existing 6400 square f foot masonry building that was constructed in 1978. Uh that building was a former garden center. The property was also formerly occupied by a forklift sales company and other service related businesses. Um the site is in includes um an asphalt surface parking lot on the north side and some existing landscape that's around um mainly the north side of the building around the perimeter. Um other things that are included in the site um is a fenced in area on the southwest corner mainly on the on the um southern side of the building. Um, today the property is used by E5 Energy. Um, and they have received a conditional use permit in the past to allow exterior storage of materials within the fenced in area. Um, so that's how the site has most currently been used and let's see here. Um, there is again that fenced in area. Um the tenants are not per the the new tenants are not proposing to have any exterior storage within that fenced in area. Um Garrett West is the manager of Frontline Auto. They are requesting a conditional use permit application to allow major and minor auto repair and also a used automobile sales use within the existing building. Uh no additional modifications are being proposed. uh with a conditional use permit. They have submitted um a floor plan and site plan. Um the submitted floor plan does illustrate that half of the building will be used for vehicle sales and an associated office space and then the other half of the building will be used for vehicle repair in office. Um so major and minor auto repair are defined by city code and um they do require a conditional use permit that also requires certain development standards within the C2 district. City code does state that used sales shall only be allowed when integral part of a new automobile dealership or if the vehicles are located completely inside a principal or accessory building. So what that means is the used vehicle sales um would have to be tied to also a new dealership license um or else the used vehicles would have to be stored completely in the building. Um the application is not going to have a new car dealership license. So it will be just used vehicle sales and all vehicles associated with those used vehicle sales will be stored or kept inside of the building as required by code. Uh the fenced in area will be used only for parking of customer vehicles that need to be kept um overnight for vehicle repairs. Um and that area will be used more so for security purposes. So here on the screen we're looking at a site plan. It's a little difficult to see. Um there is um parking stalls located along the north side of the site and then this the southern southwest portion of the site is um for that fenced in area for um vehicles that would be kept overnight for vehicle uh repairs. Um here we're looking at parking requirements. The city code does require a minimum of 26 parking spaces total for the proposed land use. The site does appear to be able to accommodate or exceed that minimum parking requirement, although parking spaces should be marked and striped as required by city code. And that is noted as a recommended condition of approval for your consideration. And then I do have some photos of the property. This photo here that we're looking at is a view from uh the front or the of the building taken from Highway 13, Frontage Road West on the north side of the property. And then this site includes 16 striped and marked parking spaces along the north and northwest corner of the property. This is a view from the northeast corner of the building or site. And it does have the ability for about six more parking spaces that would be required to be striped. And then this you're uh looking at an a photo of the west side of the property. This is the southwest corner of the site which it will include additional parking. Um that will also be required to be marked and striped. All the required parking spaces will be required to be striped consistent with city code for the new um tenant. And that is a recommended condition that staff is suggesting um be completed before a certificate of occupancy could be released for the new tenant. Um here again we're just looking at the current tenant is again it's E5 energy and you can see from the from these photos that that fenced in area is being used for um storage of generators that they use. They rent out for special event um type of functions. Um I believe E5 Energy is um planning on relocating to another site within the city of Savage. Um so all these generators, the existing tanks and outdoor storage will be removed from the property. the fence will remain here. This photo is taken from Rhode Island Avenue. It shows the west side of the property. It's fenced and screened. Um, and this is e the east side of the building and property. Um, and then this photo is the rear of the building which you can view which is viewed from the east side of the property. Um, a public hearing is required for the conditional use permit application and notice was published in the Star Tribune newspaper as required. Um, and then property owners within 350 ft were notified of a mailed uh, notification as required by state statute. Um, to date, city staff has not received any um, calls or inquiries about the requested conditional use permit application. And we've also um advertised this on our Let's Talk Savage portal that we use to educate the public on applications and just land use applications going on in the city. Um and I believe the applicant may be present here this evening if the planning commission does have questions of them. Um otherwise, I'd like to offer uh my time for any questions that you may have before you open up the public hearing. >> Great. Thank you, Angie. All right, commission. Do we have any questions for Angie or for the applicants? >> Mr. Chair, um I have just one question on the condition number one. Um can you explain just a little bit more what it means when you say um used sales shall only be allowed when an integral part of a new automobile dealership or if the vehicles are located completely inside a principal or accessory building. that to me didn't come as like very clear as what we're requiring for that. >> Yes. So, thank you. Good question. Um, so, uh, in order to be allowed to have a used vehicle sales, um, the the vehicles that are being offered for sale, the used vehicles would have to be kept within a building. So, they'd have to be stored within a building um, unless the applicant also has a new car dealership um, license. So if they also are selling new vehicles um which they are not. So in this case it's just used vehicle sales. So they are required to be completely inside the building. >> Okay. And that fenced in area doesn't include like considering being inside the principal or accessory building. >> Right. So, um, only vehicles that are the only vehicles that are, um, allowed to be kept within that fenced in area would be vehicles that are, um, being parked there for vehicle repairs, not for used vehicle sales. >> Okay. Thank you. >> Yes. >> Follow-up question on that. Is that normal for municipalities to require just for my own edification? >> It's pretty common from city to city. Um I I'm not sure exactly why. There may be uh perceptions of used vehicles maybe not as aesthetically pleasing possibly as new vehicles, but yeah, that is a pretty standard requirement. >> Okay. Thank you, >> Mr. Chair. Angie, um am I just to refresh my memory with this conditional use permit, it extends in perpetuity with the property itself. So, if the applicant were to sell the business, that conditional use stays with the property. Correct. >> Yes, that's correct. it would stay with the property unless um if that use um fails to continue to exist or occur then there is a time frame at which the cup would basically be expired or voided. >> Okay. In which case if somebody were to want to reestablish that they'd have to come back and go through the same process. Okay. >> Yes. >> Thank you. >> All right. Any further questions? Okay. I don't know if that's something that we require, but it just it seems that this is um a company that is excited to be joining the city of Savage with some strong commitments for, you know, being here for long term as well as looking at partnering with local charities. Um I did want to note one issue on condition number five where it states outdoor storage of equipment, parts, materials or equipment is prohibited except unless um I thought that was a little confusing. Except unless I think it should be something more like either unless or accept as. So maybe just getting rid of accept. >> Yep, that would be correct, Commissioner Wolf. Removing accept would make that coherent. >> And with that change, I would um make a motion to adopt the findings of fact stated in the staff report as well as the conditions recommended by the development review committee. And uh move to recommend A resolution approving a conditional use permit for used automobile sales and major and minor automobile repair for the property located at 7583 Highway 13 West contingent on the DRC conditions. >> All right.
