[0:16] **Chair:** copy okay let's do this thing call the meeting to order Planning Commission meeting Monday March 3rd item one on our agenda is the last time that we met approving of the minutes motion to approve Sam's got the minutes second second B's [Mandy Barnes] got the second all those in favor of the minutes say I those no done with minutes public hearings there are two of them this evening uh first one up is a conditional use permit multifam uh structures First Avenue First Street uh Northwest and we look to Harry Davis
[1:03] **Harry Davis (City Planner):** thank you Mr chair um my PowerPoints loading up but uh what we have in front of us tonight is a use permit request uh from Scott wapa on behalf of CAC the Community Action Center the location of the property is at first AV and First Street in downtown um so here is kind of about where the project is it's just north of buckham Library um it's kind of more closer to the top of the hill there as you get into the more residential area Bas to downtown here's kind of an aerial overview it's these two properties right here uh one building will be on one and then another building will be the other property as I mentioned before it's a conditional use permit so in a uh in our Central business district you can't do multi family by right as we as a conditional use permit and so because this is just a purely multif family building uh we have to go through a condition permanent or so here's the property outlined in red against the zoning map and if we were to zoom in on it and kind of get a idea as to what this project might look like here's a site plan for it so we can see kind of somewhat middle just offset to the right uh there kind of this black dash line that's the dividing property line between these uh two properties and then on one property in the top leftand Corner northwest corner is going to be one building it's four units uh so it's a fourplex one of those units is going to be accessible to the parking lot that's in between these two buildings and on the property line um that unit is kind of lower within the building it's intended to be very Ada accessible um the other building on the right hand side is uh another fourplex in this case I believe trying to remember remember exactly how many units on the this building are are ad accessible and I'll leave that to the appin later on uh but there is one unit that will be in the bottom of the topmost part of the building right in the bottom and you can see there's some stairs northeast corner this is the west building um and what it would look like in terms of elevations at the top there's kind of this perspective view of what it would look like from the intersection then they just one color elevation but kind of generally showing what the rest of building will look like and here's the other building so this other building is a little bit lower sitting uh versus uh westand building but you can see that there is this second story that's underneath units and the top units are they do go out they are they are pretty level with the parking but I believe it's the three units on the southern part of that building that will have second floor kind of under to them a really interesting tape um for the condition use permit we do feel that the condition use permit criteria are met by The Proposal um any additional residential that's downtown will be important to downtown's vibrants as well as contributing to downtown Town's character activity so we don't anticipate any uh adverse impacts to Runing properties so we think that it meets cup criteria and Zoning requirements so we are recommending that you forward this uh resolution to council recommending approval of the condition
[4:43] **Chair:** thank you before we move on I'll just cover kind of the rules of the road again it's been a while since we've done a public hearing both items on the agenda tonight the exact same format uh we'll have a presentation from staff this is now our opportunity to ask any clarifying questions that we have about it when the questions are done then we'll go out to the public name address organization you represent Etc when public hearing's done everybody can cycle through one time when public hearing's done then we bring it back up here and then we'll discuss what's in front of us we'll talk about it for a while somebody will make a motion to do something and we'll vote on that motion we're recommending board and Advisory Board to the city council so then that moves forward doing public like this so with that we are going to open up for questions for Harry thank you chair

[5:48] **Harry Davis:** um uh Mr chair yeah that would be correct there are only two handicaps other questions

[6:19] **Harry Davis:** Mr chair so uh the elevation that's on the left hand side it's kind of in the middle of the images so yes the north elevation so you can kind of see where this red line is and it kind of shows some stairs going down there's a dotted line to show that there's at least part that's hidden you can kind of see the top of the door it's kind of in the middle of that facade just above where those red dashes so that would be the door to that lower else good there are we done with questions anything else samam [Sam]
[7:39] **Harry Davis:** Mr chair so a duplex is exempt from a lot of our requirements when it com plan review so a duplex would just purely go to it wouldn't go any additional review there wouldn't be a site plan trying to remember off hand if a duplex is permitted by R in central business district and I don't think it is I think the only thing that is permitted residential by condition so we're kind of working with a unique situation in terms of zoning and this SP you know in terms of a difference between commercial and residential we don't consider this in terms of use a commercial development we just think that this is a m other questions

[10:19] **Leslie (City Planner):** additional use permit for the ground mounted solar um the application was brought forward from the resident Tomas barley at his res at 927 in the north new here as you can see it's a little bit more of an open space area by kind of an interesting mix of Residential Properties sort of an agricultural character and um flavors there is a solar farm just off site plan that wasant shows the driveway bit of lands dat reason that the application is being put through the conditional use permit process is the 500 the criteria The Proposal feel that the ordinance for If This Were in some dense population of residents our arizonian standards would require the Landscaping provides screening that's quite opaque six feet in height and that would meet a density requirement um within the however based on the on the context of the proposal and that the area that is quite open and where array is to be located is out of keeping to be that sort of contained so we really focused on in the DRC drivability in the screening from on travels would be the barely screened and obstruct with that in mind does meet working based on find questions
[13:22] **Chair:** do we have questions for Leslie I have one it's just kind of more of just jog my memory I remember when we approved the plat on this within the last few years all of that open space it's to the east what is that platted for are there are there potential new homes coming in there is there a road somewhere in there or is that just kind of left land locked and is going to be it's a very large then I will tell I'll if you can yeah because I'm looking at the Beacon uh yeah that yeah that U so you've got highlighted which what looks to be this lot but then you know not it looks like dozen Acres that are just huge open Green Space yeah there you go that's what I'm looking at so the subject lot is inside the green box I'm talking about everything to the east you see where I'm going with it is that eventually buildable someday
[14:05] **Leslie:** so let me briefly outline for you and I apologize for not having the parcels on map so one property in it of itself is residential where this lot is connected this is one entire property then this is single sort of residential agriculture so mix of zoning and I think I provided in your packet oh there's hand us over to Harry
[15:12] **Harry Davis:** I'm just going by what we've got in the packet uh the parcel ID 182 9478 001 okay go ahead so Mr chair so in the time that I've been here there's been no discussion about any subdivisions or expansion of of any residential at least in this part of the city so my understanding is that there's nothing really in the hopper currently and and that's fine ask can answer I just I couldn't remember what we had done in that area if the whole area was platted out or not but yeah if nothing's platted nobody's talking about anything then you've essentially answered my question got to where I was going I just wanted make sure that in 6 months from now there weren't a bunch of houses going up there and they're all angry about sure and you know maybe
[16:06] **Harry Davis:** so the other thing I'm trying to pull up is the comprehensive plan so we have a difference in terms of residential between planned and established so when we're looking at this particular um so if we're looking at the property it's kind of over here right hand side of screen that little Bode property the subject property so this is all planned residential so that means at some point between now and 2040 sure you know having a bunch of residences replatting all these are probably Mak sense uh it what it doesn't mean is that that's going to happen

[17:13] **Leslie:** so the maximum height requirement for the top of the Mechanicals is 10 ft um they did initially submit to us plans that were in excess of that and when that was pointed out to them they accommodated by redesigning the structure so that the tilt of the structure rure when it best absorbing whatever aspect it would be no greater than 10t from the ground elev good thank you
[17:56] **Mandy Barnes:** um and off of white well because um that we really need especially for home especially considering so having them on I wanted to do um having it would allow for it might be a good

[20:09] **Chair:** thank you I just want to jump in and support what what part was saying uh as far as the height thing yeah that they're doing some really creative stuff if they're a little bit higher you can get some pollinator friendly plants down there well it just seems to work better if they can be a little bit higher so that's worth discussing that 120 ft is so again that's reflected in the minutes now that's been part of our discussion so that can move forward with the recommendations I just wanted to make sure that we had it documented anything else from the group Parts [Mandy Barnes] got the motion has got the second as presented any discussion on that we will vote all those in favor say I no done with that request to be heard
