actions miss Barr would you introduce item number two five please as a.m. - 2 1-3 annexation application a n - 2 1 3 Allen ranches located along the loop 303 and Bethany home road west to citrus Road and south to camel back road public hearing mayor members of the council here to provide staff report is our interim development services director Lisa Collins Thank You mr. Phelps mayor and members of the council this is an application for Allen ranches it's a blank petition so there's no action required by the council this evening and the vicinity map shows the general location of this in conjunction with City Hall it is the far west side of the city north and Bethany Home Road Camelback Road on the south citrus road on the west and the 303 on the east so the previous council actions on this case were a council workshop on March 24th this annexation proposal was introduced it contains industrial and residential uses the council did provide consensus to move forward with the annexation process so the purpose for our hearing this evening is required by state statute a blank petition was filed and that is a it's a petition with the legal description but no names on the petition yet they're required to have a public hearing within the last 10 days of the 30-day wait period and that's why we're here today on May 11th so just to refresh everyone's memory this is an 865 acre site located in the area that I just described in the vicinity aerial it does show Maricopa County to the north and west Goodyear the city of Goodyear is to the south and the East loop 303 is to the east so the recent annexations in the area are shown in this graphic we have three sets of processes going on here as you see in the yellow those are annexations that have already been approved so cotton 303 Berkeley West 303 in copper wing logistics the blank petitions are shown in red and those are the ones we're going to see this evening so there are three the one highlighted is Allen ranches and then we do have some cases that are ready for adoption so they've already been through the process that we're at this evening and they're going for adoption we'll just see one of those this evening all three of them are listed but two of them you'll see at a later date this is a little closer up just to show you better in relation to the activity on the 303 which is fairly extensive these are the noise contours in the area and so all of the noise contours for the various annexations that are either in process are approved are indicated there when you see that it says outside of the night noise contours that's where residential uses are allowed to some degree and they're allowed in conjunction with me look at the graduated density that's established by Luke Air Force Base and that's sort of the maximum that's allowed for any of these areas so you'll see Allen ranch has some area outside the noise contours and then some areas within the 65 and 70 LDN in the 65 and 70 LDN is where the industrial is proposed and the residential is proposed outside and the arrow on there is pointing to the area that's outside so the Glendale general plan does show this as Luke compatible land uses and residential and as you know when annexations come in through the city like zoning is what is required so this current zoning in Maricopa County is residential and Luke compatible and the glendale like zoning that will occur is residential and Luke compatible so the next process the next steps in the annexation process again as required by the state statute the blank petition was filed April 15th so we're at the hearing tonight on May 12th after this the property owners can sign the petition and then after that we can schedule a hearing for the council to consider adoption if you do adopt the case in 30 days later it'll be added to the City of Glendale so with that I'm happy to answer any questions you have again this is the public hearing on a blank petition so there's no action required by the council any questions from the council mayor a question here it was a letter that we have we all have here that was given to us tonight I'd like to ask that city city clerk at least paraphrase that read it into the record it's there that we were that we received from Montana farms property owners association and their people boxes there I wouldn't expect the whole thing to be read but you'll paraphrase it so it's read into the record that it was delivered to us councilmember Aldama they did submit comments to be read into the record oh they did that's a handout for okay then we're good then thank you okay any questions yes mayor good is there a rezoning application that's working through the process as well Thank You mr. mayor councilman Turner yes there is and that will be heard at the Planning Commission on June 4th and then at City Council on June 23rd and the expectation is that the annexation and the zoning and general plan actions will be heard at the same time okay thank you seeing as the neighbors have brought up the zoning situation and changes in zoning though I realize this isn't a zoning public hearing tonight I just letting staff know that I'd like to have some information about the surrounding zoning that's in a whether it be in the county or in other cities and some history on any changes that this particular site has seen in the plan is it I'm seeing two different looks here from evitt based on what the residence is sent to us and I'd kind of like to know how the what's been what's currently proposed compares to what had been proposed in the past so we see what the changes in expectations are and I think that's all I have at the moment oh I did want to say thank you for including the noise contours in the PowerPoint tonight and look forward to seeing them in our packets in the future any other questions public hearing is now open on item 25 miss Bower I know that we have some public comments would you like to read those comments please yes mr. mayor we have eight public comments the first one is from Gary Blandino from Litchfield Park and he did also provide a handout for council blend l mayor and council members I'm ready to appeal to the council to reject the Allen Ranch residential proposal our 1-4 properties are totally unreasonable at size based on the types of surrounding development in the area this proposal is nothing nothing less than spot zoning the classic definition of spot zoning is the process of singling out a small parcel of land for a used classification totally different from that of the surrounding area for the benefit of the owner of such property and to the detriment of other owners attached file shows the results based on the fact that a very large number of residents had met and agreed in good faith with the developers in 2016 notice the transitional layout of this subdivision from west to east the Lots graduated are one 10 + r1 - 18 in the West - r1 - 6 sizes to the south and east these plans were approved by Maricopa County so you can see we were not angry citizens trying to block all development but we're just seeking a reasonable transition from the large lot developments that abutted this property the smallest lot size that Maricopa County would accept was r1 - the six existing homes to the north and west our minimum r1 - 18 along with large acre areas of an acre - 10 acres the developer had agreed to a large step back buffer zone from Citrus Avenue and the Lots were agreed to be larger and single-story along that corridor now the developer has shrunk the residential footprint and obliterated the transitional residential flow that was agreed upon the developers specious arguments for sound mitigation for the benefit of homeowners is truly laughable do you think by moving the residential property line a few hundred feet to the west will significantly reduce the sound levels I would wonder if you have ever taken the time to visit this area and experience the flight training activities this redesign is strictly for profit motivation for the developer with little regard to the residents in the area have they given you data to support this reasoning additionally with a much smaller residential footprint they are adding more homes than the original approved plan the developers are using this annexation ploy to invalidate the original agreement with Maricopa County and use Glendale as a conduit to get what they want regardless of the impact we will all be left with the economic and social debris if this is allowed to proceed as requested I would hope that as not just government officials for the city of glendale but also as Arizonans that you would consider the long-term impact of your decision this proposal to develop an isolated residential island is also a recipe for disaster for the people that buy into the community as well as for the city itself thank you for your time the next is from rob and sherry Dhakal of clearwater farms - mayor wires and the Glendale City Council my family does not believe it is in our or any of the surrounding neighborhoods best interest for Glendale to be allowed to develop the Allen Ranch parcel as they have planned to the north and northwest neighborhoods are on one acre parcels or larger and directly west the Russell Ranch community is on larger Lots the proposal that Glendale has suggested would be on considerably smaller Lots and not like any of the surrounding established communities Linda also has no plans on building the supporting infrastructure that this neighborhood and the other proposed developments that Glendale has Strip annex will need the existing area residents are not residents of Glendale so our concerns about how the changes that City Council is proposing for our communities are not as important because we have no recourse when it comes time to vote we hope that you take into consideration the changes this will bring to our way of life not just by how much tax revenue it would bring to the city of glendale the next comment is from howard Thorp Richville Park this is email correspondence with mr. Benjamin Tate of with E Morris at least the Collins and the city manager mr. Thorpe the Allen Ranch neighborhood meeting needs to be postponed until all interested participants can attend in person and not be obligated to use their personal computers this the burden is on the City of Glendale and with E Morris to post an Allen ranch town hall meeting and not on County residents to load software ensure their IP IPS are connecting properly to a WebEx meeting server somewhere you're shifting the burden to County residents where each participant becomes his/her own IT department or any troubleshooting furthermore the WebEx software it will not run on my machine regardless let me be clear I will not don't download any software on my computer or phone and have the burden of connecting on me for the benefit of with Morris or the City of Glendale this plan virtual neighborhood mean also eliminates any residents without computers or who prefer like me not to download and Trust client software is that fair therefore a virtual meeting only limits HOA officials residents and neighborhoods participation and does not offer every person an opportunity to understand why the Allen ranch property is being reconfigured if this electronic meeting occurs as scheduled April 15th I strongly up to object to any Allen ranch replan replanting rezoning or reconfiguring it until after the virus pandemic is behind us and people can gather again at city or county facilities to discuss any concerns and objections that is what I call being flexible and patient in this changing environment from Benjamin Tate with amoris on 4:13 this is neither the only nor the last hour for us to engage with you and your neighbors about the project if our schedule permits in the statewide circumstances with respect to the outbreak improved we would be happy to schedule a follow-up in-person meeting as soon as it is safe and practicable in the meantime we need to meet the requirements of the city and provide information to the neighborhood about the project if there is an additional method for doing so I'm sure we are open to it to supplement our efforts finally if you're having technical issues with your computer to prepare for the meeting I am happy to help please let me know mr. Thorpe responds to mr. Tate thank you for your reply I understand the public safety issues occurring at this time but don't trust the City of Glendale their agenda is to check off neighborhood engagement ASAP to move the project forward as proposed and based on their schedule from mr. Tate's response above this is neither the only nor the last opportunity for us to engage with engage with you and your neighbors about the project if our schedule permits and the statewide circumstances with respect to the out proof outbreak improve we would be happy to reschedule a follow-up in-person meeting as soon as it is safe and practical practicable mr. Thorpe so there is a schedule for Allen ranch rezoning approvals what is it no no reply from Glendora Glendale or with amorous as I mentioned previously the WebEx client will not run on my operating system a better solution would be a web-based webinar where residents use their browser and don't have to download and run the WebEx client most computer users read email and browse the Internet so just provide a URL to a webinar site if the City of Glendale wanted to make this meeting more broadly accessible they should have asked with amoris to set up a website or use the city site for this meeting rather than use an application the city uses and county residents do not finally will with amoris be posting transcripts and transcripts of the virtual meeting for browser access by interested neighbors and when will they be available with you more should also preface the meeting with a privacy statement since I assume the Cisco WebEx cloud will be used to store meeting content right this meeting should be postponed until the health situation in Arizona improves the neighborhood residents who are impacted by the corona corona virus and want to participate can no reply on meeting transcripts including questions and answers from lisa collins Glendale city manager or worth amoris this one is from Rik Spradlin Litchfield Park honorable Glendale City Council as a homeowner in Russell Ranch the County Island located directly west of your proposed annexation site I am extremely disappointed with Glendale decision to change the county zoning from r-11 - 4 this is in no way compatible with surrounding properties you now have one acre Lots the north and at least 1/2 to 3/4 acre Lots the west and farmland to the south how can the council fall for the developers attempt to label these smaller Lots as transitional clearly they are attempting to build as many homes as possible in a very small area the area utilized for housing actually shrank by nearly half yet the proposed number of homes has increased from the last County zoning plan as you can imagine this is unacceptable to our custom home community please reconsider and do not approve this rezoning and annexation this area is not developed for the kind of density the developer is trying to impose on both the City of Glendale and Maricopa County please vote no to annexation and read my objections into the minutes thank you for time and thoughtful consideration from Terrence and Deborah damron from Russell Ranch Glendale City Council members thank you for the opportunity to render comment on this issue first we recognize that your predecessors on the City Council made financial decisions that have left you in extremely difficult circumstances especially given the reliance your budget places on sales tax revenue to serve as your bond indebtedness having said that we hope you recognize that there are several communities in the area adjacent to Allen ranches that will be impacted by your decisions on the annexation of Allen ranches and the subsequent development of this land these communities include Montaigne farms one and two Terra estates citrus Glen Clearwater farms phases 1 through 7 and Russell Ranch Savannah and cottonwood estates although a bit west of the proposed annexation will also be impacted as well there are some key points we hope you will consider Maricopa County conducted a rezoning process which resulted in the rezoning of property in December 2016 this involved input from the stakeholders in the area and followed the development guidelines established in the white tanks Grand Avenue plan and vision 2030 the Maricopa County Comprehensive Plan this annexation and development plan will set aside the efforts of all those who participated in the earlier rezoning and the spirit of state law which is which establishes that the zoning after an annexation process should be as close to what was in place prior to the annexation the proposed development plan ignores the concerns which Maricopa County identified regarding the needs to reduce potential conflicts brought about by dramatic shifts in zoning and land use no apparent concern is afforded the impact that a relatively high density residential community will have on the lives of the families currently living in the area their general safety and their schools water is a serious issue for all Arizonans and developers continue to ignore that we are currently using this resource at an unsustainable pace this plan calls for deferring the city's responsibility to this potential Island of Glendale residents 20 miles from Glendale City Hall this is a classic example of spot zoning one of the reasons that strip annexation was out like outlawed by the state legislature in 1980 even after transferring police and fire emergency responsibilities you will still at some point have to assume responsibility for infrastructure maintenance an issue that you currently are addressing as deferred maintenance within the city limits of Glendale this plan is one more challenge to the retention of Luke Air Force Base as part of the valley economy and history we have no voice yet we hope your thoughtful actions will not make us bear a heavy burden for glendale's budget problems problems not of our making nor under our control please consider what is best for everyone and not just the residents of Glendale proper thank you the next is from Wendy Ronny no address I see hello I see you all are having a meeting tonight regarding Allen Ranch I love how you are scheduling these meetings with barely any notice to the citizens that your plans are going to effect I would really appreciate the answers to the bloke below questions one where are all these cars going to go will you be expanding and maintaining the roads and how to do plan how did you plan on handling the fact that people ride horses along the side of the road that's what many of us moved out here to do I can tell you right now that things get very crowded out here when we aren't in the middle of a pandemic adding even more traffic it's going to result in nothing but bottleneck you I have been told that Allen ranch will be high-density housing most of the housing in this area is on one acre or more in an effort to help the current homeowners keep their property values I would think that you would want to keep the same one acre zoning or is this not a worry for you since you don't live anywhere near here three who will be policing the area well Glendale be responsible or is this not a glendale issue thank you the next is from Dave and Donna Ewing Russell ranch Glendale City Council density density density here we go again a developer proposing high density to achieve maximum return on investment without regard to the existing neighborhood developments in 2016 Maricopa County rezone the Allen ranches property with Lots ranging from 18,000 square feet down to 6000 square feet this was in keeping with a transition from current development surrounding this property now we have a developer wanting to put in more homes on less acreage which vastly increases the density the proposed residential density of Allen ranches will impose a burden on services for this high-density spot zoning traffic schools and medical services will all be affected to say the least we are not opposed to development however we value our neighborhoods and our residences this high density will definitely have a negative impact on those who live in the area we request you take a hard look at this development and not just what the developer wants please consider what is best for all that for all that reside in the area vote against this high-density thank you and the last one is from the Montaigne farms to HOA and they also included handouts dear mayor City Council members and staff we are the board of directors for the Montaigne farms - property owners association which is located one block north of the proposed Allen Ranch development we are writing to share our associations unanimous opposition to the annexation and proposed development of this property by the City of Glendale for the following reasons one the proposal disrespects the sound surrounding neighborhoods in 2016 various stakeholders work together to rezone the Allen ranch property within Maricopa County which resulted in a compromised plan for the use of the land this compromise include 10,000 square foot Lots on the west end of the property with gradual decreases in lot size moving east toward cotton unfortunately the owners of this parcel now want to throw out the 2016 agreement entirely and replace it with an unacceptable plan continue a much larger industrial footprint as well as a residential development that is approximately 42% smaller and yet contains 7% more homes than the 2016 agreement please see the attached file comparing the 26 agreement with the 2020 proposal this revised plan places massive tip-up buildings in close proximity to 500,000 to 1.5 million custom homes and dramatically reduces the greed upon lot sizes from 18,000 square feet down to 4 to 8,000 square feet which would place high-density entry level homes across the street from high-end homes on much larger Lots this abrupt change in property type and lot size provides no prefer or transition which sharply contrasts with the existing character of our community also this change will lead to more rental properties higher residential turnover rates higher crime increased tractor-trailer traffic near our neighborhoods increased traffic congestion increased light pollution and would negatively impact Area Schools Arizona law stipulates that properties annexed by a new municipality should zone the property as close as possible to the zoning that existed before the annexation using the PA d designation to set aside the 26 rezoning agreement disrespects and disenfranchises existing property owners which violates the spirit of the white tank's Grand Avenue Planning guide and the vision 2030 comprehensive plan 2 we are not the City of Glendale many years ago the City of Glendale used a process known as drip annexation to make arbitrary claims on large swaths of land far away from its city center this process was made illegal 40 years ago in 1980 to avoid the swiss-cheese annexation that the city of glendale is now forcing on us which is when municipalities overextend themselves in gobble up land that creates City island surrounded by County line the people in our community are residents of Weddell which is an unincorporated area within Maricopa County when we buy groceries get a haircut or watch a movie we go to Litchfield Park but you're in surprise it is only when we watch a sporting event that we drive all the way to Glendale to catch a game in other words Glendale is not and has never been our neighbor rather it is a big city 20 to 30 minutes away three glendale's financial problems and missing city services the City of Glendale carries almost a half billion dollar debt burden due to sports facilities which is only being exacerbated by the current Koba 19 pandemic impact on spring training and tourism while we are sympathetic to glendale's plight we do not want the Glendale City Council to in fact inflict harm on our community by ignoring our wishes and gobbling a plan to gain tax revenue primarily to finish your debt we've driven around Glendale and seeing the differed maintenance on your roads and we know that Glendale is not hiring for most positions because you can't afford to furthermore the closest Glendale fire and police stations are 15 miles away which means that you are not positioned to provide city services to the new residential area anyway therefore it is our perception that you are considering this annexation for selfish reasons and that you do not have our community's best interests at heart our wishes the family in our Kamel ease in our community worked hard to purchase homes here we selected this community because it reflects the lifestyle we want to live we built good lives out here for our children and we do not want a city that is 15 miles away to ruin that we have no problem with the Allen ranch property being developed however annexation and development must be done in a manner that honors and respects that people already living here which includes the 2016 agreement it should be a win-win for the city and the residents in the area which is why we're asking you not to annex its property and to leave the twenty-sixth agreement in 2016 agreement in place thank you for taking the time to listen to our concerns we hope that you will prove us wrong and demonstrate that the City of Glendale genuinely cares about our concerns by honoring our wishes and preserving the quality of life we enjoy here at the final one that's a final one okay public hearing is now closed Pelt mayor and members of the council this is a request for a D annexation and on the vicinity map it depicts the location of City Hall and the John epilogue you saw this previously and it was called copper wing so there have been several previous actions this annexation proposal was introduced November 26 2019 the council provided consensus to move forward with the annexation process so we did hold a public hearing on January 14th on the blank petitions and those were signed there was a public here there was a City Council hearing on January 28 and the annexation was actually approved so again the purpose for the hearing is D annexation of the property so the John F long properties owns this six point three six nine acres of land located west of the northwest corner of the interchange of Dicer Road in northern Parkway the request is for a DNX a ssin from the city of glendale and annexation into the city of El Mirage this is the area on the aerial and this is really property that resulted from the northern Parkway alignments so again this shows in the highlighted green the location of what what you saw as copper wing logistics and I'll mention this property came in to the city from the county with the intent to be combined with the property to the north the city of El Mirage so that they had the opportunity to develop all within one city so that's why you saw no change in zoning there's no change in zoning all zoning entitlements will occur in the city of El Mirage so again north of this is the city of El Mirage West is Maricopa County South is northern Parkway in Maricopa County and East is Dysart Road in the city of El Mirage so is required by state statute a City Council public hearing is not required for a blank petition on this the D annexation can proceed directly to the council or adoption of the D annexation which is what we're requesting this evening and again if the DNX asian ordinance has approved a hearing would be scheduled with the Maricopa County Board of Supervisors for their approval and once approved the property would be in the jurisdiction of El Mirage so with that I'm happy to answer any questions you may have thank you okay I do this pandemic that we've been working through now we were not able to have that induction ceremony we thought if we postponed it possible we may be able to have it right now all indications are that we're not going to be able to have this year's at all which is a very large shame for many reasons one is we were expecting nearly 500 students and then secondly the fact that these same students didn't the graduating didn't get to walk across stage so it would have been nice to be able to at least have them be recognized going into our military so we are going to just shift that for next year and unfortunately this this group of young people serving our country won't be recognized as as we'd hoped we are certainly planning on our stand up for veterans that date is not going to change we're going to continue on hopefully things will be worked out but I'd rather plan on it and have to cancel it then not plan on it and then wish that we would have had it so right now the induction I'm sorry the stand up for veterans will be again late September and I'll be posting the dates on that as that comes up and that's for all all people serving or have served this country with that next on police or fire protection it is not required for homeowners to pay for the yearly subscription to rural Metro for their services Maricopa County Sheriff's Department's already spread too thin what are got their green grass in the median and the right away and every time I go by there the world is flooded so not that long ago in the paper I read an article how the City of Glendale is recommending that US citizens we wash our clothes once every six months and I take a shower once every month control to conserve water concerns water instead of God three years it's been three years since I've been attending City Council meetings I'm standing up there at the podium and I'm looking you people right in the face I'm saying what the hell is going on all this waste hundreds of billions of gallons of water being wasted being dumped in the street destroying all those totally new reconstructed roads are the millions it cost to reconstruct all those roads new asphalt new new new markings for whatever and it's all for naught it's three years now this summer that all that taxpayer dollars were reconstructing all those roads that were destroyed because of water being dumped in the
