The Planning Commission is made up of seven volunteer Bloomington residents appointed by the City Council. Tonight, we have—we do have a quorum. The Commission advises the City Council on development standards, long-range planning, and transportation issues. Our work is informed by the City's Comprehensive Plan, District Plans, and the City Code. For some, the Commission makes a recommendation with the City Council having the final decision authority; in other cases, the Planning Commission—excuse me—can approve or deny an application subject to an appeal to the City Council. For each item, there will be a staff report, opportunity for the applicant to present, and then time for any member of the public to provide testimony. Our first order of business is the Pledge of Allegiance. Please, as you are able: I pledge allegiance to the flag of the United States of America, and to the Republic for which it stands, one nation under God, indivisible, with liberty and justice for all. All right. Tonight, we have one public hearing and two study items. Before we begin, I will ask our Senior Planner to go over details on how to testify remotely.

[00:01:50] **Chair:** Our first item is a request for a Conditional Use Permit for a pet services facility. Planning Technician Novarro has the staff report.
[00:02:00] **Novarro (Planning Technician):** Good evening, Chair and board members. Item one is a Conditional Use Permit for a pet service facility in an existing shopping center located at 5101 West 98th Street. This aerial shows the subject property highlighted in blue. The site is an existing shopping center and is home to PD, which is a General Planned Development. This site is located along West 98th Street, Normandale Boulevard, and Reach to the north of the subject side. We have multiple-family residential zone R-M 12. To the east, we have single-family residential zone R-1. To the west, we have office zone B-1 PD. And to the south, we have single and full-mix multiple-family residential zone R-1 and R-4. Pet services facilities are allowed as conditional uses in the B-2 zoning district, and this is why this application is before you tonight.
This site plan shows the existing shopping center and the subject tenant space for the proposed pet service facility, which is located in 5129 and is circled in red in this screen. The subject tenant space is approximately 1,400 square feet, including a waiting area, office space, and two training rooms. The proposed pet service facility provides dog group training and private lessons. They will be open from 10:00 a.m. to 8:00 p.m. Each class will last approximately 45 minutes with a maximum of five dogs per class. Also, the applicant has stated that there will not be any animal boarding or additional pet services such as grooming or veterinary care.
I wanted to go back to the site plan just to show you that the tenant adjacent to the north of the proposed use will be a children's daycare use, and the tenant adjacent to the south of the proposed use will be a shoe repair retail use. Whenever a pet service facility shares a common wall or ceiling with another user, a structural engineering detail must be provided demonstrating sound attenuation (STC) rating of 55 or higher for such common walls and ceilings. Staff is recommending a condition of approval stating that engineering detail must be provided demonstrating the STC rating of 55 or higher for the walls and ceilings prior to occupancy. If these details are not provided, a noise study by a qualified professional must be completed and submitted prior to occupancy.
I just wanted to bring this up: as you may know, staff is required to notify property owners within certain boundaries depending on the type of application. In this case, staff notified the property owners within a 500-foot radius. However, these notifications are only sent to property owners and not the tenants. Since the pet facility is adjacent to a daycare, which is noise-sensitive, staff has had correspondence with the applicant to make sure the daycare tenants were notified of the application. As of today, staff has not received any comments or concerns from the daycare tenant regarding the application. With that, staff was able to make the required findings and we recommend approval through the following motion on the screen, and I'm available if you have any questions.

The current item on the agenda for April 27th is the 2022 System Statement/Comp Plan, and so there will be something on that meeting for sure. For the next meeting on May 11th, the agenda does not close until April 5th. We've got, as you well know, a lot of factors out there. We have a lot of people who say they will apply, but they're trying to make numbers work first. So, hopefully, we get a little more business in the next few months. Other than that, I just want to report that the City Council—in case you didn't know—actually continued for more discussion the two-family and single-family residential item on Monday night, just to discuss some of the concerns neighbors raised. Then they'll bring it back. I'm not sure what the "date certain" is on that, but I thought I would update you. That's all.
