[6:37] **John Wilcox**: i'm here at city councilman my name is john wilcox um i live in the downtown area of cannon falls first i want to start out saying it's good to see john back in his seat presiding over some of these meetings you know i'm glad you're feeling better sir thank you uh i had a couple of questions comments um in past meetings i've observed that you know when doing interactive television you know the i was reading through the league of minnesota city's uh documentation which refers to minnesota statutes and and in that it details that we should be able to see and hear there's there's four different areas but we'll be able to see all council members must be able to hear and see others and
[7:24] **John Wilcox**: all discussion and testimony presented at any location at which one at least one council number is present and the second all members of the public which you know those of us that are here would be able to see and hear those people that at a remote location i understand that there are times when that happens where uh you know and i've i can remember two different situations where a council member was off site and i could hear a roll call acknowledgement and voting acknowledgement but i couldn't see that person so that was one issue the other issue all closed meetings except those closed meetings that are permitted
[8:09] **John Wilcox**: by attorney client privilege must be electronically recorded so my question is are all the meetings this one obviously is are the commission meetings or the park board meetings or those other meetings being recorded and kept uh for the determined time under the minnesota statute and that's 13 d if uh if there's any question um i'd be interested to hear what the council has to say about uh bringing that into compliance thank you thanks john okay babe
[8:51] **Babe O'Gorman**: good evening mayor and council on your consent agenda this evening chief mccormick wants to pre-approve a police officer that has yet to be interviewed it seems a little odd to me it conflicts with the charter and ordnance 370.
[9:14] **Babe O'Gorman**: and i'm wondering why you don't make the chief follow the ordinance that you folks created and that would be 370 and go through the prop proper process um a year ago or about a year ago a little more then you hired four officers and there wasn't a problem with it it all transpired and took place and seems like there's a fire drill on this for some reason and i don't understand it second the police chief is not a member of the police commission yet it's my belief that he takes notes and develops the minutes and i don't think that's proper i can show you where
[10:00] **Babe O'Gorman**: there has been omission of items from the police minutes and that they've been manipulated at times so that is not proper the other item that i have is uh about a trash hauling there's been no mention of trash hauler single trash hauler you guys had a public hearing you all met here you had a workshop you made a decision not to make a decision in a meeting that you can't make a decision in not a big deal but the public's sitting here and they don't know what's going on because nobody's ever said anything to my knowledge can i address that babe can i address that

[11:33] **Babe O'Gorman**: like in some suburban neighborhood i believe it was richfield where they had three haulers and they each took a portion of the city to haul to and the first hauler called the two-thirds of the city the second hauler hauled to one-third of the city and the third hauler hauled to one third of the city and i'm sitting here looking around wondering well is anybody going to say anything no and then that same scenario was repeated again and yet nobody asked the question and that's a lot of the problem i'm having with this administration in this council is why don't we ask some questions

[16:41] **City Engineer Bill Angerman**: i'm sorry there are two resolutions uh in your packet uh for setting the final assessment hearings what's in your packet tonight is that we're proposing uh you'll set the final hearing for july 5th just to recap you know we explain this at the preliminary hearing how that works is then at that hearing the council will accept testimony uh if people so are inclined to offer any regarding their assessment amount so that is when they can appeal the assessment so they would appeal that to you by presenting evidence that their the benefit to their property is less than the assessment amount so you are the board that would hear that and then that evening then you would decide to either uphold the assessments or to set a different value and again just as
[17:26] **City Engineer Bill Angerman**: a reminder then if a resident does not like uh your decision then they can appeal at the district court okay so what we're doing tonight is setting that in motion and we are setting some initial items that i'll go through in the resolution so uh regarding the bids themselves so happy report the bids came in uh slightly under budget right now we are we're really nervous about that with prices particularly gas prices where they're at uh so the preliminary assessment amount was seven thousand dollars and we use round numbers when we we have preliminary hearings uh so the the total assessment amount now actual numbers and we also did include uh the city's administration fee so we are charged fees like the county for example uh to
[18:13] **City Engineer Bill Angerman**: file assessments and other administrative charges so sorry that would bring uh the assessment amount the final assessment because now we have actual bids the actual number would be seven thousand two hundred and thirty seven dollars so remember at that preliminary hearing it's just that it's a it's an estimate now we have an actual number uh that will be acting on july 5th to certify so the first resolution that you have is setting the assessment amount okay so that's detailed in your packet uh so we'd ask for so staff is recommending approval of that one and then the second one is calling the public hearing and in that you are setting out the payment terms in there as well so mayor i don't know if you want to act on the first one or if you want me to explain both of

[19:04] **City Engineer Bill Angerman**: okay all right so in the second uh uh one there what we do is we set the parameters of the assessment we just went straight out of your assessment policy we didn't deviate from that and that is uh the payback period would be so people can either prepay or they can have it go on their tax roll for a period of 10 years and then the interest rate per again per your assessment policy or per your ordinance is what's called the bond buyer's index so that's an index that you look up that's you know a national index and then it's plus 2 so the current rate as of when we published this was 3.0 percent so add two percent so the interest rate would then be five percent okay so uh people would have the
[19:46] **City Engineer Bill Angerman**: option to prepay or have it put on their taxes for ten years at five percent uh the other items that uh then are also would would would be an option is to have uh deferrals for senior citizens for military personnel or disabled uh people as well so that provision is also included in the notice and someone would be able to file that deferment by coming to city hall and discussing that with staff and i'm just looking at my notes i believe those were were the only provisions uh or the main provisions in there that you know maybe there's some subjectivity or where we fill in uh neil anything to add on that
[20:32] **City Administrator (Neil Jensen)**: that pretty much covers it all um we're just seeking approval of the two resolutions and then we'll send out our public hearing notices and then the intent would be at that july 15 we'd have that hearing and then uh you know ideally we we don't have any appeals or public comment then what would happen is you would award the contract that night and then we would issue a notice to proceed for rochester sound to begin the project

[22:46] **City Attorney Shelley Ryan**: all right good evening mayor council members uh mr jensen requested that i review the liquor license application uh this application is made by an entity
[22:53] **City Attorney Shelley Ryan**: by the name of romejo llc and there were a couple of deficiencies i noticed in the application uh one of which is that currently under city code when you have a non-resident uh applicant uh this this corporation is actually out of white bear lake um they're required to appoint a local resident manager i've discussed that with with neil and apparently that that is a requirement that's maybe not been applied in the past uh maybe is not a concern to the city council uh so that uh that is one issue that that may not uh prohibit the granting of this license um so that's one item for discussion the
[23:38] **City Attorney Shelley Ryan**: other item is that the applicant provided a responsible party an individual as they're required to do but the individual does not have a social security number uh that they did provide what appears to be a valid tax id number and there's some conflicting information in the documents and email correspondence provided by the applicant's attorney as to whether the state would accept uh the tax id number versus having that social security number so that is still uh i've attempted to reach out to the state or i have reached out to the state they have not gotten back to me so that's an open issue if you would take a very strict reading of the application form it does require a
[24:24] **City Attorney Shelley Ryan**: social security number though there's an indication from the state that they would accept a tax id number um i just want to make clear this is there's no indication that the applicant has provided a false information um it is simply that he does not have a social security number and he's provided us what he does have and so it's it's really up to the city to determine if that's acceptable and then ultimately uh whether that's accepted by the state is is a separate matter
[25:01] **Mayor Matt Montgomery**: good explanation shelly thank you okay and there's ways that you could proceed with this this evening um this applicant as you know it's an existing business i don't want to get it into the background and sort of how this transpired it's not really relevant to the application before you um but it is a it's an ongoing business that is currently without a liquor license um all other areas of the license seem to be or the applications seem to be appropriately filled in um you know if we want to wait for some confirmation that the tax id is sufficient tonight if you so choose to do a conditional type approval that's certainly appropriate well um i don't know if anybody else wants to discuss it but
[25:48] **Council Member Chris Nobach**: um i'm in favor of approving it at the city level um but you still have to get approval some type of approval from the state correct it's like conditional is it appropriate uh mr althoff that i speak

[26:04] **Patrick Moore**: so i'm patrick moore i'm a lawyer from ice ante minnesota another little town just north of the cities and i've represented ramon for many years i'm his business attorney and so that's why i came down tonight i've been working with ms ryan to uh help her with the application and get her the information that she needs and uh so what i would say is this
[26:35] **Patrick Moore**: um on the tin number we are working with the state of minnesota gambling and alcohol board to get that approval there's a mr mcmanus there that we've both been emailing with and calling to try to find this out and i can tell you i'm also a certified public accountant and back in the old days i worked at 3m as an international tax lawyer why i went to small town practice law long story but so anyway the tin number is legitimately issued to people who are here as permanent residents uh that are not nationalized citizens that's kind of the gold cup for
[27:20] **Patrick Moore**: immigrants otherwise you get a tin number which allows you to pay your taxes legally and operate legally which mr uh braless does i wouldn't have anything to do with him and but you have to get that tin number and until you become naturalized you're not getting a social and so that's that's the level he is and that's that's where he sits with that and he's been operating here in town for almost six years i don't live here but i assume it's been good for all involved he employs 12 people and provides a good multicultural cuisine for you guys i've eaten at his forest lake restaurant many times and i really enjoy it so that's all i'll say yeah if you have any questions i'd love to answer them
[28:06] **Mayor Matt Montgomery**: okay well i guess i'm kind of with steve i think we should you know we shouldn't be the ones holding this up so if we approve it subject to the state then we're you know we're not the ones who i don't want to hold this up this that's no point in that that's my feeling anyway thank you very much so unless anybody has anything else to say i'm going to make that a motion to prove it conditionally on the approval through the state

[29:50] **Council Member Matt Montgomery**: okay to me is the compost side proposal matt yeah this issue i think is great i think having them come in and sift the dirt um and taking 75 and leaving 25 i think that's just fine the reason i bring this up is more um a local resident has brought to my attention before about the compost site which related to this that it says in here that we've reached capacity we're a town of four thousand uh it's a great facility for the town however this resident is afraid that it's being abused by people in the area as far away as you know ember grove heights they've heard it's free and yep yep so a few things i think we need to
[30:26] **Council Member Matt Montgomery**: address that are related to this so that it doesn't fill up quite as fast as we need to either make some more specific signage or have hours of operation i know that's been talked about in the past these are just ideas that have been brought up um you know and the citizen i think has a valid case of for a town of our size with lawn clippings and tree branches that size is very very full and it's a great area but are we allocating more public works hours with machine and manpower to handle it than what we should for a community of our size and are we being taken advantage of so the issue of the um the dirt being sifted and 75 given that's great and i think that dirt is

[34:04] **Kyle Paulson (Chamber Director)**: the summer and the posting will be in the paper this week and next it has been online already and i just put the facebook post out on the chamber facebook page high school or college student it'll be 20 hours a week for 10 weeks and we're flexible as to when and when and how and so if anybody is interested in seeing that job description please let me know at the chamber i hope everyone knows that the chamber fun fest that was scheduled for june 9th has been cancelled it was cancelled due to lack of vendors
[34:50] **Kyle Paulson (Chamber Director)**: we only had 18 sign up and we are usually in the 50s and the 60s so it would have looked really sparse on mill street so we'll move on to july 14th is our chamber open airfare august 11th is another fun fest and september 8th is the last open airfare of the season they all run from 4 30 to 7 30 p.m we also have our 31st annual chamber golf tournament coming up on june 16th we currently have 19 teams our goal is 20.

[38:41] **Dan (Parks/Public Works Staff)**: so the trail repair was on the consent agenda um we're looking at some of the vandalism going on in east side park and how we can resolve that talked a little bit about cameras that type of thing talked a bit a little bit about pickleborg pickleball court choices in town and having some discussion about that reaching out for some quotes on striping and that type of thing and how much does a pickleball court costs we talked about it a few years ago and i thought the cost was outrageous we talked we talked about some options about converting part of the basketball court by the pool into a couple of court pickleball courts
[39:27] **Dan (Parks/Public Works Staff)**: and you could convert it to a pickleball court by just restriping and putting up a net or actually resurfacing re-striping and putting up a net so a couple different options or you could you could pour a layer of bituminous about 30 by 60 and build a court that way too so we're just going over a couple of those options as popular as it's becoming so okay and then we went through a punch list of some park maintenance issues in town so okay

[40:13] **Dan (Parks/Public Works Staff)**: i do um so um today i spent some time with league of minnesota city's insurance trust we were looking at some of the roof surfaces that were damaged during the april 12th hail storm so we'll be getting results coming back on that the pool officially opens tomorrow at one o'clock so that's a bright spot the pickup that we ordered last september i've been told is finally at the dealership so hopefully we'll see that this week and then i think what neil was maybe alluding to with the eda is um we did receive a grant through the wisconsin public service foundation towards the ada lift chair at the pool for 32.50 3 250 which basically covered i think almost everything but 700 of that chair so that's a that's that's good support from them and that was uh laura put all that together for the grant so i just wanted to give her a high five on that so thank you

[42:01] **Tyler (Police Representative)**: so the only thing that we have uh is that just reminder to people that school is out for the summer and just you know be mindful of of kids running out in the street and and playing so just be vigilant and then also uh with summer being here uh you know thefts tend to go up a little bit more in the summertime because it's warm out and things like that so just remind people to be vigilant and and if you see something say something so okay very good thanks tyler
[42:30] **City Administrator (Neil Jensen)**: neil i'm going to piggyback on that we have had a a lot of vandalism in our parks yes we had that discussion during the park board and the public works both they're vandalizing uh east side park so also if anybody is out and about and see something they're also tearing doors off the porta potts and and doing internal damage why i don't know but i guess that's the name of the game uh this year i'd hate to see uh the porta potts leaving town and not coming back um simply because we got some kids damaging them and they can't afford to keep them in town that just does not make sense so if anybody sees any uh shenanigans going on make sure you call tyler and that group the second thing is we got a annexation request in we're going to be looking at that in the next month or two or three as it goes down the process another 40 to 45 acres up on the north end of town so look forward to working with a housing developer on that

[43:21] **Council Member Matt Montgomery**: nothing big just uh congratulations to all the seniors that graduated this year from both randolph and here in canon falls as tyler said i've noticed with school out the traffic at eight in the morning and three in the afternoon nice and quiet but the foot traffic of kids is constant they're crawling around town like ants so be careful skateboards bikes they're all over the place so and there are activities for kids down at the dumps and at the high school all the time so the traffic all the streets that lead that way just be careful thank you

[44:05] **Council Member Lundell**: derek mary jill uh just one thing um i'm not sure if it's my cancer drugs or what's affecting me but i'm about to agree with babel gorman on something we did go to a lot of we made a lot of noise and we had a public hearing about a single hauler for trash it wouldn't have hurt us one bit to just come back and say hey it's not at all feasible for us right it wouldn't hurt us to do that um we should have done that i i thought of that when he was saying that i thought you know yeah that's a little lack of transparency on our part we decided not to act it wouldn't have hurt us after having a whole public hearing to just say hey we're not going to do anything about this so that's all i have to say
[45:15] **Council Member Chris Nobach**: steve i don't know i got goosebumps uh one thing about the compost site uh the grinder that comes in there does is he scheduled do you know
[45:26] **Dan (Parks/Public Works Staff)**: i can tell you that he said he was coming in may well we're now in june june already um i'm looking into other options right now i've heard some rumblings that um that it may not be happening but that's all i can say for now i'm not sure i'm not sure if we might have to go a different direction
[45:51] **Council Member Chris Nobach**: okay is that is that dakota yeah okay and one other thing on another more personal note one of our pillars of our community retired recently roxanne flatten yeah gene why is that personal after somewhat a little under 100 years in the banking service she's going to kill me for that one and anybody that uh has access to a today magazine nice wonderful wonderful article about her and her career in there and when you pick the magazine up that is not her on the front cover that is an actual baboon on the cover so don't make that oh my gosh mistake she'll kill me for that too wow wow yeah i'm glad you're maybe here i don't know
