No description available.

Ready? There we're ready up here. We're going to go ahead and call to order the regular meeting of the Oakdale City Council, June 10th, 2025. Uh Sarah, will you take the role, please? Uh Council Member Moore, here. Council member Morham, here. Council member Severson, here. Mayor Zabel, here. Please join me in the pledge of allegiance. I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all. All righty. First up tonight is the approval of the agenda. We have a slightly amended version in front of us tonight. Uh, one change to a city policy. I think that's about it. Uh, council members, can I get a motion to approve the agenda as amended? So, move. There's a motion. Is there a second? Second. Motion to a second. All those in favor say I. I. Opposed. And the agenda is adopted. Next up, approval of the minutes. Two sets tonight. First up, workshop meeting minutes for May 27th, 2025. Council members, any changes or corrections? I'll look for a motion. So, moved. There's a motion. Is there a second? Second. Motion to second. Any comments? All those in favor say I. I. Opposed? And those minutes are adopted. Uh, next set are regular meeting minutes from May 27th, 2025. Any changes or corrections on this one? I'll look for a motion. So move. There's a motion. Is there a second? Second. Motion a second. Any comments? All those in favor say I. I. Opposed. And regular meeting minutes are adopted. Uh, next up, public hearing. We have one tonight. Before we get to that, uh, staff presentation. Luke, come on down. Walk us through Enclave Helmo station. Thank you, mayor. So the location of Enclave Helmo station, it's located at the southeast quadrant of Helmo Avenue and Fourth Street and it's also located immediately east of the Norhart apartment building. So if you recall the final plat for Enclave was approved at the prior council meeting on May 27th and as a condition of approval for the plat uh there was a a requirement that the developer vacate any unnecessary public easements and zoning code prohibits encroachments onto easement areas. So as such the developer has formally applied to vacate the existing uh utility and drainage easements that are no longer needed. Sufficient corridors have been provided as part of the uh u have been provided for utility and drainage uh as part of the final plat for Enclave HL station that was just approved. And there is also a request to approve the development agreement for Enclave. And the development agreement specifies the terms and conditions that the developer has to satisfy in order to build certain site improvements for the development in including a new park. And uh with that staff recommends approval of the two easement vacations and those are resolutions 2025-57 and 58 that are in the agenda packet. And as a reminder, this is a public hearing for uh the easement vacations. Um and oh, I I should also mention that staff recommends approval of the development agreement as well. And I'd be happy to answer questions. Thank you, council members. Questions for Luke. I have one. Does the development agreement reflect the um slate language uh change regarding the park amenities that Chris you sent us today? Yes, it does, mayor. Perfect. Thank you. Uh questions? Okay. Uh at this time, I'm going to go ahead and open the public hearing. This is an opportunity for anybody in the audience that would like to uh take to the podium, state your name and address for the record, and speak on this agenda item only. Seeing none, I'm going to go ahead and close the public hearing, bring it back up for council consideration. Uh, council members, let's tackle let's tackle the resolutions and then if we have questions, we can tackle those as we go. Who wants to take the first one? I'll take it. Um, I move we wave reading and adopt resolution 2025-57 approving the vacation of the utility easement within Oaks Business Park. There's a motion. Is there a second? Second. Motion a second. Any comments? All those in favor say I. I. Opposed. And resolution 2025-57 is adopted. Next. Uh Mr. Mayor, I move we wave reading and adopt resolution 2025-58 approving the vacation of drainage and utility easements within Oaks Business Park and Oaks Business Park second edition. There's a motion. Is there a second? Second. Motion a second. Final comments. All those in favor say I. I. Opposed. and 2025-58 is adopted. Last item. Mr. Mayor, I move we authorize the mayor and city administrator to sign and execute the development agreement for Enclave Helmo Station. There's a motion. Is there a second? Motion a second. Final comments. All those in favor say I. I. Opposed. And that authorization is given. Perfect. Uh open forum. Uh open forum is our time on the agenda for anybody in the audience that wants to talk about anything with us. um similar rules as the public hearing. Please feel free to step up to the podium, state your name and address for the record um and share whatever is on your mind. Seeing none, we'll move into consensus motions. Council members, tonight we have A through J on our agendas. Uh are there any that uh council members would like to pull for individual consideration? No. All right. Who wants to make that motion? Make a motion to approve consensus motions A through J as presented. There's a motion. Is there a second? Second. Motion on a second. All those in favor say I. I. Opposed. And A through J are approved as presented. Uh next up we will check in with advisory boards and commissions. Uh planning commission met. Council member Severson. I believe you tackled that one, right? I did. Yes. The plan commission met on uh June 5th last week and um held public hearings on the comprehensive plan amendment for the Glen Brook small area comprehensive plan um and also a public hearing on the zoning and subdivision code update and the zoning map up amendment and um had some good discussion and um that was pretty much their meeting. Wonderful. Uh award bid none. So we'll move into community development. We have a couple items uh tonight. Luke, taking us through this. Welcome on back. So, yes, this uh site plan amendment, it's for Collins Electrical Construction. They're actually relocating from their headquarters in the city of St. Paul to here in Oakdale. And the location of their site is 711 Hail Avenue. So, this is the former Spartan Promotional Building, if you're familiar with that. This site plan amendment request involves expanding the existing building by approximately 19,000 square ft and adding a dedicated outdoor storage area for business equipment. So after reviewing the uh request, staff finds that it complies with the zoning requirements including the standards for parking, landscaping, exterior design standards, screening and light site lighting. Um, so staff recommends approval of the amendment subject to the following conditions that are found in the resolution 2025-55. And I would like to note that since the agenda packet was actually published, the developer submitted updated plans that satisfy conditions 2, three, and four in the resolution. So those uh conditions are a bit moot. Um, but I'll read through the the five conditions here. So number one is uh that the developer has to obtain approval for the uh civil construction plans by the city engineer. Number two provide details methods of screening for trash collection areas for external trash collection and the developer actually u they pointed out that there's an there's an existing internal trash collection area. Um so that's what will be utilized. Number three uh the condition here demonstrate compliance with the exterior design standards. The uh developer provided updated elevations and the ex building expansion is compliant with our design standards. Number four, revisions to the phototric plan to comply with the city's site lighting requirements and the updated plans uh show that they are in full compliance. And finally, number five, permits and approvals must be obtained from outside government agencies and those pro approvals must be uh provided to the city. We do have a representative from Collins Electrical here if you uh have any questions. Uh otherwise, I'd be happy to answer questions. Thank you. Thank you, Luke. Uh council members, any questions for Luke? How about the rep for from Collins Electric? Any questions? No. All right, let's hit it. I will make a motion to wave reading and adopt resolution 2025-55 approving the site plan amendment for Collins Electrical with conditions included in the attached resolution. There's a motion. Is there a second? Second. Motion a second. Final comments. All those in favor say I. I. Opposed. And resolution 2025-55 is adopted. Welcome to Oakdale Collins. Uh, next up, a building permit compliance date change or an extension request. Luke, you got that one, too? Thank you, mayor. So, yes, this is for the Rio's Church at 7287 Stillwater Boulevard. Uh the current site plan extension approval is valid through July 6 and the uh an additional 30-day extension is being requested by the church through August 5th so that the developer can obtain a building permit. Just running into a bit of issues with uh or finalizing the DA, but we uh city staff we do feel confident that we could get there here in the next few weeks. Uh the developer again is working with city staff both on the development agreement and also working towards obtaining a building permit. So happy to answer questions. Thank you. Council members, any questions for Luke? Yeah, I just had one question. Council member Markham. Thank you. I was just uh the process can take time on these things and I think this came forward already once for an extension. Should we just two three times? Two, three times for a longer period. I was just going to recommend should we make it a 90-day extension at this point? I mean, just to make sure there's time so it's not coming forward again in case there's someone that gets ill or there's vacations. or is city staff fairly confident that it's really down to the last week or two and this will be enough? Or is 30 days the max we can do? I don't know who wants to take it. So, uh, in terms of how long the the council can keep extending the the site plan approval, I guess I would look to the city attorney's office. But, um, yeah, now city staff does feel that we are really close. In fact, uh, in in terms in terms of, uh, getting the DA across the finish lines. Anything else, Andy? Well, 30 days is enough. That's fine. Uh, council members, any other questions? All right, I'll look for a motion. I'll move we approve an additional 30-day extension with an expiration date of August 5th, 2025 for Rios Diaga Viva to obtain a building permit for the proposed church at 7287 Stillwater Boulevard North. There's a motion. Is there a second? Second. Motion a second. All those in favor say I. I. Opposed. And that extension is granted. Thank you, Luke. Uh, city attorney Jim, what what do you got for us tonight? Nothing tonight, Mr. Mayor. constantly happy to answer questions. So, anybody have any questions for Jim? We had a whole bunch of items during workshop that Chris will be sending us. So, Oh, that's what I get for not going. Yeah. Uh, let's check in with our city administrator, Chris Vulkers. Chris, you got a few items there. Yeah. Hi, mayor and council. I have three items on the um under this section. So, first is a donation to the city. very generous donation by um a resident Nancy Muggenberg um in regards to her late husband Corey and in addition also part of the donating party is Michael and Don Conlin in memory of NY's husband. So um the fire department had a lot of interactions over the last recent years with um her late husband Corey and she was very appreciative of the relationship and the service that the fire department provided her. So, with that, she provided an $800 donation. And so, the motion is in front of you for consideration. Uh, council members, any questions for Chris? All right, I'll look for a motion. Make a motion to wave reading and adopt resolution 2025-54 accepting a donation from Nancy Muggenberg and Michael and Don Conlin in the amount of $800. There's a motion. Is there a second? Second. Motion a second. Final comments. All those in favor say I. I. Opposed. and resolution 2025-54 is graciously accepted. Thank you to Nancy, Michael, and Dawn for their donation to the city. The next item I'm going to ask Don Tyson, our owner's rep, to come up for it's about the new um public work or sorry, sorry, city hall, sorry, and police facility. This is our next project. So, we got two projects going on. It's pretty exciting. So, Don, thanks. Welcome. Thanks, Chris. Good evening, Mayor Council. Once again, I am Don Tyson, the owner's representative for the public works project and this these uh the police remodel expansion project and the city hall remodel project. It really is a privilege to serve in these roles for you uh on these exciting projects. Also in attendance with us tonight is Mike Phillips. He is a senior project manager with Krauss Anderson and with your approval tonight of the contract, he will be leading the project for the Krauss Anderson team. So tonight we're requesting two actions for these projects. The first action is approval of the construction manager at risk contract. Back on March 11th, you approved the process to select the construction manager with the projects in compliance with Minnesota statute 471.463. You also appointed the city administrator, city police chief, and project architect as a selection committee. Uh for this process, there was a robust selection process that took place that began with a issuing a request for qualifications. The city received eight responses and after scoring those responses we sent the request for proposals then to three firms and then after scoring those proposals the top two firms were interviewed. As the conclusion of those interviews the combined scores of the qualifications, the proposal and the interviews were told up and the selection committee is recommending Cross Anderson uh construction company for these projects. As you know, Krauss Anderson is the current construction manager on the public works facility. They have kept this project in budget and progressing forward even under challenging site and weather conditions that we've experienced out there. The transition to the police department and city hall projects will really be a smooth, seamless effort for city staff uh to keep this the next project going forward. As a side note, the team of BKV Group, the uh architect for these projects, and Cross Anderson recently completed a joint facility of public works and uh police department in Rosemont, and we actually toured that uh last week to see that. So, this team of architect and construction manager have really completed some uh great projects here in the cities together. The request for council action does contain financial information on the construction management fee and pre-construction services. I do want to point out that in the times we're in where everything seems to be costing more, the construction management fee percentage is less than the construction management fee percentage on the public works project that was approved two years ago. And thanks go to your city administrator Chris Vulkers that negotiating this this uh reduction in fee from one two two years ago. So with that, mayor, we and council, we're requesting that city council authorize the mayor and city administrator to enter into an agreement with Krauss Anderson Construction Company for construction management risk services for CIP project B2025-1 and B2026-1. Thank you, Don. Uh, council members, any questions for Don or Chris? Because, you know, we know Chris does so much on these projects. Any questions? All right, let's look for a recommendation. I move we authorize the mayor and city administrator to enter into an agreement with Carl Anderson Construction Company for construction management at risk services for CIP project B2025-1, the expansion and remodel of the police department facility and B2026-1 the remodel of city hall. Uh there's a motion. Is there a second? Second. Motion second. Final comments. All those in favor say I. I opposed. And that authorization is given. Thank you, Don. Thank Thank you. Uh the second action is identical to the action you took back on August 14th of 2024 for the public's works project, giving the city administrator a level of change order approval authority. This action tonight is for just the police department and city hall projects. For new council members and the public, I want to reiterate three points that we made back in August about this change order authority. Uh first of all, change orders are a necessary part of any project. There are things that the owner decides they want during the construction and no plan is perfect. Change orders are just a fact of life with a project. Field revisions are needed. With that, we need timely review and approval of a change order so we don't see delays because delays cost money for everybody on a project. Most importantly to that point though, there is a vigorous change order review process that's in place that will be also in place for this project. Change orders are reviewed by the project architect, the construction manager, the owner's representative, myself, uh, and even before a change order is drafted, the team reviews these change orders or potential change orders with the city administrator and get their uh, the city administrator's approval even start processing those. So that rigorous process ensures transparency and accountability and that it's actually a needed and a and a a wellpriced change order. So with that, mayor, we do request again uh that the city council authorize a city administrator to approve individual change orders up to $100,000 provided that the increases in the project cost within the city council's approved project budget for the police department and city hall projects. Thank you, Don. Uh council members, any questions for Don on this one? Yep. Go for it. Yeah. I was just uh could you speak to the number of change orders above 25,000 that have been received for the public works building to this point? I don't have that number, council member, but we can get that to you. I would say it's right now it's uh less than 10. Sure. So, and comparison to the scope of other projects of this size. Is that fairly standard? Is that more? Is that less? Yeah. The the primary the largest change over so far have been related to the winter conditions working over the winter and dealing with frozen ground. Um and that's so those have been the most significant ones moving the earthwork but nothing unusual for a project of this size or magnitude. Um the change order budget itself right now also is in uh excellent condition compared where we're at with the project with the progress that you saw out there last week. So yeah. No, perfect. Yeah, the weather conditions are a big factor in any project. So I appreciate sharing that. That's the only question I had. Thank you. Uh any other questions for Don? All right. Uh, who would like to make this motion? I can make the motion to wave reading the city administrator or to authorize Start over. Make a motion to authorize the city administrator to approve individual change orders up to $100,000 provided that the increase in project cost is within the city council's approved project budget for the police department and city hall remodel projects. There's a motion. Is there a second? Second. Motion a second. Any conversation? All those in favor say I. I. Opposed? And that authorization is given. Thank you. Thank you, Don. Uh Chris, one more item under your section. Well, first thank you, mayor and council. Um I do want to say with the public works, we'll get you a list of the change orders because they're almost all soil or or weather condition related almost. Um but I do appreciate the the faith you have in the staff to really vet this stuff. There have been times where we've said no or no, we're not going to do it that way. We're going to find a different way, which is why our change order, our whole budget is in really good shape. So be assured we're trying to work hard on that. So um as far as this agenda item, it is about city policy um CCO2 which is city council policy. Council only has a few policies. This is one. It's about advisory boards and commissions. And what we're trying to do is clarify a more clear process for both both the applicants as they go through the process to be in a commissioner board. The council as they consider the applicant and then um the council as they're managing the commissions. These are this is a council thing. The commissions and boards are council. They are not staff. We only support you guys make the decision. So, what you've got in front of you is a proposed um well, several proposed based on council discussions previously on um eight sections and it really clarifies the term of the appointments, the application process and how that flows. So, it clarifies some hiccups we've been having just because we didn't allow enough time for everything. Um reappoints, what happens in that so that commissioners know if they want to be reappointed, how that process works and how council's involved. vacancies, attendance, attendance is a big one. It is very important that people who become part of our commissions and boards attend the meetings. So the council is interested in putting a threshold for attendance expectations. So that's in the policy organization overall u meetings and then the annual work plan that they will prepare work plan and council will review it. They'll have discussions. It'll be an open discussion with the commission's board. So that's what's in front of you. these proposed changes to um city council policy C002. Perfect. Uh council members, any questions for Chris? All right, let's get a recommendation. I recommend we amend city policy CC-002 city council advisory boards and commissions. And there's a motion. Is there a second? Second. Motion a second. Any comments? The only comment I will make is thank you Chris and Sarah, our city clerk, um for all of your work on this. We know there was a lot of back and forth um and we know that sometimes these policies can get a little once we start tinkering with things they can become a headache. So we really appreciate um you pulling all of our thoughts together. So thank you for that. Uh all those in favor say I. I opposed and that policy is amended. Uh council presentations we have one action. Um so let's do that and then we can go into individual council member updates. So, um, this one is to update our board and commission assignments for 2025, uh, with the resignation of council member Willen. Uh, we just need to move a few chairs on the the boat deck. So, um, council members, can I get a motion? Make a motion to affirm the updated appointments for the boards and commission leaison for 2025 as noted on the attached. There's a motion. Is there a second? Second. Motion a second. Any conversation? All those in favor say I. I. Opposed? And those appointments are affirmed. Uh, council presentations. Anybody have anything? Council member Moore? I don't. All right. How about over here? Nothing. Nothing. Nothing. I got a whole bunch. Uh, because there's a lot going on in the city in June. So, uh, our weekly Oakdale Farmers Market began last week um, and continues every Wednesday in the city hall parking lot uh, from 2:00 to 6:00 p.m. Check it out. Uh, every single week there's something new popping up out of the ground and the the farmers are bringing it out. So, um, lots of great variety of fruit, fresh fruits and vegetables. also baked goods, lots of things out there. Um, usually there's also some city staff, either recreation department or maybe community development. So, if you see any of our team out there, stop by and say hi. We really appreciate that. Uh, it'll be continuing through October 8th. Uh, city offices will be closed on Thursday, June 19th, in observance of the Junth holiday. Uh, offices will reopen the following day, Friday, June 20th. Every summer, the city recognizes the eye-catching landscaped properties with the Oakdale Acorn Award. Uh we want to invite all residents to nominate as many properties as you can by June 30th. Uh nominations can be made on the city website oakdalemn.gov in three categories: business, commercial, public, and residential. Did we also add it to CClick Fix? They can als Yeah, Sarah's nodding her head. Yeah. So, you can also use our Cclick Fix app uh to take pictures of properties and nominate them as well. So, that streamlines things, too. Oh, boy. Hard to believe. Summerfest two weeks away. So exciting. Um, always an exciting time in our community that whole week. There's a ton of stuff going on. So, please mark your calendars for June 23rd through the 28th. Um, as always, you can check out the full schedule of events on the city or on the city website on the Summerfest website, oakdale summerfest.com. Uh, a quick rundown of some of the highlights. On Monday, the uh Oakdale Area Chamber Commerce Medallion Hunt kicks off. Um, to see the clues and hopefully find the medallion, you got to tune in to or check out the Oakdalefest.com website. Uh, the Oakdale Summerfest community organization Facebook page as well as the city. I believe we put them on our city Facebook page also. Yeah, our city comps manager nodding yes. Um, so a couple locations. They drop every day right at 8 a.m. Um, always a fun time, always a very competitive time with people hunting in our city. All of the rules for the medallion hunt can be found on the Oakdale Summerfest website. Uh Thursday is the Ted Birth Grand Parade. Starts at 6 PM, heads down uh 15th Street from Transfiguration Church to Walton Park. Um after the parade, uh stay in Walton Park. We have food trucks. We have the Lions Club beer garden. Um we're going to have live local music, uh local musicians performing in the band shell. Um so stop down for the first kind of official night of all of the fun in Walton Park. Uh Friday starts a little earlier this year. The fund starts at 11:00 a.m. in Walton Park. Um the Oakdale recreation uh department will be out there with the it truck. We're going to have pony rides. There will be giant inflatables for the kids to jump around. Plenty of food and beverage. Um at 5:00 we'll have the third layer skateboard competition. That's always a fun time. Um and Free and Easy is back this year and in the band shell. They are always they've been very popular the last few years. So we're excited to have them back and they'll be playing from 6:30 to I think 10:30. Um, so come on down for some live music in the park. And then all of the Summerfest fun uh, yep, that was the last thing on there. Uh, uh, comes to a head on Saturday. It begins bright and early with the Oakdale Nature Preserve 5K. Starts at 8 a.m. at the Discovery Center. Um, I'll be out there. I'm not running. I'll just take pictures and say hi. So, um, come on out. Cheer on the runners. If you're not a runner, it's like that line in the movie Greece. If you can't be an athlete, be be an athletic supporter. So, um, we definitely want to cheer on the runners after the Nature Preserve 5K. You like that, huh? Uh, all the fun starts down in Walton Park again at 11:00 a.m. Uh, we have balloon artist. I keep saying we, it's Oscar, the group behind Summerfest. They do an amazing job. There's going to be balloon artists. There's going to be pony rides. The inflatables will be back. Um, the the teddy bear band will be performing Saturday afternoon. That's always a fun time for the for the kids. Food trucks. Uh, the Little Blues Traveling Zoo is back again this year, so you can hang out with the animals. Uh, the Oakdale Fire Department is once again hosting a pop-up splash pad. A big thank you to the fire department for doing that. That starts at 1:00 p.m. Uh, the Minnesota Twins are sending TC Bear out uh to hang out with kids 4 to 5:00 p.m. So, you'll see see the bear walking around the park. Um, and then all of the Summerfest fun kind of accumulates with uh a concert by GB Leighton, a Midwest favorite. Um, a truly tremendous band. 6:30 to 10:30 and then the Oakdale firework extravaganza is at just after 10 o'clock. So, we hope everybody will join us. Uh, Summerfest is always so much fun. Uh, and as I mentioned, all of this is pulled together by a group of five volunteers. It is unbelievable all of the work that the Oakdale Summerfest Community Organization does for this community event every single year. Um, a big thank you to them. A big thank you to our staff um who play a huge role in making sure the logistics in Walton Park are set up and available. Everything from food vendor, food truck licenses to um having electric out at the park, all of the public work staff doing cleanup u throughout the event. It is truly a team effort and we appreciate everybody's hard work on that. Uh a reminder, I don't know if we ever actually said this, but uh this is our only city council meeting this month. We canled the one the week of Summerfest um so we could be immersed in all of the Summerfest fund fund fun. There we go. Um we will be back in July. If you need anything in between, reach out to Council Member Morham. Um thanks. We look forward to seeing everybody at Summerfest. Uh finally, um earlier today, Washington County Sheriff Dan Starry announced he will not be seeking re-election. Um Oakdale and every police department in Washington County and in the region has had a tremendous relationship with Sheriff Star. Um during his two terms, don't don't you dare. Um during his two terms, uh he's been with uh the sheriff's office. Oh, I don't even know how long he's been. Um just a leading force in public safety um and community engagement in the east metro for so long. Um thankfully, he's not done quite yet. He'll be around till January 2027. So, we we can all benefit from his experience and passion for the East Metro a little bit longer, but um Sheriff Star has been such an asset for public safety, for everything in the East Metro for so long. We wish him well in retirement. We are bummed to see him go. Um we got to pay bills. H the bills. Let's see. Claims roster. 2 million bucks. Oh, just 2 million. Uh and change for May 28th through June 10th. Council members, uh, were there any claims we wanted to pull out, uh, for more information? Never is. Um, can I get a motion? Mr. Mayor, I'll approve um I'll move we approve claims for the period May 28th, 2025 to June 10th, 2025 in the amount of 2,67,167 96 cents. It's always at 96 cents. Got to have it on there. Uh, there's a motion. Is there a second? Second. Motion a second. Any conversation? All those in favor say I. I. Opposed. Bills are paid. Uh, can I get a motion to adjurnn? So move. There's a motion. Is there a second? Second. Motion a second. All those in favor say I. I. Opposed. We are jjourned and we're going to roll right into our meeting of the Oakdale Economic Development Authority. Mr. Mayor, can you pause a second so we can get Okay. Yep. And I'll g us in the next meeting whenever we're ready. Okay, you're good. All righty. I'm going to go ahead and call to order the regular meeting of the Oakdale Economic Development Authority, June 10th, 2025. Sarah, will you please take the role? Commissioner Moore, here. Commissioner Morham, here. Commissioner Severson, here. President Zabel here. Uh, we don't do the pledge again. That's okay. That's okay. Uh, council members, can I get a motion to approve the agenda? So, move. There's a motion. Is there a second? Second. Motion a second. All those in favor say I. I. Opposed. And the agenda is adopted. Uh, next up, approval of minutes. Uh, one set in front of us, December 10th, 2024. Uh, commissioners. Can I get a motion to approve the minutes as presented? So, moved. There's a motion. Is there a second? Second. Motion a second. Any comments? Uh, Mr. Mayor, I'll abstain. I was not a member of the EDA at that point. Weren't with us yet. All right. Easy enough. Uh, all those in favor say I. I. Opposed. and one abstension from uh Commissioner Seagerson. Two business matters in front of us tonight. Uh first up, annual election of officers. We need to elect a vice president, a treasurer, and secretary. Um we have the assignments from 2024 commissioners. Any objection to just filling the positions based on seniority of the Oakdale City Council members going down typically is what we do. So, vice president would be uh Commissioner Morham, treasurer would be Commissioner Moore, and Commissioner Severson would be Secretary. Comfortable with that? Good with that. Uh I'll make a motion to elect a vice president, treasurer, and secretary for 2025 as noted. Second. Motion and a second. Any conversation? All those in favor say I. I. Opposed. And congratulations on the new jobs. Uh we have one other action item tonight in front of us. Uh an amendment to the property use agreement by Ames Construction. Mr. Getsoff, welcome. Thank you, Mr. President. Commissioners, uh the the item before you is approval of the second amendment, a temporary property use agreement with Ames related to ED own EDA owned property at Tanner's Lake. Uh Ames entered into this agreement November 16, 2022 uh for temporary use related to the Gold Line bus rapid transit project. Um that agreement was amended April 15th of 2024 extending those terms to no November 23rd, 2024. Uh condition of that agreement was that Ames was to um in exchange perform some sewer relocation work at their expense. um end up the the as did not perform the location work because it it wasn't needed based on the design of the uh Tanner's redevelopment um project. So in lie of that we've worked out an arrangement um with as that they pay the approximate cost of what it would have been done to do the work but we are just limiting that to the materials only knowing that you know they would have been on site and been able to do that. So and those numbers have been verified by the city engineer. Um, so that amount would be $27,500 with the recommendation that that go into the municipal building fund. So the action before uh the EDA here today is at the um recommendation of our city attorney to make sure we just memorialize this in an agreement form for for future auditing purposes would be to authorize um EDA president and executive director to sign and execute the se second amendment to the temporary property use agreement with Ames on behalf of the EDA. Happy to answer any questions. Uh, commissioners, any questions? No questions. I have one. Why is it going to the municipal building fund? Uh, our past practice is money yielded from public lands goes to parks. So, why the ch Well, I guess it's a council tradition. Um, why the change now? So, Mr. Mayor, city council, that was very deliberate to give you flexibility on wherever you want to move it to after that. That's the right place to move it to. So you have full flexibility. Wouldn't we have the same flexibility with just putting in the general fund? Um there are rules about this specifically and without going into too many details with the auditor who's not here. It does this this does give you you can move it back to the general fund. This gives you the most flexibility. Yeah. Because of the source of the funds. That makes sense. Thank you. I knew you'd have the answer. Of course. It's like you anticipate our questions. Yeah. Uh, commissioners, any other questions? I'll look for a motion. Well, I'll move that we authorize the EDA president and executive director to sign the second amendment to temporary property use agreement with Ames Construction Incorporated on behalf of the EDA. There's a motion. Is there a second? Second. Motion a second. Final comments. All those in favor say I. I. Opposed. And that authorization's given. Can I get a motion to adjourn the Oaka? So moved. There's a motion. Is there a second? Second. Motion a second. All those in favor say I. I opposed. We are adjourned. Thank you and good night.
