well welcome again to the Mesa city council meeting for March the 4th of 2024 all of our Council are present for this meeting uh we will begin the meeting with an invocation by Pastor Cindy Carpenter with the cheris Christian Church followed by the Pledge of Allegiance we're excited today that we have some Girl Scouts with us from Troop 3095 to lead us in that pledge so ladies right after the pastor offers the prayer please come up to the microphone and lead us in the pledge okay thank you Pastor I'm sorry please stand and remain standing for the Pledge of Allegiance thank you mayor Giles father in the name of Jesus we ask for your anointing on all of the city council members all of our representatives and all of the employees we thank you for your favor upon Mesa Arizona for your prosperity in Mesa Arizona and for the wisdom that our officials need to lead and to guide us into a more prosperous City we thank you for the growth and we thank you for the protection we ask for lower crime rates Lord in the name of Jesus that your anointing would be upon this city that your favor would be so upon Mesa Arizona that Mesa would be the best spot in Arizona and we ask all of these things in the name of Jesus Christ Our Lord and Savior amen amen thank you Pastor okay guys get right behind that microphone okay please join us in the Girl Scout I me in the Pledge of glad we had a uh women pastor and the Girl Scouts here today for reasons that will be maybe a little bit obvious uh as we proceed with the meeting because the next item on our agenda is uh Awards and recognitions um tonight we have two proclamations on the awards and recognitions agenda the first is to is to Proclaim March 2024 as procurement month in the city of Mesa uh this is actually a big deal procurement is a big part of what we do and we this is how we spend our money wisely procurement may be one of the less visible departments but their work is absolutely essential to how our city functions and provides services during procurement month we acknowledge the dedication and hard work of our procurement professionals who work diligently to ensure that taxpayer dollars are spent wisely transparently and in accordance with the highest standards of integrity and and efficiency here to tell us more is Christy Garcia Christie hello mayor Giles council members I'm Christy Garcia procurement administrator thank you for this opportunity to recognize the month of March as National procurement month and recognize the procurement staff and procurement lisons here at the city of Mesa the month of March is widely recognized by US public procurement professionals as procurement month and March 13th is procurement Professionals Day procurement month and procurement Professionals Day is an opportunity to recognize and appreciate the efforts of the many many outstanding individuals who make up the various functions of the procurement profession from Contracting to compliance to inventory management to various other things in between procurement professionals bring tremendous value to the organizations and communities that we serve thank you to our procurement staff procurement lons contract managers contractors departments executive leadership and everyone Citywide who contributes to this amazing amazing collaboration we are excited as public procurement professionals to celebrate procurement month and as part of our month-long celebration in addition to our procurement month Proclamation and some procurement training that we are doing we will also be one more Proclamation I'm proud to Proclaim March 2024 as women's History Month in mes Arizona this month is a celebration of women's contributions to history culture and Society we have a remarkable group of women working at the city of Mesa at every level from my fellow council members Deputy city managers Department directors and Engineers to police officers firefighters electricians and gas inspectors women play a huge role in leading and operating our city and we'd like to recognize them for all all doing a great job here to accept the proclamation is city of Mesa Deputy City attorney Kelly Whitmore Kelly is also a board member for Arizona women leading government and part of the women leading Mesa planning committee Kelly so you're wearing you're also functioning as the City attorney tonight so thank you for wearing a couple of hats mayor and Council this is my first time standing at this Podium so we'll see how we do tonight um first I wanted to say that every year March is designated as women's History Month by a presidential Proclamation it's a month to honor women's contributions to American history and it actually began as a week-long celebration in Santa Rosa California in 1978 it was um in the 1970s that women's history even at that time was still virtually an unknown topic it wasn't something that was talked about in schools and an educational task force made the choice to go ahead and have a week to celebrate women's history fast forward 2 years later and you end up with the presidential Proclamation from Jimmy Carter for National Women's history week so now we're 44 years away from that and we have an entire month that is dedicated to women's history so in honor of that I thought it was only fair that I had to say a little bit about women's history in Arizona so let me take you back a few years to 1910 to the formal Arizona Constitutional Convention and talk a little bit about the Arizona women's suffrage movement so at that time for the Constitutional Convention they were trying to decide what to include in the actual constitution for the State of Arizona and three propositions were sent forward to give women the right to vote and they all failed and so when Arizona became the 48th state of um on February 14th 1912 suffrages really hoped that that would be the opportunity for the First Act for our legislature to give women the right to vote so on April 10th 1912 a bill was introduced to give women the right to vote in Arizona and that failed too so what did the suffragists do they had to Pivot and they started colleting signatures so they did an initiative in order to change the Arizona Constitution to give women the right to vote so at the time they had to collect 3,342 signatures in the six weeks that they had to do it they collected ultimately 4,000 signatures and that is when they started campaigning now they only had a budget of $2,000 to campaign for the women's right to vote in $224 that represents about $62,000 for the entire Statewide initiative just to offer a reference point in 2022 nationally on average it costs $4 million to do just the collection of the signatures not even the campaigning but they started their campaigning and it worked because on November 5th 1912 women succeeded in obtaining the right to vote it was actually approved by a 68% margin which was the largest margin for approval in the United States for women's suffrage at the time now I tell these stories $2,000 and a group of suffragists and a task force that decited to have a weeklong event to show how a small group of people truly can make a big difference and now we have that small group in Mesa for our women it we have the women leading Mesa group a number of the members are here tonight and they are wearing the logo for women leading Mesa on their gray shirts and it's a butterfly and Rings to represent the butterfly effect where one very small action can make a huge and lasting impact so on behalf of the women leading Mesa thank you to City leadership for supporting our group but also also thank you to the council for uh women recognizing women's History Month well Kelly thank you to you and to all the great uh female city employees that are here we hope you realize that we all realize how critical you are to uh to the great operation that we have here so Council let's go down and the consent agenda thank you Mr Christopher uh Miss mosy do we have any requests to speak on an item that's currently on the consent agenda no mayor no requests all right thank you I see that Mr Freeman council member Freeman has made a motion seconded by council member Summers please vote thank you the vote on the consent agenda passes uh unanimously next item on our agenda is item 8A this is the amendment to Chapters 25 45 50 51 and 87 of Title 11 of the mesa city code pertaining to Billboards M Mosley do we have any blue cards on this item no requests all right thank you do any council members wish to discuss this item Mr Summers thank you mayor um I've asked for this to be pulled off the agenda we've dealt with in my time on city council a number of issues related to signage and after looking at this issue I can't understand or see a benefit uh moving forward with this I think it's going to create more headaches than it's really worth it's both aesthetically unpleasing and unpopular and the messages that are created on these Billboards is something that this uh government should not regulate but has created a whole lot of problems it's an outdated advertising medium that only attracts messages really from cheesy lawyers and political campaigns at this point we talk about the positive messages that this could bring from the city and and there are some of those for example there are City events and public service messages that we could put out there but I think about and I looked up some of the messages that are coming out that just caused a lot of community angst I mean there was an an anti-president candidate campaign that had swastikas placed on it that created issues there was a special interest group that was pushing against the God We Trust license plates here in Arizona they didn't want the state issuing them heck Brock pie there was a Billboards put up for Brock py to support him during the Super Bowl and yet people were complaining about bat because he didn't play for the Arizona Cardinals I asked the city attorney's office recently if if this was something that we might be able to manage inside of a development agreement was assured that more than like probably not that we cannot regulate somebody's First Amendment free speech I do want to commend Mary uh your staff Nana as well for um trying to limit the locations and the impacts that these um that these Billboards could have but in your report also you mentioned that there could be as many even though there's only two right now there could be as many as a dozen other locations throughout Mesa that could apply to have to have a permit to to put up these Billboards I I I just don't know that littering our highways is is how do we say no to somebody that we we say yes to this one that has a good cause how do we say no to somebody else you know one of the benefits of this that was set up and I appreciate it was putting it toward scholarship program with our community colleges and I fully support that in fact former uh council member Dennis Kavanaugh who is an Ardent advocate for higher education in our in our city longstanding uh supporter wrote a letter to council asking us not to approve this and he said quote there's little quantifiable benefit to the city residents as a whole quote I mean Billboards just don't make anybody happy they're pretty unpopular district one sees a considerable number of complaints from Bill boards that were established in the county now we can't do anything about those that's the county gets to regulate that but we can in the city of Mesa in fact a survey of Arizona's by the behavioral Research Foundation found that 73% were in opposition to electrified Billboards along State highways how many people travel to 40 between Flagstaff and Albuquerque and go what a beautiful billboard you know they kind of stand the way of our Vistas Aesthetics matter they do how are City looks matters I have been on a soap box talking about the importance of our built environment around us and research has showed that that built environment gives us a sense of community Pride when it's done right it's hard to accomplish that if we litter our freeways with an undesirable eyesore there's a reason Scottdale and Chandler and Gilbert all prohibit Billboards along our freeways so while I have supported enhanced signage packages in the past for our malls that have struggled to do some advertisement for their properties I I think opening this up to allowing Billboards would be a mistake that we will regret for time to come so for that reason I will be voting no thank you Mr Summers uh Mary can correct us uh when we would discuss this in study session I'm under the impression that this would entitle two pieces of property on the us60 between almma school and Dobson to negotiate with the city uh this is not by right to give anyone the opport you know the right to put up Billboards but they can come to the city and negotiate intergovernmental agreements or development agreements um along that those two specific pieces of property uh mayor J you're you're correct there are two properties that meet all of the criteria that is the zoning the size the frontage um the you know separation from other residential areas there are two properties that being MCC and that being the old former uh Fiesta Mall site what we did was we identified other sites that had other Zone District so remember we're looking at three zoning districts and Rachel I don't know if you want to pull up the map I'm sorry Rachel I didn't mean to to not call on you before you stepped up to the microphone I just immediately peppered Mary with that question so thank you for stepping into the line of fire here Rachel will pull up the map and and so as you'll remember there's three zoning districts where we're recommending that they be allowed and that is the id2 which is the infi development to um District the the uh mixed use district and the public sem Public District so those are the only districts that we are looking at to allow them in there are other Parcels that meet some of all of the other criteria but not the zoning criteria so some of those are zoned GI some of those are zon are zoned Li some are in the county so there's actually four Parcels in the county that meet those criteria um they would not be subject to these regulations so um if uh Rachel's pulling up that map so we can see but Mary anything in the count we don't regulate that today I mean we have Billboards popping up all the time in the county so when you use 12 that number 12 is not it's two it's two that's it's two let's be clear it's two that's correct because you're not we can't count the county CU they can do that today and they have every we know the property have every intention of doing that that's correct there are four in the county um Mr Brady that the other ones are within the city and the GI or the LI District so if Rachel could so there's a couple of the sites up near Falcon Field but they do not meet the zoning District as we've we no other properties other than these two meet the criteria that's correct two that's number is two that's correct and just to repeat myself and this doesn't give people the right to erect Billboards it gives them the right to come to the city and seek to negotiate either an inter intergovermental agreement or a development agreement that meets uh with this council's approval and takes into account the neighbors and the time of day that it's on and all of those things that that people might find objectionable about billboards so mayor Giles that's correct it also requires a an a billboard overlay resoning so Council would have the discretion of a rezoning if the billboard was requested on that parcel and they would be required to either de um enter into a development agreement or an intergovernmental uh agreement okay thank you mayor let me just clarify too if the city sees no purpose no intention no incentive for a development agreement we could refuse a development agreement to do a development agreement for any other property uh Mr R I'm actually going to ask Kelly that I mean if if they meet the criteria are we required to meet I mean the conditions of agreement are on our conditions right this not a given so mayor council member so development Agreements are a contract that the city enters into with individual private parties I I would have to look into the legal question of if we could just refuse to do one but it but it is a legislative act to do the rezoning so so that is something to bear in mind and this would just be an element of the rezoning right and so the only reason we're de doing development agreements is because it provides for a public benefit to the city right we're not doing this just because somebody's eligible for a billboard there has to be a public benefit that we derive through that contract so it seems like in order to do a contract there has to be two parties to agree to it and so if we don't have determined that there's a public benefit and we we wouldn't do it for either one of these we made decide not to do for either one of these because we can't come to a public benefit you know that we determine it reaches that qualification we wouldn't do the development given thank you Miss go forth Kelly is that statement correct um at the time they can't they can't put up a a billboard by right with this change they still have to get the billboard overlay which is a legislative act yeah mayor council M go forth they have to get the they have to get the billboard the billboard overlay District in order to um be eligible to put up a billboard so there's no there's no Billboards Allowed by right just with the passage of this ordinance okay and that's a council approval for the overlay yes Mr I think that's uh you know this is my district and that's one of the reasons why I I'm supportive of this it gives us the opportunity to have that discussion with a developer and these these two areas one being Mesa Community call and then the other one the the old Festa Mall property uh who which you know we we've seen it distressed over the years and now it's uh it's been bulldo and and and waiting to see the development happen there and having that opportunity to have a say in the process look a mile away on Country Club there's two electronic Billboards that prop up in the last eight months uh on County Island we had no say and that's that's what happened right and so having that opportunity to start the process of of having a development agreement to have a public benefit uh that we can control I think that's that's the exciting part of this um I initially when I had the uh uh when when we started this conversation I'm pretty agnostic on billboards I I didn't go one way or the other but having the opportunity to have uh a say of what type of benefit we can enter with uh uh the developer Mesa Community College to benefit our community like the Mesa promise program uh like what's going to happen in the fiesta mod Redevelopment it's exciting and seeing how that can leverage uh the opportunity uh to uh spur up even further growth in this area and so that's why I would I'm supporting this and I moved to support this uh this this item on the agenda thank you Mr R any additional discussion I'm going to join Mr hered in supporting this because I think if you were to pull people in Mesa and tell them that they we have a billboard moratorium they'd be surprised because as we we've pointed out uh County islands and and uh development folks know how to get around that moratorium um and so I think the addition of two pieces of property along the 60 that's already got a a fair share of billboards is not going to be a noticeable difference what is going to be a noticeable difference are the two public purposes that we're trying to pursue here one being increasing higher education attainment in our city that's something that we need to get better at and the Mesa College promise is the vehicle to do that and increasing enrollment at the the Southern and doson Campus of M Community College is the way to do that and this uh the revenue that comes from these Billboards uh I'm only going to vote to go forward if that Revenue goes 100% to scholarships at Dobson and Southern campus so this will be a game Cher when it comes to uh that will be in the millions of dollars and so virtually uh all you know kids are not going to have to worry about paying for mace Community College if we go forward with this the same uh Big Goal that we have is the Redevelopment of Fiesta Mall that is uh if you're out talking to to citizen groups uh and a few hands go up in the air I guarantee you one of those hands is going to be about when what are you doing about Fiesta Mall so that um that is a priority for this community to figure out how we can attract uh and and have the city play a meaningful role in steering that development in a way that's going to be positive for the entire community so those are two big goals uh and this will allow us to do that and it will also allow us to have a tight control over how it's done so that it doesn't negatively impact the residents that are they in that are around these Billboards um and but still allow for us to oh the other thing that we should that I haven't heard mentioned yet is that one of the requirements for these Billboards will be to include in the rotation of slides public service announcements that will encourage enrollment at M Community College or or promote other positive uh messages uh that we want to communicate to the public so I I see a lot of benefit to come from this Miss bilsbury I wasn't going to say anything because I feel like I'm just going to Echo some of this the um statements that have already been made but I do want to publicly Express that um I am in support of the Mesa College promise program and um when you look at our achieve 60 a z goals for the State of Arizona we we've got to do something more drastic to move that needle and MCC is perfect um to increase our postsecondary education and to help improve the lives of families through education and so um I love love that idea and so of course I'm supportive I I'm hesitant because I want to make sure we don't do anything that's going to hurt any neighborhoods around there or cause problems for for anyone in that area um and so knowing as as has been said knowing that we will get to vote on the decisions the more particular decisions of these Billboards makes me comfortable with supporting this and I do think because we've gotten a few emails about distracted driving and I think um we're way past that on the us60 so I don't think this is going to um make any difference so I'm I'm I'm going to support it as well thank you any additional discussion Miss Duff um again I feel like a lot has already be been said but I do support this just because education is so important in our city is the number one thing we can do to take care of so many issues that we have and as a society and homelessness and um you know Workforce Development and getting the job and countering um the inflation standards and a better quality of life and being able to be prosperous as a city and be able to have the services that we need we are it's it's tough as a city in today's political climate with things going on we have to have an educated um Community we are currently and correct me if I'm wrong around 43% of our community has postsecondary education our goal is 60% by 2030 so that is a heavy lift and it is transforming the lives and our community um for the future and so I strongly believe in the mission of the Misa College promise program and what this can do in Transforming Our city thank you thank thank you Council any additional discussion I'll just make a couple comments um because this is a very narrow set of circumstances where it could be allowed and because the applicant must apply uh again to um for the particulars of the spacing the lighting what goes on it things like that um because there is that sort of double step and Council review and um I I will be voting to approve this and and support thanks thank you all right any additional discussion I see that motion's been made made by vice mayor Heredia seconded by council member spillsbury please [Music] vote thank you the motion passes uh five eyes and two Nays with the council member Freeman and council member summmer voting no uh next item on our agenda is items from citizens present uh if you read our agenda you know that we limit this to three speakers uh for three minutes each uh when I walked in the room today I was handed five cards so we're going to be strict in inform in in in enforcing the three minute rule but I'm going to go ahead and allow all five because I know you were here early and and uh and app we appreciate you're here to to to speak with us so we'll go ahead and hear from from all five uh but again we we ask you to limit your comments to 3 minutes first we'll hear from James Sera thank you Mr Mayor and councilman my name is James Serpa I'm a longtime uh Bas resident I've been here 47 years I'm coming to you with an urgent problem uh on uh February 28th at 10:33 p.m. my wife and I were getting ready to go to bed a car launched over our back wall and into our house my wife was about 6 feet from the wall when I come crashing through by the grace of God she was not injured but our house is pretty much destroyed we live on South Athena 2623 South Athena in the Superstition Springs neighborhood when I look over at my back fence towards the east I'm looking right down Monteray Road Monteray comes from saucerman westbound right to my back fence it intersects with 74 Street which runs north south from Guadalupe there's a stop light there excuse me stop sign young 17-year-old driver excessive speed and Driver negligence which isn't that the two things that cause all traffic accidents hit my back fence he actually hit a landscape Boulder before he hit my back fence and launched over the fence 5 and 1/2 ft up in the air out an oak tree there that he hit that's the thing that saved our lives I'm still a little charged up about it I had a PowerPoint to present to you to show you the layout of the streets and so on what I'm pleading with you now is to address that issue of Monteray coming right down my back back of my house I look out through the hole in the wall and it looks like I'm looking down the barrel of a gun it will happen again please do something before my family is killed I'm asking that you put a barrier of some type either ballards which are the posts set 3 feet apart or a guard rail which I would think that a T intersection would dictate a guard rail but this is going to happen again my neighbor said that it happened to her some years ago where car went into a swimming pool so please whatever you can do please do it expeditiously thank you Mr Ser thank you U I should have noted we we cannot respond directly to folks that are speaking under this agenda item because it hasn't been properly agendized for us to engage in a in a back and forth dialogue uh next we'll hear from Scott Andrews good evening mayor and councel I'm Scott Andrews president of Falcon War birts Foundation Falcon war birs was founded in 2014 with a Resolute mission of Performing missing man flights to honor our veterans out of Falcon Field given that the military can no longer carry out this solemn Duty hen warbirds entered into a lease agreement with the City and Mesa for the West World War II hanger as our base of operations Falcon warbirds were requested by the airport director to bring an EAA warbird Squadron to Falcon Field and pancake breakfast Flyin both of these were accomplished and have been running since that time Falcon War Birds actively seeks to engage youth groups including Boy Scouts Girl Scouts High school students we provide an informative tour of the hangar covering the history of Falcon Field and the hanger itself in addition Falcon warb Birds hosts Community meetings their organization takes pride in being an active member of the community while performing our mission honoring vets in early 2019 Falcon warbirds was into process of renewing our lease with the World War II hanger we were surprised when the airport director told us we had to vacate half the hanger in Shar the space with the joint liability organization or our lease would not be renewed this was a forced contract completely different to different organizations in late September 2023 a severe storm hit Falcon Field causing significant damage despite the chaos that ensued in the aftermath of the storm falcon warwards continued its mission of missing man flights on honor our vets we conducted three missing man flights at the National Cemetery even without access to our stored Parts and Equipment additionally we performed five flights on Veterans Day including the city of mesa's veterans parade the upcoming Memorial Day we have eight cemeteries to do fbes for in honoring our vets as well as the Fourth of July flyovers at Fairmont princess in Scottdale Falcon warbirds is a unique group of exmilitary aircraft that serves the veterans in our state we no longer have hanger space available to house our aircraft and equipment and you request that you honor our lease thank you thank you Scott next we'll hear from Sarah Andrews hi hey Lea hey Jen so I'm Mrs Andrews executive director for the falcon warbirds I have witnessed airport director Karine needrom staff zenel Coro deian Thomas Kendra Thro and Jessica Lonzo subject the airport Community to misconduct and violations to fire codes and state and federal laws the latest example of misconduct is their attempt to remove our organization from our lease October 4th Miss deom changed the locks refused access to the facility of our property she declared the president's signature on the lease was invalid because he did not write president on his under his signature on one of the three copies she had him signed she claimed that even though the notary acknowledged the leas signer as president it didn't matter that notary had retired from the city Miss nrom said she only recognized disgrace board director Richard Stitch as the lease holder I reminded them that I that they received an email they received an email that Richard Stitch was removed from our or Organization for causing midair Collision over populated area that almost killed three people and himself embezzled funds to of Mesa I love this city um all the stuff to do and that that it offers um you know with the housing prices going up um from when we first you know moved in you know our home is double doubled in price so you know I love my home don't want to go anywhere but investors have come in purchasing homes in the neighborhood um specifically I have a Dr abahi Rao that owns four rental properties and since he's move since he bought the house behind us you know it's been nothing but problems two years as a Airbnb with people jumping off the roof and and everything Airbnb is going to have to deal with to uh one renter that was there for two years did nothing but you know leave their kids out in the backyard screaming you know until all hours of the night and to recently I've had another renter for last 2 years years um scream at us while we're outside in our yard telling us to shut the blank up and that they can do whatever they want because we rent so we've done our appropriate thing we've called the police multiple times and one of the things that came back was to to do a um injunction of harassment for me to file an injunction of harassment I have to go back to those neighbors that are harassing me ask them for their full legal name and their birth date I don't know anybody in this room that would offer that information up to anybody that walked to their door um so I've had to protect myself from stuff flying over the wall from being pelted by water balloons and and uh squirt guns and just to hear the parents go well kids will just be kids well their pool sits about two feet below ours and to actually lob it over that fence you know that's purposeful that's not by accident that's not by anything um so there's no protection for homeowners against these renters so I would ask that if you own more than two homes that you have to actually set up a business and that gets regulated by the city so that when people like me that don't have the resources to go to court you know I don't have have thousands of dollars to spend on this where I can actually voice a concern and be heard that's where I'm coming from sir thank you thank you David uh finally we'll hear from Bridget Vega good evening mayor and Council for God gave us a spirit not of fear but of power love and self-control our community is full of up standards and miss this Darkness there is a Beacon of Hope an amazing community that is not letting council members school districts or police off the hook we must confront the uncomfortable truth within our communities we cannot turn a blind eye to teen violence nor the struggles that our teens face every day from mental health issues to societal pressures we must address the underlying issues of Abandonment control anger Al alcohol drug abuse that plague families recovery begins with acknowledging our past or acknowledging our faults and seeking Redemption we must trust in a higher power humble ourselves and embark on the Journey of self-improvement only then can we extend our Helping Hands to others and heal our communities let us not be byst standards but agents of upst standards and change let us Comm commit to Breaking the cycle of harm and fostering a community built on love empathy and accountability together we must create a brighter future for generations to come as we are one and we all bleed the same we have no future if we don't protect the children we have a duty to protect the innocent if not that blood is on our hands please continue to keep the Lord family the Jenkins the Stevens the AAS the jacobo
