foreign I'm calling to order this meeting this is a regular meeting of the committee of the whole of the Council of the District of Columbia I'm Phil Mendelson chairman of the council and chair of the committee as a whole today is Tuesday February 21st 2023 the time is 11 18 in the morning and this meeting is being held live in Council chamber in person in Council chamber room 500 to the Johnny Wilson building but also several members are participating virtually and this meeting is available to the public I believe live via the via the zoom video conference broadcast platform as well as console Channel 13 and I'm never quite sure if it's streaming or just going to be available to the public on the council's website which is www.dccouncil.gov we always begin our meetings by determining whether we have a quorum so Mr Cash would you please call the roll chairman Mendelson president councilmember Allen here councilmember bonds here council member Freeman here councilmember gray councilmember Gray councilmember Henderson here councilmember Lewis George here councilmember McDuffie here councilmember Nadeau here councilmember Parker councilmember Parker council member Pinto councilmember Robert White present councilmember Treyon white president Mr chairman you have a quorum thank you Mr Cash um we have the secretary's report committee filings I'm going to recognize the chair of pro tem councilmember McDuffie thank you Mr chairman I moved away the reading of the secretary's report it's been a motion to waive the reading of the report is there discussion on the motion all those in favor of waiving the reading say aye aye aye are there any opposed I just have it unanimously we also have the secretary's log of introductions and referrals again I recognize that chair for Tim councilman McDuffie I moved away the reading of the secretary's log of introductions and referrals an emotional way of the reading of the Lord is our discussion the vote is on the motion to waive the reading all those in favor say aye aye are there any opposed you guys have it unanimously we have five measures for markup in the committee the whole and then we have consideration of four measures being reported out of other committees the first uh build being marked up in the Community Hall is Bill 25-7 entitled The Marine buried Avenue designation Act of 2022. unlike other street name designations this bill is a bit more complicated what this bill would do is it would officially redesignate Good Hope Road in southeast as marionberry Avenue Southeast this is an official naming it involves a designation of postal addresses and enables the placement of the primary entrance to residences or offices uh to give some sense here we had contacted the Department of Transportation in December they indicated to us there are 919 driver's licenses with addresses on Good Hope Road that will need to be changed 718 IDs issued that have addresses on Good Hope Road 487 registered vehicles uh to addresses on Good Hope Road Marion barriers no stranger to us or I should say is familiar to all of us Mr Berry first became involved in the Civil Rights Movement during his undergraduate studies at Lemoine Owen College in Memphis Tennessee where he served as president of the school's NAACP chapter that was in the 1950s he was elected the first chairman of the student non-violent coordinating committees otherwise known as Snick where he helped develop an organizing project in Macomb Mississippi it was in the early 1960s Mr Berry moved to Washington D.C in 1965 to open a local chapter of Snick Perry led the free DC movement that garnered support for home rule in The District in the 1960s he went on to hold elected office in the District of Columbia for a total of 35 years beginning with his first campaign Victory as an at large member of the school board following the Congressional enactment of the home rule of home rule in 1974 Mr Berry was elected as a large member of the district's first elected Council where he served as council member until 1979. in 1978 Mr Berry was elected the second mayor of the district and then served three consecutive terms 1979 through 1990. Mr Berry was subsequently elected to the council as the ward 8 council member and served in that role from 1993 to 1995. he then mounted a successful campaign for a fourth term as mayor that he won in 1994. in 2005 after six years out of public office Mr Perry returned as to award a council member and served in that capacity until his death on November 23 2014. bill 25-7 will officially redesignate Good Hope Road as marionberry Avenue the committee print has the Western Terminus of marionberry Avenue at the intersection at its intersection with Anacostia park it will run approximately 1.41 the the street which is being renamed runs approximately 1.4 miles west from that intersection with Anacostia Park to Alabama Avenue Southeast they're well over 2 000 addresses along the proposed designation uh in preparing the committee print and the committee report the committee learned of the history of Good Hope Road The Good Hope Road got its name from the town if I can call it that or a village that was at the top of the hill which was or that neighborhood which was named after the Good Hope Tavern due to the historic nature of Good Hope of the Good Hope Road designation um it's important to preserve the history of the desert of that designation in the community so the committee print would symbolically symbolically designate the portion of what would now be marionberry Avenue As Good Hope way running from the intersection of Naylor Road Southeast Alabama Avenue Southeast which is in the area formerly known as the area known as Good Hope now this would be a symbolic naming for ceremonial purposes and is in addition to and subordinate to the official name which will be marionberry Avenue uh in addition the committee print adds Provisions to provide for replacement government documents such as driver's licenses identification cards Motor Vehicle registrations and business licenses if adopted by the full Council that is this legislation the proposed redesignation to marionberry Avenue would be one of the largest street redesignations in the district affecting thousands of residents and businesses along the 1.4 mile corridor driver's licenses for example currently cost twenty dollars for a reissued replacement the community print waved several notice Provisions that would normally apply to an official redesignation and we're doing so based on input from many Community supporters of the designation the waiver of the noise requirements is mitigated by the provisions in the committee print to waive the various fees associated with the name change meaning that impacted residents and businesses are held harmless for any costs incurred by the name change and in that connection the bill has a delayed applicability date of July 1st 2023 or upon the date of its inclusion in the fiscal of its fiscal impact in an approved budget and financial plan whichever is later so there will be time before the designation becomes effective for individuals and businesses to replace their driver's licenses other government IDs vehicle registrations can so forth yeah Department of Motor Vehicles estimated that their cost could be about twenty two thousand dollars and DDOT estimated that their cost would be about five thousand dollars this legislation was originally introduced by councilmember Treyon white and 11 colleagues on October 24 2022 the committee of the whole held a hearing on that bill which was billed 24-1064 on December 13 2022. the bill was reintroduced by councilman Tran white and 11 council members on January 6th I move the print would leave for staff to make Technical and conforming changes as their discussion we have the printer Forest um Jimmy yes counselor Tran white yes thank you chairman um brief comments uh Bill 25-7 uh designates go Road Southeast located on Ward 8 to Murray Avenue in honor of the great mayor for life Marion Barry what was council member civil rights activist mayor and so many different things to different people um Murray Avenue Southeast will run from Alabama Avenues and Martin Luther King Avenue Southeast which would include over 2 000 addresses we just heard a brief history from chairman medicine so I won't go back and read that but he made an invaluable contribution uh over 30 years of service in the District of Columbia um and his child is working and as a council member and as a mayor as a father as an activist dating back to the Civil Rights era his talents and Gifts died with him as he passed away as a council member but we want to keep his hopes and dreams alive and his advocacy for all people especially those left out of the economic development of the city I would like to thank the family the late Christopher bury um my colleagues and the community for uh supporting this measure thank you chairman thank you councilmember white is there any further discussion Mr chairman uh I I am inclined to support this I I was not involved when the various hearings went on one does wonder when you talk about all the different addresses that would be affected whether it was any consideration was given to having a shorter span than the 1.4 miles and Strikes me that doing something is quite important and having the intersection of MLK and Marion Barry is very important but I wonder whether there was discussion about a shorter spam uh as I recall from the hearing there was not uh there was certainly the opportunity of the committee did look when I said the committee uh in conversations between me and the staff uh the Western terminus I think the bill is introduced uh came short by a block from Anacostia Park and other than have that little stub be keeping the name Good Hope Road we just make it from Anacostia Park up to the top of the hill but as I noted earlier and this doesn't get to your question but uh the area at the top of the hill was known as Good Hope and so we're keeping that by having the ceremonial designation it's kind of hard to think of Good Hope Road and segments so it's pretty much All or Nothing well I'm not going to say all or nothing but it's pretty much all if there's no further discussion councilmember Robert White did you want to be recognized uh yes thank you chairman uh I want to uh thank you for removing this important measure and thank my colleague council member freyon white for for pushing it uh I I think it is incredibly important to the district that we have in Avenue dedicated to one of the most uh if not the most uh prolific public servant who has served our city many of us are uh have the privilege of being told frequently in what ways we do not compare to the former uh Marion Barry um and I think people for a long time uh will get those same sentiments now but where those sentiments uh come from is an adoration for for a leader in the District of Columbia that people believed uh was working on their behalf in a time where uh other leaders Across the Nation uh were not and in the city that is the capital of the United United States we are honored to host monuments and streets named after incredible leaders from a national perspective but not uh streets in a permanent way named after our Local Heroes like Marion Barry and I think with this Avenue naming with this street naming we have an opportunity to continue to submit the powerful Legacy of Marion Barry and we still have work to do there because so many folks outside of the District of Columbia know the punch lines and not the person not the the person that we adore or why so many of us adore them so this gives us an opportunity to further cement his legacy uh something that his former wife core Masters Barry continues to work hard toward and so many other District residents who lift up his name continue to do this I think moves Us in the right direction and honors a great man a great uh a Washingtonian so I'm excited to vote in favor of this measure and again I want to thank you chairman and to thank measure for markup is Bill 25-62 entitled dedication of a portion of W Street Southeast so 16-24322 act of 2023. this bill would dedicate a portion of W Street Southeast between Railroad Avenue and Shannon place and provide for the establishment of a non-restrictive easement to the district for the surface rights of that portion of land the applicant proposes to widen W Street between Railroad and Railroad Avenue and Southern Place Southeast from 50 feet to 70. providing for wider sidewalks enhanced landscape treatments and an improved pedestrian realm the proposed Street widening is one of several public space improvements for a planned unit development or PUD that includes a mix of office retail service and residential uses just to give some better context of place this is in historic Anacostia and that would be between Martin Luther King Jr Avenue and the river our Railroad Avenue is like a block maybe two blocks west of Martin Luther King the Pud or planned Union development is being developed in three phases across nine buildings of the nine buildings four will be residential buildings four will be Office Buildings and one building will be retail the portion of W Street that will be widened is adjacent to one of the buildings building number four in the Pud after construction is completed the office space of that building will be occupied by the Department of Health and the District of Columbia infrastructure Academy at the committee's December 12 2022 hearing I'm bill 24.578 which is identical to Bill 62 which was before us the district Department of Transportation noted that the agency had no objections to the dedication or the easement provided provided that the surveyor changed the term surface easement to non-restrictive easement on the plat and the plat which is attached to the report reflects that request the uh assuming that this is approved the committee finds that the dedication of a portion of W Street Southeast between Railroad Avenue and Shannon place uh is necessary to facilitate the construction of a mixed use planned unit development that will include a mix of office retail service and residential uses the dedication will also facilitate enhanced landscape treatments and improve pedestrian realm on the affected portion of W Street this legislation was initially introduced as bill 24-578 by councilmember Tran white in December of 2021. the committee of the whole held a public hearing on the measure on December 12 2022 I reintroduced the bill apparently on January 23rd of this year so that we could move to Market up today the committee held a public hearing as I indicated on December 12th and the Committees received no testimony or comments are not positioned to the bill there's no objection we'll move both to print and the report would leave for staff to make technical conforming and editorial changes as their discussion Mr chairman House member Barnes um thank you very much for giving me an opportunity to ask a few questions um I recognize that we are very anxious as a community to develop um a land that we feel it's just sort of sitting and waiting for um to be put to better use but my question is in I know that now we're talking about the roadway but when we talk when we indicate that we're dealing with the roadway and that Improvement so that a PUD can come into play I want to know um a little more about what is proposed as a development there do you have any information that would inform us as to whether or not we're going to put up luxury um penthouses or are we going to focus on affordable units and if so do you have that information if I may yes customer right yes thank you councilmember bonds um the vision for that was to create three structures three buildings one is a government building which would be Department of Health uh one it was a a high-end apartment building but the community fought against that and now that it'll be it will be a senior living facility in which we redirected money from a lawsuit to the office of Attorney General of upwards to a million dollars to help with any uh issues that singers may have as far as paying rent fees or getting into the property um there's also in the bill uh a hotel in the bill and this is in the beginning of the plans and there are other phases that we haven't got to yet but this was also funded through tax increment financing through a Tiff also authored by the men's officers of District Columbia yes thank you very much I just want to make sure that we're we as a community the government are getting a good deal and one that includes all of our concerns thank you uh thank you and as it happens the developers testimony is not attached to the draft report so I can't add to what councilmember white said but I do want to say this typically when we have one of these measures before us it's about closing a right-of-way and of course we asked a question if we're going to close right away and that land is going to revert to property owner what are we getting in return this is not a closing this is a dedication so the developers actually giving up some land for a public Street anything further on on this measure uh I think I asked earlier without objection well the vote will be on both the print and the report would leave for staff to make technical conforming and editorial changes Mr Cash for the March 7th legislative meeting next measure for consideration is Bill 25-82 entitled Reed Street realignment Act of 2023. this legislation would order the closing of portions of an existing public alley system in squares 3841 and 3846 and a 10 foot wide portion of the south side of Franklin Street Northeast between Reed Street Northeast and 10th Street Northeast in Ward 5. give a better sense of place this is roughly opposite the Rhode Island entrance to the Brentwood Shopping Center the bill would also accept the dedication of property in squares 3841 and 3846 along the west and East sides of Reed Street Northeast between Channing Place Northeast and Franklin Street Northeast for public Street purposes the street and Alley closings and dedications will facilitate a new mixed use planned unit development or PUD that includes 683 new residents through new residential units 15 percent of which will be affordable for households with a median income of 80 percent or less the Pud was unanimously approved by the zoning Commission on October 13 2022. I think it's fair to characterize this as the Bill's title which is this is a realignment and somewhat widening of Reed Street the portion of Reed Street that will be closed is currently an incongruous right-of-way traversing the site the current conditions of the street more closely resemble an alley with the proposed realignment Read Street will offer a more direct connection to Franklin Street Northeast in a photo in the report assuming this is approved by the committee the committee finds that the portion of the existing public alley system and a 10-foot wide portion of the south side of Franklin Street are unnecessary for allier Street purposes the closures and dedications pursuant to this bill will facilitate the construction of a planned unit development with 683 new residential units 15 percent of which will be affordable accordingly the committee assuming this is approved recommends approval of the committee print the bill was originally introduced as Bill 24-1022 on September 23rd of last year introduced by councilmember McDuffie on December 12th the Community Hall held a public hearing and on January 30th of this year council members McDuffie and the next measure for markup is Bill 25-79 entitled the bishop Bishop Clarence goober way designation actor 2023 this bill would symbolically designate the 700 block of Quebec place as Bishop Clarence groover way the location is in word one it's a symbolic naming that is it's for ceremonial purposes and shall be in addition to insubordinate to any name that is an official name Clarence gruver originally from Georgia was born in 1939 he earned several degrees one of which brought him to the American University in Washington DC Bishop groover was pastor and founder of the fisherman of men Church which he started after his ordination in 1969. while the church was originally founded in his living room which would be its home for seven years the church was later moved to a permanent presence on Georgia Avenue in 1991 Bishop groover was appointed to dialysis Bishop of the Mid-Atlantic Diocese of the Church of our Lord Jesus Christ of the apostolic faith Inc in that role he oversaw churches and missions around the district and in Maryland and Virginia Bishop groover hosted a weekly radio broadcast on Sunday nights on Radio One for over 50 over 40 years the longest running show on that station his show focused on preaching the gospel in real time targeting the infirm incarcerated or anyone with a pressing need throughout his ministry Bishop coover served as a role model and earned the respect and admiration of his family colleagues and members of the church this legislation was originally introduced by councilmember Nadeau on June 27 2022 as Bill 24-892 the committee of the whole held a public hearing on the bill on that bill on December 12 2022. on January 30th of this year councilmember Bernardo reintroduced a bill as bill 25-79 which is what we are marking up as I said the committee held a hearing on December 12th the committee received has received no testimony or comments in opposition to the bill I will note that Bishop coover passed away in 2019 more than two years ago there's no objection I'll move both to print and Report would leave for staff to make technical conforming and editorial changes is there discussion Mr chairman councilmember Nadeau thank you Mr chairman I'd like to move an amendment to the committee print which was circulated by my staff yesterday after communicating with staff in the committee of the whole the amendment changes the block to be ceremonial named from the seven hunt ceremonially named from the 700 block of Quebec Place Northwest around the corner to the block of Georgia Avenue between Quebec and Princeton Place as the amendment circulation indicates this is in response to suggestions from residents and better aligns the ceremonial naming in Bishop groover's honor with the church he led which has a Georgia Avenue address I moved the amendment and hope it will be accepted as friendly thank you what's the block on Georgia Avenue George Avenue between Princeton and Quebec so that is the 3600 block of Georgia I believe but it's not the I think at 3600 goes further so you're really just trying to dial into that one block which is out front of the church okay so we're being clear it's part of the 3600 Block it's between Princeton and Quebec and I think for instance a place in Quebec is a place that's right and you circulated the amendment and I have no objection but we'll see uh it will be accepted if there's no objection I'm not hearing any objection oh the amendment is accepted Mr chairman uh councilmanito did you have anything further no thank you chairman thank you councilmember last item for markup in the community the whole is Bill 25-80 entitled Benjamin secundi senior way designation Act of 2023 this legislation was symbolically designate the 1500 Block of Channing Street North West all right we make Corrections uh would symbolically designate the 1500 Block of Channing Street Northeast as Benjamin secundi's senior way the location is in Ward five uh symbolic naming is for ceremonial purposes and is in addition to and subordinate to any name that is an official name Benjamin sukundi senior was born in New York City in 1915 around 1938 he moved to the district and eventually lived in the Mayfair neighborhood with his wife and two sons he was an electrical contractor by trade and was president of the Capital Electric Company Inc in addition he started chanting development Inc training development Inc which was a housing developer that built at least nine new detached single-family homes on the 1500 Block of Channing Street Northeast in Montana Avenue Northeast in 1952. during this time of housing redlining in through racial covenants black residents were only able to deliver purchase homes in specific areas of the district Mr secundi through his development company built these homes that were detached to brick homes with room with room for families and importantly the homes were built to sell to Black residents Mr secundi and his family lived in one of these homes on Channing Street tragically Mr secundi passed away at the age of 43 at Georgetown University Hospital in 1958 and the report has a had for the houses a designating this street with housing developed by Benjamin secundi is a fitting tribute to honor his contributions to the neighborhood the legislation was initially introduced by councilmember McDuffie in on October 23 October 3rd 2022 the committee the whole held a public hearing on the measure on December 12 2022 council member McDuffie and councilmember Nadeau co-introduced the legend uh reintroduced the legislation on January 30th of this year as I said the committee held a hearing on December 12th and received has received no testimony or comments in opposition to the bill objection and move both Chief Financial Officer and referred to the committee on January 17th 2023 the committee held a hearing on a similar measure Bill 24-1094 and Council period 24 on December 7 2022. subsequently bill 25-4 was uh marked up by the committee on February 13th of this year the bill would authorize the issuance of General obligation bonds and general obligation Bond anticipation notes for the purposes of financing certain capital projects and the refunding of certain capital indebtedness of the District of Columbia during fiscal years 2023 through 2028 and an amount not to exceed 6.4 billion dollars the committee print is identical to the emergency legislation passed earlier this month by the council that I move the resolution and actually be placed on the consent agenda for the next proposed resolution was referred to the committee on December 20th 2022. the committee subsequently held a public Roundtable in the measure on February 6th the measure came before the committee for markup on February 13 2023. if approved the proposed resolution will confirm the reappointment of Mr haddock Ortiz as a public member with experience in tourism to the Washington Convention and Sports Authority Board of Directors for return to end on May 16 2026 Mr haddock Ortiz is a more than 50-year veteran of the hotel industry he is currently the senior advisor to the Carlos Rosario International Public Charter School's chief executive officer and a current member of the Watson convention and Sports Authority board of directors prior to these roles Mr haddock Ortiz formed absolute hospitality and is the former President of Capitol hotels Mr Ortiz currently serves as an advisor on the board of the gala Hispanic theater and the Carlos Rosario International Charter as a member of the District of Columbia Housing Finance Agency board of directors she would be appointed as a board member with experience in finance for a two-year term this appointment resolution was introduced by chairman Mendelson at the request of the mayor on December 13 2022 and referred to the committee on housing on January 17 2023. on February 9 2023 my committee held a public Roundtable to consider the nomination at the hearing we heard Ms Cohen's qualifications and skills to act as a member of the board with experience in finance Ms Cohen attended undergrad at Howard University where she studied business administration and finance after graduation she worked as an associate for JP Morgan in New York City in her capacity as an associate she managed investment portfolios worth over 300 million dollars and provided investment recommendations and several diverse asset classes including publicly traded bonds directly following her work at JP Morgan she attended Northwestern University for her MBA with a focus in real estate Innovation and Entrepreneurship currently Karen Cohen is the founder and managing member of Bright Horizon Ventures Bright Horizon Ventures formed in 2016 pursues the development and acquisition of institutional grade multi-family and Hospitality assets and provides Consulting and development in construction management and her capacity as founding the founder and managing member Ms Cohen has developed and executed over 360 million dollars in real estate and asset transactions raise private funding for institutional grade Investments and she continues to provide project management financial and development Management Services to small and mid-sized developers last week Miss Cohen's nomination was approved unanimously by the committee on housing if Council does not approve Miss um Cohen's nomination uh nominating resolution by March 29th it will be deemed disapproved thank you Mr chairman thank you councilmember white thank you again chairman the mayor has nominated Toya Carmichael to the rental Housing Commission this small agency decides appeals from the office of administrative hearings and rent control cases and other matters under the rental Housing Act it also writes and revises administrative regulations under the act and issues in the annual cleric certification of the allowable rent increase percentages for rent stabilized units the rhc is led by three administrative judges who among other qualifications must be attorneys with experience in administrative law housing law or appellate law at a round table earlier this month the committee on housing confirmed that the mayor's nominee possesses experience in all of these areas Miss Carmichael award 7 resident is currently a senior executive at United Medical Center and previously worked for various administrative tribunals in the federal and District governments including the rental Housing Commission itself if the
