[0:36] **Justin Forney:** Thank you very much. The request before us is for a Comprehensive Plan amendment and rezoning for the property located on the screen. [0:46] **Justin Forney:** At one point, the Los Margaritas site was fairly small and an expansion was needed. They owned this subject parcel for possible future expansion, but they were able to acquire the property to the south along Vermillion Street that was already zoned commercial, and they expanded their site in that direction, no longer necessitating the expansion of their site into this subject parcel. The future land use map had contemplated this as a possibility, and so this property was shown on the future land use map as a commercial guided use. Now that the site is no longer having that same pressure for redevelopment, the most appropriate use of the property would be residential, as it's been used for, and there's more of this surrounding land uses around it. The future land use map of the Comprehensive Plan shown on the screen shows the properties that are in red are guided as commercial; orange would be medium-density residential, and yellow is low-density residential. [2:34] **Justin Forney:** And the zoning map is quite similar. You can see the properties around it are mostly residential R3, which is the proposal for this rezoning. The number of units that could fit on a property are based on density. Based on the size of the lot being a quarter of an acre, it would allow for two units on this property. The applicants are proposing to develop one duplex on the property. Those other properties that are zoned R3 adjacent to this parcel have small apartment buildings on them; I believe they all have four units in each one of those buildings. [3:20] **Justin Forney:** The use of this site as a commercial site on its own would not allow for a quality development. It would be too small to provide its own parking, stormwater, and landscaping, along with having fairly poor visibility being behind existing businesses on a very, very low-volume street. This is just another aerial photograph of the area. The Vermillion Street corridor plan doesn't identify this site as being an area for focused redevelopment, and also the use of single-family residential and multi-family residential are both allowable uses in this portion of the Vermillion Street corridor. This is a picture of the site before the house was removed—I think it was maybe the week before last—and I've got a couple of pictures of the area. This is just looking down the street; Los Margaritas is on the left and Applebee's on the right. The red arrow is pointing to the location of where the house was located, where the duplex would be proposed. [4:56] **Justin Forney:** And this is from an opposite view looking down the road. You can see it behind that four-unit apartment building, and on the right side of the screen, you can see some more of the apartments on that street. [5:18] **Justin Forney:** We sent a notice to property owners within 350 feet of this request and published it in the paper, and we didn't receive any comments from that notice. Staff is recommending approval of the Comprehensive Plan and the rezoning, subject only to the information that was in the report and provided by the applicant, and that the Comprehensive Plan is amended as part of any approval.
