[1:55] **Daryl Morey (Planning Director)**: good evening Madam chair and Planning Commission members just one announcement this uh evening for our meeting if uh none of our three regular agenda items uh tonight are tabled uh our next meeting on January 18th will be cancelled we have no new public hearings coming forward that concludes my announcements thank [2:17] **Chair Zac Tenneboe**: you all right moving on to the public hearing agenda items um anyone wishing to speak at the public hearing please make sure that you list your name and information at the back back of the room at on the book um for the appropriate agenda item and with that agenda item number five Ritter Meadows this is a public hearing to consider the application of te land Holdings LLC for a revised preliminary plot of 29 single family lots uh 99 detached Town Homes Villa lots and 127 attached town home units to be known as Ritter Meadows located north of 25 Street and West of I35 and here to present a brief overview of the project is Ben Schmidt. [3:11] **Ben Schmidt (TG Land Holdings)**: thank you chair and planing commission members benmit uh TG land Holdings um this will be very brief as I think there isn't a lot to uh discuss we were here I suppose we had approved maybe a couple months ago uh finding commission and City Council on this preliminary PL it probably took us here a couple two three meetings as there was a little bit of controversy throughout the process which I think we all settled through and whatnot and really the only change from what was approved a few months ago and today is at that time there was an exception parcel kind of right in the middle of the southerly portion of the property and our we're buying the land from um Dale properties Dale properties was able to purchase that exception parcel and so then we're buying a piece of that from them all that really changes is in any meaningful way is at the time Kia Cook was going to run uh north to south not all the way to 205 there was going to be a little Loop Road if you will and now with our new plan because we've got that exception parcel K cook will run north to south all the way to 205th eliminating that Loop Road um so we think it's a you know from a city perspective we think it's a better plan um and one that always was kind of contemplated that that exception par would likely be a at some point we're able to do it a little sooner than what we had thought so that really is the only change no change to units or layout or any of that it's just making that connection of Kia Cook down to 205th um with that I'd stand for any questions thank you hearing none I'll sit down thank [4:58] **Daryl Morey**: you good evening again I am uh very pleased to be able to present this to you at my last Planning Commission meeting uh Believe It or Not 35 years ago and up to not that long ago I used to make regular presentations at Planning Commission meetings so uh but I'm a little rusty I haven't done it a lot in the past few years but I'm glad to be able to present the revised preliminary plat for Ritter Meadows uh I'm just going to run through this quickly as you heard Mr Schmidt say there change are relatively minor and in our opinion staff's opinion an improvement over the preliminary plat that was approved by the city council in May uh Planning Commission held a public Hearing in March and this is the original uh approved preliminary plat I know it's going to be hard to see because it's small but if you do look on this you will see hold on one second there we go you will see that this uh we call it the former Dunham parcel was not included in the plat and the access points to 205th Street were here at Keystone and then the secondary access uh to the east between kuk and the freeway this is the revised preliminary plat again includes the former Dunham property which was uh purchased by the current land owner uh Dale properties this is the Dunham property uh this is 205th Street and the current uh kakuk Avenue intersection including the Dunham property now will allow the extension of kakuk which is a minor collector roadway uh North on the north side of 205 street with phase one and uh because of that and that alone we find that this is an improved uh preliminary plat design over the previous one uh the other change is there was a street EX uh stub that was extended to the West property line originally that street stub's been eliminated and the street been reconfigured up here in the northwest corner and that resulted in the loss of one single family lot compared to the original preliminary here's the phasing plan uh I will just touch on phase one since that final plat will probably be forthcoming relatively shortly uh basically the area here in the purple which will include 80 attached Town Homes um 18 detached Town Homes the extension of Kook and then also along this future Street which will not be constructed at this time but that's where the sanitary sewer alignment will be extended following that street so when this outlaw um that is being retained by Dale properties when that develops that street will be constructed revised site plan um shows the um layout of the house pads this is really hard to see I apologize this is the revised landscape plan and the revised grading plan again including the extension of kug in summary staff is recommending approval of the revised preliminary plat subject to the 10 stipulations which I have listed in my December uh 28th planning report and I can stand for questions thank you um and this is a public hearing so anyone wishing to speak on this agenda item can please come forward [8:48] **Peter Thelen**: now thank you for hearing me tonight my name is Peter Thelen I live at 12119 lern Trail um I've just got a couple of probably questions more than anything thing um I guess I'm going to just I I wrote some things down that I'm going to just go through and um I might not be in order but um first of all is there anything being done with the lighting out there as far as uh light pollution right now I live not too far from there and it's getting already hard to see the stars at night because of all of the light pollution from Walmart and the movie theater and whatnot um just wondering if there's anything being considered with that um I'd like to see more of that northwest corner that's all wooded right now um to be Park wildlife I know that's probably not going to happen but uh just wanted to voice my opinion on that there's I know that there was a cash payment being made in lie of Parkland and um I'd just like to see a little bit more of that wooded lot back for the Wildlife um there's a lot of deer out there right now and they're going to lose their home um the one other thing i' I've been up and and talked with you before on the um the intersection The Pedestrian crosswalks and whatnot there at kokou um I tried to see it on the on the on the plans that that were on the website I didn't see it but how is that going to be controlled was that going to be controlled with stop lights is that going to be controlled with a flashing pedestrian Crossing light is there going to be stripes on the pavement um you know how is that going to be controlled um I guess my I'd like I'd like to just read this and then and then submit this to you uh for public record uh please let it be noted for public record that on January 4th 2024 myself Peter Thelen and my wife Cindy Thelen living at 12119 lucern Trail Lakeville uh we'd like to express our concern we are concerned that the dewatering of the new uh development rear Meadows could affect our wetlands and well um in the future this was not addressed in an eaw report the letter this letter should be attached with the uh The Memo from the WSB consulting firm and um it in there states that the that this was not addressed um I guess I'd like to I'd like to submit both of these and then also there's a um I've got some questions about the there was a permit pulled in 2016 for for dewatering that it was an egg permit it was for uh a one-year it was a one-year permit and um that them ditches that were dug to do the dewatering back in 2016 were supposed to be reclaimed them ditches are still there and it's still being dewatered to a level below what uh what what originally that is supposed to be out there um that original that that pit was supposed to be 5 to 8T higher than what it is right now um that's a big concern that you know with my with my well with my Wetland my Wetland is already dried up don't know if that's affect by um by the dewatering over there or you know weather whatever um but it's it's just a big concern with with my weal you know what's going to happen in two three years when they dig them ponds 30 ft deep and they get into the Bedrock that water is going to come in Faster it's going to dewater that property and all the properties around there much faster um I'm concerned that you know something might happen with my well at that time um yeah so the egg permit you know there was supposed to be some uh omers placed out there when that egg permit was in effect and and it was supposed to be for one year them them Peter readings were supposed to be monitored for the whole year as far as I know that that there was no monitoring done of that um I I asked last time I was up here and um I I was told that that those Pomer readings were at the city um um Mr Dunham has had asked for him and and had never got him I I just talked to him the other day and and he had never gotten those Peter readings to to tell where the ground water was was at out there um and then one other thing is that um after I was up last time there was some Peters actually installed they they dug the Peters in out there and have done some testing out there right next to the Karan property out there and I was just wondering if there was any results on that stuff um so I guess I'd like to just submit this here's just a a memo from the WSB stating that you know there was no there was no um the eaw report did not address you know what effect would have on the neighboring properties with all the dewatering that's going on out there so I guess I'd like to can I bring that to you or I guess that's that's all I've got um probably more questions than than answers that I'm going to get tonight but um just wanted to bring it to you and and voice my concern okay thank you [15:37] **Chair Zac Tenneboe**: thank you anyone else wishing to speak the public hearing [15:52] **Richard Kieran**: good evening Richard Kieran 16618 Lynch path probably heard this before somebody can address his concerns I have the same one my packet and you have the same information can you speak into the microphone please thank you Braun did three tests back in 2017 um and they were required to do 12 can I get a can I get somebody to put a a video on or photo on this I'm sure you've seen this before for as well what it boils down to this is a memo from the city that um they they need 12 different tests this is the grading permit back in 2017 for doing for d for uh Excavating ditches okay and it says some medals for review prior to the full year of ground water train monitoring however staff will not support any city council reconsider consideration of development applications until a full uh year of monitoring is complete um I haven't gotten those I have't I've only gotten three from Braun here and coincidentally um May of the this year uh 10 ft off my property line three more prameters were put in I wonder I question why is that I want to know why um um they were installed and I haven't gotten any answers from anybody B watering is a big issue out there and I don't want to bore you but I'm going to give you a little background here of the from day one back in 1986 I started with a gravel operation on there free time had had a concrete operation right and I got a permit from the city to start mining we put an asphalt plant in there um the groundwater was pretty close to I wasn't you know four or five feet um to the surface trucks would come in this after about two or three years they would remove another four to five feet of material beyond the grading limits that freedheim had left um that was done starting at 4 or 5:00 in the afternoon and it continued on till about 10:00 at night where that material went went to Midwest asphalt over in Eden Prairie somehow or another greed took over and it was good material clean material you need that type of material for your different asphalt mixes and stuff it's been over 20 years I've restored my property to um to a condition well above well well above the requirements that was a long time ago there has not been one truckload of material brought in on Dale properties since then stand to be corrected you can point it out i' I've watched this uh I'm more familiar with this piece of property than probably any one of you and I'm sorry if I embarrass you on that or insult you on that but um I've been there I know so I don't excuse me um this whole issue could have gotten taken care of without dewatering could have raised upgrade I'm a contractor we're always looking for places for clean fill to get rid of clean fill always and that's my comments thank you thank you excuse me one thing more um so why is it why is it our burden because somebody um somebody didn't do their job or took out more material than what they were supposed to thank you [20:56] **Chair Zac Tenneboe**: anyone else for the public public hearing I think right a motion in a second to close the public hearing the public hearing is now closed um director Morey how would we like to address um things from 2016 [21:23] **Daryl Morey**: well let let me just say a couple of things um first of all regarding the the light pollution um yes there's going to be more light because of this development because there's street lights uh there's homes and those homes have lights and that's part of development and that's been happening in Lakeville for as long as I have been here now the lighting requirements for Lakeville and what we do for our street lights is to downcast the lighting so that you don't get the upward glare air but it's still there's going to be more lighting um in terms of ThePedestrian Crossing again I'm going with Mr thelen's comments The Pedestrian Crossing those details will be determined with the final plat um the design of the The Crossing exactly you know what that will entail will involve our engineering staff and our Parks and Recreation director in terms of looking at the traffic C out there and the expected pedestrian traffic and and what types of mechanisms they will put in place there so that will be a detail that will come with the final plat uh regarding some of the other comments uh Mr thei and and Mr Karen while I wasn't at the original public hearing for this in March uh I wasn't here physically I did watch the meeting online I was recovering from knee replacement surgery and a lot of those questions were asked at that public hearing as well and our then uh assistant city engineer Alex Jordan I thought did a very nice job of responding to those questions so many of those questions have already been addressed with the original plat again the change to this plat is basically the inclusion of the Dunham property so um if there's been requests for whether it's Mr thielen or Mr Karen if there's been requests for Peter data or other information uh I don't know if you have done this but please direct those to Zach Johnson our city engineer he would be able to provide you with that information so I don't know who uh who you directed your your questions or your requests but please send that to Zach Johnson City engineering and he'll get that information for you and and again please keep in mind that that more details in terms terms of the grading the storm water um these types of things will those those details get finalized and come into clear focus with the final plat for each development phase and as you saw in the exhibit earlier during my presentation there are three phases proposed for this development so these issues will get addressed uh and if there's questions that the the residents the neighbors have in advance of that again please feel free to reach out to our city engineer and he should be able to address those for you thank you [24:40] **Commissioner Kaitlin Swanson**: uh fellow Commissioners Madam chair um just out of curiosity I know you mentioned the change in the northwest corner with the street only extending to the north now was there a reason the Western extension was removed just out of curiosity [25:01] **Daryl Morey**: Corey if I could get my PowerPoint again please so we can get that exhibit showing on the screen and and I can have the developer correct me if I'm wrong uh but my my recollection on that was that was actually a request from Mr Karen that the street not be extended to his property at that location okay sound accurate thank you thank thank you for answering that I appreciate that Madam chair you want to see it [25:35] **Chair Zac Tenneboe**: yes [25:37] **Daryl Morey**: so the the Street Extension was generally in this location right here so right that Street then became a a curve um kind of continuing on with what d comments on that you know in terms of the crosswalk and how that's addressed in these comments and stipulations that we're putting on here item number 10 talks about how Kook will be extended north of 205th Street with the first phase final plat subject to design review and approval by the city engineer U that's essentially where you'll get your crosswalks and everything else all those answers will be forthcoming with that type of review so that's that's where we're covered in our conditions at least by my view [26:22] **Commissioner Kaitlin Swanson**: yep correct um lastly at least in terms of how I'm reviewing this project and in what I'm considering um the folks who commented today I appreciate your comments appreciate you being here today um unfortunately for me at least the issues that you've brought up were issues that were brought up at the last meeting um affecting the entire plat and I'm looking at this basically is the revision with the new piece that's been added to this and I'm thinking about it that way so as far as I'm concerned as an engineer my engineering questions were answered at the previous Planning Commission meeting and I'm satisfied thank you [27:05] **Chair Zac Tenneboe**: fellow Commissioners any other comments or thoughts [27:08] **Commissioner Lori Lily High**: Madam chair yes I don't want to miss this moment I'm glad I'm here would like to uh recognize director Morey uh if there was rust uh on him as he stood up to make this presentation tonight it wasn't apparent um I think this was a very appropo moment for him to present um and to reflect upon the questions of Mr thielen and the history that Mr Karen brought to us previously uh it has been a pleasure working with Mr Morey over many years um and these are the things that we do these are the things that he's done and helped us accomplish as it relates to developing a comprehensive plan I am mindful that uh at this particular moment within our audience we have H former mayor Doug Anderson uh our Dakota County Commissioner as well thank you for being here and a group of Boy Scouts all of these people uh interested in learning more providing the history that's been here and learning more about the history to come so what an appropo moment to introduce a question like Hey we're doing development and will there be more lighting with the development these are things that have been contemplated for many years uh by the planning director his staff and the current and prior uh planning commissions we are helping to set out the comprehensive plan that lets everyone get a very good idea of the types of things that might be built into the future and we can fully contemplate that roads will be involved and traffic will be more and and the lands that we have loved uh to watch uh trees grow and deer cross will change for us these are not always welcome things but know this that your city of Lakeville is always welcoming it is why the people uh before me came to Lakeville it is why my wife and I came here to raise a family and that those that sit in this room today and those that have been in this room prior are the reasons that this works so well well so hats off to you director Morey thank you for being here for us the city thank you for being here for us the Planning Commission and it has been my distinct pleasure to serve and work with you consider the application of United Christian Academy Foundation for the following located at the north side of 215th Street West of cook Avenue um this is a comprehensive plan amendment to reu property from commercial to medium high density residential and a zoning map amendment to rezone property from C3 General commercial District to rm2 medium density residential district and here to give a brief overview is Nick spedes. [30:57] **Nick Spedes (Architect)**: good evening uh Council or commission members I'm Nick spedes there you go thank you uh spes Riner Architects uh on behalf of uh United Christian Academy our uh request is quite simple uh this evening to uh and the details uh will be covered shortly by planning uh the United Christian Academy has acquired an adjacent property to uh the area that would be our Sports fields at the school and after as they say in Pro Sports after further review I I relayed out all of the sports fields and found that I could uh improve the layout improve the size of the field so that they're uh more uh game field sized uh improve the grading and drainage um and the storm water management and then improve the uh conditions of the adjacent homeowner to what he'll be seeing eliminating a lot of retaining walls so it's a really good uh Prospect and we just need to go through the process to since it's adjacent land same owner make this uh approval process so we can uh proceed in that fashion thank you [32:16] **Kris Jensen (Planning Staff)**: thank you um I don't have much more else to say um but as you know it's a um comprehensive plan change and the resoning um and as um he said um on the screen shows the um area the additional 10 acres which is located right here um and the redesigned Field layout that will accommodate um just the improved layout for um the school and then the change the comp plan Amendment and the rezoning changes just to bring everything in consistency with the UCA underlying zoning and land that was approved late in 2021 so we're recommending approval of this we have submitted the um notification to our jurisdictions we've received 10 out of the 11 um the end date for that is February 1st so we'll work on wrapping that up and get the submitt upon Council approval to the Metropolitan Council and I stand for any questions thank you [33:19] **Chair Zac Tenneboe**: and this is a public hearing so anyone wishing to speak on this agenda item can please come forward [33:36] **Commissioner Kaitlin Swanson**: Madam chair yes seeing no one come forward I move to close the public hearing [33:40] **Commissioner Dan Morovic**: second [33:42] **Chair Zac Tenneboe**: I have a motion in a second the public hearing is now closed fellow Commissioners any comments on this agenda item [33:55] **Commissioner Kaitlin Swanson**: y I think this one looks great so I believe we are ready for a motion now chair I'll make a motion uh motion to recommend approval of the United Christian Academy comprehensive plan Amendment and zoning map Amendment and approval of the findings of fact dated January 4th of 2024 [34:15] **Commissioner Jeff Ott**: second [34:17] **Chair Zac Tenneboe**: I have a motion and a second Miss Marl will you please take a roll call vote [34:21] **Recording Secretary**: Kalisa hi Lily High hi marovich hi a hi Tinsley hi swon Zac hi [34:36] **Chair Zac Tenneboe**: all right and director Morey when will this one go in front of the city council [34:41] **Daryl Morey**: also on January 16th and just as a reminder because of the Martin Luther King holiday on Monday that is a Tuesday night city council meeting so thank you [34:52] **Chair Zac Tenneboe**: thank you agenda item number seven this is North Ryan second edition public hearing to consider the application of Dakota County for the f following located south of 215th Street and North of 217th Street and West of jaquard Avenue it's the preliminary plat of one industrial lot to be known as North Ryan second edition and a conditional use permit to allow a Dakota County recycling facility in the op Office Park District and finally vacation of public drainage and utility easements and here to tell us about this project we have Joe Lexa. [35:29] **Joe Lexa (Dakota County)**: well good evening Madam chair and Planning Commission I am Joe Lexa with Dakota County's Capital project management department Dakota County in partnership with Scott County are proposing a new Regional household hazardous waste and recycling facility near the intersection of County Road 70 and jaquard um each County currently operates a uh household hazardous waste and recycling facility Dakota counties is in the existing one is in Egan uh Scot count is located between Jordan and Prior Lake uh both of those facilities are operating above their maximum design um above are operating above their maximum capacities um this new facility will accept similar items as the County's recycling Zone in Egan those materials are paints pesticides batteries autof fluids household cleaners Electronics tires paper cardboard glass plastic and metals uh this new facility may also um collect items such as appliances mattresses carpet Organics and bulky waste such as Furniture both counties are required by Statute to have household hazardous waste collection programs as well as meet waste objectives such as a 75% recycling goal by 2030 this new facility will help both counties meet strategies identified in their state required Solid Waste Management plans and this site is convenient because with the existing site being in in Egan this is far to the south for the residents on the south side of the county and it's also U less than 2 miles east of um of Interstate 35 and very close to Scott County that's all I have thank you [37:25] **Frank Dempsey (Planning Staff)**: good evening Madam chair planning Commissioners I am uh presenting some uh information here if I get myself set up uh for the proposed um uh preliminary plat of North Ryan second edition as presented and uh proposed by Dakota County um the the uh public hearing also includes an easement vacation otherwise uh in other words um vacating the the boundary easements on the property that we created with the original final plat of the outlaw and also the stormw uh uh maintenance agreement easement uh to cover the temporary large storm water basin that was constructed after the plat was uh preliminary plat was approved in 2022 and then a conditionally use permit is required uh for the purpose of having a government uh building other than the city of Lakeville uh in this case the warehouse that is proposed for the uh waste facility that uh was presented to you U by Mi Lexa um so Dakota county is looking for a site for uh this case 12 acres for the construction of their new Warehouse facility uh similar facility as was mentioned as the one that is in Egan um so this will be located of course in the southern important part of the C to serve this region of the county um North Ryan uh addition was approved in 20122 and it was uh largely graded uh together with where the location of but not yet shown on the they were the Magnum Warehouse uh building is now constructed south of 217 Street um and this property was preliminary graded and a storm water basin constructed to the east uh County Road 70 also what known as 215 street is located to the north of the site to the east is of the city Outlaw is jakar Avenue which one runs north and south as a major collector Street 2 17th Street is a parallel local street that will run further west as development occurs parallel to to 215 Street uh County Road 70 the property is um is zoned op Office Park District uh the the uh surroundings zoning is primarily industrial to the to the uh to the East and to the South and to the uh West is additional uh Office Park District zoning uh the building or the rather the this is the zoning map here I'm sorry um and to the north of where the uh public open space district is that includes uh Lakeville South High School the uh preliminary plat is again of uh about 12 acres and uh this out this uh exhibit here represents the easements that are proposed to be vacated as I mentioned the boundary and the stor mon easement uh this is the preliminary plat which reestablishes all the easements uh as required for this particular development which is the warehouse building this will be a single use property in other words this uh property is not proposed to be subdivided in the future uh the building will be approximately 177,000 700 Square ft and approximately uh 10,000 ft of expansion area in the future located uh to the north and I believe to the uh to the east of this particular building um the uh site will be accessed from primarily from the driveway on the east side of the property the right side here uh wrapping around the property uh to the North and then uh there's various uh service areas where people are able to drop off household goods that will fit into bins uh large containers adjacent to the building and also there's a covered area where some materials will go directly into uh the the warehouse building uh regarding uh the layout of after access if there's parking uh that is proposed uh by uh employees or or customers to the site uh parking is located primarily in the South End near the West exit uh the proposed uh number of parking spaces in in the first phase is more parking spaces than that's required and the second phase will include additional parking spaces but uh um it will comply with the zoning ordinance requirements for this particular uh building it includes office and some or warehouse and some office space uh in terms of all the streets that are budding the property no additional ride of ways required uh the um engineering division has reviewed the grading plan for the site and the grading details erosion control utilities Etc are all addressed in the engineer report uh dated December 19th one particular instance in terms of grading uh Topography is you'll notice the the steep topography here this is a drop in elevation it's approximately 15 ft from the surface of of 215 Street to the uh elevation here of the site development approximately 20 ft from this elevation so driving down the street if you had a chance to go by the property you'll notice that it sits rather High uh which addresses a lot of the uh concerns of screening that are typically associated with uh loading docks and in outside storage and that such um their uh tree preservation there are no trees on the site it was a Farmstead property and the whole site was Mas graded in 2022 uh there are no Wetlands located within this property uh there is no Park dedication land that's uh identified in the park uh an open space plan for this particular area and so park dedication will be paid in cash and Lou Park uh with the final plat uh there's a uh pedestrian trail that is uh proposed to be constructed as called out on the Transportation uh by Park open space plan and the county plan for adjacent to the on the south side of 215 Street and that would be addressed further uh the method of of construction will be addressed further in the final plat report uh this is the landscape plan uh you can see there's approximately 85 or so uh new trees that are being installed with uh focus on the perimeter the south side and the north side and the east side or west side rather of the property um uh a mixture of overstory trees and shade trees rather and and Evergreens uh this is a rendering of the building it's approximately uh 30 feet or just under 30 ft in height um it's constructed of of tip up concrete panels uh that are accented for architectural uh variation uh it is proposed to be uh two different uh shades of brown color and there's some texture in there as well for visual interest uh in the op District these are considered grade a uh materials and the plan does outline uh the various grades and percentages and it does comply with the zoning ordinance requirements for the op District uh there are two signs that are proposed on the property uh one here and one this exit here it's not identified exactly what type of sign those two are but the site is allowed to have one freestanding sign there are directional signs that are allowed if that is proposed and there are two wall signs that are allowed on this particular property um a sight lighting plan was not submitted but it's not unusual to get those with uh the building permit application and staff will review those for compliance with zoning requirements for uh light uh glare control and light impact on other properties and Street rideway and and make sure that they're all downcast type lighting which is uh consistent with zoning ordinance uh the preliminary plat report concludes with uh seven stipulations that are recommended going forward and then the conditional use permit does require findings of fact and there's a draft findings of fact for your consideration I'll stand for any questions thank you [46:17] **Chair Zac Tenneboe**: this is a public hearing anyone wishing to someone who frequently recycles I end up driving over to Egan and sometimes ask myself what is the value of recycling a button battery and I think man I must have spent more money to recycle this than I did to actually purchase it it'll be nice to have you in our community so that I can make you part of the things that I just do when I'm out and about the improvements on County 70 now uh mostly completed certainly seemed to uh put you in a good place and uh Dix has a transfer station along that same road I think this is uh the right place uh and the right timing to have this for us I also want to uh further recognize I apologize for uh referring to as our County Commissioner I wanted to highlight in my communication that we have Mary Liz Holberg in our audience tonight she is also a fellow or former uh planning commissioner and I don't know if all of you would have recognized that you likely do recognize her as our our uh former Minnesota state representative thank you for being here thank you [48:11] **Commissioner Kaitlin Swanson**: yes Madam chair I want to thank you also for opening it up to mattresses and appliances and I'm hopeful that we'll lessen them being put in construction dumpsters throughout our community because they're everywhere in our Construction Dumpsters Madam chair yes so interestingly when you brought up driving over to Egan I don't know if people realize it but actually the closest facility for a lot of us is in henip county in Bloomington so that's why this location is great so we'll look forward to that uh coming to the city of Lakeville um just a couple other comments that I just wanted to add is looking at the site design for this um piece the way this is set up I'd love to see the depth of stacking that's allowed on this site um how this can handle a large quantity of cars coming in and through the facility so I think that's great um I did have two questions um one was just a question as to whether or not this facility may have a reuse area for additional uh reuse of materials that type of thing that come into the facility and the second question I might have um is just kind of gauging an idea of what the capacity of this facility is say compared to the existing County facility um today can it handle more less um what what are what's the intent here just out of curiosity [49:07] **Joe Lexa**: Madam chair commissioner Swanson the uh it will have a re a reuse center um I items um that are frequently dropped off there are I mean that are reused are paint I think lawnmowers snow blowers um there's a variety of things that we just don't landfill when it can be reused um as for capacity maybe Dave Magnuson from environmental resources could speak to that [49:53] **Dave Magnuson (Dakota County)**: CH commissioner uh my name's Dave Magnuson I'm the was regulation supervisor for Dakota County and this program is under me um the capacity should be substantially more than our current site our current site already manages four times what we planned for when we opened it in 1992 and I actually opened that so tells you how long I've been with the county but um uh we haven't calculated the maximum capacity of this but this is substantially larger and was is being designed from scratch to do this activity where we were kind of pigeon hold into an existing facility now so it'll it will handle at least 20 years probably longer without those expansions being needed and we left some room for expansion in other words we've learned some lessons from the last 20 plus years yeah definitely [50:39] **Commissioner Kaitlin Swanson**: excellent thank you also just wanted to comment um and I appreciate this location within the city of Lakeville I think this area and this part of the city is a wholly appropriate location for this type of facility so I'm glad glad and grateful to see this before us tonight and uh we'll we'll be voting in support of this [51:03] **Chair Zac Tenneboe**: any appliances and mattresses as planned right now it will handle the same but we will work with Community see um we definitely would have the opportunity given how it's built and structured to look at expanding the type of materials we take but for the public record I wanted to make sure that that wasn't an expectation when it opened we're working on it perfect thank you and as long as I'm here I think I was at darl Morey's first Planning Commission meeting when he started um because I started on the Planning Commission in the 80s so there's really some remarkable Synergy that I'm sitting here at is last plan CH meeting as well so thank you for the good work you do and the County's happy to be a partner with the city we appreciate the relationship whether it's our roads or library and all council [53:05] **Daryl Morey**: uh also at the January 16th meeting and I would like to add about Mary Liz she was also a city council member so her picture is on the wall right over there she was chair of the Planning Commission and when we had long meetings she was nice enough to bake us really good [Laughter] cookies oh man long [Laughter] time um [53:50] **Chair Zac Tenneboe**: all right and then I have H Miss Jensen and Mr Dempsey would like to have the podium for a minute [53:54] **Kris Jensen (Planning Staff)**: as you're all aware tonight is uh Daryl's last Planning Commission meeting so I put together some numbers um that were shared with everybody at the city council meeting and I thought you guys would all be interested in hearing them as well um so 35 years and Daryl started here August 1st 1988 and next Friday January 12th will be his last day he has had six job titles uh assistant community development director assistant community and economic development director city planner acting community and economic development director director of planning and finally planning director uh he has worked with 10 planning staff including current Parks and Rec director John hennon who used to be started as a planning intern and our current assistant City administrator Alan Kennan uh he has worked with 27 Mayors and City Council Members 53 planning Commissioners uh by my count and I did actually count all these including tonight this is his 641 Planning Commission meeting um that does not include joint sessions with city council or other commissions neighborhood meetings or open houses uh darl offered his estimate that he has attended approximately 1,500 uh such official meetings once you include Council and everything uh during his 10 years recorded approximately 675 plats um in 1988 the population of Lakeville was about 23,800 it is currently about 74,000 we had in 1988 about 8,000 households and we now currently have about 25,000 households um Frank did some some figuring today of the 39 square miles within the city approximately 13 square miles of that has been developed under um Daryl's tenure here and that includes more than 300 acres um in 110 public parks natural and conservation areas um and 12 new public schools which is 428 acres and Frank's favorite little uh calculation that he did here 35 working years equals approximately 8,400 working days so I'm going to turn it over to Frank [56:12] **Frank Dempsey (Planning Staff)**: the Thousand yeah so obviously uh Chris and I wanted to um provide some information on Daryl's impact has been and and and the positive uh things that have come from his being here for 35 years obviously uh I've worked with darl for 31 of those years with him as my supervisor and uh I never regretted a day coming into work largely because of his stable and managed um uh Visionary work environment and it's it's been a a real pleasure uh working under his his his leadership um his professionalism his work ethic his commitment to Quality uh commitment to encourage and respect uh input from City residents I think is uh obvious um his process to create and update three different comprehensive plans which are all done every every 10 years has has been a a real plus uh for the direction of the city which is now nearing very closely Nearing development as you're all uh maximum development as you're all aware um also implementation of the city uh codes that have to be enforced uh uh and all these things speak volumes about his commitment to uh position the city of Lakeville to be uh you know among of the best cities in the state in our opinion um and also you know some things that were mentioned by a number of different people this evening that I had placed into my notes uh for this short speech I'm making here uh but under his leadership uh with planning Commissioners that had come on uh we witnessed uh neighborhood Representatives um that had come to public hearings often uh in situations which are uh rather concerning for them and and and and intense Environ uh public hearings some of them that went rather late and um and it was our first uh dealings with the planning department and the Planning Commission um also um it resulted in positive developments uh in their neighborhoods and eventually many of these uh uh um um residents became uh really valued and respected members of the Planning Commission uh and not only that uh I estimated and I could be wrong but at least uh six of those because I came out here and I counted Mayors too that I recognize our mayor and and and and and Council people that were on the Planning Commission but at least six one on to be elected they were appointed to city council um I did note one most recently elected to the state legislature and I had forgotten I'm sorry mariz that you as well uh were elected that position she's also obious now of the Dakota County and so it's it does speak lot volumes sometimes I think as the Planning Commission is an important launching Launchpad for uh people that want to serve their communities and move on to uh to larger office responsibilities and and um and also it's so obvious to us that the Planning Commission uh with their experiences when they go to these other uh uh levels of government that um they bring with them important understandings of how things work how things um uh reach up positive outcomes and and really the importance of the whole hashing out the details the Visions the public hearings um that make our our city great um I believe the Planning Commission can uh attest to most of what I'm saying here um but one of the important things I've noticed over the years working with him and the Planning Commission past and present never forget his fastf footed concise and quality word smithing uh to bring items to to a close that are very complicated taking input from dozens of people and bringing that concise uh recommendations forward to the city council which I don't remember a meeting being till 2 o'clock I don't remember a meeting till midnight not saying it didn't happen but but over time these consistent and efficient consistencies and efficiencies really help speed the process uh for the important work that you all do um so anyway yeah congratulations Daryl we're going to miss you and I think the Planning Commission will as well so thank you very much [1:01:07] **Daryl Morey**: thank you Chris and Frank for those very kind words uh I could go on uh when you get me the microphone I could go on forever but I will not uh I will say that and I'm glad Frank did bring up the point about uh neighborhood representatives as part of development projects that went on to be on the Planning Commission commissioner Lily high is a good example of that uh also uh former Planning Commission member and council member Wendy Wolf uh same thing similar development in neighborhood they they became involved uh and decided to take that their experience to the Planning Commission and have been very valued or were very valued commission members so I have enjoyed my time here uh I have enjoyed doing the word smithing uh I didn't like the late meetings the Brunswick Zone was a late meeting I it was on my birthday and I missed last call so that was not not fun so that one did go well past midnight uh unfortunately but uh those aside uh I have some very good memories I'm going to miss all of you so thank you very much um [1:02:43] **Chair Zac Tenneboe**: director Morey would you
