The cannabinoids are with the tobacco ones, um, and we approved the ones previously and they had to have a tobacco license to sell. Are they not renewing because when if they go to renew for their THC license and they don't do this one, then they could be in trouble, right? [11:25] Eric Johnson: Great, thank you very much, Mr. Mayor, members of the Council. Uh, before us is a request to modify the S1 Suburban zoning district to add the uh use of agritainment. Back in 2018, the city defined uh what agritainment is. It essentially runs into like corn mazes, wedding barns, etc. that way. And uh we allowed that in the C1 and the C1A zoning districts. Uh, in the last uh few months, the city has had some inquiries about adding agritainment to the S1 uh residential zoning district. So, um, staff has looked at this and uh discussed having the same requirements from the C1 and the C1A, and the fact that agritainment in the S1 would have a requirement to a minimum of 10 acres of land. Uh, you'd have to provide a site plan and a commercial industrial development permit associated with that. Um, the—the city would have the ability to set operations associated with that use as well. And lastly, that any sort of agritainment would require a special use permit for that. [12:28] Mayor Wayne Boucher: Thank you. Do we have any questions or comments from Council? Um, wanted to just step up here tonight, introduce myself. Um, I'm sure I'm going to be seeing a lot of you in the future. From time to time, this is just one hurdle that we'll probably have to jump through. Um, my siblings and I have uh inherited, so to speak, some property at 4258 Midway Road, which is a large parcel of about 19 acres here in Hermantown. And we would prefer to take that land and create an event center—a wedding venue, if you will—um, rather than parcel that out and sell it. Um, that is our—our main goal is to keep that property in the family. And um really just wanted to let you all know if anybody has any questions, concerns... um, Eric has my uh contact information. Um, we've bugged them a lot over the past few months. But um yeah, we're really excited to start a new venture here in Hermantown and offer an experience for those that are looking to get married or other different venues, such as graduation parties, city council parties, whatever that may entail in the future. But uh we're still in the very early planning stages working with um Heather Heiner down the road. Um, she's going to be our designer. Working with GJS Foundations as our architecture. Um, in addition to that S1, after conversations with the City Attorney, uh, staff believe that the uh special use permit section of our zoning ordinance is the place to provide additional requirements associated with agritainment. So uh uh staff has done some research from the state level and as part of that SUP zoning section are adding the following requirements for agritainment: that the um the—the state-licensed architect and engineer prepare any plans associated with that or to conduct code analysis on any existing structures; that they need to meet any state requirements for occupancy and fire uh codes; uh, it also apply City safety—safety requirements are required; and lastly, that a traffic analysis of property and site access given that some of these can be very um heavily used events that way, that we'd want to get traffic information associated with that, particularly if the starts abutting into um some city streets or even county roadways. This position would provide supervision to the Community Development Director and the uh Building Official um and would um oversee our economic development efforts and assist in all the other community development items. I'm glad that we're able to award this contract to someone whose business is located inside the city, uh, who's in our industrial park and who's also a Hermantown resident. Uh, I know the gentleman that owns it and he's got many years of experience running a tow company and actually uh was the manager for our previous tow contractor. So he's got a lot of experience in doing this job. I'm sure he'll do just fine. [27:17] Mayor Wayne Boucher: Uh, any public comment on this resolution? Any public input on Resolution 2023-193? Maybe David Bolf could explain those a bit. Mr. Bolf, detail? [28:31] David Bolf: Yeah, thank you Mayor and Council. So these are two change orders for work associated with um the Richard Lindgren project in the Hermantown Marketplace. Um, change order number one is specific to items on Lindgren Road, where we had to go um a little bit deeper and wider in the muck excavation section. So the bulk of that is um money for the excavation and additional sand. And then also on Steve Drive, the bituminous section was uh thicker than we anticipated, and when we removed the bituminous we had to add additional Class 5. And also there were some additional Class 5 under the sidewalks. So that um is the scope of the work under change order number one. The scope of the work under change order number two is specific to the delay caused by utility company Lumen by not um relocating their pole in a timely manner. It um effectively um pushed the construction out about five weeks and thus um Ulland Brothers and their subcontractors were not able to get the work done in time. So all the items in change order two that add up to $21,000 equate to the delay caused by Lumen. [29:57] Mayor Wayne Boucher: Thank you. Uh, any questions or comments from Council? [30:04] David Bolf: Yes, um—I mean, when we were—and I say we, the City Attorney and myself—had drafted letters in order to push them to get their utility moved, and in the conversations, there was—we put them on notification that any additional cost due to delays would be um presented to—to Lumen. [30:31] Councilor Andy Hjelle: So we're going to bill them? [30:33] David Bolf: We are, yes. [30:34] Councilor Andy Hjelle: Doesn't mean they're going to pay it, but we're gonna bill?
