Uh could you please read us the uh rules for public comment, please? >> Citizens will be allowed to attend and make public comments in person at the city planning commission meetings. The public is invited to speak on any agenda item and any other item that pertains to the planning commission. Comments are limited to three minutes. If you choose to speak during this period, you will not be allowed to speak again when the specified item is being considered in the order on the agenda. Thank you. Uh so at this time, I'll go ahead and open up the public comment and see if anyone would like to come and speak on um anything on the um other than tonight's agenda. Moving on to consent, public hearing discussion, possible action for items A, B, and C. And at this time, we're going to go uh through item number two and eight. And uh Commissioner Hendrickk will be abstaining from these two items. and then we'll move on to the other items on the agenda. >> Thank you, Madame Chair. For the record, Andrew Deus with Development Services reading in tonight's consent agenda. Starting with item number two, there was a slight typo. It should be PL8877 instead of 79. So, I just wanted to put that into the record. But that is preliminary plat Riverstone trails phase 1. And number eight is a final plat PL9069 Meadow Ridge subdivision. Staff and the technical review committee have reviewed both of these plats and determine they are consistent with the Texas Local Government Code as well as the Unified Development Code and recommend approval. Item number three, a replay for Brooklyn edition. Item number four, replat for Saratoga Industrial Place Unit 2. Item five, replat Comedream come build subdivision trench 1. Item six, a reply for steel addition. Item seven, a final for Neck Town Center phase 2. Item number nine is a conditional approval for a final plat for Park Pun 2. uh of the listed plat staff and the technical review committee have reviewed them determined they are compliant with Texas local government code in the UDC staff recommends approval and then our one zoning case item number 10 zoning case ZN9062 Gway mobile home park located in district 4 is a request from the CG2 general commercial district to the CG2 general commercial district with a special permit the purpose of the request is to install a new 95 ft cell tower staff recommends approval. If there are any questions, I'd be happy to address them. >> Thank you, Andrew. Uh, commissioners, do we have any questions for staff on these items? >> I just had a question on number nine. So, it's a conditional approval looks like because uh you had a preliminary plat, the prelim expired. So now before they can get the final plan approved, they just need to go through the process to resubmit the >> an updated prelim. Exactly. >> So that'll come again through this body. >> Okay. >> Precisely. >> So they just basically can't move forward until that's approved and then it's kind of like a simultaneous >> it. It's the best we can do to make it the the most expedited process because we understand the owner is trying to to close on the sale of the property and we want to make sure we can move as fast as we can. >> Okay. Thank you. >> You bet. Uh any other questions? I have one. I'm just curious to know on this uh uh zoning item for 10. It is because they want to um increase the square footage of the pole. >> Correct. So the way the UDC is set up there is an existing 83 foot tower. Uh as the property is zoned commercial, if the new tower were to stay under 85 feet in elevation, they would not have to reszone. Uh in this case, because they're going above that threshold, that is what triggers the special permit. >> What is the maximum height that they can go according to like without any >> there isn't a maximum height per se? the way the UDC and and Texas windstorm is set up in order to meet the mile per hour thresholds, that is really your major limiting factor, the engineering behind it. Second, there's a fall radius. So, uh, the UDC says that for every foot you go up, you must meet a 1 and a half times distance of fall radius. Even though they're engineered to pancake upon themselves essentially, if it were to fall as a solid piece, you have to have enough distance from rights of way and any dwelling unit in it. We don't want a tower landing on anyone's property. So that that is uh that those are the limiting factors. So instead of us saying you have a maximum height, we say you have to meet these fall dimensions and windstorm and that sets an artificial limitation. >> Okay. I was just curious, you know, because I thought I mean I know that it's there's more development going out there and I understand that they need more of these towers. >> It's all about data now. >> No, I get it. >> Is there a certain point when the FAA has to chime in? >> 200 feet. >> Okay. 200. >> Well, >> okay.
