eight you know this isn't so bad where you can spread out here about my agenda I'm starting off of this special joint City Council okay that's at the end then okay all right okay good morning May 20th 2020 meeting of the City Council's call to order this meeting has been properly noticed and posted in compliance with the Open Meeting Law these proceedings are being video recorded as well as presented live on KC L V cable channel 2 and our closed caption for hearing impaired viewers please note customers of CenturyLink and Cox communication may view this program in high definition on channel 100 - and its standard definition on channel 2 you may also wash this morning's meeting live on Apple TV Roku Amazon fire TV and on the go Vegas app the City Council meeting as well as all other KC LV programming may be viewed on the internet at WWDC the proceedings will be rebroadcast on KC LV channel 2 and the web the wednesday of the meeting at 8 p.m. Friday 4:00 a.m. Saturday 7 p.m. Sunday at 7 a.m. and the following Monday 5 p.m. this building is protected by state-of-the-art fire detection and suppression sprinkler systems the palarm should activate during today's meeting please evacuate using the exits at the back of the chambers going out to the mezzanine proceed out the double doors through the terrace and go down the back staircase for any one of us difficulty with stairs please check with Marshall or fire official for assistance and once outside assemble on the northeast corner across the street from City Hall Lewis and first streets employees wearing safety vests are city marshals when will inform you when it's safe to re-enter the building for public comment related items on the agenda citizen participation in public carrying items we have a speaker card available to you which you may complete and submit to the city clerk upfront cards are available in our clerk's office at 3 or these chambers if you do not submit a card does not prevent you from speaking under public comment citizen participation or specified public airing items if anyone is present today was neat for hearing-impaired equipment please come forward to the City Clerk's staff and please note if you parked in the parking garage across the street a self validation machine is located in the foyer between the council chambers and the security desk to walk through Tanner our chambers you must have either ticket with you to use the machine but if you do not see security personnel when exiting for a validation coupon and before we proceed with the agenda would everyone please rise for the invocation given by our wonderful Reverend Bonnie Pauli Christ miserable Church and then remain standing for our Pledge of Allegiance let us pray Lord God the coronavirus has turned our world upside down at times it seems like we were living in a Twilight Zone face masks have become the norm along with practicing social distancing we ask that we may find peace and joy in the midst of our trials we pray that you would teach us what it means to see beyond our troubles knowing that you are with us and will never leave us we see the challenges from those around us that who are facing we ask you to intervene to be with those who are in need to prompt us to participate with you as you care for your people and most of all to restore creation and make all things new we pray that we would not be anxious but that you will give us your peace let us live differently in the midst of trial so that the world might see you in us bless each of these council members gathered here today as they strive to address the needs of our community give them courage wisdom and foresight to provide for all whom they serve in their offices to promote the well-being of all people for yours is the kingdom Oh Lord and you are exalted has met over all men thank you and before we begin with the agenda this morning we lost a dear member well we've lost several dear members of our community certainly Roy Horne who along with secret have given us such joy and peace of mind and been so much a part of our community but just yesterday we lost another wonderful member of our community and I've asked councilman creer if you would and if I if I could ask you because it's very hard to understand you with the mask on if yeah I don't want to lose a sentence of what you're saying Thank You mayor you know normally I don't have prepared remarks I sort of just talk off the cuff but today I wanted to make sure I didn't miss anything because this is so important as the mayor mentioned yesterday morning pinaster dr. Robert E Fowler senior who's a pastor of Victory Missionary Baptist Church passed away he served as senior pastor at the V since 1996 and under his leadership victory has become the church where the where the Lord has lifted and the word is learned dr. Fowler graduated from Southwestern Baptist Theological Seminary and he received his doctorate of ministry degree from Tyndall Seminary in Dallas Texas dr. Fowler was committed to his congregation and continue to hold church and prayer services virtually during this corona virus pandemic he wanted to continue to preach and teach the Word of God to bring a level of hope and comfort to the community and as a member of the Board of Regents I had the opportunity to present dr. Fowler with the highest award that a Nevada system our education hands out which is called the distinguished abadan award and this award was so well deserved and it just commemorated his extraordinary works and deeds in the community he was truly a blessing to everyone that he came in contact with dr. Fowler frequently participated during city council meetings giving the invocation he believed it was his civic duty to be involved with his community and we at City Hall will miss his presence dr. Fowler had a peaceful spirit and many many people especially the members of victory looked to him for the Word of God in direction he was a leader with a strong presence and was always willing to serve his community whenever he was called a bar on behalf of the Las Vegas community I would like to say farewell to this faithful community servant and my friend who touched and improved the lives of many like the close with the scripture and then have a brief moment of silence I have fought a good fight I have finished my course I have kept the faith thank you thank you thank you our condolences prayers to the family his wife joy son Robert Jr why did he bring peace to so many of us over the years and just we know this is a tremendous loss for us all but I believe he's in the best place you can be so Thank You councilman okay we will open with our agenda number five which is public comment during this portion of the agenda must be limited to matters on the agenda for action the amount of time any single speaker is allowed may be limited all comments made will be cross-reference to those specific items if anyone submitted a speaker card or wishes to speak under this portion of the agenda please come to the podium state your name for the record this is your opportunity to address the council but the council is not able to respond or engage in dialogue we will set the at the time or one minute and I would also ask I'm just seeing here we have am i right we have Councilwoman Dias and of course councilman Knudsen Mayor Pro Tem Fiore and Councilman Stavros Anthony councilman courier and Councilwoman seaman so we're all here and therefore but we will be having comments from the phone so our ask our from City Clerk Luanne Holmes if she would any public comments to be read under this item in fact we'll start with you please and I'm gonna ask anybody who's speaking if you can just briefly especially if you come to the podium briefly take your mask down just for a moment so we can identify you in the future and for anybody who's speaking from staff except if you're at the podium speaking with you just for clarity it's very hard sometimes to hear through the mask and people need and I'm sorry miss Psalms I don't want to do that but please good morning mayor and council I just want to remind everybody viewers can follow along with the meeting by watching our live stream on KC L V channel to YouTube and by accessing our meetings and agendas accessing Armenians indigenous page on the city's website at Las Vegas prime gov comm Ford / portal Ford slash search each comments will be available for the public comment and public hearing items on the city council agenda online at WWE diva gov Ford / council comment and via email at City Council live at Las Vegas Nevada gov know that comments received after an item has already been heard and acted upon will be included in the record without being read aloud there may be a time limit imposed on comics read for the record as a standard practice when comments are made here in in person and on agenda item number 5 we have received no e comments thank you very much okay as anyone wishing to address the council he's come forward and state your name for the record and briefly for the moment just pull your hearing and seeing no none or no one move on to item six business items for possible action any items from the this session that the council staff and/or applicant wish to be stricken table withdrawn or held in the bands to a future meeting may be brought forward and acted upon at this time they are pro-temp thank you madam mayor as I read through the following items that have been requested and held in abeyance withdrawn tables are strictly I just have a question and it would normally go to Robert Sommerfeld so I don't know if mr. Sommerfeld is on the phone or Oh perfect Thank You mr. Sommerfeld just so I'm going to ask the question before I read this on item number 42 it's a request to withdraw without prejudice I spoke with the applicant on this it's not so much a request to withdraw as it is we just want to make sure we don't lose time we want to make sure we don't ask for that vacay so I don't want to if we request to withdraw without prejudice are we starting from the beginning madam mayor through you Robert Sommerfeld director of planning and response Mayor Pro Tem so yes so if the item is withdrawn that means a new application will have to be filed when they're ready to proceed forward if you'd like to table the item that will allow this item to go sort of in a limbo space it will have to be re noticed when the applicant is ready to proceed so there will be some additional costs associated with that Reno de fication but that will allow us to bring it back to a future agenda without a specific date in mind otherwise we do bei it to a date certain and we'd have to identify that date now that date could be three months from now if but those are your kind of your options with this one so with this one because I'm thinking of just a bang it because the only thing we want to do is go back to the original where we already notice where we already went through and then they wanted to change the Lawrence of vacatur Street we're not vacating the street so I don't want to lose time or energy or effort or dollars that have already been put out they just want to obey it for until the next council meeting to make an amendment and not vacate that and go 25 on the consent agenda which are considered to be routine or recommended for approval by the department's may be enacted in one motion are there any items that the council wishes to bring forward if I may just on the consent items I apologize a and you are sir again madam mayor Robertson field director of planning for the record I just as we've been doing for the last few meetings because of the pandemic I need to read a statement regarding some of the license items that are on your consent agenda madam mayor members of the City Council I'd like to bring to your attention that we have four items on our business license consent agenda that are affected by the declaration of emergency for the coab in nineteen directed three these businesses will not be able to operate under these licenses until the emergency has been lifted I have signed affidavits that I will submit to the clerk's from the applicants saying that they understand the directive and understand that while you are taking action on approving their licenses today that they will not be able to operate until they have been approved for to begin operations by the city or by the state once various elements of the phase reopening are underway so with that I just put that on the record thank you and you don't give us the four which are the four please sorry ma'am so those are items 13 17 18 and 19 today the two one-day openings those will be rescheduled there currently Gaming Control Board we don't know when gaming is going to be allowed so those will be rescheduled and the office of the ward offices will be notified when those one-day openings will be occurring thank you so much and those items have passed so thank you very much and we know that gende item 26 and been stricken so we are now on to agenda item number 27 discussion for possible action regarding exclusive negotiating agreement na between city parkway fives ansi b v and the Nevada Test Site Historical Foundation the developer for property located in Symphony Park generally bounded by South City Parkway to the west west Bridger Avenue to the north you the Union Pacific Railroad to the east and robin Leach way to the south this is in Ward 5 and morning good morning mayor given members of City Council bill aren't director economic and urban development I'm really pleased to introduce this item for another new project that is proposed for City Park in downtown Las Vegas with us today is our partner and I'm gonna invite Brian McCann Allen who is a familiar face to most of us up to the dais and he can introduce his team I would like to just explain the transaction very briefly and then I'll turn it over to Brian and any others from the team that want to make remarks this project is for a parcel in Symphony Park that we've known or identified as parcel m4 there is a site map here of showing where the plot is but I'd like to put an aerial map on the overhead too because it may be easier to understand for you and for the listening audience to understand where this location is and so the parcel is just almost immediately adjacent to one of our parking garages in Symphony Park the parking garage that is behind or to the east the Smith Center for the Performing Arts and then also the parcel is just immediately south of a housing development that is undergoing construction being framed as we speak for a project known as Aspen Heights that's being developed by Aspen Heights out of Austin Texas so this is a piece of land that's adjacent to the railroad has a lot of visibility from all points and we think will be a great site the project that's proposed is the Nevada the National atomic testing museum and it is being proposed to relocate from its existing location on the campus at UNLV and they're looking to develop a new building which would be developed over time the this agreement is an exclusive negotiation agreement so what this does is it allows the project team to explore the site do soil testing understand the physical site to see if it's a good fit for the museum they'll have six months to develop their plans within the first 60 days of our agreement they we've asked them to come forward with a fundraising plan and should the feasibility go well the next step after this agreement would be a disposition and development agreement so this is a first step in a two step process and so that's what we're proposing for you before you turn it over thank you mr. art mr. Mack and Allen pointed to the proposed site plan but could you put point to where it is on the app the symphony park which note the the green okay so it's sort of north northeast corner of the Smith Center correct so or you could think of it just just east of the park so just if you were walking along the park heading eastbound facing downtown you'd walk right into it immediately north of the park with the great immediately I guess south east so okay yes thank you okay okay please continue mr. art and so we're really pleased to announce this project I wanted to let Brian and the project team explain more details about the vision for the project and why they're interested in this site and Symphony Park so I'll turn it over thank you madam mayor members of the council Brian McCann Allen on behalf of the National atomic testing museum and the foundation we are so excited about this opportunity to relocate downtown or to be part of the museum corridor if you will and to bring culture and another a cultural amenity to the city of Las Vegas we think that this is a phenomenal opportunity for the museum which has been located as mr. orange said at the DRI campus adjacent to UNLV for 15 years and this gives us an opportunity to tell our story in a different way to expand in an area in which we previously the DRI building is is one that we really cannot expand in currently and there will be other opportunities and amenities that we'll be able to bring to a new site that will certainly help the museum that being said we enjoy a fantastic relationship with DRI and and she and and have for the past 15 years we also have a partner in the US Department of Energy and those relationships will continue as we relocate downtown with me in the audience is Chris key and [Music] James who is also assisting and helping the museum as we go forward we have many of them using and board members watching and actively excited about this opportunity we you know for reasons of kovat 19 just chose to have me kind of come down and present today you know we briefed all of you individually and we'll continue to do so as we move through this next six months process and develop our fundraising plan as well as determine what we need to with regard to the site and come up with tactical plans going forward after that I can't impress upon you how much we are interested in continuing to tell the story in the history of Las Vegas and and being adjacent to the railroad which is really how Las Vegas as we celebrate 115 anniversary of the city is a part of that history and we're excited to be right beside that we believe we as well as Boulder Dam and Hoover Dam were a part of really growing Las Vegas and and bringing the face of a new Las Vegas as we did in the 50s with atomic testing that took place out at the site it's one of these situations where it is hard to find people who have been connected to Las Vegas and certainly in Las Vegas natives that had you know it's it's hard to find people that don't have a personal story related to the test site and it's exciting to be a part of pulling all that together and again really bringing a new phase of history telling our story not only as a city in a state but the national story a couple points of data points for you as well as we are a Smithsonian affiliate and and we'll plan on expanding that relationship in our new location we've also been designated as one of a few national museums as an act of Congress in 2012 we received that designation so we again we are excited to be a partner with the city in developing this museum and look forward to our new home at Symphony Park and I did hear mister aren't ask mr. maconel and about funding and were you not granted something by the legislature yes mayor again Brian Mac and Ellen we received a million dollar matching appropriation grant in the last legislative session and we are executing on that in our preliminary fundraising and enjoy strong support from the state legislature let me also echo and and provide you with a statement on support that we enjoy from our delegation it is both bipartisan and every member of the delegation is excited about the opportunity and very actively engaged in helping us secure some federal support for that as well so we at the museum are excited about the aspects that we will then be partnering with you the city as well as the state and the federal government so it's it's really a good partnership and of course we'll be working on philanthropy directly from individual donors as well as foundation members and using opportunities that the city also has hopefully using opportunities and tools that the city has within its purview as well such as new market tax credits and we are in an opportunity zone so we're exploring those opportunities as well well it's really exciting I know it's something we've been pursuing since before 2012 when we got the national or you know the atomic testing got that national designation but it really does complete the historical collection because we have the Neon Museum the law enforcement mob museum obviously our Natural History Museum but to have the atomic testing National atomic testing and in walking distance of the hotels downtown but more importantly about the rest of the history because the core of history is right here in the heart of our city as well as the government so I'm really excited about it and your board has been phenomenal and certainly for those of you who may be watching on television we just hope it all comes to be certainly hope that the federal government realizes how important this is for the historical value of the entire country and not only that but for the world as well so any questions come in from councilman Graham thank you I just want to say that very excited about this and as a member of the Board of Regents for a while spent a lot of time over a DRI and int atomic testing museum and seeing what a asset it has been to our community I remember when it was actually when that building was built growing up here and actually when the museum went in so I think it's gonna be a great asset to the community and as the mayor said I always say that we're the cultural epicenter of the city and this just completely rounds it out and it'd be a great attribute to Pacific Park and to downtown Mouse Las Vegas so I wish you all the best on the next steps and I'm not sure there's any other comment nope yes yes Pro Tem thank you so much I just want to personally tell you mr. Mackall I miss you the city misses you so thank you thank you thank you thank you you know the educational advantage that's being provided to all the students all the university the count of the College of Southern Nevada every everybody it's such an exciting opportunity I know your museum has to be close because they're all closed because of the code 19 but hopefully if you haven't been there in recent times that you will open again on sight while we're in this planning correct yes mayor again Brian McCann Allen on behalf of the museum and the foundation it is our hope that we will be part of Phase two and open at the beginning of June there is a concern I think from all museums and that as as they've talked about a Phase two opening they've talked about attractions and arcades and other other amenities and entities that have a significant amount of people in a traditionally in a closer proximity museums have not been spelled out but we are aware that our sister museums the mob museum the Neon Museum and the Natural History Museum all have opening plans similar to ours and we are preparing for that right now I'll be it you know downsizing the way in which we normally do this we hope to have the reservation opportunities which which we kind of do now for tours but a reservation opportunity where you can reserve a spot and be on a guided tour through the museum I also want to thank DRI and n she for constantly providing the opportunity and the Sanitation and following the guideline the CDC guidelines and the state requirements and they've done a tremendous job with that and will continue that as we Rio and open our doors it has been you know very difficult for us as it has been for other museums that are really reliant on our members coming in to see the museum and admissions and new admissions so it you know like other businesses in the community we have been hit hard with you know having people come in the door and enjoy the amenities and that's an important part of being the museum if I could also comment on your your comment about the community and the education aspects to the museum not only are we an education amenity and and tourism destination we we realize a lot of international visitors and national visitors that come and stay on the strip and come to our Museum and have heard about it in advance but also have heard about it once they're here so we look forward to bringing some of those folks that may not always come downtown but to bring them downtown with purpose and a tent and hopefully being able to enjoy other amenities downtown we have a tremendous relationship with Clark County School District and provide a number throughout the whole year a number of students that come for field trips at various ages of course right now field trips have been suspended and we believe suspended through the end of the calendar year but we hope that that that will be a part of helping CCSD in another way I know my daughter for the first time you know I brought her down to the museum before but she went in in a field trip this year and it was exciting to see her class engage in that effort so we will be modifying how we provide field trips going forward but the other aspect of Symphony Park that I'd like to point out is you have two cultural entities that do field trips on a regular basis the Children's Discovery Museum as well as the Smith Center so it will be a good and natural opportunity for the buses and you know the offloading and pick up in Symphony Park that has already worked out and addressed so I think that that is another opportunity for us that will be not disruptive to the community there at Symphony Park and one in which is already functioning and a high degree of success well thank you so much for your presentation mr. aren't as well and I'm gonna turn this over to you can also mine career since five thank you thank you there's a motion to approve agenda item number 27 please vote and please post and that motion carries it's very exciting I remember who at that point you were with us in the city mr. Mack and Alan who was the gentleman we visited that says the National designation was right there in 2012 or whenever that was what was that gentleman's name do you remember no mayor I'm Brian McDonald and again on behalf the museum and the foundation I can't exactly remember who it is but but I'd like to tip our hat to United States Senate former United States Senate Majority Leader Harry Reid who helped carry that national designation through the US Senate and the US House and we really appreciate and enjoy that that special designation as I mentioned the relationship with the Smithsonian Museum I also would like to point out that we have the mulaskey company with us here and and Richard Worthington and some of his staff they will be helping us as we build the museum and we look forward to that relationship and that partnership and tremendously excited about that that relationship and their support of the museum as we are a we believe a legacy in Nevada that is a company that also has really provided a legacy in this in this region as well and we look forward to that relationship the motion passed thank you very much thanks for coming down we appreciate it thank you yes please thank you very much where are you mr. the review of an selection from various processes for the recruitment of a city attorney including possible authorization to the acting human resources director to execute a contract with an executive search firm not to exceed $50,000 from the general fund there you see when you came up I mean believe me we are all into doing exactly what the governor has asked us to do you have yours we all have ours we carry them but it's hard to look at who you are through your wonderful mass so thank you very much mr. s'more but please announce yourselves go ahead good morning mayor councilmembers for the record Vince Zamora Acting Director of Human Resources the item before you today is to discuss the recruitment options available to you for the upcoming city attorney vacancy and to ultimately provide that direction on how you would like to proceed it is important to note that we do have want to assure that all candidates are qualified and that they meet the eligibility requirements of the job description so with that said the options for you to consider are an internal promotional process where we post the position internally which allows for the only city employees to apply an open competitive process which allows for city employees and external applicants to imply or we engage a search firm to conduct a regional and/or a national search and with that said I'm open to your questions I would like to ask when you said obviously open internal yz1 open internally but when you said more broadly yes is that only within the city within the state we would post it on our website open all candidates that would be perusing our website and or looking for other job opportunities with the city okay thank you were you adding something okay so any comments Mayor Pro 1000 yes councilman Gleason I'm asking you I can't hear you went with your mass so I'm sorry put it back up okay Thank You mayor pro-tem thank you madam mayor depending upon the comments I would like to move to go with item agenda one where we choose internally the option one option one is that in the form of motion anybody did you want to add something yes please I concur all right there's a motion to do the entire process from internally so please vote and aamir just as a side with that process you would be for performing an interview process with the internal candidates to go ahead and vet them and assure that HR has the appropriate applications and that they meet all of the qualifications of the job description okay well there's a motion on the floor which everyone is voting upon all right would be the timeline on all of this when would it open when would it closed and then what is the timeline for getting through the process with with your approval today we can have it posted very quickly then today tomorrow and we can have it we typically have internal opportunities available for five days and there shortly thereafter we would be able to provide counsel with the candidates who have applied for the position yes point of clarification if we decide to go with item 1 which is to look at internal candidates which i think is the right thing to do you mentioned that we would be obligated to interview everyone I just want to be to be clear because if there is a candidate that sent out and the council decides that they would like to move forward with that candidate I don't want I would want it to be obligated to go through a reflection airy process that is gonna have if it's if it's the council's desire to go ahead and approve a candidate and have them appointed and placed on the agenda for ratification we would follow the direction of the counts okay so as part of the motion to bring this back to the next city council meeting point I would like that to be part of the motion so because time is of essence so can that be part of the motion yes okay now one more question sorry part of this with the resignation of the our city attorney would this then take effect immediately upon some decision from the council or would it wait for the end of the fiscal year to take office July 1 you can have the ability to have a dual fill to consider transition of the of the duties with mister gerbic where you could go ahead and have an effective on the date of his his retirement okay so that's another option at that time okay would you post it's still circling it's not posting okay it did pass unanimously thank you very much thank you thank you okay we'll move on now to resolutions agenda item 29 r22 - OH - Oh discussion for possible action regarding a resolution approving ratifying actions authorized by the city manager regarding business license fees business license status landing status sewer fees special Improvement District liens and economic and urban development agreements for commercial business tenants this has to do with all wards good morning good morning Scott Allen city manager what I'm going to read from some notes because I want to make sure that everything that that I've done over this period of emergency is is read into the record for your ratification because what this items does is approves of resolution approving and ratifying actions authorized by the city manager regarding business license fees business license status land you status sewer fees special Improvement District liens and economic and urban development agreements for commercial business tennis so there's a lot covered under this resolution and I I think part of why I want to read this is to make sure we cover everything that that I've done in terms of taking that action for ratification by you but also to communicate to our public especially those businesses how these matters are being handled going forward I think it's as much important for them to understand how we're gonna be handling these items as it is for you to ratify and excuse me but will you in fact then have it posted on our website so the clarity of what you're going to be sharing with us is there we don't we make sure it's we certainly can do that so that it's everybody understands what's happening so let me just read this statement at my direction multiple departments have taken additional administrative actions since the council's April 15 resolution to continue the city's efforts to ease the financial burden faced by Las Vegas residents and businesses during the code 19 emergency most of these actions have already been communicated publicly by the city but they now could come before the City Council with a resolution to approve and ratify several new actions and to reiterate ongoing efforts by various city departments first under business license fees and status businesses that have not yet paid their license renewal fees continue to have a grace period to pay without penalty essential businesses that had their license fees due in March April or May can pay their renewal fees on June 1st 2020 non-essential businesses that have their license fees due in March April May or coming up on June 1st can pay their renewal fees on July 1st 2020 and marijuana establishments will have their renewal fees due on July 1st as previously scheduled under land you status the Department of Planning continues to toll the date in which a use has ceased to operate until the day after the state of emergency has been lifted by the state of Nevada this policy will allow landowners and applicants to preserve land use rights without being penalized by the impact of the Cova 19 emergency resort hotels in response to licensure concerns the Planning Department received from the resort hotel industry the planning department is working with resort hotels in the city to help them maintain their city privileged licenses during the mandatory kovin 19 closures as you know there's a lot of technical issues relative to maintaining non-restricted gaming and so we've been working with the industry on those days that would go all the way out to the Marriott former grandpa anything I'm Boulder Highway anything in downtown any hotel right as defined under the statute no ordinance so we're gonna be working with those those properties on maintaining that their status sewer fees late fees penalties and liens will continue not to be assessed on sewer billing if the count is past due from March 16 through 30 days following the mayor's declaration of an end to the Cova 19 emergency may I ask you there those very hotels that now are shut do they have the same grace from us on these sewer bills it would be all of our sewer customers as I understand it Cervantes yes the hotels would enjoy the same and mr. dorker of course mayor jeff deputy city attorney i believe that's correct because everyone's billed through finance but don't hold me to it but i'm sure they're working with them either way to make sure that they are relieved if not given the full deferral and aside from this is anybody notifying them please I'm sure we are can we notify them please for the record I want this yes mayor we can notified we've been relying more on those folks that have the need for that to let us know that they've lost a job whatever the situation is till we can work with them but we can certainly do a notification well and to if you wouldn't mind I know that many of the hotels have other hotels that are not within the city confines but for the clarity of knowing that your hotel within the city confines can enjoy this respite and but we are not speaking for any of the hotels outside the city of Las Vegas right member we can do as part of our bill and we can put a notification in the envelope thank you well we be clear on the sufis we're simply deferring right now waving I could envision that a customer we may want to just pay it and not have it continue to build up as an obligation going forward right it would be up to them as to how they want us to handle that thank you special Improvement District lien sales to assist homeowners and the development community the Department of Finance has delayed the July lien sale until September 2024 special Improvement Districts the Department of Finance also elected to reduce any associated penalty from 2% to 0% during that same period so similar situation we're simply deferring so that that won't be imposing go and go to a lien sale immediately okay one more question sorry but heavily into this all of us when it comes time that the payments are due what is the process especially for an individual on any of these fees now we have compounded them now there's a very large number and they've been out of work or closed what is access to a conversation Jorge Cervantes mayor the intent is to allow him up to 12 months to make the payment with its full payment or overtime but up to 12 months I would know that we have such a good team here that you've already thought through that thank you yes weird well these are this has been there was only meetings a lot of hours of thinking through how we can handle all of our customers and then finally economic and Urban Development commercial tenant agreements finally the Department of Economic and Urban Development waived April rent payments for 17 commercial tenants located in office in retail locations operated by the city including city hall straight West High School and the Bank of America building well there were situations where they just flat couldn't make the payments and we've waived those payments so that that is a waiver we're doing everything we can to help our business community with that I begun preparing for the day when its operations can safely resume employees can return to work and our members can once again generate much-needed economic activity and tax revenue vital to the business community's recovery is flexibility and consistency from local governments through the phased in reopening process resolution our - 22 - 2020 provides relief to businesses and individuals impacted by the Cova 19 virus by waiving or deferring certain penalties and requirements the flexibility outlined in this resolution allows resort operators to gradually reopen amenities when permitted and demand returns without these waivers resorts would be faced with a difficult business decision of either having to open all of their operations or remain completely closed to be in compliance rather than be guided by safety and what makes economic sense this measure also protects licensees by preserving their license and entitlement status no business should be in jeopardy of losing their license as a result of community wide circumstances beyond their control the resolution also provides for consistency across all the local jurisdictions in Southern Nevada this action will prevent other local entities that allow a phased in reopening approach from having a competitive and attracting gaming business away from the city of Las Vegas we ask that you adopt resolution R Calus that's what we talked about on the phone is that comfortable for you still good yes madam mayor with mr. summers bill said that would be my motion have a question yes thank you you know I trust the judgment of councilman Knutson but I have a couple of questions for you this carport did you personally build this our did you hire a company to build this and the company did not to say to you that you needed a a permit in order to build this because our court this carport is huge yeah this is like a in my well number of years of going to this this is probably the biggest carport that I've seen on the front of a house that I have encountered people have built stuff but this this is huge and I kind of find it hard to believe that you built a structure this large and did not think that you had to have some type of permit in place I was told that it was not attached to the house I did not need a permit it's a free-standing carport that covers the whole driveway it's a three-car driveway if it's yeah and in mr. Sommerfeld what does it mean when you say that like they're gonna work with business licensing if this are we approving the structure now like he's gonna go back and go to business licensing to do what because it's it's it's an illegal structure now I understand what is it that he's going to get approval madam mayor three years so councilman he won't go to licensing he'll go to building and safety with this approval today you are proving that a structure meeting the setback requirements in these height this height above the principal house that you're approving that something like this can be there he will have to go through the permitting process and actually satisfy the Building and Safety Department that this building is permissible and therefore meets all safety requirements of our Building Code if for some reason they have any changes that he has to make in order to make this structure conform to the building code he'll have to make those those changes in order to satisfy the building official well nobody changes like for when there could be things for wind it looks like there's some kind of screening on the side depending on how if that contributes to any wind shear issues the the type of material construction they'll be looking at all of those issues as a part of the permitting process to verify that the footings if there are footings are sound in order to keep this from blowing away potentially or damaging any other portion of his property or his neighbor's property thank you and you're an agreement with everything mr. behalf of the applicant if I could direct your attention to the overhead I will show you where this site is located this is an interesting piece of property that's split by Gowan road but we're proposing the project beyond both the north side and the south side of Gowen Road and Durango Drive it's about 3.6 acres so it's pretty small and on both sides of the property currently it is zoned for office you can see Pio is on the zoning map however it's completely surrounded by residential there's residential our PD 10 and our PD 12 to the south and then our CL along the the sides both to the north and the east immediately across the street to the West is the YMCA just to orient you as to where this property is before I get into the details I should note that at the neighborhood meeting the first thing that the neighbors that attended that meeting said was they were very happy to hear it was going back to hopefully residential as opposed to office they were apparently opposed to the office when that was approved and so they were happy to hear not only would it be residential but we were proposing for sale townhomes I think there's some misinformation and some of the opposition cards that said apartments this is not an apartment project we are proposing for sale townhomes on this project we appreciate your staff and your Public Works Department working with us originally we had asked for our three zoning and we reduced to that request to residential townhomes again to fit within the intent of what we're doing with the townhomes and we appreciate them working with us on that this is the site plan the revised site plan we had 64 units originally we now have 58 units and you can see both entry points have been pushed as far to the east as possible again because gallon and Durango we understand is is a fairly busy intersection and so both entry points will be heat located here there are open spaces at the very entry of both communities that will be governed by one HOA however both areas will be amenitized separately so that the residents on the south or the north side can utilize the amenities on their side but they can certainly cross the street or drive across the street to use the amenities on the other side as well right now they're proposing a pool and a clubhouse one on each side because the sites are constrained we have proposed stub streets that we've worked with the fire department or I should say the engineer has worked with the fire department on and we've provided emergency access through these common elements on to Durango so my understanding is fire is comfortable with this proposal the reason because these are such small parcels it's difficult to do full Cultus acts on these properties so we'd appreciate the layout the way it currently is proposed also we have a small reduction in the connectivity ratio again not simply because this is a small site otherwise we would be able to meet that and and obviously there's major dedication for both Gowen and Durango on the property the overall the product type I'd like to show you is a really good looking product type and I think a demand is out there for for sale townhomes like this they're limited to 35 feet in height however they all have two-car garages on the first level so from a parking standpoint we meet all the parking requirements and each unit will have their own garage with two two-car garages then the second and third floor are the living spaces with good sized units from 1,200 up to 1,800 square feet so this will be a nice niche market I think for the area and for the overall valley right now considering we're at to have some price points that are attainable for folks to buy product in this area so we think the change is down to the 58 units makes for a very good product on this site we'd very much appreciate the Council's approval on this and I'm happy to answer any questions that you may have any age restriction of these senior are these children welcome animals Oh welcome and there'll be amenities there so if there are children there's a amenities right on the property for them because obviously townhomes are attached and so they'll need some space to play and there's plenty of room on both sides many bus stops RTC going up and down Durango yes I'm glad you mentioned that thank you for for reminding me we we did work with public works and I know Lucian has a revised condition for a bus stop that will be on this northern parcel on Durango Drive it's it's a tight area so public works was great working with us on the specific dimensions of that and all that Lucien read that conditional in the directive does that pull-out area I know that the city we've worked so hard to try and get private ownership of land to donate the land for the pull out of the bus because it's much safer yes is that an occurrence here or at this point not yes there'll be a small area right here for a bus turnout and a easement for with RTC any comments from Council this is mister Sommerfeld first then thank you madam mayor so staff finds that the requested allowable density under this general plan amendment request is too intense for the surrounding area and therefore has had to recommend denial of the gen and the zone change as well as the subsequent variance intended about if approved as mentioned public works does have a condition that they'd like to amend on the tentative map that condition is not condition number seven they would like that to read that prior to the issuance of permits for this site grant a forty foot by 10 foot bus shelter pad easement to the Regional Transportation Commission RTC unless otherwise allowed by the city traffic engineer and I just want to clarify for the record so in speaking to mr. Pyatt who's also available for any question they what they've worked out with public works in the applicant is not for a turnout but for a bus pad easement so that the shelter will be on technically on their property but there won't be an actual pull out it'll still be a bus stop but they'll have enough room to put a shelter and so with that if mr. Pyatt wants to add anything else I'm sure to you I mean madam mayor so this is bus shelter Pez a larger than normal pad and it's pushed further back because we don't have a plot in this case normally your your bus shelter pet is just a five foot pad and this is a 10 foot pad 10 foot wide so that the bus shelters farther away from the street and mr. Pyatt is the is that that's two lanes going north two lanes going south well currently that's what it is today but we actually have three lanes on Durango it's a hundred foot right away and the reason we thought we could do the shelter only is because of the projected volumes on Durango in this area I know it's really I mean prior took over 19 issues and the reduction in traffic it's a very and this will help increase traffic on that street so when buses do pull out you're comfortable that what you've resolved just the seating capacity and the shelter is sufficient yes actually today there isn't a route there today and so we're more planning for the future that there will be a bus route under ingo well we are comfortable the with with the volume of traffic under and having three lanes that there'll be enough that the this is far set of the signal and that a bus will build a stop safely on the far side of the signal okay thank you because I know with councilman Anthony and whose Ward this is he and I sit on the RTC and that's something we're always looking for is to keep the passengers and those ridership people very very safe and turnout seems to be the best alternative but on the southeast corner of Charleston and west wind about two and a half acres total it's an existing retail center the 6,500 square foot tavern Tap House which is a bit of an institution in the neighborhood will remain however the out day l-shaped single-story retail building will be demolished the existing buildings about ninety six hundred square feet will be replaced with the ten thousand ten square foot single tenant retail building so similar intensity of use on this site we are asking for a rezone of this corner parcel from you undeveloped to c1 to match up with the rest of the site we're seeking several variances first having to do with the residential adjacency the commercial use adjacent to a residential use I would note that it is an improvement to the existing adjacency residential adjacency and we've spoken with the neighbors they're supportive of the project as are many of the commercial and residential neighbors in the in the area and yes both the commercial adjacency and the dumpsters are an improvement to what's existing in the planning commission process we did work with Commissioner Rogan and committed to putting 36-inch boxed trees on this southern wall where initially had proposed 24-inch Box trees that would just sort of help compensate for any concerns on that residential adjacency we're also seeking of variance we're actually going to be providing 75 parking spaces where 128 are required in our estimation these smaller retail centers under 25,000 square feet have a may be an overly ambitious parking requirement once they eclipse 25,000 square feet at that ratio goes down quite a bit using that ratio were actually adequately parked and we managed lots of park lot lots of similar retail centers in this valley and we're quite certain that 75 parking spaces is sufficient for a 6,500 square foot tenant in a 10,000 square foot single tenant retail store there's two sort of outstanding items one is regarding the south wall here and the in this process staff has pointed out that it is a non-compliant wall at some point in the past it was added on to so we will be coming forward with a subsequent variance to deal with that adjacent wall we don't want to tear it down as staff has requested because this resident to the South actually has a garage right into it so now tearing it down becomes very impactful to our neighbor to the south and we don't want to do all that so we will be coming forward with a subsequent variance and then the last outstanding item is that of the bus turnout and deceleration lando to know you guys are dealing with a lot these days staff has requested we put one in here our issue with that is it's it's not long enough for a code compliant bus deceleration and turn in Lane it's very costly for these sort of infill projects that are really difficult at the end of the day you know we're gonna have to move the underground infrastructure the street lights and everything else and we're not even going to end up with a compliant bus turn in deceleration lane however we have had a lot of back-and-forth with staff and might I add that you know through WebEx and everything else we haven't missed a beat so kudos to your staff to for pressing through and he's on unchartered times and we did come up with a compromise to dedicate the land for the bus turning and deceleration without the requirement to construct so I believe Lucian has an amended condition number 17 that he may be able to acknowledge and read into the record okay so we'll wait to hear from that but otherwise we think this is a great redevelopment project it's been well received in the neighborhood we think it'll bring some new life to this corridor and lovely Ward one and with that we respectfully request your vote for approval okay thank you madam mayor staff is in support of the proposed rezoning as it will bring this portion of the site into alignment with its current general plan designation staff supports the idea of redevelopment of the subject site as it will continue to fulfill goals of the redevelopment plan such as retaining existing businesses by means of redevelopment and rehabilitation activities and develop an area that has been stagnant however staff finds that the proposed development does not fulfill the overall goals of the redevelopment plan to achieve an environment that is reflective of a high quality architectural landscape in urban design and continues to promote a pattern of stand-alone single tenant stores fronted by parking lots adjacent to rights-of-way the development style tends to lead to deterioration over time as as we've seen in many of these strip type developments and is not a part of the overall vision for the city's redevelopment area or the work that's been going on with the master plan in title 19 therefore staff has recommended denial of both the variances and the site development review has indicated there is a if approved condition change that Public Works has worked out with the applicant so on the site development review conditions 7 we were proposing would read concurrent with I'm sorry 17 seven was the last one 17 this time 17 concurrent with development dedicate a bus turnout and deceleration lane meeting the intent of clark county standard drawing number to 34.4 for the existing bus stop on charleston boulevard unless otherwise allowed by the city traffic engineer and i would just note for the record unfortunately that wall that borders the south side of this property that is property the that connection is not the city so we do not have an understanding of how they were able to build their garage into the perimeter wall so there may be some additional things that we'll have to work with the applicant on related to how that southern wall will be addressed in the future because there are some there consumers concerns there with whether that was somehow permitted even but that's outside of our jurisdiction with what the southern property owner did thank you question on the wall what year was that him put up again unfortunately we don't know we do know it's an older wall as the applicant has indicated it's been there for a while it's at the county border that's a county property so we don't know we haven't been able to find out what building permits they may have received in order to do that we really don't understand how they were able to build the garage into the perimeter wall without any kind of setback the property line there so there's a lot of open questions about whether that wall can remain and if it can remain is there perimeter wall the applicants perimeter wall versus the applicant needing to put in a perimeter wall at that south side of the property and then let that neighboring property owner deal with whatever issues that may exist with the existing wall do you in fact in examining the wall does somebody send engineers out to make sure that the rebar and the footings were adequately put because in that area in that neighborhood we've seen walls collapse over a period of time with heavy rains and in fact some with fatality so I'm very concerned about that wall the year was put in and what type of footings or rebar or whatever is in there and that somebody should really examine it so madam mayor that would be one of the questions maybe the applicant in their due diligence process on the their acquisition unfortunately the wall looks like it's on the applicants property I don't know if they've done any surveying to verify if they actually own the wall or if the wall belongs to the neighbor I do know their concern with the fact that the wall has been built up to by the neighbor and not wanting to disrupt that neighbor's neighbor's property the staff has only done a visual look at the wall so we don't have any information about its structural integrity when it was built did it have permits when it was built what its footings look like or any of that information that this and this this alley is on an easement I gather this is the service area behind the existing building that we're looking at right now belonging to to the subject property okay I was just knowing and having been here many years I would add that to questions as you go forward because safety of our people is the most important piece I space that then we have an additional parking as well one additional so onderful how many total units 16 once it reduced it to 14 14 and now we have 15 parking spaces okay and these are rentals not 12 - 124 requests they quote waiver to allow 10 Perkins boss spaces were 28 are required the proposed parking provided by the applicant represents 36% of the city's codified regulations the primary reason for my opposition is that the applicants property was has insufficient parking the property Everett I represent was built in 1932 and we have been the sole owner it is located about a hundred yards southwest of the applicants property and provides 62 parking spaces for the patrons of our family history library as well as others who have dealings here with the applicants lack of parking I of course see an increase in unauthorized parking and the applicant shifting their parking problem to this property in the past we had issues with unauthorized parking at our facility which reduced allow both spaces for our patrons it required posting several signs vigilance and enforcement and a lot of patients and threats to tow cars to rectify the problem it was a problem because the typical family history Patriot is a more senior person and we want to do what we can to they have parking available and that it is closer rather than farther away finally I spoke with the Planning Commission hearing expressing my opposition the Planning Commission recommended that the applicant reach out to the neighbors to search for resolutions I have yet to receive a request to meet to discuss alternatives with the applicants lack of effort to seek a solution I ask that you sustain the Planning Commission's seven to zero vote to deny the waiver thank you again for consideration my person who just submitted their opposition to the project that Commissioner schlattman was very clear in saying that there needed to be some community outreach a neighborhood meeting or two held there's residents from my ward that also feel this lack of parking would detrimental impact the area we have the Las Vegas high school and the vicinity there's other factors to consider about drop-off pickup and all the day-to-day activity that happens off of 10th Street and he even said make sure you contact the council woman's office and from that meeting - now I never heard from anybody representing this project so I think there's still some more homework we need to do on this we still need to go to the community and see what's workable what's Amina below the best outcome is so with that I'm going to request to hold this item in a bay so that we can work through the the discrepancies and the potential impact of having fewer parking spaces than needed well I'd like to comment to that council and I'm not sure they're theirs it must be a disconnect because I did reach out to your office's last week in an email and I have not received any information from that so we we've tried as much as we can we reached out to to your office and it's here anything we've increased the parking 50% from 10 to 15 so I'm not sure what what else we can do I mean certainly we've we've come trying to make this thing the best project we can I know but just hearing about those changes here on the spot and I will check in with my team to see about that know that we are receiving your calls directly to our cell phones we forwarded the portal that you have reaching out to the office that's what I've been reaching out to your office with I haven't received any information back so I don't know what else we could have done in the last two weeks since we got the approval from the staff we just wanted to reach out to your office if you have any questions but we didn't hear anything so we just assumed that there was no question since we had staff approval we've reduced the amount of intensity from 16 to 14 units and increase the 50% of parking it's all on site the the amount of traffic give a date okay okay so I'd like to if I if I might just so that I can understand so if you want a formal neighborhood meeting then I'm going to request that you hold us at least until June 17th if not July 8th so that there's adequate time for proper noticing and what-have-you if you're going to do something a little more informal than that might be able to be done more timely but I don't know that you have enough time between now and next council meeting to to do even an informal so I would just ask you that at least June 17th if you want a formal neighborhood meeting well I'd like to ask - what because I I understand what you're saying or what counts woman saying obviously because we've been under the quarantine and everybody's operating remotely that is obviously put possible possibly some issues what does delaying the project specifically due to your ownership and moving the project forward the only difference would be is that we're the plans are ready we're ready to submit to the city so architectures done structural is done when we the developer really wants to get this project started quickly that's the only difference we don't you know I've been in town in my whole life we've represented many clients and you know the most important thing for us is to get everybody on board and I feel that this project as it sits right here is totally within the bounds of what we set out to do it's a it's a older property this is being rehabbed it's gonna look great it's gonna have a nice elevation to it we've increased the number of parking spaces so I'm not quite sure the neighborhood meeting the what kind of concerns with their beads it's one unit this is what they wanted one unit per space so I'm not sure and we have an additional space on site so I'm not sure what else the community would want to see from this this is not this is a conforming zone change of zone change just as you spurt I ask you sir did you in fact have community I know it was difficult because we're all limited to six feet and having communities gather together did you have any neighborhood meetings no since it was not required of us to do so I got no response I mean staff said specifically that we weren't required to have a neighborhood meeting McCarthy let me find out about that if I might is that unusual was that unusual recommendation that they didn't need a neighborhood so again this is a site development review so a neighborhood meeting is not a mandatory requirement however in typical fashion when an item that has some contention to it particularly contention with the neighbors it is indefinitely in the purview of the Planning Commission to request a neighborhood meeting be conducted prior to the item coming back to City Council and that's usually at the applicants responsibility to hold hold that meeting before it comes back to City Council as the Councilwoman has indicated that was a part there was a number of things that because they knew that it was coming forward to City Council that the planning Commissioner for Ward 3 requested that the applicant do and have some additional conversations I don't know if he's specific I cannot recall he said specifically have a neighborhood meeting or if it was work with the neighbors to talk about a parking solution the applicant revised the plans and addressed the parking issue that staff had which is why you've seen an update to the staff recommendation well and perhaps I mean the letter that came to our city clerk that had to have come from something so did that come out of response to Planning Commission or did it just come out because in its agendized I believe the property owner that submitted the the information that the city clerk read was present at the Planning Commission and also raised similar objections and concerns to any project that wouldn't have sufficient parking because they they worried that they've had past parking issues with other other properties that didn't provide sufficient parking resources counsel that was at a larger number now that reduced the Fort correct so this project is you're absolutely correct mayor so at Planning Commission this project was requesting to have only ten spaces where 28 was required they have subsequently reduced the number of units which is to reduce the number of required spaces down to 24 and they've increased parking up to 15 spaces so that we're meeting at least one these are not big units so they are meeting at least one parking space per unit and then they do have a guest space that it will be available so again those are the thought processes that went into staffs recommendation change on this from a denial at Planning Commission to an approval here at City Council units we're on the board at the time it was in front of planning at the time that it was at Planning Commission there were 16 units and in the revised plans you have before you today there are 14 units okay and so that all figured into why you approved why we made a change in our recommendation from denial to approval okay and the only gentleman that was there at planning there was just one there weren't several from the neighborhood that I can't quote on I do remember almost verbatim but the city clerk read that that was a part of that gentleman's testimony I do not remember though if there were any other members of the community that spoke or submitted anything on this item at that meeting so that since the council woman's actually reviewed that most recently I would look to her madam clerk please um thank you LuAnn home city clerk for the record along with the item that we read earlier which was from Ronald Welch there's a CC on that agenda item - Kenneth Lynn Openshaw and it looks like his addresses from the familysearch.org organization and we just received from John Pratt so a protest to item 31 that says I agree with the Family Research Center regarding parking and more neighborhood outreach okay okay any comment thank you madam mayor so my concern again is you know as we go through this shutdown and when we have opportunities like the one that you're proposing and if we pass them up it could be the last time we have the opportunity because people can walk away because of this shutdown the future is not certain so we're in on certain times so I'm I'm in support of his project and I think I knowing your feelings about what we're looking to but probably while I think the project sounds absolutely terrific but listening to another neighborhood is there any way Councilwoman which might work that we don't have to wait till late July or August and deference to what he's trying to do can you find a that will work for you to have the meetings but that will help him not have to wait so long so madam mayor my proposal is to get my office involved to hold the neighborhood meeting and hold the item in abeyance for 30 days so that we have at least that follow-through from my planning Commissioner to there and so that I can receive also the courtesy of reviewing and seeing the quality of the product that's coming into my ward I haven't even received that privilege no one's come no one I mean an email was sent but you know sometimes were bombarded a call would have been nice and in addition to that email and there was neighborhood leaders like Melissa Clary who were also iterating their opposition to to this effort so I just want to do my due diligence I'm about making sure that we share the information and they're all on the same page moving forward and and sir if I may assure you I mean I think the project sounds fine but the neighborhood and what Councilwoman wishes we have had a very skeletal crew here and while you're working and getting a moment-by-moment conversation going with council with planning we were very skeleton even though council some council persons were working from home they're always presents glitches in that it was very unusual for all of us to be in the situation we are and so because of what you had said 30 days is I mean I think it's really important you have the support of the neighborhood both mayor pro-tem and I love the project think it's great but you really do need a wonderful neighborhood support and 30 days in this environment with over 19 restrictions specific meeting how is it taking place I mean where is it is it how is it notified do we have to pay for a notification or is it so we work with the war3 office on exactly how will work that we are doing neighborhood meetings here at City Hall can you control the facility and so I would expect that we'll be doing that right here at City Hall for the neighborhood meeting will were called on how the Councilwoman would like to move forward with the notification so my only encouragement to you is obviously it's been a very unusual time and because we've been trying to be do our due diligence as far as complying with the state mandates some have been working more at home some of us have been here and so a meeting we've been doing it Councilwoman may want to have a different location but we've opened up these chambers because we can accommodate the distance separation and all the amenities that we need to follow so if 30 days only because to me that seems like a reasonable time but I must say council there and I are very encouraged by the fact we want to give every council person the the right to hear this and obviously there's been a problem with the communication and we want this to be heard by everybody we want the full approval obviously we feel that it's a great project we've been working with staff and we want to get the opportunity and I think 30 days would be it'd be just fine I think we just need to sit down talk about the project and look at mark lengths and we can move forward very quickly then I think that'd be fair enough okay so what's that date please June 17th okay so councilman Councilwoman make her motion madam mayor before she makes her motion I just want to understand something there has been two people in opposition of this that have is that what I understood well that have been that we know have spoken out but we don't know in a meeting or anything like that we just know we have the letter and then we have the other communication that our clerk just read Matt okay so I will defer to the councilman but I hope that we can get this project moving as quick as possible because I concur with the Mayor Pro Tem and the mayor that we are in difficult times and we need and and I'm just excited about improving the community with this great project so thank you okay was there anything else madam Clerk because you were about to say something I saw it thank you madam mayor I just wanted to clarify for the Councilwoman we have five more opposition's that came in postcard form okay thank you just just to clarify those opposition's were made on the previous application or they on this current reduction of units that's too clear that what we want to put on the record Thank You Louanne home city clerk for the notification on this council item for today we got postcards but we don't know for sure if they've read this or why but I think the clarification given this month and the recommendation of councilman Diaz I think all that well you all know exactly what and who and I'm not sure these cards with these for this item because they don't have an item okay okay so back to you man so madam a all right just you know I want to make sure all of our Planning Commission's about commissioners voted it against it I need to go back to my planning Commissioner and go and that Reva and say hey you heard this the previous way what are your thoughts to and I haven't had that opportunity to have that conversation with my planning Commissioner either who was there through the previous reiteration I just think holding it in abeyance getting that community outreach part out and just making sure that we're all on the same page and they're we're all meeting each other's expectations this sound so with that I would move to hold this item in abeyance for the June 17 2020 very much okay let's move on to agenda item 62 a report from Scott the Adam City Manager on emerging issues good morning mayor members of City Council Scott Adams city manager my emerging issue report will focus on all the activities that we've been engaged in over the last eight well almost nine weeks now since we've been in a major shutdown I think I have continuously iterated throughout my reports that my focus has been on really three things keeping our employees safe keeping our citizens safe inand maintaining our essential services and functions over the last several weeks it's been focused on budget which you'll be hearing here very shortly to get us through our financial difficulties and reopening because now we have shifted as a city from full shutdown into now a reopening mode we are being very careful as we move forward to assess the state guidelines for reopening as we reopen our operations city operations and work with the community on reopening their operations our business community in particular I am pleased to say that our City Hall and ESC have reopened I say that with some reservation than that we've always been open but by appointment only we're now open by appointment and if a system comes in to City Hall they would need to contact our front desk and make arrangements for somebody in the building to meet with them both our employees and our citizens will be subject to a Kovan 19 screen as they come into over those two facilities of our answering a few questions and being subject to a temperature check we are recalling or calling back most of our employees as we open our operations as you know when we first shut down we had to classify our employees by essential and non-essential those that could report had to report to work could work for a moment and then on essential ploys that that were at home and really we had no work function for I expected in the next couple weeks everybody will be back to work either in their former capacity or reassigned to functions that we need to accommodate our reopening process it is a very detailed process and we have to be very deliberate to be sure that our facilities are modified our procedures are modified to meet up what is the new the new norm now in terms of standards let me just shift we have adopted a number of new things that I think are very creative we have allocated some of our care Zach funding that the city received to a business Assistance Program we've allocated four million dollars to that and that program is available to small businesses I believe it's three to twenty five employees that for pre opening or opening expenses related to having to conform to the new standards of reopening and those would be grants for up to four thousand dollars per business and there's already a fire sale on that literally in the last 24 hours we have had about 150 applications so I would expect at that rate of application those funds will be depleted probably in the next week or two so if you are in that realm of small business having those expenses please contact our economic and Urban Development Department or go line to the city's website where you will find the application process and application question on this mr. Adams and I know you've already thought it through but is that going to be taken in priority of when the individuals applied or is there an assessment and evaluation first-come first-serve as they come into our system we will take them in the order that they apply and we do repeat how they apply they apply by going online to their Las Vegas Nevada dot gov website on that website there is a form and a process by which you apply it is a very simple two-page form we will dispersed funding based on an estimate of expenses and we are issuing checks three times a week we have taken the bureaucracy out of the process I know it's sometimes hard for bureaucrats to not be bureaucrats but and this is one of those cases where we said no let's get the money out in the community and we will then work on some sampling basis on the back end on audit and verification but in this case we're trying to get it out to the businesses into the community second thing we've been doing is working with businesses on outdoor dining initially using our sidewalks downtown making those available for those in particular restaurants that may be small need additional dining area they can use the sidewalks out in front of their building as long as they maintain appropriate disability access through that sidewalk area we are looking at a couple that we've actually enacted in two districts the Arts District and Fremont East District the closure of portions of a right away a where we're going to be putting tables and chairs and umbrellas to have a common areas that the restaurants in those districts can use for additional seating so a guest could use curb-sider delivery purchase or takeout take their meal to one of those common seating areas and have their meal and those will be socially distanced but it'll be a festive fun environment we we hope that we make downtown Las Vegas the cool place to come to have dinner and be entertained but safely and and so and who mr. Adams whose expense are those tables and chairs we are gonna foot that bill using our coated night to our care Zach funding because that's an expense that we're having to accommodate that we'd not do otherwise that's unbudgeted that we can clearly track and relate to covin 19 and how about the movement in and out at night time so they're not I mean we're yeah that's where some of our staff teams will be reassigned they're gonna be men monitoring those areas to be sure folks are socially distanced and that in the evening that equipments all taken down stored and then we'll do the same bring it back out set it up in the morning there'll be open certain hours during the day and we're gonna monitor the use of it and if we have to keep it open later because we want to accommodate what we think are dinner hours for businesses we will but we're we're gonna launch this as a pilot program see how it works and we'll make adjustments as we go on and at the expense of the city not the and that's right you could kind of visualize it as think of a food court you might go to in the mall this is our downtown food court and where you go to your restaurant you give your food you go to the food court and you have dinner or or whatever it happens to be we're also going to work with and accommodate through our entitlement processes private shopping centers to do the same thing throughout the city that one's a little more difficult because it's on private property and it would take the consent of the property owner to do it but we're going to unhinge some of the regulations that might prevent a private property owner from doing that there they could for example cordon off parking spaces create a common area with seating and umbrellas and tables for the restaurants and their shopping center to do the same thing but it would take the cooperation of that private property owner to do that and this will go on from what date and what date well we would do this you know it's it's interesting because we're doing things during this crisis and during the emergency that I think could get legs afterwards so at this point the intent was for the duration of social distancing but who knows afterwards and we might find that we're creating trends new trends that the public likes and we might want to look at you adopting permanent exceptions to certain standards to allow to continue and are you in a position as the city representative then to make this happen starting Monday it's already happy it's our it's happening as we speak where again we're not we're just making it app the other thing that we're doing and I haven't spoken to you publicly is as you know we've talked to you about this in briefing we are we've been looking hard on our city facilities in our operations and how we can create a more efficient physical plant to accommodate all of our operations and something we're working on very quickly and aggressively is moving the development services Center function into City Hall and that's this is one of those we're one of the reasons we have employees coming through the front entrance of the building it's temporary we're making modifications to the first floor HR area and the hallway that normally our employees come through so that we can start to accommodate moving functions from the DSC that is on the services Center into City Hall ultimately we Co the entire DSC being in this building we would move some of our other operations into some of the other properties we own such that we could dispose of the Development Services Center and reduce the cost of operating our physical plant as a city that's a very big building it costs a lot to operate and so through this financial situation we're in it's kind of put a lot of pressure on evaluating all of our operations and is there a more efficient way to operate as a city and that's one of those things that we believe we can do that will save us a lot of money and actually create a more customer friendly environment so we envision that we would have a couple years from now City Hall the development services Center a new Municipal Court building all around a new Civic Plaza a park with appropriate parking in our parking garage at 595 Main so we have a complete Civic Plaza to serve our public in one location and then finally I want to remind our citizens and business community that we our call center is still operational it's one of the great moves I think we've made during this crisis by consolidating a lot of our customer facing functions into one operation which is in the form of parking services center space across the street in the ground floor of the garage that is a call center where you can actually go physically be there and be seen by someone or call in to and handle all types of business that the city you'd need to do with the city then phone number for that operation is 702 2 to 9 care CA re or 2 to 7 3 the number is 2 to 9 to 273 they will handle a lot of your business right over the phone whether its payments or otherwise or direct you directly to a person in the city to do business with so again we're trying to make it easy for our customers to do business with the city during this period that is definitely something we'll continue to maintain after after this emergency and crisis is over because it just makes sense provides better customers citizens and our customers so with that that is the end of my emerging issues report how about questions Councilwoman anyone councilman can also a woman yes please mr. Adams I just wanted to say that your team has been exceptional and it's talking through managers deputy directors directors I've made a lot of inquiries and a lot of requests over the last several months and everybody has been exceptional so I'm really grateful to you and everyone that works in this building because it's I think the city has been responding incredibly well to a very difficult situation so I'm very grateful to be part of the city thank you know it's exciting time for us as they see such a positive attitude and yet in compliance with everything that's been asked of us it's admirable but I know your staff has just spent hours and hours and looking at every penny and yet being compliant with the edicts that have been given to us and it's exciting just the innovation and the ideas and I compliment you all just really what a great group of people all with the same focus let's get back to where we were so thank you so much Scott ok so madam clerk now what am I to do I have a whole new piece here oh goodness I forgot 63 house shows up so sorry agenda item 63 report by mr. Ted Olivos chief of staff regarding an overview of past and pending federal legislation related to covet 19 pandemic this is in relation to all boards and congratulations don't you have two graduates in your family or is that next yeah no two freshmen in college they're back home and I think they'd be better off at college we're trying to figure out this new norm right - so many parents have their children home from college that really want to go back yeah good so I'm not alone so good morning mayor Goodman and council for the record Ted Olivas your chief of staff this morning I'm going to provide a brief overview of the federal legislation related to the Cova 19 pandemic it's probably a good prelude to the budget discussion that we're going to be having after this this is intended to be a high-level overview of all of the the federal monies that we're looking at we are going to be following up through the department's with details on on how they're exactly how they're going to spend that money so this is an ongoing process this isn't the last time this you're gonna that you're going to hear from me or the departments in fact there was an item on the agenda from Community Services for their action plan on some money that they've received from the federal government and we're making some changes to that so we moved it to your next agenda so over time you're going to be seeing additional items on the specific use of these these monies so there we are not for a lack of information right our communications department David and crew they've been sending us weekly and daily updates the US Conference of Mayors is giving us information the National League of Cities the Nevada League of Cities the White House we are getting a tsunami of information on all of this money and and what it means I'm gonna be focusing on how what this money means to the city of Las Vegas specifically so I'm not going to be talking about about the SBA money small businesses I'm not gonna be talking about that I'm going to be talking about the stuff that has a direct relationship this is a fluid process because we are getting information daily and the rules are changing and and so we're really trying to get this figured out so the first thing that I wanted to do was thank our federal delegates and their staffs because it was a monumental effort to get these bills passed it worked really hard there's been a huge lobby for states and local governments and I don't think that this has ever happened in our history I think it's unprecedented so I wanted to thank them for the information and assistance that they've been providing us so very quickly so there are essentially five bills the first four bills on this slide have been passed by Congress the the last bill the heroes Act was passed late last week by the house but I'll talk about that and kind of where it's at and where we're headed as a part of this presentation so because we have never seen this amount of federal assistance in the past we put together a federal grants committee at at Scott's request and what you'll see here are a number of the departments that have looked at this the the federal bills it's not all-inclusive some departments in the city use federal funding and some don't right I haven't used federal funding so there's a lot of us that are trying to figure out what are the requirements and making sure that we're crossing all the T's and dotting all the i's there's a lot to it but you see agenda items from departments like Community Services emergency management and Fire & Rescue and others for a grant request right so we have put together a team of grant subject-matter experts so we can get them in the room to give us some guidance and make sure that we're that we're covering every opportunity in these bills we're working with our counterparts at all levels the county federal and otherwise to identify opportunities make sure that no one's missing anything so it's a hugely collaborative effort so the first bill that was passed is the coronavirus preparedness and response supplemental appropriations act it was eight point three billion and that was essentially for money for the federal agencies to respond to the situation the second bill was a family first coronavirus response act is about 192 billion that was among other things provided to paid sick leave tax credits testing food assistance and unemployment benefits and Medicaid funding that one did a lot that was a lot for the community the the third bill the passing them to talk a little bit about this one some details here was the coronavirus aid relief and Economic Security Act the cares act as we all know it it was about two trillion dollars and again among other things it provided stimulus payments to the community expanded unemployment funding for public health costs for state and local governments which is key for us and response to the pandemic and small and large business loans so how did all of this war well and why did we get an allocation they allocated money a minimum of 1.25 billion to each state and if you were a a city or county over five five hundred thousand residents then you got a direct allocation so the county the Clark County got an allocation and the city of Las Vegas got an allocation we got about 119 million the county got two hundred and ninety five million and the balance went to the state of Nevada as you can see of the 1.25 billion the allocation to Clark County was point was 45 percent so 45 percent of the pot came to Southern Nevada to Clark County of which we got a our portion of the distribution to Clark County so we're 21 point one percent of the state population the county is fifty two point four so this is just the money per capita for our residents that comes to this to the city of Las Vegas because of our size it was very specific but in general you could only use the funds from March 1st through December 30th it has to be related to cone good night team related expenses that were not originally budgeted right so Gary's gonna be talking about next year's budget but but you know our FY 20 but one could argue that we really didn't budget for any of this right we couldn't have contemplated that so a little bit about the eligibility requirements what's eligible payroll expenses these are some of the expenses for services substantially dedicated to responding to the pandemic recovery planning money for small businesses and payroll expenses for non-essential employees that we've reassigned to covered related tasks now there are a number of other eligible expenses of course this is a high level overview and the ineligible expenses are revenue losses which has been of concern to us and capital improvement projects so moving on to the department's the this is the kind of department specific the Community Services funds these are supplemental funds to prevent prepare for and respond to the Cova 19 pandemic Cathy Thomas Gibson and her team have been working with us on those pots of money as I mentioned they have an action plan that they're working on now that they're going to present to you at the next council meeting but the first one is CDBG there were three are going to be three rounds of funding the first round is formulaic there's no match and we got a little over three million dollars the second and third rounds we don't know the details of how the formulas are going to work but in the second round it goes to States and the third round goes to States as well so we're looking for the details on that to see if there are opportunities there for the homeless assistance grants there's two rounds of funding there again this is the first round was formulaic there was no match requirements we got a little over 1.5 million dollars there is an additional two billion dollars that we do not have the details yet on how the funding is going to be distributed continuing on with community services we got some hot pool money housing opportunities for persons with AIDS its formulaic there's no match requirements we've got two hundred and eighty one thousand that item is going to be on the agenda as well with the details of how we're going to use those funds and finally the emergency food and shelter program this is a money that goes through the United Way we know that they've received one point four five million and we are going to submit an application for some of those funds moving on to the public safety departments and when I say public safety departments of course I'm talking about Emergency Management Fire and Rescue DPS Muni Cort they're kind of all working on these so that's not necessarily department specific some are some art but the first one is EMP G which is for emergency management you've seen EMP EMP G grants in the past we requested 229,000 against that grant there is a match requirement this is for the operation of our EOC and the day-to-day Emergency Management functions now you see that there's a grant requirement there but we have never had a problem using or matching that amount so as a part of our normal operations out there this was contemplated and so there's no problems with the match requirement the disaster relief fund that is actually this slide here let's see did I got ahead of myself here let me back up here okay here we go so the disaster relief fund this actually says major disaster funds it actually it should just say use of funds includes major disaster response we are going to apply for the expenses related to our is OQ out of Cashman there is a match requirement emergency management fire and rescue and Community Services are working on that as we speak going on additional public safety we have the assistance to firefighters grants this is a grant that Fire and Rescue is working on it's used for personal protective equipment and supplies we have applied for four hundred and eighty six thousand eight hundred and sixty-seven dollars there is a match requirement the burn jag is a multi Department effort including Fire and Rescue Community Court and Department of Public Safety its formulaic and we were allocated about 1.5 million dollars we're working on an action plan for that this says a cost share of 25% there was actually no match requirement we found out so that's good news and Health and Human Services this is some money that was received by Fire and Rescue we received a hundred and seventy four thousand dollars to offset lost revenues for transports that is again formulaic and there is no match going on to eud let me say this I'm mentioning the economic development administration money but our AUD Department has been working with the community with the business community identifying the opportunities for the SBA loans and other community monies so the whole time that this has been going on they have been doing community-related activity to to help those in need but specifically so they've looked at the SBA portion of that bill but this is specific opportunities for the city and they're looking at an app an opportunity in that bill you can see that it's funds for technical assistance for hiring employees skills training workforce development so there could be some real opportunities here that they are reviewing at this point why DSi youth to know development and social innovation they've got a couple bills that they're looking at this isn't money that comes direct to us this is money that goes through the state that we may be able to use as a part of our operation so the fact that that these monies go to different places we're still looking at what opportunities we may have so we know that that we've got the child care and Development Block Grant and the Department of Education elementary and secondary education there are opportunities in those bills that are being reviewed as we speak on to Cultural Affairs the National Endowment for the Arts and Humanities each received money we have submitted an application to the National Endowment for the Arts for 50 thousand for local artist contracts and have submitted an application for up to three hundred thousand dollars for some of our cultural education programs the so now I'm moving on to the fourth bill that was a carers act right I was a third bill so now we're moving on to the fourth bill which the was there is the Paycheck protection program and health care Enhancement Act four hundred eighty four billion dollars roughly and that was to replenish money that was depleted in the cares Act finally where we had what's the other possible legislation I mentioned the heroes Act it was passed last week by the House of Representatives it it has a lot of stuff in it like I have a 90 page summary of all the stuff so we're looking at the details okay and what the other opportunities are but we do know that it has three hundred and seventy-five billion dollars to assist local governments with our fiscal impacts and that's huge for us the revenue losses now it doesn't look like that there's support in the Senate right but it was passed by the house they are looking at some other bills I found out yesterday which is why I handed this out versus having to TWP previous to gary said hey you know there's a smart act out there review we're reviewing that now and that relates to money to this cities and counties and the state for the financial fallout as you know there's and i well i mentioned this in the very beginning there's a broad coalition we're looking for additional funds right particularly from a revenue loss perspective which could be really helpful to us so there's a lot of folks engaged that i mentioned before the US Conference of Mayors National League of Cities Nevada League Cities nako I mean all of them everybody is engaged in this huge Lobby effort and then there is talk about stimulus money additional stimulus money directly to the American people which doesn't necessarily have an impact on us specifically so what are the next steps well the grants committee is going to continue to meet as these things come up identify opportunities get those opportunities to you when when we need your approval on the action plans we've also created a grant documentation analysis and coordination team we many of us don't know all of the federal requirements for reimbursement on this federal money so we put together a team of subject matter our experts that are helping us and we've reached out to all the departments to define what those requirements are so there's going to be a lot of effort in that area the federal advocacy our federal lobbyist Squier patton boggs the the same people US Conference of Mayors National League we're gonna continue working with all them the white house and then at a local level obviously the Nevada League cities the Ferraro group has been involved in this from a state perspective we're gonna be monitoring state and legislative meetings and updating getting updates through our government affairs counterparts so-oh which is not in sorry the presentation I added a summary because we had a lot of numbers in here this summary on the on the back page just identifies the funds that we've already been allocated the funds that we've applied for and opportunities that we're reviewing at this point sometimes there's an amount sometimes there's not but we have received over a hundred and twenty-five million dollars to date so so that we've got that where you have to figure out an appropriate way to use those funds we've applied for just over a million dollars more we're looking at new opportunities and we have we're hopeful that there will be another bill coming that could be helpful to us so the the message here is that it's a static process right it's it's ever-changing we're getting new information all the time but your staff starting with the city manager's office we are monitoring all of that and trying to identify all of the opportunities that we have and I'll follow up in briefings about where we're at with those over time Thank You mr. the four thousand dollar grant that's being administered to small businesses and while we really are pleased to see that that's happening I feel that it also eliminates a lot of the business members that are members of our chamber a lot of our Chamber members are small mom-and-pop businesses they are sole proprietorships so they wouldn't qualify since the regulations require them to have three to twenty five employees so I'm warning it there can be an exception for those businesses that are sole proprietors or mom-and-pop so they don't have to have that requirement and they can still qualify for the assistance that they so badly need because they've also been impacted by business interruption thank you and I think what will happen is more monies come in there are more opportunities to so so my request today is that to ask if there could be an exception for the funds that are already there so I'd like to know that this would be to get that exception Council um our city managers heard January 2020 the courtyard team immediately jumped in and assisted the client and her son with rental assistance and utility expenses the courtyard continue to support Ms Martinez and her son through the flexible housing program by providing her a temporary housing unit the courtyard was also able to provide the family food donations donations of shoes and school supplies for her son as well as work shoes for mrs.
