foreign [Music] foreign [Music] good evening and welcome to the September 28 2023 meeting of the Bloomington Planning Commission the Planning Commission is made up of seven volunteer Bloomington residents appointed by the city council tonight we have five which is a quorum the commission advises the city council on development proposals development standards long-range planning and transportation issues our work is informed by the city's comprehensive plan various District plans and the city code for some items the commission makes a recommendation with the city council having the final decision-making Authority There Are No Agenda items of that nature tonight in other cases the Planning Commission can approve or deny an application subject to an appeal to the city council and we have two of those items tonight for each action item there will be a staff report an opportunity for the applicant to present then time for any member of the public to provide testimony our first order of business tonight is the Pledge of Allegiance please stand as you're able I pledge allegiance to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and justice for all right before we begin I would ask senior planner centenario to go over instructions on providing remote testimony thank you chair Roman planning Commissioners as you mentioned we have two public hearings on tonight's agenda and any folk anyone can in the council chambers or joining us remotely has the ability to testify for those public hearings if you are at home or remote you can call the phone number that's on the screen here the enter the access code followed by the passcode these numbers will be scrolling across the screen of while the meeting is underway thank you the first item tonight is a request for a conditional use permit for a daycare center at a place of assembly and planning Tech Navarro has the presentation good evening chair planning Commissioners um so item one is um Saint Michael's San Michael Lutheran preschool is proposing a conditional use permit for a daycare center in an existing place of assembly located at 9201 Normandale Boulevard I will receive correspondence from Resident which was attached to um to the packet that we sent last week and I will address her concerns throughout my presentation so the subject property is highlighted in blue the current news is a place of a place of assembly and it is on R1 they use the student North East and West are single family homes and they use to list out is the city water plant and is also Zone R1 so daycare facilities in places of assembly are allowed with a conditional use permit limited to the 25 of the total floor area in this case this floor plan shows the proposed room this designated for the daycare center and is highlighted in green on the screen these are approximately 11 of the total floor area of the places of assembly the daycare center has been in operation since 1968 with an approved license from the Minnesota Department of Human Health Services for up to a maximum of 20 children however our records indicates that there is not a conditional use permit for this property we saw how we know about this is we received a an inquiry from the Department of the human services to increase the number of children to 40 children and we did our research and that's how we knew that we noticed that there wasn't a conditional use permit for this property so the applicant would like to correct that and that's why you're seeing this application before you tonight um so for the sideline landscaping and lighting our lighting are not triggered with this application uh but they have to maintain their approved plans from 2001. staff is not concerned about parking there are 361 existing parking spaces and they require space they require parking spaces for the proposed their daycare is 10 spaces there is a fence in playground on the south side of the building and staff is not concerned about noise because it's not near the residential homes to the North or the east or west of the property the applicant is not proposing any exterior changes at this time and with that we were able to find the required findings and we recommend approval through the motion on the screen thank you are there questions for staff commissioner goldsman thank you chair um question for staff um since this has been in operation since 1968 has the city received any complaints or any issues with this property in the past Cherry commissioner goldsman so that is actually one way for us to know that a property or a use doesn't have a conditional use permit so it will be through a complaint and we haven't received any complaints otherwise we would notice that there wasn't a conditional permit for this I use thank you commissioner Curry thank you chair uh just a clarification so in the floor plan it it looked like I'd say over 25 percent of the space in the building is highlighted green and then the um uh but I believe as part of the approval it needs to be or the use needs to be dedicated less than 25 percent just want to confirm that some of the spaces not dedicated specifically to the daycare commissioner chair commissioner corice um so whatever is green on the screen those are the spaces that are designated for the daycare so what is in in white those spaces are not designated for the daycare um those green spaces is a total of I can give you the exact number hold on so uh it's approximately 7722 square feet which is dedicated for the daycare and those are the green uh Parts in the floor plan and that is equal to 11 of the total building area thank you other questions for staff okay thank you um would the applicant like to speak on this item if the applicant is here or online go ahead no okay um are there questions for the applicant okay this item is a public hearing so I will open the public hearing is there anyone in the chamber who would like to speak on this item all right seeing none and looks like all of the people online are staff there is no conditional use permit for the additional children on site I do think that it's important for us to have enough daycare centers for the city of Bloomington given that the the need is so high in that area so I'm glad that the church is able to increase the number of students in Fairly straightforward applications so I am in support I also support what I want to I do want to make a note and um playing Tech tomorrow mentioned this too is we did receive communication about someone who was concerned about noise of a of a daycare near their home and I um one that there has been a daycare in operation and no complaints to date and also I appreciate where the outdoor play area was proposed because I think that is the least likely to create noise for I mean if in that corner if your noise is enough to be overcome by Normandale Boulevard with bigger problems and so um I am supportive of this application as well other discussion or emotion or commissioner Albrecht happy to make a motion in case pl202 3-149 having been able to make the required findings I move to approve a conditional use permit for a daycare center located at 9201 Normandale Boulevard subject to the conditions and code requirements attached to the staff report second thank you we have a motion in a second to rec or to approve the conditional use permit at the subject property any further discussion all those in favor say aye aye opposed the motion passes this is a final decision unless an appeal is received by 4 30 pm on October 3rd thank you the second item is a request for a conditional use permit for a sports training facility and this item has been withdrawn by the applicant anything else we have on that or just that's it Turtleman that's that's all we have to know great the third item is another public hearing this is a request for a conditional use permit to expand the number of residents at an existing residential care facility and planning Tech hespec has the presentation for this item good evening I would love to oh is that what's going on thank you all right should be good so item three is a conditional use permit to expand the number of residents at an existing residential care facility uh the site is located at 1100 East 80th Street and is zoned um fd2 which is freeway development the sites to the north east and west are also zoned fd2 and to the South there's an apartment building zoned multiple family residential 12th Avenue South is the street that runs east of the site residential uses are conditional uses in the fd2 zoning district and the user has a conditional use permit from 2014 which was for a woman only residential care facility for 32 residents but tonight they are requesting an increase in the number of residents to 48 and removing the gender restrictions uh this slide shows the floor plan and the applicant is proposing to use about 13 750 square feet of the 23 3073 square foot built in the organization has 24 7 staff and will have security measures approved by the Minnesota Department of Human Services licensed Licensing Division to safely serve all the clients also the city received several letters of support for the project as is shown in your packet uh so we did put a condition um that the public sidewalk which is outlined in Orange on this screen should be connected with the private sidewalk um outlined in dark blue and the applicant is proposing to build a five foot wide sidewalk that would make that connection parking exceeds the required amount by 13 spaces so staff has no concerns about parking um nor circulation or access landscaping and lighting plans were approved in 2014 and they'll need to be maintained but they look good now the interior building areas are fully sprinkled and the building has secured doors internally between residential and office uses um and so with that staff is recommending approval and I'm available for questions thank you thanks for that questions for staff commissioner Albrecht thank you chair my question is is there a planned um smoking designated smoking area on site I know we've been hearing a lot about all types of smoking recently and I'm curious about uh what is planned uh chair Roman commissioner Albrecht I'm not sure but the applicant is here tonight and I'm sure they could answer that thank you thank you commissioner Goldson thank you chair I have a similar question to the previous application um since this has been open since 2014 have we received any complaints from for this property or chair Roman commissioner goldsmen none that I'm aware of great thank you other questions for staff thank you would the applicant like to speak on this item go ahead and go ahead and come on forward if you want introduce yourself would be great yes yes hello I'm Jared boosterman I'm the executive director at Progress Valley I think the summary covered it well but I'm happy to answer any questions I can speak to the smoking question go ahead yeah so yes we do have a designated uh smoking area um that's proper distance away from the door other questions for the applicant commissioner Albrecht uh thank you chair can you indicate can we go back to the map can we indicate where that is on the site map that would be yeah that would be great yeah so we actually have um so if you're looking at it it would be the top left part so the back corner of the property we have a gazebo area and then we also have some seating in like a temporary shelter sort of directly out from the front door on the other side of the parking lot that's on the north west of the Northeast so that would be it would be the left of the picture so that okay Northwest yes and adjacent to that is simply office use and other industrial or business other questions straightforward as it's been in operation since 2014 and I'd like to see that you know they're increasing their capacity which is great for them and the residence of Bloomington as well as the needed parties here so um I also like that they're inclusive of you know all people um not just uh one gender so I will support this application as it is in front of us additional discussion or emotion uh we have uh just a reminder that next week's meeting October 5th that has been canceled will not be having that meeting but looking a couple weeks in the future on October 12th we do have several development applications three are final site and building plan applications two of two of those are School District Stadium improvements I'm not sure how much media is covering that but and then an a third application for a building expansion and the 12th you'll also have an opportunity to review the annual miscellaneous issues ordinance so also schedule for the 12th and then looking a few weeks ahead of that to November 2nd a number of code amendments one would be a privately initiated code amendment to alter the limitations for daycares in the C4 District uh Mr Johnson will lead a sign ordinance study item and then there is a another small Amendment proposed for the B4 zoning District thank you are there any other items members of the commission would like to bring up at this time
