yes Gallego yes passes eight zero we next move to item 45 which is a public hearing for the proposed I-17 and Jenny Lynn Roan annexation we'll open the public hearing Eileen Baden is here to provide virtual comment Eileen the floor is yours everyone thank you so much for having me here today um I just wanted to mention that although this um this project area may seem that it's on the outskirts it actually does provide a regional connection between New River and Anthem so one concern is if the Wildfire was to break out to the north people New River would need to go south so there is a concern about the roads needing to be widened from the site plan that I saw in the past um also I I really think a pathway a perimeter path should be established as part of the project because it is a regional connection so um basically right now there's no place for I see I've seen children riding on the Frontage Road and it's just not um there's no safe place to ride so my recommendation is that if a perimeter path was added as well as down lighting and things to make sure that dark skies were protected um and then also that there's a transition in density from Anthem being a higher density area to New River being a lower density area I would be more comfortable with the project moving forward as is and that includes the annexation of the area with Maricopa County and this area isn't a Scenic Corridor there's also the New River Scenic Corridor I'm sorry the New River Daisy Mountain Area plan which calls out the I-17 Scenic corridor and um there's also Trail Connections in to Daisy Mountain and it's really important to protect public access to the mountain from both the North and the South communities um so I just wanted to mention those couple of things wonderful thank you for the testimony it's a very special area of our community close the public hearing we do not have a vote required today this is a public hearing only does anyone have comments on this item we will move on then to item 65 request to amend contract with Maricopa Corporate College for basic skills training noting that the vice mayor will not participate in this item do we have a motion I'll move to Center I will turn to councilwoman O'Brien thank you mayor um I'd like to First say that this vote would marks the last required vote to fully redevelop Metro Center mall and although this process started long before I was elected into this office as a native Phoenician and someone who worked several different jobs at Metro Center I'm beyond excited to help usher in the new era for the Metro region there are a few people I'd like to thank first thank you to former councilwoman thelda Williams who was unable to attend today's meeting but is in here it but is here with uh in spirit with fingers crossed I'm sure and probably toes and and anything else she can Cross I'd also like to thank um Chris Mackey and her Department Chris started down a list of potential developers and has gone through 25 different uh proposals only to come back to the first one so thank you to her and her staff Jeff Stapleton from Economic Development who took ownership of this project and this area to help navigate the obstacles thank you to the development team Steve spring Steve Betts and Chris Anderson with Concord Wilshire tlg Investment Partners and Heinz development for seeing the vision with us and for bringing it to life with their investment and of course to all the neighbors community members and partners the continued advocacy and love for the area is in part What drew the developers to want to commit to this they see the potential of the region and it's because of the awesome neighbors with all the puzzle pieces in place and the community excited let's please get this passed today the vice mayor I just want to thank everybody who was part of this uh project uh councilman Williams as she was stepping off one of the last things that she asked me or I asked her what would you like to see finished and it was Metro Center so congratulations to everybody that has been part of it and uh to councilwoman O'Brien for continuing to make it happen so thank you well said vice mayor I also want to congratulate councilwoman O'Brien from her hard work this is a exciting day for the City of Phoenix Metro Center is a property that has so many memories and means so much to this community with this passage its future will be as bright and exciting as its roots and history it comes at a time when we're working to make sure people have great housing in this community there's new retail which we hear from the community this is very exciting and needing as well as public amenities and just open space where families can gather it is a property right on our light rail to almost a year to today we were received that we we learned we got full funding Grant agreement from our federal Partners to build the Northwest Light Rail extension also a passion project for councilwoman felda Williams these two amenities come together the same time we are reinvesting with our state Partners in the I-17 corridor really bright future in this part of our community and I know it has been so much work for our community and economic development department and a huge priority for the district one team this comes at the same time we're making exciting investments from Park Central Mall to Paradise Valley Mall we have a delegation visiting from a Chamber of Commerce in Texas today they are interested in how we do these type of projects it's becoming a national model and I don't know how much we should share our secrets but part of it is our great team which that cannot be replicated so I want to thank everyone who worked to make today possible roll call to CSU no ceremonial signage will turn to council member Garcia thank you mayor Downtown Phoenix Inc family lost downtown hero last September uh Hans Hughes was an ambassador with Downtown Phoenix Inc who was also a regular cyclist we hope that these signs will be a reminder of hands and his wonderful Legacy but also a reminder to drivers to respect bikers on the road I also want to thank councilwoman Ansari and her office for splitting the cost of these signs he did work in all of downtown in both of our districts we know that these signs will show the community that in the words of Hans it's always another beautiful day in downtown Phoenix so with that I want a motion to approve item 83 second we have a motion and a second any additional comments very quickly councilwoman Stark I I really appreciate that we're doing this it's a great reminder of why our roadway safety plan was passed and um I think when I drive my I'm going to remember all the wonderful things he did for the downtown area this is very lovely gesture well said and I'm excited to support this Hans was an unmistakable presence in our downtown who was loved by co-workers downtown community and everyone he met he made our downtown a better place for residents business community and our visitors as alluded to we're moving forward with an important Vision zero initiative and I'm excited that one of Han's colleagues will be serving on that board Jamie trufin Jamie recently returned from a trip to Sweden where Vision zero was implemented for the first time before when it was adopted by Swedish Parliament so I think he will be thinking of Hans as he serves in that capacity and hopefully we will be a safer City because of these Partnerships roll call to CCO yes Garcia yes yes O'Brien yes Stark yes Waring yes pastor yes there you go yes passes eight zero woohoo we next moved to Phoenix Rising item 85 I'll turn to council member Garcia thank you so much mayor really excited to be able to have this motion we're a week away from the World Cup when the world's largest sporting event and with this item we'd like to welcome Phoenix Rising home I know they're moved to Phoenix will not only create a Century Located uh you know location for them but also this is going to excite the fan base and also bring economic value to the city I'm thrilled to welcome them to District 8 and I can't wait to cheer them on alongside with my family and all the fans I also want to give a shout out to the park and swap folks who I know are also excited and and are planning to be great neighbors so I'm really excited to to put this forward so motion to approve item 85. second we have a motion in a second we do have both we'll go to councilman decision oh just to comment uh to council member Garcia I mean this is our first large sporting event that's ever been brought in and since I've been around um it's amazing what you did here the amount of work and effort that you put into this I mean you really have to be congratulated for it because it's it's just something that just doesn't happen every day and I know that the mayor's office isn't intricately involved in this thing and mayor you've done an amazing job on this and the work that you put into it and to bring in something of this high quality now I'm not even though I'm Italian I don't know anything about soccer you know and I tried playing it but I it was a little too slow you got to be fast and felt but either way there are so many kids that play this sport it's amazing so I mean this is a huge congratulations to you for being able to pull off something this big to both of you I'm sorry well thank you councilman guardato thank you mayor yes as well I want to congratulate um council member Garcia I got to go to one of the games um a few a few weeks a few months ago and it's amazing um the work that they've been doing with our children one of the things that we're always talking about on the console is how do we make sure that our kids continue to stay active and we're excited to have them to have them come to Phoenix walking them back home and I think it's a it's a it's an amazing thing that's going to happen for all of those families and in South Phoenix and for all the families around I know that my child played for a year or two on the league so they do an amazing job and looking forward to seeing them start again in in Phoenix and hoping to see this development happen and once again thank you so much councilmember Garcia for your hard work thank thank you I am excited to welcome Phoenix Rising to Phoenix it seems appropriate they will be at a great location near Gateway Community College Light Rail it's not a cheap move for them they will be paying their way and making important Investments and inspiring a lot of young people in our community with that we do have several to testify and I will begin with Tim reister Tim will be followed by Aaron genberg and we could bring a microphone to Tim if okay you look like a Soccer Star mayor Gallego councilmember Garcia members of the council I am absolutely delighted to be here with you and so appreciative of your work on this if I only played more soccer as a youth my foot probably would have been strong enough not to break while I was exercising a few weeks ago you're you're absolutely correct our goal is to engage more and more children we have almost 10 000 kids participating in Phoenix Rising soccer today and the Big Challenge we have is just not enough grass for the kids in this move to Phoenix we'll not only bring our pro team closer to the center of Phoenix but it'll bring our protein and our youth club closer to the kids of Phoenix and we are committed to making this Decades of Health improvements for kids and our surrounding community and are forever grateful for everything you've done thank you I know this has been a lot of work we've worked on it a long time in kudos to Christine Mackey in your amazing Department of community and economic development they have been so professional uh in in just amazing with whom to work so thank you so much everyone thank you we'll next welcome Aaron and we do have Ben taint and Chambers to speak if necessary if council members have questions good afternoon mayor members of city council my name is Aaron Feinberg and I have the privilege to serve as the general manager of the Phoenix Park and swap in March of 2021 this Phoenix City Council did approve our five-year lease extension and I expressed in that form that we were excited to work with the city to activate the site for other uses I'm thrilled that that day has come and I can't think of a better use for the facility than having the Phoenix rise and become our co-tenant our partners and our neighbors on behalf of the 500 plus small businesses they call Phoenix Park and swap home and our 60 employees I'd like to commend and extend our sincerest gratitude uh to the aviation director Chad makovsky his entire staff especially Rich Graham and also Christine Mackey for electing to exercise the aviations option to extend our lease for another two years that's huge and we really remain committed to the City of Phoenix and have enjoyed our partnership with them over the last 16 years to council member Garcia we appreciate your support over the years and look forward to continuing to bring great things to happy for this and being able to see a Phoenix rising in Phoenix Rising has now landed in Phoenix so congratulations to everybody that worked on this really appreciated Anna woohoo that's a yes thank you Gallego yes passes eight zero welcome home Phoenix Rising we next moved to 101 the extension of our internet governmental agreement with the city of Mesa for our water use it wisely advertising materials and campaign vice mayor I moved item 101 second comments I had it pulled just because I had some concerns about it but I'm fine I did some more research on it it looks good for on my end wonderful thank you communicating with our residents about water use is incredibly important in the desert and this is an award-winning campaign that we have done in partnership with our fellow we'll go to item 108 which is the southeast corner of 59th Avenue and Dobbins Road an item in 107. sorry 107. thank you 107 in District 8. foreign I will turn to council member Garcia to introduce the item and then we'll have a very brief public hearing thank you mayor thank you Josh and Allen um just want to add a couple of questions uh Josh can you clarify the stipulation number one and what that entails for the commercial commercial piece of this for the area I know for the Levine Community they've been waiting a long time for these the commercial development and the surrounding areas are waiting to see what's what's going to happen with this project so just if you could speak to stipulation one please absolutely mayor members of the the council council member Garcia stipulation number one requires General conformance to a site plan and elevations that show on the immediate corner of 59th Avenue a commercial development occurring thus the the uh the elevations that are accompanied that show the the look and feel of that so any development that comes in to that portion of the project would be required to be in general conformance that if they wanted to deviate from that then they have to request a modification or deletion of that stipulation which would go back to the public hearing process and so we certainly understand the concern with that stipulation in place there's some protection to ensure that what what we're showing today is what they're going to be required to to develop unless they go back to the public hearing process thank you so with that I want a motion to approve uh case z 45-22-8 per the Planning Commission recommendation with a modification to stipulation number six to read as follows the developers should construct a minimum five foot wide sidewalk and a minimum five foot wide multi-use Trail and a minimum 11 foot wide landscape area located between the back of the curb and the sidewalk along the south side of Dublin's road while maintaining the subsections a through C in the stipulation as approved by the planning Planning and Development Department councilmember if I could just have you add and and Adoption of the related ordinance my apologies and Adoption of the related ordinance we have a motion and a second we will now open a public hearing Jonathan bastianelia is here to speak if necessary would anyone like to go to item 108 which is the northeast corner of 7th Street and Coulter this one we will begin with a staff report we will open a public hearing we will have 10-minute presentations from each side the first two speakers may use the entire 10 minutes or they may give it to other um folks who share their perspective if they choose to the applicant can reserve time for a rebuttal if they the applicant chooses we will then have we have extensive members of the public wishing to comment on this item and then we will close the public hearing and I think council members will have comments motions and check in with council member decisio did I get that right all right so we will begin with the staff report mayor one sec we are switching out the PowerPoint here to the staff one and then Mr uh bed and Eric is going to give the the staff presentation mayor while we're pulling that up I'll go ahead and introduce the item item 108 is rezoning application z27-22-6 the Zola North Central PUD the northeast corner of 7th Street and Coulter the requester result is to resign the site from C2 intermediate commercial to PUD to allow a multi-family residential on a 2.5 Acre Site in Council District Styx The Proposal is for oh here we go there we go The Proposal is for a 60-foot multi-family project with 200 units you see the here's the surrounding zoning on the site so you have multi-family zoning to the north and R4 commercial zoning to the South and C2 P1 and R4 zoning to the North and then commercial zoning immediately across Seventh Street slide here's a the site plan you'll see that the project is oriented on Seventh and on Coulter with a garage in the rear these are the proposed elevations for the project again 60 feet in height if there's a recommending approval per the stipulations outline in the memo dated today November 16th the Camelback East Village planning committee recommended approval by a 14 to 2 to 1 vote the Planning Commission recommended approval for the VPC recommendation by a 7-2 vote mirror that concludes staff's presentation happen to answer any questions all right we will begin with a presentation by the applicant and welcome Nick Wood and again um open the public hearing the applicant has up to 10 minutes and can control speakers floor is yours mayor members of the council Nick Wood Snell and Wilmer one East Washington we actually moved into cityscape Phoenix and I represent Zam living we could bring up the presentation please next slide please Josh thank you so the site is located at the northeast corner of the intersection of Coulter and 7th Street we are asking for 194 units which is fairly small in comparison to many of the other multi-family projects that we've handled and have otherwise been built in the area in addition we are not going to be the tallest building in the area as you can see at the southwest corner of Bethany and 7th Street there's an office building there that's 65 feet tall in fact that office building is 65 feet backs right up to the backyards of a number of single-family homes uh but as you heard Josh say we are surrounded immediately by either multi-family or commercial around us next slide please one of the things that jumped out at you is the site is currently just two acres against a small site as occupied by a two-story building that had been a charter school for quite a long time and two things that you see here is the size of 7th Street it's a sixth Lane I call it a highway traffic moves through there very quickly and fairly rapidly we had a number of meetings with a number of different neighborhood groups both to the East and to the west and with some of them right there on the site and we noticed the situation with the traffic the speed and what goes on at that intersection one of the folks that were there mentioned that is one of the most dangerous intersections all along North 7th Street through North Phoenix we asked our traffic engineer Don Cartier to check on that and sure enough it is a dangerous intersection um we've been asked by some neighborhood groups to put in a traffic signal at the cost of almost five hundred thousand dollars now of course we would rather not put in a traffic signal but uh the warrants are there uh don Cartier and representative of Civ Tech is here to answer any questions regarding that we've worked out a stipulation excuse me with uh I'm sorry with um keaney and streets department that will put up the money and then the determination will be made with respect to several things number one bike lanes and with respect to whether or not a light will go there again we'd rather not spend the money but if it's a safety issue and it must be spent then we'll support it if we go back one slide Josh please I want to I want to mention that you see that there's a lot of um you've got Windsor Square which is the subdivision to the west then to the east there's about equal number of single-family homes that are there so we've been meeting with a number of folks obviously on both sides of of our project and for example you have in your packet 347 letters of support and I'll show you a map of that in a minute 38 neutrals and 53 verbal support but they didn't want to give their information on a letter uh next slide please and next one and that's just a shot you can see what's there today with the attached sidewalk Etc next slide please on our site plan again you can see it's a wrap project with a parking structure there's not a lot of room for units around it we actually move the building back away from the street I'll show you a slide for that we have we actually added another level of parking so we're parking it at the city standards we had originally asked for a reduction but again one of the concerns that the neighbors to the east had was they didn't want people parking in their neighborhood so now we're going to be parking it at City standards we've also been asked to basically step the building back from the third level up but as you can see along 7th Street if we did that we would lose all of those units for basically three stories uh next slide please um we can go to the next slide uh this is the Crosscut along 7th Street as you can see we put in an 11 foot wide separation from Curb to the sidewalk one of the reasons is because of the speed of the cars that go through here and we did it in in the form of a bioswale so of course water will collect and maintain the trees but also creates a separation from that white Nissan and a gentleman is walking on the sidewalk we're also asked if we could widen the sidewalk so you'll see a new stipulation in your memo today where rather than a five foot sidewalk we will install a seven foot wide sidewalk uh next slide oh one other thing I want to show you is uh let's go back to that slide please that broken line to the left of the gentleman who's walking away with a with a white T-shirt that's our property line so basically in order to create this distance in order to create this setback um we actually are placing the sidewalk and part of that Swale on our property again to create that distance and it's about 31 feet from back of curb to the uh to the patio that you see it on the right next slide please uh this is what it's going to look like on the corner we have pavers on the corner and uh there's a bus stop that's right there so we have Stoops and other things for our Riders of the bus stops and some coverage for them uh if in fact it's raining or anything else uh next slide please um this is the the slide along um uh 7th Street looking to the South uh next slide and again we'll have a wider sidewalk now next slide please this is a cross cut on Coulter again same design although it's a smaller Swale but it's also a smaller Street next slide please this is a local long Coulter again there's lots of landscaping lots of trees and lots of shade next slide please this is the architecture again it's uh an extraordinary architecture from the way I look at it you have a lot of movement a lot of articulation even the roof has movement in it we've added columns along the bottom and instead of a step back of the physical building as I showed you we would lose um units we actually created a step back in the form of extending uh the balconies as you can see there are in a white on the left side of the screen next slide please and here's a shot looking basically to the southeast next slide please that's another shot of our site plan next slide please this is the result of our Outreach as you can see all of those dots are letters of support the green ones are as I mentioned there's 347 of them individual letters of support in your packet we had 38 neutrals who said build it or not we don't care and of course 53 people verbally said that they support it there was a petition submitted by the folks in Windsor Square and of course you see we also have letters from Windsor Square to the left next slide please and this was the list of of folks where we can find by address of that next slide please so again we've agreed to a number of stipulations this was one of them um with respect to the uh the sidewalk and again you have a list I think on the next slide I think that's it so again you have the list of stipulations there uh we're in agreement with all of those stipulations I'd be happy to answer any questions you might have thank you thank you I think we may have questions but we will next go to hear from Larry white cell and again Mr White cell can use the entire 10 minutes hand it over to Tracy hand it over to five people thank you very much mayor city council I'm Larry Weitzel the co-chair of the peak neighborhood association 7120 North 20th Street in Phoenix I really appreciate the opportunity to speak with you today I assume some of you have already decided how your vote on this case and my request today is that you keep an open mind until you have heard from all of today's presentations the main question for you to decide today is if you support your staff in the street Transportation Planning and Development and Zoning departments or if you support political pressure from February 1st through August 12th City staff asked for three design revisions one is setbacks that are comparable with the currently or recently approved developments in the area specifically Broadstone on 7th that would be building and Landscape setbacks you have 25 feet minimum measured from the property line on 7th Street and on culture building and Landscape setbacks a minimum of 15 feet measured from the property line they also ask for height step back on the 7th Street Frontage require a maximum of 30 feet high or three stories and then step back equivalent to one unit in width and then step up to 60 feet or five stories for the top two floors the third revision was access on an arterial Street 7th Street quote there shall be no access on culture end quote was the directive of your street Transportation engineer at the February 1st pre-application meeting and that directive has not changed no access on Coulter is also in all of the zoning department comments from the pre-app in the email dated June 23rd from Maya a planner 3 in the street department and two submittal reviews by zoning staff as recently as August 12th somehow in the three weeks between August 12th the last staff review and September 2nd the staff report that went to the Village these three design changes were not even mentioned and there had been no changes made at the Camelback East Village planning committee Mr wood admonished me by saying that I attacked the zoning staff because I asked questions about the omissions in the staff report on these same concerns the fact is I sympathize with the zoning staff because for their they worked for seven long months and in three weeks their work was reversed due to political pressure we were told by administrators in the planning and zoning department development a project really should be able to stand on its own merits and should not have to be changed covered up by the department that developed them but it developed the reviews because of political pressure at Camelback East Mr wood also stated his high regard for the work done by the zoning staff if he holds their work in such high regard then why didn't he make the changes the staff directed and suggested not to do so is both disrespectful and demeaning and by the way I was given the opportunity to meet with Mr wood this last Monday in lieu of meeting with councilman decisio which I requested at the last council meeting we set up the meeting for Monday at 3 30 and Mr wood decided not to come he sent two people in his place some of you have expressed a concern about the need for additional housing in Phoenix designing a step back would reduce this project by approximately 20 units could I have my PowerPoint presentation put up please so I can illustrate this so it would be a hundred units or 180 units instead of 200 units now Mr wood has today said they're asking 494 units it's really a moving Target the number of units depends on how many efficiency one bedroom and two bedroom apartments there are if we could go to the second slide please so this is a top floor schematic and what they would need to do to do a step back on the top two floors is simply take off one row not the complete side of the building but one row equaling maybe 20 units the number is insignificant like I said and it's really insignificant in lieu of the number of units that you're trying to accomplish through the Housing Initiative right now it looks like you're lacking about 27 000 units this 80 20 units equals zero zero zero seven percent of your goal it's not significant but it will make a huge difference in the compatibility of this project with the other recently approved developments that was stated by the zoning staff and the surrounding commercial and multi-family housing complexes and the addition of the design element that Mr wood talked about the up at the third story he called it an illusion of a setback and it really isn't it's really moving the building closer to the street you actually see it more prevalently than you would if that design element wasn't there Mr wood stated that fewer units would kill the project the only reason that it will kill the project the entire project is because the developer values profits over people and cash over compatibility they will make it pencil out if you direct them to have a step back of the top two floors and a 25 foot set back from 7th Street and access on on 7th street instead of on Coulter addressing the city Traffic Engineers directive that there shall be no vehicular traffic on culture please do not let Mr wood say that access own culture is accepted by streets or planning because the developer is going to pay for a traffic light we just heard Mr wood say that they will but they really don't want to but that's how they got the planning commission's approval by promising that they would that a traffic light was warranted and accepted this would not even be a concern if you expect the developer to follow the directive of Street transportation and the repeated request of zoning staff to have access on 7th street and arterial instead of on a local Street Coulter and Mr wood May rebut and say that access on Seventh is unsafe because of the non-alignment with Oregon and could I have the next slide please this really is not a concern because Oregon if it's offset from the entrance on 7th street to the development left turns would actually be very safe safer than having it perfectly aligned with Oregon you can see the arrows how head-on collisions would be avoided by having the offset this way the problem with access on culture isn't going west into Windsor Square it's going east on culture through the established neighborhoods that already have enough cut through traffic so if you value the seven months of hard work done by your experts in the street transportation and planning and development departments and you expect the applicant to make changes you have requested you will vote to deny the application as presented the developer will make it work if you direct them to do so vote to approve the application if you are paying playing East Coulter Street I am a proud resident of what used to be recognized by the City of Phoenix as Coulter Commons neighborhood why is it no longer recognized I am not certain but what I am certain of is that we have continued to act as an organized group in our community for the almost eight years that I have lived in the area we have been attending annual block parties assisting in our luminaria display during the holidays and we also have sorry we also have a culture Commons Facebook page that we organize and update on certain happenings with that said what we refer to as Colton Commons our alarm that the developer has presented our community in such a way that we can be construed as a different apathetic or unemotional about the changes in our community my neighbors have high expectations I have a whole list here my expectations of to maintain a certain aesthetic my friends and neighbors just want to compromise that will help preserve the integrity and historic value of our neighborhood we are an active community of young and older families and are in favor of a hawk light to accommodate pedestrian bikers and and such and with that said we're not opposed to development we just want it to be safe and we don't think a traffic light is in our best interest or safe for the east side of the neighborhood between 7th and 12th um that's basically what my next speech would be um it's just about you know we're good with with development we just don't want that traffic light we really don't think it's safe uh thank you for your time charity is next followed time Council people um I live at 921 East Colter it's directly east of this proposed PUD and um I attended the First Council meetings or the first uh the planning committee meetings and I heard Mr wood say several things that were frankly impossible they did canvas the neighborhood and got some approvals but when they canvassed our neighborhood the entrance and exit to their property was on 7th street not on Coulter and there was no mention of a street light at all and once our neighborhood found out about those two items we started to Canvas the neighborhood ourselves and I personally went to probably 40 houses I spoke with not a single resident that was in favor of those two items so I don't understand how that can happen if the developer wants the project they should have to meet certain standards and it's it's just very frustrating to me as a homeowner to see uh that he may just get away with that so I do hope that you will take the Public's concerns into consideration in thank you for your service and for this opportunity to speak to you I live in the historic district Windsor Square about two blocks as the bird flies from where this building will be built my understanding of these PUD rezoning is that it's supposed to enhance and improve the neighborhood and we do not feel that this is happening the biggest Con well maybe not the biggest but the driveway for the building is on Coulter and many something like 180 cars or something could be in that garage trying to go to work at eight o'clock in the morning and come home at five o'clock and it's probably about a block from 7th Street for that exit in Ingress egress whatever um and I just don't see how that could work out well uh we have cut through traffic already in Windsor Square coming off of 7th 7th Street on onto culture in spite of signage that says don't use you can't enter and this will just make more of that cut through traffic oh the zoning right now is for like a two-story building and this would be a five-story building and our zoning also for that area is about 17 units per acre and this would make something like 78 units per acre so it just doesn't seem like it doesn't align with the city's the general plan from 2015. oh and I think this building really should belong south of camelback where there's already zoning thank you thank you in person Susan is next and then we will go back to Virtual comment for bull Earnhardt good afternoon mayor Gallego and City Council Members I am a homeowner on 6th Street north of Camelback Road I live in vice mayor Laura pastors district four but I can see and hear councilman decisions District Six across 7th Street from our two-story home I want to thank you for listening to the concerns of nearby homeowners in addition to the business owners and development Community who go home elsewhere this inappropriate rezoning affects us we are four responsible and compatible multi-family development but the height and the density of this project sets a precedent endangering the character and the safety of the north central neighborhood the distinct character change north of camelback will no longer exist if this rezoning is granted because more will follow this is a Tipping Point the developer States they want to provide housing near the city center yet there are dozens of one story underutilized properties south of camelback along 7th Street and 7th Avenue the major arterial roads this developer chose to buy north of camelback with the hope of rezoning to match the intensity and scale south of camelback for maximum profit neighbors have asked the developer to scale back the project to make it consistent with the current zoning and the surrounding area north of Camelback zoning ordinances are a quasi contract with the public the developers continue to Max it out make no mistake this is not about the housing crisis this enriches the developer at the expense of the neighborhood and it does not create a superior environment to the conventional zoning I urge you not to approve thank you thank you we will next go to Virtual public comment uh with bull Earnhardt followed by George out to Suburbia looking for affordable housing for business businesses and restaurants like us in the area it's vital to have more housing available in town This Apartment project will be a great the Pud and borders on 7th Street we support neighborhood compatible multi-family housing but as proposed this PUD is not neighborhood compatible what do you approve today will set a precedent that could affect our neighborhood and others on 7th Street five-story buildings placed within 10 or even 20 feet of one and two-story homes will harm those homes property values and also those residents quality of life because Ingress and egress for the proposed Apartments is on Coulter a traffic light is proposed our experience with the traffic light at Rose Lane and 7th Street is directly pertinent Rose like Coulter is a residential street with varying widths some of them quite narrow our Rose Lane light signals drivers on 7th street that Rose Lane is a through Street approved for additional traffic drivers routinely speed through our neighborhood they've crashed into cars parked along the street careened through fences into front yards and on Rose Lane on the other side of 7th Street seriously injured a student walking to school we have worked on the Rose Lane traffic problems for more than a decade with no success we were told by this that the city will not remove traffic lights once they're installed we asked repeatedly for Speed enforcement traffic counts but and we installed speed bumps which we were told was our only solution traffic on Rose Lane remains a danger and a frustration to us please don't inflict these safety problems on the folks that live on the culture Commons thank you and I'll answer questions if you have them thank you Alex is next followed by Sandy gruno good afternoon Council I'll do this extemporaneously thank you mayor and councilman decisio and council members Alexander malkoon 245 East Rose Lane for Jackie witch just spoke of I want to share a couple things with you I've been at this a long time I ran against Calvin good in 1983 when I was a senior at Arizona State University for district 8. sat on the Parks and Recreation Bond committees been involved with the Neighborhood Housing group or I reviewed probably a thousand grants for the City of Phoenix neighborhood block watch Grant committee I've been on the Alhambra Village planning committee for a number of years past chairman for several of those and um during the early 80s when Terry Goddard became mayor for eight years we established all of our neighborhood groups and we gave the Neighborhood Housing service some teeth and put those things in place so that we could develop a city that didn't rot at the core like Detroit or Cleveland and it's because of those efforts that we have neighborhood groups individuals who are coming here and speaking to you today concerned about traffic concerned about crime these are the individuals who have put their soul into the central part of the city I myself have spent 25 years on Rose Lane that Jackie just spoke of and I can attest to the unfortunate traffic that is occurring they're in the dangers seven years prior to that I was in Coulter Commons off of Missouri and 13th Street so I know what I'm speaking of here and the challenge here is are we going to listen to these folks to maintain the core of our city or are we going to ask these people to put up with things that are making it more difficult to live there and eventually move and have these homes turn into rentals or we're going to put up with an out-of-state developer with an individual who's making a profit to promote the individual this in this development and uh and and walk away from these individuals let me just finally say what these neighborhood groups are asking for is not much 10 units 15 units a little bit of a change please consider that finally 7th Street is a dividing line between Alhambra Village and Camelback East I would kindly ask you to consider that since it's such a critical part of the city that we allow both Camelback East and Alhambra Village to review these because I'm going to test to you Alhambra Village would not have approved this in this format and sent it up to Planning Commission thank you for your time we'll go next to Sandy and then go back to Virtual comment for Robert rebeck followed by William Saul thank you mayor and members of the city council I address this especially to Mr decisio and to miss pastor the Grapevine says you Mr desiccio already have the votes to pass this PUD D how can that be when not all the voices stakeholders have been heard on this high intensity project which impacts two districts we Neighbors want what is best for the surrounding neighborhoods to include culture Commons and Windsor Square the 40 or excuse me the required neighborhood meetings were restricted as neighbors we were censored at those neighborhood meetings two weeks ago our representative Larry Weitzel was promised to meet with you Mr desiccio and as we heard earlier that never took place why are you working against your constituents I don't understand this did you already make a deal with the Developers the purpose of this council meeting is for Council to listen to the facts and to make a determination unless of course votes have already been decided at issue are setbacks step backs Ingress egress a huge Traffic Safety concern not one neighbor that I talked to regarding petitions was for this why wouldn't you want a project that serves everyone this can be accomplished by granting a continuance so all the stakeholders get together in one setting to include but not limit it would include City staff departments both District neighborhoods the developer not just Council we welcome the opportunity for all parties to hear all parties and arrive at a consensus for success I recommend or I ask that you look because the uh looking at the calendar the holidays are fast approaching we ask that this matter be continued to the second council meeting in January in the meantime all stakeholders will meet in one setting and come to a consensus I thank you thank you we can be heard I will say that this developer unlike any developer you know for the right reasons has done Outreach and they've taken into account at doorsteps how people feel they've taken their thoughts their considerations they've passed it back into um you know the developer and the developer at Great cost has listened and a great cost has taken into consideration uh all the things that put before them well unlike a lot of developers they generally do take into consideration and have tried to make a lot of changes to try to help all those people you know over the last months that have put their input in all of a sudden there's been this big Siege of people putting input in even from like I think one of the people said nearly a mile away you know four neighborhood associations away you know they all think they have a horse and a race but they don't the people who have a horse in the race basically or more so probably on the east side of the street behind that property their voices have been heard they have said that they you know think this would be a good development anybody knows that if it's a blighted underutilized property that does not bring values up homelessness on that property does not help bring values up they're picking City people's advice sometimes it says maybe a light is the safest thing safety is important people have been doing this a long time they sit in these offices because they know what they're doing I trust the people in the city council I trust councilman to make the right decision and I feel like approving this is the right decision thank you thank you and speakers are not required to say if they live or work in the area but I personally find it helpful if you can just tell us how you're connected today William is next and then we will go in person to Mary Crozier uh my name is Saul my address is 2221 East Georgia Avenue I'm a resident of the Windsor Square for over the last 32 years I've reviewed the plan submitted by the zom living on the 7th Street site and I'm in support of the project as a neighbor in the Proxima the close proximity to this project I attend I have attended a number of smaller number neighborhood meetings and respectfully it is clear that the neighbors don't like it and don't represent my position on this project the neighbors want the developer to dramatically reduce the height the density and and the setbacks but the issue is this is a two Acre Site and pretty obviously the developer can't meet their requirements and still have Financial viability for the project to work is really no surprise that they don't agree people are pouring into this city from California and a number of other areas in the country we're the highest in migration of people uh in the United States today so where are they going to live as many of you are aware in February of 2022 controversial Bill 2674 was introduced at the legislature which would allow the state to override local zoning and eliminate single-family zoning in the Phoenix and across the state this bill is similar to one passed already in California that will allow up to eight homes per acre versus the current three per acre this bill wants to dictate Heights setbacks and use of land interesting point this is the same opinion these opposing neighbors are saying on the zombie project which by the way is outside the their HOA boundaries however I'm 100 in agreement with the North Phoenix central uh HOA board and others in opposition that this bill would be policy and I'm glad to see that it's not moving forward however if it isn't a wake-up talk wake-up call to us the nembis have to need to have the housing I don't know what it is trust me this bill in Chambers Mary is next followed by Chuck Knowles honorable mayor and members of the city council it's been a while nice to see you all again I'm Mary Crozier president of the North Central Phoenix homeowners association councilman decisio I hope you will agree that the north central part of your district is point of Pride for the city five neighborhood organizations and hundreds of your constituents support multi-family project at this location we understand the need for new housing for our growing city any comments to the contrary intentionally misrepresent our position we are requesting three very simple things one is that the setbacks are 25 feet from 7th Street to be compatible with the neighborhood and other multi-family projects right now the Pro's design standard is 15 feet that the building setback step back excuse me is consistent with the recently approved apartment complex Broadstone on 7th to reduce the building's Normandy and massing on 7th Street that the city's Traffic Engineers ensure that the vehicular access to this high-intensity project will be safe for everyone including new tenants and the surrounding neighborhood we don't know that to be true right now that's it we're really not asking for anything more we're not asking for a massive five-story exposed garage to be underground we're not opposing the height the density the design nothing these requests are identical to the ones expressed to the developer for eight months by Planning and Development staff we naively assumed that planning would push back and insist on these changes after all that's their job instead they were and I quote heavily politically lobbied and that these concerns inappropriately disappeared we are asking you today to make this proposed PUD a win-win for everyone especially your constituents the developers of four and a half billion dollar company we've spoken with their architect and believe these changes can be easily made without compromising their profitability everyone wins the earnhardts will learn how it called earlier failed to mention they own the property will be able to sell their land Michael lead can make his commission the developer builds a superior product and your constituents will have been heard we are asking you councilman decisio and all city council members to support these three easily achievable and reasonable adjustments that Echo the expertise of our city planners thank hearing us my name is Chuck Knowles I'm a fourth generation Arizona and my grandfather served for 30 plus years in the state senate from northern Arizona we founded the city of Flagstaff a little city up north back in the 1830s but the I now live at 901 East Colter Street I'm the president of the homeowners association there and um um I have an alternate universe from what I heard earlier with the dots on who had responded in my community as the president of the association I was never contacted nor were any of my residents notified of what was going on because we weren't a neighborhood association we're a homeowners association so I've rectified that we are now a neighborhood association but we're concerned about the traffic light we're concerned about the setback we're concerned that we have one story units we have 48 one-story units in our neighborhood and we're less than a block away from this new development on the same side of the street I wonder if anybody has thought about the the implications of putting a traffic light in at that intersection when anyone who lives in that complex or in my neighborhood wants to come home from the north side of the city because we would be prevented from turning left into our own properties not only at that intersection but at any intersection for a mile and a half you would have to figure out how to get into your complex because no left turn would be allowed we've had a terrible traffic problem as an HOA we commissioned through the parking and traffic zoning department of the city a study of the of the traffic in our area and they determined it was above the speed limit but we would have to Fork out of our own budget for Speed bumps so in addition we also have an incomplete eighth place uh to the north of East Coulter eighth place is a full City size Street to the south of East Coulter um eighth place is only half a lane there's not two lanes there yet we're going to have two lanes of traffic going in and Camelback Village area projects like this need to be approved in order to continue to grow as a healthy Vibrant Community in the future out of control housing costs lack new housing and that needs to be supported ASAP as Phoenix's number one in the US was with inflation at 13 we need to stand up for the future of Phoenix and for its economic future and viability no longer can we entertain these out of date processes from single-family neighbors and want to dictate and judge their version of appropriate quality development projects outside of their boundaries using the same tired arguments over and over again like it or not I know they have their little American dream of a single family home however they're going to open their minds and move over and understand that Millennials also want to live in these nice areas and we might have a different viewpoint on appropriate living for our active lifestyle the single-family neighborhood west of 7th Street is beautiful and it can be a really great place to live however the good news is this project will not have any negative impact on the area Phoenix is the fifth largest city in the country and our city is not just made up of single-family homes uh I would not want to live in a community that was just single family homes now restaurants no retail shops no and no apartments and uh I just would not want to live in a community like that it's not a modern way to live and news flash not everybody in Phoenix wants to live in a single family home I can speak from experience I lived in a building that was really nice and luxurious for about six years and I didn't have to deal with any of the maintenance I got to live a high quality lifestyle at um an affordable price and people my age Millennials gen Z Gen X kind of prefer to live in places like this not tied to a mortgage they get lots of amenities for their active lifestyle like this zom project would would give them with no maintenance responsibilities so we need to support this project um this project we will stay virtual for one more comment Nicole Vasquez while we bring a microphone to Margaret hagram Nicole the floor is yours okay thank you my name is and my address is 1027 East Palmer and I've lived in Central Phoenix for 12 years I'm in support of this project at 7th and Coulter I believe this is a critical opportunity to revitalize and add more quality housing in this area we should continue to support quality projects like this as this is a key to spurring reinvestment in the area not everyone in our city wants to live in large lot single family homes this project is outside the boundary of these HOAs and as mayor and Council and leaders in our community you are charged with the determining a vision towards the future it's clear with the continued growth of Phoenix the demand for more dense housing will continue and I believe these projects should be along our major transportation corridors like 7th Street I believe your focus should be less on density and more on quality which this project stands out if companies cannot find housing for their employees along with quality schools a talented Workforce and strong communities they will stop moving here the State Department of Housing has said we need to build 270 000 new homes and apartments to keep up with growth if we don't build places to live the Intel's American Express and the semiconductors of the corporate world will stop moving here thank you for your time and I hope you vote to support we will go to Margaret next Margaret will be followed by Mike freret is it on okay um thank you mayor Gallego and city council members I'm Maggie Haugen president of the Imperial Plaza HOA known as Kensington Condominiums we are next door to the proposed project my purpose today is to clarify why the council should consider continuing this case to provide time for a discussion involving all the stakeholders and developing a project that meets the needs of all the stakeholders I feel like I'm in a fairy tale Jack and the Beanstalk Jack Zola planted a seed The Proposal the project was smaller in concept with a parking garage on the north side of the property aligned with the parking at Kensington and the access was on 7th Street that bean has grown and grown and grown the setback has shrunk to accommodate the increased growth the parking garage is now on the east side of the property next to the Kensington windows spewing pollution from the parking garage into the Condominiums access via culture will cause an excess of 200 Cars to use the Narrow Street of Coulter from eighth place to 16th Street on Coulter is mostly single family residents moving a plethora of cars through this quiet family neighborhood it's an accident waiting to happen the scope of this project as Zola presents it now is not conducive to the area concept the project will spoil the visual Aesthetics of the neighborhood after reviewing all of the information we request the council to go to another fairy tale and huff and puff and make some changes decrease the the density of the to the original plan requires setback as currently in the area and change the garage back to the north side of the property with access to 7th Street thank you thank you council members thank you will next go in person to Mike I'm sorry I do my best and then we will go virtual to Mary's Arab and followed by Kathleen Cochran thank you my name is Mike ferret I'm vice president of the board of directors of the Windsor Square historic district I represent 300 homes directly west of this project council members we are not anti-development we are not anti-multi family we are not in we are not nimby's characterizations to the contrary are plainly false we are only asking that you require the developer to revise their plans to make the project more consistent with other developments on 7th Street north of camelback we ask that the building be pushed back a little more from the street as Mary crosier mentioned similar to the Broadstone project and we ask that the upper floors be stepped back so that the building doesn't Loom over 7th Street and our neighborhood like some grounded cruise ship that's it not one official at staff level at The Village at the Planning Commission and we've met with most of them have said that our requests are in any way unreasonable or unachievable not one and yet all these officials have permitted the developer to ignore our requests we are baffled as to why the city would so blithefly ignore this reasonable input during our meetings with many of you we often heard this wouldn't have happened in my district this way well this is called Comfort council members but council members this is your District North Central is an incredible valuable and important part of this city not just your districts and locals and visitors from all over enjoy and admire it please do not let its charm and attractiveness be needlessly eroded when you have the power when you have the duty to acquire these small but meaningful changes to be made please deny this PUD unless and until the developer incorporates these changes and please is Mary zarab and for years I have lived at 308 a West Maryland at Central and Maryland in addition I'm a business owner in the Carol Camelback Road Corridor where we desperately need more housing options I have reviewed all the plans on the zom living project at 7th Street and Coulter and I fully support this really cool design it is exactly the type of housing I would love to live in in my opinion it is a textbook case anubiism that exclusionary zoning which robs our growing city of its best qualities to use the word NIMBY is now listed in Webster's dictionary the definition a characteristic characterization of opposition by residents who oppose developments in their area over and over again to point out the obvious restricting housing quality options like this makes all housing less affordable for everyone in a city like Phoenix who is leading the way in the U.S is a Runway of population growth I hope you city council members don't give Credence to this tired and inflexible singular voice of only these single family home owners um that zoned it as is no longer realistic or sustainable this is a well-designed residential project that clearly outside of the neighborhood boundaries of all these people who oppose this project it produces quality housing that is badly needed on a major transportation Street like 7th Street um defensive to me that these opposition folks think they can show up at every project when they when many of them live a mile or some way I live I'm sorry where I work there's a lot of large apartment complexes and they walk to my store and they walk to the shopping center and they support all the businesses right where I'm at because we desperately need this more in Central Phoenix I urge you to support this project and it's the right project in the right location thank you Kathleen Cochran followed by Belinda Penrose you all hear me hello Kathleen could you be a little louder hello now we can hear you okay great thank you so much my name is Kathleen Cochran and I live at Windsor Square um it's so great to hear so many of my neighbors and the local community neighborhoods speak um today at this hearing I want to thank America Yayo and the city council for the time today and the opportunity to be heard I appreciate all of the service that you do um in making the Phoenix Community a very safe and uh great place to live my husband and I recently moved to Windsor Square permanently in 2022 March and we became aware of this project since that time we've been actively following it we want to understand or we want everyone to understand that we support development but that's development that's responsible and safe safe and here in the current zoning this developer could develop multi-unit multi-family units in a safe and responsible way but they've chosen to file an application for a PP via Phoenix PUD establishes that PUD zoning designations create a built environment Superior to that which is accomplished through conventional zoning the PE guidelines prioritize PUD applications such that they're compatible with surrounding areas the Zola site planned here is a 60 foot tall story five-story building that's zoned in a two-story building at the northeast corner of 7th Street and Coulter it is not superior to the existing zoning and it it is out of character to the neighborhood including Windsor Square I urge you to deny this PUD application and take into consideration all of the comments you've heard from The Neighbors [Music] thank you we'll go next to Belinda Penrose followed by Amy Brannan both virtual yes we can hi um thank you for allowing me this time my name is Belinda Penrose and I am a resident of over 30 years in Windsor Square I read every letter and all of the pre-written support forms attached to these hearing documents and what I read suggests that the number of supporters in favor of this zoning change is not as great as Mr Woods at all would have you believe here are the actual numbers individually composed letters of opposition to the proposed zoning change ranging in length from a single paragraph to over four pages long that was 81. individually composed letters in support of the proposed zoning change was just two the developer sent out paid petitioners to drum up support for the project buying them with tales of the supposed fits of the project after which they provided a handy pre-written statement No must no fuss simply a fix a signature and fill in the contact information and they're all done some of these proponents didn't even provide their contact information quite a few were illegible and some were simply duplicated when I counted up those canned support forms I found that there were 242. of those 76 were obtained from a business employee or business owner and that is fully 31 of those forms submitted in favor here's where I submit that it's completely disingenuous to suggest that commercial support for the proposed additional congestion in the neighborhood should be given the same weight as the residents in the neighborhood whether in support or opposition residents by definition reside in the area business people in contrast will go home at the end of their day we all know it's the residents of the surrounding area who will be left to deal with the consequences of this zoning change 24 hours a day seven days a week in my [Music] Amy Brannon is next followed by Patrick Birch hi my name is Amy Brannan and my address is 1322 East Coulter Street I live in a house and have a business in the area of this zom project and I'm in full support as a millennial our generation is Big supporters of this live workplace scenario that a project like this offers frankly from a purist planning standpoint if you want to lower traffic then it only makes sense to build more dense housing in these infill areas near employment centers it's the only way to lower traffic congestion rather than people having to drive from the suburbs to work every day much like I had to do it doesn't surprise me at the Phoenix planning staff is recommending approval of this project as presented city planners are trained to review projects with a vision towards the next 5 10 20 years and aren't supposed to review projects in the political knee-jerk reaction because the same opposition group of neighborhood folks are vocal against this project with the same tired arguments they use every time by attacking density height and traffic again I speak not only as a close homeowner but someone that owns a successful business in the area with employees I would love for my employees to have more housing options like this close to our workplace rather than having to commute from the suburbs every day Rising housing costs housing supply shortages and changing needs for individuals and families needs to be addressed without hesitations projects like this only go a small way that a huge goal of need for all housing types in the Camelback Village infill areas this decision required strong leadership and vision for the future from you as a planning board and from our mayor and Council I love this project as this is the type of housing needed on this 7th Street and Camelback area thank you very much for your time and I hope you approve it tonight Patrick Birch is next followed by Michael Miller Patrick I can't hear you no audio for Patrick all right Michael Miller and then we will go back in person for Beth and Susan yes can you hear me we can okay I'm gonna probably reiterate what a couple things have already been said but uh within the State of Arizona we do have a huge deficit in housing I think that's the biggest issue in my opinion when you have 270 000 unit deficit we need more housing I know for me as a renter within this city that you know at the end of August end of July excuse me the property owner where I lived informed me that my rent's going to go up 50 percent 50 percent I think there's a big reason for that there's a huge deficit which is a demand and we need more Supply it's simple economics so I know there's a lot of exchange issues people who live in the area don't like the idea of the building itself uh the density but the reality is that you have many many people moving into this Valley and housing is a huge issue first and foremost the rest of it um in my opinion is subordinate and that uh something has to be done about that that's the first big problem I mean I know where I have lived but people's rents went up so much they had they said well I have to go I'm going to buy a tent because I can't find any place to live now as far as supply and demand goes it's pretty simple the more Supply you have the and less demand that drives the price of anything down within the economy we know right now we are in an inflationary cycle I get that but I know I know a couple of folks that they they work in property management and their rates are based upon the vacancy they have within the complex if they have a lot of vacancy their prices go down if they're full their prices go right back up so to me that's the biggest issue uh thanks for your time thank you I believe these are our two final speakers and staff will help me if I am off but Beth and Susan both in the council chambers my name is Beth postma I live at Second Street in Orange I've lived there for 28 years and it's basically a block from this project I'd like to note that most of the speakers that are for this don't live in the neighborhood I've only heard two so far and actually I looked this up at the last meeting the speakers I was wondering why people would speak about this when they don't live in the area and and the lady that called in earlier I'm not going to mention her name I'll call her the virtual uh Millennial she lives at the address she gave is actually a senior a retirement home so I'm not sure you might want to Google it also and verify that um I do I'm also I learned something new tonight NIMBY I'm not a NIMBY I Am pro development I own a business in the construction industry and I rely on the growth of this Valley to be prosperous I Am pro multi-family housing in all price ranges why can't we provide housing without negatively affecting those of us who live within its proximity why hasn't the developer or their attorney Nick Woods collaborated and compromised with the neighborhood why are we the neighbors the only ones who have compromised from two stories to five stories it was mentioned that this project was only viable for his client as currently designed because of the cost they paid for this land why is the community expected to accept a project that is too dense for this small site Too Tall compared to all the buildings in this Corridor and too close to the surrounding streets in actuality a project could be built with the current height of two floors or even three floors that could provide much needed housing and genuinely be an improvement for the neighborhood and for the City of Phoenix the five-story apartment complex is not the only choice for a profitable development please don't approve this project as currently designed I respectfully request that stipulation to be attached that require the developer to truly collaborate with the neighborhood increase setbacks and step back design and 7th Street access instead of Coulter thank you so much for your time thank you Susan Rhodes bring us home right my name is Susan Rhodes and I back up to 7th Street from my backyard I see this development we already have a massive five-story development on the corner of 7th Street and Missouri that regretfully is a precedent to this development the houses there are backed up to those that develop that office development and there are two group homes because they couldn't sell the house there are two group homes there from cat um Villa Camelback this unique Sunrise setting is what you can see uh three streets back on 4th Street Kensington which you heard from their property owner this is Kensington this is in the shadow of their six of their uh five-story parking garage now first of all they're going to end up having to um they'll never see the light of day but the fact that they're going to have to turn their TVs up a little louder to minimize the the noise from the 200 cars that are going to go in and out of that parking garage is ridiculous this is via Camelback they have no balconies on 7th street I don't know how they got how we got the balconies on 7th street but if they did have balconies they would look like this the uh the traffic on Camelback is already a rush hour traffic and matter of fact on October 27th at five o'clock at that intersection we had a two-car collision with a um Austin Healey and a Truck this is the Collision culture has no sidewalks so the neighbors put up these signs to slow the traffic down this is east of 7th Street and this is east of 7th Street for those of you who are searching for a place to live please go to Vienna Camelback they have the large four lease signs all across the top of their buildings so and they I must I must guess that they have some open Apartments there so if we're searching for lease this is a good place the other place is I'm sure Central and Indian school will be opening soon so that's a massive complex here's pictures thank you all right so I'm going to ask our streets department director to come down we are still in the public hearing so council members can ask questions of the applicant and anyone who testified if they wish to do so the applicant has two minutes we will close the public hearing then we'll have a motion so council member questions councilwoman Stark followed by I think the vice mayor but we'll start with councilman Stark uh yeah I I have some questions about traffic and I know um that the vice mayor and I met with some of the residents and we talked about ways to slow down the traffic and I believe keaney that you suggested we look at a new way of doing our bike path could you talk a little bit about that certainly mayor councilwoman Stark and members of the council what's going on along actually on Coulter Street which I just is coincidental with this development is we have a project that's entering design phase right now it's a Coulter Street bicycle and pedestrian Improvement project and it runs from 15th Avenue to 20th Street and we've gone through planning and pre-design efforts through that but the whole intent of this project is to be able to create a safer more comfortable bicycle and pedestrian Corridor through east west through the stretch of Phoenix and it because of that so we haven't got through the design yet but there's opportunities for able to us to be able to look at ways to be able to improve the flow of of bicycle and pedestrians there and also potentially discourage some of the cut through traffic that we see that might come from developments like this along 7th Street and so with that we have a potential for a signal design there that we haven't got to design yet but there's opportunities to look at ways to be able to address some of the concerns in the neighborhoods and we would want to through this design process on our culture Street project to be able to have a robust engagement process with the community um not just the ones West in the winter area west of this development but also east of this development as well and so that would be an iterative you know engaged process and then as far as the um signal is their decision on whether it's an actual light or a hawk or will that be a part of the discussion when you meet with the neighborhoods and the developer there's no decision on it correct that that's correct mayor councilman Stark members of council there is not a decision on exactly how the design would be but we do know there are an accident uh Collision history it's in um as we looked at some of the Collision history at this location as noted by the developer through their traffic impact study that there is some Collision activity here we'd want to address through our design uh we also know we have to accommodate uh the the traffic on on Coltrane and working through that but we would be taking all that into account as part of looking ways to be able to make a better bicycle and pedestrian connection across culture at this as this location at 7th Street so there is still a discussion that remains that you'll be working both with neighborhood and the developer absolutely okay um that's all the questions I have right now thank you thank you vice mayor hi um I heard some comments made by some of the constituents that have many concerns and uh one of the comment was by Larry and the comments that were going on was about this has been in in um discussed for about seven months so probably a little bit longer um I wasn't aware of this until about maybe a month ago with Windsor so I'm I'm disappointed at the fact that uh as me being on the west side of 7th Street that I was there was no Outreach but I could probably can understand why there wouldn't be Outreach to me um and it is what it is the comments were made that uh staff had three areas one was setbacks one was step backs and no access on culture how did that change mayor vice mayor uh as you know when a staff is working with an applicant on a proposed project that it is taking place in the context of them working with neighbors and the community discussing things with the elected official who represents that area and then also working with staff and as staff worked through those issues and our comments are General comments that we tell applicants all the time to address issues and so we told them address those issues that you mentioned we also said go meet with the the residents and try and make sure you get some support for your project go meet with the elected officials that's part of the the zoning process that we say all the time and what happened in this particular case is the applicant as he came forward in discussions with the the client and the project they were not able to address the concerns and staff made a decision once the you know case was coming forward and about what did they do and the other good things that they have addressed and good parts of this project outweighed the fact that they weren't able to address those issues simply from the standpoint of it is providing more housing it is an area that has a high capacity Transportation core along 7th Street for automobiles but also for bus transit lines are right there as well it is surrounded by other multi-family development and Commercial development the closest single family is significantly far away from where that's at and so staff made the decision to support the project we never had said in all those prior comments we wouldn't support it we said we want you to address these issues and they weren't able to address them as much as the neighbors would like but they were able to address staff's concerns overall with the project that they were proposing and that's why staff was supportive of it knowing that this is a public process and the neighbors are going to get their chance to to state their concerns about it and it's ultimately up to the mayor and Council um appreciate that Alan but I'm going to push back a little bit on that and I'm going to push back because what I hear from traffic from keaney and from Palani is that we have to build a vision zero and we need to have Safe Streets we also need to provide pedestrian friendly areas and Arena and on 7th street as you and I have discussed that south of 7th streets on several of the projects that I have been involved in thinking that uh those projects will turn out to be very safe on 7th Street we realize aren't and it all is centered around setbacks and um and and and codes that I think we need to re-look at especially on uh the sevens and how uh we would like to activate the sevens but then don't uh put our money where our mouth is in the sense of making sure that that happens and there is safety for pedestrians and even motorists um and so I get that but on 7th Street there has been a conscious effort to really build that within that area and for whatever reason this project wasn't really we didn't stay true to this is what we want to see on the seventh the other piece is I asked Kenny about a week ago two weeks ago regarding uh coming off of 7th Street and uh that that was what we were that was what what was necessary and then I come to find out that no it was shifted and it came to culture so how did that change also is it because of a light mayor uh vice mayor uh I believe that the applicant uh wanted to have access more on culture for full traffic movements and so that was important to them as part of this project and so that's why the access uh was on culture because if there was off 7th Street they would not be able to uh have lefts right left turns right out of there they'd be limited in that instance and so that's why they were wanting to go to Coulter and I don't know if keaney wants to add anything else that or Josh so so now you're saying it's safe to come off a culture you're saying it's now unsafe to go off come off on 7th street and if there's a side street then it's safe to go on culture and when did this change this philosophy changed when we have told residents and this includes me on on 7th Street south of Camelback and and even on 7th Avenue mayor vice mayor Pastor sorry I I I I just don't understand mayor vice mayor pastora members of council uh when it comes to our initial review of the applicant's um site plan was when it had driveway on 7th street and as Allen noted in his comments that was uh changed to Coulter our primary concern with them being on the driveway off of Coulter was the impact potential impact to the Coulter bike and pedestrian project that I mentioned earlier uh I do agree with Alan's assessment that probably the reason was was to provide better access for the future residents of of this development and uh that's also brought in the signal discussion as well and how to be able to accommodate those movements I share a lot of the concerns that the council has and the community has about the potential impacts to adjacent uh neighborhoods and so we will definitely incorporate those sentiments in that engage engagement process through our Coulter Street project but the Coulter Street driveway does not is not incompatible for having a residential access onto a local Street like that but um I would say we're always concerned with safety and so if the driveway is on culture we will work through that with a developer to ensure that it is done in a safe manner thank you my other comment is that um I understand we're doing a my other comment is that I think what's going to happen to Coulter is what's happening on a lot of uh streets in my area uh especially off of Central and 7th Avenue that you're gonna regardless of how we we think about the connectivity and all the pieces that we worked really hard and staff that's sitting there really hard of working with the neighborhoods I think that's now going to uh change and it's going to change because neighborhoods are now going to have congestion of vehicles within their neighborhood and the quality of life will no longer exist and what what is happening as you know this kidney in District Four there are more and more requests to shut down the streets well the concept of connectivity in our city with re invent Phoenix is now in jeopardy because of the congestion that we're putting onto the streets and I do know and we can we can go back and forth that we're hoping that people will take public transportation and we'll walk uh live play and work but that's not going to happen to quite so many many years and in different pieces and we do need quality residential but we also need affordable and Workforce so I don't want to mask this with we need more housing in the sense of are we building more housing for more companies are we building housing really to build affordability and work and Workforce and more companies and how does that really look like and how do we balance it and keep a quality neighborhood um and what what I find very offensive in in having this discussion is this nimbyism piece because I support responsible development and to me responsible development works with communities within their existing areas because those communities have been supporting the City of Phoenix for decades and now new development wants to come in and those neighborhoods will support those developments if they are working with the neighborhoods the request was could you do setbacks could you do step backs and could you have the traffic go off on 7th which followed all the planning guidelines and somewhere it shifted the other piece is that I believe Alex made a very good comment and I would like to see this and I we can bring it up at an at another time and space but I would like to see these cases that sit on Villages borders to be heard in both villages because that is truly that is truly important because there is the Alhambra and there's a Central City and seventh divides it and it's impacting all those neighborhoods within the both villages so I'm just I'm making my comments uh I will not be supporting this project thank you thank you vice mayor I'm going to turn Tech councilman O'Brien for a question but I just want to follow up on on the final comment that vice mayor made what could we ask the development Advisory Board to look at these issues when it's right on a boundary a political boundary maybe it's two Villages is the solution or maybe we invite the adjacent Village just I think there's got to be pros and cons but I think there is a opportunity to improve projects mayor and Council we can certainly uh you know look at that it would add some time to the development process and uh as as you uh hear from folks there are concerns about that as well at times but we can certainly uh accommodate that and try and make that happen on a border to have them attend both Villages if that's the the direction of the mayor and Council and one of the things I suggested was have the adjacent Village attend the village that is home to the project which I think would not I mean I guess it would add a little bit more time to the meeting if more people asked questions but not and mayor I will just point out that the notice requirements don't stop at a village they're based upon property owner uh and registered neighborhood association so it doesn't matter that you're in in this case uh you know Camelback East or Alhambra it those people who are impacted are noticed the same they're just told you can attend the Camelback East Village planning committee because that's where that one is at versus Alhambra so it it doesn't do anything the people that are really impacted are going to get noticed one way or the other other than adding a different review body to make a recommendation or they show up and speak at a at a village uh you know and and state their peace on it which they could always do but they're not officially noticed as part of the process but we're happy to look at however the council would like to try and just I think someone also pointed out we noticed neighborhood association but not an HOA and so it seems like there's opportunities to make sure that people who are deeply impacted and mayor would like to just clarify for anyone watching as well it's any registered neighborhood association with the neighborhood services department so there are not HOAs there are just groups who register through neighborhood services department and then they receive notice that's how we Define what uh what a group is and we can then find them to make sure applicants notify people on that so uh you know we want to make sure everyone's clear and aware of that and they can do that through the city's website for anyone watching thank you councilman O'Brien thank you mayor I appreciate it um so clearly residents have concerns about the height and density increasing Beyond downtown and the light rail Corridor how do we assure that our residents that approval of requests like this don't set the stage for future development that may be incompatible with the neighborhood so mayor and councilman O'Brien I think that's a great question and one that staff you know always looks at as part of these rezoning applications as you know there they are individual requests that get evaluated and staff looks at where what's the context of a particular you know site and location and so well this one meets the criteria to earn some staff support because of the surrounding area that I described in what's there from a multi-family and Commercial perspective there are areas to the north of this for example there was a a Broadstone project that was referenced that is uh you know much lower uh in in height and density and that one went through you know a significant amount of public comment a few years back and that was because the context in that area is f was not as supportive as what we are here the context is different here and we evaluate those each time and we do make sure that we are looking at at the the context and I I do want to address a couple points that some of the the neighbors brought up in terms of the height and what is what's proposed as it relates to a setback here and so the Alta project that was referenced is on 7th Street just south of Camelback and they have a 10-foot building set back along with a five foot landscape setback north of camelback but south of Missouri is the proposed Zola project where they have a 15-foot building set back and they have a 11 foot landscape setback that was shown with the bio Swale and what's there and that's partially in the in the right-of-way but that's moving the building back from the perception of the public driving by and then the Broadstone one that was referenced by some of the residents has a 20-foot building setback but only has an eight-foot landscape setback so when you look at how those really lay out this is in the same ballpark in terms of that building mass as it relates to the street Frontage and so there are you know concerns but I think a lot of those concerns are ones that staff is aware of and tries to work through and make sure that we are getting appropriate setbacks from those projects they just happen in a slightly different manner in this particular case with the increased landscape setback that is in the the public right-of-way area as opposed to just on private property thank you thank you going back to our streets director could you talk a little bit more about the opportunities to restrict cut through traffic in Windsor Square and surrounding neighborhoods mayor councilman commandment members of council the the when we go through this culture street bike and ped project uh there's opportunities to do different um devices and different signal set um designs in there that would emphasize the the bicycle movement across Heaven Street at Coulter but it also has the opportunity to be able to restrict uh movements um either east or west or or making left turn movements into an outer and that's something there's options out there other cities have done them where they're looking at bicycle projects like this where they've restricted access in there in certain neighborhoods in order to be able to reduce that cut through traffic and really to lower some of the volumes of traffic to make it more safer for bicycles and pedestrians I don't want to necessarily forecast the design of that because I would want to make sure we're doing that with in in close coordination with the community hearing what they say and what they would like to see so that it works well with our Coulter Street project but it would potentially you know one out there could restrict West westbound movements on Coulter from going across 7th Street into the Windsor neighborhood which could be one of those restrictions and then can you speak there was some enthusiasm for Speed bumps is that looking like a possible solution or not a solution but progress mayor members of council I will tell you when we look at if speed bumps and speed cushions are done outside of a city project that is something that's definitely a neighborhood-led process to do that and so there's a petitioning process to do that because we want to make sure the the neighbors are very supportive of doing this when they go through and do do that when we're talking about potentially doing traffic calming features like speed humps or speed cushions or other things like chicanes or diverters things like that through a city project we will still go through a community engagement process as part of our project but we can include those elements within a project like culture Street could a developer deposit funds for Speed cushions and then if the community decides that's not a good option it would be returned yes mayor and members of council we we do work with developers and working with Planning Development to look at options to be able to do escrows we'd like to have any escrow funds identified for a particular purpose because it makes it easier for us to identify with Acosta and how we would use them in this case for example this developer is proposing on fully funding a cost of a signal not knowing what that signal will actually look like at this point time because we have to go through the design process but we do appreciate their willingness to contribute that towards that cost because we know we're going to have to put some kind of signal in there for as part of the bicycle pedestrian project wonderful thank you I think we did hear a little bit more enthusiasm for Speed cushions than for the signal from public testimony today all right additional questions then we will welcome the applicant back for the two-minute rebuttal may I remember the council um what I heard from the opposition was uh very long on attacks on staff on Management on councilman deciccio on my signature gatherers and on me but very short on any kind of constructive ideas for our project so let me answer some of the and really the chuckles are a little childish as well so in any event if we could pull my uh presentation backup please go to the beginning please next slide um yeah as you can see 7th Street as I mentioned earlier is six Lanes wide and it's it's a dual land use right in the morning there's four lanes coming in and at night this falling is going out um and you can see where Oregon is which is that street that's right across from ours if we go to the next slide please next slide next slide so the suggestion is that somehow we should have a curb cut on 7th Street um we do not and will not allow our residents to have to navigate their way in and out of this site off of 7th Street I mean are they going to slow down when traffic is coming through at 60 miles an hour I hear we don't want us traffic light but we know and we sat out there and I sat out there with the neighbors um for half a day we met in the office building to the north and we went out there and looked at it and the traffic was was rolling by 50 60 miles an hour I don't want my clients residents slowing down to turn into that curb cut and I don't want them having to come out no way to turn left because there's no way to do that so they're going to all have to turn right and then doing u-turns to come back that is the safest position that you can see right there is there's plenty of queuing Lane same thing with garbage pickup I cannot have garbage trucks pulling in and out of 7th Street thank you and actually um can you speak to speak uh depositing funds for Speed cushions I'm sorry mayor I didn't hear that speed bumps or speed cushions oh we're happy to support those men but we are happy to support those okay we're putting up almost 500 000 to deal with all of these issues uh uh through the streets department and then there was a question about the 20 units and the um yeah the 20 units on Seventh yeah if we could pull that site plan back up please um it's not just 20 units mayor why would we take of you know three floors right times ten thirty units out of the project if we go back to the back please um right there next one please as you now forward please as you can see there's a double loaded hallways along 7th Street if you take off the top three floors of five floors you end up losing all of those units from one side the other so it's 30 it's actually almost 34 units it can't be built that way um as far as the setbacks are concerned which is intended with that with that step back we go to the next slide next line right there we stepped the building back at the neighbor's request and you can see it step back so far that our property line is where that broken line is to the left of the gentleman in the white T-shirt so all and part of the Swale all of the city's sidewalk which have now agreed to make seven feet is all in our property so we have stepped the entire building back but then when we stepped the building back now we're suggesting oh by the way take off your top three floors in the front and step it back even farther um and again you know the buildings half a block up is 65 feet and then all of the other four of the other projects that are nearby uh apartment buildings are 60 feet as well thank you any final questions councilwoman Stark thank you I guess I I want to hear from you the question I know the vice mayor asked of staff you had an original site plan where you showed um exiting only off of 7th Street no this was for you Nick I said I was going to ask you the same thing that vice mayor had asked of staff um so the original site plan did show um everyone exiting off of 7th Street and not using culture why did you guys want to change that for mayor council member Stark most for safety I mean obviously when we start a project then you know the architect is working on a land plan you know they're looking basically at the design and the layout and how things might work but then when we start looking at you know the traffic like I said we stood out there and watched it and then we talked to our traffic engineer um it really is not a safe situation to have a curb cut at that location anywhere along 7th Street especially since it would be um if you put it across from Oregon we can't line up with that with that curb cut but that street so we would have an offset um I can't speak for keaney but the streets department doesn't like offsets because it creates conflict to put it in the Middle where the other curb cut is across the street we can't design around that so again the initial design was that we were going to put it on 7th street but then as we really you know went through that process and looked at things on the ground it just didn't work one other thing if I may with your permission if we could move forward a little bit through my presentation keep going keep going keep going keep going keep going keep going I'm sorry a little bit more um keep going another one another one right there uh back one please or two one one more back there we go that's the entry into Windsor Square on Coulter coming off of 7th Street um uh when um councilman tripkin who sits on the Camelback East Village when he was a council member he said that he was responsible for putting that in to keep traffic actually from going into the Windsor Square subdivision from 7th Street on Coulter um so you know you've heard about cut through traffic but this was designed to stop that from happening now can people disobey the law sure it happens all the time but it's not one of these things where people will quickly go through if you take a look at the next slide it's not even a straight cut you really have to do some maneuvering to get there so so again like anything else as you heard Alan say you know an application evolves over time as we learn more information about the location the Dynamics around the location as we talk to Neighbors on on all sides and but more importantly you know what's a safe way to handle you know traffic especially and this is what our traffic engineer came up with and I have to rely on our professionals foreign thank you thank you close the public hearing turn to councilman decisio thank you mayor I'm going to make a motion that I'm going to make a couple comments I'm going to make a motion to approve for the November 16 member from the planning and development assistant director and adopt the related ordinance that's my motion okay so mayor just want to address a couple things first the Colter exit I favored putting it on 7th Street originally until I went out there and then you go out there I'm not going to be responsible for somebody getting hurt or dying on that street there's just no way the Coulter exit is the most logical place to put an entry in an exit at it's the most logical place and it is the safest place to put it and if we were to do as we've been accused of doing politics well the politics would be the best thing because it would literally eliminate most of the complaints if we did that but then again I'm not going to be responsible for somebody getting hurt we are putting you know if you look at what's happening across the country and some states are actually mandating density on major roads like this they're mandating it they're overriding cities because of the politics of it if you support and believe that that these individuals are going to be using mass transit which they are then you want to put them on major streets that's why I've been very supportive of putting density high density in my district on major streets because that is where it needs to be if you're going to be able to support a mass transit plan this project is designed for young people it just is these are the same young people who will take transit because people like me probably won't I have my own car these individuals don't afford that cannot afford that they want to be able to live there these are the same young people that don't want to live in a home cannot afford a home these are the same young people that service us they're the same ones that work in restaurants they work in the retail industry that is those individuals that do that these are the types of individuals that live here I've heard from the same people except you know I know it's not all that are here but some of the same individuals fought a senior housing and said it wasn't compatible uh in their own area they said we don't want this here you can stipulate a project to death to kill it that's how you do it I saw it happen with the senior housing that I believe it needed to go individuals that seniors that wanted to live in their Community live next to the young people I had an older father at the time they lived less than one mile from me it was fantastic because he fell down one time five a.m I was there I made sure he stayed there but these are the same individuals that fought a senior housing fought it and killed it so I wasn't going to let that happen here because this needs to happen for the young people too we need to have housing for them they can't be anywhere else they need to be on major roads the Coulter exit like I said needed to happen there I didn't support it at first I'm the one that insisted on it Beyond 7th Street until I went out there and saw the type of traffic and realized it's just not safe and I wasn't going to be personally responsible for that so if you look at this there's a reason why the village supported this overwhelmingly the Planning Commission supported it overwhelmingly the 347 individuals and homes that supported this they did support it now a lot of people didn't support it as well and you're starting to see that throughout the City of Phoenix where it's going to be divided but those people that are in support don't normally come to meetings like this it's generally individuals that are in opposition to it so from my end of it I'm strongly supportive of this it needs to happen I've been very supportive of other projects like this even though I'm not a huge mass transit fan but if you've got the system and you've got billions of dollars invested in it then that is the most logical place to put a higher density and I am supportive of the the type of density that they put in here I'm very supportive of the project I think it's an extremely a quality project it just is it's a very good project and it's needed here for the housing that we need to have we have a shortage of housing I don't know where people think people are going to live so like I said you can stipulate something to death to kill it I've seen that happen multiple times and I saw the same type of stipulations that were being required of the developer here that would have eventually killed the project because that's just what they would have ended up doing so I'm extremely supportive and I'm a yes vote on this thank you mayor thank you councilwoman Stark um councilman we added some additional stipulations including increasing the width of the sidewalk and um some money being deposited with the city of Phoenix so look at how this traffic control device should look and also some stipulations with regards to public participation are you okay with those completely supportive and some of these were I think that Laura pastor had asked to have them included in here and I did I wanted to make sure that we accommodated that the other thing is I can't also I should have brought this up too it was in my notes I just saw it but I believe that staff can easily design this thing to make sure that traffic does not go west of 7th Street I believe that there are some design features that can work there to make sure the traffic doesn't go west into Windsor and I'm very supportive of that as well I just want to make sure it's safe and my at least I call it direction or whatever you want to call it at the end of the day you guys make the determination that we have the public process but it just has to be safe that's it um and you've heard me harp on that before not just on this case but other cases which I believe staff is and I do have to defend staff on this too they've just done their job they're not going to design something that's unsafe they're just not going to do it you know they're just not going to do it and I'm glad you don't do those things you I'm very happy that you don't and you suffered through the pushback that people like myself and others who insisted on One Direction and quite frankly at the end of the day we can't do that we're not design people when it comes to that you are you're the experts on that and I just would like to make sure that it's a safe project thank you mayor thank you for that and I'll turn to our Deputy city manager just any yes uh thank you mayor uh members of council the the stipulations that uh councilwoman uh Stark referenced are in the the memo that came out this afternoon there were copies uh available in the back of Chambers but it encapsulates those uh stipulations that were talked about and I would like to make a slight addition to stipulation number 11 based upon the the comments here today uh where there was discussion about using speed cushions and uh Mr wood said that his client would be happy to use some of that money that they've already agreed to pay for other traffic mitigation devices and so what we would need to to do is before stipulation number 11 that first sentence uh where it ends currently at intersection we would need to say or other traffic mitigation devices on adjacent streets as approved by the street transportation department and so that would allow the 460 000 dollars a portion of that to be used for Speed cushions because that was part of we heard from the community and the council concerns but that would be up to streets and working with uh through the process on the Coulter uh bike pedestrian program wonderful and for the maker of the motion and the secondary we're okay so it would change 11 so that whatever traffic control we come up with the money could go towards correct councilman councilman all right any other comments roll call decisio yes Garcia yes cuardado yes O'Brien yes Stark yes Waring yes a store no there you go yes month and they don't even know what Christmas is going to be because we have to get up and leave from this place we haven't had no actions taking care of us I know they said they would come and we want to hear for them we haven't heard nothing tomorrow we have a meeting with the city which the city only helps us only if we are renters we're not renters we're owners we're owners from our trailer cards which we are being removed maybe if we have a buy a house or something but there's stipulations for that too these people need homes now they need a place to go to now our children are crying out loud they're waking up in the middle of the night permanently terrified crying our kids are not going to have a Christmas they say they're not gonna have a Christmas because we got to save money to move out it's not fair for them it's not fair for us the elderly we need to be heard we need your help we need lawyers to help us I get it our property sold they're the owners we get that but where is an elderly like we're going to go live with a thousand two hundred dollars with no rents are a thousand five hundred these people from California are building up all these wonderful places are they going to be worth for us I don't want to go live in the senior citizen place I want to be with their children like the gentleman said I want to be picked up by somebody that's going to help me I don't want to be just there alone because of that older man he'd probably fall down and die with me too I want our children to hear at least we're at home we want homes for them by the end of this month the Casitas are getting to have eight families that need to move out but then this month they're not even thinking of Thanksgiving or Christmas or anything they just want to be a home and it's not fair we happened there because we heard from your staff for three we had three meetings with staff so we know exactly what what was said there and basically it's not it's not being uh it's not being addressed that's the truth so uh what they're requesting is an actual uh item on the agenda so they can it can be discussed publicly and I think one of them is going to read it later but right now uh it's uh is first before I begin my time I'd like to acknowledge our ancestors that have gone down this path and are guiding us today and given us strength because they have gone down this path of land use and displacement for Generations we're here today uh to say that the city council or the city managers report um is just a beginning it's not the end of the discussion on the displacement of mobile home residents and mobile home parks there's not sufficient viable Solutions in the report and we need to continue the reality is that this should not be the end of the discussion but only the beginning it's only the beginning right now Economic Development means economic Devastation to the communities of residents in mobile home parks displacement for them means their lifetime investment we're talking about Investments of families working poor families that have been invested in mobile homes the elders and families are being demolished their dreams are being destroyed and it's time for the city council to take action and step up to this challenge of displacement of mobile home residents and that's why they're requesting that you put it as an item on the agenda thank you thank you Mr Ruiz is next Martha Gutierrez Proxima hello my name is Alondra Ruiz I'm here from Periwinkle mobile home park where we're still facing the displacement um of May 28 2023 I will read the citizens petition that we have um in The Recess follows citizens petition to add city council agenda item to address displacement of mobile home parks the residents of three mobile home parks Las Casitas Walden Court and Periwinkle mobile home parks request the City of Phoenix Council to place the an item in the agenda to address the displacement of our families and others that are in Peril of being displaced from their mobile homes the City of Phoenix is facing a housing crisis already in today's market mobile homes are the only affordable housing available hundreds of families are at risk of losing their homes and in our stable communities established decades ago by the next city council meeting at least eight residents will be displaced by the a foreign corporation while the city manager manager has issued a report that outlines immediate options the long-term recommendations like creating a mobile home park zoning overlay is not recommended even though there is a there is legal precedent to do it although the city has responded with emergency resources most fall short of providing families adequate assistance some programs require you to be or require us to be homeless to qualify for them or or we can find a place with help for one month and or a rental that is not affordable to us either way we will still be facing homelessness unfortunately we will be joined in the streets by others we will join others in the streets unless the city places priority to protect residents of mobile home parks the city must not continue to cater to special interests placing profits over people housing is a basic human right that must be respected and not destroyed please do not allow us to be homeless and help us by placing us on the on the agenda we hope to find resources that new citizen petition on racial healing in a day of remembrance for remain prison first in 2020 mayor Gallego accepted the citizen petition submitted by myself and Mr Kim Baker for a day of racial healing because our currently growing national and local awareness the biased crime particularly through our Police Department's recent proactive edition of a biased crimes unit and the inclusion of the operations order 1.6 on the prohibition of bias-based policing Mr Baker and I will now be submitting a recently inspired version with a new title and text a day of racial healing and the eradication of all biases per the recent permission given to me by the W.K Kellogg Foundation secondly since Mr brisbane's death change has been ignited by eight years of actions that included 10 solutions to build trust in our city a collaboration between our Community Coalition and police leadership that brought over 2 000 body cams into use civilian oversight in an early intervention system and year-long projects of a book club on racialized trauma and of public Forums on how we heal and on how we create a Beloved Community through the betterment of policing now let us have a moment of silence to honor remain Brisbane who left behind four daughters and a legacy of racial Justice and racial healing I'd like us to have this science until the signals sounds thank you foreign Barker will be our final speaker good evening I reside in district 7 in downtown I enjoy living downtown we are changing a whole lot we do have traffic problems but I can see you know what we've when we shut down the streets we won't have as many traffic problems I say that little facetiously but it's nice to see the mayor I saw her at earlier meeting over at mag in the city council and I went to the Board of Supervisors today and if you try to go on YouTube to see their meeting it was an unfortunate coincidence because we had a lot of irate people that were over there disliking the way that the county ran the election and they there were disfranchised many of them and told real life stories of how they were unable to go to their particular voting Center and vote and some of them went to another Center and some of them apparently weren't unable to vote but the YouTube connection that is typical over at the board was not working today so they did record the meeting if you go to maricopa.gov you would like to see that presentation because again there was the agenda was pretty short but the public comments were long and some people wanted to actually recall and recount and hand vote the election and they were told that um that's there's no state law for that and that they'll have to go to the legislature so I'd like to share this with you some of you may know what we have is is that the federal government suing the state of Arizona elect they filed this because the federal for three decades has been trying to help people to get access to vote and not have like overburdants and rules in signing up but with that it makes it so that there is no ID if you're you don't have to if you use a Federal Form you do not have to provide an identification to vote so it creates a real controversy because the State of Arizona legislature has a bill effective in January that if you're going to vote in Arizona for any election you have to have ID so some of the people that were disheartened are now told to go to the legislature and make your voices heard on these issues thank you thank you we are adjourned [Music] thank you
