is decked out as is Councilwoman seaman and oh how about mr. career here Wow that's vintage Vegas sweatshirt I think it's the first I've ever seen it it's your bling and of course councilman Anthony has his black suit on and his matching of proper shoes so you're good your tie sort of reeks though okay so and look here counsel and dancing Wow really in okay so well I mean since you're right on this morning we start off with you you have the Citizen of the month Thank You mayor yes I do but before we get to the Citizen of the Month presentation I wanted to acknowledge that from September 15 through October 15th our nation celebrates Hispanic Heritage Month recognizing the wonderful contributions made and the important presence of Hispanics and Latin Americans in the United States our October October citizen of the month is a leg with the advice and she has prepared a performance for us in honor of Hispanic Heritage Month however before I have her performance and presentation come down here before us I do want to acknowledge the hard work of our own city employees who have organized a committee have put together events for enjoyment of our citizens and we would be remiss as a council and the mayor to not acknowledge the hard work of our people that make us look so good every day so I'd like to invite Rocio Martinez and the organizing team that have participated in all the events some of us attended the coffee across the street at the downtown Las Vegas Starbucks that was them in the works this past weekend we went in we reached we touched up a neighborhood in my ward with fresh paint on the hydrants and the curbs and we are also going to put the cherry on top on October 12th we will have a culminating event it will be a family fiesta at the East Las Vegas community center and we hope everybody to tuning and can come and partake in the festivities and just celebrate with us the amazing contributions of our Hispanic books so I would like Rocio to just say a few words on behalf of the team thank you very much I wasn't prepared to speak today but Thank You Councilwoman mayor and members of the council I think I can speak on behalf of the Hispanic Heritage Month committee that we're very appreciative to have the empowerment from our leadership to plenty vents like this and to really be inclusive and let everybody know that the city of Las Vegas plans events for everybody out in our community so thank you so let's give them a round of applause for their efforts thank you and so with that mayor I'm gonna invite this you and the City Council to I would like the mayor and the council to come and join me so that we can now go to the next part of our ceremonials which is to acknowledge the hard work of our citizen of the month but I wanted you all to see the colorful vibrant warmth of our Latin American countries I mean we have a quad or Peru Panama Venezuela El Salvador Mexico Panama Peru I think I there's so many I can't capture all of them but I think the ones that are represented here today I want to say thank you to all of you you too for being here this makes this meeting special to us but even more special to me as a person that I chose to be my citizen of the month you see this woman has been basically making sure that we do acknowledge Hispanic heritage not only on his back during Hispanic Heritage Month but she's been doing it for decades she landed in this valley in the 90s there weren't very many folkloric dance troupes in the city of Las Vegas at the time she arrived she came from Mexico City she used to admire at the tender age of eleven all of the dancers that she would watch on the fabulous stages there in Mexico City and she knew from that that that's what she wanted to do for the rest of her life she wanted to dance and she wanted to partake and the fabulous cultural activities that she saw before her eyes and so when she arrived here in the 90s she saw there wasn't really much of that happening in Las Vegas and she took it upon herself to start Mexico vivo Dance Company and which have seen many iterations of folks coming through like myself I see these young ladies and it reminds me that I wasn't there that far back and I was one of her students at one time and so her worked is so impactful so powerful it really ensures that these young ladies are bilingual I love that they're singing in Spanish and their native you know language that they're taking to their cultural pride and that makes us just stronger and more vibrant as a community and so with that she's also done fabulous things she put together the world Folk Fest and she brought it to our downtown and she organized that World Folk Fest 16 times 16 years and that was economic diversity she was bringing dancers from around the world here to partake in that World Folk Fest and showcase our local talent and for others to showcase their talent and so with that he said thank you so much for everything you've done for the city of Las Vegas to make sure that we grow up seeing our cultural identity represented our cultural roots shared by you know with the community and just your labor of love because you put your heart and soul into it and you haven't changed from the day I've met you your passion and I call and I reach out I have this vision for this meeting and she just puts it together and she doesn't question it right that's just her her labor of love for all of us so he said up with that on behalf of the mayor and the City Council of Las Vegas I'd like to recognize you as October's citizen of the and Viva Las Vegas thank you so much just thank you Evie vice Allah Gutierrez so grateful beautiful beautiful ladies and costumes everything unfortunately you sang one song that I could sing with you but kept my voice quiet only councilman Anthony had to listen to the croaking so congratulations to you all thank you for all that you're doing to blend our community and enrich it okay oh my goodness and miracles happen here it is back that I hope that mayor pro-tem gave you on our behalf wishes for good health much happiness I'll wait as soon as we only have one more item if you'll wait I'll be right with you and we'll take pictures right here so maybe sit over right over here on that side and then we'll do all the photos and for our next item councilman Knutson this is your day as well thank you mayor this is not my day this it no days are my day I get the distinct honor and privilege of recognizing the importance of Fire Prevention Week and something to ask our amazing and wonderful firefighters to come on down and I have a couple of words then I'm going to really turn the mic over to our chief and Fire Marshal Robert Nolan so I have the privilege of discussing the importance of Fire Prevention Week since 1922 the now no Fire Protection Association has sponsored the public observance of Fire Prevention Week in 1925 President Calvin Coolidge proclaimed Fire Prevention Week and national observance making it the longest-running Public Health observance in our country the goal of Fire Prevention Week is to provide life-saving public education in an effort to drastically decrease casualties caused by fire Fire Prevention Week has observed each year during the week of October 9th and commemoration of the Great Chicago Fire which began on October 8th and 1871 and caused devastating damage this horrific conflagration I hope I said that right that's a really big word I'm in it I'm gonna conflagration mayor conflagration so this is about Cabul area that's and the conflagration yes that fire destroyed more than 17,000 and 400 structures and had more than 250 people without without life on a hundred thousand people homeless it's an important observation so that we recognize the damage that fire can cause to our lives in our community this year's Fire Prevention Week campaign not every hero wears a cape plan and practice your escape works to educate everyone about the small but important actions they can take to keep themselves and those around them safe as a father of a four year old my 4 year old loves firefighters and he doesn't need a cape but he loves seeing the fire trucks he loves seeing the fire helmets and I think it's important that as children we recognize the need to have heroes in our community I am grateful for the fire department here in Las Vegas and Clark County and Henderson and North Las Vegas and for every firefighter across the country that helps keep us safe because when you call and you need help it's the fire department that comes to extend a hand and bring you back to safety so I'm grateful and I'll turn the mic over to our wonderful and amazing fire chiefs you're all Chiefs Thank You councilmember Knutson Thank You mayor and members of the council I just wanted to echo the words of councilmember Knutson a fire prevention awareness is so important and I think the thing that really want to bring home is is that the safety in your home is really something that we really need to bring awareness to because that's where most of our des occurs with the place where we feel the most safe place where we should be the most safe but it's also the place where we have the most injuries in DES and so our interest is to make sure that we provide information to our community about how to keep yourself safe in your home make sure that your you have a working smoke alarm in your home make sure you have good escape routes make sure your entire family knows all of the dangers that they could face in the event that there is a fire in your home and just make sure that we protect our community and protect our citizens we are having an open house this weekend it is in Ward 1 at fire station number six on okie and Torrey Pines hope the all UV can excuse me the 12th October 12th hope you can all come out and I'd like to give a the mic over to our fire March you'd like to say a few words about fire prevention week thank you sir well thank you very much in going back 20 years over 50 people have lost their lives within our city limits and almost all of them in residential structures either apartments or single-family homes so we have a very aggressive apartment community risk reduction team and we are actively trying to put free smoke alarms into people's homes particularly the older homes where there's no smoke alarms whatsoever to date we've all installed over 300 of these and each time we do those visits we educate people about trip and fall hazards prescription drug safety and anything else that we can do to make them safer in the home where they should feel the safest our open house is at station 6 October 12th from 9 to noon that's the CSN campus on okyun Torrey Pines will be having dynamic displays of fire fighting skills in the afternoon as it will be a pancake breakfast and there will be static displays of our fire safety house but that's just part of the festivities starting with our Proclamation today we are also going to be bringing back our well-received Pizza Hut and smoke alarm delivery we'll be focusing on Ward Ward 1 October 7th Monday October 7 Ward 3 Wednesday October 9th and on Friday October 11th five the reason we picked those wards is they have the older homes where the battery operated smoke alarms are more appropriate the other wards have hardwired smoke alarms and then we get electrician for you when you need those so anyone who orders a Pizza Hut a pizza from the Pizza Hut on Decatur and meadows will get a delivery get their pizza delivered from a fire engine hopefully from the council offices I think we've reached out to you and if you would like to participate you get to write captain that night visit a household in your ward and and if you're if you let us come in and check your smoke alarm we buy the pizza and we do have to pay for it they don't give them to us for free it's a great it's a great partnership with Pizza Hut it's a great sponsors a great partnership with our council Ward and I hope that people will take advantage of that we can get out and and install some smoke smoke alarms on October 7th October 9th and October 11th so thank you very much for this proclamation and I would just like to observe that it is a passing of the torch for Ward 1 sponsors the proclamation thank you and I would like to do a picture with the proclamation we can do it with the podium here I'm told we don't have to move it Jace I'm for anybody that has children out there four year olds three year olds two year olds that will love fire trucks probably five girls but I'm not there yet but I'm super excited to bring my son to the fire station on Saturday morning next Saturday morning at pancake breakfast and there's giveaways for the kids and they get to see fire trucks so I'm gonna be the best dad ever and we will deliver as many as many fire alarms as we can I appreciate the districts going to help us beautify it sorry it's non your agenda today but you know we're gonna have a great performances and everything so October 17th I hope the leadership of Las Vegas comes out to this thing because we're gonna beautify that school in the downtown area for this city thank you thank you very much good morning your honor my name is Gerald Kellogg and I'm the building owner at 428 South fourth Street and I wanted to speak to the proposed ordinance number 201 9-3 six I'm not sure exactly what agenda item it is but it's the ordinance dealing with the homeless issue and I wanted to point out that I've offered to participate in drafting and amending this ordinance because the ordinance lacks one thing in particular which the has totally avoided its responsibility to provide any type of sanitation for all of the homeless that they're allowing to stay on the streets and this ordinance proposal it all that has to happen is someone has to determine that the courtyard facility is full and then they will suspend the enforcement of the ordinance but that enforcement does not include any provision for the city providing any type of portable sanitation my building has become a public toilet councilman Diaz has informed me that since the alley was vacated that's my problem but what happens is this homeless sleep on the city street all along side there every single day every single night they line up and the city is determined that they have a right to be there but every single one of those people are going to go to the bathroom you may recall that only because there's a minute and I'm sorry but I appreciate your comments I'd like you to give your business card if you would to our clerk and I will make sure that our legal department calls you and follows up on your offer to be included in the further dialogue but we thank you and appreciate it we're sorry we're doing the best we can and we are moving forward okay thank you your thank you for madam mayor and I know the city is doing something with this ordinance but it's not all you can do okay thank you anyone else wishing to be heard okay we'll move on to agenda item number 8 business items for director Nevada Health Link an online health insurance agency supported by silver state health insurance exchange that offers qualified health insurance plans based on income through the Affordable Care Act regarding eligibility available resources plan changes for 2020 and information on the coming open enrollment period were requested by Councilman Knutson in Ward 1 good morning good morning thank you madam and the council I really appreciate the opportunity to be here today it was my honor to travel from Carson City to prevent present this to you so my name is Heather Kaur bulik I'm the executive director of the silver state health insurance exchange which is the state agency that runs the online marketplace that facilitates the sale of Affordable Care Act plans called qualified health plans our web site is known as Nevada health link and I'm excited to be here today to give you just a little bit of information about where we are going for plan year 2020 the agency's mission is to increase the number of insured Nevadans and I'm excited also to offer you some information about the number of uninsured Nevadans that remain in our state today so this is a picture and really why I'm here this morning there's sixty two thousand six hundred and sixty three of the 83,000 Nevadans who are currently enrolled on Nevada health link who are living here in Clark County but there are still over 100,000 Nevadans in Clark are in the state that are eligible for subsidies on the exchange to access low or free costs or free insurance options on Nevada health link the Green Center recently put out a report that indicated that there are 400,000 Nevadans who are uninsured across our state we're the sixth highest uninsured state in the country and a hundred thousand of those people like I said are eligible for Nevada health link subsidies most of those people live here in Clark County most of them are Hispanic and Latino and most of them are employed they're employed that means that they are not being they're not able to access their employer-sponsored plans or they can't afford their employer-sponsored plans and that means that they're likely eligible for subsidies on the exchange so we're really working hard to connect with those people Nevada health link serves people who are not eligible for Medicaid who aren't on Medicare or who are not accessing their employer-sponsored plans we serve individuals and families these are your neighbors and your friends who are self-employed or employed meaning they can't get their employer-sponsored plans those are people who are aged over 26 and no longer able to access their parents plans who are not eligible for Medicare or who are of course of tribal or multicultural ethnicities the exchange plans help people avoid medical debt and significant medical debt and so those of you who don't know you can't be denied coverage on the exchange plans because of any pre-existing conditions 80% of our enrollees are getting subsidized plans meaning that they're able to afford their plans because of subsidies through the federal government and important to note that some of our consumers a significant portion of them have zero dollar plans all of our plans cover ten essential health benefits and we have free in-person assistance because we all know that shopping for health insurance can be complicated so we try very hard to connect people with the right folks brokers across the state right now we have we're transitioning to becoming our own state-based exchange and we'll tell you about that just in a minute here but important to note that not all insurance plans are created equal there are plans that are sold off exchange that are marketed in a way that makes people think that they're purchased in qualified health plans that are Affordable Care Act certified and they're absolutely not and they're being left high and dry with a significant medical debt because they purchased these plans so again we encourage people to work with enrollment professionals and we have a list full of 600 of them on our website I'm excited to tell you about what's new for 2020 we are transitioning and trailblazing the state of Nevada is transitioning our state away from health care Govs eligibility and enrollment services to becoming our own state-based exchange where the only way to get access to subsidies on is on Nevada health link there are certainly a lot of federal rules that we could talk about some other day I won't bore you with them right now that are impacting 2020 but the good news is that we have just announced our qualified health plan carriers for 2020 and there are three instead of two this year which shows a sign of active competition and stabilization here in our state so we'll have anthem health women Nevada and silver summit coming back this year and we'll have seven or twenty-seven plans across our state for individuals to choose from and then 17 dental plans open enrollment runs from December 1st through the 15th and again like I said we have significant number of broker and licensed professionals who are able to help either in person or on the phone and that's a free service through Nevada health link like I told you we are moving to a transition to state-based exchange and that offers some real efficiencies for us the state agency silver state health insurance exchange anticipates the savings of 4 million dollars in the first fiscal year alone by transitioning it gives us an opportunity to have access to our consumer data in real time which will allow us efficiencies and micro-targeting we're a marketing and outreach is concerned we're going to be able to have Nevadans helping Nevadans and have its platform to implement policies that's more state specific moving forward we've seen a decrease in our enrollment over the last couple of years and that speaks to volatility in Washington DC around the Affordable Care Act and also speaks to the power of becoming based exchange and really controlling our destiny so just leaving you with some information about what's coming up on September 4th we soft launched our state-based exchange we invited all of our existing consumers to come over and claim their accounts at Nevada health link comm and we're actively doing outreach to those folks right now this Thursday tomorrow is a really important date all of our window shopping becomes available so our plans will be displayed the rates for those plans will be displayed and the ability to get an idea of how much subsidies you're eligible for will be on display again November 1st through the 15th is open enrollment and I would just love if the council members would consider helping to get the word out to your constituency because 100,000 Nevadans here in Clark County are uninsured or a bulk of them are of that hundred thousand are here in Clark County and we would appreciate you guys helping us to connect us to those folks with that being said I'll end by saying that everybody in Nevada benefits when we have insured constituents that means it's good for our economy it's good for our public health and more we our neighbors our families and our friends are in better condition and have access to health care so happy to answer any questions or just leave you with all of that thank you very much we appreciate your coming down here and sharing this opportunity with everybody that pays attention to what's going on in this city I know our council people are open to this and it delighted that you've come down so we thank you I don't know if there are any questions councilman and I mayor one one quick request is for any information that any councilmember could post on their social media to get the word out I beat a point of contact to that if you're able to send me those those links and I appreciate the information I think this is one of the most talked about conversations that I've had since coming into office so thank 27 our report from Scotty ant Adams our city manager on emerging issues in reference to all wards morning good morning madam mayor members of City Council scott adams city manager i have a few items to just give you a quick update on as part of my emerging issues report the first one though what i'd like to do is simply indicate that do have four first reading today on your agenda an ordinance regarding regulation of the use of sidewalks its ordinance 20 1936 and what I'd like to do is read a statement regarding that ordinance and and from my perspective as your city manager that will be my only comment on this item item or matter until we start going through the ordinance process and there will be appropriate points during that process where our team will be making presentations regarding the rationale for the ordinance and there will be plenty of places along the way as we saw in today's meeting and a public hearing on that ordinance where the public can come in and make comment on that ordinance but let me just make a very brief statement this new ordinance was designed to help direct people to the city's courtyard homeless resource center and other existing nonprofit services to connect those in need and help break the cycle of homelessness the city believes the ordinance will be a benefit to the homeless population while at the same time protecting the health and safety of the entire community the city has always demonstrated compassion for the needs of the growing homeless population understanding public safety of everyone is a top priority so that's really I wanted to make that statement regarding why this is going forward and that there's going to be a lot of discussion going forward and a lot of opportunity for probably comment let me mention on the heels of yesterday's very solemn memorials in October that we recently I think you were all provided a copy by Tampere ago and I have to give a lot of credit to Tom for a lot of the work on the Healing Garden there's been a fantastic book written regarding the Healing Garden I just want to mention this so that the public is aware of it it's my understanding that these are available now at Barnes & Nobles of the public wants to obtain a copy of this book they can do so I have bones of nobles I want to point out that as you look out our front door kitty-corner from the front of City Hall you'll see a lot of progress on our immunised new Municipal Court building they are actively excavating the foundation of that building and I'm told by our development team that we are still on schedule for a January 2021 completion of that building so we're excited that we'll have another one of the family of city buildings Emilia adjacent across from City Hall also we had originally scheduled for this meeting but it got bumped to next council meeting an update on project enchilada and why that's important there will be a complete update on the status and progress of that project is unmod and i think you saw that in today's paper on Monday we'll start construction of Fremont Street the first segment or phase of the public improvements that are part of the scope of project and shilada to to really start the revitalization of the far east and a Fremont East so I just wanted to bring that to your attention that will start to see virtually more orange cones in the area of East Fremont and then finally we'll be discussing this with you and upcoming briefings we have been in a dialogue with the clerk mayor on how we can restructure our these city council meeting agendas to put our citizens business first we're looking hard at the items were citizens tend to sit here all day long waiting for their items come up in looking at prioritizing those items putting those on the front end of the agenda and pushing to the back end of the agenda those things that staff makes presentations on staff reports and routine business matters the whole effort of this is to be more customer friendly to our citizens so that they don't have to wait as long during council meetings for their items so with those items that is the end of my emerging issues report would you take any questions at this moment sure I can answer questions but we're not agenda for any discussion you realize this is just a note report Thank You mr. Adams so I'm so excited about our whole enchilada however I'm really hoping that as we move through the whole enchilada construction because sometimes their streets that are blocked off and it's very difficult to get around and in a maze and then this streets blocked off and that streets blocked off and that streets blocked off so with all of our businesses downtown and and with all of you know as we go and enjoy all of the restaurants downtown I'm just hoping that we're quite diligent with the traffic flow we are as we've done with all of our major public works projects especially those that are big ones with the long physical lineage footage to them we have a facilitator that works extensively with all the adjacent property owners and businesses to make sure that we're we're being acid responsibly as we can be during the construction period to meet their needs and I don't know if or has anything you might want to add to that as well notice about this chief operations officer that Scott's correct we do hire a facilitator does that they have weekly means with the business owners welcome to attend they also send out a newsletter or an email to all that business every week saying these are the streets that are gonna be impacted next two weeks here's the work those complete the previous two weeks slowly so where what's coming up next and they make this email of their attorney bills that wants to describe to so some of the business is not just a business but customers that frequent it one also they make it available so they know what's coming up in the next two weeks as far as work and road closures thank you thank you thank you a report agenda item 2805 alley hands Hamblin director office cultural affairs regarding the city of las vegas public art program accomplishments and plans for fiscal year 2020 good morning good morning good morning mayor members of the council thank you very much for giving me time to share with you about the city's office of Cultural Affairs the public the public art office is working on for fiscal year 2020 and just share a little bit of information about the impact of the Arts on our community I'd like to start with just a quick overview of the structure of our public art program we have two visual arts specialists that are full-time who work in office of Cultural Affairs they each have one has an intern and one has a part-time technician to support them with conservation and documentation efforts we also oversee the Las Vegas Arts Commission which was created by the percent for the arts ordinance and that is a commission of 12 members of the community that is appointed by all of you so I'd like to do just a quick roundup of some of the major projects that we have planned for FY 2009 my 20 or will complete in FY 20% for the arts ordinance public artists working with Public Works to incorporate public art into the design of the new city of Las Vegas municipal courthouse we're extremely excited about this project it will be a major arts project and we're hoping to attract national attention with the final installation public guard is also working with public works and MDOT to incorporate murals along the Charleston Boulevard underpass to beautify this area and to connect people between the Arts District and the medical district we're looking forward to getting this project underway in the next few months Public Works and planning reached out to cultural affairs a couple of years ago soon after I started asking us to help them incorporate public art into the third Street improvement project which you know is well underway right now the art enhancements for this project will include the incorporation of original poetry that was commissioned by the Office of public art it will be etched into the sidewalks as well as a three-dimensional art piece to be installed at the corner of 3rd and gas additionally Cultural Affairs production services team consulted extensively with Public Works on outfitting a portion of 3rd Street as an event space with a performance ready stage and street festival friendly enhancements the Office of Cultural Affairs is working to incorporate public art along the recently improved Ogden underpass corridor this new installation will speak to the history of Las Vegas as well as provide a safe well-lit corridor to encourage foot traffic between the downtown core and the burgeoning developments in Symphony Park the Las Vegas Arts Commission was invited to fund a proposal to add public art to the newly build to the newly built parking garage on parcel B and Symphony Park that final selection is in process right now as it goes through all the various channels including the symphony park development review we're also working on a new project to incorporate more artwork along Main Street in the Arts District now that that Main Street improvement project has been completed for sites along Main Street have been identified as ideal places to place public art and the first location is on the corner of Main Street and Charleston Boulevard cultural affairs has been working with former arts Commissioner and Main Street business owner Mark ableman on this developing this project we hope to install the first sculpture in the next few months our office of public art also has a handful of annual projects that they complete each year of temporary artworks the first of this is the aerial gallery which is part of the first street art trail it's it's the newest rendition of this banner artwork program which began in 2005 on Las Vegas Boulevard this gallery features up to eight artists work printed onto vinyl banners and hung along 60-66 different light poles between Bridger and Boulder avenues along 1st Street this exhibit rotates artwork every one to two years with the commitment to promoting and developing the arts as a meaningful and creative part of our entire community the contemporary public art program has partnered with the community artists and creative teams to present temporary site responsive mural sculptures projections performances and other proposed media on public and privately designed sites or private designated sites pardon me this program may remain in place for up to 12 months and this program specifically cites artwork in all six words one of our most popular programs is the amp program which is painting of the utility boxes throughout the city the office of Cultural Affairs regularly fields request for painted utility cabinets both from other city departments and community members this will be an ongoing program that will continue until and Windows on first invites artists to create original site-specific installations presented within the context of the first Street Art Trail this ongoing series of temporary installations can be viewed in the large display windows on the city hall facing first street at any time you may have noticed the display windows on City Hall building on along 1st Street they change out about every six months and typically the artwork that's installed there is artwork that reacts to the environment so the Sun or if cold can change the artwork over the period of six months a hallmark of any excellent public art program lies in the administration of that program and the behind-the-scenes work into it our city's public art office even though it's two and a half staff do a lot of work on maintenance and conservation of our collection we also spend a lot of time documenting the art collection we've recently contracted with Mona shield pane photography to help us provide professional documentation of every piece of our collection we do an annual inventory of the more than 450 pieces of artwork that are in the city's permanent public art collection and those are all cataloged in a software program that is designed for cataloguing artworks for municipalities and other arts organizations and then we also maintain an arts registry where artists can sign up to receive more information about opportunities as they come up and they can also submit proposals for new projects directly through this website so public art pardon me public art also affords the Office of Cultural Affairs with many opportunities to engage with the community on a variety of topics and in a variety of ways overseeing the banner programs for Berkeley Square the Pioneer Trail and the cultural corridor allows us to be a part of preserving the history of our neighborhoods and important cultural districts and ensuring that we're educating future generations murals give us a chance to engage with community to help beautify and activate communities in celebrating their successes and memorializing their accomplishments such as with the mural at mission high school the historic West Side gateway sign which is coming in fiscal year 2020 celebrates the history of Las Vegas is historic West Side and was designed by artist Harold Bradford who was a 35 plus year resident of the historic West Side which will be enjoyed and admired for generations to come I'd like to talk briefly about how Cultural Affairs and the Arts in our community is supports economic development in March of this year the National Endowment for the Arts published data showing that nationally arts and culture contributed 804 point two billion dollars to the US economy in 2016 this represents four point three percent of our nation's gross domestic product additionally the endowment found that from 1998 to 2016 there was a forty four and a half percent growth in GDP contribution from arts and culture production looking at where that growth was coming from the endowment found that a handful of fast-growing arts and cultural industries showed amazing growth between 2014 and 2016 many of these industries correlate to our city's commitment to investing in and promoting information technologies and smart technologies these industries are such as sound recording internet publishing broadcasting streaming and computer system design the arts were found to make up nearly half of the creative economy in copyright intensive industries which are related to I team to the tune of 500 billion dollars annually what does this mean for Las Vegas Americans for the Arts creative industries report shows that in April of 2017 there were three thousand six hundred and twenty-one arts related businesses in Clark County representing four point eight percent of all businesses in the county employing nearly twenty five thousand people looking at just downtown cultural arts meaning the Arts District Smith Center mob museum first Friday and the Neon Museum a 2013 report from our cg economics showed that the annual economic impact in 2013 of these downtown cultural assets was nearly a hundred and four million dollars generating a thousand thirty-eight jobs and thirty five point six million dollars in income considering that these numbers are from 2013 and the explosive growth of the NEA has seen nationally I think it's safe to assume that these numbers are even higher in 2019 these downtown cultural assets directly contribute 2.9 million dollars in tax revenues each year which is then leverage to find essential public services as we all know such as education public safety and capital improvements the indirect contribution of patrons and participants spending in the area before during and after visiting one of our cultural institutions drives this number even higher and keep in mind this figure does not include major festivals and events such as life is beautiful Las Vegas Book Festival the Las Vegas Bluegrass Festival and which we know brings additional substantial economic benefit directly to our city in an article posted in July 2015 at economic development org they cited culture and art as a major influence or in economic development and described arts and culture industries as those with staying power despite economic fluctuations much like the medical industry the four industries cited by this article as ones that help keep our economy afloat our galleries and museums TV movies and a gaming industry performing arts and a tourism industry specifically festivals and tournaments I'd like to also speak briefly on how the arts positively impact our public safety a new study posted in March of 2017 shows the positive influence of robust cultural resources in a community in public safety numbers in lower-income neighborhoods cultural resources are significantly linked to better health schooling and security the research which was controlled for economic well-being race and ethnicity and performed by the University of Pennsylvania School of social policy practice found the presence of cultural resources is associated with a 14% decrease in cases of child abuse and neglect a 5% decrease in obesity an 18% increase in kids scores in the top stratum on English and math exams and an 18% decrease in the serious crime rate projects that our public art team currently has underway that are directly tied to improving our community safety and health or the hundred circle parks conversion to a sculpture park in children's park the historic West Side mural program which is being funded through the mayor's fund for Las Vegas life and will support improving Public Safety in those neighborhoods in the neighborhoods of the historic West Side and a storm drain public art project of 2019 2020 which is the collaboration between public art and public works on spending an entire year educating six different elementary school classrooms in all six words about the dangers of polluting our water and how they can help prevent it this project after the full academic year will culminate in six different storm drain murals painted throughout our city and that's my presentation thank you so much for giving me the time I'd be happy to answer any questions if you have them thank you very much for the report we certainly know performing arts and our whole cultural base is there going to be an opportunity but one thing is to thank and out to the artwork they've provided on that fabulous downtown finished project me yeah I'll check neon because I think the artwork they've added is tremendous really wonderful but reports on festivals such as life is beautiful how they have impacted and I know it just occurred so we don't have any data yet but any of the art festivals of what we're doing I think would be interesting for us and if it's not something to take a public time at least a property line the neighbors were very okay with that we were talking about the intense landscape buffer that would be back there that thought that was a proper use for that we talked about this drive-thru upfront we've got the speaker going out to rainbow and the stacking in this position here with the berm we've also limited the hours of use I know that was a major concern for a lot of people from 5:00 a.m. to 9:00 p.m. we're trying to go for a coffee type of drive-through use for for this area here in addition of that were just here to answer any of the questions what is then that beyond rainbow what is the major processor the an Road and Rainbow just south of an Road okay okay let's go first not a mayor good morning the subject site is in the Rainbow Boulevard North corridor plan and is part of the and in rainbow section of that plan area this intersection of Rainbow and in Road is a single anchor to this entire section of the corridor this section of a corridor plan is primarily focused on future development because of its unique vehicular patterns and the large number of vacant parcels in this area the EM rainbow section of the corridor plan does recommend commercial development near the intersection and on vacant parcels most accessible to the surrounding residential subdivisions considering the high volume of traffic on Rainbow Boulevard which is a 100 foot primary arterial and no other access to the subject site except from the Boulevard staff is supporting the requested change of land use designation and The Associated rezoning application of this property however because of the bearings applications and the waivers that have been requested staff cannot support the proposed design of the site as well as those requested deviations from both the parking residential adjacency and some of the on-site landscaping issues as it demonstrates that the project is being over built as the applicant did mention Planning Commission did put the a limitation on the operation for the drive-through piece of this project and it is limited by current condition to 6:00 a.m. to 9:00 p.m. and we agree and that is all I have on this project member so yeah it's the fact that they need the variance for the parking they need the variance for the residential adjacency and then some of the deviations for on-site landscaping they have as the applicant mentioned they have made adjustments since this was originally submitted to the Planning Department but they do continue to have some deviations that currently are outside of code okay thank you very since this was noticed before those changes and it's a reduction in what the deviation is the the header stands but yes it is a reduced deviation per the site plan side so first of all I I want to commend you for for you came up with your original project you met with the neighbors they made a bunch of suggestions and you responded to all of them I mean I I really appreciate you doing that and working with the neighbors and changing your project to fit their concerns are important to us and it does conform to the that rainbow corridor study that we put together and we spent a lot of time on that a couple of years ago because this street here is going through of a phase right now so that study helped us decide what that Street should look like from an Road to Rancho on rainbow and this fits in there and I mean you reduce the size of the project the park parking requirement the landscaping the the drive-through you spoke about that the hours of operation so thank you for doing this I is Alan mulaskey and his team if you have any questions for them on the overhead shows you the location of the property outlined in black here is a deer Springs way and here is Durango we set just to the west of Durango behind a commercial center the proposed project that's before you is for a multi-family project that is in this orange color as I can show you right here deer Springs is to the north and this particular project whenever Ovation puts a project forward especially when they're adjacent to residences they try to do the best they can in design before we submit to buffer the residents and so part of that design when we submitted included a step up of the building the residential homes are located here and so what we did is the first portion of our project has a two-story component then the middle portion of our project has a three-story component and then this portion has the four-story component in this zoning category the town center standards allow for a maximum height of seven storeys again with this design it goes to three and then a maximum height the four stories we did have to voluntary neighborhood meetings we did one before the Planning Commission and then we did a second one between the Planning Commission and the City Council and there are always concerns as it relates to multifamily adjacent to single-family but the overriding concern of this particular neighborhood was a chillon point which is an 80-foot wide road connecting through our property to Durango now that's a really important street to your traffic folks it is on the master streets and highways plan within the town center plan it's an 80 foot wide street and you're experts in your city firmly believe that that connection might have could be necessary in the future but the residents that live here felt very strongly that that would cause safety concerns there's a lot of communities that utilize amenities on either side of echelon point and Ashlin point currently doesn't go through there really hasn't been a tremendous amount of traffic here so I want to just start by saying we thank everybody for working with us on this the neighbors we've met with your public work staff we've met with your planning staff we've met with Mayor Pro Tem furies office trying to come up with a solution and from our standpoint this was one of the times where we said we'll build it either way we can put a shell on point through if that's what's important to the city or the residents or we could come up with another solution that doesn't put it through and so the plan that we're submitting to you today and we've previously submitted to staff although I've been asked to hand you a set of plans here mr. Sommerfeld I've been asked to hand you a set of plans at the Dyess we have emailed those to staff prior to this meeting is that we would temporarily close Ashkelon Point Drive we've got conditions that either myself or staff will read into the record that address how this would work but effectively as the neighbors from the neighbors perspective the residential neighbors there would be a emergency fire access gate completely closing off echelon point right here the fire access would come through here if necessary there would be no pedestrian gates or anything so there would be no access from either our project traveling westbound or from the westbound traveling eastbound it would block off here all of our traffic for our project would come off of Durango through a chillon point and then come into our project and then in the center area we would use it for open space and we know how important trees are to mayor pro-tem so we would have a number of trees planted in this area we may even include a dog run or a pet area and then we would have some small monument signage here that identifies our project the concept of the condition is that at some point in the future down the road should the community come to mayor pro-tem and say we think it's important for us all on point to connect because of the significant amount of traffic on deer Springs way then there would be a public hearing and that public hearing you would determine whether or not you wanted to have that road make that connection so staff and Planning Commission did recommend approval of the project this design came in after the Planning Commission but it does address the concerns raised by the neighbors so we would ask you to consider this design in the revised conditions in your motion today I'd be happy to answer any questions thank you can you go back to your map is there a couple of things I asked you I guess it's your right oh no this is if this is a school this is Kohl's over here if that's what you were looking at but there is a school here Oh lower middle upper do we know in elementary the neighbors are behind me it's an elementary so it's not affected by the ability to get from inside this project since it's multi-family residential over to whatever that school is well I are you saying if we have any school-aged children in our project so if we had any school-aged children in our project because there's no vehicular or pedestrian access going this way they would have to come out Durango onto deer springs and come down onto Fort Apache to get there I just throw that out there to me that's perhaps an issue not to hold it up he does phenomenal work phenomenal work everything that's ever been done that I know phenomenal so not to cause a problem and then do you know where the nearest fire station is I personally do not know where their nearest fire station is but I can attest that I had a meeting with fire and they evaluated the access points that we have in here we did need to provide two and we are ok so the second one is coming in from the east the one that you talked about has the correct here and then of course off a vessel on point coming off of Durango so our second one becomes here so in this complex one side or the other you have from infants through all ages I would gather I'm so sorry what was the question all aged children could live in here you mean yes yes yes okay those are my only questions and just thanks for the work that you've been doing in this community for decades and this is a public hearing and then they'll take questions any from Council but anyone from the public and you'll be after them yes because I want to response I see somebody is either leaving or is coming forward please do come on forward say your name for the record and then mr. Sommerfeld will Heather Saunders and I'm from the community just I mean of course the community isn't totally for apartments but we know that they're coming but we did state what we required or requested and it sounds like it's happening as far as the street hopefully not being the through Street I know the landscaping was hopefully being adjusted for the trees and everything like that yes for some privacy on our end and stuff like that that's really hope and and the four-way stop hopefully because that Street is pretty bad as it is and it's not even a through yet so yeah we won't get through but thank you thank you very much for coming down anyone else I'll close yes sir good morning I'm Jim you-let's I live in the community coral bay right there I just wanted to throw out for your concern for the children right now there's a sidewalk all the way to the end of the dead end so if you could possibly put in I mean it's the dead end with a little bit of land where the apartments going if there's some way to create some kind of access for them to just for the kids to just hook up into the sidewalk that would help to take care of that situation thank you anyone else okay close probably caring and now team Sommerfeld good morning again madam mayor so the proposed development does meet the goals and objectives of the urban center mixed use district of the town center plan by providing a multi-family development that is compatible with those adjacent single-family homes as evidenced by the representative talking about stepping back the development those homes are as indicated to the west as well as those commercial land uses that are to the east therefore staff has recommended approval of all the applications we do have some amended conditions as indicated we did just get some updated drawings on Monday and so those were not a part of the back up so I do need to amend with your indulgence a few conditions and then to address the street situation mr. Anderson will also have an amended Public Works condition so on Str seven six by five nine I would like to amend condition three to read as follows all development shall be in conformance with the site plan date stamped 939 teen landscape plan date stamped 9 26 19 and building elevations date stamped 729 19 except as amended by conditions here in I would like to also amend condition number six that addresses the landscape plan to address the neighbors concern that spoke a moment ago with two added bullet points at the end of condition six the first added bullet point would be that the western perimeter landscape buffer shall include 36 inch box size African sumac and should tell up ha I probably mispronounced that but it'll be written and in the condition trees planting in an alternating pattern every 15 feet on center and a second added bullet point to that condition that the temporary Park area within the Echelon point Drive right-of-way shall include an additional 36 inch box size shade trees and a fenced area for dogs such as a dog run and/or park and as I mentioned mr. Anderson has a an amendment to one of the public works conditions or an added condition yes Bart Anderson Public Works and before I read the added condition I would just seek your guidance on whether the elimination of pedestrian access through the site was council's intention most of the plans that I have been in involved in with discussions included pedestrian access although some of them did not so I just wanted to see thee the guidance from the council's perspective on whether pedestrian access was to be preserved or not so as I met with the neighbors and went back and forth with emails we have because it's multifamily multi-use and this is a new property the privacy of the community with because they have a pool on one side and a park on another and they just didn't want the community to get inundated with non community members so that is why we are closing access as if to make sure that our community members that are there now we have the crash gates for fire but there will be absolutely no construction vehicles no one using that Street in their neighborhood in our ward in the northwest it's most important to me that our neighbors are happy with with the growth progress that we're making and they're at what mrs. lava vich has read is complying with their desires for their neighborhood to make sure their neighborhood stays from the trees - not having four stories in their backyard that's why we're going to three four so what we've concluded is we are not going to have access to that very good then if I'm a mayor with your indulgence add condition I'd like this to be condition number 20 and the other conditions remembered as appropriate excellent point shall be temporarily blocked with a wrought iron fence at the western edge of this site which may also be required for secondary fire access the Echelon Point public right-of-way may be temporarily used for parking landscaping including trees as well as a fenced area for a dog run other open space amenities and monument signage through a license agreement with the city and subject to removal of set improvements by the licensee at their expense upon written notice by the city no permanent structures are allowed within the Echelon Point public right-of-way prior to actual on point being opened to public vehicular traffic there shall be a public hearing at City Council which authorizes the opening of echelon point the city will construct this roadway improvement if authorized by the City Council mr. Anderson if I could reiterate here because I just did asked Mayor Pro Tem then the concept of any pedestrian passed through is not included I just want to make sure that that's clear that that's understood right that was in response to your residents overall the majority and concern concerns with okay if in the future the roadway is reopened per this condition and that would include pedestrian access as well but for the term of the closure it would be a complete closure is my understanding direction but also one one amendment that I will need mr. Sommerfeld and mr. Anderson to add is the doggy stations right so mrs. Jennifer mulaskey for your willing participation with our neighbors up there and really taking to heart their consideration thank you wonderful all motions carried thank you very much thank you another great job okay agenda item is number 52 53 52 SCP seven six nine seven five a request for special use permit for an open-air vending tranche and sales lot use number 53 SDR seven six nine seven six on a request for a site development plan review the proposed open-air vending transit sales live development the applicant owner is decatur concord LLC on point for four acres at 1934 north decatur boulevard c1 limited commercial zone the Planning Commission staff recommend denial on both items Susan Ward five who counseling career and are probably carrying such I now declare open sea an applicant present or representative yes Mary good morning my name good morning to the mayor council Rikki Barlow for the record 3172 north rainbow lve access I'm here on behalf of the applicant before you today because of a number of items that I would like to point out one there are a variety of food trucks in this particular region of the Ward that has been looking for an opportunity to sell their goods and products as far as food during the lunch and dinner hour in this particular area city staff by right by code has actually been finding a number of the food trucks because they're parking inappropriately on public as well as private properties and so this particular development at right near the corner of Lake Mead indicator is looking to have an open-air vending opportunity for the food trucks to come and set up during the day in order to sell their their food products a variety of food products and so we've been working closely with staff to come to a happy median to pull the food trucks in on to this site in the open air space and so what we're looking to do on one of the undeveloped parcels on this development which is completely dirt today we're looking to bring in pavers that heard of pavers pavers and decorate this particular site in order for the food trucks to come in and set up and we're also looking to improve the landscaping as well as some of the gazebo concepts that councilmen career mentioned that he would like to see as well but of course we would have to take your direction with that because by going through staff and setting it up the way in which you would like that would have to to be a council decision in regards to what you would like to see there but we're happy to do that but for cold purposes we're looking to do decorative pavers and allow for the food trucks to come in and be a licensed spot for the variation of food trucks that are looking to come up off the city streets and be on a license pad that they will have an opportunity to sell throughout the day and as we get into the more specific details there are a couple items or I should say one item on each of the site development review as well as especially useful made I would like to bring forward which is number four on each one of them so at this point I would like to turn it over to the mayor and council for any questions or comments or direction that the council office would like to bring for thank you very much let's turn this over to mr. Summerfield man madam mayor the subject site is a partially developed corner parcel which is owned c1 lemonade as indicated by the applicants representative they are requesting to locate for food trailers on new pavers at the center of this this portion of the parcel the applicant is requesting the SU P so that the vendors can operate on a single parcel with more than four hours within a 24-hour period and also so that more than two vendors can operate on a single parcel within a 24-hour period staff finds that the hours of operation until 2:00 a.m. are incompatible with the surrounding area the mobile trucks will be in the direct line of sight of several homes and will have no buffer to the noise associated with mobile food vending such as generators compressors filing vehicles patreon queuing outdoors and grilling operations for these reasons staff has recommended denial of the proposed entitlements the applicant was requesting staff to consult on this prior to Planning Commission and I think we have done some work as the as the representative is indicated and the application has had some improvements there's some landscape requirements that need to be brought up to current code that will need to be done as a part of this project thank you very much mayor yes if I may I just speak to a couple of points that mr. Sommerfeld has brought forward okay anyone from the public referencing 52 or 53 nope okay thank you as we all know technology has improved dramatically and so therefore as far as any noise coming from food trucks that that's actually all of the noise is internal inside the food trucks and so as far as generators and things that nature we all have had events in the parks and out in the community where you don't hear any noise from food trucks because it's all internal and the majority of everything is electric or or natural gas and so there won't be any noise coming from any of the food trucks in addition to that from a cultural standpoint specifically with a lot of the night clubs that are surrounding the entire Las Vegas Valley a lot of individuals from various ethnic groups eat after the club hours and so if you look around the valley specifically near and around the downtown area like we all have there's a number of food trucks that are parked on corners and you don't hear noise from them but you actually see people eating at 2:00 3:00 in the morning and so the nature of why we're asking for this time is because it allow for these trucks once again to operate on a license pad and not be hit with tickets for being on public and private property after a certain period of time and so therefore we're requesting that the time be allotted to the 2 a.m. hour because that's also an opportunity for them to continue to operate and sell their food product after a lot of the residents come from their various nightlife activities here in Southern Nevada in addition to that the distance from the residents the closest residents as far as home to this site is well over 200 and some feet now property line the property line it may be approximately somewhere between 60 and 80 feet and so as far as the impact of where this site is located and the nearest home specifically with the homes the back of the homes is actually facing this property not the front and so the impact I don't see where that will come into play but I'll allow that to be a council decision as it relates to the distance and the and any noise that is suggesting and I don't believe that to be the case specifically how in fact this site is located in it abuts Decatur right you'll hear more traffic on Decatur than you'll ever hear coming from a site where someone is coming in to grab a few tacos in the middle of the night okay Thank You comments question from Council Madame a yes then I just want to make sure in case it's silent there's no brilliant thought wait no my brilliant bye so thank you for coming in and thank you guys for making some improvements to the site you know this could be a really cool thing that's sort of set up throughout the entire community if I situated because you're right food trucks are parking illegally they're just sort of parking someplace and they're the people coming in and it's great but there's no really ordinance that talks about having a contiguous space for them and and thanks for going back and making it more of just instead of just putting on that dirt and I'm very familiar with that corner they do a lot of car washing there so those guys aren't gonna be happy with you guys you're gonna bump them out but the car wash is not I think it's not zone I mean it's not appropriate for their so it's not like they're I guess as a councilman I just sort of drove by and didn't really say much about it because people are trying to be you know entrepreneurial and they're doing what they're doing but this I think will add to the shopping to the area of the shopping center am I to also understand the landscaping that you have along the that would be the south buffer there with the trees and those plants all that's going in as well I reside for just where it looks pretty no this is all based on your recommendation Council right you and I both on the same page when it comes to really increasing the aesthetic look of of developments to bring up the area and so know we're looking to improve that the way in which you've recommended and suggested yeah that's a big enhancement from what that looks like now it's just like a berm of dirt that's there and actually some people drive across that to kind of get out of that shop container so I think it's great I like to we talked about making it a somewhat of a permanent structure that serious people could eat there and the know it's there instead of picking up tables and moving them out every night coming back and so we would have to waive condition number four for that which would cause for a temporary structure right mr. Sommerfeld I applied as councilman which are we on the su seer the SDR so I guess we're on the SDR now but I guess not enough that both those conditions are there because it says that condition 4 says that you you basically cannot have a permanent structure you would provide some clarity pardon me if I may provide some clarity yes okay on on the SDR councilmen and staff item number for the undeveloped portion of the lodge shall be paved prior to the approval of the business license we're okay with that well we want spelled out is the fact that you want decorative pavers and not asphalt yeah right right right and in addition to that it can there can be another condition to where as you direct us for example to have a gazebo and and and garbage cans as well as some formal permanent structure affixed to the pavers that will make this more of an aesthetic pleasing look and I can continue to work with your office to make sure that that happens to your liking yes so that can actually be placed in replace of item number four or attitude okay my apologies councilman so I don't I I guess I'm gonna kind of deviate or disagree with the representative I don't believe we need any additional conditions here because they are required to being conformance with the site plan and landscape plan that have been submitted which based on the notes on that plan would indicate the pavers I believe it indicates the the gazebo right so I don't believe we need any conditions to spell those out more than they've already been spelled out on the plans right okay make minor changes in conversation between now and when they come in with any plans a minor change to those approvals that can be done administration we wouldn't need to come back to Council for something like that in fact unless they were putting a building on the site I can't see why we would come back to Council on adjustments to this site plan and so I don't think yeah I don't think we're approving the STR then yeah that supersedes item four right gotcha right according to this site plan yeah okay you know I want something I think it's kind of cool I was in Maui Hawaii one time in the by the airport he had a group of food trucks that were there similar to what you're doing here and it was really cool had the best lemongrass chicken they called it that I've had you know I don't know it was really good so if you can find that truck and bring him over into Ward five we would appreciate it do a little real time I'm not if there's no other comments I like to make a motion madam mayor that sounds good to me as long as they make sure they have their health department clear is clearly visible in the window of every truck that that's a part of each food vendors license with the Health Department as well as the city of Las Vegas so that's that's a requirement that they must have anyway but we'll make sure being that they're on our site that we will have an opportunity to and their license number for that because you know today people are so clever with their technology and Photoshop and make your own I mean I've seen people who have graduate degrees they've never set foot in this school so you know I think it's just for the public and their own say d and the business I know they can do which is unbelievable thank you and just because I can't see it on my side is the first item the SDR Robert is the summer feel or the SUV SUV madam mayor through you at CSU P and if I may madam mayor councilman when you make your motion could you include what you would approve the hours of operation to be currently we have a condition with conformance with the conditions and since this is a kind of a deviation from the conditional use if you would just state what you would like the hours of operation to be for this special use permit that would be helpful for my staff in any future enforcement concerns and Councilman also in addition to that we're asking that item under the special use permit seven six nine seven five that item number four be stricken as well because the applicant has a current contract with one of his tenants for specific parking agreement and so this right here will eliminate that and make that contract null and void and so being that the the development is is currently over parked right now we don't see any impact as to their being in an accelerated amount of additional cars being parked so I don't want to breach the my clients contract with his tenant and so we don't we're requesting that item number four be stricken from the su P so madam mayor if I may speak to that so the problem is the proposed development is on top of where this commercial parking facility is supposed to be so in order to strike that condition I need to see a site plan that demonstrates that they can accommodate that use somewhere else on site to be able to continue that activity because that president their current site plan would negate their current approval for commercial parking facility on this location so that's why that condition is in there because you can't have basically you can't commercially park if you've converted it into something else so as a president I don't believe site plan that demonstrates that they're moving the commercial parking facility from the area where they're currently approved to do that which is where they're proposing two more items and that I'm concerned about into councilmen career obviously is assuming that the light lighting since these are people who may be on a graveyard shift or whatever their shift they're coming into the area coming home that the residents around that the lighting is adequate to really be safe for those who are availing themselves of the food trucks and the other thing that somebody actually has given a security plan for the parking in the late hours of the morning so I don't know what you've got there but it is just safety as always number one as you know safety is always number one so that there's an adequate security plan to take care of the wee hours of the morning and that lighting is adequate to protect those who are coming by car getting out of the car and then we so there are no problems that's it they're just thrown there it's not an answer to me I just want to make sure the city has it and counseling career right and Councilman courier had mentioned when I met with him last also with the opportunity for example I've seen in other communities in other cities where the string of lights the string of light bulbs would be a part of this we didn't have time to basically drop that in there but from a lighting standpoint the dim light bulbs will basically be a part and incorporated within this within this site as well okay well just you know to me that's always security is always problem and always first on my mind and lighting helps that right thank you operation - 2 a.m. 2 a.m. and councilman back to the back to the parking agreement I know that's and I respectfully disagree on this item but when you can drive through there today day or night and there's ample parking because there are some facilities that are currently dormant or basically have very small amount of parking so this entire site is has ample enough parking to to handle the influx of the few cars that would be basically coming in and out and so what I want to do is just try to protect my clients client who he has the contract with so that in plus this will be temporary because in the future as things develop and the economy turns around we're coming back in to have this removed to actually build a new building here in the future so this is all temporary for right now in basically cleaning up this site because today it doesn't look attractive it's all dirt and rock and so we're just trying to you know do what we can right through this you know the very short time frame to not only generate a little bit of income but also improve the site until things get better to where we can come and bring in the building and we'll be happy to address that parking concern at that time right so once again I'm very familiar with the with with the site I'm not from a technical standpoint you mentioned a few things that I guess needs to happen but the the site is way under park there's never an issue of parking there even with the beauty salon and the nail salon and the little CC store on the corner it gets some traffic there from the C store on the other side but never there's never really an issue so I'm not sure you tell me what needs to happen to get this approval so that we can move forward so madam mayor if I may through you so councilman you're correct it's a technical issue I would agree with the representative I do not believe that for this site that it couldn't accommodate a commercial parking facility on somewhere on the larger site the item that's before you today however is in the area where it's currently approved so I need have an updated full site parking area that would show where they can't accommodate the required parking for those existing stores the area that they would designate the new area on the site that they designate for the commercial parking facility to meet their contractual obligation and that doesn't interfere with this approval here because otherwise they may need a variance again it's a technical issue I know the site doesn't generate as much traffic as on paper it those uses that are on site may require but if they can't demonstrate that they're meeting all of those parking demands you something's got to go where they've got to request the variance so much so I'm somewhat confused in why wouldn't that be if that was that left off of the was that a requirement that you needed prior to them coming in here today or is that something that just popped up here today because I would assume that if they were told this needed to happen and then they would have so ready to with the information the my understanding is this is has been a conversation and as the representative mentioned this is a point of contention where the party hasn't agreed with staff that this requirement would be there that's why the condition reads that the use of the existing use where the transient open space lot is going to go has to cease I believe that that's a solution though that if I can maybe adjust the condition for unless a updated site plan is approved administrative ly by the Planning Department indicating that all uses can be accommodated something to that nature that way they don't have to come back for an approval if mr. Barlow this client can show that he can accommodate everything on the site otherwise he'll have to come forward for a variance for whatever deviation that would result in for the parking to keep a commercial parking facility at this location to approve at in somewhere else in the parking lot to approve this current request and then to accommodate those retail spaces that are existing in the in the commercial now that area where they're gonna put this was never parking in the first place as you're saying that since you're adding what so that's the thing technically that was shown as where the I don't think they've been using it but that when the approval for the commercial parking facility this is the area of the parking lot that was designated for that commercial parking I don't believe they I believe they've been utilizing existing spaces on site for it but technically the approval was based on them converting this area for that parking facility yes guess well we have been using the other parcels because as you very well know no one can park in the dirt that's that's a city violation so being that the site is over part we utilize other part we utilize as a matter of fact this portion of the parcel for the ten spots that that we were asked for from the client and so now we're coming in to develop this site with the pavers to basically eliminate the dust abatement and do some formal improvement there temporarily until we have an opportunity to come and build an actual structure which will meet all the parking requirements according to staff and city code where's that condition I was looking at it and I don't maybe I'm missing it the condition that we're discussing is for me so on item number four yeah yeah please any thought about doing this with all the conditions that need to be resolved as a pilot for six months see how I mean these are movable pieces easily if there's any issue then you can just stop it that's positive and safe yeah that was my review could be put on on the application to have staff let you have an update on whether or not we've had any issues or you could actually have it come back before you if you wanted to hear presentation on it well that was gonna be my next question as well if we can approve it and then some type of way work our review at some point so why don't we why don't we do that so what would be the language for that okay so two things one so condition for again I think we need to edit that to reflect that the the license for the commercial parking goes away unless the applicant is able to demonstrate that the parking can be accommodated elsewhere on the site otherwise they'll need to come back for variance for that and then it that doesn't become a problem and then based on that comment about a required review I would add a condition to the special use permit that I required review would be hold on a second let me take a look at that so an administrative required well it depends Council three madam mayor councilman would you want that to come back before council or would you be okay admin approve so an admin review shall be conducted six months from issuance of business license with the elimination of item number four again because we have the technical issue of the parking it can't eliminate it and 100% I can put some additional language on it that would allow us to administrative Lea adjust the site plan to accommodate it that's my if all parking can be met or a variance is approved by council then then the the license doesn't have to go away okay I mean I still goes back to variance that parking has to be yeah it's a technical issue they have to demonstrate that they can meet parking or they have to get improved variance so it's not to say that there's not grounds for a variance if it comes to that but I have to treat everybody equally and so I have to be able to demonstrate that the site can meet its parking that's the best we're gonna do I'm sorry that sounds like the best we're going to do that that's fun we can do it we can do a six-month review after the business license has an issue okay great so I'm gonna make a motion for item on the SU P for a marijuana cultivation facility he was displaced unfortunately my client in about 2017 due to project neon he previously has proven himself as a successful operator with the conservation facility over in Ward 3 he was located at 1916 Highland Avenue prior to being displaced by the project since then he looked for another facility within the city to relocate it's taken him several years but we've gotten to that process and he's hoping to now get reestablished and do what he did before successfully I was one of the first operators in the city he was proven to meet all of the necessary requirements in particular I know odor is a concern for anyone that's you know potentially considering being located in the proximity to a cultivation facility and what's nice about the city unlike some of the other jurisdictions is that you guys have a very strong odor control policy in fact you cannot get your certificate of occupancy and so you have a third party come out and do testing that shows you cannot emit odor from the corners of the property again my client has proven he can do that he has done that he got his occupancy and operated for approximately a year before being displaced by project nan so we're here I believe you know of the 382 postcards that were sent out I think only for protests or received we don't we try to make ourselves available to anyone that's had any concerns we have not had any issues yet relief from the community we welcome though to work with anybody who has concerns we know that this is a new business and a new industry so people often have many misconceptions or misunderstandings and again my client is more than happy to help work with any of the surrounding community members to make sure that any of their concerns are addressed and be a good partner to provide jobs in this Ward we believe that he will start out with approximately 10 to 12 employees but more than double and triple that as this is a process where they harvest marijuana and eventually as you need people to package and trim he's going to need to employ a lot more people so it will grow and again happy to answer any questions you guys have nope mr. Sam revealed that a mayor pro-tem the proposed marijuana cultivation facility does me all title 19 12 minimum distance separation requirements is noted that the subject site is located within 300 feet of an existing martial arts studio however the applicant has submitted a signed affidavit from the ownership of that studio that indicates that less than 50% of the students clients are 17 years old or younger and therefore staff has recommended approval of the proposed entitlement thank you Thank You mr. neighborhood that come out with Andrew and see the fire trucks and fire fighters the Springs Preserve is hosting haunted harvest for this for three weekends in October starting a luck October 11th and you can visit Springs Preserve org for more information and the Philadelphia Dance Company will be performing at Charleston Heights Art Center also on October 12th at 7 o'clock p.m. it's a wonderful Vegas stronger so I'm super grateful to live in this great city just a few announcements on my end to wrap us up today we do have our great career and job match fair happening this Saturday October 5th East Las Vegas library right there off of 28th and Bonanza and it will happen from 11:00 a.m. to 3:00 p.m. so if you want to seek better employment or you need employment we will have almost close to 30 employers there on-site with jobs and you just need to come and hopefully bring your resume and on Thursday so tomorrow we will be offering resume assistance if you need to bring it up to speed at the historic 5th Street School and there'll be many authors on hand and if you've just written a book come on bring it along we're just excited about a young adult novels fiction and nonfiction so it should be fabulous and then the 20th annual Las Vegas mayor's cup international soccer tournament it's coming up on October 25th through 27th and I know so many of the events go on at baby Wilson Park but around the ground the city and this is for the younger group in the fall in February we have the older children participate in the soccer tournament then again the mayor's cup and that's where we have coaches coming to watch the students and look maybe for scholarship for college so please come and then our next council meeting is in two weeks so that would put it October 16th okay yes and promptly at 9:00 and we haven't changed that either but keep an eye on us because mister Adams going to continue to look into how we can make sure we're servicing you in a better fashion by doing all the business pieces planning and everything that we can pull together first in the morning with presentations and reports in the afternoon so with that again I'm always thanking our counsel
