**[00:01:50] Christina Volkers (City Administrator):** I can do it. What—there isn't a presentation? Okay. I'll go through it real quick. I'm sorry. So, in front of you today we're going to have a public hearing on the on-sale/off-sale for Muddy Cow, which is a new business in Oakdale, formerly the Titans location. And so what we're asking for is to open the public hearing, take any comments, and then approve the liquor license subject to a background investigation which has not been yet fully complete at this point.
**[00:02:15] Mayor Kevin Zabel:** Thank you. And just one correction: it's on-sale and on-sale Sunday, no off-sale. So at this time we're going to go ahead and open the public hearing. This is an opportunity for anybody in the public who would like to speak on this one specific item to step up and share your thoughts with us. Please state your name and address for the record... I'm going to go ahead and close the public hearing and bring it back for Council consideration. Council members, any questions for staff? I'll look for a motion.
**[00:02:40] Council Member Katie Wrich:** I'll make a motion to approve the issuance of a new on-sale and on-sale Sunday liquor license to MC's Pub upon completion of a background investigation by the Oakdale Police Department that includes no disqualifying factors.

**[00:03:15] Luke McClanahan (Planning Manager):** Thank you. Yes, I have a presentation here I'll get out on the screen. So yes, JP Vang the developer is requesting approval to construct a 130-unit apartment building known as Hudson Boulevard Apartments... [Detailed presentation of the project]. This is a public hearing. I know the developer and the development team is here in attendance. I'd be happy to answer any questions. Thank you.
**[00:11:40] Mayor Kevin Zabel:** Anything else? Nice job, Luke. That is a lot of ground to cover. Council members, any questions for Luke right off the bat before we open up the public hearing? All right, we're going to go ahead and open up the public hearing... Anybody that would like to step up, state your name and address for the record.
**[00:12:15] Justin Fincher (Developer Representative):** Mr. Mayor, Council members, my name is Justin Fincher, I'm with JB Vang, the developer for the project. I just wanted to say thanks again to Luke and City staff... We did just want to ask tonight to respectfully remove the requirement for the shared access easement on our property to benefit the adjacent property owner. We're all for being good neighbors but just ask that we work through those details at a later time.
**[00:12:55] Mayor Kevin Zabel:** Is there anybody else in the audience that would like to speak on this project? I'm going to go ahead and close the public hearing and bring it back up to the City Council for consideration. Council members, we have four action items in front of us. Let's tackle the first one: the PUD Amendment. Can I have a motion?
**[00:13:15] Council Member Jake Inglebretson:** I'll make a motion to waive reading and adopt Ordinance Number 884 approving an amendment to the Greenway Station Planned Unit Development to increase the allowed density for multi-family development.
**[00:13:25] Mayor Kevin Zabel:** There's a motion. Is there a second?

**[00:14:00] Council Member Jake Inglebretson:** Mayor, if I could—is this the one with the condition on the easement, the shared driveway easement? To his point, why would we require them to have that if it's 100% on their own property?
**[00:14:15] Luke McClanahan (Planning Manager):** I might have to pull in Andy or the City Engineer here. We're thinking in the future how do we consolidate the accesses and minimize the number of accesses... Staff feels very strongly about requiring the shared access.
**[00:14:40] Mayor Kevin Zabel:** I do know when we went through the Greenway BRT/TOD planning process, that was a big area of focus... limiting as many driveways as possible.
**[00:15:05] Andrew Gitzlaff (Community Development Director):** Thank you, Mayor. I just want to reiterate some of the points that Luke made. We ran the language by the City Attorney, Jim Thompson... At a staff level, we feel this is pretty important to make this development concept work.
**[00:15:45] Council Member Jake Inglebretson:** Staff has been heard, I understand your viewpoint, but as a policymaker, I also have to look at what's fair to the applicant. I don't think giving up property rights without compensation is fair... I would like to amend the motion to not include that condition.
**[00:16:30] Mayor Kevin Zabel:** For clarity’s sake, let’s go ahead and get this motion in a second, and then if we want to make changes we can work off of this as a baseline. Can I have a motion?
**[00:16:45] Council Member Katie Wrich:** I'll make a motion to waive reading and adopt Resolution 2023-81 approving the preliminary plat and final plat for Hudson Boulevard Apartments with conditions included in the attached resolution.
