good evening and welcome to this uh uh Council me uh Prior Lake City council meeting of Monday February 27 2023. if you would please uh join me in the Pledge of Allegiance I pledge allegiance to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and justice for all well good evening and welcome uh the first item on our agenda this evening is the public forum and the public forum is that opportunity for uh anyone that would like to come before the city council to be heard and we do have Mr Dean Swanson signed up to uh to be heard this evening so Mr Swanson we we invite you uh over to uh to the side Podium and if you would uh again for the record or restate your name and address as and uh make sure the green light is on in the base of the microphone we look forward to your testimony will do thank you mayor Dean Swanson 14080 Hidden View Road um I was looking at the agenda and I don't really see any more activity I suppose with the Highway 42 re-entry house from Scott County and they're just continues to be some questions so maybe some of this could have been done in an email but this is a nice official way to get it on record to some of the questions that are that are still out there at least in my mind um I was wondering if there was any official response uh the the memorandum of understanding from Scott County based upon the letter of response that priorly accept them regarding the concessions on that re-entry house I was also wondering if there's been any discussion on increasing police visibility along Shady Beach Trail uh bay Shady Beach Trail Hidden View and Bayview Circle um with the house in operation because currently we don't really see much of any police traffic through there and not that there's any needed but it would be nice to get some visibility there through there um when that house does go into operation which we know it will um and just as a as an update the the first house in the area has gone up for sale and has been sold so the fear and the um the stress it continues regarding this uh this this transaction and um and just the disappointment in how Scott County has conducted themselves in this whole transaction thank you thank you Mr Swanson um is there anyone else that would like to come before the council and address US during the Forum seeing none I'll go ahead and close the Forum if I can direct the questions from Mr Swanson to manager Waddell and again I captured um two questions response from the county okay yes uh thank you mayor counselors and Mr Swanson so the the city council did provide a formal response back to the county based on their last letter I've had verbal discussions with them in an agreement that we would work on putting a memorandum of understanding together that is in the process as part of those discussions there was a request at the last city council meeting from one of your neighbors asking if the the number of residents on the Community Committee that's being proposed could be increased and I did get confirmation from the county that they would increase it from two to four representatives from the neighborhood so they've they've already agreed to that request so that is in the works but the the formal memorandum of understanding is still in the works second question I had is that in regards to increased police visibility and I don't know uh manageable if you want to address that or mayor and counselors I think we did discuss the you know the the police's acknowledgment of when this house does become occupied they will certainly be in contact with Scott County and and make sure that they are pursuing it and and um surveilling the neighborhood as as needed the last time I spoke with the county they were anticipating residents actually living in the house probably in mid April was the date they're they're currently targeting so knowing that we will certainly be working with the county to make sure that we're we're having a presence there okay um I think that that concludes the Forum uh Council next time on our agenda is the approval of the agenda itself any modifications if none I entertain a motion to approve as submitted so Moon Burkhart second motion by council member Burkhart second by councilman Brady approve the agendas submitted all those in favor say aye aye motion carries that brings us to our meeting minutes and a motion to approve those meeting minutes of February 6 2023. um California revisions modifications additions to those many minutes if none again I would accept a motion to approve I'll make a motion to approve the February 6 2023 city council meeting minutes broadcast seconds motion by bray to Second by council member Burkhart to approve those meeting minutes has submitted all those in favor say aye i i i and that brings us to our consent agenda I'm going to go ahead and hand this off to city manager Waddell to both um introduce the consent agenda as well as those items before us uh for consideration this evening manager Widow thank you mayor counselors and members of the audience the consent agendas for those items that are considered routine or non-controversial that are placed all together on the consent agenda so unless the mayor or counselor asks for an item to be removed for a separate consideration they're all approved under a single motion second and a vote any items that would be requested to be removed this evening would be placed under item 11 on tonight's agenda so that being said the the following items are on our consent agenda this evening approval of the claims listing approval of the January 2023 animal control services report approval of the January 2023 building permit summary report resolution declaring costs and establishing the date of assessment hearing for the fish Point Road Phase 2 Improvement project city project 2023-02 a resolution accepting bids and awarding the contract for the County Highway 21 County Highway 87 170th Street construction project city project 2020-29 resolution awarding a contract and authorizing the purchase of playground equipment for Ponds Park City project 2021-03 resolution accepting bids and awarding a contract for the wilds and Quaker lift station Rehabilitation project city project 2022-24 resolution awarding contract for Memorial Park ball field netting improvements city project 2021-03 resolution to receive plans and specifications and ratify the advertisement for bids for the Ponds Park phase one project city project 2021-03 resolution of support for lakeville's application to the corridors of Commerce program for the Reconstruction of the I-35 County Highway 1550 interchange resolution approving public improvements for the Spring View Meadows development and lastly a resolution approving purchase of personnel management and performance tracking software for the police department thank you so much manager Waddell counselor there any questions you would have on the items that manager Waddell just submitted under the consent agenda and or are there any items that you would ask be removed and taken up under um item 11. if none I would entertain a motion to approve for our consent agenda so moved second we have motion by a councilor bray to approve the consent agenda second by Council Lake all those in favor say aye aye aye and that motion carries Council are there any comments that you'd like to make on the consent agenda items that we just approved I have a comment please um agenda item e um I we did talk a lot about the street impact fees but I think it's important to note that by the time we are done with that project we will have essentially depleted our fund for Street impact fees thank you so much Mr Lake that brings us to item 10 on our agenda which is a resolution approving a major Amendment to the Jeffers Pond plan unit development PUD plan for Jeffers apartment and we have a planner Mr monskey with us this evening foreign thank you Mr Mayor members of City Council as you just said before you tonight is a project to be highlighted as a major pewd Amendment it's within the Jeffers Pond PUD and many of you are familiar with it so I won't necessarily go too long through the history but Jeffers Pond has so much of a dynamic planning to development history and stuff I just want to highlight through that to show you where we've come from to to get here tonight you're well aware but the location of the Jeffers Pond project is at the Southwest intersection of County Road 42 and County Road 21. it's a residential and a commercial development project that has primarily been designed for residential in the years since 2005 when it was first developed most recently it does also have a have a commercial Child Care Facility as part of it and I'll get into that in a little bit but what the subject site that we're looking at right now in particular is part of Outlet C of the first edition and this is the highlighted area here that is basically the basically the Western portion of the corner Outlet that's right at the intersection corner of County Road 21 and County Road 42. uh what is being proposed is 140 unit uh three-story uh market rate apartment building as well as over 35 000 square feet of potential commercial land for future uses as I said the Jeffers Pond PUD project was started in 2005 uh so well over a couple almost a couple decades ago and a mix of residential densities commercial uses both of all densive density of residential nature between low medium high density residential development uh Jeffers Pond Elementary School the Park area the trail system the fudge fire station number two as well as a commercial development that is actually now just recently been completed for construction and uh has some other vacant sites within the corner development lot that we're proposing as well as out Lot B that was uh before you um not in the more recent years uh for 197 unit apartment building and you might see that uh come back for final uh Plata in the uh in the near future on that project as well so just going through phasing I won't go through every aspect of it but as it phases through its various developments from 2005 even with the slowdown in the housing recession Jeffers Pond has seen various aspects of residential that's our the station area where our fire station is located another aspects of town homes in Parkside the point which was single family residential and all of these areas were different development phases of the Jeffers Pond phasing the last one being the little explorers child care facility that is the only commercial development that's located in this corner which was originally known as the pier or else also known as The Village was an area that was when Jeffers Pond first started in 2005. so what we're looking at in this unique's perspective is the area where you actually see the label of the village and as I said this this map wall is turned on its side North is to the right uh County Road 42 here is on the right side in County Road 21 heading towards downtown is on the South Side so on the next slide I'm going to turn it to the to uh to more Orient towards Compass North now you have Highway 42 on the North side here and 21 here and this was the 2013 or 2015 land use plan that was approved by the city council that designated somewhat of the remaining undeveloped phases of Jeffers Pond and mainly the high density and Commercial development phases and what's key here is the I wanted to key in on the two aspects of a minimum 318 residential housing units and a minimum of what was 87 000 square feet of commercial that the city council wanted to desire at this location upwards of possible 270 000 feet but a minimum of 87 000 feet so little explorers was just over 16 000 square foot so under that plan we still needed an additional 70 000 square feet of commercial and what was proposed back on April 2022 to the Planning Commission was that this site would be primarily all residential you the city council saw this as a concept proposal by the developer that wanted to do this as commercial or excuse me as a residential three-story Housing Development and shift all of the commercial to the Eastern portion of the the site and the city council reflected back to the developer through their concept proposal and the Planning Commission in a public hearing reiterated that they wanted to see some commercial uses planned for this site and not purely make it all residential because we felt that as a city that 87 000 square feet of commercial minimum would not be achievable if this site were to go all residential so the developer did take that to heart and went back and did some redesigning of their site plan proposal and it has come back with this design today so that their Jeffers Pond Apartment project which is a 140 unit single uh single building of three stories is the yellow building that you see on the southern portion of the site obviously they have a parking lot to the interior but the red portions to the site instead of proposing it for commercial or excuse me for residential uses they would remain uh undeveloped at this time but reserved for commercial uses and as their parking and development plan indicated this particular plan would indicate a possibility of around 35 000 square feet which does sync up with the 2015 land use plan of eight years ago so just wanted to highlight that they basically looked at redesigning the site again per the planning commission's recommendation per the city council's recommendation at the concept to maintaining more commercial land uses adjacent Direct adjacent to County Road 42 on the North End so what they would be proposing to build and construct at this time would be the yellow residential three-story building as well as the parking spaces in the parking lot both underground the building and in the surface parking lot that would accommodate the residential uses and in the future everything highlighted in red here for parking and Commercial uses would be able to be shared parking and other aspects of the site one of the other things that they're designing is the storm water facilities for the site as a whole so this is not just for the residential portion but they are also designing these storms stormwater facilities so that they would be able to accommodate the additional stormwater needs of the commercial aspects in that site area as well so as part of this planning to development amendment that is one of the the key pieces that they're looking at at consideration for it access to the site is through the roundabout that's on Jefferson Parkway traffic needs and accessibility this is is exactly what the site was designed to do back in 20 2005 when Jeffers Pond was originally created so they are following that plan as well here's a conceptual elevator not specifically exactly what it would look like but it's they pretty much have their building design it hasn't really changed a whole lot from previous design it's a flat roof has different varied architectural materials um awnings balconies different areas that is that is found in a lot of the other products of what Rachel development does throughout the metro area and some of their housing product types so as I've said before there have been 10 major amendments uh and a lot of changes over the years to the Jeffers Pond development project since 2005. basically as we get to each aspect of a development um we go through another amendment procedure so that the Planning Commission as well as the city council has the ability to individually approve these developments as part of this initial development design and a lot of that is because the original development of Jeffers pond in 2005 while a really Grand and nice design is obviously going to go through a lot of changes as the market changes over the years and in the past 18 years that has happened significantly you know forwards and backwards and and so as the the city is flexible to that idea that's exactly the reason why planning developments are created so that we can be more somewhat flexible in our ordinance standards but still get some high quality products and Commercial and residence development within the City of Prior Lake so I won't read through all these bullet points but obviously puds provide a flexible approach in allowing us to have that creativity allowing us to provide that good product to the City of Prior Lake and the Jeffers Pond is a really good highlight of a reasonable PUD and a good quality one that provides to the City of Prior Lake in a lot of ways so with that the city does recommend at this time approval of the major PUD Amendment for the 140 unit apartment building and the designation of that 35 000 plus square feet of future commercial land uses when some land uses come in that would be specific to that we may be back with another amendment if it was to be more specific in that square footage amount um but if it would fit within the the parameters up to 35 000 square feet they could move right into that commercial aspects of it at the desire of the city with their project so the applicant still will need to go through final plot approval for those projects so the city council would see that in the coming months for the uh for the plating of the property but that would not necessarily be a large plan discussion item as it would reinvolve mainly just final Platinum development agreement so I'll take any questions you might have at this time Kelly Johnson is here representing the developer Kelly's been with the project of Jeffers Pond since the beginning of 2005 so if you have any historical questions I'm sure she'd love to answer them thank you so much Mr motsky Council any questions for Mr motsky uh Council Brad no I basically just have a comment um you know this amendment uh has been a work in progress for quite some time uh you know I remember starting to follow that uh when the Eda weighed in on it to be sure that our much needed commercial space was saved and reserved for just that commercial um so the city can continue to diversify our tax base and also serve our residents through retail and commercial in the main arterial road so I'd like to say thank you to director McCabe planner motsky the Planning Commission the Eda for ensuring that these changes happen and also thank you to the developer for your investment in Prior Lake and for listening to the community to make the necessary changes to move forward so I'll be in support of this tonight any additional comments um I I just like to follow council member braids uh indeed the developer I know um this is one that we the council were pretty clear on and we drew a pretty solid line too as councilor braids said to ensure that the commercial growth did occur um but I would like to thank the developer for um again the investment but also seeing this through uh in the vision for the city so I too will be be supportive but Mr monsky Mr McCabe please do share our appreciation to the developer for the work that they've put into this project Council I would entertain a motion I'll make a motion to adopt Ordinance one two three approving a major Amendment to the Jeffers Pond plan unit development plan Burkhart seconds we have a motion in a second all those in favor say aye and that motion carries that brings us to our council member lays on uh updates um Mr Lake um if you would please lead us off on February 10th I attended the scale general meeting and also the Rhino Bar soft opening on February 16th I attended my community engagement committee meeting on February 17th I had the agenda review and on February 18th I had a blast participating in the Polar Plunge in on February 24th and 25th I participated in elected leaders Institute Foundation program by by the league of Minnesota cities thank you Mr Lake councilmember Churchill sorry on the 10th I attended the scale general meeting on February 16th I had my lle steering committee meeting on the 17th I had my agenda review and on February 22nd um the lle housing co-chair meeting was held thank you Council Churchill councilmember Burkhart mayor members of the Council on February 15th we had a board meeting for Minnesota Valley Transit Authority on February 21st at my agenda review in February 22nd had an orderly annexation meeting thank you and councilmember braid mayor members of the Council on 213 there was an Eda meeting on 2 17 I attended my agenda review and on February 22nd I also attended the orderly annexation board meeting with council member Burkhart that concludes my report thank you so much and for myself attended the scale general meeting on the February 10th had a meeting with the smsc on the 13th Regional Council of Mayors meeting on the 13th and also an Eda meeting on the 13th on Valentine's Day manager would unrelated to but it was Valentine's Day uh manager Waddell and I uh were up on The Hill in Saint Paul and met with multiple representatives and Senators uh in support of um our street impact fee legislation and we had many positive positive meanings on the 17th of February a manager Waddell and I also met with legislators with our mlc meeting on the east in Eagan and then again on 224 met with our mlc uh sister cities with our legislators to the west and that concludes my liaison update manager woodell anything you'd like to add thank you mayor and counselors uh the only thing I would add is just to add on to what I mentioned during the public forum so regarding the Scott County re-entry house they are sending out their mailings this week to all the homes within a 1500 foot radius of that home asking for volunteers to be on that on that Community Committee so residents should expect to see that sometime towards the end of this week excellent um with that Council I would entertain a motion to adjourn so moved second we have a motion by
