Good evening. >> Good evening everybody. The few gathered here for zoning reszoning Z3325 Gresham Lake Road. And I will call up Matthew Clim. >> Good evening, mayor and council. Matthew Clen, planning and development. Uh here to present Z3325. Uh if you'll remember, we had a public hearing for this case on January 6th. Uh the applicant expressed desire to uh amend the zoning conditions to add a number of play courts to the request. Um so I'll walk through those changes now. So this is a request to reszone 7.8 acres from heavy industrial with the special highway overlay district 2 to industrial mixed juice with the special highway overlay district 2. Uh planning commission recommends approval 8 to zero. This is the site here. Uh it is currently developed with a light industrial use and is adjacent to the east um to a landfill and to the west is uh I540. It's on Gresham Lake Road. Uh zoning conditions limit development of the site to 10,000 square feet of retail um in the aggregate. So any number of buildings on the site can have no more than 10,000 ft of retail and there can be no more than 50 plays. the intended use uh is a pickle ball facility. Um this looks at the change in uh land use intensity. So the requested zoning is a five-story industrial mixeduse zone. Uh so you can see the increase of residential units uh and some changes to setbacks. Um in some respects this is a an upzoning because taller buildings are permitted, but in other respects it's a downzoning because heavy industrial uses are no longer permitted. So, light industrial uses uh would be permitted in the EX district. Um but those heavier noxious uses are prohibited. >> Matthew, before you go, I forgot to say that um Mayor Pim Harrison is excused and absent this evening. Thank you. >> Yes, ma'am. Um consistent with the future land use map and the urban form map and the comprehensive plan overall, a number of consistent policies uh inconsistent with zoning and infrastructure impacts um in reference to the response time standards. Um, and this is the planning commission findings. I'm happy to answer any questions for you. The applicant is here as well. >> Okay, questions for Mr. Clim. Okay, so we have a public hearing and we have Isabelle Maddox signed up in support. >> Good evening. I'm Isabelle Maddox. I'm here today representing RITD LLC, the prospective developer and owner of this property. Here with me today is Christopher Mlitch who is the principal in this business and our civil engineer Bill Pyiver is also here in case you should have engineering type questions. Um let's see if I can get this presentation. Um Matthew gave you an overview and this is an it's an industrial area but there's also a lot of residential. If you look across 540 and even across Gresham Lake Road, there's more ind residential in this area than there used to be. The current business on site is a remediation business where they primarily go offsite to remediate things like, you know, water and and fire damage, that kind of thing. That will remain. Um, but what is proposed is a pickle ball complex. Um, my client has gotten very into pickle ball and has decided there's not enough courts in Raleigh. we need to do something about that. And so he's he's doing something. He's got some investors and they're very excited to bring this to Raleigh, which um all my friends who play pickle ball say the same thing. Not enough not enough courts. Um so the request is heavy industrial uh to industrial mixed use. Um there's the zoning map. We will be maintaining the Shod 2 yard along 540 and for that that's for that reason there's a lot of land there's almost eight acres in this site but there's a lot of land area so I don't think it the the height of this building will bother any neighbors because we've got you know 540 as one buffer we've got industrial heavy industrial uses around us um and we got a lot of land area in the in the uh site Um, the proposed building is sort of back on the back part of the site. And here are some uh some elevations of I've got to get I've got to remember how to get rid of this there. Um Oh, you got it. >> Yeah. So this is sort of um what what they envisioned, the pickle ball complex, some outdoor eating areas, some outdoor, you know, hanging out areas. So between pickle ball matches, you can go and enjoy that. Um so some graphics on one side of the building and there may be at some point in the future a small stadium that um would allow for tournaments and that kind of thing. Um so the conditions are you know 10,000 ft retail max which would mostly be restaurants. There would also be associated uses with pickle ball like showers and locker rooms but primarily it would be a restaurant um you know some sort of uh food service, drink service and then a maximum of 50 play courts. Um we do we are consistent with the city's plans. We have had no neighborhood opposition. We think it adds popular active use to address the play court need in the area and it is an ALA economic development target area. Uh and we feel like this contributes to sort of mixed use uh in this area because you do have a recreational use with a restaurant and uh you have a fair amount of residential in close proximity. So you know I have Mr. Pyiver here. If you have engineering questions or you have any general questions for me feel free. Okay, questions for Miss Maddox.
