Good evening and welcome to the Monday, February 12th meeting of the Prior Lake City Planning Commission. Please join me in the pledge of allegiance. I pledge allegiance to the flag of the United States of America and to the stands one nation indivisibley and justice for all. Thank you. And uh with that, we'll dive into the agenda. Reviewing today's agenda. Does anybody have any additions, changes, or comments? Seeing none, I'll take a motion and a second to approve tonight's agenda. So move. Second. Hearing a motion and a second. All those in favor say I. I. I. Today's agenda is approved. With that, uh, I'd like to review today's or the meeting minutes from Monday, November 27th. Were there any comments, questions, or additions to the minutes? Seeing none, I'll take a motion and a second to approve the meeting minutes for Monday, November 27th. So, a motion. I hear a motion and a second. All those in favor say I. I. I. The meeting minutes are approved. We have one public hearing tonight. Uh, and I have a few comments regarding how we will conduct the hearing. So bear with me for just a moment. On behalf of my fellow commissioners and staff, I'd like to welcome everyone and review the public hearing procedure we will follow this evening. First, staff will present its report on the request at or issue at hand, and planning commissioners will have an opportunity to pose questions about the staff report. Next, the applicant, if present, uh, will have the opportunity to address the commission, and commissioners can respond to the applicant with comments or questions. Following the applicant's presentation, I will open the floor to public comment. If you wish to address the commission, I'd ask you please approach the podium. Press the button until it turns green and then clearly state your name and address for the official record uh so that everyone will have a chance to speak. Please keep it keep your comments to one to two minutes in length and make concise statements of fact pertaining to the specific application. This meeting is the official public hearing and your primary opportunity to be heard on this matter. The city council has no obligation to accept further public comment and in many cases they do not. So please do not hesitate to speak up. And with that, I'll turn it over to staff for item [Music] PDEV24-00001, a conditional use permit for 4719 Park Nicollet Avenue Southeast. Chair and Commission, thank you. Tonight before you have a application for a conditional use permit for motor vehicle sales at 17 pardon 4719 Park Nicollet Avenue. Um the applicant is traditional equipment leasing and the owner is VCB properties. They are requesting a CUP to conduct motor vehicle sales business on that property. City code does allow for motor vehicle sales through a CUP in the C2 zoning district. Here we can see the subject property in context um with some of the surrounding neighborhood and we'll go over some of the details of those neighborhoods shortly. Um to the east of the subject property is medium density residential or R3. In addition to that, there's commercial C2 just like the subject property to both the west and to the south. There's an existing dealership um that's nearby and the main access is off of Park Nicola Avenue Southeast Franklin Trail on to 13. So that'd be the natural course and flow. Um the existing building is on 1.8 acres. Um there's about 21,000 square feet of structure with 84 parking spaces which become gerine shortly. Um again this is in the C2 general commercial and there's a permitted drive-through on property. So again reviewing a conditional use is allowed for motor vehicle sales in the general commercial district. There's prescriptive conditions that um will follow this as well that's found in code which we'll review. Staff also recommends an additional condition that no vehicle sales are to be displayed on site for sale and that'll become apparent shortly. In addition to staff's recommendations for condition um additional conditions are no motor vehicle um transport loading on minor streets, no display or storage of motor vehicles on um public rightway and also all test driving shall be done in accordance with the law. Again, staff is recommending an additional condition to the CUP that no vehicles are be displayed. And the reason for this is follows. There are 84 parking spaces on the subject property. Um, currently there's 21,249 ft of building and code requires one space per 250 ft. Um, this means that the requirement is 85 parking spaces approximately. This means that um, there's no additional capacity for on-site sales and storage of vehicles. And so that's the reasoning for our recommendation. In addition to that, there's some general um concepts and uh um considerations for condition use permits such as that this um application supports the comprehensive plan that it won't be detrimental to the area surrounding it. that the CUP is in alignment with the purpose of the zoning code and with the district which um it's conditional use in that district that won't have adverse impacts on infrastructure or government facilities and that it generally the site is prepared and ready for this particular use which is is already built in existing structure in use. So with that staff is recommending or requesting that we hold a public hearing. Staff recommends approval of this up with the conditions as stated. Um again a motion and a second to approve the condition use permit to allow for the sales and motor vehicle sales at 4719 Park Nichollet with the listed conditions. Um we also have tonight the applicant here with us today. Um staff would be willing to take any questions you may have and we requesting a public hearing tonight. Thank you. Thank you for a great report. I think um upon my review I felt that this was a pretty straightforward request. Um, we'll go just along the commissioners to see if there's any comments or questions. State your name and address for the record. My name is Dwayne Guyger. U, I live at 7991 Covered Bridge Road in Prior Lake. Um, so my son Ryan and I own uh traditional equipment leasing. We buy, broker, we do some selling and we do our most of our business is equipment leasing, motor coach leasing. And as a requirement for a dealer license, we have to have the the zoning for our office. So we we lease an office in the New Market Bank building and um um it's it's pretty straightforward. We uh we don't we're not we have no uh we have no issues with any of the restrictions that Paul has stated. Um we have no intention of displaying motor coaches there. Um it's not what we do. Mo most of our business is is brokerage. We buy some vehicles from from some new vehicles. Most of it is in the southern part of the country and just a business we know and so we operate it here. be happy to take any questions. And then no intentions of expanding the business beyond that core motor coach leasing? No. Okay. No. And you understand the requirements or the restrictions that are in place? And yes, that's not likely to change with that property. Okay. No. Uh I don't have any questions. I'll invite my fellow commissioners if you have any. So anything that you any vehicle that you deal with is somewhere else and you your business is virtual. Yeah. Right. Either by phone or some other Yeah. Um technical. I spent 35 years in that industry. So I have lots of relationships and um most of our vehicles are for employee um shuttles. um um California became famous for it when they were shuttling all their employees and in Northern California all their employees to their offices. But most of our work is with um in the southern part of the country with big development projects, big construction projects and and they they shuttle in hundreds of employees and they need uh they used to use school buses, now they use motor coaches and so I know the people, they know me. Um, so yeah, I guess it's kind of virtual. Um, the Yeah, we we will not have a for sale sign on vehicles in on the property there. Other commissioner questions, comments? I just had one question. Um, I saw in your letter about this being a step to getting your your dealer license. So, um, assuming you get that dealer license, will that change anything in terms of the site and the location? Okay. Thank you. No. Okay, seeing no further questions, I appreciate your comments. Thank you. Thank you. Uh I view this as a largely administrative action. Uh and I think the the staff report was put together very well, Paul. Thank you. U and it's a fairly straightforward process. I have no concerns in supporting this and I do Oh, I'm sorry. Um so I'll finish my thought. So um this feels straight fairly straightforward and I appreciate the applicant's interest in moving their business to Prior Lake and planting a flag here. Uh, commissioner comments. Just go ahead and do comments. Uh, administrative and straightforward were terms you used a minute ago. I agree completely and we'll be supporting it tonight. No problem with this with the uh uncondition of no vehicles ever Martin for sale on the property. So other and with that I support it. With that I'll take a motion and a second to approve. So moved.
