Last week I issued an emergency declaration as the municipality continues to support the state of Alaska's disaster response in western Alaska. And thank you to the members for your support. So far, 655 people have been evacuated to Anchorage and we continue to work closely with the states. The Red Cross are tribal partners ASD and many other groups to welcome displaced Western Alaska, neighbors to our community. Efforts to support long-term housing has started and our team is coordinating with the state's housing task force. Over the weekend we met with our partners at the Southcentral Foundation, Alaska native tribal Health Consortium and the Cook Inlet Housing Authority to begin housing work. While some people may be able to return to their communities in weeks, many evacuees won't be able to go home for months or up to a year or more. Anchorage needs more housing to ensure everyone in our community has a stable place to live on tonight's agenda. My team has proposed 3 key ordinances for consideration that will help us reach our goal, a building or rehabilitating 10,000 homes in 10 years. 2025, dash 9, 4, will streamline the process for updating older buildings that were legal and built but no longer comply with the zoning code. This change will reduce barriers and costs to making much needed repairs. 2020 in the 5 dash 1, 1, 2, will make it easier to repair or to replace aging mobile homes. We're simplifying the code to allow all types of safe housing in mobile home parks. This will help increase the quality in the supply of lower cost housing. Additionally, I've proposed a new registration requirement for short-term rentals. This is a critical step to help us get the information we need to measure the true impact. Also on the agenda tonight is an ordinance to authorize negotiation for the purchase of City Hall. I remember when I first started on the assembly back in 2017 and former chair D*** Training would say that we could have bought the building multiple times over by now. Christian Felix, I know you remember that too. There's been talk about buying this building since the early 1980's purchasing City Hall will save the municipality about $300,000 a year. And welcome to our regular business meeting. And I did hear from Mr. Training on the purchase of City Hall today. So he's still in the conversation after all those years. the thing all start about is the western Alaska evacuation. I'm grateful to the municipality and grateful to our friends at Southcentral Foundation, Alaska native tribal Health consortium, the Alaska National Guard, the governor and the state response, Anchorage School district everybody who's dislocated or working to get people here and get them safe. We are here. We're ready for this response. And you are welcome here. So I thank you to everybody who's been part of that. I did have an opportunity to visit one of the shelters today. We're with a group called the United Cajun Navy, which is an emergency response group that applies to events like this and provides resources and support and my father's Cajun and they come from very close to where my family comes from. So it's a great opportunity to meet with them. See some of the things that they brought and connect with some of the individuals within the shelter. you know, it was resoundingly called, which was different than a lot of shelters that have experienced over the last number of years. Thank you again to all the emergency workers, municipality or administration who have been working hard to ensure we meet this moment. We don't yet know all the ways this will impact our community. I do. The people of Anchorage always step up for neighbors just as they step up for us when things go wrong here, we'll do our best to welcome and support evacuees and make their time in Anchorage comfortable as possible. We are waiting for our delegation in Washington to impress upon the executive in Washington. To do their duty and declare this emergency. So the funding can, in fact, flow support to individuals in there. Time of need. So we're we're looking at you. Senators Murkowski and Sullivan to land this plane. Next. I'd like to talk about a little bit of a radio show that I did this last week, 10 days ago, Mr. Barker from Eagle River want to acknowledge that in these trying times one political. Discourse is coarsening and the that comes off of the debate is not light, but instead. It is incumbent upon leaders. And civic roles to model and demonstrate that, though we may not agree. On this or that issue. One thing we can agree to do is work together, said to get the work done. The people need and tomorrow for the communities out there that we can disagree passionately on any item that we can continue to do the work of building a community. So I think burger for the time, Alaska public media and I look forward to our second episode of that story. When we go on a radio show by a former member of this body. It was well received. Lots of feedback from members of the community and it was it was worth the time. So finally, the big item on our agenda tonight is the budget. The first public hearing of the budget. The code provides. We will have 2 public hearings will open the public hearing and close the public hearing. Anyone who testifies is welcome to come back and testify again in our next meeting. We haven't decided exactly. One will take up the budget question. It will either be around 06:00PM or just after the dinner break will make a motion to change the order and take up the budget items. That's set of items items, 14, 8 through 14 G that we must get through tonight. There have already been a number of work sessions on the budget that have been highly informative and encourage you to learn more and get engaged in the budget by visiting our budget and taxes. So we don't know how much time it's going to take to get through the business. But there are a lot of items on the agenda. We're going to our best to be as expeditious as possible to get the work done. And also remind members and members of the public that if you are interested in what goes on our road and drainage ponds that I would encourage looking at the shortlist that does not include specific projects, but for each district to take a look at what your district priorities are, because we know there's a lot of longtime priority. So I would encourage members to consider amending or or bringing potential amendments to that through the budget process in November. We recently submitted a resolution and believe it was e-mailed to you guys. I do have extra copies in case anyone have with like what? Thankfully, those here for the clerk. In summary, our council represents a diverse, encourage neighborhood that deeply values, compassion, safety and accountability. We recently passed resolution 2025 '04 0.1 urging the assembly and mayor to strengthen our city's homelessness response through enforcement paired with treatment and accountability. Over the past few years, unmanaged encampments have brought serious challenges to encourage. From increased violent crime and drug activity to hazardous waste and fires in public spaces. According to the encourage health Department, encampment related 9-1-1, calls are up. 37% since 2022. Ballpark in trail use in those areas has dropped nearly 30%. At the same time encourages spent more than 225 million since 2016 on homelessness. Interventions. yet the number of people living unsheltered has not decreased. The shows that housing alone is not enough without addressing addiction, mental health and employment. We're simply cycling. People through temporary fixes. We support the Assembly's passage 2025 dash 7, 4, as one which strengthens enforcement against illegal camping. But enforcement must be paired with a path forward. Mandatory treatment, mental health care and job readiness programs that restore stability and dignity. We also see new federal opportunities. President Trump's executive order on ending crime and disorder on America's streets. Prioritizes clear encampments combating open air drug markets and expanding treatment options increase should move quickly to leverage those federal resources. The funding legal authority and law enforcement support to help our city act decisively and humanely. Successful cities like Houston in Salt Lake City show that navigation centers with wrap-around services. Including health care addiction, recovery, legal aid and employment, reduce chronic homelessness by up to 60% while lowering costs, we can replicate that success here. resolution calls for enhanced enforcement treatment. Pathways. Mandatory participation in recovery in employment programs, independent audits in performance-based contracts and transparency and community engagement. So residents are part of the solution. We're asking the assembly to adopt integrated strategy that restores safety to our public spaces ensures accountability for public funds and gives every individual a real path to recovery and independence. This is not about punishment. It's about compassion with results. It's about restoring order, dignity and hope. And for everyone who calls encourage home. And whereas the NDA and theme for 2025 is celebrating value and talent. And whereas the Americans with Disabilities Act celebrated its 35th anniversary this year, a significant milestone which prohibits discrimination against people with disabilities in various areas of life, including employment. And whereas disability can happen to anyone and people with disabilities, including those with professional training, can often contribute to the workforce with accommodations and modifications. But our many times overlooked. And whereas Alaska has a lower approval rate for says Social Security disability than other states. Yeah. Do it with disabilities. Still need equal access to in palm and health care. And whereas the past few years large-scale challenge is changing norms and employment adjustments, proof that many employment requirements may be successfully completed in non-traditional ways and differently. Abled individuals have a legitimate and ongoing role in the work environment. However, it looks and changes. And whereas hiring people with disabilities creates a vibrant, diverse economically sound welcoming, robust and competitive Alaskan workforce and whereas policymakers, labor leaders and employers can increase economic vitality by training for and establishing disability, inclusive workplaces, with part-time professional work, disability, friendly technology, an equal opportunity for all. ensuring disabled workers have access to good jobs every month of the year. Now, therefore, the Anchorage Assembly recognizes the month of October as disability Employment Awareness Month and encourages the people of Anchorage to further their awareness about disability, inclusive employment passed and approved by the Anchorage Assembly. As you can see, there are multiple people here at the podium today. We've got empowering education. That's my nonprofit. We've got division of vocational rehabilitation. And we've also got the archive Anchorage represented here at the podium today. All of us, 2 very different types of work, but all of them are very important. And I think this is a wonderful representation of how disability resources and supports and impacts kind of span all over. So I'd like to introduce a couple of folks. You can say own names and info and street cred from the division of vocational rehabilitation. Good Evening. Thank U N N. >> For inviting us as your guest and thank you to the Anchorage Municipal Assembly for recognizing October as Disability Employment Awareness Month. My name is Kate Tutor. I am the director of the division of Vocational Rehabilitation and I wanted to share some of the 2 statistics about how the good work that we do has impacted the municipality of Anchorage over the last state fiscal year. Division has served 678 individuals with disabilities in the municipality. 255 of those individuals were new applicants over the last 8 fiscal year. The average hourly wage for individuals from the municipality exiting our program with amazing $19 and $0.91 per hour. And the top 3 areas of employment that our clients are now working in our office and administrative support, production construction, operating maintenance of material and then occupations and arts design, entertainment, sports and media occupation. So again, thank you so much for this resolution. It means so much to the people of Anchorage and I am going to turn this over to my colleague, Megyn, to share success story with you. It's free for your hand. >> Applause. Thank you, Chris. >> Like director Dieter said my name is Megan Sheley. I am the regional manager here in Anchorage for local DVR office. I get the opportunity to share a success story, which was hard because there's a lot of them. I decided to go for one that could have happened to any one of us. I met a young man who had gone bear hunting. And he fell out of the tree. And when he fell, he broke his back at that he spine level. And it was a he was just with the body and he couldn't move in. His body had to go and rescue him. And this started his whole journey to determining how he was going fit into life and work in a different way. He came to the division of vocational Rehabilitation and we were offer him a multiple number of services. But I'd like that just share with you. A few of them that made a real difference in this person's life. He was able to get guidance and counseling on how to adjust to his disability. Work through the ongoing medical issues associated with paralysis. The other service we're able to provide him was vocational evaluation. We have an evaluation office here in Anchorage multiple areas throughout Alaska. And he was able to determine how he would best in the world of work, aptitude interests kills, etcetera. We were able to join with our job center and he went to college and got a bachelor's degree. And then he was able to build the confidence that he needed and and be competitive in the world of work again. And he was able to gain a professional level job. And the last time that I spoke with this person, he had gotten married and bought a house. And so those are that's just one story of all the stories that that we get to participate in. I I think the assembly for recognizing this very important month for disability employment. And I want to take the opportunity to thank the all over Anchorage and Alaska that allow us to be a part of their loved one's journeys. The employers. We have so many local employers who are who embrace the people that we serve. >> We can always use more. So if you know anybody looking good employees have them call us because we have them looking for jobs. But I want to really recognize the job coaches who are out there every single day providing one to one support and allowing making it possible for the people that we serve to be able to achieve their dreams. And go to work every day and do the things that we all get to do. And that's really all they have to say. But thank you all for recognizing. >> So I hope these stories really heartwarming and positive. But you know me and have to have to share different perspectives. Sometimes just for balance as we move forward. One thing that I've been thinking about in just wanted to provide is an idea. I grew up in vessel. I went to elementary school in Bethel. And as we all know, as you all know, you just you just have been doing a lot of work around that. We have a lot of people from Western Alaska coming into Anchorage right now. this provides an opportunity for us to look at things from a brand new perspective, not just programs that already exist in making shifts to them. But brand programs or ordinances or policies. And so not to conflate ideas, but I wanted to offer you a challenge and an invitation to think about all of the things that you're doing, making sure that there's an aspect of it that includes disability, accessibility. And so I also just want to say, like as a timeout as well and not saying people from that region are all disabled. That's what I'm saying. But the same way a ramp can help somebody in a wheelchair but can also help somebody making a delivery with a heavy box with the Dali or can help somebody who is pushing a child in a stroller and so ramp can be accessible to everybody in can be helpful with whatever kinds of things are coming in the days, weeks and possible. Years ahead, making sure that. You're seeing things through. And I of disability, accessibility will be helpful for everyone and hopefully doing that can also remove some of the stigma and fear around learning about disability access because I think sometimes some people don't want to touch it because they don't want to get it wrong and it would be the equivalent of people saying, oh, I don't want to touch homelessness because they haven't been homeless. So I can't speak to that. And just imagine if the entire simply said that's helped make no sense. so it's just an invitation to start shifting are thinking about getting involved in may be reaching out to some of these amazing organizations to do some education and for the municipality is an entity to include some disability access as well. And then that way, there can be more success stories in the future. Every October to increase awareness of the disease and to raise funds for research into its cause. Prevention diagnosis, treatment and cure. And whereas b***** cancer is the most frequently diagnosed cancer among women and the second leading cause of cancer deaths in American women, although it also affects men. Advances in early detection, education and research along with community support. That increases awareness have helped improve survival rates. And overall outcomes for individuals diagnosed with b***** cancer. And whereas municipal departments, community organizations, schools, churches and private citizens are encouraged to annually to observe October with educational programs, events, pink ribbons and other awareness efforts to support screening early detection and treatment. And whereas the municipality of Anchorage has historically so supported b***** cancer awareness in multiple ways. In 2014, the Anchorage Fire Department commissioned its first pink cancer awareness Fire truck and in 2019, a new pink fire engine was unveiled with the prior unit transferred to Kodiak to continue that legacy. During National B***** Cancer Awareness Month. Anchorage Fire Department personnel are authorized to wear pink cancer. Seemed uniform apparel and members of the department have supported the real men wear pink campaign. In 2018, the municipality, solid waste services introduced king compost parts, compost carts as a part of its curbside composting pilot selecting the pink color. Originally to weigh, raise the visibility for b***** cancer awareness. The Anchorage Police Department has participated in b***** cancer awareness initiatives and has used a pink seemed police vehicle to draw attention to cancer awareness efforts. In 2025. the Anchorage, Water and Wastewater utility introduced a b***** cancer awareness, sewer jetter truck at the October 4th 2025. Making strides against B***** Cancer event. Featuring awareness graphics, a QR code for donations and the inclusion of donor names. And it's designed to extend the municipalities visible commitment to the cause. And whereas the American Cancer Society's making strides of Anchorage Walk, Slash Ron took place on Saturday, October for us 2025 to raise awareness and funds to support innovative research, provide free information and patients support and help people reduce the risk of b***** cancer. 3 generosity and engagement of the community. The 2025 making strides event raised more than $99,000 in support of the fight against b***** cancer. Now, therefore, the Anchorage Assembly recognizes October 2025. As B***** Cancer Awareness Month. Encourages increased public education and awareness about the benefits of early detection for all Alaskans and supports local community events to reduce the risks of b***** cancer. One, there is a new federal interest in security on transit systems. >> Making the bus operators feel safe, but also the writers feel safe. We have. Every 3 months survey where we survey the writers and we asked them how safe they feel on the bus, how safe they feel like bus stops. And we've seen a significant increase in security was introduced. >> Okay. That's not. No, that's awesome. That's great. glad to hear that. What exactly. So they're unarmed, though. So walking through what happens? How do secure the bus? how does that work walking through that? >> Will we have 5 guards on duty at any given time. 3 are randomly riding the bus and to our in patrol cars. So if there's an incident, one of the people in the patrol car will respond usually within about 15, 20 minutes and help de-escalate the situation by that time, the incident would have been called into dispatch. Dispatch would have made the call of whether or not to call 9-1-1, or if chain security could have handle it depending the instance. But usually through de-escalation techniques and things like that. They can resolve the incident. Usually pretty reasonable. Okay. So that. >> The real crux here, what they're what they're trying to do is to be agents of de-escalation. But if something somebody were to become violent or unruly and need to be restrained or physically stopped. They would be unable to do so they can restrain somebody until police got there. Okay. But if they have a weapon and security doesn't have a weapon. They would so well inside. Yeah, we would be dependent on APD's response. Ok? Thank you. >> So going put something on the spot Martinez, I think an ordinance addressing some of this. And I was going to ask you to kind of speak to. How we got where we are. Thank you. So last year this body passed ordinance where if you assault a transit employee, not even a bus operator, but anyone that works at the change of departments, you contractor, a security guard, you'll be prosecuted to the same level of assaulting like a police officer. And that has been a great deterrent. We have a public awareness campaign focused on that. So when we talk about security and protecting the drivers and the riding public, it's a multi finger approach, right? So we've got the enforcement. We've got the education. We've got the training. And that's just one more aspect that we that we have in our tool box. >> Thank you. It's good to hear the update on the on the tool box aspect of kind of its impact but the genesis of that was post pandemic. We heard. High increase in the number of assaults and incidents on. They needed to vacate that day. They were told you cannot sleep here tonight. One of the residents in that complex was elderly man. Who had no vehicle. And, you know, could not lift items and I I asked afterwards, I asked code enforcement. Would you want to? Slap these tenants with a criminal penalty tomorrow. If they don't move out tonight because that's what this policy does. It provides no timeline. He told me no, that is not with the intent. Was. And so I think it is really, really important to put some kind of a timeline on there where tenants can be sure of that. They're not gonna have criminal penalties. Now, that doesn't mean that they can't have the notice to vacate and have to leave and we don't have criminal penalties now. So that is something that is new. So it is something that is brand new. And so I don't see why it needs to be something that is levied on them immediately. Is Scott here. Would you mind coming up? And I just would. Mr. Campbell. With this amendment which asked to wait for 14 days. Before criminal penalties could be levied against tenants. Do you think that that would Make what you're trying to do more difficult or is that something that you would support? >> Well, I think it's already addressed and title 15, I believe, dot. >> one, A B. >> I recollect and it gives us usually 3 to 35 or reasonable time too. 2, 1, post a notice to vacate to move the occupants unless there's imminent life. Safety in danger. No hot water heat, cetera, family egress like it at that place. We want those people move immediately. And unfortunately for our situation when we went out there, the owner of the property had additional rental units off site that we could be looking at those people to immediately. So it could actually worked out in our favor. >> But we reach. >> Prefer to have flexibility with these scenarios because it's often that. Because of our housing crisis right now, it's very difficult to find places for some of the people. We do post a notice to vacate. So we'd like to have that flexibility when we do this because it is. It's a impactful thing for a lot of families. And I think you probably witness that we went there the other day. It's a difficult process. Yes. >> And so if but those tenants had been unable to get out that day. Would you have wanted them to have criminal penalties the next day? >> No. And I think that's where Cody, the existing code works in our favor. With that flexibility of 3. And 35 days through 15, not 10. Don't want to So it's kind of there's a lot of overlaps with these codes. You know. Want to make sure that we our flexible on these because every scenario is different. >> So I guess my next question is for the attorneys. Is it true that the code would give people 3 to 35 days before criminal penalties. Be able to be levied against them under this could change. >> thank you for your patience. Appreciate it. I'm not ordinance, but can food and code current code sections argued think was 15, 10 when that continue. Start with 35 days. Time frame. And we think you know, for goes, you know about this and we to be criminal penalty for the big lead to impose criminal penalties. What it still wants. That is true. Stories like theirs for the issue from Force and action. turn to to grow vote with spot. pretty sure doesn't trigger a criminal action criminal court after the 35 teamwork. understood the question correctly. >> My question is, I don't know that answer that. If a notice to vacate is given and people are told you need to be out tonight and they are not according to this proposed policy. When. Could criminal penalties be upset that assessed? Wouldn't be the next day? Would it be in 3 days? >> According to the language in ordinance that's proposed to endure and the violation by out of print. no criminal penalty to be imposed 14 days after the North's to that huge. >> For the date, the notice that hate requires. >> The document. The underlying mortgages, the and are not underlying We're It's produced. >> The chairman member Silvers under the S version, it would appear that criminal penalties could be imposed the beginning on the day specified in the notice to vacate on that very first day. I would just add, of course, there is pressed this question. I don't think anyone is out there pitching to impose those violations and that first day necessarily. That's what discretion of the charging agency. But it is a possibility under the code under the version as written. >> I understand that there is discretion involved. However, I don't think that we should be. Passing policy that we don't want to enforce. And so I think we need to really be careful about discretion and rather we need to spell out our policy. How we want to enforce it. And not rely on the discretion to not enforce the policy that we have passed. >> just. Yeah. Thank you, Mister Chair. I think I'll start by saying I see discretion as a feature, not a flaw and I think we build that into the systems intentionally because I think would be very hard for any code to contemplate every possible foreseeable scenario. And sometimes we run the risk in trying to. >> Contemplate a solution. One quarter case that we create other product challenges that we failed to anticipate. And so I just I will say for my part that having had the opportunity to work for East prosecutors office and code enforcement, I have confidence that their discretion as well exercise these cases. And I don't think anyone here is looking to be overly punitive, particularly for people who are living in challenging circumstances, right? It is sympathy for these tenants that brought us to this in the first place as the whole reason why we started this project and why myself, My co sponsor bringing us for today's to try and protect these people as best we can. This particular violation is meant to deal with a particular circumstance stuff like within the broader context this case. And I think I think Mr. Campbell's Donna, a fair job in my mind. Explain the current flexibility that exists within titled 15, which were not in any way superseding. With the S ordinance as written without this amendment, gives them the 3 to 35 days to decide based on the circumstance, what is the most appropriate amount of time? So we relocate right? And so in the version, even just that potential of criminal penalties does not. Come in until after whatever the period of time can forces decided appropriate, right? Be that to each get 3 weeks, be it a month. Plus. My question, no, I think perhaps the missile turns office. If this amendment were to pass. Just to make sure I'm reading it right. It sounds like. Code enforcement would set the time limit for those to vacate thrill say they pick 20 days. After this 20 day that 20 day period has expired. If a tenant has still failed to relocate them, there would be another 14 days on top of that period of time before criminal sections would even be a tool on the table. In my my reading this correctly, Mister Musa. Mr. Gates who wants touch it. I think that's a fair reading of the amendment. Yes. I find that problematic, especially when we're talking about the point where before you even consider nose to violate things have gotten pretty bad in these buildings. They are places that I don't think any of us would want to contemplate residing in. And they've got to be in that condition because of the actions of the property owner, not the tenant, right. And so when that decision is made locate, people don't think it's ever made lightly. And I think the process we use to decide when people need to relocate carefully considered. I. And wary about adding another layer of complexity to a system that I think Ari has the flexibility. It should especially say said there are 35 days now, 14 days beyond that before we really even have tools to tell people OK, now, finally, free of the sun have a building. You really do have to move this time, right? This is what it's about. Just sort of saying it's not safe to be here. You got to go. And that's why we put this tool in here. So. I think that the S version the existing code, I think adequately address the concerns have been raised by the sponsors. This amendment's. I would say that I see this amendment is being unnecessary and potentially problematic. I myself. Thank Mr. thank you. So probably we have to be careful about this field trip described recently. Summers went out into the field. What was the condition that caused? A notice to vacate like that? They had to go. >> So there was a structural issue which when we actually went there, somebody had braced that up. But then there was a water leak over the weekend which caused severe damage to one of the apartments. >> Was this like code enforcement shows up on Tuesday and says you gotta Levi Tuesday. >> In this particular instance, yes. And I think we would have extended it and be willing to work with those people in the building. If the owner did not have another suitable location where he could be house these individuals and we determined on site that he did have that availability. So that's why we chose to force that notice to vacate that day. So that move would happen and get those people into safe arrested. >> And there anything that was existing in the condition of the individuals who are being vacated that would lead you toward criminalizing them under this ordinance. So important to cure kind of tough, full picture. I think a little bit there. But I'm reminded of here The debates. Creating criminal penalties for camping in our public spaces. So if we're talking about creating laws where we intend flexibility, intend the ability for the departments to work with people. In order to create the best possible outcome for people. That's kind of practice of law that I think is valid. You try to work with people as much as you can. The argument is we can't have a law. Can be imagined to be abused. Homeless. This ordinance. Would be right for problems because there's no way we have the resources to arrest and put in jail. Everybody who's counting on public lands. And in fact, has been used to move people who are in dangerous places, protect public places that are. At risk when they have people doing things around them that are. Unacceptable. But it's limited in scope because we have limited resources on the police and the promise was made. This is not to Marshall lies. Our public spaces and the promise has been delivered and there is the risk that at some point in the future, some bad person could come along and turn it into exactly the worst case scenario. If the logic exist, that we can do that kind of abatement process, then the logic is parallel here that we can trust our code enforcement teams to meet their enforcement with justice and with compassion. And so I think that those arguments about the worst case scenario can't be how we maker law. Otherwise our laws perilous think so. I won't support Mr. Thank you. Yeah, I don't know if I fully buy into that analogy. We're talking about somebody lawfully occupying their home. Being given a notice to vacate that very day. What could happen? And so I want to go back to the attorneys. And I I guess I'm still confused. We know title 15 has been floated out there what is the status quo right now? Somebody gets a notice to vacate. Can they get? In misdemeanor the very next day? Or do they have to wait 3 days? What's the timeline right now? Right now? And I markets will correct me under the code as it exists, not talk about the s version of the current code to there is no misdemeanor penalty for a violation. >> Ok? So this is adding a misdemeanor and it's adding a very short timeline. And there could be a situation. Like member Silvers was able to witness herself where that same day and and thankfully. There was an opportunity for these folks to be relocated. But we don't know. That will always be the situation. So I don't think that this is I think giving a timeline. You know, folks want to defer on the on the length of time here. Maybe 14 days. It's took too long. Maybe the trigger should be the Not necessarily the actual. Vacating. If a code enforcement is able in instances to give prior notice, maybe that starts that the a stopped clock. But I think giving people a reasonable amount of time to comply before being issued with a misdemeanor and having to vacate their home mean, I just I feel like we have to take some compassionate approach to this. So I'm open to this being amended to a shorter timeline or or having. Some information or, you language rather added that would make it so that from the notice, not from the actual date of of meeting to vacate. But if this amendment doesn't pass, I cannot support underlying item. Thank you, Mister Chair. The spot >> Mr. Campbell, have you ever had a scenario where? There was tenant and I'm barely habitable. The Lincoln was determined to stay there that, you know, you needed tool 2 move them along with a criminal penalty attached. >> Almost everybody that we've well, everybody that we vacated, they they they they've been dealing with the property owner for a significant amount of time. And they just didn't have any other options. >> Sure, so there. So they eager to leave us so long as they had a safe place to go. That's correct. And can you share a little bit about some of the time scales that you have worked with when it came to relocating folks who were in buildings that were damaged and on the bubble. >> We vacated one and 2022 actually too buildings. The first building we had to post a notice to vacate. I believe we have 30 days and we were able to actually find housing for those folks in the 30 day time span, which is pretty incredible. The second location and both locations where roughly around 50 individuals. I think 67 families her. building and the second building takes a significant amount of time. took almost I would say to 2, 2 and a half months to finally get everybody House and we had difficulties with the property owner. We have posted the notice to vacate and he was still moving individuals and well, the building was posted with 5 foot sign out front. So yes, it's every scenario is different. We we try to do the best we can with the smaller creek that we have and use everybody in town. When we have to do this. If we need to, we do take it very seriously. yeah, is something that we we. We we don't take lightly. >> Of course not. I appreciate that about you and your team and that you don't you don't take lightly removing people from their homes. I think my concern with this, I really appreciate the spirit of of this amendment and >> instinct 2. >> Protect tenants is it is the spirit underneath this entire ordinance. I'm I think my concern with this amendment as written is that that 40 that the 14 day limit might also function as an arbitrary threshold that would actually limit the ability of our code enforcement team. 2 extend that time period in which people could it legally stay Barely habitable building while they were looking 4 shelter. So. If I'm not sure if there's a way that we could rework the the language of this amendment so that it does not say shall fail within 14 days because that also sounds like 14 days as a heart stop. It's not necessarily a flexible window. So I'm again open to concept here, which is to protect tenants from being charged with a criminal misdemeanor. When they cannot leave the property within 3 to 35 days. However, 14. It feels like that. We've we've also set a ceiling for Mr. Campbell and his team that might not actually be workable in the real world. And I would like to be sensitive to that and that out. As Mr. Campbell said every scenario is different and some of these processes have taken upwards of 2 months. As written, I I don't support the text of this amendment. I do appreciate the spirit in which was offered and as to whether or not particularly necessary. I don't feel that it is. But if this is something that that others on the body feel needs to be in place as a protective measure. reworking the language feels like wise idea. >> I'm open reworking the language. If you would like to. Propose an amendment to the amendment. My purpose is to give people certainty. So that when a tenant is and the kind of difficult situation that I >> saw. >> When I went out and they're they're struggling to find somebody to help them move. They're struggling to find, you know, somebody that has a truck. >> That they have the certainty that tomorrow they're not going to be slapped with a misdemeanor penalty. And I think that is very important floor. People that already in a very difficult situation. So I'm open amendments to the amendment. If you have different language that you would like to propose. Code enforcement going up, boarding up windows of buildings that have secured and have people marching in and out and all of it. And so I think that if this tool is in there. They will use it when Appropriate. That there are scenarios where this might be appropriate. To say that all of this is just off the table for 14 days. Then it just creates. A window of more lack of compliance and more trouble. And so I just believe that this department does really take their mission seriously and does not act in a manner that is being described and hasn't nearly 2 decades. California corporations are coming up, buying properties that becoming derelict. They were getting into these these buildings that are uninhabitable. I just don't see how we're pressing misdemeanor charges against corporations outside the city and the state. So I would pull back and say that keep the fines you can place liens on property, but it's not attempting to charge corporations with misdemeanors. >> Candice Ball and got there first. >> And so that was one example. It is not and certainly not representative of every scenario in which code enforcement has had to to do their work. And so it is important to have and talk. That's one of the critical elements of this entire ordinance is to actually create a criminal penalty because what we currently have on the books does not have teeth. It does not allow code enforcement too. I'm actively now hold. How hold property owners accountable regardless of where they are, whether they're in California or encourage or elsewhere. So I would urge my colleagues on the Dias to reject this amendment as critical piece of this ordinance overall and something that allows municipalities to hold people accountable. And I will note at one of the things we discussed in our work session is the fact that we can, in fact hold individual agents of corporations accountable for the acts, actions of those corporations. And so there is a mechanism by which these penalties could be addressed to an individual who lived out of state. So I would I would ask my colleagues to vote no on this amendment. Westbrook. Yeah. I think the point about kind of the agents of corporations being the ones accountable makes me think of alcohol licensing. So it's been the case for many decades in state law. >> aired also in some aspects of >> local law. But if you violate those those alcohol control laws would licensing that, that it's a misdemeanor. In fact, for a long time until a couple years ago, most things even not putting up the correct signs were a class, A misdemeanor. And so not arguing about whether that's the right policy or not. But I think in this case when you're talking about collecting money from people who are living in a building that is not legally habitable. That is a serious issue. And I think at some point property owners do need to be accountable if there has been this process and there has been as we as we said, these are edge cases. These are really where all kind of normal means and communication and attempting to work with the owner has failed. And so at some point, the question Inc, it's one thing if you're living in your own house and it's not happen double. It's another thing. If you're collecting money from someone else and making a profit from there, living in on habitable building. And so so I don't support this this amendment. But and I do take the point that we that it is difficult to arrest a corporation, but I think it is possible to hold people accountable and to have a deterrent to do so. Thanks. Yeah. They are subject to a different set of laws the accountability peace is the fines is the liens that the city can place on the property and get reimbursed from. That's the accountability. It's not the legal enforcement that you can't even uphold. That's correct. Yes, I think that's important recognize the simply because we do not take the step or contemplate extradition does not mean that there's not the criminal sanctions are there for rendered meaningless and yes, leans R. I think sort of the the first tool that we intend to to bring the bear or maybe not the first. But again, when we get. Was we walk through the escalating process, right? That leads us down the road, neglect of a property and harm to tenants. This is meant to not be first, but one, the later ones and those liens also are seen as being one of the later steps, right when a landlord fails to comply with their obligations provide the money to relocate their tenants. Yes, criminal sanctions are another step above and beyond that. But here we are talking about even more extraordinary cases. And I will see my part, I think leans have some teeth when we get to this point where people are seeing so seriously hard by the conditions are leaving living in and someone is profiting from that. I have no problem whatsoever with con considering criminal penalties in that case. I consider that conduct in terms of how my moral code operates to be criminal to be so exploitive to be so willing to harm vulnerable people in this community. For the sake of lining your pockets. When you go that far, I have no problem whatsoever labeling that individual criminal and I support this ordinance for its willingness to do so, right. We're not talking about some mom and pop is simply struggling to figure out whether or not When the king in the electrician and to fix the label, right? We're talking about places that have suffered years of neglect and have done done so for a a sick profit motive that really disturbs me. And I think when we look at the actual scenarios in which people are living today. And the cases we contemplate addressing here. They're so exceptional that I find the conduct these property owners to really our moral code. most closest analogy, my mind would be a drug dealer, writes something to somebody looking to make profits with that best total indifference to the suffering. They are inflicting so I I do not find amendment necessary and I feel very comfortable with. The sanctions, the esque. As for Jean contemplates, thank you. Altman today. It's at the bash or parking lot. It's called it an informal dirt strip. Now, this funding would turn it into larger and more effective place for people to get out and enjoy that. You got. And that's important thing. Both for resident quality life, but also for our economy. the most visited public lands in Alaska she got to the park. And if we can get visitors to spend one more day in Anchorage on average, it adds 250 million dollars of spending in the city each year. If you've been up to going out on a sunny day, you can pick your choice of places under no parking signs to park. We need more front doors into the park. This is a chance to act on CASA. It's 8 to get checks a service area. It's a great tool. We have funding for design for this project. We need to show the public to are using it to make progress. And so that's when I strongly support. Turning the page, taking a breath. The second one. I'm also on the Design Review committee for the town Square Park. And as most of you know, that's been. Pretty discouraging under utilized space for much of the last several decades. My office was that the corner a 15 to me overlooking that place. And it's not been a very successful area. Takeaways, UK, Janell concert. No Kings Press protest outside of that. It's unsafe and successful the goal. This is to add to that 2.9 million that's already been approved. That really sort of sets the stage. It's going to reduce the burns. It's going to lie to look out and see the whole thing out. A glance which will be hugely help for for sense of safety. But it's not really going to bring it to life. That's what the second set will do. It will provide more seeding, more lighting kids play and it is hoped year round. Comfortable. Outdoor seating covered and places for food and beverage. This is great projects. Why the process has moved slowly has I think it's probably just a busy and over committed project management engineering staff. This is just saw that. And this is a chance to show progress. One of the main reasons to me to support this is to do with the question you just asked was do something that's public to act on the money that's been set aside for design and let's build something in summer 2026 of people can say, OK, this thing works. The other piece of the answer is that that board has now been sort of formally agreed to its functions and its membership and invites have gone out to the people who will filled that role. Well, where I'm going with this is obviously when some someone came into office, they ran on the Portland loose. And so there are people outside early that do not have toilets, but yet we're taking 1.5 million dollars and were renovating toilets for people making 80 to 150 grand a year. My personal time.
