agenda Mr Funk uh good evening thank you mayor councel we do have one agenda item for your consideration this evening that's related to item 14a which is a concept plan for Inland development Partners at 11800 y Zetta Boulevard there were comments received after the publication of the sa re of the staff report and so you have those now as part of tonight's agenda uh that is all mayor and Council so grant program and uh Mr Mike Kuno cuno is um going to present on behalf of the staff and uh and welcome good to see you thank you good evening mayor and thanks thanks for having me tonight uh we're talking about solar on public buildings grant program uh in 20 or in 2023 the Minnesota Legislature established the solar on public buildings grant program the purpose of the program is to provide grants to stimulate the installation of solar energy systems on public buildings the Department of Commerce will administer $4.3 million in Grants to local governments in Excel Energy electric service territory so that includes includes the city minetonka uh based on the grant program criteria we were eligible to receive Grant funds for 50% of system costs up to $60,000 so the Grant application process required us to submit a notice of intent with proposed projects to assess the Readiness of those individual projects uh the city submitted three sites for that first step the notice of intent uh Central fire station number one water treatment plant number three and and Ice Arena B were the three sites that that we initially submitted on uh these sites were selected based on their solar Readiness and available funding to complete those projects at at those sites the city received notification in July that fire station number one and water treatment plant number three both qualified for the next step in the funding in the funding program so they are eligible for full Grant application process so uh staff developed request for proposal which required contractors to submit technical information cost and financial estimates for th those two projects uh fire station one project that includes the installation of a new solar array on the roof of the vehicle Bay Area so you remember that facility was constructed in 2022 and that was actually constructed the roof was designed solar ready so those new solar panels will be installed per the original roof design when when the building was constructed treatment plant 3 would include the installation of a new ground mounted solar array in an open grass area adjacent to treatment plant three uh and that treatment plant three sits right behind minetonka midddle School East so the treatment plant has adequate space for a new ground solar array but will'll just require some additional fencing uh just for security purposes around the the array to install a new ground solar array there uh we received seven proposals for the fire station project and four for the water treatment plant project after reviewing the proposals for qualifications costs equipment and workmanship warranties uh service availability monitoring systems uh staff is recommending True North for the fire station project and I solar for the water treatment plant project so the fire station number one true north proposed the lowest construction cost of $1,457 uh after the solar on public building Grant funds and the federal solar elective pay tax credits of approximately $81,000 combined our final estimated cost for that project would be $2,283 with an estimated Break Even of about three and a half years of operation with that solar array the treatment plant three project I solar was the second low cost but the low bidder on the treatment plant project did not include the costs to install the fence around it so when you added that cost in they were actually higher than I solar's proposed cost so uh but I solar proposed the cost of $1,132 after the Grant and tax incentives of just under $889,000 the final estimated cost to the city would be $222,222.22 uh funding for both of those projects was included in the 2024 through 2028 CIP and can support the Ci's share the cost these projects also promote Energy savings for us and support the city's sustainability goal of reducing greenhouse gases uh at this time staff is recommending to proceed with step two of the solar on public buildings Grant application process which includes submitting full Grant applications for both of those projects now that we know the costs we have all of the technical details we can complete both of those applications uh those applications are due on September 24th and award notifications are expected later this fall if we're fortunate enough to receive funding for one or both of the projects uh formal Grant agreements will be brought back to council at an upcoming meeting great well Mr Kuno thank you um is there uh Council any questions um councelor Shack thank you mayor I just have one question is there um does this create an issue or do we have now have duplicate costs associated with our subscription to the solar garden I mean can we take these buildings offline from the solar garden and have them on our the solar that's provided without Financial consequence yeah that's that's a great question so right now we have subscribed to all of the solar Gardens you know based on our subscription but uh there are the biggest ones that we have subscribed to are not under construction and we don't know when they will go to construction at this point so just with the uncertainty of that and the availability of this program um it makes sense to move forward with these at this time and we don't think there's a a financial like there's not a penalty for not having the you know if those Gardens come online not that I'm aware of okay very good are there are there any other questions Council so as I understand things this is an information item not an action item at this time but sounds like progress is being made and you will be back to us with a decision at a future time is that correct hopefully with good news that's correct excellent well well thank you very much for your report thank you okay no action there the next item we have is reports from city manager and council members and uh Mr Funk yeah thank you mayor good evening Council uh if you look around the council chambers uh you'll notice that we have some new art on the wall and these are original paintings by Minnesota artists located um that we've located here in the council chambers you'll notice that there's other newer art in our large and Mees small mezanine meeting rooms along with the Mei haha room uh and also we Implement a lot of the photos that are taken by our photo contests uh that are handled every year and those photos are also hung throughout some of our conference rooms and so this is really an improvement that we had planned for a few years ago uh when we did our remodeling to City Hall and it's now come to fruition so hopefully you admire some of the new artwork that updates uh some of the older work that we had here in the city you really want to say thank you to all of our artists for participating and we're proud to hang uh their pieces here at the city speaking of the annual or photo contest we do have our 2024 annual photo contest is now live and so we ask anyone that submits photos and we have a number that are submitted every year and we appreciate all of our residents that take time when they're out and about taking photos of our beautiful Community uh those photos are due Wednesday September 25th at 4:00 p.m. uh pH photographers can submit one photo and for more information anyone can go to our website where there's a lot more detail on how to participate also want to then mention that we have coming up is our celebrate latine Heritage Month event at the Civic Center Park on Saturday September 21st from 4:00 to 6 PM 6:00 p.m. our senior diversity coordinator Jay Alexander has been instrumental in coordinating that so there will be music salsa dance performances Latino dances from a Costa Rica ballroom and a live dance lesson so grab something to eat come on out and we encourage uh good attendance for that event coming up also want to give a thank you to our public work staff and many other staff members that work this last week Saturday at our special drop on Saturday September 7th that was uh started at 8:00 a.m. I know it was busy throughout the day we had great weather for it and appreciate the great service that our staff not only provides but it's available for our residents so always an event that people appreciate and then last I want to acknowledge one of our staff members as you know I we like to acknowledge staff members when they achieve either a certificate or further in their education uh this is to recognize our tennis manager Felisa rator who is recently named a US Open champions of equity honory at the United States uh tennis Association uh here out in New York and just a little history this is a newly launched uh recognition in 20 2023 where the champions of equity honor women across the United States there are 17 sections across the country and our own uh Felicia was nominated as one of those 17 and was invited out to uh the US Open this past last week on September 5th where she was recognized for her efforts U she was um for those that don't know her she was a former professional tennis player who competed on the WTA tour she played in three gun slams achieved a world ranking of highest of number 70 in the world number 80 in doubles and she's been a tennis manager at Williston since 2007 and so she was recognized um for advancing equality in the sport of tennis and we appreciate her passion and dedication for equity and she's helped build here not only in the city of minona but also for the future of our next tennis generation so with that mayor and Council turn it back over to you thank you Mr Funk uh council members do you have anything that you would like to report council member Calbert thank you mayor I I'm always so just bursting with pride almost every meeting because we have such an outstanding staff that was a very um inspiring and heartwarming and also humbling report um uh tennis is a hard sport so but uh what a great what a great Endeavor and that was great um I just uh uh last week was my uh second of three um energy environment and natural resources calls over the summer they're they're generally three um like Zoom meetings and the last meeting we really delved into um special conditions that are facing especially Rural and smaller communities um with water treatment and the liability that they face if they're not able to produce um high quality drinking water and there are some real challenges out there and communities are facing um legal challenges on top of the actual financial and logistical challenges of um water treatment and um drinking water so I just want to say you know this is the energy environment natural resources committee and one of our major focuses is drinking water and the next meeting that we're having we will be focusing on posos uh uh resolutions because it is just an increasing problem there was a big article in the newspaper a couple of weekends ago about uh how the EPA actually required um uh water treatment plants to make their sludge available for spreading on farms and it's caused some very significant contamination with chemicals that are literally never break down and are very deadly so uh we are taking a good look at our posos um resolutions and will be taking all of our resolutions to uh the US capital to talk to our legislators about it um in March thank you council member calvard um council member kley thank you mayor I just want to say something about um a nice gesture that my neighbor had um done for me um I had um four five containers in my garage um four uh containers was the yard waist trash organic and recycle but I had two yard waist um containers that I was trying to get picked up for a while from Republic and I kept calling and calling and couldn't get it picked up and finally I called again this was over a span of time like couple years like call no one came sometimes they said it's charge sometimes they say we coming and they didn't pick it up but finally this last time I call cuz now now I had like four containers and really wanted the last one gone and I'm like I can't have another fifth container in my garage so I had it outside of my garage and um um I called and um my neighbor H happened to be working for Republic and so he called me up and he said that hey KY you know um I know you and you you're north of my your neighbor Joe and all of that and I was like oh you're in the brown housee and he's like yeah and he's like I was I was like oh was you cutting my neighbor's yard and he said yeah I was cutting Joe's yard so anyways he worked for a republic and he was responsible for picking up the containers and he said yes there has been some problems with picking up containers and just assured me that he would come up and pick it up and he did he came on a off day um I left the container out and he came and picked it up and it was full of yard waste and so I told him that I would give a shout out to him for that because I thought that was really sweet and I had just been calling for a while and I just really appreciate it so yeah thank you thank you um any other comments from Council Members all right I've got a couple and one is um I just wanted to um acknowledge and extend um our condolences to the city of St Louis Park and the people who and the families um people at Methodist Hospital and the families of uh people who were uh killed and injured in the horrific um accident at Park Tavern so I want to acknowledge that and call attention to it then I wanted to I had to throw a little comment in too but you know we've got a cannabis law coming forward um we've got I'm concerned that um that you know we're making intoxicants more easily and readily available in our society and in our cities and um you know I think that there are good reasons for some of the laws that have been passed but we also have to understand that there are unintended consequences and that is that we're going to have more intoxicated people not fewer and I was talking to a friend of mine who has a significant alcohol problem and he talked to me I talked to him the other day and he said well I was at an AA meeting and after the AA meeting I went to to the um Park Tavern and I wanted to take in the memorial the informal Memorial that has been established there and this individual said you know it just is really causing me to ensure that I do the things to stay sober because I understand the consequences of failing in that and I just feel it's worth mentioning because we Face these tragedies and we have reasons for doing things but um even things that are well-intended often have unintended consequences and so I want to urge everybody to be diligent in terms of their sobriety whether you have a problem or not we've uh you know when you go out having a designated driver is good and you know just being Ultra mindful because I you know I'm virtually certain that the tragedy at Park Tavern would have not occurred if that person had not been intoxicated the fact of the matter is he didn't intend to do that he was intoxicated and it was an accident but how when you're in when you're intoxicated how can it really be an accident we need to be respectful of our fellow human beings we have to understand that some of some of these addiction challenges are very serious and and uh it's not a lack of willpower it is a matter of it's a disease and we have to be compassionate but I think we really have to be mindful when we pass pass laws and pass ordinances that these ordinances have consequences some of them intended and some of them not so I don't want to I'll get off my soap box now but I really felt that it was important to u to mention that and then I also want to say that on um on Wednesday Wednesday is 911 um and um we probably can all remember all of us that was 23 years ago um I think we're all over 23 at least up here um but you know um what what a horrific tragedy um of terrorism occurred in our country and and we said we would never forget so I want to make sure that we're not forgetting and and just remember the the loss and the tragedy that occurred on that day so that's all I had but um anyway we'll move on next item is Citizens wishing to discuss matters not on the agenda this is an open mic opportunity if you have anything that you want to make the council aware of um that is not on our agenda tonight please come forward state your name and address tell us what you are thinking of and what you want us to know no action will be taken tonight but we will um turn that matter over to staff who will investigate and report back to us and then uh we will make um uh we will comment on that in a future meeting so is there anyone who would like to come forward anyone please come forward state your name and address good evening good evening can you hear me okay we can yeah yes my name is Annie pasbrig and I am actually a resident of St Paul uh my address is well that's okay okay um I can still State my address if necessary uh 2026 Carol Avenue in St Paul Minnesota um and I am here tonight um because I am a local uh real estate agent um who works a lot in the affordable home ownership space and I just kind of wanted to bring it to the council's attention um of the urgency of the down payment assistance programs I am aware that one of your programs is not funded currently or is out of funding currently and another program has very limited funding um I have one client who is a special ed teacher in Suburban hen County she currently rents in minetonka and she is in the process of purchasing a home um the down payment assistance program while for her is not absolutely necessary would be a huge huge assistance um in terms of her monthly payment especially with um interest rates and teacher salaries um and so she is so excited to be a homeowner here in minetonka um but you know I have been keeping quiet on the down payment assistance since it's out of funding um I have several other clients who um either work Andor live in Suburban um hennipin County and are interested in living in motanka but without either of those down payment Assistance programs um will not be able to um afford a home in minetonka so I just wanted to bring a it everyone's attention I know it's supposed to be on the agenda sometime this fall or at least that's what has been communicated to me and so I just wanted to communicate it of how important is it and how you know for one specific client the the timing of it could um be a very very important gift for her right well thank you very much for that and um yeah we We Believe believe that um these Assistance programs are very important and yeah we know that the demand is I don't know Miss wishnack do you want to say anything please do certainly um we are aware that there are funding uh waiters out there and so um as we talked to the council a couple of weeks ago as we provided your housing update we indicated to you at the end of September here we would bring back some resolutions switching around some funding sources this is what's called a midyear kind of We R ran out of funds and we need to amend the budget so that requires a special action of the city council and you know it's coming um so I apologize if it's not coming in time for this person but definitely uh it's on the agenda for the 29th 29th okay I should not quote the 29th is it the 29th when's our next meeting 23rd excuse me 23rd that's sooner six days earlier great thank you it could be the make a break to be honest okay well well thank you thank you thank you for sharing that and and I just want to add too that you know um hearing stories about real people makes a difference and so I appreciate you're sharing that uh we're proud of our community we want people to feel welcome here and but we know not everybody can afford to live here and so anything that we can do to support them and their desires to to live in our great Community we want to be we want to be helpful there so thank you for coming forward I really appreciate it is there anyone else who would like to share something with the city council tonight all right then we will move on um next item is bids and purchases and we have none of those tonight so that brings us to item 10 which is our consent agenda and consent agenda items are things that are typically routine and so we read them into the record and we vote on all of them um in one motion if anyone would like to pull an item um for further consideration they can do that um tonight we only have one consens agenda item and that is an ordinance repealing um section 925 070 relating to license for veterinary hospitals and we did receive a report on that when this was um when this was introduced so um would somebody like to make a motion council member Wilburn as a veterinarian I'll go ahead and uh recommend or uh what's the word move that we adopt the ordinance thank you thank you Dr Wilburn Wilburn yes Calbert yes weome yes motion carries next item is consent agenda items requiring five votes and we have not of those tonight item 12 is Introduction of ordinances and we have none of those so that brings us to item 13 which is public hearings and um um 13A is resolutions approving special assessments for the 2023 2024 projects and Mr Nelson greetings um and uh he will be uh providing the staff report good evening mayor council members uh before you tonight is the annual process to hold a public heing to approve collections for uh proposed special assessments related to property nuisances typically we have uh other disease trees and City Court finds on this um special assessment hearing night but we have none of those this year so a bit of background uh division staff associated with the specific type of assessment have notified and worked with the property owners regarding Associated work to be financed by the city notice of the public hearing were were mailed out after the August 5th council meeting which set the public hearing date and Property Owners will have 30 days to pay or partially pay um their assessments interest free we have a total of six assessments this year five one-year assessments totally $945 and then we have one three-year assessment totaling $1,149 75 um the interest rate on these assessments is 88.5% and that is based off the US prime rate as of today um and staff has received no appeal notification as of um from any party at this point in time and then lastly included in your Council p is a report on deferred assessments U per per Council policy 2.17 staff is required required to report annually to deferred special assessment activity and for 2023 there was none so report on that is very short um and so with that um staff is recommending holy the public hearing and to adopt the attached resolutions in your Council packet with that it stand for any questions thank you all right um Mr Nelson thank you very much are there any questions from Mr Nelson on special assessments well I'm always good for one what what what was our interest rate last year because we know interest rates have gone up and so 8.5 is as high as I remember in some time do you remember what was last year was 8.25% not not too big an increase right and in hopefully a couple weeks or a week or so or when the feds meet next it would actually be lower but for this year they will be 8.5% for we base that off the prime rate right when we set the public hearing date on that end of it very good thank you Mr Nelson yeah thank you all right so um Council any comments or otherwise I will open the public hearing and is there anyone um I will open the public hearing and ask if there is anyone who would like to comment on these special assessments is there anyone I have to ask three times is there anyone all right seeing no one I will close the public hearing and bring it back to the council for comments or a motion or both cons sha spe um other business item 14 and we have a concept plan for Inland development partners for a residential Redevelopment of the existing property at 11800 Whit at a Boulevard in Miss Thomas I believe you have that report thank you mayor we're some uh Inland development Partners actually together with Dorne companies have submitted uh this concept plan the property is roughly 1.2 Acres it's currently zoned P which is planned I 394 district and it's guided mixed use in the 2040 comprehensive plan the concept plan um contemplates removal of the existing office building and construction of 26 threeory residential uh rental Town Homes those Town Homes would be situated along a central uh North South access Drive in concept um the proposed development would have a density of about 22 units per acre that would be within the range of existing multifamily development occurring in the area and within the site's um existing mixed use guidance actually residential density of anywhere from less than one unit per acre to up to 100 units per acre uh would be allowed within a a mixed use technically the development group did host a neighborhood meeting back on August 7th and the existing residents in the neighborhood who attended that meeting generally Express that again in concept a uh Town Home Development would certainly be preferred to another apartment building in the neighborhood and that the town homes themselves were attractive in design but there was some concern about the lack of green space in the concept as well as the number of parking stalls um concern about the the rate of parking per uh town home the concept was then presented to the Planning Commission on August 15th and at that me meeting members of the public again reiter ated those comments from the neighborhood meeting but they also raised a few new points um concern about potential impact to the vegetated buffer to the north um concern about rental versus owner occupied town homes and then just this unknown of traffic and parking associated with the marshrun 2 apartment building that's currently under construction for its part the planning commission generally commented again that the residential design was certainly attractive um individual Commissioners did note that it would be difficult to perform an accurate uh traffic analysis before Marsh Run 2 was open or occupied um I would note that as was the case for the Burke and marshrun 2 and as is the case for any proposal where we have a change in use type in this case from an office use to a residential use staff would require that a traffic study um be done for the proposal If This Were to move forward to um a development um formal application uh Commissioners uh certainly one commissioner maybe two uh suggested that the concept felt a little bit tight for the site in terms of setbacks obtrusive in the area and that parking was already a concern in the area and there was a concern with this concept following the commission meeting then the developer or the Development Group I should say went back and looked at their concept and uh tweaked it a little bit uh and is proposing a revised I shouldn't say proposing again this isn't a development application they're presenting to you a concept uh slightly revised here this evening the revised concept still contemplates those 26 um units still arranged along a North South Central Drive but the change in the concept is an increased depth in the buildings themselves and a narrowing of the internal drive and in combination what that does is allows for um three garage stalls per town home unit um there would be two side bys side spaces and then one tandem space so at a conceptual level um this concept would meet our I'm going to say in quotes our new um parking ordinance we've had it in place for a little over a year now um whereby uh there would be one parking stall uh per bedroom that is provided for each unit I would also note that the Burke and marshrun 2 were both um approved under the old ordinance under the new ordinance those apartment buildings also would have met the new um parking ordinance as the council is aware um the concept plan review process is just a feedback process that what we're looking for here this evening it's not a process under which um staff can answer real detailed questions because we don't have detailed plans we haven't done a a detailed analysis um this evening we're hoping as staff and the Development Group uh again for your feedback um big picture and hoping that you can answer three questions for us is there Merit for this concept to proceed to formal review if yes why if not why and what would make this particular concept better and with that I would turn it back to the mayor thank you very much um Miss Thomas I appreciate your report and um I've got a few things that I'll comment on and then we will invite the applicant to come forward to make uh their report and then um and then we'll bring it back to the council so you know concept reviews are kind of a new thing and and um it's been a little bit of a learning process for both staff and perhaps more for the council um they they're intended as a way to provide the a potential applicant because there is no application the potential applicant for okay what's the council's gut feel on this thing and what do we maybe like and maybe what do we dislike and you know if you're going to propose something what what things would maybe we want to what would make the council think it's a better proposal proposal than what's initially presented and um you know it it's really supposed to be um an informational conversation between the um the proposer and the uh the council and um you know we um I I I frequently say well councelor any questions well we're not going to have questions tonight because this isn't a formal proposal it's a it's a matter for us to kind of just share our gut feel and talk about what we think um of what uh the uh we think about the concept and and I have a long business career I was in new products for a long time and we always start the new product development process with the um um you create Concepts and then you get consumer feedback on Concepts because concepts are a lot cheaper than going to R&D or and and or buildings and saying okay now do you like it or dislike it it's it's a good way to get feedback very early in the process and and change things and when I was new on the council which was a long time ago one of the things that learnings and one of the things that concerned me is that by the time the council was presented with a proposal the perception among residents was that well this is the train has left the station whatever I say isn't going to matter they're going to it's going to get approved and my input is not going to matter so I talked to staff and it wasn't just me but we talked about okay how can we um get you know get the train closer to the station before people start learning about it and that's how we came up with this this concept review process and but then the problem was when we first did our first few um the council indicting they liked it or they didn't like it but then the developer walked away oh well they like it so I'm going to just proposed that and and it's been preapproved and in reality it wasn't pre-approved and and so there's a little bit of an art to this and that we want to have this conversation we want to share information but at the same time I don't think we're not approving anything and um and and we will get a lot more if this comes forward and that's not a certainty but if it does we will get a lot more input and when we get input we probably change some of our perspectives on some of the things that we may have told you tonight but that's part of the process it's a give and take process we want to be fair to developers we want to be fair to Residents and so um um this is a little bit different than the script I was given but um but you know the the uh the real the real idea here is that we we want to have a conversation and talk about things that could uh um go forward and also talk about things that we're concerned about so um you know um we we got the report from Miss Thomas um and I will now ask the applicant if they'd like to come forward and share your thinking uh with us and then we will um uh we will take it from there good evening good evening mayor council members thanks for your time tonight um oh I'm August bman I'm with Inland development Partners our address is 100 Lake Street West Suite 200 in wetta Minnesota um I'm director of development with Inland development partners and just wanted to say thanks to staff for all their input thus far um and I'm going off script a little bit I just wanted to say I appreciate what you said uh mayor about the collaborative nature of this process um Inland and Dorne as our partners were a collaboration first developer and one thing that we reminded um those that attended the neighborhood meeting the other or about a month ago was um you're going to have at least five opportunities for your voices to be heard on this project and to have um your input so if they couldn't make it to that meeting there were plenty more opportunities uh like tonight for them to have their voices heard so um at risk of uh being a little bit redundant um I'm just going to go through a few notes about the project and our approach to the development and then um I'll introduce Ben and we'll take it from there so we're a local developer we're based in Yetta um all of our projects are Twin Cities base uh based um our goal for each project is to be the best possible neighbors and deliver uh project the community and future residents are proud of um bringing density to this area also we think will um help support businesses around Ridgedale as well as the public public library and we really enjoyed our neighborhood meeting and appreciate the feedback that we've gotten thus far A little bit more information on the project is as follows uh we understand that we would potentially make three applications uh the first one being site and building plan approval a master development plan as well as a rezoning plan again the site is 1.2 acres and as part of our proposal the uh existing building would be removed it's a 1980s era office building currently uh 26 rental Town Homes is what we're currently proposing there's four buildings as you can see there's seven units in two of them and six in the other they're front to back uh oriented meaning there's a front door and a rear garage um and there will be only neighbors to your left and right in this situation so uh and the majority of the parking will be interior based accessed only through the private Drive uh to each garage they three level units 36 ft in height and same as the surrounding Town Homes they're all three bed 2 and a half path about 1,800 sare ft and there's one private uh parking stall per bedroom in the unit so that's three total uh parking stalls per unit in the garages um we plan to start uh construction if we're approved in the spring of 2025 that's based on U working through this process with you all as well as um existing lease terms with the office tenants in the buildings um there's some um termination uh Clauses that we need to follow there so spring of 25 is what we're currently targeting we anticipate uh construction will be 12 to 14 months um in terms of piling these structures aren't that heavy so there won't be any deep piles with these as the construction is slab on grade and then in terms of delivery of materials we use a process called Just in Time delivery of materials so all the materials that will be used to construction construct the units they won't be delivered months in advance of when they'll be needed they'll be uh delivered and utilized within the the u a short period of time in terms of uh providing affordable housing um we are meeting what we believe to be the city guidance which is uh 10% of units at 60% Ami with a minimum of 5% at 50% so that's three units total out of 26 uh proposed units so um we initially plan to be before you guys at the at the last meeting um but following some feedback that we got from the Planning Commission as well as from the neighborhood meeting we want to go back to the drawing board make some of the tweaks that staff outlined for you already and come back to you with the best possible proposal so here we are um you'll see I'd like to point out here in the middle of the site plan you can see um there are some short-term delivery only parking stalls the thought behind that was to alleviate um parking or any congestion on Fairfield Road so for the likes of Amazon USPS who are dropping off packages we don't want them stopping on Fairfield and narrowing that road making it more dangerous we wanted them to pull off onto our private property and deliver packages to the residents of the property so we did that we also are going to be working with the same management company which is called white cat management they manage the Burke as well as uh Marsh run two that's under construction right now um we believe that that will be the best for the community as they can work through issues uh when they come up like pet waste and um have a cohesive kind of approach to anything like that so we also are as you can see outlined in yellow linking up to what will be the um that walking trail we wanted to connect into that U to alleviate residents that want to go out for a walk or take their dogs out for a walk and keep them off of Fairfield Road or on wisett a Boulevard um and just lighten up the walking traffic there so um we're also long-term owners of real estate so when we build uh properties like this we tend to hold them um for at least 10 years is how we financially underwrite them so we have a vested interest in making these projects the best as they possibly can be for the long term so um with that I'll let and take it away thank you thank you good evening hello mayor uh council members um I'm Ben lindow of Dorne architecture at 7803 uh glenroy Road Sweet 200 Bloomington um under a director of design for dor architecture so um and staff and August have done an excellent job so I think I can be fairly brief here uh so with the overall site plan and placemaking uh there's really two main uh Urban things that we're trying to do here with the design and that is the established P zoning that's in place where uh with the the shopping center and the Burke and Marsh 2 and this it's meant to be designed more like a village where it's walkable it's connected with those walkable pieces uh and then also from the north where the there's the existing Town Homes uh and Condominiums there uh it's trying to take that same kind of mass and bring it down the street so that that continues down and and also it it it uh provides a a bit of a transition and it's not another multif family building but it's something that feels a little more residential as you pull off of wisota Boulevard and then come up uh Fairfield Road there um and then uh materials wise uh We've we really looked to um the P guided zoning from the adjacent shopping center with its materials and guided material use uh and then the high quality materials from both the Burke and then Marsh Run 2 Under Construction with uh masonry uh brick um cement fiber uh metal panel all of the same materials that we like to use because of the long-term uh deferred maintenance uh and and and durability with with the use so uh and then uh there's just been a minor update here where uh the uh on the site plan where we're we're looking at the buffer to the right uh here and we'll uh survey the existing healthy trees and then add to those trees with uh uh coniferous ones that will provide more um buff offering year round instead of the Deciduous ones that are mainly there right now um and then also just uh to have those uh Street trees those overgrowth trees along Fairfield Avenue with a nice Rhythm that kind of complement the town homes to again make it feel like an inviting um residential Place uh to to where you'd want to live and then uh we did align the drive aisle for for safety and access and convenience there from our previous plan uh and again we've added the uh parking with d garage stalls as you can see there um for uh just so that everyone can understand that there is more parking than just what's shown on on the site planine so um and that that's all I have uh we look forward to your feedback and any questions that you may have okay well very good thank you thanks for your pres and you guys can sit down if if there are things that come up we'll uh we'll we'll snag you and uh have have you come forward so well well thank you very much for the presentation um I we the the packet was uh quite thorough I think and we certainly we've heard from Neighbors and so forth too so um yeah we want to uh give you some feedback any thoughts and and there there may be a few questions but I think it's more a matter of um um just helping us better understand the plan and um and sharing feedback so Council thoughts what would you like to share council member sha thank you mayor um you know I'll start with this looking at this project in a vacuum I think you know if we if this parcel was a parcel that was not in this neighborhood it is I think it has a lot of Merit and it may still have a lot have Merit but um it's I think nice looking I think it's laid out well I think it's a little dense I mean it's the setbacks look pretty SM small it looks like it's using you know every bit of that space um thinking back to the project we approved at our last meeting which included some more green space some um you know the with three bedrooms presumably there's going to be families living here and it's hard to see where any kids or anybody would be able to kind of be spend any Leisure outdoor time in this development so those are concerns I I think the parking is creative I think you know I try not to think about parking in terms of the highest demand days and it's really the dayto day and you're probably okay although you know I I suspect with this extra indoor parking tandem parking we're probably going to see some spill over of the same kind of issue that we saw at the Burke which is people it's a little bit of a hassle and if you're having Grandma over are you going to you jockey cars to get her into the garage but you know ultimately the market I guess will bear that out I'm not overly concerned about parking for this particular project what I will say is you know I I feel like this has not been super intellectually honest as far as process because we know that folks from Doran did come here and address some of the parking concerns that real parking concerns that existed relative to the Burke and um I think and I thought at the time probably made some representations and at least implied promises that um are not being followed through on and I'll just say anecdotally you know I personally know somebody that lived in the Burke for a few years and had a couple parties and told her guests that the guest parking was this parcel and so you know some messaging happened there where um good bad or indiff that this parcel became the Burke guest parking which alleviated the problem for now but is going to push it back to whatever the issue is I suspect the reason for that is parking and apartment buildings has changed from when I was um a young person living in apartments which was you had a place where you could park and if you wanted to park indoors you had to pay for it and now I understand Apartments you if you want to park you have to pay to park no matter what and I understand there's some guest parking but my question is I think where we're seeing the pressure is probably from boyfriends or significant others who are spending four or five nights a week at the apartment and don't have a designated place but also don't want to register as a guest every time but that's my um that is just my suspicion what what concern I have is that these issues and and I also understand that maybe this isn't totally our problem you know if the whole 500 600 units of dor owned property are not properly parked for what their pricing is that that's maybe not our problem but it has been over the the course of the past several years so I am kind of worried about it um also the construction pressure I mean I get a lot of calls and I know because from my house to Trader Joe's I drive past Fairfield it's chaos and and I get to build the type of building that is going up there involves chaos but we're asking a lot of this neighborhood to to take six years of development pressure Without Really any kind of reprieve in fact we're going to have the marsh Run 2 not even close to complete by the time we're talking about this project starting so one of the things we talk about as a council is you know we're putting we want we don't want to be in a position where we're putting all the density in one place we want to try to find ways to spread it out of course the rigid out area is an obvious place the Opus area is OB obvious place it's going to take more pressure but this is a quarter mile area that is getting a massive number of units of all of the new development and I you know I I have a lot of empathy for the people who live there now so I don't know how I feel compelled to say this I'm not sure how we reconcile it I think it's nice I mean I think it's fine but boy is Dorne asking a lot of the city of motanka in coming to us with this so quickly after while the building of marsh Run 2 is in process thank you and if I Council if you'll indulge me I have one question that I'd like to ask of the applicant because I think it's relevant to your consideration and that is um these are three bedroom multi-level um town home units rental who is your target audience because clearly whoever you know the your intended marketing audience will will impact our comments I mean if uh I don't think I think I don't think you're looking for people above people my age and older I think you're look but I'd like to understand that because that will have an impact on our comments if you're looking for families with kids okay our comments may be one set if if you're looking for um uh people who are ju you know young professionals and people who are just getting out of college who may have roommates think okay our questions will be different so if you can answer that question I think it would be helpful as we discuss it no appreciate the question and appreciate your comments uh council member sha um obviously we never know who's going to be the renters and we're an equal opportunity renter and that's uh those are the laws that our management company abides by so we don't know but if we were to predict just in the way that you all may guess young families and young professionals are likely Target demographics uh for who may be attracted to a property like this so great great I'm a marketer so I always have a target audience but I don't you know if other people are not my target audience want to buy my product it's okay with me absolutely yep absolutely very good thanks thank you for that other comments council members council member Wilburn so council member Shaq like took the words out of my mouth um and so I won't spend all the time just repeating everything that she said but certainly again if this property was in a vacuum like on its own um yes I would say the concept has Merit but there are problems with with the Burke that have not been completely uh addressed so in addition to the parking and what was said about using this space for parking there's also the uh the problem with pets and and people from Burke still using the bring Town Homes um for their pets and not cleaning up behind their pets um and then again all the everything else that uh council member sha said I I agree with I I tend to be a fan of density where it makes sense um so I the the amount of density doesn't bother me too much although again I did think about where are the kids going to play if you have a young family um so yeah that's it very good ccor ra yeah I actually walked the site today and and drove by and I understand that there is a playground there is a park that's not that far um that said though um as as many of us up here our moms uh or have been mothers to small children you're not necessarily as Keen to pile everybody into the car and have to drive because it's not super walkable um with young kids it would you know I'm a little concerned about the lack of Green Space are amenities like you have the Burke you have some of the other um the the marsh uh two that are going to have amenity decks and and things like that and this is not and it would be one thing if you were a home owner um if you were going to be owner Town Homes then you know I think it's somewhat different than having rental town homes and not having those amenity decks so that to me is the difference um as to I believe most of the Town Homes to the north uh Julie correct me if I'm wrong are owner Town Homes is that correct um we actually don't regulate whether or not somebody rents or owns their town home so there's not they're just proposing a certain package but at at some point could they subdivide it and have ownership product yes yeah no I'm not saying that I'm just saying the ones that are currently existing now to the north I didn't know I there are renters in both okay okay well again um you know given your target audience those would be um that would be my concerns but I think the you know concept itself looks great I like the idea of having um kind of breaking up those uh multi-unit buildings with kind of a smaller uh lower uh footprint and and uh facade I think that helps kind of create a more Diversified kind of like you said Village feel which I appreciate um so I don't know if it's possible to do something like you know remove one building create you know amenities I know that's not obviously your desired Direction you know you you want to maximize profitability for obvious reasons but um I would be a lot more happy about that I think if if we saw that council member kley and then council member thank you mayor so um I think the concept is nice um looking at the Town Homes it's three bedrooms I know we talk about um in minaka a lot about having large units U it meets that um you know when I think about families I always go back to my family when my mom had like seven kids you know we go to her house now and in Rapids there's always like five six cars there we got to park on the street park on the side street park up the street and so uh when I think about a family three bedro you know usually you have two to three people well two people in the bedroom um when my mom she had two kids per room so it was kind of like that so um I'm thinking about like if you have you know a family there maybe with some teenagers um or even just um someone who had a shared um roommate situation I can see it being more than three cars and I know that um you have parking space for three three um cars but also thinking about um if there's friends over um if there's barbecues I know we have barbecues all the time and so there's always um not enough space so um just thinking about the car car space making sure there's enough parking um and then also I mean the playground or somewhere for you know families to be even if it's like a little um gazebo space something like that I think it would be nice um because when you have Town Homes I used to live in a town home um and matter of fact it was a three bedroom I've stayed in two Town Homes um back in Cottage Grove and then one in Brooklyn Park and it was a it was a three-bedroom I remember that and we never had enough parking space when my family came over I did a lot of barbecues and that always was a problem they had additional park I think I had a two-car garage an additional space but when you have family come over again from a large family um um you to not have enough parking and so um just thinking about that um and then you know some of the town I believe two of the Town Homes well one of the Town Homes I lived in had gazebo so I think Gaz gazebo or something like that where people can um hang out you know versus not having space like that um Green Space and then maybe like they said maybe a playground area if there's families there I think it would be nice um but but otherwise I mean I I love the idea of um you know we have three affordable units there um I love that and then it's large units I think is really nice and so um I appreciate that work so thank you coun Foster Bolton um yeah I agree with what Rebecca and Dr Wilburn said too about the Burke and about that problem not being solved um and that it is we I was over there too and it is chaos and with I mean and I read somewhere that the rent was going to be around $4,000 a month and so my sons um W rented a place close to that there's no way he had to have at least two other roommates to afford that um and so we're talking roommates and girlfriends and they ran into that problem um so the it and I I mean it said you know you talked about it being a village but without Green Space and without places for kids that doesn't seem very villagey to me um but it's they're they're cute the um places themselves and I like all the design and that looks great but um I just don't see it being um very villagey really thank you coun Calbert thank you mayor um so I want to preface my comments by saying that you know Doran has a history of being willing to work with staff and also trying to listen to the neighborhood to you know meet their needs and demands and desires um sometimes they they hit the mark and sometimes uh they don't but they I know they've been good for staff to work with and they're a very well respected developer and they make products that people enjoy living in and they've built some uh projects here in minaka that people really love living in um and so I wanted to start with uh I'll I'll start with my comments in terms of in a vacuum so in a vacuum there are some things to recommend this project I I like the design I like the pitch roof I like that there is um that the materials are in concert with the rest of the um uh buildings that especially the ones that have just been built um I like the size of the units I like the I like the trail which I think is good um in general I like the placement of the drive and the reasons for placing the drive across from the drive at the Burk I think that's good forethought I also know that the trail we have all received I'm sure pictures of the bright green dog waste bags which Adorn the trails and sidewalks in the neighborhood and that's just from the people that are at least good enough to bag up the dog waste um so I also think that having the trail around the Wetland it could be a recipe for contamination um but I but I understand it's a nice amenity for the um residents that are moving in in terms of um and the other thing that I like is the space that you left for Landscaping on the South Side so that because one of the things that I always think about this is it's really the gateway to minona and we're known for our tree canopy and this is an area that is increasingly losing its tree canopy so I appreciate you trying to keep that visual of of green on the South Side in terms of in a vacuum um for this project the setbacks along Fairfield um especially if we if we look at the aerial views of you know where the other um buildings are in relation to Fairfield I mean there's barely room to walk let alone I mean you're planting little trees there that may or may not mature over time um but uh it does not feel like that neighborhood and and one of the things that that we have always talked about is retaining the character of a neighborhood and it's very hard for some people around the city to understand that particular area but I've door knocked that area many times and I've walked through that area and I know a lot of the residents in that area and up until these apartment buildings were built it really did have a single uh household feel to it it was very quiet it was very residential it felt like a single family home neighborhood and um putting putting the building so close um doesn't doesn't feel like the rest of the neighborhood to me um it feels very Urban and I understand that we're moving that way and density makes sense there that's another reason why um it has Merit but I I did listen to the Planning Commission meeting and uh I I tended to agree with um commissioner Maxwell who had observed that maybe maybe not breaking up the building I walking that property um today frankly it just seems too narrow to really have two buildings and when you think about the view out of the building that's going to AB but marshrun 2 they're basically looking right there are trees there some of those trees I don't think are going to make it because of the construction but they will be pretty much look right into the um building next door and there were concerns from the neighbors to the north about how close the building was another thing that I thought was good was sort of the scale of the buildings it does fit in with the town homes there and I know they appreciated it um so I appreciated sort of the the the height and just the design in general um but the tree loss um the buffer the lack of Green Space um it just seems and the parking really is a concern and I I you know I just think about who can afford to move into a place like that for $44,000 a month and it's probably going to be people with roommates and partners and so I I just don't think and and I do have to just reiterate that there was a little I think intellectual Dishon dishonesty as council member sha put it because when asked the the Doran representative said we don't have plans to develop that parcel at this time so technically true there probably were no plans in hand I think a more intellectually honest thing to have said would have been um we plan to develop it but we don't have plans in hand at the moment just to be honest with the neighbors and um my heart goes out to the people that live in the town homes because it has been they lived in this quiet neighborhood and they have put up with some really intense construction for years and some of that construction involved pilings and I know that this particular project is just slab on grade so uh it it won't the vibrations and the banging the same way as Marsh Run 2 but um those poor people have lived some of them have lived there for decades and I think that um they're absorbing a lot of the problems that the developments caused the dog waste the parking issues um just the use of the infrastructure there that they pay for with their HOA dues um and so I just you know I want to make it right I also looked at the parking situation at the Burke today so not in a vacuum and you know there there is signage about what you need to do to park underground and I and I you know I've been trying to think you know it's it's around the corner from the office where the parking is so it's like a several you drive up oh I have to register you get out of your car you go to the front desk you register get back in your car drive around the corner and go on the underground parking and if you're visiting your girlfriend or boyfriend or your partner or your friend every day it it's it probably is a little I don't know you feel a little sheepish about it if you're spending a lot of time over there and you're like overnighting it so um I don't know how we solve for that and I'm and I really appreciate the work that you did on the the garage parking there um another um concern that I have is the snow removal so I know that if you know we haven't had a lot of snow in the past year if we had a lot of snow I know that there's some thought that it would be trucked away I also heard that the snow is going to be pushed towards the Wetland towards the back of the buildings and I think about the salt and the salt getting pushed right into a wetland where there were trumpeter swans and other really sort of rare species back there that haven't been there since all of the construction began so um I I just want to I want to be really sensitive about what we would do with snow removal and um you know I like the product I wish it was homeown and not rented um but that's not my call um and it's not for me to solve the economics um I do also agree that um even though this area was planned for high density um in our comprehensive guide plan and that we have to do traffic studies it it just does seem a little um backwards to kind of move forward with all the expense of a plan um and then do a traffic study when we haven't even finished building a really large apartment building so um I don't know I you know it's one of those things where yeah density makes sense I like the product it it looks attractive for the most part but the green space really bothers me and I really think that in that very narrow property it only makes sense to have one line of buildings I also like the way you broke up the the the massing just with the sort of rhythm of of the buildings and the colors and and and the um material palette that you're using um but I just feel like two rows of buildings in that very narrow um property just it just I just feel like it's hard to make it workk sorry for being so long-winded thank you councelor ra you good yeah all right um well I'll make a few comments and um you know as I look at this I agree with much of what was said in terms of you know it's an attractive building um or it's attractive set of buildings you know the issues that that I'm concerned about are you know again this target audience question what who what is the intended Market um you know and you're not always going to get that 100% but but understanding that um helps us understand okay what things should we be asking for um if the target audience is young adults and no kids well then we'd probably be less interested in a playground um if it's um if it's young families with kids well then you know we we'd need to see something there the the park down the street is is a good amenity but um in today's day and age I don't think there's you know you're going to have a lot of little kids walking down that street on their own so you know those so who what is the intended target is an important question to me um clearly we haven't resolved the parking issue and I'm concerned that this project will exacerbate the existing parking challenges because this property was a partial solution for the challenges particularly at the bar Burke and we don't have Marsh run to to see um if there's going to be issues there and then we add this I mean we're so we're dealing with a lot of unknowns that make make me conservative um without answers I'm going to say you know we need to reduce the density because um I don't have answers to those questions and so that uh you know having having a project that answers I mean one of the thoughts I had is well those parking those overflow parking spots maybe they should just put a small parking ramp on this property at the end of this thing because where where are they going to pick up the parking the Overflow parking that has been demonstrated to be necessary at the Burke and so so that's that's I don't recommend that it's an off-the-wall idea but but the problem is real we're going to have to solve that um you know there are some Pro you know i' I've read the E the letters and emails from residents and the one that kind of irritated me a little bit was the one with the pictures of all the the dog poop bags because the truth of the matter is the um the Burke the man Doran has provided has done what they've said they can do and there's nothing that we can do here as a council to change human nature and the people that are leaving the poop bags around um that's like asking us to solve original sin I mean bad bad behavior is bad behavior and that's not the developers problem that's that's a bigger issue that we're probably not going to solve here and so it's irrelevant as far as I'm concerned Dorne honored their commitment to provide poop bags and I'll even bet that there are people who don't live in any Dorn owned properties who use those poop bags too and uh you know I think there might be some mitigation things but the reality of it is that there are problems we can solve with better better and better thinking and then there are things that we will never solve we I mean there I I see those bags along the trail in mitaka I see those bags in my neighborhood where people think that just bagging bagging their dog waste is sufficient they don't have to take care of it and dispose of it I mean those people really irritate me but I don't expect the city or um or a developer to solve those types of problems I expect people to be considerate and responsible but we know that we don't betat a thousand even in minaka so I I I want I want to focus on issues that we as a council can affect and so to me it's you know I I I need some solutions for parking and um you know I I I really think that I'd like to see we need more green space I think the setbacks are tight and um so you know my while we ask for um why we ask for density in places um I think this is probably more dense than this area can really handle and so we need some solution for that and then the other thing is you know timing um I know that the property as it is was not going to stay that way forever but at the same and and i' I've kind of looked at this two ways I mean the advantage of doing this now and getting it done is that um you know how long do you want to live with construction we could say well listen we got to wait we're not going to we're not going to approve it and we're not approving anything tonight but but we should wait till Marsh Run 2 is done and understand that before we consider a project here but then that only means that there's going to be another two years of construction and construction traffic and nobody likes construction traffic I mean I moved into a neighborhood um 30 years ago in mitaka and we were the third house of 28 and I knew that when I moved in there was a lot of there was a lot of empty space there and we lived with construction a long time and I was really happy when the last house house in my neighborhood was built so nobody likes to live with construction but that's that's the nature of the Beast and so what's better um you know this traffic study thing which will be required you know how valid will it be um I've driven there you know I've I've been going down the frontage road and I mean you know it is it is the marsh Run 2 activity is very significant there's cars parked all along there some up on the grass some both on the grass and on the street um you know it's but it is what it is um um and uh but that's what you have to live with and construction is tough so um I'm probably done stating the obvious but you know those are my issues really that I haven't heard a parking solution I think we're going to have to reduce the density to to um to have um a compatible solution that is considerate of the parking challenges this whole area faces some of which are relatively unknown because Marsh Run 2 is not complete and then I think you know again um I think the I think understanding your target audience and then having a plan that comes forward that represents that if it's family with s families with kids I expect that there will be some accommodation with amenities and things on the property that can that can handle those issues if it's if it's young adults and um and young married couples and so forth and there's and you don't anticipate there's going to be any kids well then maybe you only need two bedroom units and not three and um and there you know there are just different things and so this a concept I wanted to give you my feedback but I think that these things need to be thought through um because physically the buildings in my view when I go through that neighborhood and look some look at some of the stuff that was there before the Burke these are not this plan is not incompatible with what's existing there I do believe that the nature of the neighborhood has changed because we've got two large apartment buildings there now but this really fits pretty well and I don't want to say in a vacuum because we don't ex we don't live in a vacuum but you know if the if the two large apartment buildings were there this would fit great this makes all the sense very consistent with with what's there but the challenge is fitting these pieces together in a way that makes sense in a in a pretty tight area so I hope that's helpful I'm you know the I I didn't say anything that you haven't already thought of but but I think that you know for this Council I think we're going to need need to see some of these things addressed if a project comes forward Council anything else I uh we do know that Dorne builds a quality product and uh we do know that they uh they're not always the easiest customer for staff to work with but um but you build a quality product and and you and and we work together to get things done and and that's a good businesslike Rel relationship and that's what we expect so thank you all um Julie yes yes may uh if we could thank you mayor and council members just a few things to clarify before we leave tonight and then uh just because we have people watching I just want to make sure we clarify a few things Susan can you there were two things I heard about traffic study that was one and HOA then I'm going to talk about construction very good go ahead Miss Thomas sure I'll start in um Miss MN can jump in if I if I miss something that she wants me to to address um first a as we discussed any any project um that comes forward on on this property we would require a traffic study just um I can tell you from staff's perspective we find that our traffic studies that we uh commission are very accurate and I'll give you an example um we did a traffic study for the Burke before the Burke went in and we had um trip volumes were projected for for the Burke and then several years later when the marsh run two was proposed we had a traffic study done for that and the consultant went out and took trip counts again and found that um the trips that were being generated by the now occupied Burke were actually less than they had projected for the Burke so those projections that they had were um even conservative so we are um very confident in the consultant that we use for for our um our traffic uh traffic reports so that said but we um did hear uh tonight that again whatever comes forward uh for this property either in the short term or the long term we will need to look at some type of kind of holistic parking analysis uh for the area um that's that's what I I heard from the council then in terms of the HOA um this has come up several times as we look at uh as we looked at the Burke and Marsh Run 2 and now again there is um a an incorrect assumption that the trail system that runs behind the gables which are the town homes on the east side that the homeowners association there for the gables um maintains that trail system and is um responsible for maintaining it and for funding the maintenance of that that trail system and the property on which those Trails exist is actually owned by CSM which is the the commercial property owner um they maintain those trails and they're responsible for um the costs associated with with their maintenance so I just want to make sure we get that on the public record and then uh finally just some thoughts about construction um I obviously I'm a little upset when people call it chaos um I I do think that it's a large project in the area so um the types of vehicles and the number of vehicles you see there on a daily basis is part of normal and typical Construction in the city so nothing um that's occurring on the site is atypical so I want to be sure I I say that however um there have been complaints about start times and the city is monitoring start times they happen compliant with their start times thank you for the cooperation on that secondly um if there are any issues with parking there was parking on the street and on the sidewalk originally we ask them to move to the South Side get off the street get off the trail so that there's no inter rtion this is also been vetted by the police department this is a an actually a good solution for parking in the area so um we as Staff feel like we've handled some of the issues and the um the identified issues from the neighborhood that have come our way if you're hearing other things we need to hear that uh as a staff member um we can uh address those issues but again it's not atypical for construction in menaka about what's happening there so if you hear anything else let me know thank you mayor thank you m wishnack and Council any last things that you would like to comment on um coun sha I I want to apologize about the ca I think construction's chaotic right and I think a construction of a just under 300 unit building is going to be inherently chaotic so it's nothing unusual going on but sometimes you have a truck backing up supplies and it it's expected but it is pressure on the neighborhood so I I don't think anybody's doing anything wrong and I'm that's not the allegation thank you and um in C Shack I would I would just uh support that when I've when I've been there it's busy there's no question that's an enormous project and it's busy and you know as we've just been talking about there's there's not a lot of excess obviously available parking but but I I noticed that all the cars were on the south side of the road um they were orderly they were the way they were supposed to be um but but it looked like it was busy and it is so um yeah I don't want to I don't want that to get blown out of uh um context and um yeah and again for people in the audience or listening um the contractors uh superintendent phone number is right on the website as well so the city's website has their direct dial um so if you can't get a hold of a staff member that's another way in case there's an emergency great so I hope this has been helpful to you and thank you
