world neurofibro ptosis awareness day in witness whereof i have here unto set my hand and cause the seal of the city of aurora colorado to be affixed this third day of may 2021. thank you and i see that we have the mayor we just finished the proclamations uh mayor pretend uh never change your password on a council meeting night because there may be problems uh public invited to be heard mayor i don't know if we wanted to uh remove item 11a and move the adoption of the agenda um okay uh so that people aren't waiting and necessarily uh i'm gonna i need a motion um well first of all um well i need a motion uh to move the agenda uh councilmember comes so moved it's been uh moved by councilman coombe seconded by here second uh second by um [Music] uh to um to approve the um agenda um i need to remove item 11a uh from the agenda and i would like to um place um the reports by mayor and council after public invited be heard item number 20. i support removing 11a but i object to moving the reports to the end um perhaps the mirror pro tem will want to elucidate this a little bit but we did talk about it in the uh rules committee meeting last week and we thought that it would be best to enable council members to give their reports so that members of the public can get any information there rather than putting those and then if council members have a need to provide a response or request more information that they be permitted to do that during public i'm not going to recognize anyone after a public invited be heard mayor um that meant for him yes um so we did uh have the rules committee and that was a decision of the rules committee so are you saying we adopted that yet has that been formally adopted well no because it goes through the rules committee and then i guess we are bringing it up right now foreign okay well that could be why you just voted down then um if that's your if that's your desire um well i'm gonna sever the two uh so first uh uh we'll do it in the form of an amendment uh first amendment is the removal of item 11a from the agenda is there any objection assuming none item 11a will be removed from the agenda then um uh let's see is there objection to moving uh item 19a and 19b after public invited to be heard mayor abject um both remember coombs councilmember berzins last word uh majority have arisen uh so that amendment fails and so um further discussion on the adoption of the agenda as amended uh seeing none um with this clerk with the staff please call the role on the adoption of the agenda mayor kaufman yes councilmember coombs yes councilmember marcano yes councilmember gardner yes councilmember johnston yes councilmember mario yes councilmember lawson yes councilman persians yes mayor pro tim bergen yes councilmember hiltz yes councilmember gruber yes the motion passes uh public invited to be heard okay let me unmute roger one moment please we do have two individuals in the line for public invited to be heard okay roger you're unmuted all right first up is mitch uh you've got three minutes go ahead my name is mitch westall and i currently have uh an issue with a cell tail being placed in front of my unit um council member mcconnell is helping with that um and he's trying to currently get it moved from the front yard to the side yard which is the appropriate location but i've discovered that i had another one was placed next to another rental that i have um and uh i'm realizing that there was no notice or no no information given to me um from the planning department uh and we're like literally a hundred feet away and and uh and it's difficult because the it appears that there's not really any good communication coming from the zoning department but furthermore it also makes makes me realize that i think there's a discrimination going on within aurora they're choosing to place these cell towers in low-income multi-family homes and targeting them because they do have have streets and easements next to them that you guys are allowed to use but it's putting the burden of the placement of these cell towers on the people that are are less to do and it also you know it it seems to me that it would make sense for the entire community to know where these cell powers are going um it'd be nice to know where all i going understand if they are going in that location it'd be nice if there was a large picture um showing exactly where the location is and and showing the picture of what it looks like i went door-to-door knocking on people saying look this is in our front yard and um literally you know four or five different houses didn't even speak english and didn't even know what i was talking about um and i just think a picture you know similar to what we do for for a zoning amendment would make sense to let the community know that these are going in and these are the locations that they're going in i'm not against having cell powers in our community i'm against not talking about it and not informing the public and having that communication any questions mayor mayor mayor you're muted customer johnson um thank you um thank you councilwoman marcano for for working with this gentleman i i just have had an issue it was actually in um councilmember berzin's ward but i had several families attend this school and i did get a map of the cell phone towers and the city staff this was like two years ago um worked to try to see if it could be adjusted but it was the owner of the building and they were under some kind of contract with the cell phone towers but i just want to see if we could get a presentation from staff in terms of zoning this was an issue at least the family members when they got a pre i coordinated a presentation with the city and the family were very concerned about health issues and um just want to see and and mayor in the past we've had this when public asks a question council members can um respond and council member mcconnell may want to but if staff can can comment if council member marcano wants to have that since since i've been mayor and so uh i think we all know the individual in question and and let's get back with him but but certainly i think it's appropriate uh during either your time or after the meeting to um uh to make the request uh but but we are not but there's there's no precedent as long as i've been mayor for having a back and forth in public inviting be heard it may or may i no you may not proceed with the next public inviter to be heard next is cynthia you have three minutes go ahead hello i'm cynthia edwards from washington d.c i'm actually here in denver colorado i've met with the city council before last february of last year before covet and i am here to find information about my brother david north hawkins unfold homicides and find out what resources the royal police department needs to shed more money on what happened to him i have discovered that there are some inaccuracies within the police report that describes the incident and i wanted i'm here to correct that as well as to shed light on the stories of homicide victims across this nation um as you know i'm very far even when i arrived here yesterday that there was a mass shooting here in colorado springs and my heart and my prayers and our action goes out to those families um paying for peace on the legacy of my mother dorothy hoffman's grace and my brother david hawkins is actually bringing an office to aurora colorado and i wanted to continue to work with this community and reach out to this community the only reason i did not relocate here last year is shortly after i returned back to washington i actually had coveted banks and i was hospitalized so i just wanted to share some information i created two videos in in life of mass shootings as well as homicide victims and particularly fun fall homicide victims all over this nation um and i believe it will be a tool that will be very helpful for your residents as well as america within the state of colorado and we are um i'm going to be walking across this nation and promoting non-violence until we have less family suffering from homicide so i just wanted to um thank you for allowing me to speak but i just wanted to know that i'm still here and i will continue to work with this community and eventually be a part of this community to do my part in making sure that left hand is suffer from this this carnage that unfortunately is unfolding as a daily occurrence in our country okay that was all we have for public invited to be heard mayor i think we need to approve 8a i'm sorry with the clerk now please read the title to uh item number 8a reconsideration of resolution 2020-24 to suspend certain council rules uh discussion motion mayor uh council member mcconnell need to approve a day removed by councilmember mcconnell secular number eight a discussion uh seeing none uh with click please call the rules roll on the adoption of item number eight a council member gruber yes councilmember hiltz yes councilmember persons yes councilmember lawson yes mayor pro tim bergen yes council member mario yes councilmember johnston yes councilmember gardner yes councilmember marcano yes councilmember coombs yes the motion passes um next is the adoption of the consent calendar but apparently if i understand a right to of clerk there is a duplicate item uh number uh 9h is the same as 9f so we will entertain a motion of item number 9a through 9g with the exception of 9h and then 9i is there a motion mayor that councilman mcconnell summoned moved by councilmember mcconnell seconded by birkin county mayor den bergen the prove item number the consent calendar item number nine a through a g and then item number nine i um discussion with the clerk please call the rule the role on the um adoption of the consent covenant mayor kaufman yes all right council councilmember lawson yes councilmember johnston yes councilmember health yes councilmember coombs yes councilmember partner yes councilmember mcconnell yes mayor pro tim bergen yes councilmember gruber yes councilmember mario yes and councilmember burzen council member burson looks like she might be having some connectivity issues okay the motion passes uh with her now please read the title number 10a item 10a is resolution 2021-30 a resolution of the city council of the city of war colorado approving intergovernmental agreement for exchange of water between the city of aurora colorado acting by and through its utility enterprise in the south adams county water and sanitation district acting by and through the south adams county water and sanitation district activity enterprise motion and remove to approve 10a it's a bit moved by uh councilman gruber second by second presidential recruit number 10a discussion mayor councilmember coombs can we get a brief presentation for the benefit of the public uh presentation by staff i'm mayor and council this is marshall brown general manager of aurora water i'll give a brief summary of this item in that aurora owns water rights in in various ditch companies up north in the brighton area adams county south adams county water district also owns water rights in various ditch companies up north in the brighton area some of the water rights that aurora owns and ditch companies geographically work a little bit better for south adams and some of the water rights that south adams owns work a little bit better in aurora's system so we are proposing this evening essentially uh an equal trade with south adams where we would receive some of their water rights in ditch companies that work better for us they would receive some of our water rights that work better in ditch companies for them there are some little nuances in that some of the water rights have been through water court others have not so the agreement does uh have a reconciliation at the end of the uh the process where the water rights would all get through water court so that the trade essentially um is equal and equally beneficial for both parties so again an opportunity to have a win-win for both the city of aurora and south adams water to get water rights for each of us that work a little bit better in our respective systems discussion questions uh seeing none um uh would the club please call the role on the adoption of item number 10a mayor pro-tem bergen yes councilman yes council member council member maria yeah councilmember berzins councilmember lawson yes councilmember johnston yes councilmember hiltz yes councilmember coombs yes councilmember garner yes and council member marcano yes the motion passes and fyi uh council member represents is trying to get reconnected okay thank you mayor person mayor uh councilmember o'connell thank you i have a point of inquiry for um city attorney broughtsman um if we if a majority of council chose would we be able to suspend the rules and have a different individual run the meeting if we disagree with the way they were running the meeting and you the mayor is the presiding officer so he runs the meeting if you have issues there is an appeal that council can do on individual items but you can't remove the person running the meeting on overall so you can do it piece by piece okay thank you where were we um mclaren now appreciate that please read the title to item number 10b 10b is resolution 2021-31 a resolution of the city council of the city of aurora colorado expressing the aurora city council's pledge to work with the metro denver homeless initiative on builds for zero for regional coordination to reduce homelessness motion mayor councilman combs so moved removed by councilman raccoon seconded by second councilmember mcconnell uh discussion let's see um yeah just can we get a brief presentation on this item as well and just for clarity's sake um moving forward on resolutions if there's not a presentation i'm gonna ask because i think if people don't watch study session they don't know what we're voting on and so we're just kind of blazing through these votes without information to the public presentation absolutely thank you so on march 18th there was a convening with the metro denver homelessness initiative which is a regional collaboration amongst the eight county region within that mdhi is asking for each of the jurisdictions counties et cetera to sign a pledge committing to building and sustaining a new future where homelessness is very brief and a moral and public health imperative that is necessary for an equitable future and so um this is just signing on to the pledge that our community is willing and interested in uh joining this regional collaboration and committed to working towards a functional zero number which is bringing our homelessness number down to a functional zero in our community further discussion mayor uh councilman i just wanted to point out that i will not support this i'm concerned after reading through it it's a i guess 80 towns have uh signed up to be part of this i don't mind signing up and and saying that we will we'll support it but when you sign a pledge you're giving your word that you're going to be supporting something and in this case i'm concerned that it could be a blank check because it requires a pledge as opposed to a simple statement of support i will not support i will not vote for this item right councilwoman johnson thank you i i just want to remind folks that this is a public health issue and for some reason it is becoming political we have said several council members have said these issues are regional we have top-notch staff who are using data-driven evidence-based policy to come up with opportunities including working regional the pledge is not committing us to dollars it's committing us just like we do with a resolution to our to our values and our support i was extremely disappointed that after our discussion that the mayor criticizes council members and the majority um of staff who are again non-political which we have a city manager form of government not a mayor's strong form of government and are making recommendations and then puts on a a social media post about um the majority of council and supported by staff are going to to make homelessness policy even worse than it was before and increase homelessness so we're just really veering off i know i'm going there right now and i'm probably being a little political by calling it out but this all started because this is a public health issue and i don't even know why we're debating this and making this making this about politics and different partisanship and all of that i i would hope we can look at this as regional collaborative best practices support the staff and recommendations and do the right thing further discussion mayor cozmo mccombs um yeah so i just want to make sure that it's very clear what resolutions are and what they do though we have done this many many times they unless they explicitly commit us to some particular funding they don't commit us to any funding unless they explicitly commit us to particular programs they don't commit us to programs this commits us to join the regional collaborative um and work together with other partners in the region and that's it every single program and dollar that we spend will still have to go through staff and council in order for us to uh to spend those dollars so i just want to make sure that folks understand that that's the case further discussion mayor uh mayor jim um yeah and i think this is probably a good uh collaboration to have uh regionally my only issue is it being a pledge as was mentioned earlier and and i know we say many times the resolution doesn't mean anything it doesn't do anything it doesn't it doesn't direct staff it doesn't mean that we're going to spend money but honestly i have seen several occasions when we pass a resolution and then it actually the next time next meeting or so it is a request for funding or is it is you know goes further so um as much as i think it's a good idea i i won't support it just because of the word pledge further discussion uh seeing now the question before us is the adoption of vitamin c with the clerk please call the roll yes resolution 2021-31 council member marcano yes councilmember gardner yes council member gruber no councilmember coombs emphatically yes councilmember mario yes councilmember johnston yes councilmember lawson yes mayor pro-tem bergen no councilmember hilts yes uh council member berzins you know i gave my reasons last week and the answer is still no okay we'll go now please read the title to item number ten see is resolution 2021-32 a resolution of the city council of the city of aurora colorado to modify the rules of order and procedure for the aurora colorado city council oh i'm sorry uh motion mayor uh councilmember combs so moved it's removed by councilman coombe second or by bergen councilmember bergen to approve our number 10c uh discussion mayor councilman combs can we have a brief presentation from staff i'm sure we'll have comments from members as well but our presentation by staff hi everybody um thank you for uh having me this evening so the proposed revisions that are in front of you are the 2020 revisions to the city council rules that have been discussed last year so these are all of the revisions except for any changes to the oath of office and you all had heard these last week at study session other questions every question persons concerned persons thank you um it's on um number six executive session and if you'll scroll down i think it's page three i was curious why why do you have to have two-thirds of a quorum before entering executive session uh this is dean bronson yeah that is actually a colorado statutory requirement okay okay and um one other statement and i i'm not going to oppose it because of this but i i'm still concerned about the executive backup material i know we talked about it and i think most everybody thinks it's fine to get it out i i'm thinking at some point there might be an exception to that something so sensitive that it really or so last minute that it can't be out to us within 24 hours before so i it's just a concern on that one other than that i'm fine with the rest further discussion uh seeing none of the question then before us is the adoption of item number 10c with the clerk please call the roll mayor pro tim bergen yes councilmember hiltz yes councilmember burzins yes councilmember lawson yes councilmember gardner yes councilmember mario yes councilmember marcano yes councilmember gruber yes councilmember coombs yes councilmember johnston yes the motion passes well the clerk okay with plug now please read the title to item number 10d item 10d is resolution 2021-33 a resolution of the city council of the city of aurora colorado to adopt a new employee manual for the aurora colorado city council that was that was the final let me ask a clerical question was the final uh version did that take out city council uh no it did not this was already published on friday so if council would like to make a motion to remove um for the aurora city council at the end of the um title of the reputation now so first of all let me have a motion mayor move to approve attendee that's right it's been moved by council gruber seconded by sector second by council member lawson to approve item number 10d um discussion there uh councilman combs yeah can we get a hopefully brief presentation from staff i know this was an extensive presentation at study session but if there's a way to have one briefly i'd be appreciated presentation by staff this is deanna giordano hr director here with the city of aurora uh what you have before you is the proposed 2021 employee handbook with modifications that the human resources department along with the finance department in partnership with the city's attorney's office reviewed the handbook the major and significant changes were more related to federal laws as well as state laws so compliance with the equal pay for equal work act the healthy families and workplace act ucera pregnancy gender identity at the state level fmla and ada modification so really to reflect compliance with legal laws and requirements to establish a workplace that's productive and conducive to a positive work environment the manual was shared in study session as well as stakeholders throughout the city okay further discussion we'd like to offer an amendment to the title uh to strike [Music] the words all after a new employee manual because i katie what was the appropriate what was the proper language i believe you just wanted to remove for the aurora city council that way where you wanted to adopt it for the employee manual for the city well we're we are not am i if i'm correct the city council is not subject to this all right let me let me defer to the city attorney it is my understanding that that's those extra words um are not applicable that is correct that this applies to the appointees actually adopt the employee manual for their for all for their employees so what should it should be okay so so simply strike after everything after the word manual and you'll be fine okay mayor second your motion okay um second by uh moved uh by the mayor seconded by council member gruber uh to strike uh the language after uh employee manual uh discussion can i ask the city attorney a question i had i believe had he had said earlier that it would have to be a council member since it's a resolution to make the motion uh councilmember gruber you can make a motion press a motion to change the title to a resolution of the city council of the city of aurora colorado to adapt a new employee manual is there a second second by mayor for tim um discussion on the amendment seeing none with the clerk please call the roll on the on the gruber amendment council member mario councilmember lawson yes councilmember coombs yes councilmember johnston yes mayor protein bergen yes councilmember marcano yes councilmember gruber yes councilmember berzins yes councilmember hilts yes councilmember garner yes the motion passes for resolution 2021-30 a resolution of the city council of the city of aurora colorado to adopt a new employee manual okay that was to the amendment yes okay now we're to um the resolution itself uh discuss further discussion on item number 10d and dan again i'm sorry if you want to refer to the city tune i think it could be made in one motion is what he had said so the approving the resolution with that amendment okay okay that's that that's correct okay then uh number ten to be as adopted uh with clerk please read the title item number 10e item 10e is resolution 2021-34 a resolution of the city council of the city of aurora colorado approving the land exchange of certain real property located in arapahoe county for the first creek detention pond project uh motion uh councilwoman comes so moved been moved by councilmember mccoombs seconded by perkin like uh mayor denbergan to approve of number 10d um discussion title i'm sorry item 10 emails uh discussion here all right councilman um yes can we just get a brief presentation i know this was also somewhat extensive but brief presentation from staff your presentation absolutely um good evening mayor city council i'm sarah young deputy director in aurora water and planning and engineering this item is um is based on a study that was done with mile high flood district back in 2010 uh where uh we did a master drainage plan identifying a large regional pond uh south um east of uh i-70 and e-470 that first creek detention pond as it's called is large enough that it actually crosses multiple properties so we did negotiations with four different property owners through the process and some of the properties that we purchased in the process were larger because we had to purchase the entire parcel so some of them were larger than than the area that is going to be taken up by the pond and in the negotiations uh with mchenry family the bell and fairbaugh families and hints we purchased all of those total properties in conversations uh with the fourth property owner um we uh uh we offered up the appraised value for that property um and then they submitted a counter offer which we rejected and so at that point we started talking about a potential land swap for the property that's on there that's within their property that the pond is on versus other areas that were outside of where the pond is being constructed and so we discussed the concept of swapping some of the property that we weren't going to be using for property that we needed for the pond they accepted that offer some of the benefits for that as the city is is now we can we have the ability to construct this pond for the ig that's required from the mile high flood district study the property must be annexed into the city upon development they have given us prior approval for any necessary temporary construction easements and then the future developer of the property along the south will be responsible for the major arterial roadway construction um and then there's no additional cost of the utility um for the property that's on the on the north side of the fourth property ownership property per bpm414 when we dispose of any city real property assets that require city council approver approval so that's why we're here asking for approval to do this land trade questions of staff let's see none discussion seeing none with the clerk please call the roll uh on the to move forward but both are in the back up for review mayor uh motion um uh councilman gardner never mind mayor dave grieber move to approve 13a been moved by councilmember grover second by second neighbor uh senate by council member coons to approve number 13 a discussion uh councilman carter i'm confused why we have the second version in here um we we approved the first version at m f we approved the first version at study session and in fact had a very outlined conversation i think as to why um the there's a really it's a it's a an extra sentence that's contained in the second version as to why that was inappropriate involving an ordinance i'm curious from staff's perspective or how why we have two different versions in here um because now this has gone through both committee and the full council to approve the first version so it just doesn't make sense then why we have the second version included at all mayor this is katie my address councilmember gardner what happened was this the entire backup and the the item got moved over from study session so it gets referred in escribe we could have removed the second ordinance and moving forward next time we will do that it was just in there as backup for reference in the future so for ordinance number one that's why i wanted to clarify that's what has been moving through the whole time and it's going to be on record and in the minutes that was just included as a backup for extra reference all right further discussion uh may i pretend okay thank you i just have a question on on the supplemental amendment request on on 13a where it has one point or one fte youth violence prevention manager and five fte youth violence prevention outreach specialists i i thought i thought that was going to be phased in so can um jessica talk to that or somebody councilmember bergen this is just compressor yeah so we are currently recruiting for two outreach specialists okay and we have are working with hr to convert one of the outreach specialists to a program coordinator this will be more administrative and focused on events and other things and so right now we're only recruiting for the two outreach specialists okay so the other ones will most likely come later in the year okay i was because i was confused on that so they're approved but not being uh filled at this time that's correct okay yeah because i think we had discussion uh on how would you know how many you need when it's a brand new program but maybe now well that's fine thank you very much further discussion uh seeing none uh with the clerk please call the role on the adoption of item number 13a councilmember berzins yes councilmember hiltz yes councilmember johnston yes councilmember gardner yes councilmember mercano yes mayor protein seniors to the commission for older adults the motion mayor that comes from the combs so moved second like moved by council member uh chrome secretary councilwoman johnson to approve i remember 13b uh discussion mayor uh councilman combs can we get a brief presentation from staff on this item i think it's contained in the title but a brief presentation by staff good evening council my name is joe sack i'm the recreation services manager i'm here to request on behalf of the aurora commission for seniors and chair jeanne davis to change the name of the commission of the aurora commission for older revolt older adults in an effort to combat ageism ageism is the stereotyping and discrimination against individuals or groups based upon their age ageism can be taken in many forms including prejudicial attitudes discriminatory practices or institutional policies and practices that perpetuate stereotypical beliefs to come to this decision the commission has done a lot of research here is what they discovered words matter the words we use describe and label older adult older members of our society reflect our vision of their capabilities as well as their contributions the descriptors with which we identify ourselves says a lot about all of us the neutral sounding term seniors is on the decline globally report from cnn indicated 51 percent of older adults surveyed said they are not comfortable with that term by renaming the commission and is the beginning of recognizing that words we use matter how older adults are perceived and as it relates to our willingness and our desire to change the narrative the commission and staff request that city council support the name change to expand the awareness and understanding of aging in our community by approving the ordinance tonight thank you the discussion mayor the councilor comes so i just want to say that um the commission did come and give a really excellent presentation at the public relations and uh pr plus committee um where boards and commissions are heard for any changes and reports they want to make and they provided a lot of good data they also talked about their vision which includes working together with our youth commission and doing some joint programming that really combats ageism on both sides and builds more connections in our community so i just really appreciate them taking the time and strongly
