Our first item today is a presentation of the Mayor's Honor Roll, which recognizes Henderson students, teachers, administrators, support professionals, and parents of students for special achievements, exemplary service, and outstanding contributions in education. This is our first awards presentation for the 2025-2026 school year. Our first honoree is Kayvel Basu, an eighth grade student at Bob Miller Middle School. As president of the robotics team and vice president of National Junior Honor Society, he mentors younger peers in robotics and innovative Lego building, inspiring their interest in STEM. Over the summer, he volunteered more than 120 hours with organizations such as Ronald McDonald House, Baby's Bounty, Helping Hands of Nevada, and Three Square. A three-year Nevada Science Olympiad medalist, Cavell leads by example through his charitable work, fundraising efforts, and thoughtful recognition of educators, including nominating his teacher for a national award that provided $5,000 for her classroom. His leadership, compassion, and commitment to giving back make him a true role model within his school and community. Our next recipient is Andrea Rose, a special education teacher at Liberty High School. Ms. Rose creates engaging hands-on learning experiences that foster independence and confidence in students with learning disabilities, while securing additional resources through grants and DonorsChoose to enhance instruction. Beyond the classroom, she serves as an advisor for Key Club, Hope Squad, and the Jewish Student Union, empowering students to become compassionate leaders and active community members. Through her collaboration with colleagues, families, and local partners, Ms. Rose cultivates a culture of inclusivity, respect, and service that positively impacts the entire school and sets her apart as a leader in education. Our last recipient today is Stacy Tiffany, an outstanding parent volunteer at Foothill High School who has greatly enriched the school community of not only Foothill High School, but also Smalley Elementary for more than a decade. As vice president of the PTO, she plays a vital role in organizing events, coordinating fundraisers, and managing volunteer signups. She consistently goes above and beyond and is known for her kindness, reliability, and tireless support. Congratulations to our Mayor's Honor Roll recipients. The community came together for our annual Veterans Day ceremony on November 8th at the Water Street Plaza Amphitheater, where we paid tribute to our local patriots and military heroes. We celebrated the grand opening of our go back. Thank you for the Veterans Day ceremony. Sorry. Now on to the next one. We celebrated the grand opening of our 75th park, Centiero Park on November 12th, 2025. Centiero is our seventh and final park in the Inspirata community. Item 31 is a public hearing, appeal of decision AP-9-25 for variance VAA-2025-017447, Evelyn Pipitone, single residence, and the recommendation is to affirm Planning Commission's decision of approval. Mayor and members of Council, this is an appeal of the Planning Commission decision to approve the variance to reduce the interior site setbacks from 5 feet to 3 feet for a principal residence dwelling unit located approximately 100 feet southwest of the intersection of Evelyn Avenue and Jefferson Boulevard. Staff in the Planning Commission recommended approval for the applicant, as they provided a compelling case that their request was a legal hardship based on the narrowness of the lot. Thank you. Tessa Stewart, 89002. Good evening and thank you for hearing this appeal. This is a tight knit neighborhood and people here genuinely care about what happens on their street. In just two days, 42 neighbors signed an opposition of this variance. This is not normal turnout. That's a sign a community is deeply worried. To be clear, nobody is against building a home. What we object to is building a three story structure with reduced setbacks that would directly harm privacy, safety and livability. This proposed house is already unusually invasive for a neighborhood that is 95% single story. Actually, every house on Evelyn Street is a single story. A three-story structure will overlook every surrounding backyard, cast large shadows, and fundamentally change the character of this block. Shrinking the setbacks from five feet to three feet make the impact even worse. Being three feet off a property line is extremely close, especially for a house this tall. It also pushes the structure dangerously close to the existing utility pole and transformer. Nevada Energy's own clearance standards make it clear that reducing space around the pole compromises access and safety. I understand the lot is small, but the lot directly behind it is the same size and shape, and that home was built within code. Two stories, two bedrooms with a garage. Nothing about this parcel prevents the applicant from building a perfectly livable home. This isn't a housing crisis issue. This is wanting a bigger, grander house than the law can support issue. The applicant claims they need a variance to build what they want, but using a standard footprint, the house would only lose about 240 square feet, still leaving roughly 1800 square feet plus a 232 square foot garage. That's not a hardship, that's a preference. The city created these setback rules for a reason. Abending them for lots this small we remove the protections that keep this neighborhood safe consistent and livable We simply asked the city to apply the same rules to everyone a home can and will be built there Just not the one that damages the quality of life of the families who already live beside it for the reasons We respectfully ask you to not deny the variance. Mayor Paterson- Can I say something? Born and raised in Henderson. I have no issue with anybody building anything on my street. I've watched many houses in 37 years be built on my street. I've never complained about any of them, but a big orange three-story house, which is as tall as the telephone poles in my neighborhood, everybody will see it. I'm the one that had all the petitions signed, all the signatures, and everybody I talked to had no problem with the house being built there until I showed them the picture of the house. You guys have a picture of the house? If you have a picture of the house, you'll see exactly what we're talking about. Somebody needs to show a picture of the house. This is the picture everybody needs to see. Excuse me one second. I'm going to try to hurry here. Come on. No, it's not going to work. Tiffany, can you pull that up? Picture of the house? My phone's not working for some reason in here. If you can see the picture, it is a big, giant, orange house squeezed in between two lobs. There's no way in this picture will come out with a fence line in between that house and that house. They will have no yard. That picture is deceiving. I want to say just if you guys allow this, every time I open my window, I'm going to see this big old orange house in my, I live across the street from it. And I just think you guys are not looking at the big picture. Nobody wants the house except for the guy that the city sold the property to, which was too small to build anything on. Now they want the revenue out of it. So they're going to let him build this house. So when I build my addition, 15 years ago, you guys wouldn't let me go 12 feet. I only had to go 11 feet because you wouldn't let me because of the variance. So I had to make my house 100 square feet smaller when I did my addition. And you guys only gave me one option, sell my house and move to another neighborhood or make my house bigger. So I tried to make my house bigger. You guys denied it. Not you guys, but the building commission denied it. So just like Tiffany, her and her father spent a year and a half building her house, her and her father. built her house right next to this house. She will have no privacy. Six houses up, I talked to the other neighbor, you know, she says she, you know, sometimes stays in the nude. If we deny the setback, that's the only variance that's being asked of this, what happens? Are they still meet height requirements, everything else, if they move forward with this, as long as they adjust the height Yes, Mayor. So the height in the district is 35 feet. They're under that. They're not requesting a variance for the height of the house. They're requesting the, basically it slims down at the front by the two feet on either side for the setbacks, and then it gets wider, and so that's what they're asking for the variance is for those extra two feet on each side, so four feet towards the rear of the property, which they've set it back from the single-story homes adjacent to it. So if you... overturn the Planning Commission's decision to approve the variance waiver, then basically they wouldn't be granted the setback, so they could then, they could come back again and ask for a waiver, or they could come back with a different variance, or they could just build the home at the same height without it being encroaching into the setback. Okay. Mayor, may I ask a question? This gentleman here said that he had a height limit, Has the code changed? Not a height limit. It's silent. Which they're asking for. Okay. Mayor and members of council, this is a four-part item for age-restricted affordable multifamily development on 7.5 acres on the northeast corner of Pueblo Boulevard and Boulder Highway. This includes a comprehensive plan and zone change amendment from commercial to mixed use on a 0.7 acre portion of the site. There's a negotiated development agreement for an age-restricted community, which requires biennial reviews to ensure compliance with the age-restricted obligations. And last is a design review for a 270-unit multifamily development. Staff and Planning Commission recommend approval. The applicant is here for a presentation. Good evening, Mayor and Council. My name is Bob Feibelman, and I'm with Nevada Hands, located at 9121 West Russell, Suite 219, Las Vegas. We're a nonprofit developer of affordable housing and have been serving the community for over 30 years. We're here tonight to present our plans for the proposed Pueblo Pines project. This project is located on 7.52 acres at the northwest corner of Pueblo Boulevard and Boulder Highway. We're very excited to be able to bring 270 units of high quality, affordable senior housing to the city of Henderson. This project consists of five four-story buildings, each with 54 apartments. It is also exciting to integrate this housing with the Reimagine Boulder Highway project, which provides efficient mass transit and beautification of the corridor. During our neighborhood meeting, we heard several concerns. Traffic on Pueblo. We know that senior housing has minimal impact on traffic compared to most other uses. At the Planning Commission meeting, there was discussion between the Planning Commissioners and the City's traffic engineer. They had reviewed and approved the project. There was also discussion about the project entrance location. The City determined the location of the entrance since no driveway can be built on Boulder Highway nor closer to the corner on Pueblo. The driveway location is where a utility easement exists, thus nothing can be built there. The neighbors did not like the buildings in the height of the buildings in that they lived in a one-story community and felt that our residents would look down into their backyards. We've taken several steps towards almost eliminating that concern. First, under the current zoning, we're allowed to build up to 90 feet in height, but we chose to stay under 60, actually closer to 50. That's almost half of what is allowable. The buildings do not have balconies for residents to view residents in their backyards. Third, our site is separated from the neighbors by a wide utility easement. 225 feet is the closest point from our closest building to a neighbor's backyard. The range from our buildings to the neighbors' backyards is 225 to 498 feet. We located the buildings to mostly avoid the north property line and designed the location of the closest building to be parallel to the perimeter wall, to not to be parallel to the perimeter wall in order to increase separation from the neighbors. We purposely worked to avoid building along the north property wall. For example, we located our dog park in the corner to further eliminate any visual impact from a structure. We prepared this line of sight exhibit to show the view from the neighboring backyards. Neighbors might see part of our third floor and most likely the fourth floor. Yet due to the significant distances, there should be very little visual impact to the neighbors. Fourth, the neighbors brought up the fear of the homeless. We believe developing this property should positively impact that. Finally, the neighbors spoke about past experiences with poorly maintained apartment complexes. We agree that property management is everything. Nevada HAND has been developing and managing our developments for over 30 years. We're very proud of our new construction. However, we are more proud of our older buildings because they are well maintained. We invite anyone to visit any of our 36 communities with over 5,400 apartments in Clark County to see how well maintained they are. I'd like to add that Nevada HAND provides additional services such as a transportation fleet to take our residents around the valley, full resident services department to help seniors with services that they are looking for. And we also have food pantries in many properties. Note that we have intentionally oriented the common area amenities to the center of the project. For amenities, we have large combination leasing, recreation, maintenance building with staff offices, large activity room, fitness area, and computer lab. Outdoors, we have covered areas, a swimming pool and spa, dog park, garden area, walking paths, and seating areas. We're here before you requesting approval to amend the comprehensive land use plan from commercial to transit-oriented development and rezoning from RS6 low-density residential to or mixed use for a small portion of the site, approval of the development agreement allowing for an age-restricted community, and design review for a 270-unit multifamily development. Anthony Jukes, senior planner with the City's Long Range Planning Division. In 2024, City Council approved the nominations of eight parcels in West Henderson for inclusion in the upcoming 2025 Bureau of Land Management Land Sale. The parcels are shown on that plan there. In preparation for the potential sale and future development for these nominated parcels, City staff conducted an evaluation of the current land use and zoning.
