[11:18] **Council Member Aurin Chowdhury**: Thank you, President Payne. The BIZ committee is bringing seven items forward. Item number one is approving bonds to the University Gateway Corporation. Item number two is denying an appeal submitted by Molly Reichart regarding the Seven Points residential development. Item number three is approving five liquor license renewals. Item number four is approving three gambling licenses. Item number five is accepting a grant from the Subaru Loves Pets program for pet adoption fees. Item number six is accepting a grant from the MN State Historic Preservation Office for costs related to the NAPC conference next July. And lastly, item number seven is approving a rezoning application to Quarry Developers for the property at 1501 Johnson Street Northeast. With that, I will move all items for approval and move item number two for denial.

[12:22] **Council Member Aurin Chowdhury**: Thank you, President Payne. I did want to just take a moment to share about a receive and file that we got at the Business, Housing, and Zoning Committee on August 12th. We received a presentation from the Director of Regulatory Services on the Encampment Reporting Ordinance Quarter 1 report which accounted for encampment removals from December 19th to March 18th actually I believe. Um, I feel like it's important to just share this out in the larger body because we have gotten two reports back to us and this is the first report of the year. I want to reiterate that the legislative intent of the encampment removal reporting ordinance was to bring transparency, accountability, and oversight to the processes involving the removal of encampments in Minneapolis. And also responding to the growing need for a data-driven approach to managing and understanding unsheltered homelessness in our city and the fact that good governance requires good data. And that's why I want to take some time to share about that report in a larger group and we also did not have a lot of time for questions to really dig deeper into it. I will share a little bit of my dismay that both times that the report was being brought to the body, the presentation of the report itself was what I felt dismissed. The item was set to be a simple receive and file without a presentation. Both times I myself had to act to change course. The first time was understandable. The second time I don't find acceptable. It flies in the face of the legislative intent. And the LIMS files alone cannot give anyone a full understanding of the state of unsheltered homelessness and encampments in our city. An issue that real people are impacted by, both housed and unhoused alike. And an issue especially lately in our city that many of our constituents have been reaching out to to understand what is our plan as local government to address, and an issue that so clearly shows the results of poverty, addiction, government action or inaction, negative action and so on. Additionally, there were many discrepancies within that report that I believe warrant a presentation and questions from council to staff to improve reports into the future. A couple of things that I will highlight is that the HRT visits are up, which I think is a good thing. I think it is us strengthening the capacity that we have as City of Minneapolis to do street outreach, and there's opportunities to connect better with Hennepin County and other jurisdictions to improve on that. Police aren't being used as the main tool to clear encampments, which is a difference from the last report. There needs to be significant work done between the city and county to improve data collection on housing outcomes and a clear idea of when people are seeking resources especially around addiction. There was not a clear delineation between acceptance of shelter but an acceptance of other housing types. There needs to be a correction issued in this report to include data that's required that shares when an encampment was within a one-mile radius of another encampment within a year. The report also indicated that service providers are not consistently notified of the day of an encampment closure and oftentimes not even there at all even as there are individuals present at the day of an encampment clearing, which is deeply concerning. Only six out of the 13 clearings had a notice of closure, oftentimes without advanced notice. And then something that I do find troubling that I think as a city we can address pretty rapidly if we have the will to, is that items are routinely discarded and currently there is no information on what items are discarded and recorded, and storage is not provided on the day of a removal when people are most likely to accept storage services. The last thing that I'll close on is I think there is a kind of an urge to paint the conditions from the first report to the second report as rosy and better. I was really dismayed to see that a press release was given on July 29th before we got a presentation by the administration that had shared that the cost had dropped by 81% and that things were so much better. I think any math teacher would say that you cannot compare five months of data to three months of data as a one-to-one, it's not proportional. And also as a city, comparing the summer season to a winter season given what we know about unsheltered homelessness is a choice I don't think gives the public an accurate representation on what's going on. Lastly, I'll just share from my perspective in tracking unsheltered homelessness this last year, we do have a new policy that's implemented where we aren't whack-a-moleing and breaking apart encampments, rather we're whack-a-moleing and telling people that they can't sleep in a certain area and that's a choice that has been made. I do see a result of that being people hiding in the shadows, being in areas that are less visible. I've heard from service providers and community members that are doing work in unsheltered homelessness that they are seeing a lot of the unsheltered people that they're communicating with in jail rosters—not just within the City of Minneapolis, but in suburbs and seeing an uptick of that. I think it's just really important that we hold ourselves accountable as an organization to be really eyes-wide-open on what's actually happening so we can address unsheltered homelessness in the city of Minneapolis with compassion and with a goal of actually reducing it. I don't think we're quite there yet. And I think our community can point out many places within our city where we're seeing disproportionately Indigenous and Black community members, especially young community members, struggling with the combination of unsheltered homelessness, addiction, and poverty. So, I just wanted to take some time to speak on it because this report is really important to me and I hope that there are improvements made in the next report and I will be doing work with staff and my other colleagues if they want to join me in ensuring that we can have a better report. I want it to be successful and I want it to help us get to the policy outcomes that we're trying to get at. Thank you.

[19:30] **Council Member LaTrisha Vetaw**: Thank you, President Payne. My question is for Council Member Chowdhury. I guess I'm wondering, you had the report but you were saying you had to advocate to have the report, so it did happen in BIZ. So that would be with the chair of BIZ. That's not staff or anybody else. That would be like someone putting it on the agenda which is usually the chair.
[20:10] **Council Member Aurin Chowdhury**: Yeah. So, I did express to the chair and the vice chair that this is something that needs to be a presentation moving forward. I don't know why they decided not to have it be a presentation. Even though I've indicated that in the past, I will say that in agenda setting, all staff was present to chime up and say, "Yeah, this needs to be a presentation or not." I think there's just accountability across the board that needs to be shared. It's not my goal to finger-point or blame one individual, one entity. I just think we need to do better.
[20:31] **Council Member LaTrisha Vetaw**: No, I agree with like, you know, sometimes it's not one person, but I just needed some clarity on exactly. I mean, I just thought like a chair puts things on agenda setting and that's what staff does. If it gets placed in discussion, it's a discussion and not like staff can say we don't want to talk about that. So, it's really at the chair's discretion to have it as a discussion item or not. So, thank you for getting it on the discussion item. I just needed some clarity on that.

[21:05] **Council Member Andrea Jenkins**: Thank you, Chair Payne. I guess I just add a little context as a member of the committee. You know, we have very, very long agendas and our meetings typically go until 4:30. And so I think the chair was just trying to manage the process and not necessarily disregarding the report. It's just my opinion, but the context is we typically have pretty contentious public hearings as well as very long agendas.
[22:04] **Council Member Aurin Chowdhury**: Thank you, President Payne. I will say I meant to say this in my remarks. I think for the future, if there's not time in our BIZ agenda because it is long—I will say the day that we were supposed to have the presentation, we ended early, so there would have been ample time—we should either have it at the Committee of the Whole, which is a request to this body, or we should have it at the Administration and Enterprise Oversight Committee if there's more time. I think it's just worthwhile having a longer conversation and time to prep. We didn't get to a place where we could ask all the questions, especially I can speak for myself, I didn't get to ask all the questions I would have liked to.

Um, I can be in touch with all of you about any changes to the format of those boards that have been suggested by staff and we can take it from there. But I understand that there's some concern over massive changes. I don't see these as massive changes. I mostly see this as a format change. They used to be an ordinance and now they're going to be a resolution just like the rest of our appointed boards and commissions.

I'm really energized by all of these ordinance introductions and referrals coming through and curious to learn more about the goals. And I just was wondering if Council Member Wonsley would give us a brief overview of what the rental license ordinance might include? I ask because there are some landlords in my ward who have been pretty negligent to the point where tenants unions are forming all over Loring Park right now. And there's a couple of owners in particular who I believe don't deserve to have rental licenses from the city given the conditions that they're putting the renters through. So I'm a little curious about what we could do through this ordinance to maybe increase some of the penalties that are being put on landlords who do have a series of inspections showing incomplete maintenance of the building. But if you could just give a brief sense of what you're intending to do with this ordinance, that would be great.
[45:18] **Council Member Robin Wonsley**: Yeah, thank you council member Cashman for the question. So we're still very early in the development of this and just the notice. So more than happy to have further conversations offline, but the key intent—if you think of how we approve liquor licenses and where we can raise concerns about certain business practices or conditionally permit those type of opportunities—essentially it would be having a similar process for rental licenses. Because as you highlighted, we've talked about those repeat offender property owners in the individual or piecemeal sense, but to have a place in a committee where we do view them collectively when they're being asked for permission or approval. We would like to see that process move forward. So, again, very early stages, but I would say equate it to the approval and review process of our liquor licenses.

So at our previous council meeting I remember sharing with the body that I had some amendments that I had been working on with the City Attorney's office. They were in the process of reviewing those. We had the opportunity to discuss that last week and have parsed out these amendments into things that are going to require a lot more work that kind of need to be separated. I know that's something council member Palmisano has brought up as well. So I think that's in line with her request about not continuing to delay this for months at a time while we work through things that are going to take a substantial amount of time. So with the remaining items that our attorneys can work through more quickly—they just need a little bit more time to get those finalized and make sure that those are parsed out so that we can get this ordinance adopted with the easier to work through amendments first, and then can return to the policy itself at a later date if that's the direction that we want to go in. So with that, I'll make a motion to continue this item by one more cycle. Just wanted to provide my colleagues with all the context.

Council member Chughtai can maybe provide more insight into what those small changes are; she has not yet shared them with me. Though through conversation with the City Attorney, I understand they are small, albeit they are deviations from state ordinance. For example, no longer exempting farmers in our version of the ordinance as the state does. Now there are not many farmers in our city with employees, but to the extent that there are, I am reluctantly willing to wait one more cycle. Unfortunately it's a 3-week cycle and I will say yet again I do not want to hold up this initial work. It was about two years worth of staff work for possibly several months. So, I appreciate council member Chughtai's willingness to separate some of the deeper things here and bring that forward when it's ready. But to the extent we can accommodate some of these small changes, I will agree to this one more time. Thank you.
